The Delta Chi Fraternity Georgia Southern University Chapter By-Laws Updated 3 April 2013 Note: The Georgia Southern Chapter by-laws should serve as a guide to help the chapter with decision-making situations. The by-laws cannot and do not cover every issue that the chapter might encounter, but does provide a basic outline to follow. Remember, chapters and/or colonies do not have constitutions. The only constitution, the supreme law of the fraternity, is one of the three sections in Delta Chi Law. The Georgia Southern University Chapter by-laws should be used as a tool to help the chapter in its operations and should be referred to in the case of a dispute. In resolving disputes, the chapter 2 should first review federal, state, and local law. Second, check Delta Chi Law. Finally, refer to the chapter by-laws. Furthermore, the by-laws do not constitute legal advice. Questions on acceptable alternatives may be found by consulting Delta Chi Law, the International Headquarters, or a leadership consultant. In revising the Georgia Southern University chapter by-laws, be sure not to adopt any changes that conflict with Delta Chi Law and fraternity policies. DEFINITIONS By-laws – laws of governance made by an organization Delta Chi law – the constitution, by-laws, and regulations of the Delta Chi Fraternity; only the chapters and colonies while sitting in convention make amendments and changes Student Member – an undergraduate initiate in good standing at a chapter or colony of Delta Chi. Delta Chi does not use the terms “active” or “brother” so as to not be confused between alumni and undergraduate members. Associate Member – an undergraduate member of a chapter or colony that has not been initiated. Historically referred to by other fraternities as a “pledge”. By-laws of the Georgia Southern Chapter of the Delta Chi Fraternity Article I: Name The name of this organization shall be the Georgia Southern University Chapter of the Delta Chi Fraternity. Article II: Purpose and Policy A. A. This chapter shall be conducted under the policies, principles, and provisions set forth in Delta Chi Law and in these by-laws of the Georgia Southern Chapter of the Delta Chi Fraternity. B. Members of the chapter shall uphold the “basic expectations” of a Delta Chi: 1. I will strive for academic achievement and practice academic integrity. 2. I will respect the dignity and worth of all persons. I will not physically, mentally, psychologically or sexually abuse or haze any human being. 3. I will protect the health and safety of all human beings. 4. I will respect my property and the property of others; therefore, I will neither abuse nor tolerate the abuse of property. 5. I will meet my financial obligations in a timely manner. 6. I will neither use nor support the use of illegal drugs; I will neither abuse nor support the abuse of alcohol. 3 7. I will acknowledge that a clean and attractive environment is essential to both physical and mental health; therefore, I will do all in my power to see that the chapter property is safe, properly cleaned and maintained. 8. I will know and understand the ideals expressed in my fraternity Ritual and will incorporate them into my daily life. 9. I will exercise compassion and understanding in dealing with all persons. 10. I will sustain my commitment to and involvement with our fraternity throughout my lifetime. 11. I will challenge all my fraternity members to abide by these fraternity obligations and will confront those who violate them. Article III: Membership A. Eligibility for Membership 1. Any male student enrolled in any college or school at Georgia Southern University shall be eligible for membership in the chapter 2. No personal shall be denied membership in the chapter based on race, color, creed, sexual preference, religion, national origin, handicap, age, or marital status. 3. No man shall be eligible for membership who is, or was, a member of another National Interfraternity Conference (NIC) Fraternity. 4. Membership in the chapter shall be limited to student members and associate members. 5. Membership shall be granted by a seventy-five percent (75%) affirmative vote of the student members in good standing with the chapter. B. Academic standing necessary to maintain membership 1. A student member of the chapter must, in order to maintain his membership, maintain a cumulative GA of 2.6 on a 4.0 scale. 2. If the cumulative or semester GPA of any student members shall fall below a 2.6, that member will be placed on academic probation for the next semester. This is subject to review of the executive committee and the alumni board of trustees (ABT) at the end of the semester following the period of academic deficiency. a. If the member earns above a cumulative GPA above a 2.6 the following semester, he is taken off academic probation. b. If the member raises his cumulative GPA but not above a 2.6, he is on continued academic probation. However, this is considered a sign of good faith for the member. c. If the member fails to raise his cumulative GPA above a 2.6, he has one more semester to do so or he shall be placed on involuntary inactive status until his cumulative GPA is above a 2.6. 3. Academic probation will include, but will not be limited to restrictions on attendance of social events, attendance at two events put on by the academic success center, at least two meetings with our academic advisor during the semester, and midterm grade reports signed by the professor and fraternity academic advisor. The scholarship chair will enforce these rules. C. Inactive Status 1. Inactive status entails no participation in social activities, voting, rush activities, and the right of suffrage, but can attend all meetings. 4 2. Inactive status may be granted upon a two-thirds (2/3) vote of the chapter. Such action must be ratified by a two-thirds (2/3) vote of the ABT, as per Delta Chi Law (Article V, Section 1, Subsection 1). 3. It takes two-thirds (2/3) vote of the chapter to regain active status. D. Involuntary Inactive Status 1. Inactive status may be imposed at the discretion of the executive board on any member who is more than fifty-dollars ($50) in arrears to the chapter, past thirty (30) days due. 2. Inactive status may be imposed at the discretion of the executive board on any member that has a cumulative GPA below a 2.6 for two consecutive semesters without improvement. Such status will be removed if the member raises his cumulative GPA above a 2.6. The chapter or the ABT shall have the power to inactivate any member of the chapter for above reasons. For further information refer to Article III, Section B, of the by-laws of the Georgia Southern University Chapter of the Delta Chi Fraternity. 3. Involuntary inactive status may be imposed at the discretion of the executive board on any member that fails to earn at least a 1.5 GPA for a single semester. If a member earns less than a 1.5 GPA for a semester they will be inactive for the following semester, but may petition to regain active status after the semester hiatus. 4. Involuntary status may be imposed on any member who fails to attend more than 75% of chapter meetings. a. Shall not apply to excused absences as long as it does not exceed 50% of the chapter meetings b. Excused would consist of verifiable: medical issues, academic, work, personal obligations, all approvals of excused absences will be at sole digression of executive board 5. Involuntary status may be imposed on any member who fails to attend more than 50% of chapter events. a. Shall not apply to excused absences as long as it does not exceed 50% of the chapter events b. Excused would consist of verifiable: medical issues, academic, work, personal obligations, all approvals of excused absences will be at sole digression of executive board 6. At the sole digression of the executive board, fines can be imposed in lieu of involuntary inactive status, the amount of which shall be determined ad hoc and on a situational basis with a majority affirmative vote of the executive board. E. Financial Obligations of Inactive Members 1. An inactive member shall not be assessed dues, fees, or other monetary obligation by the chapter during the period of inactivity if placed on inactive status before the active role is sent to the international headquarters (IHQ). If the member goes inactive after the role is placed, they must up-hold their international insurance to the general fraternity. 