The REF Site is located immediately east of the Barangaroo South development site. The proposed works (the ‘Activity’) at the REF Site will upgrade the existing stormwater system, regrade the road pavement within the REF Site and install new landscaping to: resolve existing ponding of water on Hickson Road in storm events, including ponding that has the potential to flood the Sussex Hotel in a 100 year ARI event as the existing stormwater drainage system is inadequate; address the potential for the existing flooding to be exacerbated by sea level rise in the future and the interruption of overland flow paths from Hickson Road across the Barangaroo South development site when the public domain is complete; improve the amenity of the streetscape and its relationship with the proposed permanent public domain works at Barangaroo South; and respond to the raising of the ground level of the adjacent Barangaroo South development by approximately 900mm through increasing the level of the adjoining roads to better relate to the new ground level at Barangaroo South. The Activity involves the following components: construction works, including; – Demolition of existing improvements; – Removal of temporary ramps/stairs on western abutment of Napoleon Bridge (Shipwright Walk) and the entrance of Mercantile Walk; – Establishment of erosion and sediment controls; and – Establishment of traffic management controls, and temporary services diversions. works to Hickson Road, Sussex Street, Napoleon Street and Shelley Street, and part of Barangaroo South that will be reserved as Watermans Quay in the future, including: – works resulting of the change in levels of Sussex Street in the areas of the removed temporary ramps/stairs on western abutment of Napoleon Bridge (Shipwright Walk) and the entrance of Mercantile Walk; – works resulting from the change in grade of existing infrastructure (pavement, drainage pits) adjacent to Sussex Street Bridge (Wynyard Walk) western bridge abutments; – removal of some existing trees along Hickson Road; – replacement of existing Sydney Water potable water main; – adjust/deviate/relocate existing utilities services and surface structure that conflict with the proposed road works; – demolition of existing pavements and gutters; – removal of existing road and footpath pavement; – placement of fill and pavement materials; – construction of new road pavement; – construction of footpath pavements; – construction of a new cycle way; JBA 10051 i Barangaroo South Hickson Road Alterations | August 2015 – construction of new pedestrian crossings (including mid-block traffic signals); – construction of taxi ranks, drop off zone and car parking; and – construction of new kerbs. Construction of a new Sydney Water potable water main to replace the existing main; Adjustment to levels of existing utilities services surface structures affected by the proposed road works (e.g. sewer man holes, valves/hydrants, electrical and telecommunications service pits); construction of stormwater drainage infrastructure including pipelines and inlet structures; and landscaping works including planting new trees and installation of street furniture. This REF has been prepared in accordance with the requirements of all potentially relevant NSW and Commonwealth legislation. The REF has been prepared in accordance with Clause 228 of the Environmental Planning and Assessment Regulation 2000. In doing so, the REF satisfies the requirements of Section 111 of the Environmental Planning and Assessment Act 1979 (EP&A Act), which requires the Barangaroo Delivery Authority to examine and take into account to the fullest extent possible, all matters affecting or likely to affect the environment as a result of the activity. The Activity will have the following key benefits: introduce cycle infrastructure to Hickson Road within the REF Site; reduce the local flood risk for a 100 year ARI storm event to within the City of Sydney requirements; manage the risk of sea level rise; and improve the public domain in the area by providing a new carriage way, footpath, street furniture and landscaping and improve the relationship between the road and adjacent properties including the future public domain at Barangaroo South. The key adverse impacts of the Activity include: the removal of existing street trees; and short term construction impacts. Potential adverse impacts identified within this REF will be appropriately managed in accordance with the mitigation measures outlined in Section 8 and the measures set out in the Activity-specific Environmental Construction Site Management Plan, prepared by Lend Lease, who will undertake the works on behalf of the Barangaroo Delivery Authority. These mitigation measures will ensure that the Activity is delivered in such a way that it both maximises benefits to the wider community, and minimises any potentially adverse impacts to the community and the environment. In considering the overall potential environmental impacts and the proposed management and mitigation measures outlined in this REF, the Activity is not anticipated to have a significant effect on the environment for the purpose of s112 of the EP&A Act. On balance, it is considered that the benefits of the Activity outweigh any environmental impacts and that the Activity should proceed. ii JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 JBA 10051 iii Barangaroo South Hickson Road Alterations | August 2015 1.0 Introduction This Review of Environmental Factors (REF) has been prepared by JBA to examine and take into account to the fullest extent possible all matters affecting or likely to affect, the environment by reason of the Activity, as defined in Section 3. The Activity is proposed to be carried out by Lend Lease (Millers Point) Pty Ltd on behalf of the Barangaroo Delivery Authority. 1.1 Activity Background and Overview The REF Site is located immediately east of the Barangaroo South development site as shown on Figure 2. Works to the road are required to prevent future stormwater management issues and also to improve the public domain and road infrastructure in the vicinity of Barangaroo South. There is existing ponding of water on Hickson Road which has the potential to flood the Sussex Hotel because the existing stormwater drainage system does not meet the current City of Sydney requirements for conveyance of 100 year (ARI) stormwater. Furthermore, when completed, the ground level of the Barangaroo South precinct will have been raised to above the existing level of Hickson Road in order to address potential future sea level rise. This will permanently alter existing overland stormwater flow paths such that existing ponding of water on Hickson Road will be exacerbated unless works are undertaken to improve the capacity of the stormwater system and manage ponding distribution at surface level. The Activity will upgrade the existing stormwater system, regrade the road pavements within the REF Site and install new landscaping to: resolve existing ponding of water on Hickson Road in storm events, including ponding that has the potential to flood the Sussex Hotel in a 100 year ARI event as the existing stormwater drainage system is inadequate; address the potential for the existing flooding to be exacerbated by sea level rise in the future and the interruption of overland flow paths from Hickson Road across the Barangaroo South development site when the public domain is complete; improve the amenity of the streetscape and its relationship with the proposed permanent public domain works at Barangaroo South; and respond to the raising of the ground level of the adjacent Barangaroo South development by approximately 900mm through increasing the level of the adjoining roads to better relate to the new ground level at Barangaroo South. As part of the Activity, Lend Lease proposes road works in Hickson Road, Sussex Street, Napoleon Street, Shelley Street adjacent to the Barangaroo South, and to an area of Barangaroo South that will be reserved in the future as Waterman’s Quay (Globe Street). Construction of a new Sydney Water potable water main to replace the existing main; Adjustment to levels of existing utilities services surface structures affected by the proposed road works (e.g. sewer man holes, valves/hydrants, electrical and telecommunications service pits); construction of stormwater drainage infrastructure including pipelines and inlet structures; and landscaping works including planting new trees and installation of street furniture. 1.2 Activity Objectives The objectives of the Activity are: to improve and upgrade the functionality of the existing roads within the REF Site; to resolve existing ponding of water on Hickson Road in storm events, including ponding that has the potential to flood the Sussex Hotel in a 100 year ARI event by improving drainage in the area to reduce future flood risk and manage the risk of sea level rise; improve the amenity of the streetscape and its relationship with the proposed permanent public domain works at Barangaroo South; and respond to the raising of the ground level of the adjacent land at the Barangaroo South development site by up to approximately 900mm through increasing the level of the adjoining roads to better relate to the new ground level at Barangaroo South. JBA 10051 3 Barangaroo South 1.3 Hickson Road Alterations | August 2015 Purpose of the REF The purpose of this REF is to describe the Stage 1A road works as described in Section 1.1 (the ‘Activity’), to document the likely environmental impacts and to detail mitigation measures that would be implemented. The Barangaroo Delivery Authority is the proponent and a determining authority for the Activity under Part 5 of the EP&A Act. The Activity involves works to a road for which the Barangaroo Delivery Authority is the appropriate roads authority. For part of the REF Site, the appropriate roads authority is the City of Sydney Council. As outlined in Section 4 of this REF, the City of Sydney Council has been consulted and has raised no objection to the Activity. This REF has been prepared in accordance with the requirements of all potentially relevant NSW and Commonwealth legislation. The REF has been prepared in accordance with Clause 228 of the Environmental Planning and Assessment Regulation 2000 (EP&A Regulation). In doing so, the REF satisfies the requirements of Section 111 of the EP&A Act, which requires the Barangaroo Delivery Authority to examine and take into account to the fullest extent possible, all matters affecting or likely to affect the environment by reason of the activity. 1.4 Notes on Text The names of roads referred to within supporting documents have been subject to amendment during the course of this compilation of this assessment. The Barangaroo site has been divided into three distinct redevelopment areas (from north to south) – the Headland Park, Barangaroo Central and Barangaroo South. The REF Site includes an area of Hickson Road, Sussex Street, Napoleon Street, Shelley Street and a small area of Barangaroo South (part Lot 5 of DP876514) that will be reserved as Watermans Quay in the future. The REF Site runs in a north-south direction along the eastern boundary of the Barangaroo South precinct. Figure 1 shows the REF site in the context of the CBD. The REF Site is shown on Figure 2. Construction of a new Sydney Water potable water main to replace the existing main; Adjustment to levels of existing utilities services surface structures affected by the proposed road works (e.g. sewer man holes, valves/hydrants, electrical and telecommunications service pits); construction of stormwater drainage infrastructure including inlet structures; landscaping works including planting new trees and installation of street furniture; and the removal of a temporary lift located adjacent to Napoleon Bridge (City Walk Bridge). Note that approval for the removal of this temporary lift is not sought as part of this activity as it was approved as part of a previous REF and is contingent on the commencement of operation of Sussex Street Bridge (Wynyard Walk). JBA 10051 7 Barangaroo South 3.1 Hickson Road Alterations | August 2015 Detailed Description The Activity will improve the existing road and footbath pavement along Hickson Road, Sussex Street, Napoleon Street and Shelley Street. The Activity will also take place in an area of the Barangaroo South precinct that will be reserved as Watermans Quay. The Activity will address existing stormwater management issues and increase the current level of the road pavement to better relate to the future level of the Barangaroo South precinct to the west of Hickson Road. The Activity will introduce a central median strip to Hickson Road along with a taxi rank and additional parking bays on the western (northbound) carriageway. A cycle path will be provided on the eastern (southbound) carriageway. The cycle path will allow bi-directional travel to allow for connection to the broader cycle network planned for the CBD. Traffic signals will be installed on the Hickson Road/Napoleon Street intersection and also the Hickson Road/Watermans Quay intersection. As the REF Site is a Classified Road concurrence is required from RMS for the proposed road works. Improved street furniture and signage will be installed as part of the Activity. Civil drawings of the REF Site following the Activity are provided in Appendix A and landscape plans are provided in Appendix H. Tree Removal Existing Ficus microcarpa var. ‘Hillii’ (Hills Weeping Fig) trees are located along Hickson Road. Where these trees are located within or adjacent to the REF Site, they may be affected by the Activity. The trees to be removed have been assessed within the Arboricultural report attached to the REF as Appendix E. Trees that are to be retained have been found to be in good health and suitable for retention. Planting of new street trees is proposed as part of the landscaping works associated with the Activity. The details