NOTICE OF LAYOUT AND TAKING
The State of Maine by its Department of Transportation does hereby give notice to all whom it may concern:
That the Department of Transportation in accordance with the authority of Title 23 M.R.S. Section 651, has determined that
public exigency requires the altering, widening, changing the grade, changing the drainage, laying out and establishing of a
portion of Cape Jellison Road in the Town of Stockton Springs, County of Waldo.
That the Department of Transportation, in accordance with Title 23 M.R.S. Sections 701 and 651, hereby lays out the location
of a portion of Cape Jellison Road in the Town of Stockton Springs.
That the Department of Transportation, in accordance with Title 23 M.R.S. Sections 651 and 151 to 159, has determined that
public exigency requires the taking of all rights in land as hereinafter specified and described, and as shown on a Right-ofWay Map, Cape Jellison Road, Town of Stockton Springs, Federal Aid Project No. STP-1666(500), (W.I.N. 016665.00), dated
January 2017, on file in the Office of the Department of Transportation, (D.O.T. File No. 14-209) and to be recorded in the
Registry of Deeds of Waldo County, a print of which is on file in the office of the County Commissioners of Waldo County.
Base Line Description
Cape Jellison Road Base Line
Beginning at a point in the present travelled way of Cape Jellison Road and designated as Sta. 1+00.00;
Thence northeasterly by a 19°45’25.8” curve to the left, one hundred twenty-three and fifty hundredths (123.50) feet to P.C.C.
Sta. 2+23.50;
Thence northerly by a 10°48’37.9” curve to the left, one hundred sixty-two and eighty-six hundredths (162.86) feet to P.T. Sta.
3+86.36;
Thence N. 06°14’55.5” W. and crossing the tidal inlet to Mill Pond, sixty three and sixty hundredths (63.60) feet to P.C. Sta.
4+49.96;
Thence northerly by a 05°05’34.6” curve to the right, one hundred thirty-eight and twenty-one hundredths (138.21) feet to P.T.
Sta. 5+88.17;
Thence N. 00°47’25.6” E. forty-one and two hundredths (41.02) feet to P.C. Sta.6+29.19 at a point in the present travelled way
of Cape Jellison Road
DESCRIPTIONS OF EASEMENT TAKING
The following described rights of easement in land are taken at the locations, in the manner, to the extent specified and as
shown on the right-of-way map hereinbefore mentioned:
HIGHWAY EASEMENT
The perpetual right is hereby taken to enter upon land within the following described boundaries, to construct and maintain
a public way and said taking does include the acquisition of any and all buildings and improvements within the described
boundaries, which are located with respect to the before described Base Line:

Westerly Boundary Line
Beginning on the Cape Jellison Road Base Line at Sta. 1+90.00;
Thence northeasterly along the Base Line thirty-three and fifty hundredths (33.50) feet to P.C.C. Sta. 2+23.50;
Thence northerly along the Base Line about three (3) feet to about Sta. 2+26 at or near the northeasterly corner of land
now or formerly of Carol Kamala Kinsey and the southeasterly corner of land now or formerly of Harbor Point Condominium
Association;
Thence northwesterly along the present southerly line of said Association and along the present northerly line of land of said
Kinsey about twenty (20) feet to a point twenty and no hundredths (20.00) feet northeasterly from and as measured along a
line normal to the Base Line at about Sta. 2+26;
Thence northwesterly by a direct course about twenty-seven (27) feet to a point thirty-five (35) feet westerly from and as
measured along a line normal to the Base Line at Sta. 2+50;
Thence northerly along a curved line thirty-five (35) feet westerly from and concentric with the Base Line, one hundred twentyseven and thirty-six hundredths (127.36) feet to a point thirty-five (35) feet westerly from and as measured along a line at right
angles to the Base Line at P.T. Sta. 3+86.36;
Thence N. 06°14’55.5” W. sixty-three and sixty hundredths (63.60) feet to a point thirty-five (35) feet westerly from and as
measured along a line at right angles to the Base Line at P.C. Sta. 4+49.96;
Thence northerly along a curved line thirty-five (35) feet, westerly from and concentric with the Base Line, one hundred forty
two and fifty-one hundredths (142.51) feet to a point thirty-five (35) feet westerly from and as measured along a line at right
angles to the Base Line at P.T. Sta. 5+88.17;
Thence easterly along said right angle line to the Base Line;
Thence N. 00°47’25.6” E. along the Base Line forty-one and two hundredths (41.02) feet to P.C. Sta. 6+29.19, at the northerly
end of the Easterly Boundary Line to be herein after described.

Beginning on the Cape Jellison Road Base Line at Sta. 1+90.00;
Thence southeasterly along a line normal to the Base Line, twenty and no hundredths (20.00) feet to a point;
Thence northeasterly by a direct course, thirty-nine and sixty hundredths (39.60) feet to a point thirty-five (35) feet
southeasterly from and as measured along a line normal to the Base Line at P.C.C. Sta. 2+23.50;
Thence northerly along a curved line thirty-five (35) feet easterly from and concentric with the Base Line, one hundred
seventy-three and sixty-one hundredths (173.61) feet to a point thirty-five (35) feet easterly from and as measured along a line
at right angles to the Base Line at P.T. Sta. 3+86.36;
Thence N. 06°14’55.5” W. sixty-three and sixty hundredths (63.60) feet to a point thirty-five (35) feet easterly from and as
measured along a line at right angles to the Base Line at P.C. Sta. 4+49.96;
Thence northerly along a curved line thirty-five (35) feet easterly from and concentric with the Base Line, one hundred thirtythree and ninety-one hundredths (133.91) feet to a point thirty-five (35) feet easterly from and as measured along a line at
right angles to the Base Line at P.T. Sta. 5+88.17;
Thence N. 00°47’25.6” E. forty-one and two hundredths (41.02) feet to a point thirty-five (35) feet easterly from and as
measured along a line at right angles to the Base Line at P.C. Sta. 6+29.19;
Thence westerly along said right angle line to the Base Line, at the northerly end of the Westerly Boundary Line herein before
described.
SLOPES
The right to enter, clear, grub and/or construct, and maintain slopes of the highway, as long as they are necessary for highway
purposes, on land outside of and adjoining the before-referenced highway boundary lines and within the limits defined by the
“Slope Easement Limits” as shown on the beforementioned right-of-way map, at the following locations:

The Department of Transportation directs that this Notice of Layout and
Taking be recorded in the Registry of Deeds of Waldo County and filed
with the Town Clerk of the Town of Stockton Springs and with the County
Commissioners of Wldo County and published in the “Republican Journal”
a newspaper of general circulation in the County where said highway is
located, and also directs that a copy of the Right-of-Way Map be filed with
the County Commissioners of said County and also that Notice be sent by
Certified Mail to any Owners and Mortgagees of Record.
