Approved: March 03, 2014 MINUTES OF THE SENATE JUDICIARY COMMITTEE The meeting was called to order by Chairperson Jeff King at 10:40 a.m. on Monday, February 24, 2014, 346-S of the Capitol. All members were present except: Senator Carolyn McGinn – Excused Senator Terry Bruce – Excused Committee staff present: Lauren Douglass, Legislative Research Robert Allison-Gallimore, Legislative Research Jason Thompson, Office of Revisor Toni Beck, Committee Assistant Katherine McBride, Office of Revisor Conferees appearing before the Committee: No conferees present Others in attendance: See Attached List Chairman King turned the Committees attention to HB2446-District courts; court trustee operations fund. Jason Thompson provided an overview on the bill. Representative Richard Carlson presented written testimony as a proponent on the bill stating his judicial district is unique in that they are the only district which had an appointed trustee and later left the position vacant, but still had undispersed funds in the account. This bill allows the chief judge of a judicial district to authorize expenditures from the fund for district court operations. It contains no consequences to the state budget. (Attachment 1) The chairman closed the hearing on the bill. Chairman King turned the Committees attention to SB348-Qualifications for office of sheriff. Jason Thompson presented an overview on the bill. Senator Love moved, Senator Pettey seconded, for favorable passage SB348. Motion adopted. Jason Thompson presented an overview on the bill. Senator Knox moved, Senator Pettey seconded, that SB359 be amended per a technical amendment suggested by Jason Thompson. Senator Knox moved, Senator Pilcher Cook seconded, the amended bill for favorable passage. Motion adopted. Chairman King turned the Committees attention to SB404-Clarifying the culpability required for violations of the Kansas racketeer influenced and corrupt organization act. Jason Thompson presented an overview on the bill. Senator Peterson moved, Senator Pilcher Cook seconded, to adopt a balloon amendment correcting references to crimes and adding a new crime to the definition of racketeering activity. Motion adopted. Senator King moved, Senator Pilcher Cook seconded, SB404, as amended, be inserted into a substitute bill for HB2182-Relating to grand juries as amended. Motion adopted. Senator Peterson moved, Senator Love seconded, to recommend Senate Substitute for HB2182, favorably for passage. Motion adopted. Chairman King turned the Committees attention to SB377-Relating to district judge and district magistrate judge vacancies. Senator King moved, Senator Knox seconded, SB377 be inserted into a substitute bill for HB2065Relating to the crime of home improvement fraud as amended. Motion adopted. Senator Knox moved, Senator Lynn seconded, Senate Substitute for 2065, favorably for passage. Motion adopted. Chairman King turned the Committees attention to SB399-Allocating moneys from driver's license fees to the judicial branch non-judicial salary adjustment fund, without objection, HB 2446District courts; court trustee operations fund, which was heard earlier in the day. There was no objection to consideration of HB 2446. Jason Thompson presented an overview on SB399. Senator King moved, Senator Love seconded, SB399 be added to HB2446. Motion adopted. Senator Smith moved, Senator Pilcher Cook seconded SB401 be amended as proposed in the balloon. Motion adopted.
