ELIGIBILITY REQUIREMENTS 1. Eligible policy rewrites and new lines of insurance added to existing lines are subject to new business underwriting guidelines as stated. Any policy which has been non-renewed or cancelled by Kemper is ineligible to be rewritten. Eligible policy rewrites: a. Package to Monoline b. Monoline to Package c. Change effective date d. Change Policy Term e. Change in liability type (combined/split) INELIGIBLE DRIVERS Drivers who do not qualify for the "Good Driver" discount, including: Drivers without a valid license Drivers with less than 3 years of driving experience Drivers with no accidents but more than 1 minor moving violation in the past 3 years. Drivers with no violations but an accident which resulted in bodily injury or death in the past three years. Drivers with no violations but more than 1 chargeable accident in the past 3 years. An accident with property damage of $1,000 or less is not chargeable. With a DUI/DWI offense in the past 10 years. Drivers with a major violation (non-DUI/DWI related) in the past 3 years Note: Newly licensed dependent children are eligible on family accounts, provided their driving record is clean, and they are not the principal operator of a Class I or II vehicle. INELIGIBLE VEHICLES Pickups or Vans used for business. Any vehicle not owned or leased by named insured Motorcycles or Motor scooters Off road utility vehicles Vehicles used for delivery, driver training, emergency or commercial purpose Vehicles non - U.S. market, antique, off road, limited production or kit car Vehicles altered to increase speed or acceleration capabilities, rendering the vehicle unsafe in violation of governing state or federal safety standards Vehicles which fail to meet governing state or federal safety guidelines . GOOD DRIVER DISCOUNT A 20% Good Driver Discount shall be afforded when all operators of a vehicle qualify for the discount. If there are automobiles in excess of the number of operators, the Good Driver Discount applies to any excess autos, provided one driver qualifies. The discount is applied separately to each coverage after application of the primary and secondary rating factors, if applicable. The discount shall be applied to the total premium for a vehicle, except premium charged for Covered Property Coverage and Automobile Accident Coverage, if provided. The Good Driver Discount will be identified by the presence of a 1 in the ninth position of the rate classification code. 3 KIC UAH / CA A “good driver” is a driver who meets all of the following requirements. 1. Has been continuously licensed for the previous 3 or more years. 2. Has not been convicted for more than one moving violation and has no principally at-fault accidents in the prior 3 years. 3. Has not been involved in more than one principally at-fault accident resulting only in damage to property exceeding $1,000 and had no convictions for a moving violation in the prior 3 years. 4. Has not been involved in any principally at-fault accident resulting in death, or from bodily injury where total loss or damage from injuries and damage to property exceeds $1,000, in the prior 3 years. 5. The operator has not been convicted of any of the following during the past 10 years: Driving a motor vehicle with a blood alcohol level equal to or in excess of 0.08 (0.05% percent for persons under the age of 18) Driving under the influence of alcohol, drug, or any combination of the two, and causing bodily injury or death Gross vehicular manslaughter while intoxicated Vehicular manslaughter while intoxicated and in commission of an unlawful act, without gross negligence 6. The operator has not been convicted of any of the following during the past 3 years. Failure to stop at the scene of the accident Reckless Driving Causing bodily injury or death while evading a police officer Driving the wrong way on a divided highway Driving at speeds in excess of 100 miles per hour Engaging in any motor vehicle speed contest on a highway Engaging in, or aiding and abetting in, any motor vehicle exhibition of speed Illegal transportation of explosives Vehicular manslaughter 7. There has not been more than one dismissal (pursuant to the Vehicle Code), during the past 3 years, which has not been made confidential, a conviction of which would have resulted in the imposition of more than one California violation point count. Additional Rules Applicable to Good Driver Discount a. Out-of-state convictions count the same as in-state convictions, provided the violation would have resulted in a point assignment had it occurred in California. b. Use the conviction date for determining whether the incident is with the prior 3 years. c. The convictions mentioned above in requirements 2, 3 and 6 will not disqualify a driver who was cited for the violation while operating a motor vehicle for compensation during the hours of employment. This exception only applies if that driver‟s specific duties included driving employers‟ motor vehicles, or to individuals who own or lease a highway carrier and have authority in their own names to operate these types of vehicles, and the driver has submitted a written declaration made by the driver under penalty of perjury, that the driver was, at the time of the violation, operating a motor vehicle during the hours of his or her employment. d. If a Good Driver is not eligible to purchase a good driver discount policy because of the driving safety record or years of driving experience of any other person, then the good driver shall be able to purchase a good driver policy which excludes such other persons from coverage. Attach: Auto 767 Exclusion of Named Driver Endorsement. 