AN ACT
REMOVING THE RESTRICTIONS IN THE REGISTRATION OF LAND TITLES UNDER SECTIONS
118, 119, AND OTHER RESTRICTIONS AGAINST ENCUMBRANCE OR ALIENATION ON FREE
PATENTS ISSUED UNDER SECTION 44 OF COMMONWEALTH ACT NO. 141 OR THE PUBLIC
LAND ACT, AS AMENDED
Be it enacted by the Senate and the House o f Representatives o f the Philippines in Congress assembled:

SECTION. 1. Short Title. - This Act shall be know n as th e A gricu ltura l Free Patent Re­
fo rm Act o f 2017.

Sec. 2. D eclaration o f Policy. - It is th e policy o f th e State to rem ove th e restrictions
4
on free patents to a llo w th e e fficie n t and e ffective u tiliza tio n o f these lands to co n trib u te to
5
w e a lth creation, e ntre p re ne u rsh ip , and econom ic developm ent.

Sec. 3. Removal o f Restrictions. - A gricultural public lands alienated o r disposed in
7
favo r o f qualified public land applicants under Section 44 o f C o m m onw ealth Act No. 141, as
8
am ended, shall n o t be subject to restrictions regarding encum brances, conveyances, trans-
9
fers, o r dispositions im posed und e r Sections 118 and 119 th e re o f. A gricu ltura l free p atent
10
shall now be considered as title in fee sim ple and shall n ot be subject to any restriction
11
against encum brance o r alienation.

Sec. 4. Retroactive Effect. - This Act shall have re tro a ctive e ffe c t and any restriction

regarding encum brances, conveyances, transfers, o r dispositions im posed on agricultural
1
free patents issued und e r Section 44 o f C om m onw ealth Act No. 141, as am ended, before
2
the e ffe c tiv ity o f this Act shall be rem oved and are hereby im m e d ia te ly lifte d .

Sec. 5. Repealing Clause. - All laws, decrees, orders, rules and regulations, o r o th e r
4
issuances o r parts th e re o f inconsistent w ith the provisions o f this A ct are hereby repealed or
5
m odified accordingly.

Sec. 6. Separability Clause. - If any p o rtio n o r provision o f this A ct is declared uncon-
7
s titu tio n a l, th e re m ainder o f this Act o r any provision n o t affected th e re b y shall rem ain in
8
force and effect.

Sec. 7. E ffectivity Clause. - This Act shall take e ffe ct a fte r fifte e n (15) days fo llo w in g
10
th e co m p letio n o f its p ublication e ith e r in th e O fficial Gazette o r in a new spaper o f general

circulation in th e Philippines.
