They have been prepared in conformity with the rules laid down in the Danish Postal Services Act (Postloven) (Act no. 1536 of 21 December 2010 as amended) and related provisions. The General Terms and Conditions apply to items handed over for conveyance by post as from 1 January 2017 and onwards. International Letters are letters posted with Post Danmark and sent to recipients abroad as well as to recipients in the Faroe Islands and Greenland. In the following, working days are Monday to Friday, excluding public holidays and 5 June (Constitution Day), 24 December as well as intermediate days approved by the Danish Transport and Construction Agency. Intermediate days are single working days falling between Sundays and public holidays as weel as official non-working days. 1 INTERNATIONAL LETTERS 1.1 DELIVERY TIME AND QUALITY TARGETS The delivery time for International Letters depends on the country to which the letter is sent and where the letter is posted. Further information on delivery times to individual countries of destination can be obtained from Post Danmark‘s Customer Service. Information on delivery times are also available at www.postdanmark.dk. The quality target for cross-border letters (A Prioritaire) within the European Union is delivery of 85 per cent of the letters within three working days after posting, and delivery of 97 per cent of the letters within five working days after posting; see Individual licence granted to Post Danmark A/S. Compliance with the quality target presupposes that items are posted at a post office. 1.2 DIMENSIONS All letters must comply with the following formats: Minimum: 14 x 9 cm. If a letter has the form of a roll or a tube: length 10 cm and the length + 2 x diameter/height = 17 cm. Maximum: length 60 cm and length + width + height = 90 cm. If a letter has the form of a roll or tube: length 90 cm and length + 2 x diameter/height = 104 cm. 1.3 WEIGHT A letter may weigh up to 2 kg including packaging. 1.4 CONTENTS Senders are responsible for checking whether the contents of the letter is subject to duty or tax and whether, according to the rules of the country of destination, import of the contents of the letter into the country of destination is allowed, and if so, the conditions applicable to such import. Post Danmark neither checks nor advises on these matters, but recommends senders to contact the authorities of the country in question, for example embassies or consulates. International Letters may not contain: Money in cash, travellers checks, bearer securities, precious metals, including platinum, gold and silver, precious stones and other valuable articles. Subject to certain limitations in terms of value, such contents may, however, be send as Registered Letter. Bearer securities mean debt instruments, equities, uncrossed cheques, bills of exchange, safe custody receipts and other documents, which represent a monetary value, and which authorise the holder of the document to assign the document, to receive payment according to the document, or claim personal property released or services provided under the terms of the document. Dangerous goods. Dangerous goods mean all substances or materials, the physical or chemical properties of which may present a hazard to people, animals, the environment (for example production equipment and other items) or means of transport. Dangerous goods include all articles designated from to time to time as dangerous goods according to the ‘UN Recommendations on Transport of Dangerous Goods. Model Regulations’ (UN Model Regulations). Lithium cells or lithium batteries, which are not installed in equipment, are categorised as dangerous goods and must therefore not be sent by mail. Lithium batteries or lithium cells, which are installed in equipment, may, however, be sent as International Letters, when special packaging rules are observed. Further information can be obtained from Post Danmark, including information about the countries of destination that do not allow International Letters containing lithium batteries and lithium cells installed in equipment. A letter may contain a maximum of either four lithium cells installed in equipment or two lithium batteries installed in equipment. The content of lithium metal or lithium alloy in cells may not exceed 1 g per cell, and for cells with lithium ions, the maximum is 20 Wh per cell. The content of lithium metal or lithium alloy in batteries may not exceed 2 g of lithium per battery, and for batteries with lithium ions, the maximum is 100 Wh per battery. Lithium cells or lithium batteries installed in equipment that have been identified by the manufacturer as being defective for safety reasons, or that have been damaged or have the potential of producing a dangerous evolution of heat, fire or short circuit must not be sent by mail. Post Danmark has published the brochure ‘Farlige stoffer, der ikke må sendes med Post Danmark’ ( Dangerous goods that may not be sent by Post Danmark) as well as information material about dangerous goods/lithium batteries, which can be obtained at the post office. Weapons/soft guns of any kind and active/inactive ammunition or explosive elements. Live animals. Counterfeit and pirated articles. If a letter, which has been checked by X-ray screening before air transport, is found to contain dangerous goods or prohibited articles, it will be returned to the sender against payment of a fee or handed over to the proper authority. 