4 KIC UAH / CA e. Ineligibility or restriction of any vehicles does NOT apply to Good Drivers. GOOD DRIVER PLUS Operators that meet the definition of a Good Driver may qualify for a Good Driver Plus discount if the operator has had no accidents or violations in the last five years. Operators that qualify for the Good Driver Plus discount will receive a 4.0% discount in addition to the 20% Good Driver discount. Five years of violation and accident free operation is required. Exceptions: Comprehensive losses, not-at-fault accidents, non-moving violations and commercial violations are excluded in the determination of Good Driver Plus. PROFESSIONAL GROUP PROGRAM A factor of .95 in the premium for Bodily Injury, Property Damage, Medical Payments, Uninsured Motorists (Bodily Injury and Property Damage), Comprehensive and Collision coverage is available if the name insured or spouse/ Registered Domestic Partner is a member of one of one the professional groups listed below. This program will apply on a per policy basis but will not apply to the PCL endorsement. Acceptable documentation may include proof of membership in a professional organization, a diploma or professional license. Any and all other supporting documentation will be considered by Underwriting. Documentation must be maintained by the Agent. Veterinarians - The named insured or spouse/Registered Domestic Partner must be a licensed member with the State of California. Dentists - The named insured or spouse/Registered Domestic Partner must have a valid, current license issued by the Dental Board of California. Dental Hygienists and assistants are not eligible. Accountants - The named insured or spouse/Registered Domestic Partner must have a current license issued by the California Board of Accountancy. Firefighters - The named insured or spouse/Registered Domestic Partner must be employed as a full time firefighter for a state or local fire department within California. Volunteer firefighters are not eligible. Paramedics/ EMT- The named insured or spouse/Registered Domestic Partner must have a current EMT-1, EMT-IL or EMT- P certificate from the state of California. Pilots - The named insured or spouse/Registered Domestic Partner must have a current airmen certificate issued by the Federal Aviation Administration. All certificate classes apply except student certificates. They are not used as a public or livery conveyance They are not rented to others, except as part of a registered peer-to-peer rental agreement A motor vehicle that is a pick up or small van shall be considered a private passenger auto if it: has a gross vehicle weight of less than 10,000 lbs. and is not used for delivery or transportation of goods or material unless such use is: incidental to the insured‟s business of installing, maintaining or repairing furnishing or equipment, or for farming or ranching. A pick up or van used in the business of the United States Government, by an employee of the Government, shall be considered a private passenger auto only if: It meets the conditions above and coverage is limited in accordance with the Federal Employees using autos in Government Business Endorsement. A motor vehicle owned by a farm family co- partnership or farm family corporation shall be considered a private passenger auto owned by two or more relatives who are residents of the same household if: it is principally garaged on a farm or ranch and is otherwise meets the definitions above. CHANGES All policy changes will be computed pro-rata. MINIMUM PREMIUM RULE A minimum annual premium charge of $30.00 will be applied for each policy, certificate, declaration or binder covering one or more of the following: Bodily Injury Property Damage Combined Single Limit Comprehensive Collision Premium will be adjusted on a pro-rata basis in the event of cancellation. Premium for other coverages is in addition to the minimum annual premium. PACKAGE PLUS BILLING Kemper can bill the insured for the auto premium and the mortgage company for the home premium. No policy may be written for a period longer than twelve (12) months. 12-MONTH POLICIES The premium charge is equal to the policy‟s annual premium or the minimum annual premium, whichever applies. 