ATIENZA REP. ATIENZA. Maraming salamat po, Mme. Speaker. Thank you, Dep. Majority Leader, at sa aking mga kasamahan sa Kongreso, mayroon po kaming nais iparating sa inyo sa araw na ito. Today is a very important day in our history, September 21, 2015. On September 21, 1972, Martial Law was declared all over the country. Magmula po noong araw na iyon, nagsimula ang landas ng ating bansa sa landasing hindi natin naiintindihan. Ngayon, sa paglingon ng panahon, maaari na nating gunitain ang mga aral ng Batas Militar. For 14 years, we were deprived of our rights and freedoms in a democratic society. We sacrificed ourselves in the process, and we saw with our very own eyes and our lives the lessons of this very critical, important period in our nation’s life, most important of which, I would like to state, Mme. Speaker, is the element of national discipline. Disiplina ang kailangan upang tayo ay gumalaw bilang isang lipunan, isang bansa tungo sa kaunlaran. Marami po ang nangyari sa pamamagitan ng panawagang tayo ay magkaroon ng disiplina. Higit sa lahat, sa aking gunita, ang napakagandang aral ng Martial Law ay ang pagpupunyagi ng sambayanan sa kanilang karapatan because in the long run, no matter what transpired in those 14 years of martial rule, where rights were violated and the good old saying that power corrupts and absolute power corrupts absolutely, it overtook the good intentions probably of the ruler of our country then. Tayo po ay nakawala sa tanikala ng Martial Law sa pagpipilit, pakikipaghamok at pakikibaka ng sambayanan, na hindi makapaniwala ang buong mundo na nagawa natin ang tama. Magmula noong Pebrero 25, 1986, itinanghal ang Pilipinas na nagkaroon tayo ng kalayaan sa ating pagsisikap bilang nagkakaisang mamamayan. So as we look back in history, we have to commemorate these very significant events in our national life, lest we do not also gain any benefits out of them. Many of our colleagues in this Congress were deprived of 14 years of their freedom. Many of our countrymen sacrificed their lives even. Up to now, many faceless, nameless Filipinos have disappeared, nowhere to be found. Wala na po tayong alaala rito kung hindi ang ating pansariling karanasan. As we pause today, as we cannot allow this day to pass without commemorating and inculcating in our minds that we have to learn from the past, therefore my colleagues, mga minamahal kong mga kababayan, kinakailangan ding paalalahanan natin ang lahat ng sektor upang tayo ay hindi na dumaan pa sa ganyang uri sa ating buhay. 12 We have to learn, ladies and gentlemen, distinguished Members of Congress, to be very careful in how we wield our powers. Iyan din po naman ang panawagan ng panahon na ang mga namumuno, both in the national and the local levels, should be very careful so as not to abuse power, authority and our helpless people. Sa mga makapangyarihan, ang pag-apak sa isang mahirap ay napakadaling gawin, subalit sa damdamin ng isang mahirap na naaapi, hindi po maaaring madampian ng anumang solusyon kung hindi katarungan lamang. I am calling on all the levels of government today to be very careful, circumspect and always remember the lessons of Martial Law so that we will not abuse our newfound freedom and authority. Tingnan po natin ang nangyayari sa Maynila. I would like to focus on the city of Manila in this particular case simply because I know that in my city, our poor are being deprived of their rights by a government that did not keep its promise. Ang sabi po nila, sila ay tutulong sa mga mahihirap. Subalit ngayon, ano ang nangyayari sa Maynila? Sinimulan ang