Executive Summary
1.1 Introduction
1.1.1 Overview
The Americans with Disabilities Act (ADA) is a comprehensive civil rights law for persons with disabilities
in the provision of employment, state and local government, public accommodations, commercial
facilities, transportation, and telecommunications. The purpose of the ADA is to provide a “clear and
comprehensive national mandate for the elimination of discrimination against individuals with
disabilities.” Congress emphasized that the ADA seeks to dispel stereotypes and assumptions about
disabilities and to assure equality of opportunity, full participation, independent living and economic
sufficiency for people with disabilities. The Garden City Community College is in the process of a
comprehensive evaluation of its facilities to determine the extent to which individuals with disabilities
may be restricted in their access to services and buildings.
The ADA Transition Plan is prepared in fulfillment of the requirements set forth in Title II of the ADA.
The ADA states that a public entity must reasonably modify its policies, practices, or procedures to avoid
discrimination against people with disabilities. The ADA Transition Plan will assist Garden City
Community College in identifying physical barriers to accessibility and in developing solutions set forth
to assist in the removal of such barriers that will facilitate the opportunity of access to all individuals.
This report describes the process by which Garden City Community College’s facilities were evaluated
for compliance with Title II of the ADA; presents the findings of that evaluation; and establishes the plan
for accessibility improvements. Section 1 provides an overview of the requirements and the process for
developing the ADA Transition Plan. Section 2 addresses the findings and recommended actions,
including a schedule of barrier removal related to the Garden City Community College campus and other
outreach locations for providing accessible buildings, parking facilities, and paths of travel.
1.1.2 Federal Legislative Mandate
The development of a Transition Plan is a requirement of the federal regulations implementing the
Rehabilitation Act of 1973, which require that all organizations receiving federal funds make their
programs available without discrimination toward people with disabilities. Section 504 of the
Rehabilitation Act, which has become known as the “civil rights act” of persons with disabilities, states
that:
“No otherwise qualified handicapped individual in the United States shall, solely by reason of
handicap, be excluded from the participation in, be denied the benefits of, or be subjected to
discrimination under any program or activity receiving federal financial assistance.”

Subsequent to the Rehabilitation Act, Congress passed the Americans with Disabilities Act (ADA) of
1990. Garden City Community College is obligated to observe all requirements of Title I and ADA in its
employment practices; Title II in its policies, programs and services; any parts of Title IV and V that apply
to the college, its programs, services, and facilities; and all requirements specified in the ADA
Accessibility Guideline (ADAAG) that may apply to facilities.
The Department of Justice’s Title II regulation adopts the general prohibitions of discrimination
established under Section 504 and incorporate specific prohibitions of discrimination for the ADA. Title
II provides protection to individuals with disabilities that are at least equal to those provided by the
nondiscrimination provisions of Title V of the Rehabilitation Act.
The federal legislative mandate, therefore, prohibits Garden City Community College from either directly
or through contractual arrangements:


Denying persons with disabilities the opportunity to participate in services, programs or
activities that are not separate or different from what other individuals are offered.
In determining the location of programs and services, making selections that have the effect of
excluding or discriminating against persons with disabilities.
Mandate for Public Accommodations TITLE I & II
Discrimination-subject to the provisions of Title I and II, no qualified individual with a disability
shall, by reason of such a disability, be excluded from participation in or be denied the benefits of the
services, programs or activities of a public entity, or be subject to discrimination by such entity.
The definition of "disability" under the ADA reflects the intent of Congress to prohibit the specific
forms of discrimination that persons with disabilities face. While individuals with disabilities may
experience the types of discrimination that confront other groups, they also may encounter unique
forms of discrimination because of the nature of their disabilities and the effect that their present, past,
or perceived conditions have on other persons. The purpose of the ADA is to eliminate discrimination
that confronts individuals with disabilities.
Since the definition of the term "disability" under the ADA is tailored to the purpose of eliminating
discrimination prohibited by the ADA, it may differ from the definition of "disability" in other laws
drafted for other purposes.