6-MONTH POLICIES If a policy is written for a specified period of 6 months, charge 50 percent of the policy‟s annual premium or the minimum annual premium. This provision shall not apply to risks written under any Automobile Insurance Plan (assigned risks) When policies are issued with an effective date on the 29th, 30th or 31st of any month, the first such policy may be extended to run from the date of issuance to the first day of the calendar month following expiration of the policy. Premium for this extended coverage of one to three days may be waived. ROUNDING RULES Rates and premiums displayed in: 1. On every new business policy written where the payor is the Insured or Other and none of the conditions below exist 2. Only on the side of a package policy where the side is a new business policy but the other side meets one of the conditions below DOWN PAYMENTS ARE NOT REQUIRED: 1. If the policy is a rewrite, which is defined by the Prior Carrier = Kemper (or one of the Unitrin Companies) 2. If the policy is an approved block transfer 3. If the policy is an inter-agency transfer 4. If the policy has a Mortgagee as the Payor for a home monoline policy 5. For the side of a policy with a CEC (Credit for Existing Coverage) as long as the CEC effective date is 30 days after the processing date A CEC allows an agent to write a package with non concurrent effective dates for auto and home. THE FOLLOWING DOWN PAYMENT RULES WILL APPLY WHEN UTILIZING RPW 6.0 FOR ISSUING POLICIES: 1. Down payments greater than or equal to the Estimated Down Payment for each new business entry. 2. The minimum down payment amount will be based on the payment method and/or pay plan selected countrywide: a. If Recurring Payment Method = EFT or Visa/MasterCard and Pay Plan = Monthly, 1 month down is required for both annual and semi-annual policies b. If Recurring Payment Method = Paper bill and Pay Plan = Monthly, 20% down payment is required for both annual and semi-annual policies c. If Recurring Pay Plan = Quarterly, 25% down payment is required for EFT, Visa/MasterCard or Paper Bill recurring payment methods d. If Recurring Pay Plan = Two Pay, 50% down payment is required for EFT, Visa/MasterCard or Paper Bill recurring payment methods e. If Recurring Pay Plan = One Pay and Payor = Insured or Other, 100% down payment is required for EFT, Visa/MasterCard or Paper Bill recurring payment methods f. If Payor = Mortgage, down payment is not required and is optional 11 KIC UAH / CA SAFE DRIVER INSURANCE PLAN (SDIP) Administration of SDIP shall apply to all applicants. Eligibility is determined by the underwriting guidelines, regardless of how many surcharges are allowable under the SDIP. The experience period shall be the three years immediately preceding the date of application or the preparation of the renewal. Surcharges are applied to the vehicles primarily driven by the operator responsible for the surcharge subject to primary class vehicle assignment rules. DRIVING RECORD SUB-CLASSIFICATION The driving record sub-classification shall be determined from the number of Driving Record Points accumulated during the experience period. Determine the number of points applicable to each operator. o If an auto is customarily operated by one operator, assign a Sub-Classification based on the points generated by that operator. o Only the accident points applicable to one individual operator may be applied to a single vehicle. o Only the conviction points applicable to one individual operator may be applied to a single vehicle. o If all operators who customarily operate the auto have generated no points, assign SubClassification 0 to that auto. ADMINISTRATION OF SDIP Initial information necessary to assign the proper Driving Record Sub-Classification shall be obtained from any one or combination of the following: o an application signed personally by the applicant. o Company‟s own records; or o Motor Vehicle records; or o Loss Exchanges o Consumer Reports o Prior Carrier Letters of Experience o NAMED DRIVERS DECLARATION, made under penalty of perjury, attesting to his or her atfault accident history, shall be sufficient proof of that accident history in the absence of contrary information form an independent source (those including but not limited to any items listed in Section D (1) (a-f) above). If we discover that a declaration contains a fraudulent or material misrepresentation, we may use that information to rate the policy, to cancel the policy as per CIC sections 661 and 1861.03 (c)(1), and take any other action authorized by law. The signature of the applicant on all applications received from an agent, broker or solicitor shall be certified by such agent, broker or solicitor. SDIP - ACCIDENTS Points will be assigned for each accident that occurred during the experience period, involving the applicant or any current resident operator, while operating an auto. Points will be assigned to the vehicle customarily driven by the operator responsible for incurring the points subject to primary class vehicle assignment rules. Only the accident points applicable to one individual operator may be applied to a single vehicle. Accidents Points Principally At-fault accident* 4 *An accident, occurring within the experience period is a principally at-fault accident, if any of the following apply: 12 KIC UAH / CA 1) the driver‟s actions or omissions were are least 51% of the proximate cause of the accident and a. resulted in death, or b. resulted in injuries and/or damage totaling more than $1,000 (after applicable deductible). 