2. All monetary obligations owed to the chapter at the time of the granting of inactive status shall be paid immediately or by an installment plan approved by the “D” and the ABT. 5 F. G. H. I. 3. In no event shall the granting of inactive status invalidate debts to the chapter. Status of Graduate Students 1. Any member of the chapter who is awarded a degree, then enrolls in a graduate program may his option maintain his status as a student member with all the rights, privileges, duties, and obligations of such, per Delta Chi Law. 2. Any graduate student member who does not wish to maintain student member status shall be declared an alumnus with the characteristics of that status. Affiliates 1. A student at Georgia Sothern University who was initiated at another chapter or colony may petition to affiliate with the Georgia Southern University Chapter. 2. Such petition may be granted by an affirmative vote of the student members in good standing. 3. Before a petition may be granted, the “C” shall contact the petitioner’s previous chapter or colony as well as the Delta Chi International Headquarters to determine that the petitioner is in good standing with both. 4. The petitioner must present a valid affiliation card provided for in Article V, Section 1 of the By-Laws in Delta Chi Law. 5. The Georgia Southern Chapter of the Delta Chi Fraternity must be given written proof from the A and D of the affiliate’s previous chapter confirming that he is in good standing. Initiation into membership 1. In order for initiation to be valid, the Delta Chi Headquarters must have the following: a. Personnel Record Form b. Initiation Dues c. Associate Member Dues 2. The ritual of the Delta Chi Fraternity shall be a mandatory requirement for student membership 3. The chapter shall choose candidates for initiation into membership as set forth in these by-laws Suffrage 1. The right to vote shall be limited to student members who meet the following criteria a. Good academic standing, as outlined in Article III, Section B b. Not under censure by the judicial board c. Not in alumnus status 2. In all cases abstentions shall go with the majority, except in those where affirmative vote is necessary. In the case of a tie, the chapter “A” shall vote to break the tie. 3. Those members not present, that have not cast a vote in advance, or submitted a proxy shall be counted as an abstention.Upon the request of any active brother, votes will be carried out with heads down and hands up. Votes will be counted by the “A” and a non-executive and non-running member. 4. Upon a set forth motion passed by affirmation, a particular vote may be carried out by secret ballot. Ballots shall be tallied in accordance with Article III, Section I, Subsection 3. 6 5. Votes may be carried out via electronic means. a. Electronic votes shall require the name of the member voting, in order to prevent fraud. b. Names and direction of individual votes shall not be disclosed beyond the executive board. Article IV: Government A. Officers – the officers of the chapter shall consist of the following elected officers 1. The “A” shall be deemed the president for purposes of interpretation of Robert’s Rules of Order or other such documents. The “A” shall maintain order at all meetings. The “A” shall be the inter-fraternity council representative for the chapter. The “A” shall follow all guidelines set for him in these by-laws, Delta Chi Law, and other publications of the Delta Chi Fraternity. 2. The “B” shall be deemed the vice-president for purposes of interpretation of Robert’s Rules of Order or other such documents. The “B” shall coordinate the committees of the chapter and be responsible for the semester review of the chapter’s by-laws. The “B” shall follow all guidelines set for him in these bylaws, Delta Chi Law, and other publications of the Delta Chi Fraternity. 3. The “C” shall be deemed the secretary for purposes of interpretation of Robert’s Rules of Order and other such documents. The “C” shall maintain records of all chapter business and shall be responsible for all official correspondence for the chapter. The “C” shall follow all guidelines set for him in these by-laws, Delta Chi Law, and other publications of the Delta Chi Fraternity. 4. The “D” shall be deemed the treasurer for purposes of interpretation of Robert’s Rules of Order or other such documents. The “D” shall be responsible for keeping accurate financial records of all transactions. He shall report at the first regular chapter meeting of each month, the names of all members who are in arrears to the chapter and the amount they owe. The “D” shall set up an annual budget with the help of the ABT and the executive committee of the chapter. The “D” shall follow all guidelines set for him in these by-laws, Delta Chi Law, and other publications of the Delta Chi Fraternity. 5. The “E” shall be deemed the alumni relations chairman for purposes of interpretation of Robert’s Rules of Order. The “E” shall prepare all articles for submission in the Delta Chi Quarterly. The “E” shall prepare not less than one alumni newsletter per semester. The “E” shall maintain a filing system of all members and alumni of the chapter as well as alumni living in the area. The “E” shall follow all guidelines set for him in these by-laws, Delta Chi Law, and other publications of the Delta Chi Fraternity. 6. The “F” shall be deemed the sergeant at arms for purposes of interpretation of Robert’s Rules of Order. He is responsible for coordinating the performance of the ritual of the fraternity as well as ensuring the chapter is conducting an effective risk-management program. The “F” shall be the chairman of the judicial board, which is described in these by-laws. He is responsible for mediating disputes between members and for helping to keep order during meetings. The 7 B. C. D. A. “F” shall follow all guidelines set down for him in these by-laws, Delta Chi Law, and other publications of the Delta Chi Fraternity. 7. The “G” shall be deemed the brother at large for purposes of interpretation of Robert’s Rules of Order or other such documents. The “G” will be the mediator between student members of the chapter and the executive committee. The “G” shall be responsible for identifying, mediating, and relaying issues within the chapter to the executive committee. The “G” shall hold an open forum not less than once a month to allow the student members to voice their opinions and concerns regarding the chapter and executive committee. The “G” shall follow all guidelines set down for him in these by-laws, Delta Chi Law, and other publications of the Delta Chi Fraternity. 8. The “R” shall be deemed the recruitment chair. The “R” shall be placed in charge of recruitment events including planning all events for IFC formal recruitment. He shall be in charge of attending all events dealing with IFC recruitment, or picking someone to go in his place, preferably the rush chair. He shall be in charge of handing out bids and dealing with all rules from the office of fraternity and sorority relations. 