(b) Statutory Definition -- With respect to an individual, the term "disability" means:
(A) a physical or mental impairment that substantially limits one or more of the major life
activities of such individual;
(B) a record of such an impairment; or
(C) being regarded as having such an impairment.
42 U.S.C. § 12102(2); see also 29 C.F.R. § 1630.2(g). A person must meet the requirements of at least
one of these three criteria to be an individual with a disability under the Act.
The first part of the definition covers persons who actually have physical or mental impairments
that substantially limit one or more major life activities. The focus under the first part is on the
individual, to determine if (s) he has a substantially limiting impairment. To fall under the first part of the
definition, a person must establish three elements:
(1) that (s)he has a physical or mental impairment
(2) that substantially limits
(3) one or more major life activities.
The second and third parts of the definition cover persons who may not have an impairment that
substantially limits a major life activity but who have a history of, or have been misclassified as having,
such a substantially limiting impairment, or who are perceived as having such a substantially limiting
impairment. The focus under the second and third parts is on the reactions of other persons to a history
of impairment or to a perceived impairment. A history or perception of an impairment that substantially
limits a major life activity is a "disability." These parts of the definition reflect a recognition by Congress
that stereotyped assumptions about what constitutes a disability and unfounded concerns about the
limitations of individuals with disabilities form major discriminatory barriers, not only to those persons
presently disabled, but also to those persons either previously disabled, misclassified as previously
disabled, or mistakenly perceived to be disabled. To combat the effects of these prevalent

misperceptions, the definition of an individual with a disability precludes discrimination against persons
who are treated as if they have a substantially limiting impairment, even if in fact they have no such
current incapacity.
902.2 Impairment
(a) General -- The person claiming to be an individual with a disability as defined by the first part of
the definition must have an actual impairment. If the person does not have an impairment, (s)he does
not meet the requirements of the first part of the definition of disability. Under the second and third
parts of the definition, the person must have a record of a substantially limiting impairment or be
regarded as having a substantially limiting impairment.5
A person has a disability only if his/her limitations are or were regarded as being the result of an
impairment. It is essential, therefore, to distinguish between conditions that are impairments and those
that are not impairments.
(b) Regulatory Definition -- A physical or mental impairment means
(1) [a]ny physiological disorder, or condition, cosmetic disfigurement, or anatomical loss
affecting one or more of the following body systems: neurological, musculoskeletal, special sense
organs, respiratory (including speech organs), cardiovascular, reproductive, digestive, genito-urinary,
hemic and lymphatic, skin, and endocrine; or
(2) any mental or psychological disorder, such as mental retardation, organic brain syndrome,
emotional or mental illness, and specific learning disabilities.
Regarding Title I, it means an individual with a disability who, with or without a reasonable
accommodation, can perform the essential functions of the employment position that such an individual
holds or desires. For the purposes of Title I, consideration shall be given to the employer’s judgment as
to what functions of a job are essential, and if the employer has prepared a written description before
advertising or interviewing applicants for the job, this description shall be considered evidence for the
essential functions of the job.

1.1.3 Accessibility Requirements
The federal legislation mandates that all publicly funded buildings, structures, sidewalks, curbs and
related facilities shall be accessible to and usable by persons with disabilities. These regulations, often
referred to as parking facilities and lots, walk ways, curb ramps that were constructed using state, local,
municipal funds or that are owned, leased, rented, contracted, or sublet to Garden City Community
College. The mandate states that all persons with disabilities may approach, enter or exit buildings. This
includes access to restrooms, drinking fountains and telephones and applies to new construction and
specific areas of existing buildings, when remodeled.
The mandate regarding the accessibility of parking lots and structures include the following:






When a parking lot does not serve a particular building, accessible parking shall be located in the
shortest route to an accessible pedestrian entrance of the parking facility; and
In buildings with multiple accessible entrances with adjacent parking, accessible spaces should
be dispersed and located closest to the accessible entrance; and
Parking lots shall comply with the minimum number required parking stalls as referred to in
section 4.6.1 in the compliance manual; and
Ground surfaces along accessible routes and in accessible spaces shall comply with section 4.5 in
the compliance manual; and
The parking spaces designated for accessible parking shall comply with the federal mandate for
appropriate width and sloping as referred to section 4.6.3 in the compliance manual; and
All accessible parking stalls shall be equipped with an appropriate sign showing the symbol of
accessibility as referred to 4.30.5 in the compliance manual. Such signs shall not be obscured by
a vehicle parked in the space.
The mandate regarding the accessibility of buildings in compliance with Section 504, ADA is as follows:


Alterations to existing facilities or buildings shall comply with the applicable provisions of 4.1.1
to 4.1.4 of 4.1 minimum requirements to new construction; and
No alteration of an existing element, space, or area of a building shall impose a requirement for
greater accessibility then that which would be required for new construction.
1.1.4 Garden City Community College Policy and Procedure- Accommodation Services
Garden City Community College Policies and Procedures governing Accommodation Services state that
disability programs and services are required to observe the following:

