GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP Insurer: AGA International Tour Gallieni II – 36, avenue du Général de Gaulle 93175 Bagnolet Cedex Insurance General Terms and Conditions The cover provided by this policy, with the exception of assistance cover, is governed by the French Insurance Code. The policy consists of these General Terms and Conditions, plus the Specific Terms and Conditions, which are given to the Insured. This cover applies to all private Trips, for a maximum length of 3 consecutive months, sold by the Approved Organisation or Intermediary with which the policy was taken out. Only the type(s) of cover stated in the option that has been taken out, as indicated on the booking invoice, will be provided. In this particular case, policies are considered to have been taken out in France, but without prejudicing the protection provided to the consumer by the law of the country in which he/she is usually resident. Therefore, in the event of a dispute about the policy, French law shall apply unless legal provisions are more favourable in the country in which the beneficiary's usual residence is situated. By mutual agreement between the Insurer and the Approved Organisation or Intermediary, which is the Policyholder of this insurance policy, claims processing will be carried out in French, and in English when necessary. These General Terms and Conditions should be read carefully. They specify the respective rights and obligations of the Insurer and the Insured and answer any questions the Insured may have. COMMON DEFINITIONS Terms that are shown in italics in the policy are either defined in this section or at the start of the section describing each type of cover. ACCIDENT: any sudden, unforeseen event, external to the victim or the damaged item, constituting the cause of the damage. BODILY ACCIDENT: any unintentional bodily injury caused by the sudden action of an external cause, and diagnosed by a Doctor. SPORTS ACTIVITY: taking part in a sport or leisure activity on an amateur basis, during a course or sports leisure activity package as stated on the contract for the supplied service, and which is covered by this policy. Any official competition, whether it is an amateur or professional competition, is not considered to be a sports activity. SNOW SPORTS OR LEISURE ACTIVITY: All sports activities that, theoretically, can only be practised in winter, usually because these activities need the presence of snow or ice. T&C Page 1/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP THE INSURED: the persons named in the Specific Terms and Conditions, provided that they are Domiciled in Europe. INSURER: AGA International, hereinafter referred to by its trade name of Mondial Assistance, which is the Insurer with which this insurance policy has been taken out. BENEFICIARY: person receiving payments made, not on their own behalf, but because of their relationship with the Insured. ACCIDENTAL BREAKAGE: any accidental damage to, loss or destruction of an item. NATURAL DISASTER: an event caused by the abnormal intensity of a natural agent and within the scope of Law No. 82-600 of 13 July 1982 when it occurs in France. ESTABLISHED PARTNERS: two people who are not married and have not signed a civil partnership agreement but can prove that they live together (partnership certificate or failing this, housing tax, electricity, gas, water, or insurance bill, rent payment receipt, etc.) and that they have been living under the same roof from the date at which this policy was taken out, until the date of the Claim. DEPARTURE: planned start date and time of the Trip. CONSEQUENTIAL LOSS: any monetary loss resulting from deprivation of the enjoyment of a right, interruption of a service provided by a person or by an item, from the loss of a benefit and which is the direct or indirect consequence of a covered Bodily injury or Property damage. DOMICILE/HOME: place of usual residence, which determines the exercise of the Insured's civil rights. BREAK-IN: forcing, damage or destruction of an anti-theft device. FOREIGN/ABROAD: any country except the country in which the Insured is domiciled. EUROPE: the territories of the Member States of the European Union, located geographically in Europe, and the following territories and countries: Guadeloupe, Guyana, Martinique, Mayotte, Réunion, SaintBarthélemy, Liechtenstein, the Principalities of Monaco and Andorra, San Marino, Switzerland, Vatican City. The Azores, Canaries and Madeira are not included within this definition. RANDOM EVENT: any unforeseeable circumstance that is external to the Insured and beyond their control. FRANCE: Metropolitan France (including Corsica), Guadeloupe, Guyana, Martinique, Mayotte, Réunion, Saint-Barthélémy. METROPOLITAN FRANCE: European territory of France (including the islands in the Atlantic Ocean, the English Channel and the Mediterranean) but excluding all the French Overseas areas (departments, regions, communities, territories and countries). EXCESS: the share in the damage payable by the Insured when the Claim is settled. Excess amounts in respect of each type of cover are specified in the Table of Cover. CIVIL WAR: an armed struggle, within the same state, in which different groups that are identifiable by their ethnic, religious, community or ideological origins are in conflict with each other or when at least one of these groups is in conflict with the regular armed forces of that state. T&C Page 2/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP FOREIGN WAR: a declared or undeclared armed engagement between one state and one or more other states or an irregular, external armed force and motivated primarily by a geographical, political, economic, racial, religious or ecological dispute. LIMIT PER EVENT: maximum amount of cover for a single event giving rise to Claims, irrespective of the number of Insured persons under the policy. ILLNESS: any alteration to a person's state of health, as diagnosed by a Doctor. DOCTOR: any person who holds a qualification as a medical doctor that is legally recognised in the country in which he/she usually carries out their professional activity. APPROVED ORGANISATION OR INTERMEDIARY: travel professionals, transport professionals, the distributor of the insured service. TIME LIMITATION: period beyond which any claim is time-barred. INTERVENTION LIMIT: the time period, amount or minimum percentage, which is the threshold for the Insurer's responsibility or the point at which cover takes effect. CLAIM: an event resulting in damage such that one or more of the types of insurance cover are called upon. POLICYHOLDER: the signatory of the Specific Terms and Conditions, who thereby undertakes to pay the insurance premium. SUBROGATION: the process by which the Insurer replaces the Insured in respect of his/her rights against any party liable for his/her damage, in order to obtain repayment of the sums the Insurer has paid to the Insured following a Claim. THIRD PARTY: any natural person or legal entity, except the Insured. AGGRAVATED THEFT: theft of Covered property committed with a Break-in or an Attack, and evidenced by registration of a detailed crime report. TRIP: transportation and/or accommodation during the validity period of this policy and organised, sold or supplied by the Approved Organisation or Intermediary with which this policy has been taken out, except for trips undertaken for the purpose of a work placement or a school or university course. TERRITORY OF THE POLICY Cover for "Travel assistance", Damage to insured belongings", "Breakage of ski equipment", "Trip curtailment", "Sports or leisure activity curtailment", "Private civil liability abroad", "Civil liability for holiday accommodation", "Civil liability for sports", "Delayed arrival" in this policy applies in the country or countries visited during the Trip organised by the Approved Organisation or Intermediary and which are stated in the Specific Terms and Conditions. Cancellation cover applies to any Trip organised by the Approved Organisation or Intermediary. Cover under "SOS forgotten items" applies to anything sent out to the country or countries visited during the Trip organised by the Approved Organisation or Intermediary, as stated in the Specific Terms and Conditions. Cover relating to "Easing your return home" only applies to Metropolitan France. Page 11/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP COVERED DAMAGE COVER AMOUNTS AND LIMITS EXCESSES OR INTERVENTION LIMITS CIVIL LIABILITY FOR SPORTS All Damage combined: Bodily injury, Up to a limit, per claim, of €150,000 property damage and consequential loss - for Property damage and Consequential loss Up to a limit, per claim, of €45,000 - for Bodily injury and consequential loss Up to a limit, per event of €150,000 T&C Per claim: €150 Page 12/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP COMMON EXCLUSIONS TO ALL TYPES OF COVER In addition to the specific exclusions stated for each type of cover, we never insure the consequences of the following circumstances and events: 1. damage of any kind that is intentionally caused or provoked by the Insured or with his/her complicity, or which arises from the Insured's wilful misconduct or fraudulent fault, except in a case of self-defence or assistance to a person in danger; 2. suicide or attempted suicide of the Insured person; 3. damage resulting from the Insured's consumption of alcohol and/or the Insured's absorption of medicines, drugs or narcotics, that have not been medically prescribed; 4. unless stated otherwise in the policy cover, damage resulting from Civil War or Foreign War, acts of terrorism, riots, popular movements, coups d’état, hostage taking, strikes; 5. civil or military application of nuclear reactions, which means altering the structure of the atomic nucleus, transportation and treatment of radioactive waste, use of a radioactive source or body, exposure to ionising radiation, contamination of the environment by radioactive agents, an accident or malfunction occurring at a site carrying out alterations to the structure of the atomic nucleus; 6. events for which liability may fall either on your Trip organiser by application of Title 1 of Law No. 2009-888 of 22 July 2009 on the development and modernisation of tourism services, or on the carrier, unless stated otherwise in the policy; 7. bans decided by local authorities, restriction on the free movement of persons or property, airport closure, border closures. T&C Page 13/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP POLICY COVERAGE CANCELLATION (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS COVER: CANCELLATION: the Insured's firm and definitive withdrawal from all of the insured services as declared to the Approved Organisation or Intermediary. CHECKING OF CHANGED STATUS: a further medical consultation and/or performance of additional medical tests. SERVICE CHARGES: fees charged when booking air travel and billed by the Approved organisation or Intermediary. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER When the Insured cancels their booking, the Approved Organisation or Intermediary of the Trip may hold the Insured responsible for all or part of the cost of the services; this is described as cancellation fees, and these fees increase as the Departure date approaches. These are calculated using the scale contained in the Table of Cover. The Insurer will reimburse the Insured for the cost of the levied cancellation fees, subject to deduction of the Excess amount as stated in the Table of Cover. 2. EVENTS COVERED IN THE EVENT OF CANCELLATION Cancellation, after the insurance has been taken out, must be the result of one of the following events, which absolutely prevents the Departure of the Insured person. ► Medical events: 2.1. An Illness, included a pregnancy-related condition, a Bodily accident, and the results, after-effects, complications or deterioration of an Illness diagnosed or a Bodily accident that took place after the Trip booking was made, and which necessitates: either, hospitalisation from the day of the Cancellation until the Departure date or, - T&C the Insured to cease all professional activity, or to stay at home if they are not working, from the day of the Cancellation until the Departure date, Page 14/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP and - a medical consultation, and treatment with medicines from the day of the Cancellation or the performance of medical tests prescribed by a Doctor, and in all cases, these acts being paid for by one of the health insurance bodies of which the Insured is a member, occurring to: the Insured himself/herself, his/her spouse or Established partner or civil partner under a P.A.C.S. agreement, his/her direct line ascendant or descendant, or those of his/her spouse, Established partner or civil partner under a P.A.C.S. agreement his/her brother, sister, brother-in-law, sister-in-law, son-in-law, daughter-in-law, father-in-law, mother-in-law, legal guardian and any person placed under his/her guardianship, the person, specified when this policy was taken out, who is paid to look after or act as travel companion to the Insured's minor children or a disabled person living under the same roof as the Insured, while the Insured is away on the Trip, another member of the Insured's family provided that their hospital stay lasts for over 48 hours, IMPORTANT: It is the Insured's responsibility to prove that all the conditions for application of cover are met when making the Cancellation. The Insurer can reject the claim, if the Insured is unable to supply the supporting documents stated in Section 6. 2.2. A vaccination contraindication, the effects of vaccination or being medically unable to take preventive treatment required for the Insured's Trip destination, provided that he/she received a favourable medical opinion, prior to the Trip being booked. ► Family events: 2.3. The death of: the Insured himself/herself, his/her spouse, Established partner, or civil partner under a P.A.C.S. agreement, his/her direct line ascendant or descendant, or those of his/her spouse, Established partner, or civil partner under a P.A.C.S. agreement, his/her brother, sister, brother-in-law, sister-in-law, son-in-law, daughter-in-law, father-in-law, mother-in-law, legal guardian and any person placed under his/her guardianship, the person, specified when this policy was taken out, who is paid to look after or act as travel companion to the Insured's minor children or a disabled person living under the same roof as the Insured, while the Insured is away on the Trip, another member of the Insured's family, provided that the deceased person's domicile is not the destination location of the Trip. T&C Page 15/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP ► Professional or study-related events: 2.4. Notification made to the Insured of a resit examination in connection with his/her studies, at a date during the insured Trip, provided that the examination failure was not known at the time when the booking was made. 2.5. Redundancy of the Insured or of his/her spouse, Established partner or civil partner under a P.A.C.S. agreement, provided that the corresponding invitation to the individual appointment was not received before the date on which this policy was taken out and/or the booking for the insured Trip was made. 2.6. Obtaining a salaried position or paid work placement, taking effect before or during the scheduled dates of the Trip when the Insured had been registered as a jobseeker, provided that this is not an assignment provided by a temporary work company. Cover is also valid if the Insured, after taking out this policy, obtains a permanent position, when he/she already held a fixed term employment contract with the same company at the time when they booked the Trip. ► Property events: 2.7. Serious Property damage resulting from: a burglary with a Break-in, a fire, water damage, a climate, meteorological or natural event, subject to any exclusions contained in Article 4.9, that directly affects the following real property: the Insured's main or secondary residence, his/her farming business, his/her business premises if the Insured is a tradesperson, trader, company manager or works in a liberal profession, and which requires him/her to be present at that location on a date during the period of the Trip to carry out administrative actions relating to the damage or repairs to the damaged real property. 2.8. Serious damage to the Insured's vehicle requiring assistance from a professional and occurring within 48 hours prior to his/her Departure, provided that the vehicle is unable to be used for transport to the end destination. 