Driver's License Format, Issuance, and Renewal
License Classes, Restrictions, and Endorsements Appear After the Driving Record Content Section
License Format
The format is eight numbers, beginning with 0, 1, 2, 3, or 4. (Use of the
number 4 started in late 2015) License numbers are sequential and
computer-generated.
Document Appearance
The current driver licenses and identification cards, redesigned with
new and enhanced security features, were put into production April 15,
2009. The prior driver licenses and ID cards are still valid and will be
phased out as they expire. An abbreviated description of the new
documents is shown below.
Editor’s Note: Although the web page indicates that DPS has
submitted a plan to the U.S. Department of Homeland Security (DHS)
that keeps Texas compliant with REAL ID laws, there is no mention of
issuance of these new document.
Current Documents
License has digital photo with state capitol in light blue on right side on
a beige background, with TEXAS at the top left side in blues
Security Characteristics: At this time, the agency has deferred from
describing the security features.
Position of Photo: Photo is located on the left side.
Minor Age Driver Locator: This driver license is presented

Security Characteristics: Security laminate has TEXAS printed in

green under ultraviolet light. There is a bar code, magnetic strip and
endorsement/restriction codes printed on back.
Position of Photo: Photo is located on the right side; the DPS audit
number appears along the side of the photo and the director's
signature falls halfway on the beige background on the top of the
photo.
Minor Age Driver Locator: Vertical format license with forward
facing photo at bottom right. For ages 18-21, “under 21 driver
license” is printed in red across the top; if CDL, “under 21
commercial DL” is brown. Also, “under 21 until (MMDDYY)”
appears in red on first detail line of license. For ages 16-18,
“provisional driver license” is printed in purple across the top.
CDL Indicator: COMMERCIAL DRIVER LICENSE appears in
brown in the header line. “CDL” appears in text next to the eightdigit license number.
Issuance
Residency Requirements
To be eligible for a Texas driver license or identification card, the
applicant must be a resident of or domiciled in Texas. New residents
must secure a Texas license 90 days after entry into the state and
surrender any driver license from the prior state of residence.

Age Requirements
The minimum age for a Regular License is 18; 16 with completion of
approved driver education course. Texas has a graduated license
program. A Learner License can be issued at 15 upon the completion of
at least 6 hours of classroom instruction of driver education; and must
be accompanied by licensed driver age 21 or over. The restriction "B"
(for an accompanying licensed driver) will not be removed until an
individual reaches the age of 16, has held a Learner License at least 6
months and completes the behind the wheel instruction of driver
education and has passed a driving test, or has applied for a MRDL
(Minor's Restricted Driver License), or has turned 18 years of age and
has passed a driving test. If over the age of 18, driver may remove the
"B" restriction once the road test is passed. If between ages 18 and 24,
driver must complete an adult driver education course.
A Provisional License may be issued at 16: must have held a Learner
License at least 6 months and completed behind-the-wheel instruction
of Driver's Ed. During GDL Phase II, the minor is restricted until their
18th birthday to:
1) No more than one non-family member passenger under 21.
2) No driving after midnight and before 5am unless driving is
necessary for employment, school or school related activity or
medical emergency. When an individual is accompanied by a
licensed operator age 21 or over in the front seat, the driver is not
limited to the hours of operation or number of passengers.
3) No operating vehicle when using a wireless communication device,
including cell phones.
A Learner License is issued to a person, under the age of 18 and valid
until the person’s 18th birthday. A Hardship License can be issued at 15
until 18, under necessary conditions.
Renewal
There are four ways to renew a driver license or ID card: online, by
phone, by mail or in person. Individuals must renew in person every
other time to update their picture.
Since 01/01/02, all renewals, with the exception of commercial driver
licenses and limited term licenses, are issued for 6 years. Commercial
licenses are issued for 5 years, and limited term licenses are issued for
the length of lawful presence up to 6 years. Driver keeps same number
when renewing. All drivers who renew in person, regardless of age,
must take and pass a vision exam. Non-CDL renewal and address
changes are available online at www.texas.gov. Non-CDL renewal is
available by phone at 866-357-3639. Address changes are not available
by phone.
Military personnel may renew their expired TX licenses by mail. Upon
renewal, military personnel may be assigned a new driver license
number. Although licenses carried by military personnel are legally
valid, they may be purged if not renewed within two years of expiration.
Elderly-Related Restrictions
Since September 1, 2007, state law requires drivers age 79 or older to
visit a driver license office in person and prohibits renewing a driver
license by alternative means such as by mail or through online services.
Additionally, drivers age 85 or older receive a two-year renewal instead
of the standard 6-year renewal.