9. The AMC shall be deemed the associate member councilor. The AMC shall be placed in charge of all associate members. He shall also be in charge of all aspects dealing with their education in aspects of the fraternity, payment of dues and fees owed to the fraternity, big brother night, initiation week, and initiation. The “BB” 1. The “BB” shall adhere to all applicable provisions of Delta Chi Law. 2. The “BB” shall be a member of the Delta Chi Fraternity. 3. The “BB” shall be deemed the alumni advisor for purposes of interpretation of Robert’s Rules of Order. 4. The “BB” shall have on file at the Delta Chi Headquarters all reports mandated as well as an Oath of Office. Officer Notebooks 1. It shall be required of each officer and committee chairman to keep a record of all functions of his office, including either successful and unsuccessful endeavors or plans. 2. The executive committee or whenever they see fit as a committee shall inspect the record of the first meeting of every month. Officer Reports 1. Each officer shall submit written officer reports monthly to the ABT for their review or whenever they see fit as an ABT. Article V: Terms of Office The “A”, “B”, “C”, “D”, “E”, “F”, “G”, AMC, and “R” 1. The lettered officers shall serve for one calendar year (i.e. a twelve month period) and for conjunctive terms of academic vacations or until their successor is duly elected and has taken the oath of office. 2. The AMC shall serve a term of one semester. He can serve conjunctive terms of academic vacations or until his successor is duly elected and has taken the oath of office. 8 B. C. D. E. A. B. 3. The lettered officers shall be eligible to success themselves for one additional term in office. 4. A member may hold an executive office for a single semester by a vote of twothirds (2/3) of the student members of the chapter. The “C” and “E” are exempt from this by-law because it would conflict with Delta Chi Law. Note: Only the “C” and “E” are required by Delta Chi Law to serve year terms. The “BB” 1. The “BB” shall serve a two-year term. There will be no limit on successive terms. 2. The “BB” may be removed from office by a vote of four-fifths (4/5) of the student members of the chapter in good standing. Such removal is subject to the approval of the executive committee of the Delta Chi Fraternity. Removal from Office 1. Any officer may be removed from office for sufficient cause by a two-thirds (2/3) vote of the student members of the chapter in good standing. 2. In addition, officers may be removed from office by an affirmative majority vote of the ABT. Recruitment Chairman 1. As soon as possible after his election, the “R” shall appoint a chairman of the recruitment committee, with the advice of the executive committee. 2. These men shall serve at the pleasure of the executive committee. 3. As with the lettered officers, the rush chairman may be removed by an affirmative vote of two-thirds (2/3) of the student members of the chapter in good standing. 4. A brother may get his dues discounted $35 for being responsible for the recruitment of a newly initiated brother. Credit shall be given to the brother that introduces the potential to the chapter, not the brother that rushes him, and this determination will be at the discretion of the R. If the R brings around a future initiate, his dues may be discounted $20 Committee Chairmen 1. As soon as possible after his assumption of office, the “B” shall appoint a chairman to each standing committee of the chapter at the approval of the executive board. 2. The “B” shall appoint a chairman for each ad hoc committee as necessary at the approval of the executive board. 3. All chairmen appointed by the “A” shall serve at the pleasure of the executive committee. Note: While the “A” has the authority to appoint chairmen per Delta Chi Law, it is recommended that he delegate this to the “B” since the “B” has the responsibility to oversee them Article VI: Elections Nominations for the officers of “A”, “B”, “C”, “D”, “E”, “F”, “G”, AMC, and “R” 1. Each student member in good standing and present at the chapter meeting may nominate up to three (3) persons for each office. 2. The ABT shall serve, as the credentials committee to ensure that all members nominated are eligible to hold that office. Eligibility for Election and Holding of Office 9 C. D. E. F. 1. Nominees must be student members of the chapter in good standing at the time of nomination, election, and at the time of taking the oath of office. 2. A member must have a 2.6 cumulative GPA on a 4.0 scale to be nominated or elected to a position. He must maintain a 2.6 for each semester in office. If the officer falls below a 2.6 GPA, he will go before the judicial review board for review. 3. A member must have been a student member for one semester, except for the office of “A” who shall be required to be a student member for two semesters or one calendar year, whichever is greater. Resignation to Accept Nomination 1. No officer shall be required to resign his present position in order to be nominated for any other position. 2. No member may serve more than one lettered office in the chapter simultaneously. Vacancies – Special Elections 1. In the event that a vacancy occurs in an office, such vacancy shall be filled by a special meeting by a quorum of the student members in good standing. 2. Such special meeting may be concurrent with the next regularly scheduled chapter meeting. General Elections 1. The election of all officers shall be done by a secret ballot, numbered and counted by the “F”, and a non-executive and non-running member. 2. The nominee who receives the majority of the votes shall be declared the winner. 3. Providing no candidate receives a majority of the votes, a run-off election shall be held between the two candidates receiving the most votes in the general election. A candidate must secure a simple majority of the votes in a run-off election to be declared the winner. Timing of Nominations, Elections, and Assumption of Office 1. Nominations for elections for the officers of “A”, “B”, “C”, “D”, “E”, “F”, “G”, AMC, and “R” shall be held at least a week prior to the schedule fall initiation date and new offices will be taken at the first regular meeting of the spring semester. The second nomination and election of AMC will take place one calendar week after initiation or the second chapter meeting following initiation, whichever is the longer period of time. 2. The election for “BB” shall be at the end of his two-year term. All other procedures used in other elections will apply. 3. Elections will take place at the first regular meeting following the fall associate member class initiation or the second to last regular meeting of the fall semester, whichever comes first. 4. Those elected will take office at the first regular meeting of the spring semester. 5. The retiring “A” will be responsible for setting up an officer’s retreat before the start of the spring semester. 6. The new officers should meet with the old officers no less than twice to explain the position, go over the officer’s notebook, and provide a smooth transition. 7. The ABT should also meet with the new officers to explain the positions and policies of the ABT. Also, the ABT shall conduct an officers training session at 10 G. A. B. C. this meeting. Such a meeting shall take place by the next regular meeting of the ABT. Removal from Office 1. If any officer of the chapter fails or refuses to perform his duty as prescribed by these by-laws and Delta Chi Law, or has otherwise violated his oath, his resignation may be demanded by a two-thirds (2/3) affirmative vote of the chapter of a majority vote of the ABT. In the event the officer refuses to comply with the request, written charges shall be filed against him and after a notice has been given, a vote shall be taken to remove the officer in accordance with Delta Chi Law. If two-thirds (2/3) of the votes are for recall, the office shall be declared vacant and the chapter will fill the position as prescribed in the special elections section of these by-laws. Article VII: Committees Executive Committee 1. Membership a. The “A”, “B”, “C”, “D”, “E”, “F”, “G”, “R”, and AMC of the chapter shall constitute the executive committee. The “BB” shall be an ex-officio non-voting member. b. If the officer of president of the associate member is filled, such officer may be invited to attend meetings, but will have no vote or ability to make motions. 