The Wailea Tennis Club is the largest resort

INVITED SPEAKERS
OVIE L. CARROLL
DIRECTOR, DEPARTMENT OF JUSTICE CYBERCRIME LAB (CCIPS), WASHINGTON, D.C.
Ovie Carroll has twenty-nine years of law enforcement experience and is currently the Director for the Department of Justice
Cybercrime Lab at the Computer Crime and Intellectual Property Section (CCIPS). The Cybercrime Lab provides advanced
digital investigative analysis, cybercrime investigative and other technical support to DOJ prosecutors as it applies to implementing
the Department’s national strategies in digital evidence, combating electronic penetrations, data thefts, and cyberattacks on critical
information systems. Mr. Carroll is also an adjunct professor with George Washington University for the Masters of Forensic
Science program, teaching two classes: Cyber Crime/Internet Investigations and Interview and Interrogation. Mr. Carroll is
also a course author and certified instructor with the SANS Institute where he teaches computer forensics. Prior to joining the
Department of Justice, Mr. Carroll was the Special Agent in Charge of the Technical Crimes Unit at the Postal Inspector General’s
Office, responsible for all computer intrusion investigations impacting the postal service network infrastructure and for providing
all digital forensic analysis and technical surveillance in support of criminal investigations and audits. Mr. Carroll was also the
Special Agent in Charge of the Computer Investigations and Operations Branch, Washington Field Office, Air Force Office
of Special Investigations (AFOSI), where he was responsible for coordinating all national level computer intrusions occurring
within the United States Air Force. He has extensive field experience applying his training to a broad variety of investigations
and operations. As a special agent with the AFOSI, Mr. Carroll worked both general crimes and counterintelligence, and has
conducted investigations into a variety of offenses including murder, rape, fraud, bribery, theft, and gangs and narcotics.
THE HONOURABLE MADAM JUSTICE SUZANNE CÔTÉ, FACTL
SUPREME COURT OF CANADA
The Honourable Suzanne Côté was appointed to the Supreme Court of Canada on December 1, 2014. Before her
appointment to the Supreme Court of Canada, Justice Côté was a partner at Osler, Hoskin & Harcourt LLP, where she was
head of the Montréal office’s litigation group. She specialized in complex civil and commercial litigation, including cases
involving manufacturer’s liability, class actions, shareholder disputes and public law. Justice Côté received the Advocatus
Emeritus distinction from the Barreau du Québec in 2011. In addition, she has been a Fellow of the American College of
Trial Lawyers since 2005. Justice Côté argued cases in various trial courts, as well as in the Québec Court of Appeal, the
Federal Courts and the Supreme Court of Canada. Justice Côté has taught evidence and litigation at the École du Barreau
du Québec, and has also lectured at the Université du Québec à Rimouski and at the Université de Montréal. She has also
contributed for many years to the organization of the annual Coupe Guy-Guérin trial advocacy competition, a provincial
competition that leads to participation in the Sopinka Cup.
STEVE ELKINS
DOCUMENTARY FILMMAKER, PASADENA, CALIFORNIA
Steve has been working in television for thirty years as a cinematographer, editor, and producer. Before starting his media career,
he received a B.S. in Earth Science from Southern Illinois University where he also did an interdisciplinary archaeological
research project on a rock shelter site he discovered. After several years as director of an environmental education program in
Chicago and a field researcher for paleo-climate studies at the University of Wisconsin, Steve moved to Los Angeles where he
initially worked in petroleum engineering before succumbing to the siren call of Hollywood. His media career has garnered
an Emmy as well numerous other industry awards. Desiring to blend his scientific interests with filmmaking, Steve has been
fortunate to work on a variety of adventure and science oriented programming around the world. Elkins became fascinated
with the Honduran Mosquitia and its lost city legends while filming there in 1994. Reading about the advent of airborne
lidar as a tool for unveiling archaeological ruins, he formed a company in 2012 (UTL: Under the Lidar) with colleagues
to explore the Mosquitia jungle using lidar while producing a documentary about the process and results that happen to
include the discovery of two “lost cities.” In 2013, Steve and his UTL partner, Bill Benenson, were both selected as two of
Foreign Policy Magazine’s Leading Global Thinkers of the Year for their innovative approach to exploration. In addition, their
project was the subject of a feature story in the May 2013 issue of The New Yorker titled, “The Eldorado Machine.” This year,
with Steve as project leader, they organized a multi-disciplinary scientific ground expedition to one of the sites discovered
by lidar in 2012. The results have garnered world headlines including an article in the October 2015 issue of National
Geographic (“Lure of the Lost City”) and a recent episode of National Geographic Explorer (“Legend of the Monkey God”).
LINDA HIRSHMAN
AUTHOR, PHOENIX, ARIZONA
Ms. Hirshman is a lawyer and cultural historian and the author of SISTERS IN LAW: How Sandra
Day O’Connor and Ruth Bader Ginsburg Went to the Supreme Court and Changed the World, Victory:
The Triumphant Gay Revolution, and many other books. She received her J.D. from the University
of Chicago Law School and her Ph.D. in philosophy from the University of Illinois at Chicago. For
fifteen years Ms. Hirshman practiced law, representing mostly organized labor. She participated in
three cases in the United States Supreme Court, including, in 1985, the landmark case of Garcia
v. San Antonio Metropolitan Transit Authority, which established the line between the federal
government and the states. She then went into academia, teaching law, philosophy, and women’s
studies, before she retired from Brandeis University in 2002. Her writing has appeared in The New
York Times, The Washington Post, Slate, Newsweek, The Daily Beast, and POLITICO. Ms. Hirshman
divides her time between New York City and Phoenix, Arizona.

