HAZMAT DETERMINATION POLICY
An ORM-D is a material such as a consumer commodity which presents a limited hazard during
transportation due to its form, quantity, and packaging. These items are regulated by the Department of
Transportation and have special requirements regarding shipping and handling. The Code of Federal
Regulations defines hazardous material as a substance or material, including a hazardous substance,
which has been determined by the Secretary of Transportation to be capable of posing an unreasonable
risk to health, safety, and property when transported in commerce. Examples include: aerosols, paint,
perfume, nail polish, nail polish remover, hairspray, and diffusers. Some examples of commonly shipped
products that are not hazardous include: lipstick, shampoo, conditioner, eye liner, eye shadow and hand
cream. ORM-D products present a limited hazard during transportation due to its form, quantity, and
packaging. ORM-D materials are classified as consumer commodities, packaged, and distributed in a form
intended for sale through retail sales for personal care or household use. Products that are classified as
higher degree of hazardous materials and do not fall under ORM-D classification CANNOT be accepted at
Urban Outfitters, Inc. distribution centers or stores.
It is essential that the following procedures are adhered to so we continue to ship those items determined
to be hazardous within the limits of the law.
General requirements for hazardous material transportation:
1. Outer packaging is required to be indelibly marked with ORM-D – Consumer Commodity, and
be affixed to the surface of a package on a label. The marking must be on each carton, and be
separate from any other carton marking.
2. The outer packaging must be strong enough to stand up to normal travel conditions, and protect
the inner packaging of the product.
3. Packaging must be closed properly with no visible leaks or breaks.
4. ORM-D shipments must be shipped by GROUND SERVICES only.
5. Urban Outfitters, Inc. requires you to send an MSDS (Material Safety Data Sheet) form. The
MSDS should be emailed to [email protected] prior to a purchase order being issued. We must be
able to make hazardous material determination at the time the product setup occurs in our
system. We cannot ship product without this information on file.

Failure to comply with these requirements could result in a $200 chargeback, refusal of product,
and/or seeking all legal remedies as necessary.

All cartons of safety matches must ship ground only.
Cartons MUST NOT be marked ORM-D.
Cartons MUST be marked – Safety Matches – UN #1944.
The packaging requirements for safety matches are found at 49 CFR 173.186 (b). The rules state
that:
“Safety matches and wax ‘Vesta’ matches must be tightly packed in securely closed inner
packaging to prevent accidental ignition under conditions normally incident to transportation,
and further packed in outer fiberboard, wooden, or other equivalent-type packaging.
These matches in outer packaging not exceeding 23 kg (50 pounds) gross weight are
not subject to any other requirement (except marking) of this subchapter. These matches
may be packed in the same outer packaging with materials not subject to this subchapter.

Fines and penalties can result if proper procedures are not followed.
Not all hazardous materials qualify for an ORM-D classification and our company cannot ship those
items. This includes common items such as matches, fire extinguishers, and lithium batteries.
Filled lighters must contain less than 4 fluid ounces to qualify as an ORM-D.