2) a previous insurer determined that the driver in the accident was principally at fault, 3) the accident was uninsured and information available is sufficient to determine that the driver was principally at fault. We will consider a driver to be principally at fault if the driver fails or refuses to provide accident information, or 4) it was a solo vehicle accident, subject to the exceptions below. Exceptions: 1. No points are assigned for accidents incurred by an operator demonstrated to be a named insured or a principal operator of an auto insured under a separate policy; and 2. No points are assigned for accidents occurring under the following circumstances: a. Auto lawfully parked. A vehicle rolling from a parked position will not be considered to be lawfully parked and will be charged to the person who parked the auto; or b. For involvement in an accident as a result of which (a) a court judgment declared the operator of another vehicle involved in the accident to have been 50% or more negligent; or (b) a reimbursement of at least 50% in settlement of the insured‟s damages was obtained from, or on behalf of, the owner or operator of another vehicle involved in the accident, or c. Auto is struck in the rear by another vehicle and the applicant or other resident operator has not been convicted of a moving traffic violation in connection with this accident; or d. Operator of the other auto involved in the accident was convicted of a moving traffic violation and the applicant or resident operator was not convicted of a moving traffic violation in connection with the accident; or e. Auto operated by the applicant or any resident operator is struck by a “hit-and-run” vehicle, if the accident is reported to the proper authority within a reasonable time by the applicant or resident operator; or f. The accident resulted from contact with animals, birds, or falling objects; or g. The applicant or any resident operator was using the auto in response to an emergency if the operator of the auto at the time of accident was a paid or volunteer member of any Police or Fire Department, First Aid Squad, or any law enforcement agency. This exception does not include an accident occurring after the auto ceases to be used in response to such emergency; or h. The accident was a solo vehicle accident that was principally caused by a hazardous condition of which a driver, in the exercise of reasonable care, would not have noticed (example, “black ice”). REFUND OF SURCHARGED PREMIUM If points have been assigned for an accident and it is later determined that the accident falls under one of the exceptions in this rule, the company shall refund to the insured the increased portion of the premium generated by the accident. SDIP - CONVICTIONS DRIVING RECORD POINTS Points will be assigned for convictions during the experience period for motor vehicle violations of the applicant or any other current resident operator as follows. Points will be assigned to the vehicle customarily driven by the operator responsible for incurring the points subject to primary class vehicle assignment rules. This applies only to those individuals whose specific duties include driving their employer‟s motor vehicles or individuals who have authority in their name from the Public Utilities Commission to operate as a highway carrier and who are the registered owners or lease operators of the motor vehicle used in the operation as a highway carrier. DECLINING SURCHARGE PLAN The number of points assigned to each operator will be reduced by one if the operator has incurred no chargeable accidents or convictions within the preceding 12-month period. Points will continue to be reduced by one for each additional 12 month period (until they fall out outside the experience period) if no chargeable accidents or convictions are added. Conviction points will be reduced first before accident points. The declining surcharge plan does not apply to violations and accidents with an initial charge of more than 4 points. Note: Points, once reduced, will not increase for the remainder of the experience period. An active, internally operated alarm that includes a forced action prompter. A high security ignition replacement lock. (A sticker may identify the presence of this system.) Passive: A passive alarm system, if equipped with a shaker device, permits the shaker to be independently deactivated for the remainder of the system; or includes either a redundant starting means or an internally operated special anti-theft lock for the hood locking and latching system. A passive fuel cut-off switch. A passive ignition cut-off system Good Driver Discount shall be applied to the premiums for all coverages. Operators that meet the definition of a Good Driver will qualify as a Good Driver Plus driver if the operator has had no accidents or violations in the last five years. Operators that qualify as a Good Driver Plus will receive a 5% discount in addition to the 21% Good Driver discount for a total of 