of proposed landscaping works are provided in Appendix H and include: the installation of standard City of Sydney tree pits on the eastern and western side of Hickson Road, planted with Liriodendron tulipfera and Fraxinus pennsylvanica; and planting of 7 Livistona australis in the Hickson Road median strip. Parking Timed on street parking is located on both the east and west sides of Sussex Street. The exact number is not known as there are no marked spaces. The Activity will provide timed parking on the east side of Sussex Street between 9am and 3pm. It is intended the area will be a clear way between 3pm and 8pm to ensure both south bound lanes are functional. Parking is to be provided on the western side of Sussex Street. Seven (7) parking spaces are to be provided along with five (5) taxi bays to the southern extent of the works. A minimum of thirty (30) bike parking spaces will be provided. General parking arrangements are detailed on the civil engineering drawings 460 and 461, provided at Appendix A. Pedestrian Crossings On grade pedestrian crossings are located at the signalised intersection with Napoleon Street and the proposed mid-block signalised pedestrian crossing located 8 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 under the Sussex Street Bridge. These are detailed on drawings 460 and 461 provided at Appendix A. Fill Material It is anticipated fill material will need to be imported to facilitate level adjustments to Sussex Street. Concept earthwork volumes indicate approximately 700m3 of engineered fill material is required over and above pavement materials. The source of the material cannot be determined at this stage; however sandstone material may be available from other projects within the CBD depending on construction timing. Any fill material used will be validated for use by a suitably qualified Geotechnical Engineer. Coordination of RL levels is detailed on drawings 410 and 411 provided at Appendix A. Smooth connections shall be made with the existing levels of the surrounding areas. Public Transportation Public transport infrastructure within has not been allowed for as part of the proposed Activity. However, the possible future light rail has been allowed for in the existing road corridor. Sketch plans have been discussed with Council and the Barangaroo Delivery Authority during the preparation of this REF. Staging As the Activity will coincide with the closure of George Street due to the installation of light rail in Sydney CBD, allowance has been made for temporary bus stops within the REF Site. A temporary bus stop will be located north of the Napoleon Street/Hickson Road intersection in both directions. The Activity will be managed in such a way as to allow for the continued operation of both northerly and southerly bus stops throughout construction. 3.2 Construction Management An Environmental, Construction, and Site Management Plan (ECSMP) has been prepared by Lend Lease and is included at Appendix D. This plan, along with the management and mitigation measures within Section 8 sets the parameters for construction methodology and mitigation measures to be undertaken to support the delivery of the proposed activity. A detailed Construction Environmental Management Plan (CEMP) will be prepared prior to the commencement of the Activity. Construction traffic management arrangements will be detailed in a separate traffic management plan, which will be finalised prior to construction, based on the outcomes and recommendations of the construction traffic assessment in Appendix D and the ECSMP. JBA 10051 9 Barangaroo South Hickson Road Alterations | August 2015 4.0 Consultation Section 111of the EP&A Act states that the determining authority is ‘to examine and take into account to the fullest extent possible all matters affecting or likely to affect the environment’ as a result of the Activity. Consultation has been undertaken with the following entities: Ausgrid; City of Sydney Council; Sydney Water; and Roads and Maritime Services All issues that were raised during this consultation have been resolved during the detailed design of the proposed Activity. Additional management and mitigation measures required by Sydney Water have been appended to the measures provided in Section 9. 10 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 5.0 Planning Context 5.1 Environmental Planning and Assessment Act 1979 (EP&A Act) The EP&A Act is the legal framework through which the use of land is managed in NSW. The Activity is subject to Part 5 of the EP&A Act. Section 111 of the EP&A Act requires the determining authority to examine and take into account to the fullest extent possible all matters affecting, or likely to affect the environment by reason of the Activity. This REF includes an environmental assessment, which addresses the requirements of section 111 of the EP&A Act. Subsection 111 (2), (3), and (4) of the EP&A Act prescribe that the determining authority shall consider the effect of an Activity on: conservation agreements and plans of management entered into under the National Parks and Wildlife Act 1974 (NP&W Act); any critical habitat, threatened species, populations and ecological communities, and their habitats and any other protected fauna or protected native plants within the meaning of the NP&W Act; joint management agreements or any biobanking agreement entered into under the Threatened Species Conservation Act 1995; and any wilderness area (within the meaning of the Wilderness Act 1987) in the locality in which the activity is intended to be carried on. The REF Site is not subject to any existing conservation arrangements to which the determining authority should have regard under this section of the Act. 5.2 State Environmental Planning Policies (SEPPs) The SEPPs which apply to the site of the proposed works and are relevant to the assessment of the proposal are outlined below. 5.2.1 State Environmental Planning Policy (Infrastructure) 2007 Development without Consent Clause 94 provides that development for the purposes of road or road infrastructure facilities may be carried out by or on behalf of a public authority on any land, and specifies that ‘alterations or additions to an existing road (such as widening, duplication or reconstruction of lanes, changing the alignment or strengthening of the road)’ are included as development for the purposes of road or road infrastructure facilities. As works may be carried out on any land, the Barangaroo Delivery Authority is able to undertake these works on land for which City of Sydney Council is the appropriate roads authority without consent. Consultation with City of Sydney Council is outlined in Section 4. The component of the Activity that is associated with the works to Hickson Road, Napoleon Street, Shelley Street, Sussex Street and future Watermans Quay are road works to which Clause 94 applies. The REF Site is not on land reserved under JBA 10051 11 Barangaroo South Hickson Road Alterations | August 2015 the National Parks and Wildlife Act 1974 and the proponent is the Barangaroo Delivery Authority which is a public authority. Clause 111 provides that development for the purpose of stormwater management systems may be carried out by or on behalf of a public authority without consent on any land. The component of the Activity that is associated with stormwater infrastructure is development to which Clause 111 applies. All demolition works, including the proposed removal of trees along Hickson Road, is required as part of the construction works in connection works in connection with a road or road infrastructure facilities and is therefore undertaken in accordance with Clause 94 of the ISEPP. The Activity is ‘permissible without consent’ and can be assessed under Part 5 of the EP&A Act. Exempt Development The Activity also includes several components that can be carried out as exempt development, as defined by clause 97 of the ISEPP. Clause 97 specifies that the following works can be carried out as exempt development when carried out on a road or within a road reserve by a public authority for the purpose of a road or road infrastructure facilities: ‘erection, installation, maintenance, reconstruction, repair or replacement of any of the following, and any associated landscaping works: – security fencing with a height above ground level (existing) of not more than 3.2m, – safety barriers or systems, including Jersey barriers, – directional, safety or other advisory signs relating to road works or the use of existing road infrastructure facilities, – pedestrian and cyclist facilities (such as footpaths, street lighting, kerb adjustments and ramps, pedestrian fences, refuges, holding rails, and bollards), – minor road pavement or shoulder work (such as patching, grading, resheeting, sealing and re-sealing), – street furniture (such as seats, bins and directional signs) and any associated kerb construction, access paths and ramps, lighting and signage that complies with AS:1428.2 and the Disability Standards, – removal from or addition to existing traffic lights of items such as signal displays, loops or buttons, – street lighting, if any replacement involves the replacement of existing materials with similar materials only and if the lighting minimises light spill and artificial sky glow in accordance with AS/NZS 1158:2007, Lighting for Roads and Public Spaces, – pavement and road surface markings (such as bus lane markings), lane delineators, electric pavement lights, detection loops and traffic counters, – kerb and guttering, – culverts, drains and other works to improve the quality or control of stormwater runoff,’. Clause 58B of the ISEPP also specifies the following as exempt development within the Barangaroo Site when carried out by, or behalf of, a public authority: 12 JBA 10051 roads, cycleways, pedestrian bridges, at grade car parks, ticketing facilities and viewing platforms, outdoor recreational facilities, including playing fields and associated earthworks, but not including grandstands, Barangaroo South Hickson Road Alterations | August 2015 amenity facilities, including toilets, change rooms and food preparation and related facilities for persons using public spaces within the site, information boards and other information facilities (except visitor centres), lighting if the lighting minimises light spill and artificial sky glow in accordance with AS/NZS 1158 Set:2010, Lighting for roads and public spaces Set, maintenance depots used solely for the maintenance of the land or structures within the site, environmental management works, landscaping, including landscape structures or features (such as art work) and irrigation systems (whether or not they use recycled water), Christmas trees that comply with subclause (2), demolition of buildings (unless the building is a State or local heritage item or is within a heritage conservation area) so long as the footprint of the building covers an area no greater than 250 square metres. No assessment or approval of exempt development is required under the EP&A Act. The proposed works that can be carried out as exempt development under the provisions of clauses 58B or 97 of the ISEPP are incidental to the works that are permitted without consent and therefore described as part of the Activity within this REF for context. These works are indicative and may be amended within the scope of the exempt development provisions in the future if necessary. Consultation Clause 14 of the ISEPP requires that where development may be carried out without consent by a public authority, the public authority must not carry out the activity if it is not minor or inconsequential on a local heritage item unless it has: had an assessment of the impact to the local heritage item prepared (a Statement of Heritage Impact prepared by TKD is included in Appendix F); given written notice of the intention to carry out the development and a copy of the assessment to the local council for the area; and and taken into consideration any response received within 21 days of the notice. As discussed in further detail at Section 5.5, the Activity involves the removal of street trees that form part of local heritage item I1952 in the Sydney Local Environmental plan (SLEP) 2012. The Activity is also located adjacent to the Statelisted Sussex Hotel. The Activity will therefore impact on the visual curtilage of a heritage item, but, as determined by the Statement of Heritage prepared by TKD (Appendix F), the impacts of the development on items of heritage significance will not be substantial. As such, although referral under clause 14 of the ISEPP may not necessarily be required, City of Sydney Council will be notified of the Activity. Clause 16(2)(d) of the ISEPP requires that where development may be carried out without consent within the foreshore area within the meaning of the Sydney Harbour Foreshore Authority Act 1998, the proponent must notify the Sydney Harbour Foreshore Authority. Part of the site is located within this area. Therefore notification of the Sydney Harbour Foreshore Authority is to be undertaken under clause 16 of the ISEPP. JBA 10051 13 Barangaroo South Hickson Road Alterations | August 2015 5.2.2 State Environmental Planning Policy (Major Development) 2005 The Barangaroo site is listed as a State Significant Site under Schedule 3 of State Environmental Planning Policy (Major Development) 2005 (Major Development SEPP). The majority of the REF Site is within the Barangaroo Site as defined in the Major Development SEPP. The areas of the REF Site located outside of the Barangaroo Site listing include the southern tip, which relates to works on part of Sussex Street and part of Shelley Street, and the eastern tip, which relates to works on part of Napoleon Street. Sydney Local Environmental Plan (SLEP) 2012 is the environmental planning instrument that applies to these areas (see Section 4.3). The part of the REF Site covered by the Major Development SEPP is zoned ‘B4 Mixed Use’. Figure 3 overlays the REF Site on a hybrid of the Major Development SEPP and LEP 2012 zoning maps, and illustrates the parts of the site covered by each instrument. Clause 22(1) of Part 12 of Schedule 3 the Major Development SEPP provides that: This Part does not restrict or prohibit, or enable the restriction or prohibition of, the carrying out of any development that is permitted to be carried out with or without consent or that is exempt development under State Environmental Planning Policy (Infrastructure) 2007. As detailed in Section 4.2.1 under the provisions of the ISEPP the Activity is permissible without consent on any land when being carried out by, or on behalf of, a public authority (except for those elements, as described above, that are exempt development and for which no assessment or approval is required). 