A message from President Johnny Crumby
I’ve been in touch with the State Lodge leadership in West Virginia and Louisiana. The massive flooding that has hit those areas has caused mass destruction to many of our fellow FOP members. Not only are they tirelessly working
to rescue and help others, they are doing this knowing that their own homes
have been destroyed and their families uprooted.
I remember how it was when Nashville was flooded in 2010 and how difficult
times were. The Nashville flood was nothing in comparison to what has happened in West Virginia and Louisiana. THEY NEED OUR HELP! I am asking for
everyone, who can to reach deep into their pockets and send what you can.
No amount is too small when all you have are the clothes on your back and
they are wet and dirty. National Secretary Patrick Yoes reported that over
20,000 people have been rescued and 40,000 homes have been destroyed.
Donations to the NFOP Disaster Relief Fund can be mailed to the NFOP Foundation at 701 Marriott Drive—Nashville, TN 37214. Please make sure you
write WV and/or LA Disaster Relief on the memo line. Your donation will be
tax deductible.
At the National Board meeting in September, National Trustee Duane Phillips
will cast Tennessee’s vote for United States President. The Presidential
Screening Committee sent both candidates the questionnaire and conducted
an interview with Donald Trump. Hilliary Clinton refused to answer the questionnaire and was therefore not interviewed by the committee.
Each local lodge should have a procedure in place to record the wishes of
their members. The local lodge must complete the necessary paperwork
(mailed from the State Lodge) to cast your lodge’s vote. The paperwork must
be signed by two different lodge officers and received at the State Lodge by
the close of business at 4:00 p.m. on Friday, September 9, 2016.

On August 5th, 2016 the Presidential Screening Committee flew to New York to meet with
Donald Trump. The meeting was as a result of the campaign answering the screening
committee questionnaire. The meeting lasted about 40 minuets and during that time we
discussed the Hate Crime Legislation and voiced our concerns about the uptick in violence
against police. Mr. Trump was candid and advised the committee that he did not realize how
dangerous law enforcement was. HE stopped the questions to make notes on the figures
about how many officers have been shot this year as well as the number of officers
assaulted.
In our discussion we focused on issues that pertain to access to his administration access
and our rights as police officers. In light of the answers to the questionnaire issues I asked
Mr. Trump in light of his Federalism stand on many of the issues would he vow to not
support a National Right to Work Bill. His response was that he would talk to us and listen to
our concerns but that he would support issues based on what he felt “was best for the
American People”. We emphasized the fact that his states rights stand on many issues
would allow him to let the states decide those decisions.

He asked if we had seen the Law and Order platform at the Republican National Committee
and he vowed that he supports law enforcement and says his record is clear. He advised he
always takes time to thank officers when they work his detail and we acknowledged that we
had heard that from our members.

He vowed that he would clear the backlog of PSOB claims in his first 100 days. He also said
that he would overturn the Executive Order that restricted the 10-33 program. These are
both important issues to our members.
Overall he demonstrated that he supports law enforcement and that he would always have
the FOP at the table to discuss the issues.

Social Media by State FOP Attorney Daphne Davis
Can you imagine a law enforcement officer whose Facebook page lists his job title as "garbage collector?" What about one where an
LEO says his mood is "devious"? Or an LEO posting that he or she is watching the movie "Training Day" to brush up on proper police
procedure? How about a comment on a news story such as, "Let someone try to stab me, he will end up shot."
These are all actual social media postings that subjected their writer/poster to discipline from their respective police agencies, or that
completely negated a testifying officer's credibility.
I've represented officers for many years now, and while officers generally know that there are some things they can't or shouldn't post
on social media, they also think their First Amendment rights protect their speech in most instances. Wrong.
The authority on speech by public employees (that's police officers) is Garcetti vs. Cerballos, 547 U.S. 410 (2006). This Supreme Court
case established a test to see if speech is protected by the First Amendment. Although the test is slightly more complicated, the part
you most need to know is this: Your speech is likely NOT protected if it hinders the effectiveness or efficiency of the police organization. This can include morale. It also includes impact on discipline, harmony among co-workers, and potential detrimental impact on
close working relationships.
Ultimately, what you post on social media is your decision, but you must remember that MNPD has a Social Media Policy, and if violated, you subject yourself to a 1 to 4 day sanction.
If you do post to social media, I suggest you follow these rules:
1. Do not indicate your affiliation with MNPD. This means no uniform pictures.
2. Never post while you are on duty (potential violation of policy--devoting entire time to duty)
3. Never divulge confidential information that you know because of your position in the department.
4. Set your privacy settings as strictly as possible.
5. Don't post about your own bad behaviors.
6. Assume that everything you post will be read by the Chief of Police---and that he knows who you are.
7. Never disparage a racial or ethnic group (or any group, really) of people based on a news story or incident.
8. Do not threaten to use force.
9. Before you post something, ask yourself if you want that post brought up in cross-examination by a criminal defense attorney, or at a
federal trial for excessive use of force. If not, don't post it.