26%. A factor of 0.95 applies in the premium for Bodily Injury, Property Damage, Medical Payments, Uninsured Motorists (Bodily Injury and Property Damage), Comprehensive and Collision coverage if the name insured or spouse/ registered domestic partner is a member of one of one the professional groups listed in the manual. This discount will apply to each vehicle on the policy. The owner operator must be a full time student with less than 10 years driving experience. A certified statement is required from a school official indicating during the immediately preceding school semester, the student has maintained a "B" average or an average equivalent to a 3.0 on a 4 point grading system, is in the upper 20% in his or her class scholastically, or is listed on the "Dean's List" or "Honor Roll" or equivalent. This discount can only be applied at policy inception or renewal. If a youthful operator is a student residing at an educational institution over 100 miles from the auto's principal garaging location and with no vehicle at school, the student away at school discount shall be applied. This factor shall be based on the eligibility of the principal operator of the auto for the mature driver improvement course discount. 1. The Mature Driver Improvement Course Discount applies if the principal operator of the auto is age 55 or older, and has successfully completed a mature driver improvement course approved by the California Department of Motor Vehicles within the three year period immediately preceding the effective date of the policy for both new and renewal policies. 2. For total loss, we will pay the unpaid amount due on the lease/loan less any deductions specified under the endorsement. Coverage must be added within 180 days after delivery of the new or leased vehicle. The endorsement is available only for vehicles purchased or leased new. Repair or Replacement Coverage must be maintained continuously on the auto. Coverage on the vehicle cannot be reinstated, once it has been discontinued. Repair or Replacement Auto Loan Lease Gap Coverage is available only if Collision and Comprehensive coverage are carried for the auto. Attach: Auto 684: Repair or Replacement Plus Endorsement REPAIR OR REPLACEMENT PLUS RATE 12% of the combined Comprehensive and Collision premium for qualified vehicles 5 years of age and younger. 20% of the combined Collision and Comprehensive premium for qualified vehicles over 5 years of age. Note: This coverage includes Auto Loan Lease Gap Coverage. SUSPENSION OF INSURANCE Under any policy providing only physical damage coverage, only Collision may be suspended. Liability coverages may not be suspended for risks for which a financial responsibility filing is in effect. Insurance may be suspended by endorsement in accordance with the following provisions provided the period of suspension is at least thirty (30) consecutive days: Insurance may be reinstated upon the named insured's request effective not earlier than receipt of such request by the company or any of its authorized representatives. The Reinstatement of Insurance Endorsement shall not extend the policy beyond its original expiration date. Pro Rata premium credit shall be granted for the period of suspension upon reinstatement. Companies can retain a minimum of ninety days premium calculated on a pro rata basis for the policy period. 27 KIC UAH / CA If the policy expires during the period of suspension, the named insured shall be entitled to pro rata return premium in accordance with the foregoing provisions of this rule with respect to the minimum period of suspension and minimum premium retention by the company. Under any policy providing just physical damage coverage, only Collision may be suspended. Liability coverages may not be suspended for risks for which a financial responsibility filing is in effect. If Liability coverage is suspended on all owned autos, coverage for which separate premiums apply including uninsured motorists coverage, underinsured motorists coverage, medical payments coverage or extended liability coverage provided under the use of other autos provisions - may be continued in force without premium adjustment for these coverages. If Liability or Collision is suspended on all private passenger autos owned by an individual or husband and wife, use of other autos coverage, for Liability only, afforded without separate premium charge under a Personal Auto Policy may be continued in force. In this case, 80% pro rata of the owned auto premium calculated in accordance with the provisions of this rule shall be returned to the insured upon reinstatement of the coverages. Insurance covering a private passenger auto which is withdrawn from service for a period of at least thirty (30) consecutive days because of a strike, may be suspended. Pro rata return premium on such vehicles shall be granted in accordance with Section (C) provided the insured furnishes the company with a letter requesting the return premium. The letter shall be written on the insured's letterhead, signed by an executive of the company and shall include the following: o A