1.5 PACKAGING Senders must ensure that items are packaged such that the contents are sufficiently protected during normal handling, including mechanical sorting, and such that the letter is prevented from causing damage or harm to other items, Post Danmark or any third party. Only postcards can be sent without packaging. Fragile or liquid contents may be sent only in packaging approved by Post Danmark. 1.6 MARKING The address side of International Letters must bear the indication ‘Prioritaire’ or be marked ‘A Prioritaire’. If the letter is not endorsed/labelled correctly, the time of delivery may be extended. 1.7 CUSTOMS CLEARANCE Where other than ordinary correspondence is contained in a letter sent to a country outside the EU, the contents and the value of the contents must be specified to ensure quick customs clearance. Senders are responsible for correct completion of customs documents. Customs declaration fees as well as customs duties and VAT are payable by the recipient. 1.8 POSTING Senders may post letters in the following ways: At a post office At a letter sorting centre or business dropoff location In one of the post boxes provided by Post Danmark. For households in rural areas, prepaid letters may also be handed to the postman, but without the option to buy additional services. Letters must be posted at the post office by the latest acceptance time, which appears from postdanmark.dk under ‘Find us’. When letters are handed in later than the latest acceptance time, one extra day of delivery must be expected as compared with the time of delivery stated. If letters are posted in a post box or handed to the postman, an additional delivery time of 1-3 working days must be expected as compared with the time of delivery stated. Letters franked with a PP (printed postage) impression may be regarded as posted on the following day if insufficient posting details were provided or if posting conditions have not been met. The sender will be charged with the cost of splitting up a batch, if any. 1.9 RIGHT OF DISPOSAL Until the letter has been delivered to the recipient stated on the letter, senders of letters to a number of countries are entitled to demand their letter returned or delivered to another recipient. If a sender uses the right of disposal, Post Danmark is entitled to charge a fee for forwarding the request for the changed arrangement. In some cases, the postal operator of the country of destination will charge additional postage from the recipient for redirecting a letter. 1.10 DELIVERY AND REDIRECTION Letters are delivered according to the rules applicable in the country of destination. Letters franked with Danish postage, which cannot be delivered to the recipient in the relevant country abroad, will be returned to the return address. 1.11 UNDELIVERABLE LETTERS Undeliverable letters are handled by Post Danmark in accordance with the rules laid down in section 12 of the Postal Services Act and related provisions. 1.12 SECRECY OF THE MAILS AND OPENING OF MAIL Post Danmark treats any information on the sender's use of postal services as confidential. According to Danish Consolidated Act no. 5 of 9 January 2013 on the Civil Registration System as amended, an obligation may, however, be imposed on Post Denmark by local councils to provide such information for use in the investigation of a person’s residential circumstances. Where it has not been possible to find the addressee or the sender, letters posted may be opened by Post Danmark without an order of the court in accordance with the provisions of section 12 of the Postal Services Act. Likewise, letters may be opened without an order of the court where this is done to determine the extent of any damage to the letter. 1.13 FRANKING International Letters must be franked by postage stamps, postage labels, franking marks, mobile postage, PP (printed postage) impressions or as unstamped reply items. ‘PP impressions’ can be obtained from www.postdanmark.dk. The rules as to the placement of PP impressions on letters can be viewed at www.postdanmark.dk. PP impressions may be used subject to the fulfilment of the following conditions: The items must be posted at a business drop-off location, at a letter sorting centre or at certain post offices. Please see www.postdanmark.dk Batches of less than 250 items may be posted against payment of a surcharge. The items posted must be from the same sender. The items must be provided with the name and address of the sender. The items must be accompanied by a delivery note or similar list indicating the number of items and their size. For large letters and maxi letters, the delivery note or similar list must also indicate the number of items per weight interval or actual weight per item. Based on these conditions, Post Danmark must be able to carry out postage control. The items must be split up according to size when posted. Large letters and maxi letters must also be split up according to weight interval. The split-up according to weight intervals may be omitted if the data in the delivery note on number per weight interval (and weight per item, if relevant) is generated on the basis of an IT system. (Post Danmark may be contacted for details). If the items are not posted in a condition enabling immediate postage control, Post Danmark will split up the batch of mail to allow postage control. Post Danmark will charge an hourly rate for this additional work. Payment will be charged for a minimum of 20 minutes. 