Furthermore, it should be noted when reading the spreadsheet provided, that each disciplinary sanction represents a proportionate outcome to each substantiated allegation. Without reading the investigating officer's report and/or the rationale for each disciplinary outcome, it is not possible to fully appreciate the reasons for a particular disciplinary sanction. Resignation of Police Officers and Members of Police Staff The disciplinary process for police officers and members of police staff in England and Wales is governed by statute and national guidance. These have allowed employees subject of an accusation, to submit an application to resign and/or to retire prior to the conclusion of an investigation or disciplinary proceedings. As of 12 January 2015, an amendment to the Police (Conduct) Regulations 2012 has meant that police officers are no longer permitted to give notice to resign or retire without obtaining the consent of the appropriate authority. A police officer can therefore no longer resign or retire where an allegation is made that would result in a misconduct hearing or special case hearing (a hearing that could lead to an officer being dismissed), subject to limited exclusions. It is of note that this also includes police officers that are the subject of a live final written warning where, following receipt of an allegation (whether classified as misconduct or gross misconduct), the officer could be subject of a misconduct hearing. Members of staff (inclusive of police officers subject to the previous police regulations) that were permitted to resign or retire, left with their record of service indicating that they left whilst under investigation and/or subject to disciplinary proceedings. The alternative may have been a potentially lengthy period on full pay on restricted duties or suspension. Please note that the most severe sanction available under the disciplinary process for police officers and members of police staff is dismissal. Furthermore, the resignation and/or retirement of a police officer or a member of police staff does not affect any criminal investigation or in the case of police officers, the ability of the MPS to seek forfeiture of their pension. The forfeiture of an officer's pension is governed by Regulation K5 of the Police Pensions Regulations 1987. These allow a police authority to seek forfeiture of an officer's pension when an officer has been convicted of a criminal offence in connection with their service, which is certified by the Secretary of State either to have been "gravely injurious to the interests of the State" or "liable to lead to serious loss of confidence in the public service". The decision to forfeit an MPS officer's pension is taken by the Mayor's Office for Policing and Crime (MOPAC) and the Secretary of State. Any assumption that an employee has been permitted to retire and/or resign to avoid the sanction of a disciplinary/misconduct hearing, criminal investigation and/or the forfeiture of an officer's pension would be incorrect. It should also be noted that police employees that are alleged to have committed any offence are investigated and held accountable through the Criminal Justice System in the same way as any other person. In this regard, where an employee has been proven guilty at court of a criminal offence (please note that this information has not been provided in this Freedom of Information Act notice), they will be the subject of the same management/monitoring processes as a member of the public. For example, if an employee of the MPS was convicted of an offence that led to them being placed upon the sex offenders register, they would be subject to the same monitoring procedure as any other offender. They would also face a disciplinary hearing that would, in all probability, lead to their dismissal. Maintaining Public Trust in the MPS Securing and maintaining the trust of the community is integral to the principle of policing by consent and to continue to do so, the MPS recognises that its staff must act with professionalism and integrity whether on or off-duty. The MPS treats each occasion when an allegation is made about the conduct of its staff extremely seriously and will fully investigate each incident to determine whether the conduct of that member of staff has breached the standards of professional behaviour. Where the conduct of staff is proven to have fallen below the standards of behaviour expected, the MPS will take robust action to ensure that its staff are appropriately disciplined and that lessons are learnt from each case. Any instance where the conduct of our staff is alleged to have fallen below the standards of behaviour expected is treated extremely seriously by the MPS.