2. Duties a. The executive committee shall transect the day-to-day business of the chapter. b. The executive committee shall set the agenda for all chapter meetings. c. The executive committee shall faithfully execute any duties assigned to it by these by-laws or by the chapter. 3. Chairman a. The “B” shall chair all meetings of the executive committee. b. In his absence, the “C” shall assume the duties of chairman, and the “D” will take the minutes. c. The chairman – “B” is a non-voting member of the executive committee, except in the case of a tie, in which he may vote to break the tie. 4. Meetings – the executive committee shall meet not less than once a week during the school year and monthly during the summer. Recruitment Committee 1. Membership – any member of the chapter may serve on the recruitment committee at the discretion of the recruitment chairman. 2. Purpose – the primary duty of the recruitment committee is to coordinate the recruitment efforts of the chapter. It is every member’s duty to participate in recruitment. 3. Duties – the recruitment committee shall make all arrangements necessary to conduct an effective recruitment. Associate Member Committee 1. Membership 11 a. The associate member counselor shall oversee the committee and appoint each of the following positions to the members of the committee: big brother coordinator and fraternal educator. b. The associate member counselor may request help from any member of the chapter. 2. Purpose a. The associate member counselor is entrusted with the responsibility to develop and conduct activities designed to promote leadership, responsibility, character, and brotherhood in associate members in every way consistent with the principles of the Delta Chi Fraternity. D. Judicial Board 1. Membership a. In addition to his other duties, the “F” shall be a member and the presiding officer of the judicial board. b. In addition to the “F”, the judicial board shall consist of four (4) nonexecutive members of the chapter to be appointed by the “F” with the advice and consent of the executive committee. c. When making appointments to this committee, the “F” shall secure a broad representation of the members. d. Shall a member of the judicial board be placed under judicial review; his membership on the judicial board shall be terminated for the remaining duration of his student membership. 2. Term of Office a. Once appointed, the four members shall serve for one year or until their resignation or removal from office, as stated in these by-laws. b. Change in status of the member shall not render him ineligible except that a member who terminates his enrollment at Georgia Southern University or is declared inactive shall be required to resign. c. A two-thirds (2/3) vote of the executive committee may be sufficient to remove a member from the judicial board if they feel he is failing to comply with standard procedures and precedent. 3. Powers and Procedures a. The judicial board shall have the authority to review all violations of Delta Chi Law, the risk management policy, house rules, or chapter by-laws made by student members and/or their guests. b. The judicial affairs manual shall be the governing document for the processes and procedures of the judicial board. This contains the process to follow for a judicial hearing and suggested restitutions for delinquent acts and violations of the aforementioned documents. c. The judicial affairs manual is to be maintained and updated by the “F” on occasion so as to remain current and effective. d. The judicial board members shall be trained in the judicial process and hearing mechanics, as defined by having read and given written acknowledgement of the judicial affairs manual. 12 e. The judicial board shall guarantee full due process for all parties during the hearing procedure, ensure the confidentiality of the proceedings, and maintain a tape recorded or written record of all testimony. f. The judicial board shall call witnesses and adjudicate cases involving actions of members and/or their guests. g. Delineate between situations of organizational, individual, and dual responsibility. h. Levy thorough, consistent, and educational sanctions that will both deter and redirect further violations. i. The judicial board must follow Delta Chi Law when expulsion action is being taken against chapter members. 4. Appellate Authority a. Any decision of the judicial board may be appealed to the entire chapter no later than the next regular chapter meeting. b. The judicial board may adopt rules of procedure governing appeals and regulations. c. To overturn a judicial decision a two-thirds (2/3) vote must be obtained, and the motion for appeal must be raised through proper parliamentary procedure under the new business section of the meeting. The “C” should be advised before the meeting of the student member’s intention to appeal. d. If an appeal is made before the chapter the “F” shall be allotted time to explain the reasoning of the judicial board for their actions. 5. Arbitration Authority a. The judicial board may consider and resolve any dispute between members of the chapter presented to it by those members. b. The judicial board may adopt rules and procedures and may conduct its business and deliberations in closed sessions. E. General Committees 1. Standing committees – the following shall be other standing committees, along with those already mentioned: executive committee, alumni relations committee, by-laws committee, brotherhood committee, community service committee, finance committee, fund-raising committee, housing committee, intramural committee, philanthropy committee, public relations committee, ritualistic committee, social committee, and scholarship committee. a. Social Committee: shall be responsible for the social calendar of the chapter. All social events must be in compliance with the FIPG, Inc. risk management policy. b. Scholarship Committee: shall be responsible for developing and administering a scholarship program to aid each member in the “acquisition of a sound education”. The committee members shall be required to review the Scholarship BRIEF published by the Delta Chi Fraternity. c. Intramural Committee: shall consist of one (1) team captain from various sports in which the chapter participates. The committee should see that a team is fielded in sports in which the chapter wishes to compete. 13 d. Community Service Committee: shall coordinate the chapter’s efforts to become responsible, caring members of the community. e. Philanthropy Committee: shall be responsible for conducting at least one event a semester, 2 a year in the name of Jimmy V or Jeffrey’s Voice. f. Brotherhood Committee: shall be responsible for conducting and organizing brotherhood events to further the brotherhood of the chapter. g. Public Relations Committee: shall be responsible for displaying Delta Chi, by way of flyers, newspaper, radio, and any capacity that brings Delta Chi to the public. They shall also be in charge of sheet signs, and the hanging and taking down of sheet signs. h. Housing Committee: shall be responsible for conducting a clean and proper house. They are to work with the corporation to assess parlor fees. They shall be in charge of non-resident and resident housing contracts. They shall conduct a maintenance sweep each week along with the “F” to ensure a safe environment. i. Chaplain: shall be responsible for organizing and conducting regular religious and spiritual activities within the chapter. The chaplain will be an approachable figure who is readily available to discuss and counsel spiritual, moral, and personal issues among brothers. 