1.14 PRICE The list prices in force from time to time can be found at www.postdanmark.dk and at post offices, which also provide information about all current prices. Unpaid or underpaid International Letters will be delivered as requested by the sender. For this service, Post Danmark is entitled to send a bill to the sender for the deficient postage as well as to charge an administrative fee. The amount of the fee is stated in the price lists available from post offices and at www.postdanmark.dk. If Post Danmark does not know the sender, the recipient will be charged the deficient postage amount and any fee payable to the postal operator in the country of destination. 1.15 PAYMENT Unless a written agreement has been concluded on the granting of credit, the payment must be made in cash when the letter is posted. 1.16 COMPENSATION Post Danmark's liability for International Letters is governed by the rules of the Universal Postal Convention (UPU) and related provisions or the agreements that may have been concluded with the postal operator in the country in question; see Individual license granted to Post Danmark A/S. According to the Universal Postal Convention, no liability is accepted for delay, loss, including wrong delivery, total or partial loss of contents or damage etc., to letters. 1.17 LIABILITY OF THE SENDER The sender is obliged to indemnify Post Danmark for any loss incurred by Post Danmark as a result of non-compliance with the requirements regarding contents and packaging of a letter set out in these General Terms and Conditions, including the requirements set out in clauses 1.4 and 1.5, as well as the further requirements for Registered Letters set out in clause 3.1. Moreover, the sender is liable in damages in accordance with the general rules of Danish law. 1.18 COMPLAINTS Any complaint by senders or recipients about Post Danmark's conveyance of an item must be submitted to Post Danmark, Customer Service. The complaint must be submitted within six months after the item was posted. As regards claims for compensation, please see the specific time limits for complaints in clause 3.5. Post Danmark undertakes to handle complaints within one month of their receipt, unless special circumstances apply. In accordance with the provisions of the Universal Postal Convention, certain countries of destination refuse to handle complaints about International Letters without additional services and articles for the blind. The handling of complaints about items to these countries of destination will therefore be limited to attempted tracing of the items in Denmark. Any decision taken by Customer Service may be brought before Post Danmark's Complaints Review Service, Carsten Niebuhrs Gade 4, 2, DK-1577 Copenhagen V. The Complaints Review Service also provides guidance on the complaints procedure. 2 ARTICLES FOR THE BLIND Articles for the blind are comprised by the General Terms and Conditions for International Letters, see clauses 1-1.18, subject to the modifications specified below as well as in Appendix 1 to Individual license granted to Post Danmark A/S. 2.1 WEIGHT Articles for the blind may weigh up to 7 kg including packaging. 2.2 CONTENTS Articles for the blind may only contain communication material for the use of the blind. Reference is also made to the provisions in Appendix 1 to the abovementioned licence. 2.3 MARKING Articles for the blind must be marked using a special label available from certain post offices. Information about the relevant post offices can be obtained from Post Danmark's Customer Service and is also available at www.postdanmark.dk. 2.4 PACKAGING Articles for the blind must be sent in packaging that ensures sufficient protection of the contents, while permitting quick and easy verification of the contents. 2.5 PRICE Articles for the blind can be sent free of postage, unless otherwise provided by the Universal Postal Convention and related provisions or other international agreements. Articles for the blind may only be sent postage-free if the relationship between the sender and the recipient is non-commercial. ________________________________________________________________________________________________ ________________________________________________________________________________________________ Page 3 of 4 INTERNATIONAL LETTERS P O ST D ANM A R K A /S G E N ER AL T ERM S A N D C O N DI TI ON S F OR IN T E RN A TIO NA L L ET T ERS AP PLI C A BL E FR OM 1 J AN U A RY 2 0 1 7 3 REGISTERED LETTERS Registered Letters are covered by the General Terms and Conditions for International Letters, see clauses 1-1.18, subject to the following modifications: 3.1 CONTENTS Registered Letters may contain cash and/or bearer securities at a value not exceeding DKK 1,050 per letter. Certain countries of destination do not allow Registered Letters containing coins, banknotes, bearer securities, travellers checks, platinum, gold, silver or other valuable articles. Further information can be obtained from the post offices about the countries of destination concerned. For certain countries of destination, the information is also available at www.postdanmark.dk. Senders are responsible for checking that the contents of a letter may be sent by registered mail. The value of bearer securities is calculated on the basis of the current value of the document. If the document does not state a value, or if the value stated in the document does not represent the current value, the value must be fixed at the commercial value that the document represents. Post Danmark may demand documentation of the commercial value from the sender. 