14 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 Figure 3 – Major Development SEPP and Sydney LEP 2012 Zoning Source: JBA JBA 10051 15 Barangaroo South Hickson Road Alterations | August 2015 5.2.3 State Environmental Planning Policy 55 – Remediation of Land (SEPP 55) SEPP 55 provides for the consideration of contamination and remediation matters to be considered as part of zoning or rezoning proposals and in the determination of a development application. The Activity is neither a zoning nor rezoning application, or a development application. As such SEPP 55 does not apply. Notwithstanding this, contamination is identified as a relevant issue to be considered by the determining authority and is therefore addressed in the REF. The excavation associated with the Activity is minimal, restricted to the area around the proposed drainage works. During the operation of the Activity, this area will retain its existing use as a road and footpath, and the final development will leave the ground in the same condition as it currently is, being covered with hard stand and unexposed to sensitive receivers. As detailed in Section 4.4.4, the northern section of the REF Site is adjacent to, and overlaps with land that is subject to a Declaration No. 21122 as a Remediation Site under the Contaminated Land Management Act 1997 (EPA Declaration Area). AECOM have undertaken investigations in the REF Site to determine the extent of any existing contamination. This report is included as Appendix M and is summarised in Section 5.10 of this REF. Based on the previous investigations within the REF Site, including the EPA Declaration Area, AECOM has concluded that any contamination that is discovered while carrying out the Activity is likely to be associated with existing road fill, not with the EPA Declaration Area, and is unlikely to require remediation to allow the continued use of the REF Site as a road. As such remediation is not considered to be required and is not proposed as part of the Activity. In light of the above, the Barangaroo Delivery Authority can be satisfied that the REF Site is suitable in its current state for its intended use. An unexpected finds protocol has been established with Appendix M should contamination be discovered on the REF Site during the carrying out of works as part of the Activity. 5.2.4 Sydney Regional Environmental Plan (Sydney Harbour Catchment) 2005 All existing Regional Environmental Plans are deemed to be State Environmental Planning Policies for the purposes of the EP&A Act. The REF Site is within the boundaries of the Sydney Harbour Catchment, as defined in Sydney Regional Environmental Plan (Sydney Harbour Catchment) 2005 (SREP). For development within the Catchment, the SREP lists several matters under Division 2 of Part 3 that must be considered by public authorities before they carry out an activity to which Part 5 of the EP&A Act applies. An assessment of the Activity against these matters is provided in Table 2 below. No boat storage facilities are proposed. 5.3 Sydney Local Environmental Plan 2012 As identified in Section 4.2.1, part of the REF site is located within the area covered by SLEP 2012. Figure 3 above identifies that the area of the REF Site zoned by SLEP 2012 is B8 Metropolitan Centre, with the exception of a small area of Sussex Street which is located under the Western Distributor and zoned SP2 Infrastructure. A number of heritage items, listed within the SLEP, are located within and in the vicinity of the REF Site, outlined below. The REF Site is includes the area that is referred to within the SLEP 2012 as “Sandstone retaining wall, palisade fence and Ficus hillii trees (adjacent Napoleon Street) (I1952)”. The REF Site is also located adjacent to a number of items that are listed as having local heritage significance within the SLEP 2012 Including: Former warehouse “MSB Stores” including interior (I880); Former warehouse “Grafton Bond Store” including interiors (I1813); and The Sussex Hotel (I1953). A SoHI has been prepared by TKD and is located at Appendix F and summarised at Section 5.5 of this REF. The SoHI concluded that the Activity would not have any significant impact on the locally and State listed items within and in the vicinity of the REF Site. The SLEP 2012 contains clauses relating to the preservation of trees (Clause 5.9) and flood planning (Clause 7.15). These clauses are not relevant to the Barangaroo Site. 5.4 NSW Legislation 5.4.1 Heritage Act 1977 The MSB Stores, the Grafton Bond Store and the Sussex Hotel are listed under the Heritage Act1977 and are located in the vicinity of the REF Site. Approval must be granted under section 57(e) to carry out any development in relation to the land on which a State heritage listed building, work or relic is situated. Approval must be gained under section 57(h) to damage or destroy any tree or other vegetation on or remove any tree or other vegetation from the place, precinct or land. JBA 10051 17 Barangaroo South Hickson Road Alterations | August 2015 An assessment of the impact of the Activity on these two requirements is included in Section 5.5. As outlined in Appendix F Activity would remove some trees that are subject to a local heritage listing and works in the immediate vicinity of State heritage items. No works are proposed not directly to State heritage items. The impact of the Activity on State heritage items is discussed at Section 5.5. The SoHI concludes that the Activity does not negatively impact the fabric or visual setting of these heritage items. As such an approval under section 57 of the Heritage Act 1977 is not considered to be required. However, the Heritage Council will be consulted in relation to the proposed works. 5.4.2 Threatened Species Conservation Act 1995 (TSC Act) The Activity involves the removal of 19 trees along Hickson Road. None of these trees can be classified as a vulnerable species or other category of species under the TSC Act. The Activity is not likely to cause significant impacts on any threatened species or populations, ecological communities or their habitats as listed under the TSC Act. 5.4.3 Rural Fires Act 1997 The requirement to obtain a Bushfire Safety Authority under s100B of the Rural Fires Act 1997 is triggered by development on bushfire prone land that involves the subdivision of land or a special fire protection purpose. The REF Site is not identified as being bush fire prone. The Rural Fires Act 1997 therefore does not apply to the Activity. 5.4.4 Contaminated Land Management Act 1997 The northern section of the REF Site is adjacent to, and overlaps with land that is subject to a Declaration No. 21122 as a Remediation Site under the Contaminated Land Management Act 1997 (CLM Act). A Remedial Action Plan has been prepared as part of a Voluntary Management Proposal (VMP) that has been agreed between the Barangaroo Delivery Authority and the EPA in relation to addressing the EPA Declaration (VMP No. 20101719). The RAP, dated 24 July 2013, has been approved by an EPA certified site auditor and the EPA through the VMP approval process. Investigations (detailed in the RAP and summarised in Appendix M) show that there is unlikely to be any contamination encountered in the REF Site that is associated with the EPA Declaration and that therefore requiring remediation. The investigations also conclude it is unlikely that contamination will be encountered that is of a nature that would require remediation to facilitate the continued use of the site as a road. To mitigate against the unlikely circumstances that such contamination is encountered however, the RAP includes an unexpected finds protocol. Any contamination identified as part of the works associated with the Activity will be managed in accordance with that protocol, as well as any other relevant provision within the RAP. 5.4.5 Water Management Act 2000 There are no watercourses which traverse the REF Site and the Activity is not located within 40 metres of ‘waterfront land’. As such a Controlled Activity Approval is not required to be obtained under s91 of the Water Management Act 2000. 18 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 5.4.6 Roads Act 1993 The Roads Act 1993 (Roads Act) grants a roads authority the power to undertake a range of works, and sets out the obligations for that Authority when undertaking those works. The Barangaroo Delivery Authority is the relevant roads authority for the REF Site, with the exception of the works that occur within Shelley Street and on Sussex Street, south of the intersection with Shelley Street, where the City of Sydney is the relevant road authority. As the REF Site is a Classified Road concurrence is required from RMS for the proposed road works. The REF must also be referred to the City of Sydney for approval under Section 138 of the Roads Act 1993 in relation to the works that are to be undertaken on land for which the City of Sydney Council is the appropriate Roads Authority. 5.5 Commonwealth Environment Protection and Biodiversity Conservation Act 1999 The provisions of the Environment Protection and Biodiversity Conservation Act 1999 require an action to be referred to the Commonwealth government should any of the prescribed triggers be met. A checklist of these triggers is provided in Table 3 below. The Activity does not meet any of the prescribed triggers, therefore it does not have to be referred to the Commonwealth government. No impact is anticipated No impact is anticipated Approvals The REF must be referred to the City of Sydney for approval under Section 138 of the Roads Act 1993 in relation to the works that are to be undertaken on land for which the City of Sydney Council is the appropriate Roads Authority. JBA 10051 19 Barangaroo South Hickson Road Alterations | August 2015 6.0 Environmental Impact Assessment The following section provides an outline of the potential impacts of the activity on the environment, and how these impacts will be managed. 6.1 Environmental Planning and Assessment Regulation 2000 Considerations Table 4 below provides a summary checklist of matters to be considered under clause 228 of the Environmental Planning and Assessment Regulation 2000. Table 4 – Summary of Activity Impacts Factor (a) any environmental impact on a community As demonstrated in this REF it is unlikely that there will be any adverse environmental impacts on the community during the construction phase such as noise, dust or vibration that cannot be addressed as part of the mitigation measures that will be put into place. Over the long term positive impacts on the functionality and visual amenity of the road are expected as a result of the works. (b) any transformation of a locality The works form part of the redevelopment of Barangaroo, and therefore form part of the positive transformation of the western edge of the CBD. The Activity itself is small component of the wider development and will not result in any transformation of a locality. (c) any environmental impact on the ecosystems of the locality Whilst the Activity requires the removal of existing street trees, this impact is necessary in order to be able to improve the existing road and footpath pavement, which is on balance, considered to be a more important outcome. As detailed at Appendix E, the loss of the trees will not result in adverse impacts on any sensitive ecosystems and environments. The street trees will be replaced with new cohesive planting as part of the landscaping scheme associated with the Activity. (d) any reduction of the aesthetic, recreational, scientific or other environmental quality or value of a locality The Activity does require the removal of street trees, some of which are heritage listed. These trees contribute to the aesthetic quality of the locality, however the Activity forms part of an overall upgrade to the streetscape in the area, which will involve the eventual replacement of these trees. (e) any effect on a locality, place or building having aesthetic, anthropological, archaeological, architectural, cultural, historical, scientific or social significance or other special value for present or future generations The Activity does require the removal of heritage listed street trees, however the Statement of Heritage Impact (SoHI) at Appendix F and summarised in Section 5.5 concludes that the removal of the trees is acceptable. (f) any impact on the habitat of protected fauna (within the meaning of the National Parks and Wildlife Act 1974) The REF Site is not located in a habitat area of protected fauna. It will not impact on the habitat of any protected fauna. (g) any endangering of any species of animal, plant or other form of life, whether living on land, in water or in the air The Activity is not likely to endanger any species of animal, plant or other living thing. (h) any long-term effects on the environment There will be no long term effects on the environment; mitigation measures will ensure temporary demolition and construction impacts are minimised. (i) any degradation of the quality of the environment Any minor and temporary impacts on the environment will be managed with mitigation measures to reduce impacts on noise, air, and water quality. 