Registration Renewal
Passenger Plate Descriptions
Renewal is set on a 12-month basis and can be done in person, by mail,
or online (http://txdmv.gov/motorists/register-your-vehicle?tab=how-toregister). Vehicles must first pass an inspection. Counties and cities
have the ability to enforce a program to block registration to those who
have not paid municipal traffic fines; county fees, fines, or taxes; or toll
fees.
Two plates and one windshield decal are issued. Vehicles with no
windshield (trailers, motorcycles, etc.) have one plate with one decal
showing MO/YR of expiration. In July 2012, Texas began issuing a
new license plate called The Texas Classic with a seven digit format.
Older general issue plates with six and seven digit patterns are still in
use, but will be replaced when the plate’s age reaches seven years.
Texas has no coding on license plates signifying the county of issuance.
Owners of vehicles sold in private sales are encouraged, but not
required, to remove the license plates from the vehicle. Dealers must
remove the license plates from passenger cars and light trucks. Seller
may transfer plates to another vehicle. Specialty license plates remain
with the owner.
New Residents
New residents must title and register their vehicle(s) within 30 days of
establishing residency (www.txdmv.gov/motorists/new-to-texas).
Inspections and Emissions Testing
Most Texas registered vehicles are required to receive an annual
inspection administered by the TX Department of Public Safety (DPS).

Some vehicles are required to have an emissions test in addition to the
safety inspection, if registered in one of the 17 designated counties
listed below, and are between 2 and 24 years old, or upon expiration of
the two-year initial inspection. Diesel powered vehicles and
motorcycles are exempt from the emissions standards, but are still
required to have the annual safety inspection.
Designated emissions testing counties are: Brazoria, Collin, Dallas,
Denton, El Paso, Ellis, Fort Bend, Galveston, Harris, Johnson,
Kaufman, Montgomery, Parker, Rockwall, Tarrant, Travis, and
Williamson.
Insurance and Financial Responsibility
Texas has compulsory liability insurance, but does not have a no-fault
insurance provision. Minimum financial responsibility limits are
$30,000/$60,000/$25,000. Proof of insurance is required at the time of
vehicle registration, vehicle inspection, original driver license issuance,
or upon request by a law enforcement officer. There are penalties for
breaking the state’s financial responsibility law. The first conviction
results in a fine between $175 and $350. Additional convictions could
result in fines of $350 to $1,000, driver license suspension, and vehicle
impoundment.
Withdrawal Sanctions, and Alcohol and Drug Testing
Alcohol and Chemical Testing
Texas' illegal intoxication level is .08 percent for 21 years and older for Class C licensees, .04 for CDL drivers, and any detectable amount for persons
under 21 years of age. Blood and breath testing are authorized; urine testing is authorized only for CDLs. Texas has an implied-consent law provision.

