OTHER ISSUES O F THE GAZETTE
Public Service issues contain notices concerning administrative matters, including examinations, vacancies,

distribution of these notices will be by their inclusion

Tariff concessions issues contain notices of tariff concessions proposed, granted or revoked in accordance with
the provisions of Part XVA of the Customs Act 1901.
These issues are published each Wednesday and are

Periodic issues contain lengthy notices of a non-urgent
nature, including the following: certificates of Australian
citizenship; registered tax agents; authorised celebrants;
unclaimed deposits and moneys; Australian Public

the Governor-General has declared that service by
members of the Defence Force with the United Nations
Military Observers G r o u p India/Pakistan ( U N M O G I P )
in Kashmir is a prescribed operation for the award of
the Australian Service Medal with Clasp ' K a s h m i r ' as
detailed in the following Declaration:

I, WILLIAM G E O R G E H A Y D E N , Governor-General
of the Commonwealth of Australia, on the recommendation of the Minister of State for Defence Science and
Personnel, hereby:
(a) under regulation 3 of the Australian Service Medal
Regulations set out in the Schedule to Letters
Patent dated 13 September 1988, declare the
United Nations Military Observers G r o u p in India/Pakistan activity during the period that commenced on 14 February 1975 to be a prescribed
operation for the purposes of those Regulations;
and
(b) under subregulation 4 (2) of those Regulations,
determine that the conditions for the award of
the Australian Service medal in respect of that
prescribed operation are:
(i) the Medal may be awarded to a m e m b e r of
the Australian Defence Force who rendered
military service as such a m e m b e r while
posted to or serving with the United Nations
Military Observers G r o u p in India/Pakistan
for a period commencing on or after 14 February 1975 and being a period of not less
than ninety days;
(ii) the qualifying period of service as described
in subparagraph (b) (i) may be deemed by
the Chief of the Defence Force or his delegate to have been established notwithstanding that the m e m b e r has been posted to or
has served with the United Nations Military
Observers G r o u p in India/Pakistan for a
period of less than ninety days commencing
on or after 14 February 1975;
(iii) the Medal shall be awarded to members
qualifying under subparagraphs (b) (i) or
(b) (ii) with the clasp 'Kashmir'; and
(iv) the Chief of the Defence Force in exercising
his discretion to deem under subparagraph
(b) (ii) above shall take into account whether
the member's service with the United Nations Military Observers G r o u p in India/
Pakistan:
(a) was terminated owing to death, evacuation owing to illness or injury or other
disability due to service; or
(b) was terminated due to G o v e r n m e n t or
Defence Force reasons.

1.
I, Cathy Argall, state Manager of the Australian Property Group
in Queensland, a person to whom the Minister administering the
Lands Acquisition Act 1989 (The Act) has by delegation dated
the 7th day of June 1989 delegated his powers and functions
under sub-section 22(1) of the Act, DECLARE that I am
considering the acquisition by the Commonwealth of Australia,
an acquiring authority under the Act, of an interest in land
specified in the schedule, for the public purpose of Defence,
namely the expansion of the RAAF Base at Amberley.
2.
The land appears to me to be suitable for use for that public
purpose•
3.
The land will be used as buffer purposes for the Base to allow
for the construction of an Ordnance Storage Facility in close
proximity to the area.
4.
The reason why the land appears to be suitable is that it is
adjacent to the Base and it is mostly vacant and allows for the
natural expansion of the Base.

ACT 1981
Pursuant to section 25 of the Environment
Protection
(Sea Dumping) Act J981, notice is given that a general
permit was granted on 30 May 1990 to the Port
Hedland Port Authority, P C Box 2, Port Hedland WA
6722 to d u m p at sea over a period of twelve months
up to 350 000 tonnes of spoil derived from the dredging
of the shipping channel and ship turning basin in Port
Hedland harbour.
Dumping of the dredge spoil is to take place within
an area described by the following coordinates:

DIRECTION U N D E R S E C T I O N 120
I, J O H N CHARLES KERIN, Minister for Primary Industries and Energy:
(a) having power under section 120 of the Wool
Marketing Act 1987 ('the Act'), subject to the
conditions set out in subsection (2) of that section, to give directions to the Australian Wool
Corporation ('the Corporation') concerning the
performance of its functions and the exercise of
its powers; and
(b) being satisfied that, because of the existence of
exceptional circumstances, it is necessary to give
the following direction in order to ensure that
the exercise by the Corporation of its powers
under subsection 66 (1) of the Act does not conflict with major government policies; and
(c) having given the Corporation a written notice
stating that I was considering giving the following
direction; and
(d) having provided the Chairperson of the Corporation an adequate opportunity to discuss with
me the need for the proposed direction;
hereby direct the Corporation under section 120:
(e) subject to section 66, to determine (or re-determine) under paragraph 6 6 ( 1 ) (a) the prices that
ought to be the prices for certain types of wool
for the 1990-91 wool selling year so that the
weighted average of those prices is no more than
700 cents per kilogram clean; and
(f) subject to section 66, to publish under paragraph
6 6 ( l ) ( b ) as the minimum market indicator reserve price for that year a price no more than
700 cents per kilogram clean.

