N “For depriving us in many cases, of the benefits of Trial by Jury” (DOI) Due process – under the English Bill of Rights British citizens had the right to due process (certain steps that must happen when someone is accused of a crime). T Sam Davis is planning a public meeting in front of the town library to protest against a new city tax for playgrounds. He has filed all of his permits and the city has said that he can have his meeting. The night before the meeting, however, the mayor finds out that Sam was arrested 2 years ago in another town for starting a riot. On the day of the meeting, police show up to prevent the meeting and Sam is not allowed to hold his meeting. H At a gun show, George Samuels picked out 13 guns that he wanted to add to his expensive collection of guns from the 1800s. When he tried to pay for the guns he was told by a security guard that he wasn't allowed to take so many. The security guard would only allow George to buy 5 guns. A Martha Cortez opens her door to find four soldiers from the United States Army with all of their gear. They tell her that they have been assigned to stay with her as the local military base can no longer afford to feed and house them. They inform her that they would like to have a big dinner as they have training tomorrow. D The Gideon family is just sitting down to dinner when a SWAT team breaks down their door and tears apart their home looking for illegal weapons that a neighbor has accused the Gideons of having. Mrs. Gideon, a lawyer, demands to see the search warrant and the SWAT officers reluctantly admit that they don’t have one. T Hans Schlemming was a German immigrant to the US. On Saturday night he was coming out of a store and the police arrested him for stealing. He said he didn't do anything, but the police were convinced that they had the right person. When he told them that he wanted a lawyer, one of the policemen said, "You don't need a lawyer, you guilty pig. You and your German friends killed my great grandfather during the war. I know that you're guilty. We're locking you up and throwing away the key." H “For transporting us beyond Seas to be tried for pretended offences” (DOI) O Citizens have the right to bring lawsuits against others when they have been harmed and have a jury decide the outcome of these civil trials M S John just bought a new car and has it parked in his driveway. His next door neighbor has built a catapult and is throwing rocks with it. One of the rocks sails over the fence and breaks the windshield of John’s new car. The next one dents the hood. The last one shatters a side window. John sues his neighbor in court to recover the cost of repairing his car and he asks for a jury trial because he knows people will sympathize with him. L W Amendment I Amendment II Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. I Amendment III No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law. M M Amendment IV The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. E Amendment VII In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any Court of the United States, than according to the rules of the common law. O Amendment VIII Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. N Amendment IX Amendment X The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
