In 2013, you made a tremendous difference for our communities and our resources, during a time when they needed you the most. over by her appointees, and the appointees of her appointees. And it shows. But courtrooms are another matter. There, judges are striking down the illegal, anti-environment and anti-public decisions made by the Administration. The decisions that are coming out of courtrooms are good news for communities throughout our state…and bad news for an Administration that is still trying to evade the law. Three years into the administration of Governor Susana Martinez, we had one foot in administrative hearing rooms, and one foot in judicial courtrooms. They are both important arenas for New Mexico’s environment and communities. You’re making it possible for us to win those critical decisions – some of which are discussed in this Annual Report. While that system keeps us in the good graces of the IRS, it can make our Annual Reports appear unbalanced. For instance, using the GAAP system, it seems that our expenses exceeded our revenue in 2013. In reality, we received payments for several grants that were booked in previous years, and met all of our expenses last year. As water becomes more valuable, speculators are attempting new ways to get a hold of New Mexico’s scarce supply; 2013 saw us in a multi-week hearing in front of the State Engineer, fighting to keep a developer from grabbing rights to water in the East Mountains. We expect a decision in 2014. I 2 Victory for government transparency in Energy Conservation Codes case. NMELC affirmed a legal requirement that State decision-makers must explain the reasons for their decisions. Mineris Vitae, LLC asked the NM Mining Commission to change the Mining Act regulations so that the company could operate bigger humate mines with fewer rules. After we made our argument against the scheme, the Commission gave the company just a fraction of what it asked for. And we convinced legislators that they should not exempt humate mines from the Mining Act. 4 Built strong case for appeal in Copper Rule case. NMELC took part in a challenging rulemaking in 2013, in which the Water Quality Control Commission overturned more than three decades of regulations, policies and court rulings to allow an entire industry to pollute groundwater. But we built a strong record, and now we’ve taken the Commission to the Court of Appeals. 5 Built strong case for appeal in Oil & Gas Pit Rule case. Community Response (local) State-Level casework National-level casework Challenged State’s failure to regulate industrial dairies. Where there are good environmental regulations in place, like the Dairy Rule, the New Mexico Environment Department has suspended enforcement of them. With your help, we're working with citizens who live near dairies to hold the line on existing protections, get contaminated water cleaned up and prevent new contamination from occurring. 9 Successfully killed every bad environmental bill 6 Still no new uranium mining in New Mexico! 18 years after the Law Center became involved in the fight to stop new uranium mining in the Eastern Agency of the Navajo Nation, no new mines have opened. But we now have 17 uranium cases on our docket, ranging from advocating for the cleanup of Cold War-era mines and a mill to preventing the opening of new mines. In 2013, you made a tremendous difference for our communities and our resources, during a time when they needed you the most. over by her appointees, and the appointees of her appointees. And it shows. But courtrooms are another matter. There, judges are striking down the illegal, anti-environment and anti-public decisions made by the Administration. The decisions that are coming out of courtrooms are good news for communities throughout our state…and bad news for an Administration that is still trying to evade the law. Three years into the administration of Governor Susana Martinez, we had one foot in administrative hearing rooms, and one foot in judicial courtrooms. They are both important arenas for New Mexico’s environment and communities. You’re making it possible for us to win those critical decisions – some of which are discussed in this Annual Report. While that system keeps us in the good graces of the IRS, it can make our Annual Reports appear unbalanced. For instance, using the GAAP system, it seems that our expenses exceeded our revenue in 2013. In reality, we received payments for several grants that were booked in previous years, and met all of our expenses last year.