NOTICE O F I N Q U I R Y SUBMISSIONS INVITED
On 1 June 1990 the Australian Broadcasting Tribunal
approved the transfer of the licence for commercial
radio service 3AK from General Television Corporation
Pty Ltd (General Television) to Actraint No. 93 Pty
Ltd (Actraint). Actraint was a wholly owned subsidiary
of general television.
The Tribunal has now commenced an inquiry into
the acquisition of 100 per cent of the issued capital of
Actraint by Sandhurst Downs Pty Ltd (to be known as
Peter Corso (Broadcasting) Pty Ltd). Applications have
been lodged by Sandhurst Downs Pty Ltd (Sandhurst)
and Peter Corso who will acquire a prescribed interest
in the 3AK licence.
The issues to be considered in the share transaction
inquiry are whether, if the applications were for consent
to the transfer of the licences under section 89A of the
Broadcasting Act 1942, the Tribunal should refuse consent having regard particularly to:
(a) whether the applicant has given an undertaking to
comply with the conditions of the licence, to provide an adequate and comprehensive service pursuant to the licence, to encourage the provision of
Australian programs and to use and encourage the
use of Australian creative resources;
(b) whether it would be contrary to a provision of the
Act;
(c) whether it would be advisable in the public interest,
because of Tribunal is not satisfied that:
(i) the applicant is a fit and proper person to hold
the licence;
(ii) the applicant has the financial, technical and
managerial capabilities necessary to provide an
adequate and comprehensive service;
(iii) the applicant is otherwise capable of complying
with the conditions of the licence;
(d) whether if consent was given,
(1) a contravention, amounting to an offence of
section 90C (limitations of radio interests) or
92JB (limitations of cross media interests) would
likely occur;
(2) a person would be contravening section 90F
(limitations of directorships) or 92JD (limitations of cross media directorships) would likely
occur;
(3) a condition specified in section 90G (foreign

INDUSTRIES
The Prices Surveillance Authority is to hold a public
inquiry into the charges by the stevedoring and container depot industries. The inquiry will examine; the
current basis for establishing stevedoring and container
depot charges; the appropriate basis for determining

whether improvements in efficiency resulting from the
reforms to the stevedoring and container depot industries are reflected in future charges and costs to users;
and the appropriate role for the Prices Surveillance

Melbourne.
The Sydney hearing will commence at 10.00 am on
Thursday, 19 July 1990 and will be held at the Department of Social Security Appeals Tribunal, 11th Floor,

NOTICE UNDER SUB-SECTION 269TD(2)
OF THE CUSTOMS ACT 1901
In Commonwealth of Australia Gazette No.S 27 of 1 February
1990 notice was given of initiation of inquiries into alleged
dumping of sorbitol 70 per cent solution from France, the
Republic of Korea, Taiwan Province, Thailand and Mexico. The
Notice was published following an application by ICI
Australia Operations Pty Ltd (ICI) for the imposition of
dumping duties. The Australian Customs Service (Customs) has
now considered the application, taking into account
submissions received and any other matters that the
Comptroller-General considered relevant.
As a result of this consideration, I, Richard John Hunt,
delegate of the Comptroller-General of Customs, have made a
preliminary finding under sub-section 269TD(2) of the Customs
Act 1901, that:
(a) there are sufficient grounds for publication of a dumping
notice; and
(b) it is appropriate to take securities under section 42 of
the Customs Act 1901 in respect of any dumping duty that
may become payable upon the importation on or after
7 June 1990 of sorbitol solution from France, the
Republic of Korea, Taiwan Province, Thailand and Mexico.
Customs will, within seven (7) days of the publication of
this Notice, refer to the Anti-Dumping Authority the question
as to whether the publication of the Dumping Duty Notices
sought by ICI is so justified, as required by paragraph
269TD(2)(b) of the Customs Act 1901.