2.9. An Accident or mechanical breakdown of the means of transport used by the Insured for travel to the departure point, which causes a delay of more than two (2) hours compared to the scheduled arrival time, and resulting in the Insured missing the transport booked for his/her Departure, provided that the Insured has made arrangements to arrive at the Departure point at least 30 minutes: T&C before latest check-in time if travelling by air; before the Departure time stated on the person's rail or sea crossing ticket. Page 16/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP ► Other events: 2.10. A riot, a terrorist action or attack that occurs Abroad in the destination town(s) or the town(s) where the Insured is staying. The cover applies in the case of a riot, attack or terrorist action, when all of the following conditions are met: the event has resulted in Damage to property and Bodily injury in the destination town(s) or the town(s) where the Insured is staying, the French Foreign Affairs Minister has advised against travel to the destination town(s) or town(s) where you are staying, the Trip's Approved Organisation or Intermediary is unable to offer the Insured an alternative destination or replacement holiday, the date scheduled for the Departure is less than 30 days after the date on which the event occurred, no similar event occurred in the destination town(s) or the town(s) where you are staying, within the 30 days before the Trip was booked. Compensation is paid after deduction of the specific Excess amount stated in the Table of Cover. This Excess also applies to those persons who are booked on the Trip at the same time as the Insured. 2.11. Another Random event, constituting an immediate, real and serious obstacle preventing Departure and/or participation in activities planned during the Trip. The Random event must have a direct causal relationship with the inability to leave and/or use the insured service. It is the Insured's responsibility to prove that all the conditions for application of cover are met when making the Cancellation. If the documentation provided does not prove the materiality of the stated Random event, the Insurer will be entitled to reject the Insured's claim. Compensation is paid after deduction of the specific Excess amount stated in the Table of Cover. This Excess also applies to those persons who are booked on the Trip at the same time as the Insured. 2.12. Cancellation by insured travel companions remaining alone or with just two people travelling as a result of the covered cancellation by one of the insured persons, provided that all of them are insured under this policy and their names are shown on the same booking form for the insured service. However, all insured persons who form part of the same home for tax purposes or who can prove that they have a direct line relationship are insured under "Optimum Cancellation" cover. T&C Page 17/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 3. AMOUNT COVERED The Insurer will refund the amount of cancellation fees levied by the Trip's Approved Organisation or Intermediary, up to the limits stated in the Table of Cover. The levied cancellation fees are reimbursed up to the limits set per insured person in the Table of Cover, but shall not however exceed the per person and per event limits. The Insurer's compensation amount is always limited to the fee amount that would have been charged to the Insured if the Insured had notified the Approved Organisation or Intermediary on the day on which the event occurred. Service charges will be fully reimbursed, only if they form part of the insured amount, declared when this policy was taken out. The cost of tips, administration, visas, airport taxes and other expenses, outside of Service charges, as well as the premium paid to take out this policy will not be reimbursed. In the event of the occurrence of a covered event, if the Insured decides to change the Trip dates, in preference to cancelling the Trip, the Insurer will refund the modification fees, up to the amount of the cancellation fees that would have been levied on the date of change to the Trip. An Excess amount per insured person (or per trip for rentals and sea crossings), as shown in the Table of Cover, is always deducted from the compensation due to the Insured. 4. COVER EXCLUSIONS In addition to the exclusions that are common to all types of cover, the consequences of the following circumstances and events are also excluded: 4.1. Illnesses already diagnosed or Bodily accidents that had already occurred, or treatment or relapse or deterioration or hospitalisation between the date on which the Trip booking was made and the date on which this policy was taken out; 4.2. Ilnesses which had previously been diagnosed, had a changed status, a further test or change in treatment within the 30 days prior to the booking of the Trip; 4.3. Bodily accidents which had occurred or given rise to a surgical procedure, physiotherapy, a further test or change in treatment within the 30 days prior to the Trip being booked; 4.4. ear drum ailments, gastric and/or intestinal disorders, disorders of the vertebral column unless there has been a Change in Status examination by a Doctor within 15 (fifteen) days after the first medical consultation which was the reason for the Cancellation; 4.5. Illnesses related to pregnancy beyond the 28th week, voluntary termination of pregnancy, in vitro fertilisation; 4.6. medical contra-indications to undertaking a Trip that are not the result of an Illness, including those related to a pregnancy condition or to a Bodily accident, under the conditions set out in Article 2.1; T&C Page 18/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 4.7. forgetting to get vaccinated or failure to take the preventive treatment necessary for the Trip destination; 4.8. lack of or excess snow coverage, except when this occurs at ski resorts located at an altitude of over 1,500 metres, between the 3rd Saturday in December and the 2nd Saturday in April, and results in the closure of over 2/3 of the ski lift facilities normally operating at the resort during the stay, for at least two consecutive days in the 5 days prior to Departure; 4.9. epidemics, local health situations, natural or human pollution, as well as natural, meteorological or climate events that do not result in Serious property damages under the same provisions as those set out in Article 2.7; 4.10. Natural disasters, subject of the procedure covered by Law N° 82-600 of 13 July 1982; 4.11. failure to present or irregularity of identity documents required for access to the reserved transport, and/or of administrative documents required for customs purposes; 4.12. criminal proceedings against the Insured; 4.13. any event that occurs between the date on which the Trip was booked and the date when this policy was taken out; 4.14. any circumstance that only harms the simple pleasure of the Insured's Trip; 4.15. failure of any kind, including financial failure, of the Approved Organisation or Intermediary of the insured Trip or the carrier making it impossible for them to perform their contractual obligations. 4.16. the Insured's refusal to board the flight originally arranged by the Approved Organisation or Intermediary. 5. WHAT THE INSURED MUST DO IN THE EVENT OF A CANCELLATION The Insured must notify the Trip's Approved Organisation or Intermediary about his/her withdrawal as soon as the event that prevents his/her Departure takes place. SUPPORTING DOCUMENTS TO BE PROVIDED The Insurer will notify the Insured of the information that is needed in order for the Claim to be declared and it will be the Insured's responsibility to provide the Insurer with any documents or information that support the reason for the Cancellation and enable the Insurer to assess the compensation amount. If the reason for the Cancellation is medical, the Insured may, if wished, send the medical details in an envelope marked "Confidential" for the attention of the Insurer's medical expert (Médecin conseil). COVERED EVENTS SUPPORTING DOCUMENTS TO BE PROVIDED - IN ALL CASES - In the event of Illness, including a pregnancy related condition or a Bodily accident: T&C - booking confirmation of the insured trips, bill for the cancellation fees for the insured services, when applicable, the official document showing the relationship with the person who was the reason for the Cancellation (copy of the family identity booklet, partnership certificate, etc.), R.I.B. (bank account details), after the file has been reviewed, any other supporting document requested by Mondial Assistance. if relevant, medical prescriptions for drugs, if relevant, test results, if relevant, a copy of the sickness certificate, if relevant, a hospitalisation form, after the file has been reviewed, if requested by the Insurer: statements showing reimbursement by the health insurance body of which the Insured is a member. Public transport: the travel ticket for the public transport, stating the Departure time, a copy of the certificate provided by the transport company stating the date and time of the incident and the length of the delay or stoppage. Page 21/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP In the event of a Random event: - any document which describes the situation which caused the obstacle to travel. DAMAGE TO RESIDENTS' PROPERTY (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS COVER: ATTACK: any bodily injury or threatened bodily injury, arising from the action of a third party. ESSENTIAL ITEMS: items of clothing and toiletries providing the Insured with replacements due to the temporary unavailability of his/her Covered property. COVERED PROPERTY: baggage and its contents, including Personal effects and Valuables, belonging to the Insured, carried for the Trip and/or acquired during the Trip. PERSONAL EFFECTS: articles, clothing, jewellery, accessories, and their contents that the Insured was carrying on their person/wearing at the time of the Claim incident. VALUABLES: any item, except clothing, with an individual purchase value above €250. TRIP/HOLIDAY: period of cover, outside of the actual transportation of the Insured and his/her Covered property. TRANSPORT COMPANY: airline, shipping company, railway company, or other service provider, who is responsible for transporting the Covered property during the Insured's Trip. WEAR AND TEAR: depreciation of an item's value caused by time, use or its current condition on the day of the Claim incident. Unless stated otherwise in the policy, the Wear and Tear applied when calculating compensation is 1% per month, up to a limit of 80% of the original purchase price. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER The Insurer provides cover for damage sustained by the Covered property during the Insured's Trip, up to the limits specified in the Table of Cover. 2. COVERED DAMAGE 2.1. Whilst the Covered property is being handled by a Transport company Loss of, or damage occurring to the Covered property when it is being transported During a Trip, when the Insured entrusts his/her Covered property to a Transport company, the Insurer will cover it against loss or damage sustained while it is being handled in the baggage hold, up to the limit specified in the Table of Cover, and subject to deduction of the Excess amount shown in the same table. IMPORTANT: T&C Page 22/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP As soon as he/she becomes aware of the loss or damage to the baggage, the Insured must declare this to the Transport company and obtain the Baggage Irregularity Report which must then be submitted to the Insurer together with the original purchase receipts for the Covered property in question. Any compensation paid by the Transport company will be deducted from the damage amount. Delay in delivering the Covered property If the Covered property is over 24 hours late in being delivered to the Insured's holiday residence the Insurer will refund the Insured's expenses that he/she incurs to purchase Essential items while awaiting the baggage, up to the amounts specified in the Table of Cover. IMPORTANT: In this case, the Insured must obtain confirmation of the delayed baggage delivery from the Transport company and this document must state the actual delivery date and time. 2.2. Damage that is covered during the Holiday On presentation of receipts for the original purchases, and subject to the limits stated in the Table of Cover, the Insurer will cover accidental damage or Aggravated theft of the Covered property carried or purchased during the Trip, subject to the following specific cases: Theft of Valuables: The Insurer will provide cover, up to the limit amounts stated in the Table of Cover, for theft of Valuables only when the Insured is carrying/wearing them on his/her person, is using them under his/her direct supervision, or has put them into an individual left-luggage locker where a ticket is issued, or has deposited them in a hotel safe. Theft from a vehicle: The Insurer covers theft of the Covered property when it is placed out of sight in the rear boot of a vehicle and only if all the following conditions are complied with: - the Break-in to the Insured's vehicle takes place between 7 am and 10 pm (local time); - the vehicle must be locked completely, with the windows and sunroof fully closed. It is the Insured person's responsibility to provide proof of the vehicle Break-in and proof that the theft was committed during the covered time period. 3. 3.1. COMPENSATION FOR LOSS Amount covered Cover is provided up to the ceiling limit per insured person and per Claim, as stated in the Table of Cover. For each Insured and each Claim, an Excess amount, as stated in the Table of Cover, will be payable by the Insured. T&C Page 23/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP Compensation is paid for the following events, subject to the conditions stated below: Theft of Valuables Compensation that is paid in the event of theft of Valuables shall not exceed 50% of the amount of cover for "Damage to the insured persons' belongings". Delay in delivering the Covered property In the event of the delayed delivery of the Covered property to the Insured's holiday location, cover is provided up to the limit stated in the Table of Cover. If a single event results firstly in delayed delivery, followed by loss and/or damage to the Covered property, the compensation paid in respect of "delayed delivery of the Covered property" will be deducted from the sums due in respect of cover for "Loss or damage during transportation" up to the ceiling limit stated in the Table of Cover. IMPORTANT: For the same Claim, the total of the ceiling limits stated for these events shall not exceed the total amount of cover for "Damage to the insured persons' property" as stated in the Table of Cover. 3.2. Loss assessment Compensation that is due is calculated on the basis of the original purchase receipt provided by the Insured or, failing this, on the basis of the replacement value of items of the same type, subject to a deduction for Wear and Tear and up to the ceiling limits stated in the Table of Cover. Compensation is only paid for jewellery, watches, pearls, precious stones and articles made from precious metal after presentation of the original purchase receipt or a certified valuation from a registered expert. No Wear and Tear will be applied. Compensation is paid for image- and sound-related equipment and accessories after presentation of the original purchase receipt and on the basis of their value at the time of the Claim, estimated using the official listing price in the second-hand market. The compensation due for damage to an item of Covered property, which can be repaired is calculated on the basis of the repair bill. In all cases, the compensation due is estimated by mutual agreement and shall never exceed the amount of damage suffered, nor shall it take into account Consequential losses such as transport costs, telephone expenses, etc. 4. IF THE INSURED FINDS THE STOLEN OR LOST ITEMS If the Insured person's Covered property is found, he/she must inform the Insurer by sending an e-mail to [email protected] as soon as he/she has knowledge of this: T&C Page 24/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP If the Covered property is returned to the Insured, he/she undertakes to make a declaration to the Insurer only for those items that are missing or damaged. If the Insured has already received compensation from the Insurer, he/she must refund the compensation that was paid out, less a deduction of the compensation amount relating to any missing or damaged items. 5. COVER EXCLUSIONS In addition to the exclusions that are common to all cover, except for Article 6, the following are also excluded: The following circumstances: 5.1. theft, damage or loss, as a result of a decision by an administrative body or a prohibition on the transportation of certain items; 5.2. delay, damage or loss occurring when using an airline operated by a company listed on the European Commission's blacklist, regardless of the departure or destination location. 