20 JBA 10051 Impact Long term: Positive Nil Nil Short Term: Minor Negative Long Term: Nil Minor Negative Nil Nil Nil Nil Barangaroo South Hickson Road Alterations | August 2015 Factor (j) any risk to the safety of the environment The activity is not likely to result in a risk to the safety of the environment. (k) any reduction in the range of beneficial uses of the environment The Activity will not remove or reduce beneficial uses. The Activity will in fact improve the existing road and footpath infrastructure as well as the stormwater infrastructure and therefore provide a beneficial use of the environment. (l) any pollution of the environment Minor air, noise, and water quality impacts from construction works may be generated. Mitigation measures are proposed to minimise pollution to the environment. (m) any environmental problems associated with the disposal of waste As part of the ESCMP provided at Appendix E, the contractor will be responsible for disposal of waste and any hazardous materials found on the site. The ESCMP identifies appropriate measures which will be implemented to ensure adverse environmental impacts are not incurred as a result of waste. (n) any increased demands on resources (natural or otherwise) that are, or are likely to become, in short supply No significant or substantial increased demands will be made on resources which are or likely to become in short supply. (o) any cumulative environmental effect with other existing or likely future activities The environmental impacts during the demolition and construction have been assessed in the context of the wider Barangaroo redevelopment, and mitigation measures will be undertaken to reduce the temporary impacts on air, water and noise. 6.2 Impact Nil Long term: Positive Nil Nil Nil Nil Evaluation of Alternatives As outlined in Section 1.2 the Activity has four key objectives, these are: to improve and upgrade the functionality of the existing roads within the REF Site; to improve the drainage in the area to reduce flood risk and manage the risk of sea level rise and thereby resolve existing ponding of water on Hickson Road which has the potential to flood the “Sussex Hotel; improve the amenity of the streetscape and its relationship with the proposed permanent public domain works at Barangaroo South; and respond to the raising of the ground level of the adjacent land at the Barangaroo South development site by up to approximately 900mm. A number of options to achieve these objectives were explored. These alternatives are outlined below. Do Nothing Adopting a ‘do nothing’ approach is not considered appropriate as, following construction of the Barangaroo South precinct, it would result in an unacceptable change in level between the existing road level and the future level of the adjoining footpath. It would also result in unacceptable pooling of stormwater following rainfall events. This situation is not desirable and therefore the ‘do nothing’ option is not a viable alternative. Stormwater It was considered possible to upgrade the stormwater management infrastructure only, thereby removing the problem of pooling stormwater or mitigate the flooding impacts potential future sea level rise. Although this option would address one of the objectives for the Activity it would not enhance the amenity of the street or address the change in levels between the future Barangaroo South precinct and the existing Hickson Road. This option was therefore discounted. JBA 10051 21 Barangaroo South Hickson Road Alterations | August 2015 Conclusion In light of the above evaluation, it is considered that the selected alternative (the Activity) is the most appropriate scope of works to address the specified objectives. 6.3 Stormwater Management A flood study of the Barangaroo South area was conducted by Cardno (provided in draft in Appendix C, a final flood study will be provided for comment). Assessment and mitigation measures within the study are summarised below. 6.3.1 Assessment The 100 year ARI map (Appendix C) shows that a significant area of ponding occurs in the Sussex Street low point to a depth in the order of 710mm (RL2.76). This shows that the existing Sussex hotel, with a floor level of RL2.78 will be close to being inundated in a 100 year ARI event. Figure 4 shows the existing low point and the impact that this point has on the 100 year ARI flood levels on the REF Site. Figure 4 – Existing 100 year ARI flood levels Source: Cardo Flood Study (Appendix C) Furthermore, Barangaroo is located downstream of a 16.3ha catchment. The existing pipe system and overland flow path traverse the REF site and drain the existing low point. However, construction of the Basement Car Park on the Barangaroo South Stage 1A site will severe the existing overland flow path and pipe system and require it to be diverted around the site. The flood study (Appendix C) compared different drainage arrangements for the site to identify the most appropriate stormwater management system to address the above issues. The design also takes into account the potential need to mitigate sea level rise impacts. The proposed piped drainage system will consist of 2700mm x 1500mm, 2100mm x 1200mm and 1800mm x 1200mm box culverts from the identified low point to the Darling Harbour outlet. Figure 5 shows the proposed alignment of the stormwater management system within the REF Site. The stormwater management system will flow west into Darling Harbour. 22 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 Figure 5 – Proposed Drainage Alignment Source: Cardo Flood Study (Appendix C) To reduce excessive ponding in Sussex Street, the 100 year event will be collected at the Sussex Street low point by a series inlet pits. The Cardno study shows that the Activity will have a positive impact on the area as there will be a reduction in potential flood depths within the REF Site. The existing maximum flood depths of 710mm during a 100 year ARI event will be reduced to 160mm following the completion of the Activity. Whilst the section of Sussex Street between Napoleon Street and Shelley Street will be regraded to raise the level in the low point from RL2.00m to approximately RL2.48m, this still results in a flood depth 120mm lower than the current flood level. The flood study results also show that for the 100 year ARI event that: There is a net reduction in the area of low hazard flooding due to the removal of the deep ponding in Sussex Street which occurs in the existing condition. The capacity of Hickson Road drainage system will be significantly improved as a result of the proposed diversion works and that there are no adverse consequences as a result of the alteration to the overland flow path. 6.3.2 Mitigation Measures A site wide Environmental Construction and Site Management Plan(ECSMP) (see Appendix D) applies to the Barangaroo South development site. The provisions of this plan will be applied to the Activity to manage any potential impacts during construction. No specific mitigation measures are required following the completion of the Activity. 6.4 Tree Removal An Arboriculture Report has been prepared by Tree Talk (Appendix E). Tree Talk examined the trees on the site on the REF Site, identifying their health and the potential impact of the Activity. Assessment and mitigation measures within the study are summarised below. 6.4.1 Assessment The Arboriculture Report (Appendix E) identifies six (6) trees within area of works requiring removal due to roadway level changes and road widening. Two trees were identified as being suitable for retention. These are located in the southern end of the study area. 6.4.2 Mitigation Measures Trees that are to be retained must be adequately protected so they can make a contribution to future landscaping and amenity. JBA 10051 23 Barangaroo South Hickson Road Alterations | August 2015 In order to manage and mitigate any adverse impacts on trees to be retained during the construction of the proposal, Tree Talk has recommended a range of protective measures. These measures are fully described in Appendix E and have been incorporated into the Mitigation Measures in Section 8. Tree No. 7 is large and of particular significance due to its association with a heritage item (see Section 6.5 below). It is likely to have a large percentage of roots under the road surface. The removal of bitumen must be performed with care so as to prevent damage to roots below, and once existing surfaces are removed an assessment of where roots are located will be useful in fill management. New paving levels may require modification to accommodate the tree roots, or alternatively, it may be necessary to bridge over the roots or install 'structural' or gap-graded soils. As part of the landscaping works associated with the Activity, trees will be planted along Hickson Road. These will partially offset the loss of existing trees in the area. 6.5 Heritage and Archaeology A Statement of Heritage Impact (SoHI) has been prepared by TKD, (Appendix F). This report is supported by an Archaeological Impact Statement, which was prepared by Casey and Lowe (Appendix G). Assessment and mitigation measures within these studies are summarised below. 6.5.1 Assessment A number of State and locally listed heritage items have been identified within and in the vicinity of the site including the MSB Stores, the sandstone retaining wall and trees, Grafton Bond Store, and the Sussex Hotel. TKD has assessed the Activity against the model questions within the NSW Heritage Office’s publication Statements of Heritage Impacts. Only two model questions were answered in the affirmative, comprising ‘new development adjacent to a heritage item’ and ‘tree removal or replacement’. As such, further questions have been addressed for these two specific areas. New development adjacent to a heritage item The location of the Activity and its relationship to the existing heritage items has been examined by TKD. It is considered that the Activity will not have a significant impact on the existing heritage items in the vicinity of the REF Site. Tree removal or replacement The Activity requires the removal of some existing street trees. The SoHI (Appendix F) identifies that one (1) of these trees are associated with the local listing of ‘sandstone retaining wall and trees’. However, the SoHI further identifies that the other trees in the area are not part of the early 20 th century planting and are therefore not heritage items. The SoHI has determined that the affected trees are not the ones to which the heritage significance is applied and further, despite the loss of trees, the remaining tree, along with those planted as part of the Activity will continue to exist as dominate streetscape elements. Once the proposed landscaping is undertaken to partially replace the removed trees, the visual curtilage provided by the existing trees will be reinstated. Archaeological Report The Archaeological report within Appendix G identifies that the REF Site is located above the potential archaeological remains of a string of early to late nineteenthcentury properties. The proposed Activity will involve relatively minor sub-surface 24 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 impacts and the road level will be raised rather than lowered. The stormwaterrelated works have only a very limited potential to impact on intact archaeological remains, as the existing services would have disturbed or removed any remains along their routes when they were installed. Therefore the Activity only has the potential to have a minor impact on the potential archaeological remains and any impacts would be localised. Conclusion The SoHI and archaeological report conclude that the Activity will not have any substantial or unmanageable heritage impacts. 6.5.2 Mitigation Measures In order to manage the potential impact to the archaeological remains within the REF Site, a S139(4) notification should be made to the Heritage Division, Office of Environment and Heritage, identifying exception type 1B, where ‘The excavation or disturbance of land will have a minor impact on archaeological relics including the testing of land to verify the existence of relics without destroying or removing them’. This notification will be made at least 7 days prior to undertaking the Activity. The Activity should be monitored when they are in the vicinity potential archaeological. The location and alignments of wall footings and any other archaeological remains should be recorded on plan and by the surveyor where possible if exposed. Artefacts relating to the 19th-century use of the area should be collected if disturbed by the works. A number of general management and mitigation measures are set out in Section 8 that address construction impacts. 6.6 Landscape and Visual A Landscape and Design Statement has been prepared by Aspect + Oculus (provided in Appendix D). Assessment and mitigation measures within the report are summarised below. 6.6.1 Assessment The proposed road and landscape works to Hickson Road will change and improve the existing streetscape character and amenity. The key upgrades to the streetscape include high quality granite paving, street tree planting and furniture elements. The landscape works proposed, along with the civil infrastructure improvements will integrate well with both the existing and new development on either side of the road. Despite the unavoidable removal of selected trees along Hickson Road as part of this and other separate applications, the Activity will ensure a continuation of the tree lined boulevard north of Napoleon Bridge through the retention of the high value trees and planting of new trees that support the current character. The planting of new street trees will partially offset the proposed removal of the existing trees in the short term, and will eventually improve the streetscape character in the long term. 6.6.2 Mitigation Measures As part of the landscaping works associated with the Activity, trees will be planted along Hickson Road to offset those that will be removed. As a result no further mitigation measures are required. JBA 10051 25 Barangaroo South 6.7 Hickson Road Alterations | August 2015 Construction Air Quality AECOM has prepared a letter addressing the potential air quality impacts of the Activity (Appendix I). Assessment and mitigation measures within the report are summarised below. 