NAVIGATION (AMENDMENT) ACT.
Act No. 27, 1941.
An Act to amend the Navigation Act, 1901-1935,
in certain respects; and for purposes connected therewith. [Assented to, 10th April,
1941.]

E it enacted by the King's Most Excellent Majesty,
by and with the advice and conserit of the Legislative Council and Legislative Assembly of New South
Wales in Parliament assembled, and by the authority of
the same, as follows :—
1 . (1) This Act may be cited as the "Navigation
(Amendment) Act, 1941," and shall be read and construed with the Navigation Act, 1901-1935, as amended
by subsequent Acts.
(2) T h e N a v i g a t i o n Act, 1901-1935, a s a m e n d e d b y
subsequent Acts, is in this Act r e f e r r e d to as t h e
P r i n c i p a l Act.
(3) T h e P r i n c i p a l Act, as amended b y this Act, m a y
be cited as the N a v i g a t i o n Act, 1901-1941.
(4) T h i s A c t shall commence u p o n a d a y to be
a p p o i n t e d by the Governor a n d notified b y p r o c l a m a t i o n
published in the Gazette.
2. T h e P r i n c i p a l A c t is a m e n d e d —
( a ) b y i n s e r t i n g n e x t after section two the following
new section:—
2A. This Act shall be r e a d a n d construed so
as not to exceed the legislative p o w e r of the
S t a t e to the intent t h a t w h e r e a n y provision of
this Act or the application thereof to a n y p e r s o n
or circumstance is held invalid the r e m a i n d e r
of this Act a n d the application of such p r o ­
vision to o t h e r p e r s o n s or circumstances shall
n o t be affected.
(b) b y i n s e r t i n g in section t h r e e immediately before
t h e definition of the expression "qualified p i l o t "
the following definition:—
" p r e s c r i b e d " m e a n s p r e s c r i b e d b y this
A c t or b y r e g u l a t i o n m a d e u n d e r t h i s
A c t or the N a v i g a t i o n A m e n d m e n t
( R e g u l a t i o n s ) Act, 1904.
(c) b y i n s e r t i n g next a f t e r section four the following
new section:—
4A. The provisions of this Act r e l a t i n g to ships
u s i n g steam p o w e r for the p u r p o s e of n a v i g a t i o n
a n d to s t e a m n a v i g a t i o n shall a p p l y , with such
modifications (if a n y ) a s m a y be p r e s c r i b e d by
r e g u l a t i o n s m a d e u n d e r this Act, to ships p r o ­
pelled by mechanical p o w e r a n d t o the naviga­
tion of such ships.
( d ) (i) b y o m i t t i n g from subsection one of section
twenty-four t h e w o r d " t w o " a n d b y insert­
ing in lieu thereof the w o r d s " o n e or
more'';
(ii) by o m i t t i n g from the same subsection the
w o r d " a s s e s s o r s " w h e r e secondly o c c u r r i n g
a n d by i n s e r t i n g i n lieu thereof t h e w o r d s
" a s s e s s o r or a s s e s s o r s " ;
(e)
(e) by o m i t t i n g section t h i r t y - t h r e e ;
(f) by o m i t t i n g from subsection one of section
t h i r t y - f o u r the w o r d s " c o n s t r u c t e d or intended
to c a r r y p a s s e n g e r s shall d u r i n g the actual
employment of such ship in t h a t c a p a c i t y " a n d
by i n s e r t i n g in lieu thereof the w o r d " s h a l l " ;
( g ) by o m i t t i n g subsection t h r e e of section t h i r t y six a n d by i n s e r t i n g in lieu thereof the follow­
ing subsection:—
(3) T h e B o a r d m a y i n s e r t in the certificate
for a s h i p —
( a ) the n u m b e r of p e r s o n s which the ship
may carry;
(b) the n u m b e r of p e r s o n s which m a y be
c a r r i e d in a n y p o r t i o n of the ship.
(h) b y o m i t t i n g from subsection t h r e e of section
thirty-eight the word " p a s s e n g e r s " and by
i n s e r t i n g in lieu thereof the w o r d " p e r s o n s " ;
(i) b y omitting from section forty-two the w o r d s
" w i t h a n y p a s s e n g e r s on b o a r d " w h e r e v e r
occurring;
(j) b y omitting section f o r t y - t h r e e a n d by i n s e r t i n g
in lieu thereof the following new section:—
43. (1) N o ship shall c a r r y a g r e a t e r n u m b e r
of p e r s o n s t h a n the n u m b e r which the ship m a y
c a r r y as specified in the certificate for the ship.
(2) W h e r e the certificate for a ship speci­
fies a n u m b e r of p e r s o n s which m a y be c a r r i e d
in a n y p o r t i o n of the ship, the ship shall n o t
c a r r y a g r e a t e r n u m b e r in t h a t p o r t i o n t h a n
t h a t so specified.