A driver issued a speeding ticket and found guilty of driving at a speed of 95 MPH or higher or 25 MPH over the posted speed limit is prohibited
from taking a driving safety class to dismiss the ticket. CDL holders are prohibited from taking a driver safety course to dismiss any ticket.
Non-ALR suspension or revocation of driving privileges is automatic unless an administrative hearing (when authorized by law) is requested. The
suspension period is 90 days or, in certain circumstances, an indefinite revocation is imposed.
The Following
An Administrative Hearing may be requested within 20 days from the date notice is received. The outcome can be suspension of the license for up
to one year, probation up to two years, or revocation of the license for an indefinite period, or dismissal of the hearing. A hearing may be held for
any of the following reasons.
• Commission of Offense in Another State, which would be grounds for Suspension/Revocation in TX

Restriction Violations
Driver Responsibility Program (DRP) and Point System
The Driver Responsibility Program authorizes the DPS to assess
surcharges to an individual based on certain traffic offenses that have
occurred on or after September 1, 2003. Individuals are notified by
mail each time a surcharge is added to their driver record. Surcharges
are in addition to other fees and do not replace a suspension,
revocation, denial, disqualification or cancellation resulting from the
same conviction.
Point Assessment
Points are issued as part of DRP. Traffic offenses resulting in points
are designated by Title 37 Texas Administrative Code Rule 15.89.
Points are assessed to moving violations classified as Class C
misdemeanors. Points are assigned as follows:
•
Two points for a moving violation conviction in Texas or that of
another state.
•
Three points for a moving violation conviction in Texas or
another state that resulted in a crash.
DPS assesses a surcharge when the driver accumulates a total of six
(6) points or more on their driver history during a three-year period.
The driver must pay a $100 surcharge for the first six points and $25
for each additional point.
Annual Assessment
The surcharge assessment will be reviewed annually. If the driver
history continues to reflect six or more points during the prior threeyear period, the surcharge will be assessed. Therefore, drivers may be
required to pay for one or more years if six or more points continue
to accumulate on the driver record. Point surcharges are cumulative
and may vary with each annual assessment if convictions are added or
removed from the driver history. Failure to pay surcharges results in an
indefinite suspension.
Conviction Based Surcharges
Drivers who receive a conviction for an offense listed below pay an
annual surcharge for a period of three (3) years from date of
conviction. No points are assessed for these offenses. Once the
conviction is reported to DPS, the following surcharges are assessed:

The surcharges are cumulative; example, an initial conviction for DWI
will be assessed $1000 annually, and a subsequent DWI conviction
within the same three-year period will be assessed an additional $1500
annually.
DPS offers an Indigency Program that reduces surcharges owed for
some individuals with incomes at or below 125 percent of the federal
poverty guidelines.
DPS offers an Incentive Program that reduces surcharges owed for
some individuals with incomes above 125 percent and below 300
percent of the federal poverty guidelines.

Deferred Adjudication - Defensive Driving Course
No points will be assessed or surcharges applied if the conviction is
deferred, or a DDC course is taken. Only non-CDL drivers may be
granted deferred adjudication, and/or take a defensive driving course
(DDC) for any points-based citation and No-DL citations.
No-Insurance and DWLI offense are eligible for deferred adjudication.
Intoxication offenses are NOT eligible for deferral.
Reinstatement Requirements
The renewal/issuance of a Texas license will be denied until the reinstatement fee is paid.

Per Texas Transportation Code Ch. 730, the state adopted the provisions
of Driver’s Privacy Protection Act (DPPA). Also governing the release
of records is Transportation Code 521.052.
The Texas Transportation Code Ch. 730.007 states as follows:
“Sec. 730.007. PERMITTED DISCLOSURES.
(a) Personal information obtained by an agency in connection with a
motor vehicle record may be disclosed to any requestor by an agency if
the requestor:
(1) provides the requestor's name and address and any proof of that
information required by the agency; and
(2) represents that the use of the personal information will be strictly
limited to:
(A) use by:
(i) a government agency, including any court or law enforcement
agency, in carrying out its functions; or