6.7.1 Assessment A range of air quality investigations have been undertaken as part of the Project / Development Applications submitted to the Department of Planning & Environment and approved by Minister to date. These relate to: Bulk Excavation and Basement Car Park (MP10_0023 - approved 2 November 2010); Commercial Building C4 (MP10_0025 - approved 3 March 2011); Commercial Building C5 (MP10_0227 - approved 24 April 2012); Commercial Building C3 (MP11_0044 - approved 24 April 2012); R8 R9 Residential Buildings (MP11_0002 - approved 28 June 2013); and Concrete Batching Plan (SSD 5967 – approved 11 April 2014). In the context of these approvals, Lend Lease has prepared, and regularly updates, a detailed Air Quality and Odour Management Sub-Plan. The Sub-Plan details prevention and management measures for air quality and odour issues associated with construction works at Barangaroo South. As the Activity will be undertaken by Lend Lease on behalf of the Barangaroo Delivery Authority, it is appropriate that the same air quality and odour management regime applied to the works on the Barangaroo South site be applied to the Activity. Dust can be generated from all types of construction activities involving soil, including excavation, handling, loading and unloading and wind erosion of exposed areas and stockpiles. Dust from the Activity will be managed in line with the ECSMP. The Activity would involve some diesel-powered plant and equipment. The combustion of diesel fuel generates a range of pollutant emissions such as oxides of nitrogen, carbon monoxide and particulate matter. Certain contaminants have associated odours which can be liberated to air during excavation and handling of spoil material. In the event that contaminated material is encountered, it will be addressed in accordance with existing procedures, including the unexpected find procedures, used at Barangaroo South and described within the ECSMP. It is not expected that the Activity or the equipment to be employed in executing the Activity will have any substantive impact on air quality in the immediate vicinity of the REF Site. 6.7.2 Mitigation Measures During the Activity the mitigation measures (where relevant to the nature of construction and ground conditions at the REF Site) set out in Section 5 of the Air Quality and Odour Management Sub-Plan prepared for Barangaroo South will be implemented. These include the following measures relevant to the Activity: 26 JBA 10051 Cover all loads departing the REF Site to minimise potential spillage / dust generation. Barangaroo South Hickson Road Alterations | August 2015 Immediately clean up any spills. Directly load spoil generated at the site into trucks for off-site disposal to minimise the need for stockpiling. Cover any stockpiled spoil material overnight during windy / rainy conditions, unless spoil is damp, and provide bunding around the base. Turn engines off while parked on site. Regularly tune and maintain equipment, plant and machinery to minimise visible smoke / emissions. 6.8 Construction Noise and Vibration Works are proposed to be generally undertaken between the hours of 7.00am and 7.00pm Monday-Friday and between 7.00am and 5.00pm on Saturdays. Occasional night works, and works on Sundays or public holidays, would be required where dictated by authority requirements (such as road closures) or for worker or public safety. This is consistent with the ECSMP (Appendix D). A report on noise and vibration impacts associated with the Activity was prepared by Wilkinson Murray (Appendix J). Assessment and mitigation measures within the report are summarised below. 6.8.1 Assessment Noise The report identified 15 receptors that may be affected by construction noise as a result of the construction. These receptors are mainly located in Millers Point and are identified by Figure 2-1 in Appendix J. Noise Management Levels based on the EPA Interim Construction Noise Guidelines (ICNG) were determined for these identified receptors. Wilkinson Murray then modelled various construction scenarios to determine the likely acoustic impact of the Activity on the receptors. A review of the results indicated that noise from the proposed construction works associated with the Hickson Road realignment has the potential to exceed the noise management levels during periods of works which are in close proximity to the surrounding buildings. In particular this applies to some types of out of hours works on Saturdays at the residences along Hickson Road. The predicted noise levels generally comply with the Highly Noise Affected limit of 75dBA at these residences, with the exception of some hydraulic hammering activities due to the requirement to add a + 5dB modifying factor. At Napoleon on Kent some exceedances are predicted (particularly to the upper floors) during use of hydraulic hammers where they are not shielded by the Napoleon Street retaining wall or the Sussex Hotel. Due to the close proximity of commercial receivers, including the Sussex Hotel, significant exceedances are predicted of the Noise Management Levels when works are at their closest. There are other construction works associated with Barangaroo and other projects in the surrounding area that will be under various stages of construction when the Hickson Road realignment works are scheduled (March 2016 – March 2017). With the exception of the Sussex Hotel where the Realignment works occur directly adjacent it is considered the other projects will dominate the noise levels at the identified receivers due to both the greater scope of works and closer proximity. JBA 10051 27 Barangaroo South Hickson Road Alterations | August 2015 Wilkinson Murray consider that the procedures and management measures that are included in the existing site Environmental Management Plan are appropriate to address any noise generated by the Hickson Road Realignment works and accordingly no additional specific noise and vibration have been identified with the exception that activities such as hydraulic hammering and saw cutting are restricted to standard construction hours and are not scheduled for the extended construction on Saturday afternoons. This recommendation is included in the Mitigation Measures below. Vibration Vibratory impacts are predicted at two locations proximate to the REF Site, namely the Sussex Hotel and the stairway adjacent to the Sussex Hotel. Certain construction activities, such as dynamic compaction, have the potential to exceed the levels established in the EPA guidance document Vibration a Technical Guideline. 6.8.2 Mitigation Measures Noise and vibration will be managed within a specific noise and vibration sub-plan within the Activity ECSMP. Activates such as hydraulic hammering and saw cutting of concrete will be restricted to standard construction hours and will not be scheduled for the extended construction on Saturday afternoons. 6.9 Crime Prevention 6.9.1 Assessment From a crime prevention perspective, there are no evident concerns regarding antisocial and/or criminal behaviour, resulting from the Activity. 6.9.2 Mitigation Measures The report suggests that anti-graffiti coatings should be applied to exposed surfaces and that additional lighting within REF Site should be consistent with the LED lighting being installed by Council. 6.10 Contamination An assessment of the land contamination issues associated with the Activity has been carried out by AECOM, with consideration of the RAP for Barangaroo South. (Appendix M). Assessment and mitigation measures within the report are summarised below. 6.10.1 Assessment The Activity will not require the excavation of soil (other than base and sub-base materials used in the construction of the existing road surface) from the REF Site. All excavated material will be disposed offsite to a NSW EPA landfill in accordance with the Department of Environment, Climate Change and Water, (2009) Waste Classification Guidelines Part 1: Classifying Waste. The AECOM assessment divided the REF Site into two portions: 28 JBA 10051 The ‘southern portion’, which extends along the eastern boundary of that part of Barangaroo South known as Stage 1A (outside the NSW EPA Declaration Area). The ‘northern portion’, which extends up to and over the southern end of that portion of the NSW EPA Declaration Area that is located within Hickson Road. Barangaroo South Hickson Road Alterations | August 2015 Within the northern portion concentrations of contaminants of potential concern (CoPC) were recorded as being less than: the risk based remediation criteria developed for the Stage 1A development (i.e. the ‘Area A’ Site Specific Target Criteria [SSTCs] derived for areas outside the ORWS basement [ORWS Amended RAP, AECOM, 2011]); and the applicable NEPM (NEPC, 1999, as amended 2013) soil criteria for a commercial/industrial land use. In addition, all BTEX, TPH and PAH concentrations were reported at concentrations less than the laboratory limit of reporting. AECOM has therefore concluded that gasworks related contamination is not located within this portion of the REF Site and that subsequently contaminated materials are unlikely to be uncovered during the Activity. Importantly, the northern end of the REF Site is also outside the extent of remediation as provided for in the RAP demonstrating that remediation of the subject area is not considered to be required to facilitate removal of the NSW EPA Declaration. Within the southern portion: the depth to bedrock at BH43 was observed to be 0.57 m bgl and 0.9 m bgl at BH09. Borehole TBH09 was abandoned at a depth of 0.64 m bgl within a thick asphalt layer; gasworks related wastes were not identified in the fill or underling natural materials. No other visual or olfactory signs of contamination were observed during the sampling works; and the CoPC concentrations reported in samples collected from BH09 and BH43 were less than both the risk based remediation criteria developed for removal of the NSW EPA Declaration (the SSTCs for unsaturated soils as detailed in the VMP/Block 4 RAP (AECOM, 2013b) and the applicable NEPM (NEPC, 1999, as amended 2013) criteria for a commercial/industrial land use. Due to the nature of the roadbase material identified at TBH09, the sample was not analysed. The AECOM report states that any contamination that may be discovered in the REF Site during the Activity is not likely to be associated with the EPA Declaration Area and that the REF Site is likely to be suitable in its current state for the proposed use and would not require remediation. Remediation of contamination that may be identified is unlikely to be required because contamination typically associated with fill and the presence of a concrete and/or asphalt over the entire area is likely to prevent a complete exposure pathway between a future land user (e.g. pedestrian) and the underlying contamination (if present). Fill material is likely to be required to facilitate the Activity. The source of the required material cannot be determined at this stage; however sandstone material may be available from other projects within the CBD depending on construction timing. Fill material that is required to be imported from off site will be certified suitable for this activity. Imported fill material will be either VENM or it will be engineering material that has been deemed suitable for use and will be imported subject to an exemption from waste licencing issued in accordance with Clause 91 and 92 the Protection of the Environment Operations (Waste) Regulation 2014. JBA 10051 29 Barangaroo South Hickson Road Alterations | August 2015 6.10.2 Mitigation Measures An unexpected finds protocol has been established within RAP and is outlined in the ECSMP at Appendix D. This will be applied if contamination is identified during the carrying out of works associated with the Activity. While the Activity is unlikely to require excavation of material other than the existing road pavement and road sub base materials, the unexpected finds protocol will be undertaken to mitigate risks to human health in the unlikely event that contamination is found to be present in association with the Activity. 6.11 Geotechnical A geotechnical report was prepared by Coffey (Appendix L). Assessment and mitigation measures within the report are summarised below. 6.11.1 Assessment Coffey undertook a geotechnical investigation within the REF Site to determine the suitability of the area for the Activity. Twelve boreholes were drilled at points within the REF Site to inform the assessment. The subsurface conditions in the area can be characterised as comprising mostly granular fill, overlying estuarine sediments in some places or sandstone bedrock. The report concluded that the REF Site is suitable for the Activity subject to measures being implemented as outlined below. 