N.N.—9054542 G o v e r n m e n t House Canberra A C T 2600 21 May 1990 It is notified for general information that His Excellency the Governor-General has declared that service by members of the Defence Force with the United Nations Military Observers G r o u p India/Pakistan ( U N M O G I P ) in Kashmir is a prescribed operation for the award of the Australian Service Medal with Clasp ' K a s h m i r ' as detailed in the following Declaration: C O M M O N W E A L T H O F AUSTRALIA AUSTRALIAN SERVICE M E D A L REGULATIONS DECLARATION UNDER REGULATION 3 DETERMINATION UNDER SUBREGULATION 4(2) I, WILLIAM G E O R G E H A Y D E N , Governor-General of the Commonwealth of Australia, on the recommendation of the Minister of State for Defence Science and Personnel, hereby: (a) under regulation 3 of the Australian Service Medal Regulations set out in the Schedule to Letters Patent dated 13 September 1988, declare the United Nations Military Observers G r o u p in India/Pakistan activity during the period that commenced on 14 February 1975 to be a prescribed operation for the purposes of those Regulations; and (b) under subregulation 4 (2) of those Regulations, determine that the conditions for the award of the Australian Service medal in respect of that prescribed operation are: (i) the Medal may be awarded to a m e m b e r of the Australian Defence Force who rendered military service as such a m e m b e r while posted to or serving with the United Nations Military Observers G r o u p in India/Pakistan for a period commencing on or after 14 February 1975 and being a period of not less than ninety days; (ii) the qualifying period of service as described in subparagraph (b) (i) may be deemed by the Chief of the Defence Force or his delegate to have been established notwithstanding that the m e m b e r has been posted to or has served with the United Nations Military Observers G r o u p in India/Pakistan for a period of less than ninety days commencing on or after 14 February 1975; (iii) the Medal shall be awarded to members qualifying under subparagraphs (b) (i) or (b) (ii) with the clasp 'Kashmir'; and (iv) the Chief of the Defence Force in exercising his discretion to deem under subparagraph (b) (ii) above shall take into account whether the member's service with the United Nations Military Observers G r o u p in India/ Pakistan: (a) was terminated owing to death, evacuation owing to illness or injury or other disability due to service; or (b) was terminated due to G o v e r n m e n t or Defence Force reasons. Actraint was a wholly owned subsidiary of general television. The Tribunal has now commenced an inquiry into the acquisition of 100 per cent of the issued capital of Actraint by Sandhurst Downs Pty Ltd (to be known as Peter Corso (Broadcasting) Pty Ltd). Applications have been lodged by Sandhurst Downs Pty Ltd (Sandhurst) and Peter Corso who will acquire a prescribed interest in the 3AK licence. The issues to be considered in the share transaction inquiry are whether, if the applications were for consent to the transfer of the licences under section 89A of the Broadcasting Act 1942, the Tribunal should refuse consent having regard particularly to: (a) whether the applicant has given an undertaking to comply with the conditions of the licence, to provide an adequate and comprehensive service pursuant to the licence, to encourage the provision of Australian programs and to use and encourage the use of Australian creative resources; (b) whether it would be contrary to a provision of the Act; (c) whether it would be advisable in the public interest, because of Tribunal is not satisfied that: (i) the applicant is a fit and proper person to hold the licence; (ii) the applicant has the financial, technical and managerial capabilities necessary to provide an adequate and comprehensive service; (iii) the applicant is otherwise capable of complying with the conditions of the licence; (d) whether if consent was given, (1) a contravention, amounting to an offence of section 90C (limitations of radio interests) or 92JB (limitations of cross media interests) would likely occur; (2) a person would be contravening section 90F (limitations of directorships) or 92JD (limitations of cross media directorships) would likely occur; (3) a condition specified in section 90G (foreign control provisions) would be contravened.