5.3. theft committed by the insured persons or members of the Insured's family (ascendants, descendants, partner) or committed with his/her complicity, by the Insured's staff in the performance of their duties; 5.4. theft committed without a Break-in or by using duplicate keys; 5.5. theft of the Covered property if left in a public place, and not under the Insured's constant supervision; 5.6. theft of the Covered property when in a tent; 5.7. loss, other than loss by a carrier as provided for in Article 2.1, negligence, items that have been lost by the act of the Insured or by the act of a third party; 5.8. damage resulting if an item of property is not used in accordance with the manufacturer's instructions or resulting from the Insured's gross negligence; 5.9. damage to or loss of Valuables of any kind whatsoever, including during their carriage by a Transport company; 5.10. damage resulting from the insured item's own inherent vice, its normal wear and tear; 5.11. damage to fragile articles, especially pottery and glass, porcelain or marble objects; 5.12. damage resulting from smoking Accidents, scratches, grooves, tears or stains, leakage of liquid, grease, colorants, or corrosive materials, that form part of the contents of the insured baggage; 5.13. damage caused during the repair, maintenance or renovation of the Covered property; 5.14. Consequential loss; T&C Page 25/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 5.15. consequential loss arising from a natural event such as an earthquake, volcanic eruption, tidal wave (or tsunami), flood, avalanche, or other cataclysm; The following items: 5.16. documents, identity documents, credit cards, magnetic cards, travel tickets, cash, shares and securities, keys; 5.17. equipment, that because of its type or purpose is used for the Insured's business activity, sales representatives' product sample collections, goods, medical equipment and drugs, perishable foods, wines and spirits, cigarettes, cigars and tobacco; 5.18. cases, boxes, sacks, bags, or covers for this sports or leisure equipment, musical instruments; 5.19. sports or leisure equipment used for snow sports activities; 5.20. objets d’art and crafted objects, antiques, religious objects, collectable items; 5.21. items, of any kind, carried for (or intended for) humanitarian aid; 5.22. spectacles (lenses and frames), contact lenses, prostheses and artificial aids of all kinds, unless they are destroyed or damaged at the time of an accident causing Bodily injury to the Insured person; 5.23. animals; 5.24. all motorised vehicles or devices and their accessories, caravans and trailers; 5.25. pleasure craft with sail or engine, including jet skis; 5.26. computer equipment, mobile phones. 6. WHAT THE INSURED MUST DO IN THE EVENT OF A CLAIM He/she must: In the event of theft: report the crime within 48 hours, to the nearest police authorities to the crime location. In the event of damage: obtain a written report of the damage, from a competent authority or failing this, from a witness. In the event of loss or complete or partial destruction by a Transport company: it is essential to immediately have a Property Irregularity Report (P.I.R.) drawn up by a qualified employee of this company. (bank account details), - after the file has been reviewed, any other supporting document requested by Mondial Assistance. in all cases: - the original Property Irregularity Report (P.I.R.) drawn up by the Transport company's baggage handling service, Page 27/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP - the original check-in ticket for the baggage concerned, and in the event of loss: Transport company: and in the damage: event of and in the event of delayed delivery of the baggage: in the event of theft: In the event of damage caused to the Covered property during the Trip the original purchase receipts for the missing Covered property. - the original invoice for the repair to the damaged Covered item together with a copy of the purchase invoice for that Covered item. or - a certificate issued by a professional stating that the damaged Covered item cannot be repaired, together with the original purchase invoice for this Covered item. - a document confirming the delayed baggage delivery, which states the delivery date and time, - the original purchase receipts for the Essential items. - a detailed crime report drawn up by the nearest police authorities to the crime location - the original purchase receipts for the Covered property. - photos and valuation certificates issued by a registered expert in the case of jewellery, watches, pearls, precious stones and articles made from precious metals. - a detailed crime report drawn up by the nearest police authorities to the crime location - the receipt notification of the declaration of the claim to the vehicle insurer or the description of the vehicle on the day when it was returned to the rental company - the original purchase receipts for the Covered property. - a written statement from a companion or a third party and/or a medical certificate if the damage occurs at the same time as the Insured suffers a Bodily accident, in the event of theft from a vehicle: in the event of complete or partial damage: T&C - Page 28/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP - the invoice for the repair to the damaged Covered item together with a copy of the purchase invoice for that Covered item. or - T&C a certificate issued by a professional stating that the damaged Covered item cannot be repaired, together with the original purchase invoice for this Covered item. Page 29/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP TRAVEL ASSISTANCE (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER SKI AREA: set of sliding runs including marked pistes, established by a municipal bylaw, and the off-piste area EMERGENCY DENTAL EXPENSES: dental treatment that the Mondial Assistance Medical Department considers to be emergency treatment. SEARCH COSTS: cost of operations undertaken by civil or military rescuers or specialist public or private rescue bodies, who set out specifically to search for the Insured in a place which does not have any organised rescue services in the vicinity. RESCUE COSTS: transport costs after an Accident (when the Insured has been found) from the place where the Accident occurred to the nearest medical centre. ACCOMMODATION COSTS: additional hotel costs and cost of telephoning Mondial Assistance, excluding all costs for meals and drinks. FUNERAL COSTS: first conservation costs, handling, placing in coffin, specific arrangements for transportation, conservation made compulsory by legislation, packaging and simplest coffin required for transportation and compliance with local legislation, excluding burial, embalming and ceremony costs. MEDICAL COSTS: medically prescribed pharmaceutical, surgical, consultant's and hospital costs required for the diagnosis and treatment of an Illness. OFF-PISTE SLIDING: practising a sliding snow sport in unmarked areas that are uncontrolled, not prepared by the winter sports resort's safety services. EMERGENCY HOSPITALISATION: a stay of over 48 consecutive hours in a public or private hospital, for an emergency procedure, which is unscheduled and cannot be postponed. IMMOBILISATION: being required to stay at Home or at the holiday residence, after the visit of a Doctor and issuance of a medical certificate ROUTE/LEG: route from or to the destination place that is stated on the travel ticket or the Trip booking form, irrespective of the means or number of types of transport used. ADVICE TO TRAVELLERS: Before the trip: - check that the policy covers the selected destination and the duration of the planned Trip; - obtain information about the required identity documents for entry to the countries you are visiting (identity card, passport, visa,) and the health conditions; obtain and carry the necessary documents (vaccination booklet, medical insurance document); - obtain the documents you need to carry from the Health Insurance Association to certify they are responsible for medical expenses during the Trip: European Health Insurance Card or specific form, depending on the country. - if the Insured is undergoing treatment, they should take with them a sufficient supply of medicines, over and above the amount required for the planned trip period, to allow for the eventuality of their return being delayed; T&C Page 30/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP While travelling: - keep medicines and the prescription in hand luggage so that treatment will not be interrupted should any checked-in baggage be delayed or lost; - keep separate copies of both sides of your identity papers and means of payment. These photocopies will be useful, in the event of loss or theft. IMPORTANT: Minor children: Some types of holiday and certain destinations are not suitable for very young children. Given the risks of disease related to travel time or conditions, the health situation and the climate it is advisable to consult your attending physician or paediatrician when planning the trip. All minor children who are travelling must have valid identity documents. In addition, if the child is travelling without its parents or without a person who has parental authority, the child must be in possession of the administrative authorisation to leave the country, signed by them. In all cases, when a minor child is repatriated, Mondial Assistance cannot be held responsible for any delay caused by the need to correct the administrative situation. Pregnant women: Because of risks that could endanger the health of women at an advanced stage of pregnancy, the various airlines apply different restrictions and these are liable to change without advance notice: medical examination a maximum of 48 hours before departure, presentation of a medical certificate, request for the medical approval of the company, etc. In the event of an emergency and if their contract allows, assistance companies organise and pay the cost of air transport on the express condition that doctors and/or the airlines have no objections. 1. ASSISTANCE SERVICES ASSISTANCE DURING THE TRIP When the Insured calls on the Mondial Assistance Assistance Department, decisions regarding the nature, the appropriateness, and the way in which the measures to be taken are organised are the exclusive responsibility of Mondial Assistance. ► Assistance in the event of Illness, Bodily accident or the death of the Insured: 1.1. Repatriation Assistance If the Insured's state of health requires them to be repatriated, Mondial Assistance will assist as follows: T&C Page 31/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP By organising and paying the cost for the Insured to return Home or for the Insured to be transported to a hospital Mondial Assistance organises and pays the cost for the Insured to return to their Home in Europe or for transport to the hospital which is closest to the Home and/or is the most suitable to provide the care required by the person's state of health. In this case, if the Insured wishes, Mondial Assistance can then organise the return to their Home in Europe as soon as their state of health permits. Organising and paying the cost for a covered travel companion to return home When the Insured is repatriated more than 24 hours before their originally planned return date, Mondial Assistance, after approval by its medical department, will organise and pay the cost for the insured persons who were travelling with the Insured to return Home provided that the original means of returning home can no longer be used or cannot be altered. Organising the return of the Insured's pet Mondial Assistance will organise transportation by a petcare professional (dogs or cats only, all other animals are excluded) to return the pet to the Insured's home, up to the limit stated in the Table of Cover. The animal in question must have already received all the obligatory vaccinations. Dogs, which are mentioned in the decree of 27/04/99 in the list of dog breeds that are considered dangerous, are excluded. IMPORTANT: Decisions are only taken in consideration of the medical interests of the Insured and are the exclusive responsibility of the Mondial Assistance doctors in agreement with the local medical practitioners. Mondial Assistance Doctors contact the local medical teams and, if required, the Insured's usual medical practitioner, in order to gather the information that will enable the most appropriate decisions in respect of the Insured's state of health to be taken. The Insured's repatriation is decided on and managed by medical staff who hold qualifications that are legally recognised in the country in which they usually practice their professional activity. The Insured's medical interests and compliance with health regulations in force are the only matters taken into consideration when determining the transport, the selected means of transport to be used and the choice of the place of hospitalisation. If the Insured refuses to comply with the decisions taken by the Mondial Assistance Medical Department, this discharges Mondial Assistance of all liability in relation to the consequences of such an initiative and especially if the person returns by their own means or in the event of a deterioration of their state of health and the Insured loses all rights to services and compensation from Mondial Assistance. Furthermore, Mondial Assistance will, under no circumstances, replace the local emergency services. T&C Page 32/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 1.2. Assistance to the Insured's minor children Organising and paying the cost for the Insured's minor children to return home If the Insured's state of health requires him/her to be repatriated, once the Medical Department has agreed to this, Mondial Assistance also pays the transport costs to enable the minor children who were travelling with the Insured and no other adult member of the family was present at the holiday location with them to return Home. Organising and paying the round trip transport costs of a person to escort the Insured's minor children on their return journey If the Insured is hospitalised Abroad when accompanied by at least one minor child and no other adult member of the family was present with them, Mondial Assistance will pay for the outward and return Journey of a person of their choosing who lives in Europe. The costs of accommodation, meals and drinks of the person selected to accompany the minor children are payable by the Insured. 1.3. Visit of a close relative/friend if the Insured is hospitalised locally If the Insured is hospitalised locally for more than 3 days, or for more than 48 hours if the person is a minor or is disabled and no adult member of the family was travelling with him/her on the trip, Mondial Assistance pays the costs that enable a member of the family to get to them in hospital: Mondial Assistance pays the cost of an outward and return Journey for a member of your family staying in Europe to enable them to get to the hospital; On presentation of supporting documents, Mondial Assistance will reimburse the cost of that person's accommodation, up to the amount limit stated in the Table of Cover until the Insured is eventually repatriated or leaves hospital if he/she is able to continue the Trip. This service is not cumulative with the "Organisation and payment for return of covered travel companions" cover. 1.4. Emergency hospitalisation expenses Abroad If the Insured is a member of a basic health insurance scheme or an insurance or provident organisation: In the event that the Insured suffers a Bodily accident and/or Illness requiring him/her to be hospitalised Abroad, Mondial Assistance can make a direct payment of the unforeseen emergency hospital expenses after approval by the Mondial Assistance Medical Department and up to the limits stated in the Table of Cover. In this case, the Insured must take all the necessary steps to have these costs reimbursed by its basic health insurance organisation, its mutual insurance scheme or any insurance or provident organisation and in this connection to immediately transfer any sum received to Mondial Assistance. T&C Page 33/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP Otherwise, Mondial Assistance will be entitled to claim expenses and legal interest at the statutory rate in addition. To receive this service, the Insured must belong to a primary health insurance scheme. This service ceases on the day on which the Mondial Assistance Medical Department considers that it is possible for the Insured to be repatriated. If the Insured is not a member of a basic health insurance scheme or an insurance or provident organisation scheme: - In the event that the Insured suffers an Accident and/or Illness requiring him/her to be hospitalised Abroad, Mondial Assistance can make an advance of the unforeseen emergency hospital expenses for the prescribed treatment after approval by the Mondial Assistance Medical Department and up to the limits stated in the Table of Cover. In this case, the Insured undertakes to reimburse the advance to Mondial Assistance within 3 months commencing from the date on which he/she returns from the Trip. After this deadline, Mondial Assistance will be entitled to claim expenses and legal interest at the statutory rate in addition. This advance is subject to a formal recognition of the debt being drawn up. This service ceases on the day on which the Mondial Assistance Medical Department considers that it is possible for the Insured to be repatriated. 