HONORABLE ALEX KOZINSKI
JUDGE, U.S. COURT OF APPEALS FOR THE NINTH CIRCUIT
Judge Kozinski was appointed United States Circuit Judge for the Ninth Circuit on November 7, 1985, and
served as Chief Judge from 2007 to 2014. At the time of his appointment by President Reagan in 1985, he
was the youngest federal appeals court judge. He graduated from UCLA, receiving an A.B. degree in 1972,
and from UCLA Law School, receiving a J.D. degree in 1975. Prior to his appointment to the appellate
bench, Judge Kozinski began his career in law as a law clerk to Circuit Judge Anthony M. Kennedy, then to
Chief Justice Warren E. Burger. He was an attorney at Forry Golbert Singer & Gelles, then for Covington &
Burling. He then moved on to serve as Deputy Legal Counsel for the Office of President-Elect Reagan, Assistant
Counsel for the Office of Counsel to the President, then as Special Counsel for the Merit Systems Protection
Board before being appointed Chief Judge of the United States Claims Court in 1982. Judge Kozinski was
born in Romania, where he lived until moving to Los Angeles at the age of twelve. Both of his parents are
Holocaust survivors. In addition to his judicial duties, Judge Kozinski is an essayist and judicial commentator.
DAVID F. LEVI
DEAN, DUKE LAW SCHOOL, DURHAM, NORTH CAROLINA
David F. Levi became the 14th dean of Duke Law School on July 1, 2007. Prior to his appointment, he was the
Chief United States District Judge for the Eastern District of California with chambers in Sacramento. He was
appointed United States Attorney by President Ronald Reagan in 1986 and a United States district judge by
President George H. W. Bush in 1990. A native of Chicago, Dean Levi earned his A.B. in history and literature,
magna cum laude, from Harvard College. He entered Harvard’s graduate program in history, specializing in
English legal history and serving as a teaching fellow in English history and literature. He graduated Order of
the Coif in 1980 from Stanford Law School, where he was also president of the Stanford Law Review. Following
graduation, he was a law clerk to Judge Ben C. Duniway of the U.S. Court of Appeals for the Ninth Circuit, and
then to Justice Lewis F. Powell, Jr., of the U.S. Supreme Court. He was the first president and a founder of the
Milton L. Schwartz American Inn of Court, now the Schwartz-Levi American Inn of Court, at the King Hall
School of Law, University of California at Davis. In 2014, he was appointed chair of the American Bar Association’s
Standing Committee on the American Judicial System, and in 2015, he was named co-chair of the North Carolina
Commission on the Administration of Law and Justice. Dean Levi is the co-author of Federal Trial Objections
(James Publishing 2002). He currently teaches courses on Judicial Behavior and Ethics at Duke Law School.
JUSTICE R. ASHBY PATE
ASSOCIATE JUSTICE, SUPREME COURT OF THE REPUBLIC OF PALAU
R. Ashby Pate became a Supreme Court Justice of the Republic of Palau in January 2013. He is one of four
justices on the Republic’s highest court and is the youngest justice in the island nation’s history. As a member
of Palau’s Supreme Court, he has presided over several hundred civil and criminal cases as a trial judge and
has served as a panelist on over forty civil and criminal appeals. He is a member of the prestigious American
Law Institute, where he contributes to projects including The Restatement (Fourth) Foreign Relations Law of
the United States, The Restatement (Third) The U.S. Law of International Commercial Arbitration, and The
Restatement (Third) Torts: Liability for Economic Harm. He is also member of the International Bar Association,
the American Judges Association, and the American Bar Association. Prior to his judicial appointment, he
practiced for several years at the firm of Lightfoot Franklin & White, in Birmingham, Alabama. Justice Pate
graduated summa cum laude from the University of Colorado, where he was elected to Phi Beta Kappa and was
nominated for most outstanding honors graduate. He graduated magna cum laude from Samford University’s
Cumberland School of Law, where he also served as Editor in Chief of the Law Review. After law school, he
clerked for U.S. District Judge U.W. Clemon in the Northern District of Alabama. He then earned his LL.M.
at the University of East Anglia’s Norwich Law School in England, where he graduated first in his class and
was awarded the distinguished Sir Roy Goode Prize in international law. In 2009, he served as Senior Court
Counsel for the Republic of Palau, where he contributed to legislation establishing Palau’s first jury trial system
and authored Palau’s first jury trial rules. Prior to law school, he played music professionally, touring regionally
around the Southeast in a band and releasing two albums of original material. He is also the author of a
published children’s book about Palau.
HONORABLE MARK E. RECKTENWALD
CHIEF JUSTICE, SUPREME COURT OF HAWAII
Mark E. Recktenwald was sworn in as Chief Justice of the Supreme Court on September 14, 2010. He joined
the Supreme Court as an Associate Justice on May 11, 2009, and previously served as Chief Judge of the
Intermediate Court of Appeals beginning in April 2007. He participated in more than 250 cases and authored
ten published opinions. Prior to his appointment to the Intermediate Court of Appeals, Recktenwald served as
the director of the Department of Commerce and Consumer Affairs, as an Assistant United States Attorney for
the District of Hawaii where he served as the health care fraud coordinator and environmental law enforcement
coordinator and litigated both civil and criminal cases, and as an attorney in private practice specializing in
employment litigation. He received his undergraduate degree from Harvard University and his law degree
from the University of Chicago.