description of each auto o The dates between which it was laid up because of the strike o A statement by the insured that he agrees to reimburse the company for any payment made by the company on account of any accident, claim or suit involving a coverage for an auto described in the letter for which return premium has been allowed by the company. A recreational trailer is a non-self-propelled unit equipped as living quarters including cooking, dining, plumbing, or refrigeration facilities. A camper body is a non-propelled unit designed to be transported by a pickup, with or without cooking, dining, sleeping, plumbing, or refrigeration facilities. The camper body may or may not be permanently attached to a pick up. The insured must maintain a separate and permanent residence other than the recreational trailer or camper body. Coverage is not provided on an agreed basis. We may request information, from the insured, as is listed below in Information Requirements, to support the Vehicle Use declaration and/or Annual Miles estimate. An insured may respond to our information request via means including verbal representation, signed applications, surveys and questionnaires, narrative responses and supplemental documentation. Our agents are authorized to secure, represent and/or provide, in consultation with the insured, vehicle use and annual miles support and policy rating information. Such records shall be retained by the agent, and are subject to company review and certification upon our request. Additionally, we may secure this information directly from our insured, or we may use contracted third party vendors to do so on our behalf. Those records may be retained by the company, or provided to our agents to retain in their files. Vehicle Use and estimated Annual Miles will be determined as follows: NEW BUSINESS AND MID-TERM VEHICLE CHANGES During the application process, or when a vehicle is being added or replaced during the term of the policy, the insured shall provide the miles they expect each listed vehicle will be driven during the 12month period following policy inception. If an insured does not provide vehicle use and/or an estimated annual miles figure, and/or the required support information, and/or if the information provided does not support the insured's vehicle use and/or estimated annual miles, we may issue a policy using a reasonable objective use and mileage estimated based upon the information provided. If a reasonable estimate cannot be determined, we will apply the appropriate default average vehicle use and annual miles figure: o Primary Vehicles: 13,000 Annual Miles and Work Use (8 miles to work, 5 days/week) o Excess Vehicles: 4,000 Annual Miles and Pleasure use (0 miles to work, 1 days/week) RENEWAL BUSINESS We will request, at least every three years, that an insured provide the estimated vehicle use and annual miles for the 12-month period following policy renewal. We may also request information from the insured to support that estimate. We may, if not requesting updated information, use the vehicle use and annual miles figures from the expiring policy, or use a reasonable objective estimated based solely on the information requirements below. We may renew the policy using either the vehicle use and annual miles figures from the expiring policy, or using a reasonable objective use and mileage estimate based upon the information requirements set forth below, whichever we determine is the most reasonable. We may, if we do not receive a response to our request for updated information, renew the policy using the appropriate default vehicle use and annual miles figures listed above. Before renewing a policy, we will provide the insured written notice that highlights the vehicle use an annual miles rating for the expiring and renewal policies. VEHICLE USE AND ANNUAL MILEAGE INFORMATION REQUIREMENTS We may require an insured to provide the following information upon request: If vehicle is used to drive to work or school, the location of the workplace, school, or other destination, and if applicable, an estimate of the number of miles the vehicle will be driven in the course of employment or related activity. 31 KIC UAH / CA The number of days per week the vehicle will be used for driving to work or school. An estimate of the annual miles to be driven for pleasure or other purposes. The appropriate total number of miles driven for any time period within the previous 24 months. The reason for any differences between the estimate for the upcoming 12 months and the miles driven during the previous 12 months; and The current odometer reading of the vehicle to be insured. We may obtain and use smog check odometer readings from the CA Bureau of Automobile Repair to estimate the annual miles driven. We may also request, but not require, an applicant or policyholder to provide the following information: Service records which document the odometer reading of the vehicle to be insured. The use of technological devices provided by the insurer or otherwise made available to the insured that accurately collect vehicle mileage information.