6.11.2 Mitigation Measures Following the assessment, Coffey made the following recommendations: For areas featuring loose material: – Removal of a 200mm thick layer of material and replacing with a granular material containing not more than 15% fines (silt and clay), and – compacting with a suitable roller or flat plate packer to 98% Standard Dry Density – Site-won material may be suitable for this purpose, but would need to be tested for confirmation of suitability. Such tests should include Atterberg Limits tests, California Bearing Ratio (CBR) tests and Particle Size Distribution (grading) tests. Other areas should be proof-rolled prior to installation of the service. Where invert level is below the water table, it may be necessary to install a concrete blinding layer. Dewatering may be necessary to carry out work at or below the invert level. No specific surface preparation is recommended where the stormwater pipe will be founded on rock. 6.12 Traffic and Transport The Activity involves works to a public road, a summary of the anticipated impacts on traffic and transport is included below. A Traffic and Transport report has been prepared by ARUP and is included as Appendix N. 6.12.1 Assessment Operational Traffic The ease of traffic flow on urban roads is expressed as a ‘Level of Service’ (LoS) LoS is expressed from ‘A’ to ‘F’, ‘A’ being free flowing and ‘F’ being heavily 30 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 congested. For intersections in the Sydney CBD during commuter peak hours, achieving a LOS E or better is generally considered acceptable. The traffic modelling for the Hickson Road / Napoleon Street intersection indicates that once the proposed road works are completed the intersection will operate satisfactorily in both the AM and PM peak hours at a Level of Service D at the completion of the Barangaroo Precinct including Headland Park and Barangaroo Central. The traffic signals at this intersection will be coordinated with those at the mid-block signalised crossing to be constructed at Sussex Street (under the Sussex Street Bridge) to ensure traffic operates efficiently along Sussex Street. Operational Movement and Design The proposed layout of Hickson Road and Sussex Street has been designed in accordance with relevant guidelines and standards, most notably the Austroads Guide to Road Design and Australian Standards for Parking Facilities (AS 2890). The vehicle swept path analysis undertaken by ARUP demonstrates that the proposed design can satisfactorily accommodate the turning manoeuvres of the above design vehicles. All movements are able to be executed independently without crossing the path of another vehicle. The review of the proposed road arrangements demonstrate that the configuration is suitable for the intended movements and will provide adequate capacity for the level of development completed during Stage 1A. Construction Traffic During the Activity, roads through the REF Site will remain partially open at all times. Traffic around the REF site will be managed in line with the indicative staging and frame work management measures outlined in Appendix N. The works propose no changes to the number of traffic lanes on Hickson Road and Sussex Street compared to the existing situation. A dedicated right turn bay will be provided at all times during constructions for vehicles to travel from Sussex Street into Napoleon Street. Therefore there will be no change to the carrying capacity of the road network during the construction period relative to the current situation. To support the construction activity and maintain an acceptable level of traffic operation, existing on-street parking bays will be temporarily suspended on Hickson Road and Sussex Street. To support the construction works sections of the Hickson Road and Sussex Street footpaths may be also be closed for pedestrian access. The report makes a range of recommendations to minimise the temporary impacts of the works which are detailed in the Mitigation Measures below and will be used to inform a more detailed traffic management plan (TMP) that will form part of the Activity-specific CEMP. This will be finalised and agreed with all relevant roads authorities before the commencement of the Activity. Staging As the Activity will coincide with the closure of George Street due to the installation of light rail in Sydney CBD, allowance has been made for temporary bus stops within the REF Site. A temporary bus stop will be located north of the Napoleon Street/Hickson Road intersection in both directions. The Activity will be managed (with the BDA) in such a way as to allow for the continued operation of both northerly and southerly bus stops throughout construction. JBA 10051 31 Barangaroo South Hickson Road Alterations | August 2015 6.12.2 Mitigation Measures A Traffic Management Plan will be created to complement and be implemented alongside the ESCMP. In order to minimise the impacts of the closure of the footpaths for pedestrian access the following measures will be considered: erection of hoardings to permit pedestrian movement adjacent to the construction zone and separate pedestrians from construction vehicles; installation of signage indicating recommended pedestrian routes; maintaining access to either the western or eastern footpaths along Sussex Street and/or Hickson Road throughout the construction period; maintaining access to the temporary bus stops to be located north of napoleon Street; and maintaining safe crossings at the Kent Street/Margaret Street/ Napoleon Street intersection and Sussex Street / Shelley Street intersection. 6.13 Construction Management An ECSMP has been prepared by Lend Lease (Appendix D) this outlines the framework and principles to guide the preparation of a detailed Construction Environmental Management Plan (CEMP) by the appointed contractor prior to the commencement of works. 6.13.1 Assessment The ESCMP outlines high level site management guidelines for: site management, including site establishment and construction methodology; environmental management, including training responsibilities and contacts; implementation, including management plans to mitigate any impacts; and ongoing monitoring and review procedures. These guidelines will establish the appropriate site management principles which, when fully detailed as part of the ECSMP, will ensure that potential impacts associated with the management of the demolition and construction activities do not adversely impact upon the community. A stakeholder engagement strategy has also been provided to outline consultation methods and procedures which will be undertaken throughout the process. This includes complaints handling and management procedures. With the implementation of these above procedures and the development of a site specific CEMP prepared by the selected contractor, all potential construction impacts are expected to be managed. 6.13.2 Mitigation Measures The Activity should be carried out in accordance with the ECSMP and the future more detailed CEMP, to be prepared by the selected contractor. Works to utilities services will be undertaken in accordance with the relevant utilities standards. 32 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 6.14 Cumulative Environmental Impacts In light of the assessment in Sections 5, it is considered that the Activity does not give rise to any cumulative environmental impacts that cannot be appropriately managed through the mitigation measures identified in Section 8. Clause 228 of the EP&A Regulation requires the assessment of any cumulative environmental impacts with other existing or likely future activities. Accordingly, this REF has considered the cumulative impacts of all phases of the Activity. The Activity will occur between March 2016 and March 2017 and will coincide with works associated with the following projects: construction of R1/R7 Residential Buildings; Block 4 Remediation Works; Block 5 Remediation Works; Stage 1A Public Domain Works; Stage 1C Remediation and Earthworks; and works to Barangaroo Central – Waterfront Promenade. The Activity can reasonably be expected to intensify activity in this locality. In this regard, it should be noted that the works are to be undertaken by Lend Lease (on behalf of the Barangaroo Delivery Authority), this means that every aspect of the construction works at the bridge site can be managed seamlessly with, and in the same manner as, activities on the Barangaroo site by Lend Lease on behalf of the Barangaroo Delivery Authority. JBA 10051 33 Barangaroo South Hickson Road Alterations | August 2015 7.0 Justification for the Proposal In general, investment in projects can only be justified if the benefits of doing so exceed the costs. Such an assessment must consider all costs and benefits, and not simply those that can be easily quantified. As a result, the EP&A Act specifies that such a justification must be made having regard to biophysical, economic and social considerations and the principles of ecologically sustainable development. This means that the decision on whether an activity can proceed or not needs to be made in the full knowledge of its effects, both positive and negative, whether those impacts can be quantified or not. The Activity involves upgrade works to the existing Hickson Road, the stormwater management infrastructure, and improvements to the public domain and services along Hickson road. The assessment must therefore focus on the identification and appraisal of the effects of the proposed change over the REF Site’s existing condition. Various components of the biophysical, social and economic environments have been examined in this REF and are summarised below. 7.1 Social and Economic The Activity will have a number of positive social and economic impacts, including: to improve and upgrade the functionality of the existing roads within the REF Site; to resolve existing ponding of water on Hickson Road in storm events, including ponding that has the potential to flood the Sussex Hotel in a 100 year ARI event by improving drainage in the area to reduce future flood risk and manage the risk of sea level rise around Barangaroo South; to improve the amenity of the streetscape and its relationship with the proposed permanent public domain works at Barangaroo South; and responding to the raising of the ground level of the adjacent land at the Barangaroo South development site by up to approximately 900mm through increasing the level of the adjoining roads to better relate to the new ground level at Barangaroo South. The construction works have the potential to generate negative social and economic impacts due to disturbances to the local visual and acoustic amenity and the LoS of the local road network during the Activity. The Activity will also have a temporary impact on State and locally listed heritage items, as outlined in Appendix F, Appendix G and Section 5.5. Construction impacts will be temporary in nature, limited to the construction duration, and can be largely managed through the Mitigation Measures set out in Section 8. Longer term impacts, such as those impacts to the identified heritage items, have been assessed within this REF and will not have a significant adverse effect provided that the mitigation measures set out in Section 8 are followed. 34 JBA 10051 Barangaroo South 7.2 Hickson Road Alterations | August 2015 Biophysical The environmental impact assessment of the Activity has demonstrated that there will be no adverse biophysical impacts. While the works require the removal of eighteen (19) trees, this impact is necessary in order to enable the Activity and to avoid causing the trees to become a hazard in the future if left in place. As part of the landscaping works associated with the Activity replacement trees will be planted within the REF Site. This replacement planting of American Tulip Trees, Urbanite Ash, and Cabbage‐tree Palms will offset the loss of the existing trees from the REF Site (see Section 5.6). The Activity is therefore unlikely to result in adverse impacts on any sensitive ecosystems and environments. 7.3 Ecologically Sustainable Development The EP&A Regulation lists 4 principles of ecologically sustainable development to be considered in assessing a project. They are: the precautionary principle; intergenerational equity; conservation of biological diversity and ecological integrity; and improved valuation and pricing of environmental resources. An analysis of these principles follows. Precautionary Principle The precautionary principle is utilised when uncertainty exists about potential environmental impacts. It provides that if there are threats of serious or irreversible environmental damage, lack of full scientific certainty should not be used as a reason for postponing measures to prevent environmental degradation. The precautionary principle requires careful evaluation of potential environmental impacts in order to avoid, wherever practicable, serious or irreversible damage to the environment. This REF has not identified any serious threat of irreversible damage to the environment and therefore the precautionary principle is not relevant to the proposal. Intergenerational Equity Inter-generational equity is concerned with ensuring that the health, diversity and productivity of the environment are maintained or enhanced for the benefit of future generations. The Activity has been designed to benefit both the existing and future generations by: minimising the impact on the heritage listed items for future generations to appreciate and enjoy by avoiding impacts to listed street trees adjacent to the Sussex Hotel, and improving the public domain thereby allowing greater appreciation of other heritage items in the vicinity of the REF Site; implementing safeguards and management measures to protect environmental values; and improving the public domain in the area by reducing the local flood risk and improving the relationship between the road surface within the REF Site and the Barangaroo South precinct. The Activity has integrated short and long-term social, financial and environmental considerations so that any foreseeable impacts are not left to be addressed by future generations. JBA 10051 35 Barangaroo South Hickson Road Alterations | August 2015 Conservation of Biological Diversity and Ecological Integrity The principle of biological diversity upholds that the conservation of biological diversity and ecological integrity should be a fundamental consideration. The Activity would not have any significant effect on the biological diversity and ecological integrity of the study area. Improved Valuation, Pricing and Incentive Mechanisms The principles of improved valuation and pricing of environmental resources requires consideration of all environmental resources that may be affected by a proposal, including air, water, land and living things. Mitigation measures for avoiding, reusing, recycling and managing waste during construction and operation would be implemented to ensure resources are used responsibly in the first instance. 