2. Ad Hoc Committees a. The chapter may create ad hoc committees as needed. b. Ad hoc committees shall exist only until their purpose has been completed. c. Ad hoc committees existing for more than two consecutive semesters have the option for applying for standing committee status. Failing this, they will be dissolved. Article VIII: Alumni Board of Trustees A. Membership 1. The Alumni Board of Trustees (ABT) shall consist of at least five members of the majority of who shall be alumni of the fraternity, see Article VII, Section 6, and Subsection 2 of the by-laws of Delta Chi Law. 2. The “A”, “D”, and “BB” of the chapter are to be members of the ABT; see Article VII, Section 6, and Subsection 2 of the by-laws of Delta Chi Law. 3. The ABT will select from among its members a president and a financial advisor as well as any other positions it sees fit. The “BB” and any undergraduate members of the ABT are not eligible for election to an ABT position, although they are members of the board. 4. Board members shall serve two-year terms (except the “A”, “D”, and the “BB”, who shall serve their terms as described in these by-laws) that are staggered as much as possible to provide the board with opportunity. 5. Board members shall be elected by a majority vote of the standing ABT members. 6. Board members can be removed from office by a four-fifths (4/5) vote of the undergraduate chapter or the ABT, subject to approval of the executive committee of the Delta Chi Fraternity or a unanimous vote of the executive committee when, in judgment, the board member fails to properly perform the duties of his office. 14 B. Powers (see article VII, Section 6, Subsection 3 of the by-laws of Delta Chi Law) 1. Supervisory power over the planning, supervision, and control of the chapter finances and the use and maintenance of real and personal property of the chapter. 2. Power to investigate, regulate, and control any and all expenditures and disbursements of the chapter funds. 3. Power to approve or disapprove actions of the chapter “D” and to remove any chapter officer by a majority vote. C. ABT Meetings – shall be held once a month at times decided by the members of the ABT. Article IX: Meetings A. Quorum 1. A majority of the student members of the Georgia Southern University Chapter of the Delta Chi Fraternity shall constitute a quorum. 2. Quorum must be met in order to conduct business. 3. A quorum is the minimum number of members required to conduct business at a meeting. Any and all business may be conducted as long as quorum is met, so long as it takes place at a regularly scheduled meetings and or proper notice of 72 hours is given. 4. Once a quorum at a meeting has been established, the continued presence of a quorum is presumed to exist only until the chair or any other member notices that a quorum is no longer present. If the chair notices the absence of a quorum, he or she should declare this fact, at least before taking any vote or stating the question on any new motion. Any member noticing the apparent absence of a quorum can and should make a Point of Order to that effect whenever another person is not speaking. It is dangerous to allow the transaction of substantive business to continue in the absence of a quorum. Although a Point of Order relating to the absence of a quorum is generally not permitted to affect prior action, if there is clear and convincing proof no quorum was present when business was transacted, the presiding officer can rule that business invalid (subject to appeal). B. Order of Business 1. The order of business shall be: a. Call to order b. Roll call c. Reading of previous weeks minutes d. Officer reports e. Committee reports f. Old business g. New business h. Announcements i. Adjournment 2. It shall be the duty of all student members to attend regular chapter meetings. 3. Robert’s Role of Order shall govern in all proceedings of meetings except where there is a conflict with these by-laws or Delta Chi Law. 4. Proxy voting shall be allowed by any voting member. 15 C. Time 1. Regular meetings of the chapter will occur on Sunday of each week while school is in session unless otherwise ordered by a two-thirds (2/3) vote at a regular meeting of the chapter. 2. Meetings shall commence promptly at ____PM and shall last no longer than one hour. Meetings may be extended in length by a two thirds (2/3) affirmative vote of the members of the chapter. 3. Executive meetings will commence promptly one hour prior to the chapter and shall last no longer than one hour. D. Special Meetings 1. The executive committee serves the right to call special meetings in cases of emergency or urgency. Article X: Chapter Finances A. Expenditures 1. No expenditures over and above the items set forth in the budget prepared by the “D”, ratified by the ABT, and adopted by the chapter will be allowed without the approval of the ABT. B. Extensions 1. Any student or associate member who is not in a position to pay an obligation due to the chapter, shall apply for an extension of time in which to make payment to the chapter by making an application to the “D” no later than seven (7) days prior to the date due. C. Arrears 1. Any student or associate member who has not paid an obligation within thirty (30) days after it is due shall be deemed indebted to the chapter and shall be considered in arrears if he has not applied for an extension with the “D”. 2. The chapter shall set in conjunction with the ABT a schedule for collection of fees. All members shall at the beginning of each semester sign a contract agreeing to meet the schedule of fees assigned to them. D. Collection of Delinquent Accounts 1. Suspension of privileges a. If a member is in arrears, defined as any debt older than thirty (30) days to the chapter shall not be allowed to vote in meetings, attend social functions, participate in intramural athletics, take part in ritualistic activities, and eat at or live in the fraternity house. 2. Referral to ABT a. If, after forty-five (45) days, a member still does not pay his bills, his case shall be turned over to the ABT. The ABT shall review the overdue accounts referred to them and take necessary action to collect the bill. 3. Legal Action a. If the bill is delinquent more than sixty (60) days without arrangements made that are approved by the ABT, the chapter shall seek legal action. 4. Expulsion a. The constitution and by-laws of Delta Chi Law provide for and details the procedure for expulsion of a member of the fraternity. Indebtedness to the 16 chapter or to Delta Chi constitutes unworthy conduct as defined in Article V, Section 3 of the constitution in Delta Chi Law. E. Damages 1. Each member of the chapter shall be responsible for any damage done by himself or his guest(s), to the chapter property and/or property rented by the chapter. He shall be responsible for the replacement, or repair of the property at original cost or his cost, whichever is deemed appropriate. The judicial board, if not mutually agreed upon, shall determine appropriateness. F. Collection Process 1. No membership or associate member dues will be accepted in cash form. Only checks, money orders, or credit card transactions will be accepted by the “D”, who will provide a receipt for said payment to the member. Article XI: Associate Members A. Invitation to Membership 1. Membership will be granted by a three-fourths (3/4) affirmative vote of the student members in good standing with the chapter. 2. All Legacies require a 90% affirmative vote. 3. A bid may be extended at any time within the limits provided by Georgia Southern University or the Delta Chi Fraternity. 