(ii) a private person or entity acting on behalf of a government
agency in carrying out the functions of the agency;
(B) use in connection with a matter of:
(i) motor vehicle or motor vehicle operator safety;
(ii) motor vehicle theft;
(iii) motor vehicle product alterations, recalls, or advisories;
(iv) performance monitoring of motor vehicles, motor vehicle parts,
or motor vehicle dealers;
(v) motor vehicle market research activities, including survey
research; or
(vi) removal of non-owner records from the original owner records
of motor vehicle manufacturers;
(C) use in the normal course of business by a legitimate business or an
authorized agent of the business, but only:
(i) to verify the accuracy of personal information submitted by the
individual to the business or the agent of the business; and
(ii) if the information is not correct, to obtain the correct
information, for the sole purpose of preventing fraud by, pursuing a
legal remedy against, or recovering on a debt or security interest
against the individual;
(D) use in conjunction with a civil, criminal, administrative, or arbitral
proceeding in any court or government agency or before any selfregulatory body, including service of process, investigation in
anticipation of litigation, execution or enforcement of a judgment or
order, or under an order of any court;
(E) use in research or in producing statistical reports, but only if the
personal information is not published, redisclosed, or used to contact
any individual;
(F) use by an insurer or insurance support organization, or by a selfinsured entity, or an authorized agent of the entity, in connection with
claims investigation activities, antifraud activities, rating, or
underwriting;
(G) use in providing notice to an owner of a towed or impounded
vehicle;
(H) use by a licensed private investigator agency or licensed security
service for a purpose permitted under this section;
(I) use by an employer or an agent or insurer of the employer to obtain
or verify information relating to a holder of a commercial driver's
license that is required under 49 U.S.C. Chapter 313;
(J) use in connection with the operation of a private toll transportation
facility;
(K) use by a consumer reporting agency, as defined by the Fair Credit
Reporting Act (15 U.S.C. Section 1681 et seq.), for a purpose
permitted under that Act; or
(L) use for any other purpose specifically authorized by law that
relates to the operation of a motor vehicle or to public safety.
(b) The only personal information an agency may release under this
section is the individual's:
(1) name and address;
(2) date of birth; and
(3) driver's license number.
(c) This section does not:
(1) prohibit the disclosure of a person's photographic image to:
(A) a law enforcement agency, the Texas Department of Motor
Vehicles, a county tax assessor-collector, or a criminal justice
agency for an official purpose;
(B) an agency of this state investigating an alleged violation of a state
or federal law relating to the obtaining, selling, or purchasing of a
benefit authorized by Chapter 31 or 33, Human Resources Code; or
(C) an agency of this state investigating an alleged violation of a state
or federal law under authority provided by Title 4, Labor Code; or
(2) prevent a court from compelling by subpoena the production of a
person's photographic image.
(d) Personal information obtained by an agency in connection with a
motor vehicle record shall be disclosed to a requestor by an agency if
the requestor:

(1) provides the requestor's name and address and any proof of that
information required by the agency; and
(2) represents that the intent of the requestor is to use personal
information in the motor vehicle record only for the purpose of
preventing, detecting, or protecting against personal identity theft or
other acts of fraud and provides any proof of the requestor's intent
required by the agency.
(e) If the agency determines that the requestor intends to use personal
information requested under Subsection (d) only for the represented
purpose, the agency shall release to the requestor any requested
personal information in the motor vehicle record.
(f) Personal information obtained by an agency under Section 411.0845,
Government Code, in connection with a motor vehicle record may be
disclosed as provided by that section.
Consent Forms
Driver Records: Use of Form DR-1 is required for a copy of a driving
record, or DR-36 for a copy of a certified abstract driver record. See
www.dps.texas.gov/internetforms for the forms. The signature of
requester is required but does not need to be notarized. Type 1, 2 and 2A
driver records are available to anyone with DR-1 Form (or DR-36 for
certified abstract) who qualifies per one of the exceptions allowed in
TRC Chapter 730. Casual requesters can obtain records with personal
information with a DR-1 Form (or DR-36 for a certified abstract) that
contains a written authorization signed by the subject, as found on the
form. A notary is not required. With this is a one-time release, Type 3
and 3A driver records are provided with the customer’s consent.
Vehicle Records: Use of Form VTR-275, Request for Texas Motor
Vehicle Information, is required to access vehicle records. The form
must be signed by the requestor to certify the information will be used in
compliance with state and federal laws for a “lawful and legitimate
purpose.” Requestor must furnish a government issued photo ID (driver
license, passport, etc.). If the requestor has permission from the subject
(i.e. previous owner, owner, or lien holder), submit Form VTR-275 with
a current copy of requestor’s government issued photo ID and written
authorization from the subject using Form VTR-386, Authorization for
Release of Personal Information. Submit Form VTR-386 with the
subject’s signature and government issued photo ID number. All