36 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 8.0 Summary of Impacts The Activity is subject to assessment under Part 5 of the EP&A Act. This review of environmental factors (REF) has examined, and taken into account to the fullest extent possible, all matters affecting or likely to affect the environment by reason of the proposed activity. The Activity, as described in the REF, best meets the stated objectives but will result in some minor impacts to existing street trees and heritage items. The implementation of the mitigation measures detailed in Section 8 of this REF and as recommended by the various specialist reports (refer to Appendices) will serve to ameliorate or minimise these expected impacts. The Activity will also result in a number of positive impacts, including: to improve and upgrade the functionality of the existing roads within the REF Site; to resolve existing ponding of water on Hickson Road in storm events, including ponding that has the potential to flood the Sussex Hotel in a 100 year ARI event by improving drainage in the area; and to improve the amenity of the streetscape and its relationship with the proposed permanent public domain works at Barangaroo South. Short-term negative impacts during construction can be acceptable managed through the application of appropriate management measures. These are set out in in the ECSMP and the CEMP. On balance, the Activity is considered to be justified. The environmental impacts associated with the Activity are not likely to be significant and the proposal will not impact on any matters of national environmental significance. Having regard to the above, it is concluded that the Activity is not likely to significantly affect the environment within the meaning of section 112 of the EP&A Act. JBA 10051 37 Barangaroo South Hickson Road Alterations | August 2015 9.0 Mitigation Measures The mitigation measures outlined in this document and summarised in this section, form part of the proposal and will be incorporated into the detailed design and implemented during the construction phases associated with the pedestrian bridge. The implementation of these safeguards and measures will ensure that the proposed works associated with the Activity will not have a significant impact on the environment. This REF has been prepared in accordance with the plans and supporting information described in Table 5 below. Community Notification and Consultation 1.1 Stakeholder engagement should be undertaken in accordance with the Stakeholder Engagement Strategy prepared for the Barangaroo Site. 2. Construction Work Site 2.1 All relevant legislation and associated regulations are to be complied with. 2.2 Traffic during construction will be managed in accordance with AS 1742.3 - 1996 “Manual of Uniform Traffic Control Devices Part 3: Traffic Control Devices for Works on Roads”. 2.3 Where possible, existing traffic access will be used and maintained. 2.4 Where possible, protective site safety fencing will be installed around the construction site. 2.5 The hours of demolition or construction, including delivery of materials to and from the site, shall be restricted as follows: a) between 7.00am and 7.00pm, Monday to Friday, inclusive; b) between 7.00am and 5.00pm, Saturdays; and c) no work or deliveries on Sunday and/or public holidays. 2.6 The worksite is to be left tidy and rubbish free each day prior to leaving site and at the completion of the works. 2.7 No hazardous materials or dangerous goods will be used or stored on site. 2.8 No plant and equipment storage areas or bunded areas for storage of petroleum, distillate and other chemicals will be permitted within the site. 2.9 The contractor will meet all workplace safety legislation. 2.10 All materials on-site or being delivered to the site must be contained within the site. The requirements of the Protection of the Environment Operations Act 1997 are to be complied with when placing/stockpiling 38 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 loose material or when disposing of waste products or during any other activities likely to pollute drains or watercourses. 2.11 Signage at key intersections approaching the site should be installed to inform drivers of the construction and the detour routes that are in place. 2.12 The final extent of any construction zone will be subject to an application and approval by the road authority, which will also include the submission of traffic control plans to be prepared by an RMS accredited contractor. 2.13 Measures to mitigate temporary footpath closures should include: Erection of hoardings to permit pedestrian movement adjacent to the construction zone and separate pedestrians from construction vehicles Installation of signage indicating recommended pedestrian routes; maintaining access to the temporary bus stops to be located north of napoleon Street; Maintaining access to either the western or eastern footpaths along Sussex Street, as well as the Napoleon Street eastern footpath, throughout the construction period 3. Excavation and Construction 3.1 A copy of the approved and plans, specifications and documentation shall be kept on site at all times and shall be available for perusal by any officer of Council. 3.2 Where possible, site hoardings are to be installed around demolition and construction areas to prevent public access to the site. 3.3 During construction, should the site turn out to be heavily contaminated, contaminated soil would have to be handled as contaminated waste, any on-site spot remediation that may be required can be undertaken as Category 2 Remediation under SEPP 55. 3.4 Works to utilities services will be undertaken in accordance with the relevant utilities standards. 4. Tree Protection 4.1 Each tree to be retained should be fenced off to the extent of the Tree Protection Zone excluding all activity unless otherwise indicated in the report. The fencing is to exclude storage of materials, site sheds, machinery, run off (eg concrete, or chemical treatments), the movement of pedestrian or vehicular traffic, the temporary, location of services, eg trenches, pits or canals. 4.2 No works should be performed within the fenced area without specific consideration given. This includes mechanical scouring of existing vegetation and changes of soil levels (either the addition or removal). 4.3 Where access is required adjacent to a tree eg along a driveway trunks and branches will require protection 4.4 For large significant trees fencing should be 1.8m in height of cyclone chainmesh or similar. Other vegetation can be isolated using star pickets and orange parra-webbing8. 4.5 Site Signage on the fencing reminds workers of specific reasons for the fencing – for example: ‘This fencing is not to be moved’. ‘This Tree Protection Zone is to isolate vegetation from the building process’. No equipment or materials are to enter or be stored within the fenced area and no chemicals or run off enter this protected zone. Should fencing need to be moved for any reason first contact …Site Manager on 9999 9999 or Arborist on 0417 022 692’. 4.6 Where a tree trunk is likely to be knocked (eg site access along a driveway) it must be protected from possible damage. Protection material should cover from the base of the tree to 2m (or to a level that is likely to be damaged by passing equipment, branch protection also may be required. Where access or works within TPZ are required soil surface protection must be installed i.e. a platform (constructed of steel material or timber/rumble boards capable of supporting and distributing the weight over a layer of mulch) and geotextile fabric To accommodate works some pruning might be required. All pruning should be performed by a Qualified Tree Surgeon to ensure pruning is to AS 4373- 1996 ‘Australian Standards for Pruning Amenity Trees, see Appendix D). (If greater than 10% council approval may be necessary). The TPZ should ideally be maintained as least as well as was previously experienced by the tree. Where there are significant changes to the trees normal water supply such as diversion of previous run off or in extended periods of dry, watering should take place. (Check by digging down 1015cm to ensure water is wetting the root zone and not running off). The demolition process should occur well outside the tree protection zone and ideally be greater than the drip zone or 6m from any trees to be retained. Where this is not possible, a protection layer of mulch (100mm of Eucalyptus wood mulch or similar) should be laid over the area of encroachment. Where vehicular access is required across the mulch layer, further root protection should be constructed with steel material or timber capable of supporting vehicles and distributing their weight. Pruning of foliage may be required. Within the drip zone of a tree to be retained, demolition should be performed by hand to ensure that the tree is not damaged. Where works or site access is proposed within the canopy of a tree, careful consideration of the appropriate protection is required. Works such and scaffolding installation or where tall machinery is to pass, can damage foliage of trees on the site or overhanging from adjacent land. Pruning should be undertaken to prevent damage and this should be performed to AS4373. Note: Where trees overhang from adjacent land, Council and tree owner approval is required. Trunks and branches are important for tree structural support and anchorage, nutrient transport and nutrient storage. Damage to trunk and branches are usually caused by works too close to a tree or during site access for other areas. Damage to the trunk or branches can affect tree stability and allow pathogen or disease to enter. In most cases the whole tree and TPZ should be isolated from the works process by Tree Protection fencing. Where access is required near a tree the trunk and branches should be wrapped and boarded for protection from damage. It is important to minimise soil compaction by isolating the tree and most of the tree roots zone from site works or significant changes Tree decline is often not evident for several years. Where works are required within the TPZ, soil surface protection methods must be undertaken. This involves adding mulch and rumble boards. Weight distribution over the area with the use of rumble boards or steel plates over mulch over geotextile fabric. Where works are required within the SRZ it is important to minimise damage and avoid damage to roots providing tree anchorage. All works within SRZ should be performed using hand tools and to specific arboricultural specifications and preferably with your AQF Level 5 arborist on site to ensure that no roots of 20mm or greater are damaged. Barangaroo South Hickson Road Alterations | August 2015 4.24 When heavy equipment passes over them or materials are stored within their growing area. Installation of services, paving and landscaping within the TPZ must be carefully consider likely damaging tree roots and loss of air and oxygen in the soil. 4.25 All tree works recommended in this report should comply with the Australian Standard for Pruning of Amenity Trees AS4373-2007, and be performed by a suitably qualified and experienced tree surgeon, preferably with membership of a recognised organisation. Tree Contractors Association (TCA) or National Arborists Association of Australia (NAAA). 4.26 All equipment used should be cleaned before use and between trees with either 10% bleach 90% water or 70 % Metho 30% water. 4.27 Where a tree is suspected of being diseased the wood should be disposed of with care and not used for mulch. 5. Heritage 5.1 Any heritage relics or sites discovered during construction shall be reported to the Barangaroo Delivery Authority. Any proposal to disturb any suspected relics or heritage sites may require consultation with the NSW Heritage Office. 5.2 Any evidence of Aboriginal relics discovered during construction shall be reported to the Barangaroo Delivery Authority. Any proposal to disturb suspected relics or Aboriginal heritage site may require consultation with OEH. All work is to cease on site until the relevant permit is received or advice is provided by the Barangaroo Delivery Authority that work can recommence. 5.3 a S139(4) notification should be made to the Heritage Division, Office of Environment & Heritage, identifying exception type 1B, where ‘The excavation or disturbance of land will have a minor impact on archaeological relics including the testing of land to verify the existence of relics without destroying or removing them’. This report should accompany the application. 6. Air Quality 6.1 Section 5 of the Air Quality and Odour Management Sub-Plan prepared for Barangaroo South must be implemented throughout construction. 7. Noise and Vibration 7.1 The Noise and Vibration Management Sub-Plan prepared for Barangaroo South must be implemented throughout construction. 7.2 Activities such as hydraulic hammering and saw cutting are restricted to standard construction hours and are not scheduled for the extended construction on Saturday afternoons 8. Geotech 8.1 For areas featuring loose material: Removal of a 200mm thick layer of material and replacing with a granular material containing not more than 15% fines (silt and clay), and compacting with a suitable roller or flat plate packer to 98% Standard Dry Density Site-won material may be suitable for this purpose, but would need to be tested for confirmation of suitability. Such tests should include Atterberg Limits tests, California Bearing Ratio (CBR) tests and Particle Size Distribution (grading) tests. 