“Local Government (Procedures at Meetings) Regulations 2000” will ask:

In respect of the works that were done during the past 12 months on the railway
line at Islington, how many tons of materials were removed from the site during
these works;
(2)
What tests for contaminants were done on the soils beneath the tracks before the
works began;
(3)
What measures were put in place to protect the local residents from the dust
emanating from the site while the works were in progress;
(4)
As 250 Churchill Road was used to store all the debris before it was finally taken
away in trucks, what measures were put in place to ensure that all this activity on
the site of 250 Churchill Road (a known contaminated site) did not have any
adverse affect on the local residents?

Councillor B Wellby having complied with the provisions of Regulation 13(3) of the
“Regulations Under the Local Government Act, 1999” will move:
(1)
That in accordance with the results of our public consultation a strong message be
relayed to the State Government via a letter to the appropriate Ministers and
Department Heads, to have the property at 250 Churchill Road not to be continued as
an industrial site and as a consequence we strongly implore the government to
reconsider its position, and suspend the sale of said property until it has been rezoned.

That Council approve the preparation of a joint boundary re-alignment proposal with
the City of Port Adelaide Enfield pursuant to Section 27 of the Local Government Act
1999 in order to alter the boundary that divides the property at 35 (Lot 54) Warren
Avenue, Prospect so that the property will be comprised wholly within the City of
Prospect.

That the Chief Executive Officer be delegated the power and authority to do anything
else necessary or incidental to the proposal and/or the boundary realignment for the
purpose of facilitating the outcome described in 6.1.

That the City of Prospect (“the Council”) hereby revokes all previous delegations made
to the Eastern Health Authority Incorporated.
(2)
That in exercise of the powers contained in Section 9 of the Supported Residential
Facilities Act 1992 the powers, functions and duties under the Supported Residential
Facilities Act 1992 contained in Attachments 2-6 are hereby delegated by the City of
Prospect this 21st day of February 2006 to the Eastern Health Authority Incorporated
(“the Delegate”) and the said powers, functions and duties may be sub-delegated by the
Delegate to any other officer of the Delegate.
(3)
That in exercise of the powers contained in Section 6 of the Public and Environmental
Health Act 1987 the powers, functions and duties under the Public & Environmental
Health Act 1987 contained in Attachments 6-7 are hereby delegated by the City of
Prospect this 21st Day of February 2006 to the Eastern Health Authority Incorporated
(“the Delegate”) and the said powers, functions and duties may be sub-delegated by the
Delegate to any other officer of the Delegate.
(4)
That in exercise of the powers contained in Section 6 of the Public and Environmental
Health Act 1987 the powers, functions and duties under the Public & Environmental
Health (Waste Control) Regulations 1995 contained in Attachments 8-10 are hereby
delegated by the City of Prospect this 21st Day of February 2006 to the Eastern Health
Authority Incorporated (“the Delegate”) and the said powers, functions and duties may
be sub-delegated by the Delegate to any other officer of the Delegate.
(5)
That in exercise of the powers contained in Section 44 of the Local Government Act
1999 the powers, functions and duties under the Expiation of Offences Act 1996
contained in Attachments 10-11 are hereby delegated by the City of Prospect this 21st
Day of February 2006 to the Eastern Health Authority Incorporated (“the Delegate”)
and the said powers, functions and duties may be sub-delegated by the Delegate to any
other officer of the Delegate.
(6)
That in exercise of the powers contained in Section 44 of the Local Government Act
1999 the powers under the Environment Protection Act 1993 contained in Attachments
11 are hereby delegated by the City of Prospect this 21st Day of February 2006 to the
Eastern Health Authority Incorporated (“the Delegate”) and the said powers may be
sub-delegated by the Delegate to any other officer of the Delegate.

That the delegations made by Council be incorporated into the Council’s Delegations
Register.