Vendor and Third Party Access Policy
Driver Records: Approved vendors can access records for another
vendor who will then sell to an end-user, as long as all vendors meet the
privacy exceptions. The state suggests that all vendor chain implement
an agreement specifying that each vendor meets a qualified exception
(DPPA permissible use).
Vehicle Records: Permissible users can purchase in bulk or database
format. They can then resell to another permissible user or another
vendor selling to a permissible user. However, the motor vehicle record
information obtained for a permitted use may not be sold or disclosed
unless the information is used only for the permitted use. The vendor
shall maintain, for a period of not less than five years, records as to any
person or entity receiving the information and the permitted use for
which the information was obtained. The purchaser must also provide a
copy of those vehicle records to the department upon request (reference
Transportation Code Title 7, Subtitle J, Chapter 730).
Records Ordered For Non-permissible Uses
Certain limited types of records, such as a driver license status or motor
carrier compliance or complaint history, are released to the public.
Otherwise, specific driver or vehicle records are not released, even
records without personal information, unless there is consent or the
requested use is per one of the listed permissible uses and the stated
procedures are followed (reference Transportation Code Title 7, Subtitle
J, Chapter 730).

Driver Record Types and Fees
The following types of records can be requested either online at
www.dps.texas.gov or by mail:
• License Status Record (Type 1): name, date of birth (DOB),
license status, and latest address. ($4.00, $4.50 if online)
• 3-year History Record (Type 2): name, DOB, license status, list of
crashes where a citation has been issued and violations within the
immediate past 3-year period. ($6.00, $6.50 if online)
• Certified 3-year History Record (Type 2A): certified version of
Type 2. This record is not acceptable for Defensive Driving Course
(DDC). ($10.00, $12.00 if online)
• List of all Crashes and Violations in Record (Type 3): name,
DOB, license status, includes all crashes and violations in record.
($7.00, $7.50 if online). When ordered manually this record is only
furnished to the license holder; however it can be it is furnished to
others but only if written consent if given.
o Note this Type 3 is available electronically to approved
entities with permissible use and does include CDL
Medical Cert. information.
• Certified List of All Crashes and Violations in Record (Type
3A): certified version of Type 3. This record is acceptable for
Defensive Driving Course (DDC). ($10.00, $12.00 if online) This
record when ordered manually is only furnished to the license
holder or to others only if written consent if given. Type 3A is
available electronically to approved entities with permissible use.
• Certified Abstract of Driver Record (Type 4 "AR"): Certified
text abstract of complete driving record of a license holder.

The complete Type 3 records follow the purging criteria shown later in
this section. There is no record offered that shows just CDL or CMV
violations.
In-Person – The Driver License Division does not offer counter
service for driving record requesters.
Mail – Mail to DPS, Attn: L.R.S. PO Box 149008, Austin TX787149008. Requests mailed to the state are processed within fourteen to
twenty-one days. The driver license number and name, or name and date
of birth are needed when ordering, and use of Form DR-1 or DR-36 is
required. The form can be downloaded from the Internet site. The fee
must accompany each request.
Electronic – A commercial service is available to ongoing requesters
and companies who have permissible use and have signed contracts with
DPS. Access is by both interactive and batch methods. Call 512-4245967 to receive a copy of the license agreement. Various record types
are available as described above. An online service is also offered to
eligible license holders; see By Person of Record below.
Bulk – The entire driver license file is available to permissible users.
Output on a DVD, including names, addresses, and DOBs of all
licenses, is sold for a fee of $2,000. Weekly updates may be purchased
for $75.00. Driver history is not included.
By Person of Record – Eligible TX Driver License holders may
purchase their own driver record by mail or online.