The December 1, 2015, amendments to the Federal Rules of Civil Procedure are designed
to make the civil litigation process more streamlined and less expensive. The amendments
address four interrelated areas: increased cooperation among counsel, more active judicial
management, proportionality of discovery (as opposed to the “reasonably calculated” standard,
which is gone), and remedies for the loss or destruction of electronically stored information.
Our panel will address the background of these dramatic changes, review the ways in which
they differ from their predecessors, and explain how they are expected to operate and what
they are intended to achieve.
Two hours of general CLE credit will be offered.

This fifteen-mile ride begins in Kula at an elevation of 3,000 feet,
where the open road of Old Kula Highway awaits. The winding road
passes open meadows and rewards cyclists with views of Haleakala
and the Pacific Ocean. After a final bike fitting and orientation,
cyclists will set their own pace and skill level at a 1:5 guide ratio on
pre-fitted, Litespeed Titanium 10 speed bikes with 2.5 hours of ride
time. Guests are asked to bring their own cycle shoes, and have the
option to bring their own pedals to fully customize the experience.

Includes: Green fees, shared cart, range balls, transportation to
the Wailea Golf Club, professional tournament coordination, box
lunch with bottled water, and tax.
Dress Code: Shirt with collar and Bermuda-length shorts or
slacks. This is a non-metal spike golf facility.
Club Rentals Requests: Call Wailea Golf Club at (808) 8757450 x1. Rentals and pro shop items are at the player’s expense.
Includes: Transportation, round-robin tournament, use of the
tennis facility, professional tournament coordination, tennis
balls, rental racquets and refreshments.
Dress Code: Tennis shoes and appropriate tennis attire must
be worn.