pagsingil ng serbisyo sa health center. Sinimulan ang pagsingil ng serbisyo sa ospital. Sinimulan ang pagsingil sa paggamit ng playgrounds. Iyon bang mag-swimming ka sa public swimming pool magbabayad ka pa? Ito po ay ginagawa ngayon dito sa ating lungsod. The biggest issue now, Mme. Speaker, is the so-called “sell-out” of all our public markets. Can you visualize a country with no public markets? Ang pamilihang bayan po ay isang pangako sa isang demokratikong sistema na ang mahihirap ay mabibigyan ng paraang makabili ng bilihing mas mababa ang presyo sa pribado. Ang pamilihang bayan po ay isang commitment ng pamahalaan upang ang maliliit ay magkaroon ng lugar upang sila ay makapagnegosyo. This is mandated in the city of Manila by no less than the Local Government Code and the Revised City Charter of Manila which mandates that the local government must provide and maintain public markets. Saan po nila hinuhugot? Iyan po ang tanong ng mga kabataan ngayon. Saan nila hinuhugot ang kapangyarihan na ang pamilihang bayan ay ibenta mo sa pribado? Ang tawag po nila, “privatization.” Ang iba naman ang tawag ay restoration. Ang iba naman ang sabi, ito raw po ay negosyo ng pamahalaang lungsod. Pero hindi ko po maalaala sa aking paglaki sa Maynila na nagkaroon kami ng batas na ang pamilihang bayan ay kinakailangang kumita ng salapi para sa gobyerno. In fact, all the expenses of a public market operation are derived from the appropriations granted by the people themselves through their elected councilors. Kaya ang katagang “privatization” ay ang pagsasaayos para sa ating kapakanan ay hindi po kapani-paniwala. Nasa kontrata po sinasabi na ang palengke ay kukunin na ng isang pribadong korporasyon. Sa palengke lang po nakakabili ng tingi--tinging suka, tinging patis, tinging bigas. Lahat po, natitingi sa palengke sapagkat iyan ang tunay na buod at tunay na dahilan na ibigay ang mga pamilihang bayan sa tungkulin ng mga pamahalaang lungsod. It is the duty of the local government unit to establish and maintain—iyon po ang mga kataga, “establish and maintain”—public markets as a major public service. Ito po ay ipinananawagan ko sa inyo sapagkat alam ko, nakatingin ang ibang lungsod—dito lang sa Metro Manila, Pasay is probably watching, the same with Caloocan, Mandaluyong, Parañaque and all the other cities. Nakalulungkot po talaga, ayon sa sinabi ni Kagalang-galang Atienza, ang estado po namin sa Siyudad ng Maynila. Hindi ko maintindihan baka sakasakaling ito naman ay kayang-kaya namang sagutin ni Honorable Atienza. Hindi ko maintindihan, is there a compelling reason para itong mga palengkeng ito ay isapribado? Ano ba talaga ang dahilan? Kaya hindi ko po maintindihan, distinguished Gentleman from Manila whom I know, whose heart is in the right place in his chest, whose brains are also in the right place in his head. Hindi ko po maintindihan, bakit ang palengke ang pinag-iinitan at bakit hindi gumamit ng kanilang paraan at kapangyarihan upang ang palengke ay iayos na hindi ibinibenta kanino pa man. REP. BAGATSING. Mr. Speaker, naitanong ko rin po sa ating Kagalang-galang na Atienza, ito bang mga tao sa palengke, na mga nagbebenta roon, pati iyong mamimili sa palengke, sila ba ay nakonsulta bago gawin ang plano ng siyudad ang kanilang ninanais? Mayroon bang konsultasyon, mayroon bang due process na ginawa? Dahil sa nadidinig ko sa telebisyon, sinasabi nila, nagkaroon daw ng konsultasyon, nagkaroon daw ng public hearing. Kapag tinatanong naman natin iyong mga tao sa palengke, sila-sila ang nag-hearing pero wala ang publiko. Hindi ko maintindihan na ito