The online record must be printed when viewed; a copy will not be
mailed. Online eligibility is determined by the system at log-in – see the
frequently asked questions for information on the requirements. Upon
verification of this data, the licensee may select from the six different
types of records. Drivers must submit DL or ID number, DOB, last 4
digits of SSN and most currently issued DPS Audit number (appears on
the DL card).
Notification/Monitoring Program
The Department continues to progress toward implementation of the
Driver Record Monitoring pilot as directed by the state legislature. The
Department selected three vendors for participation in the pilot program.
With recent completion of several efforts, pilot planning and testing is
underway with intent to begin monitoring in May 2017. Upon successful
completion of the pilot, the Department may proceed with full
implementation of the program where it would contract with eligible
entities to provide driver record monitoring services.
Crash Reports
Reporting – Crashes involving death, injury, or property damage in
excess of $1,000 or more to one person's property must be reported
immediately to the local authorities. If the crash is not investigated by the
police, a written report (Form CRB-2, Driver's Crash Report) must be
filed by the involved drivers within ten days with the Texas DOT, Crash
Data and Analysis, PO Box 149349, Austin TX 78714.
Due to TxDOT’s 10-year retention policy for crash reports, and changes
to the form, there are three possible groups of forms that can be used:
1. Crashed occurring after 01/01/2017
2. Crashes occurring between 01/01.2015 and 12/31/2016
3. Crashes occurring between 01/01/2010 and 12/31/2014

The Traffic Operations Division of the Texas Department of
Transportation has the responsibility of maintaining crash records.
Access to records is by mail or online. For either method, the fees are
$6.00 per record, $8.00 if certified. Records are available for 5 years to
present, first available 10 days after the event. Information needed must
include two of the following: the date, specific location including city
and county, and full name of one party involved.
By Mail: Either the CR-3 (copy of the peace officer's crash report) or
CR-2 (copy of driver's crash report) can be ordered. The request forms
are available at the web page. Normal turnaround time is 20 days, but
can take as long as 4 weeks. Written requests should be mailed to the
address above. Also, the Texas Peace Officer's Crash Report (CR-3) Code Sheet is available for download at www.txdot.gov/insidetxdot/division/traffic/law-enforcement/crash-reports.html.
Online: The agency provides a Crash Report Online Purchase System
designed request and purchase a copy of the Texas Peace Officer's Crash
Report (CR-3) filed with TxDOT. There is no fee to verify the existence
of a record. See https://cris.dot.state.tx.us/public/Purchase/. The same
fees ($6.00 uncertified or $8.00 certified) are charged to download the
report. Credit cards are accepted. There are helpful Crash Code Sheets at

General Information
Vehicle Titles and Registration Division, Texas Dept. of Motor

Records remain in the active files until the record has no activity for 18
months. After 48 months of inactivity records are archived. Title history
information is available either on microfilm or digital imaging for 10
years.
The fee for VIN and plate checks is $2.30, $3.30 if certified. A title
history is $5.75, if certified then $6.75.
In-Person & Mail – Research by license plate number or vehicle
identification number (VIN) is available at 16 TxDMV Regional
Service Centers. Title histories and registration information are only
provided to requestors who certify the information requested is for a
permitted use. Use of Form VTR-275, Request for Texas Motor Vehicle
Information, is required and must be submitted with current photo
identification containing a unique identification number. Permissible
identification includes:
• Driver license or state identification card issued by a state or
territory of the United States,
• United States or foreign passport,
• United States military identification card, or
• United States Department of Homeland Security or United States
Citizenship and Immigration Services identification document.
Electronic – There are several electronic access systems available.
1) The Production Data Support Branch offers a web inquiry system
(MVInet) for immediate VIN and plate searches. Access requires a
written service agreement, $200.00 escrow deposit, $23.00 monthly fee,
and $0.12 fee per inquiry. Searches or queries based on a name or
address are not available. There are approximately 2,400 companies
with over 16,000 users on the system, including car dealers, insurance
companies, record-retrieval firms, and investigative companies. The
use of personal information by approved requestors is strictly limited to
only those entities as listed previously in the Governing Statutes and