4. All associate members shall be given the Associate Member Ceremony of the Delta Chi Fraternity within seventy-two (72) hours of accepting a bid. It is only after this ceremony that a man is considered an Associate Member of the chapter. 5. Include the bid committee B. Termination 1. An affirmative majority vote of the student members of the chapter is required to terminate the membership of an associate member. 2. The Associate Member Counselor or any other member that deems such a vote to be necessary may recommend such a vote. 3. A unanimous vote of the associate member class (excluding the associate member in question) will terminate the membership of that associate member. a. This termination can be overridden by a two thirds majority vote of the chapter C. Requirements 1. A man must have a cumulative GPA of 2.75 on a 4.0 scale to be issued a bid. He must maintain that average to be initiated. A high school GPA of a 3.0 on a 4.0 scale will be sufficient for first semester freshmen. 2. An associate must complete the associate member program to be initiated. D. Prohibition of Hazing 1. No student member or associate member of the Georgia Southern University Chapter shall engage in, observe, or tolerate the hazing of any Associate Member or initiated member at any time. E. Definition of Hazing 1. “Hazing” is any action or situation created whether on or off fraternity or campus premises, which produces mental or physical discomfort, embarrassment, harassment, anxiety, or ridicule, no matter how good the intent or end. 17 a. Georgia State Law 16-5-61 Hazing: I. As used in this code section, the term: i. “Haze” means to subject a student to an activity which endangers or is likely to endanger the physical health of a student, regardless of a student’s willingness to participate in such activity. ii. “School” means any school, college, or university in this state. iii. “School organization” means any club, society, fraternity, sorority, or a group living together which has students as its principal members. iv. “Student” means any person enrolled in a school in this state. II. It shall be unlawful for any person to haze any student in connection with or as condition or precondition of gaining acceptance, membership, office or any other status in a school organization. III. Any person who violates this code section shall be guilty of a misdemeanor of a high and aggravated nature. F. Initiation 1. An associate member must receive a three-fourths (3/4) affirmative vote for the student members of the chapter in order to be initiated. 2. Initiation shall be in accordance with the ritual of the Delta Chi Fraternity. 3. Any attempt to alter the ritual in any way by any member will result in immediate motion for expulsion, if willful intent can be proved. Article XII: Amendments A. Chapter By-laws 1. These by-laws can only be amended by a two-thirds (2/3) affirmative vote of the student members. 2. The member proposing the amendment must be present to take it from the table for consideration. 3. If a motion is not taken from the table at the next regular chapter meeting, it will automatically fail. 4. In order to pass exceptions, these by-laws can be suspended by a two-thirds (2/3) affirmative vote of the student members. B. Written Programs 1. May be amended by a two-thirds (2/3) vote of the committee responsible for the written program or by a majority vote of the chapter. C. Conflict and Adoption 1. These by-laws will in no way conflict with Delta Chi Law. If a conflict arises, Delta Chi Law supersedes these by-laws. 2. These by-laws will be approved by a two-thirds (2/3) vote of the chapter and upon approval will supersede any previous by-laws in use. 18 3. The chapter “B” is responsible for reviewing Delta Chi Law and these by-laws prior to the adoption or amendment to these by-laws to ensure that there are no conflicts. Article XIII: Regulations A. Membership Dues Structure 1. The amount of dues shall be set by the “D” and the executive board, with a majority vote from the chapter 2. Members will be given two options for paying their dues: a. Pay the full amount less five percent (5%) at the beginning of the semester. b. Pay the full amount in four (4) equal installments, each due at the beginning of the first four months of the semester. c. Other payment plans may be set up on an individual basis with the approval of the “D”. d. No payment will be accepted in cash form. (See Article X, Section F) 3. Penalties for late dues. a. The payment for dues will be due by the end of the assigned meeting. Any funds not given to the “D” by this time will be considered delinquent. b. A fifteen-dollar ($15) penalty will be assessed for each week that the payment is late. (Up to thirty (30) days, refer to Article X, Section D) c. The payment of dues will not be “paid in full” until the amount of dues plus any late fees are paid (i.e. If the payment is $100, but is two weeks late, the payment will not be complete until $130 are paid). 4. Senior Dues a. Must be a 5th year senior or older and must have paid Delta Chi membership dues for 7 semesters. Add $50 per semester less than seven, minimum of 5 semesters of full dues paid needed to qualify for senior dues discount. b. Members who qualify for the senior dues structure will pay half of parlor fees and any money required by international headquarters, the Georgia Southern Interfraternity Council, the Georgia Southern Office of Fraternity and Sorority Relations, and social money. B. Associate Member Dues Structure 1. The “D” with the approval of the executive board shall set the amount of the dues. 2. Associate Members will be given two options for paying their dues. a. Pay the full amount less five percent (5%) at the beginning of the semester. b. Pay the full amount in eight (8) equal installments, each due by the end of the Associate Member’s weekly meeting. c. Delivery of Dues I. The associate member treasurer will be in charge of collecting the dues from the associate members at every meeting and delivering the funds to the “D” after the meeting. d. Penalties for Late Dues 19 I. The payment must be delivered to the “D” the night of the meeting, or it will be considered delinquent. II. A fifteen-dollar ($15) penalty will be added to the payment for each week it is late. III. The payment of dues will not be “paid in full” until the amount of dues plus any late fees are paid (i.e. if the payment is $100, but it is two weeks late, the payment will not be complete until $130 are paid) C. Housing Corporation Dues Structure 1. The “D” and the housing chairman, with the approval of the executive board, as well as a majority vote, shall set the amount of dues from the chapter. 2. Members and Associate Members will be given two options for paying their dues. a. Pay the full amount at the beginning of the semester. b. Pay the full amount in two (2) equal installments, one due at the beginning of the semester, the other due four (4) weeks from that date. 3. Penalties for late payment. a. A fifteen-dollar ($15) penalty will be added on for each week the payment is late (up to thirty (30) days, refer to Article X, Section D). b. The payment of dues will not be “paid in full” until the amount of dues plus any late fees are paid (i.e. If the payment is $100, but is two weeks late, the payment will not be complete until $130 are paid). D. Recommended Written AMC Program 1. Week 1 – Associate Members are pinned and receive their cornerstones at the pinning ceremony. The pinning ceremony is to be held within seventy-two (72) hours once the associate members sign their bid cards. The pinning ceremony is held at the fraternity house in the chapter room. At the first meeting they will receive the questions over the first two chapters in the Cornerstone. They will then learn about how a matrix board works and operates. Additionally, they will select their class officers. The associate members are introduced to the “Ten Basic Expectations of a Delta Chi”. Furthermore, they will write down three brothers whom have made a positive impression upon them. One of these brothers will then become their big brother. Dues and financial obligations will be discussed at length. The “D” will attend the meeting to discuss these financial obligations. Personal Record forms will be filled out and there will be a press release in the University newspaper. 