3.2 MARKING The address side of a Registered Letter must be endorsed/marked ‘Rekommanderet’ (Registered) for letters sent to the Faroe Islands or Greenland and ‘Recommandé’ for letters sent to international destinations. 3.3 POSTING Registered Letters must be posted at one of the post offices accepting registered items. Information about the relevant post offices can be obtained from Post Danmark's Customer Service and can also be found at www.postdanmark.dk. Post Danmark may issue a receipt for the posting on a completed ‘Postkvittering’ (Certificate of posting) form. 3.4 COMPENSATION According to the Universal Postal Convention, no liability is accepted for any delay in the delivery of a Registered Letter or any damage caused by the delay. According to the Universal Postal Convention, loss-independent compensation of SDR 30, or approximately DKK 280 (at 1 January 2017) is granted if a Registered Letter is totally damaged, lost or totally rifled. In case of partial loss of contents or damage, compensation will be paid for the value of the lost item or the deterioration in value caused by the damage, but at an amount not exceeding SDR 30. No compensation is paid for the loss of profits or other indirect losses. If a Registered Letter is damaged, lost or totally or partially rifled at a time when Post Danmark is responsible for the conveyance, any compensation to the sender will, however, be fixed according to the provisions for domestic registered letters, provided that these provisions are more favourable to the sender. Reference is made to the paragraph about registered items in the General Terms and Conditions for Domestic Letters. If a registered item is totally damaged, lost or totally rifled, Post Danmark will, in addition to compensation, reimburse the price of posting, including the surcharge for items sent as Registered Letter. The same applies where a Registered Letter is damaged or partially rifled and the recipient has refused to take delivery of the letter as a result of the damage, or where an undeliverable Registered Letter is returned to the sender without an indication of the reason for non-delivery. Compensation will be paid to the sender, unless the item has been delivered to the recipient. In that case, compensation, excluding the supplementary service charge, will be paid to the recipient. No compensation, including reimbursement of the amount charged for conveying the item etc. is paid if a Registered Letter is damaged, lost or rifled as a result of fault or negligence on the part of the sender, poor condition of the letter or force majeure. Post Danmark is in no circumstances liable to pay compensation, including reimburse the amount charged for handling etc., where the sender has failed to meet the requirements set out in these General Terms and Conditions regarding packing of or contents admitted in a Registered Letter. The detailed conditions for payment of compensation, including reimbursement of the amount charged for conveyance, and rules for determining liability are as specified in the Universal Postal Convention and related regulations. 3.5 TIME LIMITS FOR COMPLAINTS In the event of damage or total or partial loss of the contents of a Registered Letter, the recipient, or, where the letter has been returned to the sender, the sender must when taking delivery of the Registered Letter complain to the postal operator in the country in question. Any complaint about total loss of the letter must be made within six months from the day on which the item was accepted for conveyance. Where complaints are not made within the stated time limits, any claim made against Post Danmark by respectively the sender and the recipient will be forfeited. 3.6 PERIOD OF LIMITATION The provisions of the Danish Limitation Act (Forældelsesloven) (Consolidated Act no. 1238 of 9 November 2015 as amended) apply to the period of limitation for a claim against Post Danmark. 4 CONSIGNMENT/DIRECT ENTRY Consignment/Direct Entry is the designation of items handed in to or collected by Post Danmark, which are posted jointly to a country of destination and cleared through customs in countries outside the EU. Items sent as Consignment/Direct Entry appear as if they were sent as domestic mail in the country of destination. International Letters (A Prioritaire), Economy Letters (B Economique) and unaddressed mail can be sent as Consignment/Direct Entry. Letters sent as Consignment/Direct Entry are covered by the General Terms and Conditions for International Letters, see clauses 1-1.18, subject to the following modifications which also apply to Unaddressed Mail and Economy Letters (B Economique) sent as Consignment/Direct Entry: 4.1 CONDITIONS FOR SENDING CONSIGNMENT/DIRECT ENTRY Senders of Consignment/Direct Entry must have entered into a Customer Agreement with Post Danmark to this effect. Consignment/Direct Entry agreements must conform to the rules of the country of destination. Senders are responsible for checking the rules of the country of destination, including rules about liability to pay customs duties or taxes, rules as to whether the country of destination allows import of the contents and, if so, the conditions under which they may be imported. In addition, senders must make sure that contents meet any current requirements as to contents established by the country of destination. For details about these rules and requirements, senders are recommended to contact the authorities of the country in question, for example embassies or consulates. 