3) Title Check provides access to the National Motor Vehicle Title
Information System (NMVTIS), a national consumer protection
database that provides title information from states across the country.
With a VIN, any user can obtain a report from the NMVTIS database
that provides the vehicle’s title history, which includes whether the
vehicle has any value limiting brands, was ever in the possession of a
junk or salvage yard, or was declared a “total loss” by an insurance
company.

4) TexasSure is a vehicle insurance verification system that uses a
database to match vehicle registration information (such as the VIN,
owner name and address, and make, model, and year) to insurance
policy information (such as insured drivers name(s), address, insurance
company name, and policy effective dates). Access is only available to
authorized users, such as law enforcement, county tax assessorcollectors, the TxDMV, the Department of Insurance, the Department of
Information Resources, and the Office of the Attorney General, per the

Subscriptions – The TxDMV provides subscriptions to the Weekly
Dealer Supplemental Files and to the eTag (Buyer’s Tag) files.
(1) The Weekly Dealer Supplemental Files contain dealer weekly sales
transactions including dealer “P” number, document number, and VIN.
The dealer name and address by dealer “P” number is provided in a
second file. The latest 104 Weekly Dealer Supplemental Files are
available. The processing charge/fee is $95.00 per week with a 12week minimum purchase (Example: $95.00 X 12=$1,140). For more
information, the customer should contact the TxDMV Information
Technology Services (ITS) Division at [email protected].
(2) The eTag files contain one record for each eTag created on a given
day. Each record includes the Create Date (date and time stamp when
the tag was created), Tag Effective Date (the sale date reported by the
dealer), Tag Type (indicates the vehicle has been sold), VIN (represents
the vehicle being reported as sold; this field can be blank-NULL-for
some tags) and the Dealer License Number issued by the Motor Vehicle
Division (this field can be blank-NULL-for some tags). The processing
charge/fee is $9.00 per day with a 365-day minimum purchase
(Example: $9.00 X 365=$3,285). Contact the TxDMV at (512) 4654048 for more information.
Bulk – The TxDMV Production Data Support Branch offers CD and
FTP retrieval of VIN and plate numbers (but not by name) to eligible
organizations under signed contract. Fees are based on the cost of a
"computer run" and a fee per record. (The entire vehicle database can
be purchased for $5,000.00 plus $0.38 per 1,000 records written.
Weekly updates are available for $135.00 per week with a $1,755.00
deposit.). Strict control is in place to assure that requesters abide by the
DPPA provisions as defined in Texas Transportation Code, Ch.

Access to Vessel-Related Records

Boats, boat motors and personal watercraft are titled and registered with
the Texas Parks and Wildlife Department: all motorized boats must be
registered and titled; all sail boats 14 ft and over must be registered and
titled.
Boat and outboard motor ownership information is, by law, public
information and TPWD retains historical boat/outboard motor
documentation for a period of 10 years. Two types of records commonly
requested: for current data including lien holders there is no fee, a
complete ownership history is $11.00. Use of Form PWD 763 is
strongly advised. The form, downloadable from web, requires the
signature of the requester and attests that the use of the data is for legal
purposes. The signature of the subject is not required. Record checks can
be processed by any TPWD Law Enforcement Field Office or at a
participating County Tax Assessor-Collector office, as well as the office
listed above. If the form is not used, the name and/or registration
number is required and request must contain the following phrase in the
request: “The information obtained will be used for a lawful purpose.”
Turnaround time is 2 days, can be longer in the summer months.
Online access to current owner/lienholder names, addresses, and vessel
or outboard motor description is available to view as long the user
provides a valid TX number or serial number. Data is updated daily.