1.5. Reimbursement of the emergency Medical expenses that the Insured has paid Abroad To receive this type of refund, the Insured must belong to a primary health insurance scheme which covers his/her medical expenses Abroad for the whole period of this policy. The Insured must be able to provide Mondial Assistance with the original statements or refusal letters from the schemes to which he/she belongs. Up to the amount limits stated in the Table of Cover, less the deduction of the Excess stated in the same table: Reimbursement of the costs the Insured is responsible for (except dental costs) If the Insured incurs medically prescribed medical or hospital expenses Abroad, Mondial Assistance will reimburse him/her for the remaining costs payable by him/her (except dental costs) after payment by the basic health insurance body, the health insurance company or any other insurance or provident organisation. Reimbursement of emergency dental costs which the Insured is responsible for Mondial Assistance will also reimburse the Insured for the cost of emergency dental treatment incurred Abroad, which he/she is responsible for after payment by his/her basic health insurance body, health insurance company or any other insurance or provident organisation. T&C Page 34/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 1.6. Search and/or rescue costs On receipt of the original bill paid by the Insured, Mondial Assistance will reimburse the Insured for the Search and/or Rescue costs corresponding to operations organised when the Insured is lost or has a Bodily accident, up to the ceiling limit stated in the Table of Cover. 1.7. Assistance in the event of the death of the Insured In the event of the death of the Insured, Mondial Assistance organises and pays for: 1.8. transportation of the body from the place where it is placed in the coffin to the funeral home or to the Home of either the deceased person or a family member in Europe, funeral expenses, up to the ceiling limit stated in the Table of Cover, additional transport expenses for the insured members of the deceased person's family or an insured person, travelling with the deceased person, insofar as their originally planned means of returning to Europe can no longer be used on account of this death. Psychological support Mondial Assistance provides the Insured with its telephone support service, up to the limits stated in the Table of Cover, in the event of major trauma resulting from a covered Illness or Bodily Accident. The Insured person must personally make a request for this service from the Mondial Assistance Medical Department. 1.9. Providing a driver to return the Insured's vehicle If, as the result of a covered Illness or Bodily accident, the Insured's state of health means that they are unable to drive their vehicle to return to their Home in Europe and if no other passenger travelling with them is able to replace them, Mondial Assistance provides a driver to return the vehicle, to the Insured's Home in Europe by the fastest route. The Insured's hotel and meal expenses and the cost of fuel, tolls and parking are payable by the Insured. Parking and storage costs for the vehicle while awaiting its return are payable by the Insured The Insured is provided with this cover if the car is in good working order, complies with international and national highway codes and meets mandatory motor vehicle roadworthiness standards. T&C Page 35/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP ► Legal assistance: 1.10. Legal assistance Abroad Reimbursement of lawyer's fees When a legal action is commenced against the Insured as the result of an Accident that occurred in the course of the Trip, Mondial Assistance will reimburse the lawyer's fees, on presentation of receipts and up to the ceiling limit stated in the Table of Cover, provided that: - the lawsuit is not related to the Insured's professional activity, - the lawsuit does not relate to using or keeping a terrestrial motor vehicle, - the actions with which the Insured is charged are not, under the legislation of the country in which he/she is staying, subject to criminal penalties. Advance for bail If the Insured is imprisoned or threatened with imprisonment, provided that the proceedings in which the Insured is involved are not motivated by: - trafficking of drugs or narcotics, - the Insured's participation in political movements, - any wilful infringement of the laws of the country in which the Insured is staying, Mondial Assistance will advance the legally required amount of bail, up to the limit stated in the Table of Cover In this case, the Insured has three months from the date on which the sum was provided to repay this advance to Mondial Assistance. After this time, Mondial Assistance will be entitled to claim expenses and legal interest at the statutory rate in addition. This advance is subject to a formal recognition of the debt being drawn up. ► Assistance for other events disrupting the Insured's Trip: 1.11. Early return assistance Mondial Assistance will organise and pay the costs, if the originally planned means for the Insured's return journey to Europe can no longer be used: T&C either for the Insured to return Home and, accompanied if necessary, by a family member who was travelling with him/her who is also insured under this policy. or for an outward/return Trip for one of the persons insured under this policy and shown on the same policy application form. Page 36/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The Insured can receive this service in the following cases: in the event of Illness or a Bodily accident, resulting in Emergency hospitalisation commencing during the Insured's holiday and which, in the opinion of our Medical Department, is of a life-threatening nature to the life of his/her spouse, Established partner or civil partner under a P.A.C.S. agreement, of a direct line ascendant or descendant, a brother, sister, the legal guardian or a person under his/her guardianship who was not taking part in the Trip; in order to attend the funeral after the death of his/her spouse, Established partner or civil partner under a P.A.C.S. agreement, of a direct line ascendant or descendant or those of his/her spouse, Established partner or civil partner under a P.A.C.S. agreement, a brother, sister, brother-in-law, sister-in-law, son-in-law, daughter-in-law, parent-in-law, the legal guardian or a person under his/her guardianship who was not taking part in the Trip and lived in Europe; in the event of damage to property as a result of a burglary with a Break-in, fire, water damage or natural event, making the Insured's presence at the location essential to implement conservation measures and administrative actions, and affecting: - his/her main or secondary residence, his/her farming business, his/her business premises if the Insured is a tradesperson, trader, company manager or works in a liberal profession. 1.12. Supplying medicines prescribed before Departure If, as the result of lost, stolen or delayed baggage or, if the holiday is extended as agreed with the assistance department, the Insured who is staying Abroad needs medicines: - prescribed before his/her Departure; that are essential to a curative treatment in progress; and cannot be found at the holiday location, Mondial Assistance will assist as follows: either, Mondial Assistance will search for and provide the Insured with equivalent medicines, subject to the agreement of the prescribing attending physician if this is required, or, Mondial Assistance will provide some method of enabling the Insured to continue the treatment he/she needs. Mondial Assistance can't, however, be held liable for delays attributable to the carrier companies used for the despatch of medicines or for the potential unavailability of the medicines. The Insured undertakes to refund the cost of these medicines to Mondial Assistance within three months of receiving them. After this time, Mondial Assistance will be entitled to claim expenses and legal interest at the statutory rate in addition. T&C Page 37/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 1.13. "Unforeseen" assistance Theft of the Insured's identity papers, his/her means of payment, his/her travel tickets If the Insured's identity papers, means of payment and/or travel tickets are stolen, Mondial Assistance can: - advise the Insured on the steps to take; - if the Insured no longer has any means of payment, Mondial Assistance will grant a funds advance for an amount not exceeding the ceiling stated in the Table of Cover, arrange for the Insured to return or continue the Trip; the expenses incurred will be payable by the Insured. In this case, the Insured has three months from the date on which the funds were made available or his/her return date to repay Mondial Assistance for this advance or the expenses incurred by Mondial Assistance on behalf of the Insured. After this time, Mondial Assistance will be entitled to claim expenses and legal interest at the statutory rate in addition. This advance is subject to a formal recognition of the debt being drawn up. Communication with the Insured's family If the Insured is unable to contact his/her family, but is able to contact the Insurer, the Insurer will transmit any urgent messages to them. ASSISTANCE AFTER THE TRIP 1.14. Additional personal assistance During the Trip, if the Insured suffers an Illness or a Bodily accident, requiring him/her to be repatriated and is then Immobilised, Mondial Assistance will provide the Insured with additional services, provided that these are requested within fifteen days after his/her return Home. These services are provided only in Metropolitan France and operate from 8 am to 7 pm on Mondays to Saturdays (except public holidays. Unless otherwise specified, it may take at least half a working day to set up assistance services at Home. The services which are offered to the Insured are as follows: Home nurse If the Insured is Immobilised for a period of over 2 days when they return Home, Mondial Assistance will arrange and pay for a home nurse to sent to assist him/her, up to the cost limit set in the Table of Cover. T&C Page 38/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The home nurse is not a replacement for a health professional such as a qualified nurse or doctor who provides medical care. Delivery of medicines If the Insured has been issued with a prescription requiring essential medicines to be purchased and is unable to go out to obtain them: - when the Insured sends the prescription to us, Mondial Assistance will do what is required to find, purchase and deliver these medicines to the Insured's Home, provided that they are available in a pharmacy, - Mondial Assistance advances the cost of these medicines, which the Insured will refund to Mondial Assistance at the time when the medicines are delivered. Mondial Assistance pays the cost of the delivery service. Delivery of meals If the Insured is unable to leave his/her Home: - Mondial Assistance will organise and pay for the delivery of meals in the form of packs containing 5 or 7 "lunches + dinners" if these are available locally and up to the limit amount stated in the Table of Cover. This service is established within a maximum of four (4) working days. It is not available in Corsica, and is not available on Saturdays. In areas which do not have a service of this type, or if the meal pack is not suitable, Mondial Assistance may offer to supply a domestic help to prepare meals at the Insured's own Home. Delivery of shopping If the Insured is unable to leave his/her Home: - Mondial Assistance organises and pays the cost, insofar as services are locally available, for delivering your shopping for the time period stated in the cover and excess amounts table, on the basis of one delivery per week. The Insured must be available to provide the money and the list of required products. The cost of the shopping is payable by the Insured. Domestic help If the Insured is unable to personally carry out their usual daily household tasks, Mondial Assistance will find, recruit and pay for a domestic help up to the time limit specified in the Table of Cover, with these hours spread over four (4) weeks. Childcare If the Insured has dependent children or grandchildren living at his/her Home and they are under 16: T&C Page 39/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP - either, Mondial Assistance will arrange and pay for the children to be looked after at the Insured's own home between 8 am and 7 pm for a minimum of 2 hours from Monday to Saturday, and up to the time limit specified in the Table of Cover. This service is carried out by a domestic help, a childminder or care worker. The person may, if no close relative or friend is available, take the children to school or the nursery and collect them afterwards; - or Mondial Assistance will provide a close relative or friend of the Insured residing in Europe with a round trip (train or air) ticket to enable them to get to your home to look after the children; - or, Mondial Assistance can provide the Insured's children with a round trip (train or air) ticket to enable them to get to the home of a close friend or relative residing in Europe. They will be accompanied by an attendant appointed by Mondial Assistance. Educational support in the main school subjects If, as the result of a Bodily accident or Illness, the Insured is a minor of school age who is immobilised for more than 14 consecutive days, resulting in absence from school for that period, Mondial Assistance will organise and pay for private lessons with a tutor, providing that one can be found locally and up to the amounts specified in the Table of Cover. This service is valid for children at primary or secondary level (1st and 2nd cycle), from the first day of their Immobilisation and for the actual period of the current school year, during normal school days, except Saturdays. The service will cease when the child recommences normal lessons and, in any case, at the end of the school year. It may take 2 working days before this service can be set up. This service is not applicable if the child has a school phobia. This service may also be arranged if a child is hospitalised resulting in absence from school for more than 14 consecutive days and subject to receiving the express consent of the medical institution and parental authorisation and, if necessary, a liability release letter. Mondial Assistance will then act to supplement the compensation paid by the health insurance company. Care for pets Mondial Assistance will be responsible for: - either, a professional to take care of the Insured's pets (dogs and cats, but excluding all other pets), outside the Insured's Home, provided that the pets have received the required vaccinations. Dogs, which are mentioned in the decree of 27/04/99 in the list of dog breeds that are considered dangerous, are excluded. Expenses for care of pets and their food are paid up to the limit stated in the Table of Cover; T&C Page 40/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP - or, transportation of the animal by a petcare professional to a close relative friend selected by the Insured, who lives in Metropolitan France within a maximum distance of 100 km from the Insured's Home. Only one of these services may be used. 2. COVER EXCLUSIONS In addition to the exclusions that are common to all cover, the following are also excluded: For all assistance cover: 2.1. expenses incurred without the prior approval of the Mondial Assistance Assistance Department; 2.2. the consequences of events that occur in countries excluded by this policy; 2.3. the consequences of any air transport incident that is booked by the Insured, if it is operated by a company included in the blacklist established by the European Commission, regardless of the departure or destination location. 