BUILDING, NISKU, ALBERTA.
Order and Roll Call
The meeting was called to order at 1:32 p.m., Tuesday, July 5, 2016 by Mayor John Whaley as
Chair with Council Members Glenn Belozer, Rick Smith, John Schonewille, Tanni Doblanko and
Audrey Kelto present. Council Member Clay Stumph was absent due to personal reasons.
Also present were Mr. Duane Coleman, County Manager; Mr. Rick Thomas, General Manager,
Community Services; Ms. Joyce Gavan, Recording Secretary; Mr. Dean Ohnysty, Director of
Parks and Recreation; and Mrs. Brandy Kelly, Communications Coordinator.
Present as well were five other individuals.
Agenda Adoption
Councillor Smith -- that the agenda for the July 5, 2016 Regular County Council

Public Presentation
Mayor Whaley asked if there was anyone in attendance to provide a public presentation, and
there was no one.
Introduction of Duane Coleman. County Manager
Mayor Whaley introduced and welcomed Mr. Duane Coleman, County Manager, to Leduc County
Council.
Request for Sponsorship - North Central Female Elite Hockey
Mr. Dean Ohnysty, Director of Parks and Recreation, provided a staff recommendation with
respect to the request for sponsorship in the amount of $12,478 towards the North Central
Female Elite Hockey Program.

Councillor Belozer -- that Leduc County Council approves funding in the amount of
$1,000 to North Central Female Hockey to support initial program development costs to start a
Female Bantam and Midget program for ages 13-17, and further Leduc County Council invites
representative(s) of North Central Female Elite hockey to provide a presentation during 2017
budget deliberations for any additional request for funding.

Councillor John Schonewille requested to be excused from the following matter due to a potential
conflict relating to assessment as he sits on the Regional Assessment Review Board.

Sundance Estates Tax Assessment and Property Value- Access to Public Beach Areas
Messrs. Russ Paull, Sundance subdivision and Randy Keller, resident at Sundance Estates,
provided a presentation with respect to the loss of pubic beach access at the Summer Village of
Sundance Beach, highlighting the following:

Requesting Leduc County to file an appeal challenge to a bylaw passed in 2013 by the Village
of Sundance Beach which was done with no notice to adjacent landowners within Sundance
Estates.
The bylaw lowered the value of all properties located within Sundance Estates which total 35
separate titles by _±$50,000- _±$60,000 each.
There were 12 separate areas designated as public beach access within Sundance Beach.
There were six residents who shared the public beach area in front of Lots 8 and 10 Block;
twelve with the residents of the Village of Sundance Beach where trees were removed and the
bank of the lake front modified which allowed the other 9 residents of Sundance Estates to
make use of the 60' Pine Road allowance and the public beach in front of Lots 9 and 11 ,
Block 11. That seemed to work as there was no congestion on the water with a large number
of boats and people and we shared responsibility to maintain the beach access area.
The bylaw has forced all 15 residents in Keeley Place to now use the remaining 60' Pine road
allowance which the Village of Sundance Beach could not privatize.
This has been a challenge as the Village residents have encroached on both the beach
access and road allowance going to the lake.
Recently the Village has placed boulders and stakes on Leduc County property to further
reduce our access to the land front. This was brought before the Leduc County Councillor in
2013.
Respectively request the County to take necessary steps to have the 2013 bylaw by the
Summer Village of Sundance Beach revoked that removed the public beach access.
Also request the County to formally locate and mark the boundary line between the County
and Village of Sundance Beach and advise the Village to remove boulders and stakes that
restrict access to the lake via the one road allowance remaining.
The Village is taking the right away from the residents within the Village and all Albertans,
access to these specific portions of Pigeon Lake.
This issue has been ongoing since 1991.
Have attempted to negotiate with the Summer Village of Sundance Beach office however,
have been told the bylaw is passed and nothing will be done.
The Minister of Municipal Affairs has been contacted as well however no action was taken.

Councillor Belozer -- that Leduc County Council receives as information the
presentation provided by Russ Paull and Randy Keller; and further directs administration to
conduct research and provide a report back to Council with respect to the right of way, access to
the lake and Alberta Environment's jurisdiction on Pigeon Lake.

Report New Sarepta Water Rates Review
Mrs. Renee Klimosko, Director of Finance, provided a staff report with respect to the New Sarepta
Water Rates Review.

Planner, entered the Council Chamber at 2:10p.m.

Councillor Smith -- that Leduc County Council receives as information the report
regarding the proposed amendment to the 2016 New Sarepta Water Utility rate of $4.65, effective
August 1, 2016 with the following process to be completed:

Council approves the use of the reserve "Hwy 21 /New Sarepta ASP" of $1 05,000 to pay
off the internal borrowing debt of the New Sarepta Water and Sewer Utilities in the amount
of $88,015 (Water Utility $50,788 and Sewer Utility $37 ,227); and
the remaining balance of $16,985 in the reserve after the above transfer will be used to
offset the 2015 deficit incurred in the Sewer- Lagoons Utility in the amount of $16,678;
the remaining $307 will go into the "Water Fund - New Sarepta Rate Stabilization
reserve".

Councillor Schonewille -- that Leduc County Council approves, in principle, an equal

cost sharing with the Black Gold Regional Schools for the purchase and installation of an
emergency generator for the County Centre to be included in the 2017 Capital budget.

Mrs. Charlene Haverland, Senior Planner, reviewed the agricultural small holdings policy within
the Municipal Development Plan impacting subdivision of agricultural lots.

provided on agricultural small holdings within the Municipal Development Plan, and further
administration provide Council with a more descriptive policy for consideration at a future Council
Workshop.