2. Week 2 – Associate Members will begin their meeting by reading the Delta Chi preamble. From here on, Associate Members are to run their own meetings. They will take the first test at the beginning of the meeting. Associate Members will then receive the questions that will be on the second test. We will review how the “A” and “B” function in accordance with chapter operations. The current “A” and the “B” will attend the meeting to explain their functions. The current “F” will lecture and discuss the FIPG policy. The meeting will conclude with the singing of the first verse of the Delta Chi Bond Song. Later in the week we will have an alumnus who works in law enforcement come and speak about alcohol and drugs. 3. Week 3 – The meeting will commence with the reciting of the preamble. The “C” and “D” will review their positions and their importance in relation to the 20 fraternity. We will discuss parliamentary procedure and Associate Members will receive their pamphlets. They will take their second test and receive information that will be on the third test. They will take part in “pass the candle”. Once again, the meeting will conclude with the singing of the first and second verses of the Delta Chi Bond Song. 4. Week 4 – The meeting will commence with the reciting of the preamble together. They will take their third test and receive the information that will be covered on the fourth test. We will have a guest speaker on etiquette and dress. The first third of the chapter by-laws will be covered. They will take part in “pass the candle”. Once again, the meeting will conclude with the singing of the first and second verses of the Delta Chi Bond Song. 5. Week 5 – The meeting will commence with the reciting of the preamble together. The associate member class will take the fourth test and receive the information that will be on the fifth test. The “E” will review his position and how he effectively keeps alumni involved. The middle third of the chapter by-laws will be addressed. The first verse in Fovens Matter will be gone over. Furthermore, initiation dues are to be collected. Additionally, we will sing the first and second verses of the Delta Chi Bond Song to close the meeting. Big brothers will take their little brothers out following the meeting. 6. Week 6 – The meeting will commence with the reciting of the preamble together. The Associate Member will take their fifth test and receive the information that will be covered on their sixth test. The “F” reviews his job and the importance of risk management. We will go over the second verse of Fovens Mater. The last portion of the by-laws will be discussed. Associate Members will begin to discuss taking part in a community service project that will involve associates and brothers. 7. Week 7 – The meeting will commence with the reciting of the preamble together. The Associate Member class will take their sixth test. We will have a guest speaker and the recruitment chairman will come and discuss the importance of rush. The Associate Member Counselor (AMC) will hand out the Associate Member Program evaluation. The AMC will make sure the matrix board has been completed. The Associate Member class will develop a chapter yell/cheer/or song. The meeting will conclude by singing the Delta Chi Bond Song and Fovens Mater. 8. Week 8 – The meeting will commence with the reciting of the preamble together. All unfinished business will be addressed. The Associate Members will be given a comprehensive exam. Pass the Candle will be performed and we will close the meetings with the Delta Chi Bond Song and Fovens Mater. Ritual will take place the Saturday of that week. E. Duties of Housing Committee 1. Inspect and enforce cleanliness of personal rooms. 2. Will be in charge of assigning house duties that includes a structured system to ensure all members are participating equally. Duties may include but not limited to, vacuuming, mopping, dusting, taking out the trash, sweeping, cigarette butt disposal, pressure washing, gardening, and minor repairs. 21 3. To bring member(s) to the judicial board for review if a member fails to keep personal rooms, and or public rooms properly clean or did not complete house duties on time. 4. To work closely with the housing corporation and owner of the building and land for repairs, maintenance, and that they are completed in a timely fashion. 5. To be in charge of flag duty and that it is folded and stored properly each day. 6. Keep an accurate file of day-to-day repairs, needs, damages, and work with the housing corporations to follow all safety requirements. F. Damages for missed mandatory meetings 1. Fifteen ($15) U.S. dollars for all mandatory meetings. Further explanation can be found in Article XIII, Section J. 2. All fines that a member has accrued from missing mandatory events will be added to their current semester’s dues unless they have already paid fully. If the member has already paid the current semester’s dues he is required to settle his debt by semester’s end. G. Judicial Review Process 1. For all sanctions and review please look at the Delta Chi Judicial Manual H. Press Releases 1. Shall be in the local and or University newspaper no later than seven (7) days following the event. If possible it shall contain a picture at the function. If it is recognizing an individual or a group of individuals a picture should be incorporated with the release. I. Deadline for active/inactive status 1. Any member wishing to become inactive shall notify the executive board no later than one week prior the deadline of the International Headquarters requesting the list from Georgia Southern University. a. Fall deadline is October 1st and shall be reported a week prior to the deadline. b. Spring deadline is February 15th and shall be reported a week prior to the deadline. 2. Any member requesting to become active must notify the “C” in writing no later than the first meeting of each semester that the executive board meets. The member shall not be financially in debt or for any reason be held from retaining active status. If for any reason the member does not meet all requirements for reinstatement, he shall address the issue and resolve it before being reinstated. a. Exceptions on a case-by-case basis may be reviewed. J. Mandatory Meetings / Events 1. When the executive board or chapter passes a vote that makes an event mandatory, the member must be present. If unable to attend, the member must present a written reason no later than twenty-four (24) hours to the “C”. The “C” then records the reason for not attending in the minutes. The “C” has full discretion on whether the absence is unexcused or excused. If unable to reach the “C”, contact the “A”, and further down the chain of command. If a member has a legitimate reason to contest the decision made by the “C”, he can appeal his case to the judicial board. The member must contact the judicial board and make aware 22 K. L. M. N. of the situation no later than forty-eight (48) hours after the decision was rendered. If the “C” finds that the excuse is not excusable and the brother does not contest the decision made by the “C”, the member must pay a fine of fifteen ($15) U.S. dollars to the Georgia Southern Chapter of Delta Chi for missing the event. The fifteen ($15) U.S. dollars must be paid within thirty (30) days of missing the event. Failure to pay the fine in the allotted time will result in judicial review. 