2.4. the consequences of Illnesses or injuries that were pre-existing, had been diagnosed and/or treated, as well as surgical "comfort" operations resulting in a hospital stay, day patient or outpatient treatment, in the 6 months prior to the assistance request; 2.5. the consequences of an unconsolidated ailment being treated and from which the Insured is still convalescing, as well as any ailments occurring during a trip taken for the purpose of diagnosis and/or treatment; 2.6. the eventual results (check-up, additional treatment, recurrence) from an ailment which previously gave rise to a repatriation; 2.7. organising and paying for the transport referred to in Article 1.1 "Repatriation assistance" for ailments or minor injuries which can be treated on the spot and do not prevent the Insured from continuing the Trip; 2.8. voluntary termination of pregnancy, childbirth, in vitro fertilisation and their consequences, in addition to a pregnancy which has resulted in hospitalisation within the 6 months prior to the assistance request; 2.9. the consequences: of infectious risk situations in an epidemic scenario, of exposure to infectious biological agents, chemical agents of a combat gas type, incapacitating agents, or to neurotoxic agents or agents with residual neurotoxic effects, which require a quarantine period or specific preventive or monitoring measures by the local and/or national health authorities of the country in which the Insured is staying; T&C Page 41/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 2.10. the Insured's participation in any sport practised as a professional or under a paid contract, in addition to preparatory training; 2.11. the Insured's failure to comply with official prohibitions and his/her non-compliance with official security rules, related to the practice of a sports activity; 2.12. the consequences of an Accident that occurs when the Insured is taking part in an air sport or one of the following sports: skeleton, bobsleigh, skijump, mountain climbing above 3,000 m, rock climbing, scuba diving, pot-holing, bungee jumping, parachute jumping; 2.13. expenses not expressly mentioned as giving rise to a refund, in addition to any expenses for which the Insured is unable to produce a receipt. In addition, under cover for "Emergency hospital costs Abroad" and "Reimbursement of emergency Medical expenses paid by the Insured when Abroad", the following are excluded: 2.14. the cost of thermal spa treatment, heliotherapy, slimming treatments, all kinds of "comfort" or beauty treatments, physiotherapist's cost, the cost of treatment or care not resulting from a medical emergency; 2.15. the cost of implants, internal, optical, dental, hearing, functional or other prostheses and the cost of fitting them; 2.16. vaccination expenses; 2.17. the cost of treatment or care, the therapeutic nature of which is not recognised by French legislation. 3. WHAT THE INSURED MUST DO IN THE EVENT OF A CLAIM 3.1. To request assistance The Insured or a third party must contact Mondial Assistance: For bookings made with Pierre et Vacances: by calling 01 42 99 08 65 or 33 1 42 99 08 65, if the Insured is outside France 24 / 7 For bookings made with Maeva: by calling 01 42 99 08 08 70 or 33 1 42 99 08 70, if the Insured is outside France 24 / 7 A case number will be assigned immediately and the person must provide the following information to the customer assistance agent: T&C Page 42/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP the policy number, an address and telephone number where he/she can be contacted and the contact details of the people who are assisting him/her, permission for the Mondial Assistance Doctors to access all the medical information about the Insured or the person who needs assistance from Mondial Assistance. 3.2. For a refund claim In order to receive a refund of expenses advanced by the Insured with the approval of Mondial Assistance, the Insured must provide Mondial Assistance with all the supporting documents that will enable us to determine the validity of the claim. either by post to the following address: Mondial Assistance Service Relations Clientèle (Customer Services) Tour Gallieni II 36 avenue du Général de Gaulle 93175 Bagnolet cedex or by calling Monday to Friday, between 9 am and 5.30 pm: 01 42 99 08 83 or 33 1 42 99 08 83, if the Insured is outside France Services which have not been requested in advance and which have not been organised by Mondial Assistance do not provide entitlement to a refund or a compensation payment. 4. LIMITS TO THE INTERVENTION OF MONDIAL ASSISTANCE Mondial Assistance acts in compliance with national and international laws and regulations. The company's services are subject to obtaining the necessary approval from the competent authorities. Moreover, Mondial Assistance cannot be held liable for delays or hindrance to the performance of the agreed services as a result of a case of force majeure or events such as strikes, riots, popular movements, restrictions on free circulation of persons or property, sabotage, terrorism, civil or foreign wars, the consequential effects of a radioactive source or Natural disasters or any other exceptional circumstances. IMPORTANT NOTE: Mondial Assistance organises and pays for the Insured's covered transport up to the limit of travel by train in 1st class and/or economy class air travel or specialist medical vehicle. In all cases, Mondial Assistance becomes the owner of the Insured's unused travel tickets. The latter undertakes to return them to Mondial Assistance or refund to Mondial Assistance the reimbursement obtained from the Trip's Approved Organisation or Intermediary. 5. T&C SUPPORTING DOCUMENTS TO BE PROVIDED Page 43/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP Depending on the assistance services provided, Mondial Assistance will inform the Insured of the documents that need to be supplied in support of the assistance request: SUPPORTING DOCUMENTS TO BE PROVIDED INSURED SERVICES Travel Assistance Reimbursement of medical expenses Reimbursement of Search costs/Rescue costs Reimbursement of Search costs/Rescue costs T&C - the original used travel tickets (boarding cards for air travel) and unused tickets - if relevant, the death certificate - if relevant, a copy of an official administrative document proving the relationship with the beneficiary, - any other supporting document requested by Mondial Assistance. - R.I.B. (bank account details), - a copy of the Trip booking form, - copies of the medical expenses bill(s) paid by the Insured - a copy of the refund statement issued by Social Security - the original of the refund statement issued by the mutual insurance fund - after the file has been reviewed, any other supporting document requested by Mondial Assistance. - R.I.B. (bank account details), - A copy of the Trip booking form, - the original paid bill for the Search costs/Rescue costs. - any other supporting document requested by Mondial Assistance. Page 44/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP DELAYED ARRIVAL (MULTI-RISK AND COMPREHENSIVE PASS) 1. PURPOSE OF THE COVER The Insurer covers delayed arrival, up to the limit stated in the Table of Cover. Late arrival is caused by an unforeseeable, insurmountable event outside of the Insured's control occurring within the 24 hours preceding the initially planned time of the Insured’s arrival at the holiday location. Delayed arrival at the accommodation location is understood to be when the Insured arrives at the location over 24 hours after the planned start date of the insured rental accommodation, as stated on the booking form for the Insured's Trip. Cover only applies if the stay is for a period of over 5 days. An unforeseeable, unsurmountable event outside the control of the Insured is understood to be any event such as: - death - illness - accident - bodily accident - family events - theft of documents - business and study-related events - material events - and any other unforeseen event. 2. AMOUNT COVERED The Insurer will pay the Insured the compensation amount as specified in the Table of Cover. Under no circumstances can the covered amount be more than the cost of cancelling the Trip. This cover is provided on condition that the Insured has allowed sufficient time from their departure, and depending on the means of transport they are using, to reach the holiday location. Sufficient time is understood to be: T&C If the Journey is by road, the length of the route between the Home and the holiday location, plus a minimum of 20 minutes, If the Journey is by train, the length of the route between the Home and the Journey departure station, plus a minimum of 20 minutes (in the event of a connection, sufficient time is the amount of time stated by the railway networks), If the Journey is by air, the length of the route between the Home and arrival at the airport, plus a minimum of 20 minutes (check-in and boarding time are not taken into consideration). Page 45/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 3. COVER EXCLUSIONS Exclusions common to all types of cover shall apply. Furthermore, consequences resulting from the following types of event are excluded and will not give rise to the intervention of the Insurer, nor will compensation be paid under any circumstances whatsoever: - events which the Insured had knowledge of at the time when this policy was taken out; - events which the Insured had knowledge of between the time when the Trip was booked, and up to the departure date. 4. SUPPORTING DOCUMENTS TO BE PROVIDED The Insurer will notify the Insured of the information that is needed in order for the Claim to be declared and it will be the Insured's responsibility to provide the Insurer with any documents or information that support the reason for the delayed arrival and for assessment of the compensation amount. If the reason for the delayed arrival is medical, the Insured may, if wished, send the medical details in an envelope marked "Confidential" for the attention of the MONDIAL ASSISTANCE medical expert (Médecin conseil). Also, the following supporting documents must be provided: COVERED EVENTS SUPPORTING DOCUMENTS TO BE PROVIDED - booking confirmation of the insured services, - when applicable, the official document showing the relationship with the person who was the reason for the delayed arrival (copy of the family identity booklet, partnership certificate, etc.), - R.I.B. (bank account details), - after the file has been reviewed, any other supporting document requested by Mondial Assistance. IN ALL CASES T&C Page 47/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP TRIP CURTAILMENT (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITION SPECIFIC TO THIS TYPE OF COVER TRIP CURTAILMENT: early termination of the Trip as a result of a covered event. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER The Insurer undertakes to pay compensation, up to the limits stated in the Table of Cover, if the Insured's holiday is curtailed as a result of one of the following events: medical repatriation of the Insured, organised by Mondial Assistance or another assistance company, early return of the Insured as a result of an event covered under Article 1.12 of the "Travel assistance" cover and organised by Mondial Assistance or another assistance company, hospitalisation of the Insured when Abroad, provided that this was approved by Mondial Assistance or another assistance company. 2. AMOUNT COVERED Compensation is calculated from the day after the occurrence of one of the events listed in Article 1. "Purpose of the Cover" (medical repatriation, early return, hospitalisation locally). Compensation is proportional to the number of days of your Trip/stay that are unused and the number of insured persons who have actually vacated the accommodation for the period concerned. Deductions will be made from the calculation basis for administration expenses, service charges, visas, tips, the insurance premium and refunds or compensation paid by the Trip's Approved Organisation or Intermediary. Compensation will be paid, per insured person, up to the ceiling limits stated in the Table of Cover, but this may not, however exceed the Limit per event. The basis on which the compensation is calculated varies depending on the type of service that is covered: When staying in a hotel or rented accommodation: Compensation is calculated on the basis of the cost of the insured rental accommodation, up to the limit amounts per person and per event stated in the Table of cover, on the assumption that the rental accommodation will be fully vacated. T&C Page 48/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The Insurer will also pay the end-of-stay cleaning costs, whether these were originally included or not, up to the limit per accommodation unit and per event as shown in the Table of Cover, on the assumption that the rental accommodation will be fully vacated. For flight only arrangements Compensation corresponds to the cost of the unused travel ticket, up to the limit shown in the Table of cover. If the Insured's original travel ticket is used for his/her repatriation, the Insured will be compensated up to the limit stated for flight only arrangements. The compensation amount paid for flight only arrangements is not paid in addition to compensation paid for other types of service. IMPORTANT NOTE: If the trip was curtailed by the Insured being hospitalised locally: - The insured travel companions who continued to occupy the holiday accommodation will be compensated from the day after the actual date of repatriation. - Insured travel companions who are obliged to leave the holiday accommodation and who receive the benefit of payment of their additional Accommodation costs under "Travel assistance" cover will receive compensation under the same conditions as the Insured. 3. COVER EXCLUSIONS In addition to the exclusions that are common to all types of cover, the consequences of the following circumstances and events are also excluded: 3.1. any event that is not specified in Article 1 "Purpose of the cover" is excluded; 3.2. epidemics, local health situations, natural or human pollution, natural, meteorological or climate events; 3.3. Natural disasters occurring Abroad, definitely caused by the abnormal intensity of a natural agent and those Natural disasters referred to in Law N° 82-600 of 13 July 1982. 4. WHAT THE INSURED MUST DO IN THE EVENT OF A CLAIM 4.1. (bank account details), - the original return travel tickets both used and unused, - the claim file reference under which the Insured received approval from Mondial Assistance to curtail the trip, or T&C - the intervention statement from another assistance company, indicating the reason for their intervention, - after the file has been reviewed, any other supporting document requested by Mondial Assistance. PURPOSE OF THE COVER The Insurer undertakes to pay compensation, proportional to the number of unused days in the Sports or leisure activity package, up to the limits stated in the Table of Cover, if the Insured has to stop carrying out the Sports or leisure activity insured under this policy, as a result of one of the following events: medical repatriation of the Insured, organised by Mondial Assistance or another assistance company, Illness or Bodily accident of the Insured that prevents him/her from taking part in the insured Sports or leisure activity. one of the following exceptional climate events: storm, hurricane, cyclone preventing the Insured from carrying out the activity planned during the stay provided that the curtailment of the activity exceeds 3 consecutive days. 2. COMPENSATION AMOUNT AND PAYMENT METHOD Compensation will be paid as a proportion of the number of unused days in the Sports or leisure activity package. It is due from the day after total stoppage of the activities that are covered. It is calculated on the basis of the total price per person of the Sports or leisure activity package and up to the ceiling limit stated in the Table of Cover. Deductions will be made from the compensation amount for administration expenses, tips, the insurance premium and refunds or compensation paid by the Approved organisation or intermediary from which the Insured purchased the Sports or leisure activity package. 3. COVER EXCLUSIONS In addition to the exclusions that are common to all types of cover, the consequences of the following circumstances and events are also excluded: 3.1. 3.2. Page 53/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP PRIVATE CIVIL LIABILITY ABROAD (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER BODILY INJURY: any injury to a person's physical or mental integrity that is suffered accidentally and all the monetary damage arising from it. CIVIL LIABILITY: obligation to repair the consequences of damage caused to a Third Party by one's act or the act of persons for whom one is responsible or the act of things which one has custody of. THIRD PARTY: any natural person or legal entity, except: - the Insured himself/herself, - members of his/her family, which are the ascendants, descendants, collateral relatives of the Insured up to the second degree, - any person accompanying the Insured on this Trip. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER The Insurer will provide cover for the financial consequences of the civil liability that the Insured could incur in the form of Damages during the Trip, by application of the legislation or case law of the country in which he/she is staying: bodily injury, property damage, non-pecuniary damage directly consequential to the covered Bodily injury or Property damage, resulting from an Accident that occurred in the Insured's private life and caused to a Third party by: his/her act, the act of persons for whom he/she is responsible, the act of things or animals in the Insured's care. 2. SUBSIDIARITY OF THE COVER Cover is provided to the Insured for his/her Trips outside his/her country of domicile and only in those countries in which he/she does not have the benefit of Civil liability insurance taken up with another company. COVER AMOUNTS Cover is provided up to the ceiling limits stated in the cover and excess amounts table, on the assumption that: The Per event limit stated in the Table of Cover constitutes the maximum amount of coverage for a single event, i.e. a combined limit for all Damages: bodily injury, property damage and directly consequential loss, in all cases, an Excess per Claim, for the amount stated in the Table of Cover will be payable by the Insured. 