AIR NAVIGATION ACT.
Act No. 9, 1938.
An Act to provide for the application of the
Commonwealth Air Navigation Regulations
to and in relation to air navigation with­
in the State of New South Wales; to
amend the State Transport (Co-ordination)
Act, 1931, in certain respects; and for
purposes connected therewith. [Assented to,
6th October, 1938.]
W
H E R E A S a t a conference of r e p r e s e n t a t i v e s of t h e
G o v e r n m e n t s of t h e Commonwealth a n d of t h e
S t a t e s held in A p r i l , one t h o u s a n d nine h u n d r e d a n d
thirty-seven, it w a s resolved t h a t t h e r e should be u n i f o r m
r u l e s t h r o u g h o u t the C o m m o n w e a l t h a p p l y i n g to a i r
n a v i g a t i o n a n d aircraft, the licensing a n d competence of
pilots, a i r traffic rules, a n d the r e g u l a t i o n of a e r o d r o m e s ,
a n d it w a s a g r e e d t h a t legislation should be introduced
in the P a r l i a m e n t of each S t a t e to m a k e provision f o r
the application of the Commonwealth A i r N a v i g a t i o n
R e g u l a t i o n s , as in force from time to time, to a i r n a v i g a ­
tion a n d a i r c r a f t within the j u r i s d i c t i o n of the S t a t e : B e
it t h e r e f o r e enacted b y the K i n g ' s Most Excellent
Majesty, by a n d with the advice a n d consent of the Legis­
lative Council a n d Legislative Assembly of New S o u t h
W a l e s in P a r l i a m e n t assembled, a n d by the a u t h o r i t y of
the same as follows :—
1 . T h i s A c t may be cited as the " A i r N a v i g a t i o n Act,
1938."
2 . T h i s Act shall commence u p o n a d a y to be a p p o i n t e d
b y t h e Governor a n d notified by p r o c l a m a t i o n published
in the Gazette.
3 . I n this A c t —
" t h e Commonwealth A c t " m e a n s the A i r N a v i g a ­
tion Act, 1920-1936, of the Commonwealth of
A u s t r a l i a and, if t h a t A c t is amended, includes
t h a t A c t as amended from time to t i m e ;
"the
" t h e r e g u l a t i o n s " m e a n s the A i r N a v i g a t i o n Regu­
lations m a d e , a n d a s in force from time to time,
u n d e r the Commonwealth A c t ;
"the
T e r r i t o r i e s " m e a n s t e r r i t o r i e s u n d e r the
a u t h o r i t y of the Commonwealth a n d includes
t e r r i t o r i e s g o v e r n e d b y the Commonwealth
under a mandate.
4 . The regulations from time to time in force applic­
able to a n d in relation to a i r n a v i g a t i o n within the
T e r r i t o r i e s shall (except so f a r a s those regulations a r e
by v i r t u e of the Commonwealth Act a n d the regulations
applicable to a n d in relation to a i r n a v i g a t i o n within
N e w South W a l e s ) apply, m u t a t i s m u t a n d i s , to a n d in
r e l a t i o n to a i r n a v i g a t i o n within N e w South W a l e s as if
those r e g u l a t i o n s as so applied were i n c o r p o r a t e d in
this Act a n d for the p u r p o s e s of this A c t those regula­
tions shall be r e a d a n d c o n s t r u e d a n d take effect
accordingly.
5 . W h e r e , by or u n d e r the regulations, a n y power
or function is vested in or exercisable by a n y p e r s o n or
a u t h o r i t y for the p u r p o s e of the r e g u l a t i o n s or a n y p a r t
thereof, the like p o w e r or function u n d e r the regulations
in t h e i r application by v i r t u e of this A c t shall be vested
in or exercisable b y t h a t p e r s o n or a u t h o r i t y for t h e
p u r p o s e s of the regulations in such application.
6 . A n y certificate, license or r e g i s t r a t i o n
issued, recognised or effected—
granted,
(a) by or u n d e r the regulations in t h e i r application
u n d e r the Commonwealth A c t ; or
(b) by or u n d e r the regulations in t h e i r application
b y v i r t u e of t h e law of a n y o t h e r S t a t e of the
Commonwealth,
a n d a n y cancellation or suspension of a n y such certificate,
license or r e g i s t r a t i o n , shall in N e w South W a l e s have the
same force a n d effect as if it h a d been g r a n t e d , issued,
recognised or effected in p u r s u a n c e of the regulations
in t h e i r application by v i r t u e of this Act.
7 . All fees

8. (1) T h e S t a t e T r a n s p o r t (Co-ordination) Act,
1931, a s amended by subsequent A c t s , is amended—
(a) by i n s e r t i n g in subsection one of section three
after the definition of " A g e n t " the following
new definition:—
" A i r N a v i g a t i o n R e g u l a t i o n s " means t h e
A i r N a v i g a t i o n Regulations m a d e a n d
a s in force from time to time u n d e r t h e
A i r N a v i g a t i o n A c t , 1920-1936, of t h e
Commonwealth of A u s t r a l i a or a n y A c t
a m e n d i n g t h a t Act.
(b) by omitting from p a r a g r a p h (d) of subsection
two of section fourteen t h e w o r d s " o r u n d e r a n y
A c t of the C o m m o n w e a l t h " a n d by i n s e r t i n g in
lieu thereof the words " o r in t h e case of a n
a i r c r a f t , p a r t i c u l a r s of the certificate of r e g i s t r a ­
tion a n d the certificate of a i r w o r t h i n e s s issued
under the Air Navigation Regulations";
(c) by omitting from the proviso to p a r a g r a p h ( g )
of subsection t h r e e of section seventeen t h e
w o r d s " a r e g i s t r a t i o n of a i r c r a f t u n d e r a n y A c t
of t h e C o m m o n w e a l t h " a n d by i n s e r t i n g in lieu
thereof the w o r d s " t h e certificate of r e g i s t r a t i o n
a n d the certificate of a i r w o r t h i n e s s of a n a i r c r a f t
issued u n d e r the A i r Navigation R e g u l a t i o n s " ;
(d) by omitting p a r a g r a p h (k) of subsection eight
of section forty-eight.
(2) E x c e p t a s p r o v i d e d in subsection one of this
section n o t h i n g in this A c t shall affect the provisions of
the S t a t e T r a n s p o r t (Co-ordination) A c t , 1931, a s
a m e n d e d by subsequent Acts.
