Property Description/Findings:
The subject property is a 10,397± sq. ft. parcel that is improved with a single-family residence that was
constructed in 1967. The current owner and applicant acquired this property in 2012. The property has
frontage and access from SE 1st Place and has water frontage along the San Carlos Canal. The
surrounding area consists of single-family residences in all four directions. A site visit was conducted on
July 11, 2014. An aerial of the property is located below:
The applicant states in their Letter of Intent (LOI) that they seek to build a new swimming pool enclosure
on the property with a six-foot rear setback. In addition to the swimming pool, the applicant also
proposes to construct a covered patio extension to the rear of the single-family home with a six-foot
rear yard setback. The applicant’s request requires two variances to LUDR, Section 2.7.1 that requires a
10-foot rear yard setback for swimming pool enclosures and a 20-foot rear yard setback for the covered
patio which constitutes an expansion to the principal structure. The proposed swimming pool enclosure
would be approximately 57 feet x 18 feet or 1,026 sq. ft. Of this 1,026 sq. ft., 288 sq. ft. would be
covered with a hard roof, thus necessitating the 14-foot rear setback request. The remaining 738 sq. ft.
of the enclosed pool would be covered with open mesh.
Analysis:
The Planning Division has reviewed this application based on the City’s LUDR, Section 8.10.3a-e and the
five (5) standards that covers variances, and offer the following analysis for consideration 1.

Special Conditions. The special conditions and circumstances exist which are peculiar to
the land, structure or building involved and which are not applicable to other lands,
structures or building in the same zoning district; that the special conditions and
circumstances do not result from the actions of the applicant.
Both variances are reviewed together, unless otherwise noted.

Staff Response: Planning staff finds that there are no special conditions concerning the
land or structure that would apply to the applicant’s requested variances. The applicant
asserts in their LOI that the property has a peculiar shape and that the house is different
from other properties because the house does not run parallel with the seawall.
Planning staff finds that the rectangular shape and size of the property is consistent with
many other properties in the surrounding area and throughout the City. Staff also finds
that even though the house is slightly skewed in respect to the seawall, the orientation
is not wholly different from other surrounding homes that are located on the curvature
of a canal. In fact, City regulations (LUDR, Section 3.8.2.D) allow single-family homes to
be offset from the front property line by an angle not to exceed 45%. In such situations,
no special consideration is given to providing an owner with leniency in regards to
building setbacks.
2.
No special privilege. The granting of the variance requested will not confer on the
applicant any special privilege that is denied by this ordinance to other lands, buildings
or structures in the same zoning district.
Staff Response: The granting of the variance would confer a special privilege to the
applicant. Any other applicant seeking approval to encroach on the minimum rear yard
setback with their principal structure or a swimming pool enclosure could reasonably
expect to have their request denied. The applicant states in their LOI that nearby
properties have received similar variances, however, staff research indicates that no
properties within 1,000 feet of the subject property have received a variance for a rear
yard setback reduction in order to accommodate a swimming pool enclosure or an
expansion to the principal structure.

Hardship. That literal interpretation of the provisions of this ordinance would deprive
the applicant of rights commonly enjoyed by other properties in the same zoning district
under the terms of this ordinance and would work unnecessary and undue hardships on
the applicant.
Staff Response: Planning staff finds that the applicant has not adequately demonstrated
a hardship for the proposed variance requests. The applicant enjoys reasonable use of
the property as evidenced by the use of this property with a single-family home. Staff
agrees with the applicant that swimming pools are a common feature associated with
many homes in Cape Coral, however, swimming pools are not guaranteed or required
for single-family homes. Planning staff finds that a swimming pool could be constructed
behind the home, however, some remodeling of the existing home may be necessary to
a provide a pool with the dimensions desired by the applicant.
4.
Minimum variance. That the variance granted is the minimum variance that will make
possible the reasonable use of the land, building or structure.
Staff Response: Planning staff finds that the requested variance is not the minimum
variance to allow for reasonable use of the land, building or structure. Planning staff
finds that the applicant currently enjoys reasonable use of a single-family home. Any
encroachment of the setbacks detailed in the R-1B district would exceed the criteria for
the minimum variance standard. The applicant could also modify his current plans for