8.2 Other areas should be proof-rolled prior to installation of the service. 8.3 Where invert level is below the water table, it may be necessary to install a concrete blinding layer. 8.4 Dewatering may be necessary to carry out work at or below the invert level. JBA 10051 41 Barangaroo South Hickson Road Alterations | August 2015 8.5 No specific surface preparation is recommended where the stormwater pipe will be founded on rock. 9. Water Quality 9.1 Section 5 of the Water Quality Management Sub-Plan prepared for Barangaroo South must be implemented throughout construction. 9.2 An Erosion and Sediment Control Plan must be developed prior to construction, outlining specific requirements to ensure protection of the surrounding environment. The plan should include the following measures: Protect stormwater kerb inlets with filter fabrics and sediment control ‘socks’. Keep the work zone clean at all times. Classify material to be excavated during the services investigation stage. Directly load spoil generated at the site into trucks for off-site disposal to prevent runoff from excavated material entering the stormwater system. Ensure no on-site storage of fuel, hydraulic oil or chemicals during the works. Refuel machinery using mini-tankers. Ensure spill kits are available at all times. Keep trucks in the work zone on the existing roadway surface at all times. Cover loads and check wheels prior to exiting the site to ensure no dirt is tracked onto Sussex Street. Ensure all erosion and sediment controls are in place prior to any work taking place and checked daily. 10. Waste Management 10.1 All waste generated by the Activity, shall be beneficially reused, recycled or directed to a waste facility lawfully permitted to accept the materials in accordance with the DECCW’s “Waste Classification Guidelines (2008)” and the Protection of the Environment Operations Act 1997. 10.2 Where available, recyclable site and construction waste are to be recycled in accordance with the NSW Government’s “Waste Reduction and Purchasing Policy (WRAPP guidelines)”. Waste oil will be sent to approved recyclers. 10.3 The type and volume of all waste materials (e.g. excavation material, green waste, bricks, concrete, timber, plasterboard and metals) will be estimated prior to demolition and construction with the destination specified either for on-site re-use or recycling, or off-site re-use or recycling and as a last resort disposal at a licensed waste facility. 10.4 No burning or burying of wastes is permitted on site. 10.5 Non-recyclable waste and containers are to be regularly collected and disposed of at a licensed landfill or other licensed disposal sites in the area. 10.6 Waste management practices for the Proposal are to follow the resource management hierarchy principles embodied in the Waste Avoidance and Resource Recovery Act 2001. These practices include: avoid unnecessary resource consumption; recover resources (including reuse, reprocessing, recycling and energy recovery); and dispose (as a last resort). 11. Contamination 11.1 If any contaminated materials or hazardous substances (for example, asbestos, polychlorinated biphenyls, synthetic mineral fibre, lead dusts, paint containing lead and ozone depleting substances) are encountered during demolition and construction then safe work method statements and appropriate documented practices are to be implemented. 42 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 11.2 Contamination of the site during construction works is to be avoided. 11.3 Any contaminated materials or hazardous substances are to be classified first and then stored, transported and disposed of in accordance with OEH requirements at an OEH licensed waste facility. 11.4 Should any new information come to light during demolition or construction works which has the potential to alter previous conclusions about site contamination then the Managing Contractor must be immediately notified and works must cease. Works must not recommence on site until the site is remediated in accordance with an approved Remedial Action Plan, and a Validation and Monitoring Report together with a notice of completion of remediation pursuant to clause 18 of State Environmental Planning Policy No 55 – Remediation of Land has been submitted to and approved by OEH. 11.5 Asbestos removal and management in NSW is regulated under the Occupational Health and Safety Act 2000 and Occupational Health and Safety Regulation 2001. The handling of asbestos and asbestos work must be carried out in accordance with the following documents published by the NOHS Commission in August 1988, as in force from time to time (clause 259): “Guide to the Control of Asbestos Hazards in Buildings and Structures [NOHSC: 3002 (1988)]”; and “Code of Practice for the Safe Removal of Asbestos [NOHSC: 2002 (1988)]”. 11.6 The Regulation requires licensed contractors to contact WorkCover NSW of each bonded asbestos removal project of 10m2 or more. 11.7 Any contaminated material (i.e. lead paint) is to be classified first and then stored, transported and disposed of in accordance with OEH requirements at an OEH licensed waste facility 11.8 Excavations within the subject areas will be visually inspected by a qualified environmental engineer/scientist; 11.9 If the subsurface soils are significantly different to those described in Section 4.0 (i.e. based on visual and olfactory observations), validation soil sampling of the excavation base and walls will be conducted. If required, the validation soil samples will be collected as follows: 11.10 The soil analytical results will be compared to: - for excavations within the Declaration Area - the unsaturated SSTC (VMP/Block 4 RAP [AECOM 2013b]); or - for excavations outside the Declaration Area: - the NEPM (NEPC, 1999, as amended 2013) soil criteria for a commercial/industrial land use; or - complete a site specific risk assessment could be undertaken. It is noted that remediation of contamination that may be identified in the subject area is unlikely to be required based on a site specific risk assessment because contamination typically associated with fill and the presence of a concrete and/or asphalt over the entire area is likely to prevent a complete exposure pathway between a future land user (e.g. pedestrian) and the underlying contamination (if present). 11.11 Based on the assessment of the above soil validation results, undertake additional remediation and validation works (as required); and 11.12 Materials used to backfill the trenches will be tested and validated to ensure they meet either the applicable SSTCs (for inside the Declaration Area) or the NEPM (NEPC, 1999, as amended 2013) soil criteria for a commercial/industrial land use (for outside the Declaration Area). 11.13 Wall validation samples will be collected at 10 m lineal metre intervals in material identified to be the most impacted (either by visual observations of field screening of samples using a Photoionisation Detector); and 11.14 Base validation samples will be collected at 10 m lineal metres along the base of the trench. 11.15 Imported fill will be certified before being introduced to the REF Site. JBA 10051 43 Barangaroo South 12. Hickson Road Alterations | August 2015 Sydney Water 12.1 You must enter into an agreement with Sydney Water in the form of the enclosed Deed. 12.2 You must engage your current or another authorised Water Servicing Coordinator (Coordinator) to manage the design and construction of the required works to Sydney Water’s standards and procedures. Before you engage another Coordinator you must write and tell Sydney Water. For a list of authorised Coordinators either visit www.sydneywater.com.au > Plumbing, building & developing > Developing > Providers > Lists or call 13 20 92. Coordinators will give you a quote or information about costs for services/ works including Sydney Water costs The Coordinator generally will be the single point of contact between you and Sydney Water. They can answer most questions you might have about our process and charges 12.3 After you engage a Coordinator, you and your accredited Developer Infrastructure Providers (Providers) will need to sign and lodge both copies of the enclosed Deed with your nominated Coordinator. After Sydney Water has signed the documents, one copy will be returned to the Coordinator. The Deed sets out for this project: – your responsibilities; – Sydney Water’s responsibilities; and – the Provider’s responsibilities. You must do all the things that we ask you to do in that Deed. If Sydney Water does not receive the signed Deed for our signing by 11 September2015 you will need to re-apply (and pay another application fee). Note: The Coordinator must be fully authorised by us for the whole time of the Deed 12.4 If you need to enter a neighbouring property, you must have the written permission of the relevant property owners and tenants. You must use Sydney Water’s Permission to Enter form(s) for this. You can get copies of these forms from your Coordinator or the Sydney Water website. Your Coordinator can also negotiate on your behalf. Please make sure that you address all the items on the form(s) including payment of compensation and whether there are other ways of designing and constructing that could avoid or reduce their impacts. You will be responsible for all costs of mediation involved in resolving any disputes. Please allow enough time for entry issues to be resolved 12.5 You must not start work on the existing water main or the proposed adjustment until Sydney Water advises your Coordinator. This includes the placement of any temporary pipework. Before you can do this pipework, you must engage your Coordinator to lodge an application that must include appropriate temporary pipework detail as well as the design of the proposed adjustment. Sydney Water will then assess both designs and advise your Coordinator when they are approved and of any conditions to be met before pipe placement. One condition will be: 44 JBA 10051 Barangaroo South Hickson Road Alterations | August 2015 – the lodgement of an unconditional security bond from an acceptable financial institution that will cover Sydney Water’s risk for this work; and – your acceptance in writing to bonding conditions that we will provide in another agreement. If any work on our assets is carried out without that advice or final approval, Sydney Water will take action to have work on the site stopped. We will apply the provisions of Section 45 of the Sydney Water Act 1994. 12.6 Construction of these works will require you to pay project management, survey, design and construction costs directly to your Providers. Additional costs payable to Sydney Water may include: – water main shutdown and disinfection; – connection of new water mains to Sydney Water system(s); – design and construction audit fees; – contract administration, Operations Area Charge & Customer Redress prior to project finalisation; – creation or alteration of easements etc.; – water usage charges where water has been supplied for building activity purposes prior to disinfection of a newly constructed water main. Note: Payment for any Goods and Services (including Customer Redress) provided by Sydney Water will be required prior to the release of the Bank Guarantee or CashBond. Your Coordinator can tell you about these costs. 12.7 Sydney Water is currently investigating the request for Sydney Water to contribute towards the adjustment/renewal work. If a contribution is applicable the Sydney Water (Urban Growth) Procurement Guidelines must be followed. The actual amount of funding will be determined when the design plans are finalised. Construction commencement will not be permitted until a business case for the budget allocation has been approved by Sydney Water. 12.8 Any variation submitted to Sydney Water for approval during the design and/or construction stages of the works must include the associated cost and details of the variation. Sydney Water will review the variation and advise of the outcome. As soon as a variation occurs, Sydney Water is required to be notified in writing within a reasonable period of time of the estimated cost of the variation, nature of variation and description on events and history. All variations, where there is a contribution by Sydney Water must follow the Sydney Water (Urban Growth) Procurement Guidelines. 12.9 Because this work involves construction on a “live” Sydney Water water main, you must also: – Have your Building Plans are approved prior to temporary pipework and excavation, – Submit your temporary pipework design (if required) with your permanent wastewater deviation design for approval, – Accept in writing to bonding conditions that will be provided in the Bond Agreement, – Submit your Bond and signed Bond Agreement, – Submit the Construction Commencement Notice for construction of the temporary pipework, JBA 10051 45 Barangaroo South Hickson Road Alterations | August 2015 – Have your temporary pipework constructed by a listed provider, and then – Complete your permanent deviation works. After we receive a copy of the successful tender for the work, we can calculate the amount of this bond. We will then send you that other agreement which will tell you this amount. You must lodge the bond and the completed agreement with Sydney Water before you start constructing the work. The bond will be released after you have completed the construction of the works. (This includes lodgement of Work As Constructed plans and production and/or recreation of documentation and reports and completion of all the excavation and landscaping works needed for the total project.) In addition, the following specific conditions apply: – No upsizing of the 300mm drinking water main is required. 46 JBA 10051 – The proposed water main is required to be constructed as per quote provided, using DICL material. – Design consideration regarding location difficulties due to the number of trees and tree barriers in the area. Tree guidelines needs to be followed.