The Accommodation Services program shall be the primary provider to assist in facilitating equal
educational opportunities for students with disabilities; and
The Accommodation Services program shall be available to students with verified disabilities as
per Section 504, Rehabilitation Act and Americans with Disabilities Act to include but not limited
to reasonable accommodations, accessible facilities, access to accessible equipment, and
services provided by the Garden City Community College: and
No student with disabilities is required to utilize services provided by Accommodation Services;
and
The Dean of Student Services shall assure the Accommodation Services program conforms to all
requirements established by relevant laws and regulations; and
Student disability records shall be kept confidential and separate from all other records stored
at Garden City Community College.
1.1.5 Discrimination and Accessibility
There are two types of accessibility: physical accessibility and program accessibility. Absence of
discrimination requires that both types of accessibility be provided.
The ADA establishes requirements to ensure that buildings and facilities are accessible to and usable by
people with disabilities. Design guidelines to achieve accessibility have been developed and are
maintained by the Access Board under the jurisdiction of the ADA. Accessibility Guidelines (ADAAG)
cover a wide variety of facilities (including buildings, outdoor recreation sites, and curb ramps) and
establish minimum accessibility requirements for new construction and alterations to these facilities.
Garden City Community College may achieve physical accessibility by ensuring that a facility is barrier
free and meets ADAAG technical requirements as set forth in Section 504 Compliance Manual. Barriers
include any obstacles that prevent or restrict the entrance to or use of a facility.
Programmatic accessibility includes physical accessibility, but also entails policies, practices and
procedures that permit people with disabilities to participate in programs and to access information,
opportunity to participate in or benefit from a public entity’s programs or services.
Garden City Community College may achieve program accessibility by a number of methods, both
structural and non structural:




Structural methods such as altering an existing facility;
Redesign of equipment;
Assignment of aides and/or
Providing services at alternative accessible sites

When choosing a method of providing program access, Garden City Community College will give priority
to the one that results in the most appropriate to encourage interaction among all users, including
individuals with disabilities.
1.1.6 Undue Burden
Undue Burden is defined as an action requiring significant difficulty or expense. Among the factors to be
considered in determining whether an action would result in an undue burden are the following:
1. The nature and cost of the action;
2. The overall financial resources of the site or sites involved; the number of persons employed at
the site; the effect on expenses and resources; legitimate safety requirements necessary for safe
operation, including crime prevention measures; or any other impact of the action on the
operation of the site;
3. The geographic separateness, and the administrative or fiscal relationship of the site or sites in
question to any parent corporation or entity;
4. If applicable, the overall financial resources of any parent corporation or entity; the overall size
of the parent corporation or entity with respect to the number of its employees; the number,
type, and location of its facilities; and
5. If applicable, the type of operation or operations of any parent corporation or entity, including
the composition, structure, and functions of the workforce of the parent corporation or entity
Garden City Community College will not take action that it can demonstrate would result in fundamental
alteration in the nature of program or activity, would create a hazardous condition for other people or
would represent an undue financial and administrative burden. The determination can only be made by
Administration of Garden City Community College in collaboration with the ADA Coordinator with a
statement citing the reasons for reaching the conclusion or decision.
The determination that an undue financial burden would result must be based on an evaluation of all
resources available by Garden City Community College.
1.2 Garden City Community College Approach
Garden City Community College completed an implementation plan in June of 1994. While this plan was
thorough and comprehensive, many changes to the campus have occurred. Garden City Community
College received money from a trust allocated for an addition to the Nursing Department in fiscal year
2008. The trust mandates the building of smart classrooms, room simulators for the nursing students,
and a nursing lab.

Garden City Community College has been awarded stimulus funds from the State of Kansas that allow
for only the renovation of college buildings to assist in compliance of accessibility in designated

The transition plan update, in accordance with Title II of the Americans with Disabilities Act and
requirements of the State of Kansas included a survey of all campus facilities, including parking facilities,
buildings, campus paths of travel, classrooms and or program activities are provided for the public.
The ADA Transition Plan Update was led by the ADA Compliance Coordinator, Dean of Student Services,
Dean of Administrative Services, Director of the Physical Plant, and the Assistant Director of Physical
Plant for the Garden City Community College.
1.3 ADA Transition Update Development Requirements
The ADA sets forth specific requirements for the preparation of an acceptable Transition Plan. At a
minimum, the elements of a plan should include:
 A list of physical barriers that limit the accessibility of its programs, activities or services to
students with disabilities;
 A detailed outline of the methods to be used to remove these barriers and meet the current
standards of accessibility requirements;
 A schedule for taking the steps necessary to remove architectural barriers;
 The name of the individuals responsible for the plan’s implementation.
1.4 ADA Transition Plan Update Development Process
1.4.1 Introduction
Services and programs offered by Garden City Community College to the public must be accessible.
Accessibility applies to all aspects of a program or service, orientation, eligibility, participation, testing,
physical access, provision of auxiliary aids, and transportation.
The process of making facilities accessible to all individuals will continue to be ongoing and Garden City
Community College will continue to review accessibility issues and periodically evaluate the success of
improving access to facilities.
The goals of the ADA Transition Plan Update were:
 To conduct an accessibility evaluation of the facilities at Garden City Community College
 To develop facility accessibility recommendations for the campus; and
 To incorporate the views of the disability community in the Transition Plan Update.