this improvement as discussed above within the Hardship Section of this report while
maintaining compliance with the City’s setback requirements for this zoning district.
5.
Purpose and intent; public interest. That the granting of the variance will be in harmony
with the general intent and purpose of this ordinance, and that such variance will not be
injurious to the area involved or otherwise detrimental to the public welfare.
Staff Response: Staff finds that the granting of the variance would not be in harmony
with the intent and purpose of the ordinance which is to ensure that adequate spacing
is maintained between residences and between buildings and a property line. Setbacks
between residences allow for privacy and prevent neighborhoods from having homes
located “on top” on each other. Staff finds that the requested variance is not in concert
with the ordinance and would allow for a swimming pool enclosure and an expansion of
the principal structure into an area where no structures are permitted. Planning staff
also finds that setbacks for properties located along a canal or waterway are important
in order to ensure that proper construction standards are maintained. Typical
construction of seawalls includes multiple concrete deadman that are set 10 feet from
the seawall. Encroachment of the 10-foot rear yard setback by a swimming pool
enclosure or an expansion of the principal structure may require special engineering and
construction methods. Staff finds that the expansion is unlikely to negatively affect the
surrounding neighborhood, since the proposed expansion would occur along the
waterfront where there are no neighboring homes to the immediate rear of this
property. Staff notes that the adjacent property owners to the north and south may
lose some visibility down the canal, however, the loss of visibility should not be
substantial as the swimming pool enclosure and roofed lanai will be screened, therefore
some visibility through the screening may be retained.
Staff Conclusion:
For a variance to be granted, the Board of Zoning Adjustment and Appeals must find that all five
standards outlined above can be met or are satisfied by the applicant. Planning staff finds that the
application does not meet the five standards required for the approval of a variance request and
therefore recommends denial.

Dear Director:
The purpose of this letter is to ask you to approve a dimensional variance of four (4) feet
to the required ten (10) foot setback to the property seawall. This will still allow six (6)
feet of space for public utilities and drainage easement as required. Because of the
peculiar shape of my lot and the house running parallel with the north boundary line, the
house had to be placed farther back on the lot to accommodate the side load garage
and driveway. Per my local pool contractor, extra space is needed because of the local
building code "Angle of Repose" to support the pool wall against the existing concrete
porch.
I feel that because my house is placed farther back on the lot and does not sit square to
the seawall, it is different from other properties in the same zoning district. These
special conditions are not a result of my actions, but are a result of a home constructed
in 1967.
I do not feel that this variance would give me special privileges because other residential
homes in the community have swimming pools with some having been granted a
variance for similar hardships.
The literal interpretation of this ordinance would deprive me of the right to have a normal
size swimming pool. Putting a pool in without the variance would cause undo hardship
and not make financial sense due to the size restrictions.
The four (4) foot variance requested is the minimum amount needed to fit a minimum
12' wide swimming pool.
Granting of this variance would be within the purpose of this ordinance because it would
not be injurious to the area or otherwise detrimental to the public welfare.

VARIANCE – APPLICATION
CRITERIA APPLICABLE TO VARIANCES
Cape Coral Land Use & Development Regulations Section 8.10
A.
Definition: A modification of the requirements of this ordinance when such modification will not
be contrary to the public interest where, because of conditions peculiar to the property involved
and not the result of the actions of the applicant which occurred after the effective date of this
ordinance, a literal interpretation of the ordinance would result in unnecessary and undue
hardship.
B.
Generally: Before any variance may be granted, the Board must and shall find all of the following.
Such findings shall be recorded, along with any imposed conditions or restrictions, in the Board’s
minutes and the records and issued in written form to the applicant to constitute proof of the
variance:
1. Special conditions. The special conditions and circumstances exist which are peculiar to the
land, structure or building involved and which are not applicable to other lands, structures or
buildings in the same zoning district; that the special conditions and circumstances do not
result from the actions of the applicant.
2. No special privilege. The granting of the variance requested will not confer on the applicant any
special privilege that is denied by this ordinance to other lands, buildings or structures in the
same zoning district.
3. Hardship. That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning district under the
terms of this ordinance and would work unnecessary and undue hardships on the applicant.
4. Minimum variance. That the variance granted is the minimum variance that will make possible
the reasonable use of the land, building or structure.
5. Purpose and intent; public interest. That the grant of the variance will be in harmony with the
general intent and purpose of this ordinance, and that such variance will not be injurious to the
area involved or otherwise detrimental to the public welfare.
C.
Effect of approval: A variance applies to the property for which it is granted and not to the
individual who applies for it. A variance also runs with the land and is transferable to any future
owner of the land, but it cannot be transferred by the applicant to a different site.
D.
Recording: All variances, including any attached conditions or restrictions, approved by the Board
shall be recorded in the office of the City Clerk.