(3) T h e m a s t e r or o w n e r of a n y ship
u p o n which, or in a n y p o r t i o n of which p e r s o n s
a r e c a r r i e d in c o n t r a v e n t i o n of subsection one
or subsection two of t h i s section shall i n c u r a
p e n a l t y of n o t less t h a n five p o u n d s a n d not
m o r e t h a n fifty p o u n d s .
(k) b y o m i t t i n g f r o m subsection five of section
eighty-one t h e w o r d s " P r o v i d e d t h a t this enact­
m e n t shall n o t a p p l y to steam-launches, except
such
such a s a r e used for Lire, or for the c a r r i a g e
of goods, or for towage p u r p o s e s . "
(1) b y i n s e r t i n g in section one h u n d r e d a n d t h i r t y five after p a r a g r a p h (c) the following new p a r a ­
g r a p h s :—
(d) for a n d with respect to the inspection
a n d t e s t i n g of m a c h i n e r y a n d appliances
for the loading a n d u n l o a d i n g of v e s s e l s ;
(e) for a n d with r e s p e c t to the p r e v e n t i o n of
the use of defective m a c h i n e r y or appli­
ances for the loading or u n l o a d i n g of
vessels;
(f) for and with r e s p e c t to the p r o t e c t i o n of
the h e a l t h a n d the security from i n j u r y
of p e r s o n s engaged in the l o a d i n g or
u n l o a d i n g of vessels a n d of p e r s o n s
engaged in the h a n d l i n g or s t o r a g e of
cargo in or upon a n y w h a r f ;
( g ) for a n d with respect to the use of lights
or fire in the holds of v e s s e l s ;
(h) for a n d with r e s p e c t to the safety of
p e r s o n s going on a n d coming from vessels,
a n d the provision of m e a n s of escape
from the holds of vessels while cargo is
being loaded or u n l o a d e d ;
(i) for a n d with respect to the m a r k i n g on
packages or articles of c a r g o of the
weight thereof before the same a r c
loaded on vessels.
( m ) by o m i t t i n g section one h u n d r e d a n d fifty a n d
b y i n s e r t i n g in lieu thereof the following
section:—
150. (1) T h e B o a r d m a y , b y notification p u b ­
lished in the Gazette, limit the speed of vessels
within navigable w a t e r s . A n y such notification
may apply to—
( a ) vessels g e n e r a l l y or to a n y p a r t i c u l a r
class or classes of vessels or to vessels
o t h e r t h a n vessels of a p a r t i c u l a r class
o r classes;
(b)
(b) navigable w a t e r s generally or to a n y
p a r t i c u l a r p o r t i o n or p o r t i o n s thereof
or to navigable w a t e r s other t h a n a
p a r t i c u l a r p o r t i o n or p o r t i o n s .
(2) If a n y vessel to which a n y such noti­
fication applies shall exceed the speed specified
t h e r e i n the m a s t e r or owner of such vessel shall
be guilty of a n offence a n d shall incur a penalty
n o t exceeding fifty p o u n d s .
( n ) by i n s e r t i n g n e x t after section one h u n d r e d a n d
sixty-five the following new section:—
165A. T h e G o v e r n o r m a y m a k e regulations
p r e s c r i b i n g all m a t t e r s which by this A c t a r e
r e q u i r e d or p e r m i t t e d to be p r e s c r i b e d b y regu­
lation or which a r e n e c e s s a r y or convenient for
c a r r y i n g this A c t into effect.
(o) by i n s e r t i n g next after section one h u n d r e d a n d
seventy-two the following new section:—
173. (1) T h e G o v e r n o r on the recommenda­
tion of the B o a r d m a y from time to time, by noti­
fication published in the Gazette, declare t h a t ,
subject to such conditions, limitations, a n d
r e s t r i c t i o n s (if a n y ) a s a r e e x p r e s s e d in t h e
notification, the p r o v i s i o n s of t h i s Act, or such
of t h e m a s a r e m e n t i o n e d in the notification,
shall n o t a p p l y to such vessels or classes of
vessels as a r e specified in the notification.
A notification u n d e r this subsection shall h a v e
effect according to its tenor.
(2) W h e r e u n d e r subsection one of t h i s
section the G o v e r n o r h a s declared t h a t a n y p r o ­
vision of t h i s A c t shall n o t a p p l y to a n y specified
vessels or class of vessels t h e G o v e r n o r m a y by
r e g u l a t i o n s m a k e such f u r t h e r or o t h e r p r o v i ­
sion for o r in r e l a t i o n to such vessels or class
of vessels a s he m a y deem n e c e s s a r y or con­
venient for c a r r y i n g out t h e p r o v i s i o n s a n d
objects of t h i s A c t .
(3) Subsection two of this section shall
n o t p r e j u d i c e the g e n e r a l i t y of a n y p r o v i s i o n of
t h i s o r a n y o t h e r A c t which confers p o w e r to
make regulations.
(4)
(4) In this section " v e s s e l " shall have
the meaning ascribed to it in section one hundred
and thirty-three of this Act.
(p) by omitting from section one the figures " 1 7 2 "
and by inserting in lieu thereof the figures
"173.''