1.4.2 Garden City Community College Campus Involvement Survey
Below are sample comments provided by students, staff, and faculty from Garden City Community
College; 101 total respondents to the campus survey. Details of all responses may be found in Appendix
II-Survey Results.






Some automatic doors are needed for all entrances to the buildings.
Handicap door buttons should be easier to find; buttons are placed in hard to see and reach
locations.
Some issues with grading between section and cracks
Parking lots are far from buildings.
Crosswalk by the Penka parking lot and the BTSC is difficult for students in wheelchairs.

1.4.3 Garden City Community College- Ongoing Commitment to Accessibility
Garden City Community College’s commitment to accessibility is for the development of a focus group
centered on improvements towards compliance. Through the team approach all barriers listed and
recorded will be maintained by all members of the group. Through the focus group a plan of action will
be implemented for the removal of campus barriers as recorded in the master plan of this document.
ADA Transition Plan Update
2.1 Introduction
The ADA Transition Plan Update presents the findings of the facility surveys and public participation
process conducted by the college in the fall of 2009.
The following information is included in the Transition Plan Update for the removal of architectural
barriers to program access:
 Identification of the architectural barriers to program access
 Identification of a schedule of barrier removal
 Identification of responsibility for ensuring barrier removal
2.1.1 Facility Survey Process
The survey process was accomplished using a team of key personnel equipped with measuring devices,
facility diagrams, and information regarding campus improvements. The survey process identified
barriers on campus buildings, parking, and campus paths of travel based on ADAAG and Title II

standards. Garden City Community College will conduct a survey on a biennial basis. Diagrammatic
sketches of each building floor plan were annotated during the survey process and are included in the
facility reports. The diagrams indicate the location of architectural barriers and are numbered to
correspond to the facility report process. The annotated diagrams will assist the team in prioritizing
barriers of removal. The diagrams provide a visual reference for evaluating the physical and
programmatic barriers posed by each architectural barrier.
2.1.2 Facility Reports
A facility report has been produced for each site and building, detailing each item found to be in
noncompliance with ADAAG and Title II standards. The facility report for each site includes:





Barrier Identification Table: Each specific barrier encountered during the survey process is listed
in table format. Barriers are organized by building location.
Conceptual Solution: A feasible conceptual solution to resolving the barrier is provided in text
format.
Cost Estimate: A cost estimate is provided for the removal of each barrier.
Priority Level: A priority is given for each architectural feature and each action related to the
removal of barriers.
Reference Diagram: A reference diagram locates the barriers at each building, parking facility
and path of travel.
2.2 Transition Plan- Garden City Community College Priorities
2.2.1 Overall Campus Barrier Removal Priorities
Recognizing that the college has limited funds and cannot immediately make all facilities fully
accessible, the following criteria were applied as the basis for prioritizing the removal of
architectural barriers campus wide:




Number of users: The facility or building serves a large number of people, including persons
with disabilities.
Stagnant facilities: The facility houses programs or departments that cannot easily be shifted to
another location.
Current degree of accessibility: The facility is in need of access improvements.
Long term planning status: The facility or building is scheduled for improvements that will
include accessibility.

2.2.2 Specific Barrier Removal Priorities within a Facility
The criteria listed below were used to assist in the determination of specific program based barrier
removal actions within a facility for the Transition Plan.
1. Primary access and path of travel: The highest priority is placed on those barrier removal items
that provide accessibility at the main entrance of a facility or improve the path of travel where
program activities take place ( for example, parking, walks, ramps, stairs, doors, and corridors).
2. Program area: A second level priority is placed on those barrier removal items that improve or
enhance access to program use areas (for example classrooms, department offices and
restrooms).
3. Amenities: A third level priority is placed on those barrier removal items that improve access to
amenities serving programs areas (for example, drinking fountains, telephones, etc).
4. Not required to be modified: A fourth level priority is given to areas or features not required to
be modified for accessibility.
Since not all barriers must be removed in order to provide program access, those barriers that limit
access to programs, services and activities are given first priority. These criteria will also be used for
prioritizing the removal of architectural barriers in future projects.
