4. (1) An inspectorappointedundersection52 of the Act may ar any
reasonable
time enterany premiseswhere the inspectorhas reasonto
believethat
(u) an incandescent
filarnentlamp is being manufactured,
stored,offeredfor saleor beingdistnbuted,or
(b) an importedused arr-conditioneris stored,being offered
l'or saleor distributed,
(2) An inspectorshallseizean incandescent
filamentlamp manufacn:red,stored,offeredfor saleor which is berngdismbutedur the counrry,
(3) An rnspector
or a customsoffrcershallseize
(a) an rncandescent
filamentlamp, or
(b) a usedair-conditioner
rrnportedinto the countryand shallnot releaseit to the importer.

(a) An incandescent
seized
filamentlamp or a usedair-conditioner
undersub-regulations
(2) and (3), shallbe destroyedwithin four weeks
after seizureand rhe offendershall be surchargedwith the expensesincurredin the destruction.
(5) An inspector
a personto contravene
or customsofficerwho assists
theseRegulationscommitsan offenceand is liableon summaryconviction to a fine of not more than rwo hundredand fifty penaltyunits or
imprisonmentfor a term of not more than Melve months or both.
Exemption
5. (1) Subjectto subregulation(2), theseRegulationsdo not apply to
the followingrypesof incandescent
filamentlamps:
(a) motor vehiclelighrs;
(b) flood lights;
(c) halogenlights:
(d) spothghtsor searchlights;
(e) atrportrunway lights;
O streerlights;and
(g) spectalpurposelights,includingtheatreor stagelights.
(2) A personwho intendsto manufacrure,import, store,offer for
sale,distributeor disposeof an item lisredin sub-regulation
(l) shall
obtainprior written approvalfrom the EnergyCommission.
Offences
6. (1) A personwho
(a) contravenes
regulations1,2 or 3, or
(b) obstructsor interfereswith an inspectorrn the performance
of the inspector'sfirnctions,
commitsan offenceand is liableon summaryconvictionto a fine of not
more than fwo hundredand fifty penalty units or a term of imprisonment of not more than rwelvemonthsor to both.
(2) where an olfenceunder theseRegularionsis committed by a
or a frrm, eachmember,
?odycorporate,or by a memberof a parrnershrp
directoror officerconcernedwith the managementof the firm commits
an offenceand is liableon summaryconvictionto a fine of, not more

"Commission"meansEnergy Commission;
"floodlights" meansan appararusfor illuminating in broad

beams;
"incandescent
filam.entlamp" meansa light bulb with tungsten
filamentwhich is housedin a glassglobeor housing;
"searchlight" means an apparutusfor projecting a powerful
beam;
"specialpurposelights" meanshigh intensitylights used to illuminate placesincluCingstudios,clubs, and theatresor for
the film industry or other specializedapplications;
"streetlights"meanslighted mountedon a pole to illuminate a
public streetor highway; and
.
"used appliance"meansa usedrefrigerator,refrigetator-freezer,
freezerand air-conditioner.

8. TheseRegulationscome into force six months after the date of
notification exceptregulation3, which shall come into force