4.2 DELIVERY TIME AND QUALITY TARGETS The time of delivery of Consignment/Direct Entry depends on the country to which items are sent, and whether items are sent as International Letters (A Prioritaire) or Economy Letters (B Economique). Further information can be obtained from Post Danmark's Customer Service, tel. +45 70 10 01 15. 4.3 DIMENSIONS, WEIGHT AND PACKAGING The national rules applying in the country of destination must be met. Further information about these rules can be obtained from Post Danmark, but senders are responsible that the rules are observed; see clause 5.6. 4.4 POSTING Consignment/Direct Entry must be posted at a letter sorting centre. In respect of certain Consignment/Direct Entry types, requirements are established for notification, special acceptance times or times for posting. Further information about these requirements can be obtained from Post Danmark. A batch of Consignment/Direct Entry letters posted must contain at least 500 items per total batch. Batches of less than 500 items will generally be subject to payment of a surcharge. Further information about batch volumes for the different types of items, including batch volumes for Unaddressed Mail, can be obtained from Post Danmark. Senders are responsible for ensuring that the current requirements of the country of destination as to EUR pallets are met. The maximum weight per bag is 20 kg and 600 kg per pallet. A pallet must not exceed the following dimensions: length x width x height = 120 X 80 X 180 cm. Senders of Consignment/Direct Entry must comply with the current rules about delivery notes. Sending Consignment/Direct Entry is conditional on the Customer’s completion and printing of the necessary delivery notes via an Excel printing solution. For each individual country, the following documents to be used in connection with posting and direction must be printed via the Excel printing solution: K100 ‘Consignment/Direct Entryfølgeseddel” (Consignment/Direct Entry delivery note) (the Customer's receipt) Three copies of CN32 ‘Level 3, Direct Entry note’ (delivery note intended for the border sorting office) K98 ‘Consignment/Direct Entry dirigeringssedler’ (Consignment/Direct basis of any amount for which the postal operator in the country of destination may subsequently have invoiced Post Danmark. The sender is generally obliged to indemnify Post Danmark for any loss incurred by Post Danmark as a result of non-compliance with the requirements set out in these General Terms and Conditions regarding contents and packing of an item. Moreover, the sender is liable in damages in accordance with the general rules of Danish law. Post Danmark accepts no liability for delay, loss, including wrong delivery, total or partial loss of contents or damage to items sent as Consignment/Direct Entry; see clause 1.16. The above also applies to Unaddressed Mail sent as Consignment/Direct Entry. Entry direction slips) ‘The Customer's receipt’ and the three copies of CN32 ‘Level 3, Direct Entry note’ must be handed in in K48 ‘Plastpose’ (plastic bag). A combined invoice for use in customs clearance must accompany a Consigment/Direct Entry batch for countries outside the EU. For items containing commodities, the copy of a commercial invoice must also accompany each item. Each transport package must be provided with a K96 ‘Plastpose (plastic bag), which must contain a completed K98 ‘Consignment/Direct Entry dirigeringsseddel’ (Consignment/Direct Entry direction slip), which is numbered and followed by a hyphen and the total number of transport packages (Page 1 of 3, page 2 of 3 and page 3 of 3). The direction slip for the transport package to which the delivery notes are affixed must be marked ‘F’. If letter trays on tray carriers are used, only the tray carriers need to be provided with a K96 ‘Plastpose’ (plastic bag) containing delivery note and direction slip. 4.5 IMPORT DUTIES AND TAXES In connection with Consignment/Direct Entry for countries outside the EU, the sender must be represented by a local agent in the country of destination who will take care of customs clearance and be responsible for the payment of import duties and taxes. 4.6 COMPENSATION The Customer is responsible that items sent as Consignment/Direct Entry meet the requirements of the country of destination. Post Danmark will not check that this is the case. In case of non-compliance of Consignment/Direct Entry with these General Terms and Conditions, Post Danmark reserves the right to collect an additional charge on the ________________________________________________________________________________________________
