H E R E A S b y a n A c t of t h e G o v e r n o r a n d Council passed in t h e
t e n t h y e a r of t h e r e i g n of H i s l a t e M a j e s t y K i n g George t h e
F o u r t h i n t i t u l e d " An Act for instituting
and, regulating
Courts of
General Quarter Sessions in New South Wales" provision is m a d e
for t h e election n o m i n a t i o n a n d a p p o i n t m e n t of a J u s t i c e of t h e P e a c e
qualified as t h e r e i n - m e n t i o n e d t o act as a C h a i r m a n of t h e several
C o u r t s of Q u a r t e r Sessions i n t h e said Colony a n d w h e r e a s it is
e x p e d i e n t to a l t e r a n d a m e n d t h e said A c t so far as t h e s a m e relates
to s u c h provision a n d whereas b y a n o t h e r A c t passed i n t h e f o u r t h
y e a r of t h e r e i g n of H i s l a t e Majesty K i n g W i l l i a m t h e F o u r t h
i n t i t u l e d " An Act to amend an Act of the Governor and Council
" intituled 'An Actfor instituting Courts of General and Quarter Sessions
"in Nero South Wales'"
provision is m a d e for t h e n o m i n a t i o n a n d
a p p o i n t m e n t of a C h a i r m a n of Q u a r t e r Sessions for t h e district of
B a t h u r s t a n d it is e x p e d i e n t t h a t so m u c h thereof as r e l a t e s t o t h e
n o m i n a t i o n a n d appointment, of a C h a i r m a n for said district should
b e a l t e r e d B e it therefore e n a c t e d b y H i s E x c e l l e n c y t h e G o v e r n o r
w i t h t h e advice of t h e Legislative Council T h a t from a n d after t h e
p a s s i n g of t h i s A c t so m u c h of t h e said recited A c t s as relates t o t h e
election n o m i n a t i o n a n d a p p o i n t m e n t of a C h a i r m a n of t h e several
C o u r t s of Q u a r t e r Sessions i n t h e Colony aforesaid or a n y of t h e m
a n d t h e qualifications r e q u i r e d for s u c h office shall b e a n d t h e s a m e is
h e r e b y repealed.
2. A n d be it e n a c t e d T h a t t h e said C h a i r m a n s h a l l b e chosen
n o m i n a t e d a n d a p p o i n t e d i n m a n n e r following t h a t is t o say t h e
J u s t i c e s of t h e P e a c e for t h e said Colony shall a n d t h e y are
h e r e b y r e q u i r e d to a t t e n d at some place w i t h i n t h e said Colony
where
w h e r e P e t t y Sessions h a v e been d u l y a p p o i n t e d t o h e h o l d e n a n d
b e t w e e n t h e h o u r s of t w e l v e a n d four o'clock i n t h e day on t h e
t h i r d T u e s d a y i n t h e m o n t h of O c t o b e r i n t h e p r e s e n t y e a r a n d o n
t h e first M o n d a y i n t h e m o n t h of S e p t e m b e r i n every following
year t h e said J u s t i c e s so a t t e n d i n g a t such t i m e a n d a t s u c h place
or places shall t h e n a n d t h e r e declare i n w r i t i n g i n t h e form or
to t h e effect set forth i n t h e Schedule t o t h i s A c t a n n e x e d w h i c h of
t h e several J u s t i c e s of t h e P e a c e for said Colony t h e y severally
a n d respectively desire t o h a v e a p p o i n t e d as s u c h C h a i r m a n as afore­
said a n d t h e Police M a g i s t r a t e of t h e district if p r e s e n t a t t h e m e e t i n g
or if n o t t h e n t h e senior M a g i s t r a t e p r e s e n t shall f o r t h w i t h t r a n s m i t
t h e v o t i n g p a p e r or p a p e r s or a n y declaration i n w r i t i n g as aforesaid
t o t h e Colonial Secretary for t h e p u r p o s e of b e i n g laid before H i s
E x c e l l e n c y t h e G o v e r n o r a n d t h e J u s t i c e of P e a c e i n whose favour
t h e greatest n u m b e r of J u s t i c e s t h r o u g h o u t t h e Colony shall h a v e so
recorded t h e i r votes or declarations i n w r i t i n g as aforesaid shall b e
declared a n d a p p o i n t e d b y t h e said G o v e r n o r t o b e C h a i r m a n of t h e
several C o u r t s of Q u a r t e r Sessions w i t h i n t h e said Colony for t h e y e a r
t h e n n e x t following c o m m e n c i n g from t h e first day of J a n u a r y of
such y e a r P r o v i d e d always t h a t if t h e r e s h o u l d be a n e q u a l i t y of
votes for t w o or m o r e J u s t i c e s i t shall b e lawful for t h e said G o v e r n o r
a n d h e is h e r e b y r e q u i r e d t o a p p o i n t either of t h e said J u s t i c e s t o b e
s u c h C h a i r m a n as h e shall see fit P r o v i d e d a l w a y s t h a t n o t h i n g
h e r e i n c o n t a i n e d shall b e c o n s t r u e d t o e x t e n d t o a n y place w h e r e
P e t t y Sessions a r e or shall b e h e l d w i t h i n t h e district of P o r t P h i l l i p
or a n y o t h e r district w i t h i n t h e said Colony for w h i c h a C h a i r m a n of
t h e Q u a r t e r Sessions is n o w or shall b e hereafter a c t u a l l y n o m i n a t e d
a n d a p p o i n t e d u n d e r t h e provision of t h e said hereinbefore l a s t recited
A c t of C o u n c i l for t h e a p p o i n t m e n t of C h a i r m a n t o d i s t a n t places.
3. A n d be it declared a n d enacted T h a t n o t h i n g hereinbefore
c o n t a i n e d shall be c o n s t r u e d t o r e p e a l or a l t e r t h e provisions contained
i n t h e A c t hereinbefore last recited for t h e a p p o i n t m e n t of a C h a i r m a n
a t d i s t a n t places a n d also for s u p p l y i n g t h e place of t h e C h a i r m a n i n
case of d e a t h r e s i g n a t i o n r e m o v a l or illness b u t t h e same shall r e m a i n
a n d b e i n full force a n d effect a n d shall b e held t o a p p l y as far as t h e
s a m e m a y be necessary t o t h e C h a i r m a n so t o b e elected n o m i n a t e d
a n d a p p o i n t e d u n d e r a n d b y v i r t u e of t h e provisions of t h i s A c t .