• Moving violations appear on a Type 2 driver record for the past 3
years only.
• All moving and non-moving violations appear on a Type 3 driver
record for a period of 15 years with the exception of serious
offenses.
• All crashes that are investigated by a police officer are recorded on
the individual’s driver record. The driver record does not indicate
fault on the part of the individual but shows the date and location of
crash.
In general, the length of time convictions MAY be retained on the
driving record is:

CDL Medical Cert Data
Information regarding a CDL driver’s medical certification appears on
Type2 or Type 2A and on Type 3 on Types 3A records when ordered
manually or electronically.
Data Retention
Records of licenses are permanent records.
Court to Repository
Since January 1, 2013, courts must submit convictions using a secure
web-based process to protect Personal Private Information (PPI).
Convictions must be reported within seven days and are placed on the
record in a timely manner.
Any necessary information omitted from the convictions will have to be
obtained from the issuing court. The court information can be found on
the ticket/citation/report and www.courts.state.tx.us/oca/. For questions

Codes for License Classes, Restrictions, and Endorsements
License Classes– Commercial
Texas began issuing the CDL in September of 1990.
The holder of a valid commercial driver license may drive all vehicles in the class in which he/she is licensed and all lesser classes of vehicles
(except for motorcycles and mopeds).
Class A
Any combination of vehicles with a GCWR of 26,001 pounds or more—providing the GVWR of the vehicle or vehicles being towed
exceeds 10,000 pounds.
Class B
Any single vehicle with a GVWR of 26,000 pounds or more, any one of those vehicles towing a vehicle that does not exceed 10,000
pounds GVWR, and any vehicle designed to transport twenty-four passengers or more (including the driver).
Class C
Any single vehicle or combination that is not a Class A or B if either vehicle is:
a Designed to transport sixteen to twenty-three passengers, (including the driver); or
b Used in the transportation of hazardous materials that require the vehicle to be placarded under 49 C.F.R. Part 172, Subpart F.
Note: Persons operating motorcycles which carry hazardous materials requiring a placard must hold a Class M license in conjunction with a Class
A, B, or C - CDL license.
License Classes– Non-Commercial
The holder of a valid non-CDL may drive all vehicles in the class in which he/she is licensed and all lesser classes of vehicles except for
motorcycles and mopeds. A driver may not operate a CMV with a non-CDL license unless they are specifically exempt from the CDL Act.
Class A
Any vehicle or combination of vehicles with a GCWR of 26,001 pounds or more—provided that the GVWR of the vehicle(s) being
towed is in excess of 10,000 pounds.
Class B
A single vehicle with a GVWR of 26,001 pounds or more, and any such vehicle towing either a vehicle with a GVWR that does not

or after September 1, 2003. Surcharges are in addition to other fees and do not replace a suspension, revocation, denial, disqualification or
cancellation resulting from the same conviction.
Point Assessment
Points are issued as part of DRP. Traffic offenses resulting in points are designated by Title 37 Texas Administrative Code Rule 15.89. Points are
assessed to moving violations classified as Class C misdemeanors. Points are assigned as follows:
•
Two points for a moving violation conviction in Texas or that of another state.
•
Three points for a moving violation conviction in Texas or another state that resulted in a crash.
DPS assesses a surcharge when the driver accumulates a total of six (6) points or more on their driver history during a three-year period. The driver
must pay a $100 surcharge for the first six points and $25 for each additional point.
Annual Assessment
The surcharge assessment will be reviewed annually. If the driver history continues to reflect six or more points during the prior three-year period,
the surcharge will be assessed. Therefore, drivers may be required to pay for one or more years if six or more points continue to accumulate on
the driver record. Point surcharges are cumulative and may vary with each annual assessment if convictions are added or removed from the driver
history. Failure to pay surcharges results in an indefinite suspension.
