involve a complaint from a member of the public) cases recorded from 01 January 2009 to 31
October 2014; where the 'circumstance field' contains either misuse of 'Computer (unknown
type)', 'CRIMINT', 'CRIS', 'PNC', 'Other internal program', 'internet', 'E-mail', 'Non Aware' or
'MDT'. The data provided includes allegations recorded against police officers and members
of police staff.

'Cases', 'allegations' and 'officer/staff allegations' are different measures of complaint
recorded against police officers and members of police staff. By way of a hypothetical
example, three members of police staff are the subject of an internal police investigation
where it is alleged that they circulated an email between themselves that contained
inappropriate content. This would be recorded as one case (i.e. one incident/matter), one
allegation (i.e. one allegation of computer misuse) and three staff allegations (i.e. one
allegation per staff member). You have been provided with the number of cases, the number
of police officers and police staff subject of allegations and the number of officer/staff
allegations. You have not been provided with the number of allegations.
Please note that the increase in the number of cases from 2013 to 2014, is the result of
historic police staff discipline cases being transferred onto Tribune in 2014. The incident date
would not, in the main, be calendar year 2014. Furthermore, there are a number of cases that
are made up of a large number of allegations. For example, in 2014 1 case alone was

'Discontinuance' refers to instances where a force considers that it is no longer practical to
continue with an investigation and is unable to conclude the investigation. There are
established grounds upon which a discontinuance may be granted. A force or police authority
must obtain IPCC agreement for a discontinuance.
'Officer not informed' refers to instances where it is deemed appropriate not to inform an
officer about the result of any investigation into their conduct. For example, an officer may
have left the employ of the MPS.
'Substantiated' refers to instances where, following investigation, the investigating officer
determines that, based upon the available evidence, there is a case to answer in relation to
an allegation made concerning an officer's conduct.

I would like to take this opportunity to reiterate that the increase in the number of cases from
2013 to 2014, is the result of historic police staff discipline cases being transferred onto
Tribune in 2014. The incident date would not, in the main, be calendar year 2014.
Furthermore, there are a number of cases that are made up of a large number of allegations.
For example, in 2014 1 case alone was comprised of 53 separate allegations. It should also
be noted that a small number of allegations have been incorrectly categorised as computer
misuse. Furthermore, it should be noted when reading the spreadsheet provided, that each
disciplinary sanction represents a proportionate outcome to each substantiated allegation.
Without reading the investigating officer's report and/or the rationale for each disciplinary
outcome, it is not possible to fully appreciate the reasons for a particular disciplinary sanction.
To further assist you with your request, please also find an explanation of a number of the
columns provided within the attached spreadsheet:
'Year' refers to the date that the complaint was recorded by the MPS.
'Type Description' refers to the category under which allegations of a similar nature have been
grouped together. Definitions can be found upon pages 11-17 of the Independent Police

'Summary' refers to a synopsis of the allegation made against each officer/staff member.
'Staff Type' refers to the role performed by the employee of the MPS.
'Officer number' refers to a number attributed to each police officer/member of staff subject of
an allegation.
'Result' refers to the outcome of each proportionate investigation into each allegation
recorded.
Resignation of Police Officers and Members of Police Staff
The disciplinary process for police officers and members of police staff in England and Wales
is governed by statute and national guidance. These have allowed employees subject of an
accusation, to submit an application to resign and/or to retire prior to the conclusion of an
investigation or disciplinary proceedings. As of 12 January 2015, an amendment to the Police
(Conduct) Regulations 2012 has meant that police officers are no longer permitted to give
notice to resign or retire without obtaining the consent of the appropriate authority. A police
officer can therefore no longer resign or retire where an allegation is made that would result in
a misconduct hearing or special case hearing (a hearing that could lead to an officer being
dismissed), subject to limited exclusions. It is of note that this also includes police officers that
are the subject of a live final written warning where, following receipt of an allegation (whether
classified as misconduct or gross misconduct), the officer could be subject of a misconduct
hearing.
Members of staff (inclusive of police officers subject to the previous police regulations) that
were permitted to resign or retire, left with their record of service indicating that they left whilst
under investigation and/or subject to disciplinary proceedings. The alternative may have been
a potentially lengthy period on full pay on restricted duties or suspension. Please note that the
most severe sanction available under the disciplinary process for police officers and members
of police staff is dismissal.
Furthermore, the resignation and/or retirement of a police officer or a member of police staff
does not affect any criminal investigation or in the case of police officers, the ability of the
MPS to seek forfeiture of their pension. The forfeiture of an officer's pension is governed by
Regulation K5 of the Police Pensions Regulations 1987. These allow a police authority to
seek forfeiture of an officer's pension when an officer has been convicted of a criminal offence
in connection with their service, which is certified by the Secretary of State either to have
been "gravely injurious to the interests of the State" or "liable to lead to serious loss of
confidence in the public service". The decision to forfeit an MPS officer's pension is taken by
the Mayor's Office for Policing and Crime (MOPAC) and the Secretary of State. Any
assumption that an employee has been permitted to retire and/or resign to avoid the sanction
of a disciplinary/misconduct hearing, criminal investigation and/or the forfeiture of an officer's
pension would be incorrect.
It should also be noted that police employees that are alleged to have committed any offence
are investigated and held accountable through the Criminal Justice System in the same way
as any other person. In this regard, where an employee has been proven guilty at court of a
criminal offence (please note that this information has not been provided in this Freedom of
Information Act notice), they will be the subject of the same management/monitoring
processes as a member of the public. For example, if an employee of the MPS was convicted
of an offence that led to them being placed upon the sex offenders register, they would be
subject to the same monitoring procedure as any other offender. They would also face a
disciplinary hearing that would, in all probability, lead to their dismissal.
Maintaining Public Trust in the MPS
Securing and maintaining the trust of the community is integral to the principle of policing by
consent and to continue to do so, the MPS recognises that its staff must act with
professionalism and integrity whether on or off-duty. The MPS treats each occasion when an
allegation is made about the conduct of its staff extremely seriously and will fully investigate
each incident to determine whether the conduct of that member of staff has breached the
standards of professional behaviour. Where the conduct of staff is proven to have fallen below
the standards of behaviour expected, the MPS will take robust action to ensure that its staff
are appropriately disciplined and that lessons are learnt from each case.
Any instance where the conduct of our staff is alleged to have fallen below the standards of
behaviour expected is treated extremely seriously by the MPS.