bang mga leaders na ating tinulungan-- nakasama kita noong nakaraang eleksyon, natulungan natin--ay naging insensitibo na ba, naging highly insensitive, at iyong kanilang personal agenda na lamang ang kanilang pinaiiral? Balewala na ang sentimyento ng mga taong nakapuwesto sa palengke. Balewala na rin ang sentimyento noong mamimili na sakop nitong mga palengkeng ito. Hindi ko po maintindihan kung bakit po ganito ang pakiramdam ng mga taong iyan. Isinasawalang bahala ang ‘ika ngang concern ng mga taong tatamaan sa planong iyan. Kagaya ng sinabi po ninyo kanina, Kagalanggalang na Atienza, noong panahon ninyo, ginugol ninyo, sariling pondo ng siyudad para ipagpagawa ang palengke. Noong panahon po ninyo, hindi katulad ng panahon ngayon, medyo masikip nang kaunti ang pera ng city hall noong panahong iyon, pero sa kabila niyan, naituloy ninyo. Itong panahon ng kasalukuyang alkalde, itinaas ang presyo ng real estate, 100, 200, 300 percent. Itinaas ang presyo ng business tax to 300 percent, maraming buwis na ipinatong. Sa kabila ng dami ng buwis na ipinatong sa balikat ng mga Manileño, bakit kinakailangan pa siyang kumuha ng partner kung talagang ang interes ng mga tao sa palengke ang kanyang inaalagaan? Bakit hindi siya tumulad sa inyo na noong kayo ay alkalde, sa kabila ng kakulangan ng pondo, hindi ninyo isinapribado ang palengke bagkus, pinaganda ninyo? Baka ‘ika ko mayroon kayong alam na dahilan kung bakit may pera naman sila, ay bakit humahanap ng joint venture partner. REP. ATIENZA. Ginoong Kinatawan ng ating lungsod, wala po akong makitang kadahilanan kung hindi po iyong gusto nilang pagkakitaan itong mga pamilihang bayan, whether officially or personally, sila lang po ang nakakaalam noon. Pero hindi po natin puwedeng ipaliwanag, bakit ninyo ginagawa iyan? Isa lang ang aking nakikita rito, akala nila ang mga taga-palengke ay maliliit. Ang akala nila ay hindi makalalaban. “Puwedeng-puwede natin itong alisan ng kapangyarihan at karapatan, walang magagawa iyang mga iyan.” I can only sense that they are not respectful of the rights of our people in the public markets. Akala nila ay magtatagumpay ang kanilang maruming hangarin. At ikinalulungkot ko namang aminin, tila wala nang naiwan na mga miyembro ng konseho municipal. Alam ko sa pagkakataong ito, Congressman Bagatsing, palagay ko ay iyong mga nakaupong Congressman ay magagalit sa iyo, ikaw pa naman ay haharap sa lungsod. Na kapag tinatanong ko naman ang mga taga-palengke ay talaga namang sinasabi nila, “Hindi, hindi kami pumapayag, hindi kami papayag sapagka’t iyang palengke ay kung ibibigay din lamang sa pribado, ang sabi ng batas, ibigay iyan sa kooperatiba sa loob ng palengke.” So, they know their rights, but it is the underestimation of the authorities at city hall today. Sila ang nagkakamali, ang akala nila, iyong kaliitan ng mga manininda ay kaya nilang pagsamantalahan. Alam ninyo, iyong aming palengke sa Paco, na isang magandang palengke, ay isinapribado ng dating alkaldeng si Lim, nai-privatize niya. Ngayon, iyong mga stallholders namin sa Paco nagbabayad na sa City Hall, nagbabayad pa ng management fee doon sa binigyan ng dating alkaldeng Lim. Siya ang nag-umpisa sa privatization. Hindi ko lang maintindihan kung bakit itong kasalukuyang Mayor ay sumunod at ang sinundan, siyam o 10 palengke, phase one. So, hindi ko maintindihan kung bakit sa kabila ng dami ng pera nila ay humahanap pa rin sila ng joint venture partner. Ako ay gulong-gulo, siguro ba itong mga taong ito ay talagang wala nang pakialam sa pakiramdam ng mamamayan, pinipilit na lang nilang gawin iyong gusto nila. Walang