4. COVER EXCLUSIONS In addition to the exclusions that are common to all cover, the consequences of the following are also excluded: 4.1. harm caused to members of the Insured's family, meaning his/her ascendants, descendants, collateral relatives up to the second degree, and any person accompanying the Insured on the Trip; 4.2. damage caused to pets or objects belonging to the Insured or which have been rented, loaned or entrusted to him/her; 4.3. damage caused by: any terrestrial motor vehicle that meets the definition contained in Article L 211-1 of the French Insurance Code, any terrestrial vehicle that has been designed for the purposes of attachment to a terrestrial motor vehicle, any air, sea or river navigation device; 4.4. damage resulting from hunting, or any mechanical sport that uses any kind of motor-driven terrestrial vehicle, all air sports, all sliding sports, and any of the following sports: mountain climbing above 3,000 m, scuba diving, pot-holing, parachute jumping; 4.5. damage caused to Third parties which results from the organisation, preparation or participation in a competition organised under the aegis of a sports federation, subject to official approval or is under a legal insurance obligation; 4.6. damage caused in the performance of the Insured's professional activity or when he/she is participating in an activity organised by a non-profit association, an institution or community; 4.7. the Insured's contractual liability; 4.8. the liability the Insured could incur due to a fire, explosion, implosion or water damage. T&C Page 55/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP In addition, fines and all monetary penalties, pronounced as penalties, which do not constitute the direct repair of a Bodily injury or Property damage and/or directly Consequential loss are never covered. 5. TIME-RELATED APPLICATION The time period for operation of the cover is stated in Law No. 2003-706 of 1 August 2003. Cover that is triggered by the harmful event covers the Insured for the monetary consequences that he/she is liable for, when the harmful event occurs between the original effective date of the cover and its cancellation or expiry, irrespective of the date of the other elements constituting the Claim incident. 6. WHAT THE INSURED MUST DO IN THE EVENT OF A CLAIM The Insured must not make any acknowledgement of liability, nor have any dealings without the agreement of the Insurer. Admission of a material fact or acting simply from a duty of assistance does not constitute admission of liability. In the event of court proceedings against the Insured, he/she grants the Insurer all powers to manage the case and exercise any method of recourse in relation to the civil jurisdictions or to associate with the Insured's defence and exercise any method of recourse for civil interests in relation to the criminal jurisdictions. On receipt, the Insured must send the Insurer any notification, summons, served document and proceedings-related document that is sent to him/her or which has been served on him/her. T&C Page 56/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP In the event of a delay in sending these documents, the Insurer can claim compensation from the Insured that is proportionate to the harm suffered by the Insurer (Article L 113-11 of the French Insurance Code). If the Insured fails in his/her obligations subsequent to the Claim incident, the Insurer will compensate the Third parties whose rights have been infringed or their entitled Beneficiaries, but the Insurer may bring proceedings against the Insured to recover the sums paid out. 7. MEASURES IN THE EVENT OF INCOME BEING GRANTED TO A VICTIM BY A COURT RULING If an order is made for the purchase of securities as a guarantee for payment of income, the Insurer will establish this security guarantee up to the amount of its responsibility. If no order has been made in respect of security, the capital value of the income is calculated using the rules that apply to the calculation of the actuarial reserves for this income. If this value is below the amount of the Insurer's cover, the Insurer is responsible for the total income. If it is higher, only the income that corresponds to the amount of the Insurer's cover, is the responsibility of the Insurer. 8. SUPPORTING DOCUMENTS TO BE PROVIDED The Insurer will provide the Insured with the information that will be needed for the claim file to be set up. It is the Insured's responsibility to provide the Insurer with all the documents and information in support of the claim and which will enable the Insurer to assess the loss, in particular: DAMAGE CAUSED TO THE VICTIM IN ALL CASES PROPERTY DAMAGE and/or CONSEQUENTI AL LOSS BODILY INJURY and/or CONSEQUENTI AL LOSS T&C SUPPORTING DOCUMENTS TO BE PROVIDED - Trip booking form, the refusal letter sent by the Insured's main insurer for Civil liability (multi-risk home insurance company). - the repair bill for the damaged item and the payment receipt, accompanied by a copy of the original purchase bill on which the damaged item is specified or - a certificate issued by a professional stating that the damaged item cannot be repaired, accompanied by a copy of the original purchase bill on which the damaged item is specified - any other element relating to the claim submitted by the victim, any other supporting document requested by Mondial Assistance. - full contact details of the victim, any supporting medical documents provided by the victim, any other element relating to the claim submitted by the victim, any other supporting document requested by Mondial Assistance. Page 57/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP CIVIL LIABILITY FOR HOLIDAY ACCOMMODATION (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER BODILY INJURY: any injury to a person's physical or mental integrity that is suffered accidentally and all the monetary damage arising from it. CIVIL LIABILITY: obligation to repair the consequences of damage caused to a Third Party by one's act or the act of persons for whom one is responsible or the act of things which one has custody of. HOLIDAY ACCOMMODATION: an apartment, individual house, chalet or stationary mobile home or campsite pitch, occupied temporarily by the Insured and/or his/her travel companions during the Trip. THIRD PARTY: any natural person or legal entity, except: - the Insured himself/herself, - members of his/her family, which are the ascendants, descendants, collateral relatives of the Insured up to the second degree, - any person occupying the Holiday Accommodation in their capacity as an Insured. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER The Insurer will cover the financial consequences of the Insured's Civil liability that he/she could incur in his/her capacity as an occupier of the insured Holiday accommodation, in the form of Damages: bodily injury, property damage, non-pecuniary damage directly consequential to the covered Bodily injury or Property damage, caused to a Third party and resulting: from a fire, an explosion or implosion, from water damage, originating in the buildings that are occupied temporarily. 2. SUBSIDIARITY OF THE COVER Cover is provided to the Insured only in those countries in which he/she does not have the benefit of Civil liability insurance taken up with another company. TIME-RELATED APPLICATION The time period for operation of the cover is stated in Law No. 2003-706 of 1 August 2003. In the event of court proceedings against the Insured, he/she grants the Insurer all powers to manage the case and exercise any method of recourse in relation to the civil jurisdictions or to associate with the Insured's defence and exercise any method of recourse for civil interests in relation to the criminal jurisdictions. On receipt, the Insured must send us any notification, summons, served document and proceedings-related document that is sent to him/her or which has been served on him/her. In the event of a delay in sending these documents, the Insurer can claim compensation from the Insured that is proportionate to the harm suffered by the Insurer (Article L 113-11 of the French Insurance Code). If the Insured fails in his/her obligations subsequent to the Claim incident, the Insurer will compensate the Third parties whose rights have been infringed or their entitled Beneficiaries, but the Insurer may bring proceedings against the Insured to recover the sums paid out. MEASURES IN THE EVENT OF INCOME BEING GRANTED TO A VICTIM BY A COURT RULING If an order is made for the purchase of securities as a guarantee for payment of income, the Insurer will establish this security guarantee up to the amount of its responsibility. If no order has been made in respect of security, the capital value of the income is calculated using the rules that apply to the calculation of the actuarial reserves for this income. If this value is below the amount of the cover, the Insurer is responsible for the total income. If it is higher, only the income that corresponds to the amount of the Insurer's cover, is the responsibility of the Insurer. 8. SUPPORTING DOCUMENTS TO BE PROVIDED The Insurer will provide the Insured with the information that will be needed for the claim file to be set up. It is the Insured's responsibility to provide the Insurer with all the documents and information in support of the claim and which will enable the Insurer to assess the loss, in particular: DAMAGE CAUSED TO A VICTIM IN ALL CASES PROPERTY DAMAGE and/or CONSEQUENTI AL LOSS BODILY INJURY and/or CONSEQUENTI AL LOSS T&C SUPPORTING DOCUMENTS TO BE PROVIDED - the Holiday accommodation rental contract or booking form, the refusal letter sent by the Insured's main insurer for Civil liability (multi-risk home insurance company). - the repair bill for the damaged item and the payment receipt, accompanied by a copy of the original purchase bill on which the damaged item is specified or - a certificate issued by a professional stating that the damaged item cannot be repaired, accompanied by a copy of the original purchase bill on which the damaged item is specified - any other element relating to the claim submitted by the victim, any other supporting document requested by Mondial Assistance. - full contact details of the victim, the supporting medical documents provided by the victim, any other element relating to the claim submitted by the victim, any other supporting document requested by Mondial Assistance. Page 61/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP CIVIL LIABILITY FOR SPORTS (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER BODILY INJURY: any injury to a person's physical or mental integrity that is suffered accidentally and all the monetary damage arising from it. CIVIL LIABILITY: obligation to repair the consequences of damage caused to a Third Party by one's act or the act of persons for whom one is responsible or the act of things which one has custody of. THIRD PARTY: any natural person or legal entity, except: - the Insured himself/herself, - members of his/her family, which are the ascendants, descendants, collateral relatives of the Insured up to the second degree, - persons who are mentioned along with the Insured on the same contract for the insured service. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER The Insurer covers the financial consequences of the Civil liability that the Insured may incur when engaged in a Sports or leisure activity, in the form of Damages: bodily injury, property damage, non-pecuniary damage directly consequential to the covered Bodily injury or Property damage, resulting from an Accident that occurred during the Sports or leisure activities and caused to a Third party by: his/her act, the act of things or animals in the Insured's care. 2. SUBSIDIARITY OF THE COVER Cover is provided to the Insured when they are participating in their Sports or leisure activity, provided that this activity is not covered by another insurance policy. 3. COVER AMOUNTS Cover is provided up to the ceiling limits stated in the cover and excess amounts table, on the assumption that: T&C Page 62/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The Per event limit stated in the Table of Cover constitutes the maximum amount of coverage for a single event, i.e. a combined limit for all Damages: bodily injury, property damage and directly consequential loss, in all cases, an Excess per Claim, for the amount stated in the Table of Cover will be payable by the Insured. 4. COVER EXCLUSIONS In addition to the exclusions that are common to all cover, the consequences of the following are also excluded: 4.1. harm caused to members of the Insured's family, meaning his/her ascendants, descendants, collateral relatives up to the second degree, and any person mentioned on the same booking form as the Insured person; 4.2. damage caused to pets or objects belonging to the Insured or which have been rented, loaned or entrusted to him/her; 4.3. damage caused by: any terrestrial motor vehicle that meets the definition contained in Article L 211-1 of the French Insurance Code, any terrestrial vehicle that has been designed for the purposes of attachment to a terrestrial motor vehicle, any air, sea or river navigation device; 4.4. damage resulting from hunting, or any mechanical sport that uses any kind of motor-driven terrestrial vehicle, all air sports; 4.5. damage resulting from taking part in a snow sport or leisure activity; 4.6. damage caused to Third parties which results from the organisation, preparation or participation in any competition organised under the aegis of a sports federation, subject to official approval or which is under a legal insurance obligation; 4.7. damage caused in the performance of the Insured's professional activity or when he/she is participating in an activity organised by a non-profit association, an institution or community; 4.8. the Insured's contractual liability; 4.9. the liability the Insured could incur due to a fire, explosion, implosion or water damage. In addition, fines and all monetary penalties, pronounced as penalties, which do not constitute the direct repair of a Bodily injury or Property damage and/or directly Consequential loss are never covered. 5. T&C TIME-RELATED APPLICATION Page 63/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The time period for operation of the cover is stated in Law No. 2003-706 of 1 August 2003. Cover that is triggered by the harmful event covers the Insured for the monetary consequences of his/her Civil liability when the harmful event occurs between the original effective date of the cover and its cancellation or expiry, irrespective of the date of the other elements constituting the Claim. 6. Page 65/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP SOS FORGOTTEN ITEM (MULTI-RISK AND COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER FORGOTTEN ITEMS: items or clothes belonging to the Insured that have been left behind at the Insured's Home. 1. PURPOSE OF THE COVER The Insurer will reimburse the cost for the despatch of a Forgotten Item, up to the limit stated in the Table of Cover. 2. WHAT IS COVERED If the Insured has left a personal item at Home, the Insurer will reimburse the Insured for the despatch costs (excluding insurance) by express delivery, (i.e. receipt within 24 hours) to permit the Insured to recover their Forgotten item. The Insurer shall not be held liable: - for delays attributable to the carrier companies used for the despatch of the Forgotten item; - for breakage, loss damage or theft of the Forgotten item while being transported; - for consequences resulting from the nature of the Forgotten item; - if national or international customs services prevent despatch of the item. 3. AMOUNT COVERED Cover is provided on presentation of the original invoice for the despatch of the Forgotten item and up to the ceiling limits stated in the Table of Cover. 4. COVER EXCLUSIONS In addition to the exclusions that are common to all types of cover, the following are also excluded from cover: 4.1. 4.2. 4.3. SUPPORTING DOCUMENTS TO BE PROVIDED The Insurer will inform the Insured of the supporting documents to be supplied for reimbursement of the despatch costs up to the amount limits stated in the Table of Cover. COVERED EVENTS if a personal item is forgotten: T&C SUPPORTING DOCUMENTS TO BE PROVIDED - the original invoice for the despatch costs issued by the carrier that was requested to deliver the Forgotten item Page 68/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP EASING YOUR RETURN HOME (MULTI-RISK AND COMPREHENSIVE PASS) 1. PURPOSE OF THE COVER In order to facilitate and prepare for the Insured to return Home comfortably, the Insurer will put the Insured in contact with suppliers who can provide the following services: - delivery of shopping, - housework, - ironing, - gardening. 