2. Extreme cases will be looked at on a case-by-case basis. 3. Fines for initiation week shall be as follows: a. $50 for an unexcused absence at an initiation week activity b. $75 for an unexcused absence at ritual 4. Fines for other specific chapter events shall be as follows: a. $25 for pin-in ceremony b. $40 for big brother ceremony c. $30 for a philanthropy event 5. Fines for formal recruitment week shall be as follows: a. Any member who has an unexcused absence will be fined $25.00 per day Composite Photos 1. Any member who fails to get their composite photo taken without a proper excuse will be fined $25.00. 2. The chapter will continue to use Fraternal Composites for all Composite photo needs. Chapter Room Selection 1. The rooms selection for living in the fraternity house shall be as follows: “A” gets first chose of room, followed the “D”, the “F”, then finally the house manager. The fifth choice of room goes to the highest ranking officer/chairman not required to live in the house, or the member who has achieved active status for the longest period of time should there be no officers/chairmen who wish to live in the house. The remaining room choices shall go to the next highest ranking officer/chairman not required to live in the house, or the member who has achieved active status for the longest period of time should there be no officers/chairmen who wish to live in the house, until the house is filled to capacity. Dress for brothers during chapter meetings 1. The following dress code should be observed by all members in attendance: Delta Chi lettered T-shirt OR a collared shirt, shorts, khakis, or jeans, and close toed shoes. Attendance at Executive Board Meetings 1. Only executive board members are to attend the executive board meetings. Only after thirty (30) minutes past the hour when the meeting started, non-executive board members can be admitted into the meeting. However, if there is business at hand that carries past the first thirty (30) minutes, the executive board has the right to keep the meeting closed exclusively to them until all matters are concluded at hand. If at any time during the meeting after admitting nonexecutive members the executive board deems that the meeting must conduct further business solely with the executive board, non-executive members must leave without objection Furthermore, if at any time any non-executive board member is not following Roberts Rule of Order or is disrupting the meeting, the 23 “F” has the authority to excuse the member from leaving the meeting without objection from the member. O. Silent Hours 1. Shall be enforced throughout the house between the hours of 12 A.M. and 7 A.M. Sunday through Wednesday. Thursday through Saturday the house shall be quiet and noise contained by 2 A.M. and must stay quiet until 7 A.M. the next morning. If at any time the residents of the house file a complaint about excess noise that occurs during designated times the offender(s) shall be placed under judicial review. P. Study Hours 1. Members having below a 2.75 GPA shall be mandated to perform study hours. The amount of study hours to be performed shall be determined in accordance with the scholarship plan mandated by the scholarship chairman. 2. Study hours will begin the Sunday the member is notified in writing of his academic standing with the fraternity. Study hours must be completed and recorded in the fraternity’s study hour recording folder by 6 P.M. Sunday of each week. The weeks of homecoming and pre-initiation mandated study hours are suspended. 3. If a member fails to complete his study hours he will be granted a one-week grace period to make up the deficient hours as well as the assigned hours. On the Sunday concluding the week of study hour deficiency a study hour deficiency notification form will be issued. It is to be signed and returned that night. 4. If after this week he is still found to be deficient he will be notified. A study hour deficiency final notification will be issued to the member. The member will then have to decide whether to volunteer as a sober driver at the next social event or face the judicial board. He must mark his decision on the study hour deficiency form and submit it to the scholarship chairman within seven (7) days of notification. After the week grace period study hours continue in their assigned amount. 5. If a student member feels he cannot complete study hours in house or need to study in an hours in an outside location, he must complete the off-site study hour form. The form can be obtained from the scholarship chairman and must be returned to him before hours can be completed off-site. The scholarship chairman will file this form. It is then the responsibility of the member to track his study hours for the week and submit them in writing to the scholarship chairman by 6 P.M. on Sunday concluding that week’s hours. Q. Scholarship Administration 1. Each fall and spring semesters two scholarships in the amount of two-hundred ($200) dollars are to be given to two active members that are not indebted to the chapter, not under judicial sanctions, and will be enrolled as a full time student the semester of receiving their scholarship. a. A highest GPA scholarship shall be given to the member who has the highest overall adjusted GPA. b. Most improved GPA scholarship shall be given to the member who has the greatest positive net change in overall adjusted GPA from the previous semester to the current semester. 24 c. In the event there is a tie, the scholarship shall be equally distributed to each winning member. 2. Each fall and spring semesters one scholarship in the amount of two-hundred ($200) dollars are to be given to one associate member that is not indebted to the chapter, not under judicial sanctions, and will be enrolled as a full time student the semester of receiving their scholarship. a. Highest GPA scholarship shall be given to the Associate Member who has the highest overall adjusted GPA. b. In the event that there is a tie, the associate member class shall vote on who will receive the scholarship. c. In the event that there is an associate member class tie, the AMC shall be the determining vote. d. In the event that the associate member class is only one man, he shall receive the scholarship by default. R. Filling the Chapter House 1. It shall become the responsibility of the fall and spring associate member classes to fill the remaining beds in the chapter house should it not be filled by older brothers. They shall live in the house for no less than one full year at which time their duty shall be filled. 2. If the fall and spring associate member classes fail to fill the house, should older brothers not fill it, they will be responsible as a group to cover the rent of the empty rooms. This additional amount will be determined by the housing corporation and the “D” and will be added to their dues. 3. All leases to fill the house must be completed by the end of the fall semester of the previous year S. Attendance Policy 1. Each member shall be allowed only one absence per month from chapter meetings. In the event a member does miss a meeting, he shall contact the “C” no less than 24 hours in advance of the meeting. Decision to excuse the member from the meeting shall be made at the discretion of the “C”. If a member more than one meeting a month, he will not be allowed to participate in the next social or intramural event, and will be assessed a fine of fifteen ($15) dollars per absence. This is to certify that the Georgia Southern University Chapter of the Delta Chi Fraternity, colonized on the campus of Georgia Southern University acknowledges acceptance of these bylaws and Delta Chi Law and certifies its willingness to do so, subject to amendments of this chapter and the Delta Chi Convention.
