PRESENT: Mayor Pro Tem Tom Leonard, Aldermen Suzanne Gray, Don Harte, and Richard Peters, Town Attorney Brian Edes, Town Manager Stuart Turille and Town Clerk Carin Faulkner. NOT PRESENT: Mayor Daniel Tuman and Alderman Richard Macartney I. CALL TO ORDER: Mayor Pro Tem Leonard called the meeting to order at 10:00 a.m. He went over some ground rules for conducting the public hearing. II. APPROVAL OF AGENDA: • Alderman Gray made a motion to approve the agenda as presented. Alderman Peters seconded the motion. • The motion passed unanimously. III. PUBLIC HEARING TO RECEIVE PUBLIC COMMENT ON A PROPOSED MORATORIUM FOR BUILDING ANY HOUSES WITH MORE THAN SIX BEDROOMS: A public hearing was conducted to receive comment on the proposed moratorium. The following person spoke in support of the moratorium: Pat Stigall The following persons spoke in opposition to the moratorium: Mo Afify, Orin O’Quin, Tyler Newman, Christina Asbury, Sandra Ledbetter, Michael Afify, Paul Dorazio, Greg Eichman, Mike Sauer, Craig Greif, Chuck Thompson, Lenny Denittis, Richard Baker, Steve Coggins (Mr. Coggins presented a written memo to the Board and Town Attorney), Stuart Harness, Hiram Williams, Jean Miller, John Dabney, Hanna McCloud (Ms. Hill read the Planning Board report aloud on her behalf) Alderman Peters made a motion to close the public hearing. Alderman Harte seconded the motion. Town of North Topsail Beach Board of Aldermen Special Meeting Minutes May 14, 2014 DISCUSSION AND POSSIBLE ACTION TO ADOPT ORDINANCE 2014-4 (ORDINANCE ESTABLISHING A DEVOLOPMENT MORATORIUM ON HOMES WITH MORE THAN SIX BEDROOMS - DRAFT): • • • • • • • • • • • • • • • • Alderman Gray made a motion to adopt Ordinance 2014-4 Ordinance Establishing a Development Moratorium on Homes with More than Six Bedrooms. Alderman Peters seconded the motion. There was discussion. Mayor Pro Tem Leonard discussed amending the draft ordinance as presented to make it less restrictive such as what Oak Island passed. Attorney Edes confirmed that Oak Island passed an ordinance limiting over 7 bedrooms and over 5,000 square feet. There was discussion. Alderman Harte asked if the Board could legally impose the moratorium. The Town Attorney mentioned NCGS 160-A 31(e) and indicated, from his discussions with the School of Government, that traditional residential use is not the same as high intensity rental use and that a moratorium aimed at the seasonal rental use could be passed in order to study density or intensity of intransient use as opposed to residential use. He advised the Board that regardless of whether or not the ordinance establishing the moratorium passes, that the Board direct the Planning Board to discuss objective criteria and subjective criteria (set-backs, height, impervious surface, parking, and being in harmony with the surrounding areas) and make the homes of whichever number of bedrooms and square footage the Board prefers be subject to a special use permit process which is where the Town of Oak Island is right now. There was further discussion. Alderman Harte made a motion amending the current motion for the ordinance to read “more than seven bedrooms and greater than 5,000 square feet” and to keep the moratorium at 60 days. Alderman Peters seconded. There was further discussion. The Board voted on Alderman Hart’s motion to amend the drafted ordinance to read “more than 7 bedrooms and greater than 5,000 square feet.” The motion failed 3 to 1 for lack of a 2/3 vote, with Alderman Gray voting against. Alderman Gray made a motion to direct the Planning Director to review the Town policies as far as parking, house sizes, lot sizes, set backs, the whole zoning issue and permitting process for homes being built with the Planning Board and a have a decision by June 5th. Attorney Edes made a suggestion to have the Planning Board discuss making a special use process. Alderman Gray amended her motion to direct the Planning Director, pursuant to the Town Attorney’s advice, to have the Planning Board discuss the issues in her original motion plus making a special use process concerning larger homes. Alderman Harte seconded the motion. The motion passed unanimously. Page 3 of 3 • • V. Town of North Topsail Beach Board of Aldermen Special Meeting Minutes May 14, 2014 Alderman Gray made a motion to direct Town Staff to advertise for a public hearing to amend the Town’s Unified Development Ordinance at the June 5th regular Board of Aldermen meeting. Alderman Harte seconded the motion. The motion passed unanimously. ADJOURNMENT: Alderman Gray made a motion to adjourn. Alderman Peters seconded the motion.