2. WHAT IS COVERED In order to assist the Insured to organise his/her return Home, the Insurer will put the Insured in contact with the Insurer's network of service providers, subject to local availability of the domestic help services mentioned in the paragraph on the purpose of this cover. This cover may be established during the Insured's Trip until he/she returns Home. This cover is only provided in Metropolitan France. In all cases, the costs incurred are payable by the Insured. 3. AMOUNT COVERED The services organised under this cover shall be payable by the Insured. 4. WHAT THE INSURED MUST DO The Insured must contact Mondial Assistance: by calling 01 40 25 15 49 Monday to Friday between 8 am and 8 pm and Saturday between 9 am and 6 pm The Insured will be contacted by the Personal Services Provider within a maximum period of 48 hours (working days) after his/her request. T&C Page 69/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 5. LIMITS TO THE INSURER'S INTERVENTION The Insurer acts in compliance with national and international laws and regulations. This cover is subject to the company obtaining the necessary approval from the competent authorities. Moreover, the Insurer cannot be held liable for delays or hindrance to the performance of the agreed services as a result of a case of force majeure or events such as strikes, riots, popular movements, restrictions on free circulation of persons or property, sabotage, terrorism, civil or foreign wars, the consequential effects of a radioactive source or Natural disasters or any other exceptional circumstances. Likewise, the Insurer shall not be held liable for the poor performance of the service providers who have been requested to operate the services under this cover nor for the failure of those service providers to act. T&C Page 70/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP CANCELLATION (SNOW PASS & COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS COVER: CANCELLATION: the Insured's firm and definitive withdrawal from all of the insured services as declared to the Approved Organisation or Intermediary. CHECKING OF CHANGED STATUS: a further medical consultation and/or performance of additional medical tests. SERVICE CHARGES: fees charged when booking air travel and billed by the Approved organisation or Intermediary. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER When the Insured cancels their booking, the Approved Organisation or Intermediary of the Trip may hold the Insured responsible for all or part of the cost of the services; this is described as cancellation fees, and these fees increase as the Departure date approaches. These are calculated using the scale contained in the Table of Cover. The Insurer will reimburse the Insured for the cost of the levied cancellation fees, subject to deduction of the Excess amount as stated in the Table of Cover. 2. EVENTS COVERED IN THE EVENT OF CANCELLATION Cancellation, after the insurance has been taken out, must be the result of the following event, which absolutely prevents the Departure of the Insured person. 2.1. Lack of snow or excess snow When this occurs at ski resorts located at an altitude of over 1,500 metres, between the 3rd Saturday in December and the 2nd Saturday in April, and results in the closure of over 2/3 of the ski lift facilities normally operating at the resort during the stay, for at least two consecutive days in the five days prior to your departure. Compensation is made after deduction of the specific excess amount stated in the cover and excess amounts table. This excess also applies to those persons who are booked on the trip at the same time as yourself. 3. AMOUNT COVERED The Insurer will refund the amount of cancellation fees levied by the Trip's Approved Organisation or Intermediary, up to the limits stated in the Table of Cover, but without exceeding the per person and per event limits. T&C Page 71/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The Insurer's compensation amount is always limited to the fee amount that would have been charged to the Insured if the Insured had notified the Approved Organisation or Intermediary on the day on which the event occurred. Service charges will be fully reimbursed, only if they form part of the insured amount, declared when this policy was taken out. The cost of tips, administration, visas, airport taxes and other expenses, outside of Service charges, as well as the premium paid to take out this policy will not be reimbursed. In the event of the occurrence of a covered event, if the Insured decides to change the Trip dates, in preference to cancelling the Trip, the Insurer will refund the modification fees, up to the amount of the cancellation fees that would have been levied on the date of change to the Trip. An Excess amount per insured person (or per trip for rentals and sea crossings), as shown in the Table of Cover, is always deducted from the compensation due to the Insured. 4. COVER EXCLUSIONS In addition to the exclusions that are common to all types of cover, the consequences of the following circumstances and events are also excluded: 4.1. epidemics, local health situations, natural or human pollution, as well as natural, meteorological or climate events that do not result in Serious property damage; 4.2. Natural disasters, subject of the procedure covered by Law N° 82-600 of 13 July 1982; 4.3. any event that occurs between the date on which the Trip was booked and the date when this policy was taken out; 4.4. any circumstance that only harms the simple pleasure of the Insured's Trip; 4.5. failure of any kind, including financial failure, of the Approved Organisation or Intermediary of the insured Trip or the carrier making it impossible for them to perform their contractual obligations. 4.6. the Insured's refusal to board the flight originally arranged by the Approved Organisation or Intermediary. 5. WHAT THE INSURED MUST DO IN THE EVENT OF A CANCELLATION The Insured must notify the Trip's Approved Organisation or Intermediary about his/her withdrawal as soon as the event that causes the trip cancellation takes place. SUPPORTING DOCUMENTS TO BE PROVIDED The Insurer will notify the Insured of the information that is needed in order for the Claim to be declared and it will be the Insured's responsibility to provide the Insurer with any documents or information that support the reason for the Cancellation and enable the Insurer to assess the compensation amount. COVERED EVENTS SUPPORTING DOCUMENTS TO BE PROVIDED - IN ALL CASES - T&C booking confirmation of the insured services, bill for the cancellation fees for the insured services, R.I.B. (bank account details), the snow conditions report issued by the approved organisation, which corresponds to the period of the trip and mentions closure of two thirds of the pistes at the resort. after the file has been reviewed, any other supporting document requested by Mondial Assistance. Page 73/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP BREAKAGE OF SKI EQUIPMENT (SNOW PASS & COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER ACCIDENTAL BREAKAGE: any damage to, loss or accidental destruction of an item, and also any harm suffered by a pet. WEAR AND TEAR: depreciation of an item's value caused by time, use or its current condition on the day of the Claim incident. Unless stated otherwise in the policy, the Depreciation applied when calculating compensation is 1% per month, up to a limit of 80% of the original purchase price. 1. PURPOSE OF THE COVER The Insurer will cover accidental breakage of property (equipment and specific clothing) exclusively used for participating in a sport and which belong to the Insured or which have been hired. Cover is provided for the reasons and limits stated in the Table of Cover and Excess Amounts. 2. AMOUNT COVERED Compensation that is due is calculated on the basis of the original purchase receipt provided by the Insured or, failing this, on the basis of the replacement value of items of the same type, subject to a deduction for Depreciation and up to the ceiling limits stated in the Table of Cover. In all cases, the compensation due is estimated by mutual agreement and shall never exceed the amount of damage suffered, nor shall it take into account Consequential losses such as transport costs, telephone expenses, etc. 3. COVER EXCLUSIONS In addition to the exclusions that are common to all cover, the following are also excluded: 3.1. damage resulting from earthquake, volcanic eruption, tidal wave or other cataclysm, flooding, unless these events are declared by an interministerial decree to be natural disasters; 3.2. the consequences resulting from use that does not comply with the manufacturer's instructions; 3.3. damage caused to the insured equipment, whilst it is being repaired, maintained or renovated; 3.4. damage resulting from the inherent vice of the insured equipment or its normal wear and tear; 3.5. damage resulting from your blatant negligence; 3.6. damage resulting from scratches, grooves, tears or stains; 3.7. thefts committed by the insured persons or by the members of your family, (ascendants, descendants, spouse) or committed with their complicity; 3.8. damage resulting from losing or forgetting the equipment; 3.9. damage due to smoking-related accidents; 3.10. terrestrial motor vehicles and their accessories, caravans and trailers; 3.11. cases, boxes, sacks, bags, or covers for sports or leisure equipment; 3.12. mobile telephones; T&C Page 74/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 3.13. spectacles (lenses and frames), contact lenses, prostheses and aids of all kinds; 3.14. computer equipment. 4. WHAT YOU MUST DO WHEN MAKING A CLAIM You must: In the event of complete or partial destruction: obtain a written report of the damage, produced by a competent authority or the responsible person; or failing this, by a witness. In the event of complete or partial destruction by a transport company: it is essential to have a report drawn up by a qualified employee of this company. In all cases, you must: take all steps so as to limit the consequences of the incident; advise the Insurer of the claim, by registered letter, within five working days of your knowledge of the event, except in the case of exceptional circumstances or force majeure. T&C Page 76/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP PERSONAL ASSISTANCE SEARCH AND RESCUE COSTS (SNOW PASS & COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER SKI AREA: set of sliding runs including marked pistes, established by a municipal bylaw, and the off-piste area. SEARCH COSTS: cost of operations undertaken by civil or military rescuers or specialist public or private rescue bodies, who set out specifically to search for the Insured in a place which does not have any organised rescue services in the vicinity. RESCUE COSTS: transport costs after an Accident (when the Insured has been found) from the place where the Accident occurred to the nearest medical centre. OFF-PISTE SLIDING: practising a sliding snow sport in unmarked areas that are uncontrolled, not prepared by the winter sports resort's safety services. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE ASSISTANCE SERVICES 1.1. On-piste Search and/or Rescue costs In connection with carrying out a sports or leisure activity, Mondial Assistance will reimburse the Insured for the Search and/or Rescue costs corresponding to operations organised when the Insured is lost or has a Bodily accident, up to the ceiling limit stated in the Table of cover. 1.2. Off-piste Search and/or Rescue costs When the Insured is practising an Off-piste sliding sport, Mondial Assistance will reimburse the Search and/or Rescue costs incurred, on receipt of the original paid invoice, and up to the limit stated in the Table of Cover. This service is only provided if the Insured is accompanied by a mountain guide or a ski instructor and they remain in the Skiing area. 2. COVER EXCLUSIONS In addition to the exclusions that are common to all cover, the following are also excluded: 2.1. T&C For all assistance cover: the consequences of events that occur in countries excluded by this policy; Page 77/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 2.2. the consequences of Illnesses or injuries that were pre-existing, had been diagnosed and/or treated, as well as surgical "comfort" operations resulting in a hospital stay, day patient or outpatient treatment, in the 6 months prior to the assistance request; 2.3. the consequences of an unconsolidated ailment being treated and from which the Insured is still convalescing, as well as any ailments occurring during a trip taken for the purpose of diagnosis and/or treatment; 2.4. the eventual results (check-up, additional treatment, recurrence) from an ailment which previously gave rise to a repatriation; 2.5. organising and paying for the transport for ailments or minor injuries which can be treated on the spot and do not prevent the Insured from continuing the Trip; 2.6. the consequences: of infectious risk situations in an epidemic scenario, of exposure to infectious biological agents, chemical agents of a combat gas type, incapacitating agents, or to neurotoxic agents or agents with residual neurotoxic effects, which require a quarantine period or specific preventive or monitoring measures by the local and/or national health authorities of the country in which the Insured is staying; 3. 2.7. the Insured's participation in any sport practised as a professional or under a paid contract, in addition to preparatory training; 2.8. the Insured's failure to comply with official prohibitions and his/her non-compliance with official security rules, related to the practice of a sports activity; 2.9. the consequences of an Accident that occurs when the Insured is taking part in an air sport or one of the following sports: skeleton, bobsleigh, skijump, mountain climbing above 3,000 m, rock climbing, bungee jumping, parachute jumping; 2.10. expenses not expressly mentioned as giving rise to a refund, in addition to any expenses for which the Insured is unable to produce a receipt. WHAT THE INSURED MUST DO IN THE EVENT OF A CLAIM In order to receive a refund of expenses advanced by the Insured with the approval of Mondial Assistance, the Insured must provide Mondial Assistance with all the supporting documents that will enable us to determine the validity of the claim. LIMITS TO THE INTERVENTION OF MONDIAL ASSISTANCE Mondial Assistance acts in compliance with national and international laws and regulations. The company's services are subject to obtaining the necessary approval from the competent authorities. Moreover, Mondial Assistance cannot be held liable for delays or hindrance to the performance of the agreed services as a result of a case of force majeure or events such as strikes, riots, popular movements, restrictions on free circulation of persons or property, sabotage, terrorism, civil or foreign wars, the consequential effects of a radioactive source or Natural disasters or any other exceptional circumstances. 5. SUPPORTING DOCUMENTS TO BE PROVIDED Depending on the assistance services provided, Mondial Assistance will inform the Insured of the documents that need to be supplied in support of the assistance request: SUPPORTING DOCUMENTS TO BE PROVIDED INSURED SERVICES Reimbursement of Search costs/Rescue costs - R.I.B. T&C Page 79/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP CURTAILMENT OF A SPORTS ACTIVITY (SNOW PASS & COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER EXCEPTIONAL CLIMATE EVENTS: a climate and meteorological event consisting of an unexpected variation in the following atmospheric conditions: temperature, sunshine, precipitation, humidity, wind speed; characterised by a drought, flooding, heatwave, storm, thunderstorm, cold or hot spell, heavy rainfall, snowfall, fall of hail of such intensity that the event destroys and damages several well-constructed buildings or the access roads to the destination town of the insured service. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER The Insurer undertakes to pay compensation, proportional to the number of unused days in the Sports activity package, up to the limits stated in the Table of Cover, if the Insured has to stop carrying out the Sports activity insured under this policy, as a result of one of the following events: Medical repatriation of the Insured, organised by Mondial Assistance or another assistance company, Illness or Bodily accident of the Insured that prevents him/her from taking part in the insured Sports activity. Lack of or excess snow coverage when this occurs at ski resorts located at an altitude of over 1,500 metres, between the 3rd Saturday in December and the 2nd Saturday in April, and results in the closure of over 2/3 of the ski lift facilities normally operating at the resort during the stay, for at least 2 consecutive days during your insured trip. An exceptional climate event that results in the closure of more than 2/3 of the ski lifts normally operating at the Trip resort between the 3rd Saturday in December and the 2nd Saturday in April in ski resorts located at over 1,500 metres altitude. Loss or theft of the ski lift pass during the insured trip. 2. COMPENSATION AMOUNT AND PAYMENT METHOD Compensation will be paid as a proportion of the number of unused complete days in the Sports activity package. It is due from the time after total stoppage of the activities that are covered. It is calculated on the basis of the total price per person of the Sports activity pass and up to the ceiling limit stated in the Table of cover. T&C Page 80/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The basis on which the compensation is calculated varies depending on the type of service that is covered: For ski lift passes: The Insurer will refund the cost of the ski lift pass, according to the limits set in the Table of Cover and on a prorata basis. For skiing lessons: The Insurer will refund the cost of insured ski lessons that have not been used from the same day as one of the events specified in Article 1 "Purpose of the cover" and the refund will be provided up to the amount limits stated in the Table of Cover. Administration charges, tips and the insurance premium will be deducted from the compensation. For hire of ski equipment: The Insurer will refund the cost of ski equipment hire, according to the limits set in the Table of Cover and on a prorata basis. 3. COVER EXCLUSIONS In addition to the exclusions that are common to all types of cover, the consequences of the following circumstances and events are also excluded: 3.1. any event that is not specified in Article 1 "Purpose of the cover" is excluded. 4. T&C SUPPORTING DOCUMENTS TO BE PROVIDED Page 81/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The Insurer will provide the Insured with the information needed to submit the Claim and the Insured will be required to supply the Insurer with any documents and information in proof of the claim that will allow the amount of loss to be determined, in particular: COVERED EVENTS IN ALL CASES LACK OF SNOW OR EXCESS SNOW: LOSS OR THEFT OF SKI LIFT PASS T&C SUPPORTING DOCUMENTS TO BE PROVIDED - the invoice for the Sports activity package, - R.I.B. (bank account details), - the claim file reference under which the Insured received approval from Mondial Assistance to curtail the trip, - after the file has been reviewed, any other supporting document requested by Mondial Assistance. - confirmation by the resort pistes operator stating that snow cannons are in operation at the resort, - the snow conditions report issued by the approved organisation, which corresponds to the period of the trip and mentions closure of two thirds of the pistes at the resort. - solemn declaration of the loss of the pass, - or a detailed crime report drawn up by the nearest police authorities to the crime location Page 82/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP CIVIL LIABILITY FOR SPORTS (SNOW PASS & COMPREHENSIVE PASS) DEFINITIONS SPECIFIC TO THIS TYPE OF COVER BODILY INJURY: any injury to a person's physical or mental integrity that is suffered accidentally and all the monetary damage arising from it. CIVIL LIABILITY: obligation to repair the consequences of damage caused to a Third Party by one's act or the act of persons for whom one is responsible or the act of things which one has custody of. THIRD PARTY: any natural person or legal entity, except: - the Insured himself/herself, - members of his/her family, which are the ascendants, descendants, collateral relatives of the Insured up to the second degree, - persons who are mentioned along with the Insured on the same contract for the insured service. Definitions of terms that are common to all types of cover are contained in the Common Definitions section, at the start of the policy. 1. PURPOSE OF THE COVER The Insurer covers the financial consequences of the Civil liability that the Insured may incur when engaged in a Sports activity, in the form of Damages: bodily injury, property damage, non-pecuniary damage directly consequential to the covered Bodily injury or Property damage, resulting from an Accident that occurred during the Sports activity and caused to a Third party by: his/her act, the act of things or animals in the Insured's care. 2. SUBSIDIARITY OF THE COVER Cover is provided to the Insured when they are participating in their Sports activity, provided that this activity is not covered by another insurance policy. 3. COVER AMOUNTS Cover is provided up to the ceiling limits stated in the cover and excess amounts table, on the assumption that: T&C Page 83/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The Per event limit stated in the Table of Cover constitutes the maximum amount of coverage for a single event, i.e. a combined limit for all Damages: bodily injury, property damage and directly consequential loss, in all cases, an Excess per Claim, for the amount stated in the Table of Cover will be payable by the Insured. 4. COVER EXCLUSIONS In addition to the exclusions that are common to all cover, the consequences of the following are also excluded: 4.1. harm caused to members of the Insured's family, meaning his/her ascendants, descendants, collateral relatives up to the second degree, and any person mentioned on the same booking form as the Insured person; 4.2. damage caused to pets or objects belonging to the Insured or which have been rented, loaned or entrusted to him/her; 4.3. damage caused by: any terrestrial motor vehicle that meets the definition contained in Article L 211-1 of the French Insurance Code, any terrestrial vehicle that has been designed for the purposes of attachment to a terrestrial motor vehicle, any air, sea or river navigation device; 4.4. damage resulting from hunting, or any mechanical sport that uses any kind of motor-driven terrestrial vehicle, all air sports; 4.5. damage caused to Third parties which results from the organisation, preparation or participation in any competition organised under the aegis of a sports federation, subject to official approval or which is under a legal insurance obligation; 4.6. damage caused in the performance of the Insured's professional activity or when he/she is participating in an activity organised by a non-profit association, an institution or community; 4.7. the Insured's contractual liability; 4.8. the liability the Insured could incur due to a fire, explosion, implosion or water damage. In addition, fines and all monetary penalties, pronounced as penalties, which do not constitute the direct repair of a Bodily injury or Property damage and/or directly Consequential loss are never covered. T&C Page 84/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP 5. TIME-RELATED APPLICATION The time period for operation of the cover is stated in Law No. 2003-706 of 1 August 2003. Cover that is triggered by the harmful event covers the Insured for the monetary consequences of his/her Civil liability when the harmful event occurs between the original effective date of the cover and its cancellation or expiry, irrespective of the date of the other elements constituting the Claim. 6. WHAT THE INSURED MUST DO IN THE EVENT OF A CLAIM The Insured must not make any acknowledgement of liability, nor have any dealings without the agreement of the Insurer. Admission of a material fact or acting simply from a duty of assistance does not constitute admission of liability. In the event of court proceedings against the Insured, he/she grants the Insurer all powers to manage the case and exercise any method of recourse in relation to the civil jurisdictions or to associate with the Insured's defence and exercise any method of recourse for civil interests in relation to the criminal jurisdictions. On receipt, the Insured must send the Insurer any notification, summons, served document and proceedings-related document that is sent to him/her or which has been served on him/her. In the event of a delay in sending these documents, the Insurer can claim compensation from the Insured that is proportionate to the harm suffered by us (Article L 113-11 of the French Insurance Code). T&C Page 85/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP If the Insured fails in his/her obligations subsequent to the Claim incident, the Insurer will compensate the Third parties whose rights have been infringed or their entitled Beneficiaries, but the Insurer may bring proceedings against the Insured to recover the sums paid out. 7. MEASURES IN THE EVENT OF INCOME BEING GRANTED TO A VICTIM BY A COURT RULING If an order is made for the purchase of securities as a guarantee for payment of income, the Insurer will establish this security guarantee up to the amount of its responsibility. If no order has been made in respect of security, the capital value of the income is calculated using the rules that apply to the calculation of the actuarial reserves for this income. If this value is below the amount of the cover, the Insurer is responsible for the total income. If it is higher, only the income that corresponds to the amount of the Insurer's cover, is the responsibility of the Insurer. 8. SUPPORTING DOCUMENTS TO BE PROVIDED The Insurer will provide the Insured with the information that will be needed for the claim file to be set up. It is the Insured's responsibility to provide the Insurer with all the documents and information in support of the claim and which will enable the Insurer to assess the loss, in particular: DAMAGE CAUSED TO THE VICTIM IN ALL CASES PROPERTY DAMAGE and/or CONSEQUENTI AL LOSS BODILY INJURY and/or CONSEQUENTI AL LOSS T&C SUPPORTING DOCUMENTS TO BE PROVIDED - the booking form for the Sports or leisure activity, the refusal letter sent by the Insured's main insurer for Civil liability (multi-risk home insurance company or any other insurer). - the repair bill for the damaged item and the payment receipt, accompanied by a copy of the original purchase bill on which the damaged item is specified or - a certificate issued by a professional stating that the damaged item cannot be repaired, accompanied by a copy of the original purchase bill on which the damaged item is specified - any other element relating to the claim submitted by the victim, any other supporting document requested by Mondial Assistance. - full contact details of the victim, the supporting medical documents provided by the victim, any other element relating to the claim submitted by the victim, any other supporting document requested by Mondial Assistance. Page 86/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP ADMINISTRATIVE PROVISIONS 1. REGULATIONS GOVERNING THE POLICY AND THE LOCATION AT WHICH IT IS TAKEN OUT This policy is governed by the French Insurance Code, the General Terms and Conditions and the Specific Terms and Conditions. The General Terms and Conditions have been drawn up in French. In respect of transactions which are carried out on the Internet, the virtual space constituted by the Policyholder's own website pages is considered to be located in French territory and policies taken out via this site are therefore located in France, without prejudice to the protection provided to the consumer by the Law of the country in which he/she is usually resident. In the event of a dispute about the policy that was taken out, French law shall apply unless legal provisions are more favourable in the country in which the insured's usual residence is situated. 2. PROCEDURES FOR TAKING OUT COVER, WHEN IT TAKES EFFECT AND ITS TERMINATION The policy must be taken out on the same day as the booking and/or, at the latest, before the commencement of the cancellation charges scale. Cover takes effect: for "Cancellation" cover: at 00:00 on the day after payment of the premium. It ceases as soon as the insured services commence; for all other cover: at 00:00 on the Departure date as stated in the Specific Terms and Conditions and, at the earliest, after the premium has been paid. Cover terminates at midnight on the day of your return that is stated in the Specific Terms and Conditions. "Cancellation" cover is not combined with the other types of cover. 3. RIGHT TO CHANGE YOUR MIND In accordance with Order No. 2005-648 of 6 June 2005 on distance marketing of financial services, the right to change your mind does not apply to travel insurance or baggage insurance policies (Article L 112-2-1 of the French Insurance Code). 4. CUMULATIVE INSURANCE If the Insured is covered for the same risks with other insurance companies, he/she must inform the Insurer and provide the Insurer with their details and the scope of their cover, in accordance with Article L 121-4 of the French Insurance Code. T&C Page 87/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP The Insured can obtain compensation for his/her damage by contacting the insurance company of their choice. 5. SUBROGATION IN THE INSURED'S RIGHTS AND ACTIONS In consideration for the payment of compensation and, up to its limit amount, the Insurer becomes the beneficiary of the rights and actions that the Insured owned against anyone liable for the Claim, in accordance with Article L 121-12 of the French Insurance Code. If the Insurer is no longer able to perform this action by the Insured's act, the Insurer can be discharged of all or part of its obligations towards the Insured. 6. PENALTIES APPLICABLE IF YOU MAKE A FALSE DECLARATION WHEN TAKING OUT THE POLICY Any non-disclosure, or intentional false statement by the Insured when declaring the risk, will be penalised by the policy becoming void, under the conditions contained in Article L.113-8 of the French Insurance Code. Any omission or inaccurate declaration by the Insured whose bad faith has not been established, will be penalised under the conditions contained in Article L.113-9 of the French Insurance Code: 7. - if this is observed before any Claim: the Insurer is entitled to maintain the policy by increasing the premium, or may cancel the policy within ten days by registered letter and refunding the extra premium amount. - if this is only observed after a Claim: the Insurer may reduce the compensation, proportionate to the premium paid in relation to the premium which would have been due if the risk had been fully and accurately declared. PENALTIES APPLICABLE IF THE INSURED MAKES AN INTENTIONALLY FALSE STATEMENT AT THE TIME OF THE CLAIM Any fraud, non-disclosure or intentional false statement by the Insured about the circumstances or consequences of a Claim will result in the loss of all entitlement to services or compensation for this Claim. 8. TIME LIMITATION Any legal action arising from an insurance policy is subject to a time limitation period of 2 years from the event which gives rise to it, under the conditions established by Article L 114-1 of the French Insurance Code. With regard to "Private civil liability Abroad" and "Holiday Accommodation liability" and "Civil liability for Sports" cover, the period only starts to run from the day on which a Third Party informs the Insured of his/her intention to obtain compensation from the Insured, subject to his/her action not having a stated time limitation under Article 2226 of the French Civil Code. T&C Page 88/91 GENERAL TERMS AND CONDITIONS PIERRE ET VACANCES GROUP In accordance with Article L 114-2 of the French Insurance Code, the time limitation period is suspended by: a registered letter with acknowledgement of receipt sent by the Insurer to the Insured relating to legal action for payment of the premium or sent by the Insured to the Insurer relating to payment of compensation, appointment of an expert in response to a Claim, the standard causes for suspension of the Time Limitation period. 9. LOSS ASSESSMENT The causes and consequences of the Claim are assessed by mutual agreement and failing this, by jointly agreed loss assessment, subject to the respective rights of the Insurer and the Insured. The expert's fees are shared between the parties. If the parties are unable to agree on the selection of the third party expert, the expert may be appointed by the presiding judge of the Tribunal de Grande Instance of the place of Domicile of the Policyholder. This appointment shall be made on a written request signed by the Insurer or by just one party, the other party having being summoned by registered letter. CLAIM SETTLEMENT TIME PERIOD As soon as the Insured's case is complete, compensation will be paid within 10 days following the agreement between the Insurer and the Insured or an enforceable court ruling. 12. COMPLAINTS HANDLING PROCEDURES If an insured person is not satisfied with the handling of his/her claim, they must first of all inform their usual contact to allow them to understand the nature of the problem and seek solutions to it. A response will be sent to the insured within two (2) months after the date of receipt of the complaint, unless there are specific circumstances, which the insurer will inform the insured of.