public hearing, at nabalitaan ko pa na nag-file ng anti-graft ang mga market stallholders ng Quinta, at noong makita ko iyong kanilang ‘ika ngang, kasong nai-file laban sa kasalukuyang Alkalde, sampu ng ilang miyembro ng konseho at ilang mga sa legal counsel, napag-alaman ko na iyong Market Life Leasing na siyang nakakuha ng kontrata sa Quinta ay, nang ipa-check iyong address, Unit 2018 sa Mayfair Tower ba iyon, doon sa may Mabini at United Nations, eh nang i-check noong Administrador, “Mayroon bang Unit 2018 dito?” Ang sabi ng Administrador, ang unit ho sa condominium na ito ay hanggang 2010 lamang. Ang gusto nila marahil, maibigay ang pamilihang bayan sa mga bilyonaryo ng ating lipunan sapagkat sila lamang ang maaaring magtangka na kamkamin ang yaman ng ating mga pamilihang bayan, that if it happens, our country will have nothing else to offer except malls and structures of the super rich. Ang nakikita po natin ngayon na ang mayaman, yumayaman at ang mahirap, lalong naghihirap ay lalo pong mangyayari at lalaganap. So, I urge—umupo na pala si Congressman Bagatsing—ay bibigyan ... po. Hindi po tungkulin ng Kongreso iyan, hindi tungkulin ng Senado, tungkulin po ng local government units—mayor and governor. Lokohin pa ninyo ang mga manininda at mamimili na ito ay mag-aayos lamang ng palengke, ito ay magbibigay ng panibagong palengke. Kung panibagong palengke at pag-aayos lamang ang inyong hangad, bakit po kayo kukuha ng mamumuhunan panlabas? Uulitin ko, common sense dictates, when the investor puts in millions of pesos to reconstruct or construct a new public market, and I am sure magkakaroon iyan ng mga additional floors, e sino po ang kikita roon? Dito po sa 17 na mga public markets po na ito, ilan po ang sa pagtaya ninyo, ilan po ang mga mangangalakal na nabebenepisyuhan ngayon at nagkakaroon po ng pagkakataon na magkaroon ng marangal na hanapbuhay sa pamamagitan ng pagtitinda sa ating mga 17 public markets? REP. ATIENZA. Mayroon pong palengkeng maliit, Mme. Speaker, mayroong palengkeng napakalaki. Kung ia-average natin iyan, puwede na nating sabihing 1,000 manininda sa bawat palengke. So, if we are to estimate the affected parties here, no less than 15,000 small … REP. DELA CRUZ. Stallholders. 17 REP. ATIENZA. … market vendors, small entrepreneurs of the city of Manila will lose their opportunity to do business. Alam ninyo kung bakit? REP. DELA CRUZ. Bakit po? REP. ATIENZA. Kapag nagawa na ang bagong palengke, again, common sense should tell us, iyong rate na P40 na binabayaran ng isang may-ari noong puwestong iyon ay tiyak sisingilin baka P80 bawat metro kwadrado. So, if you are occupying 10 square meters in a public market, you will have to pay P800 a day. E wala na pong makapagbabayad ng ganyan na hindi naman niya itataas ang presyo ng kanyang ititinda. Kaya sino po ang papasan nito? Ang pangkaraniwang maybahay na araw-araw namamalengke dahil hindi niya kayang bumili sa malalaking mga supermarket for a week’s supply or a month’s supply, ang binibili lang nila, lalo na po ang mga mahihirap, ay ang kakainin lang nila sa gabing iyon. Kung maaari, makabili sila ng konting ulam, konting bigas, konting panluto, at iyon ang kanilang ikinabubuhay. So, we will continue to fight, Mme. Speaker, this malpractice and abuse of authority, and we will win and prevail over the dictates of greed. I call that nothing else but greed on the part of those who are taking advantage of the helplessness of the small market vendor. REP. DELA CRUZ. So, hindi po kayo naniniwala, Mme. Speaker, Your Honor, na ang ginagawang ito ay para sa kabutihan ng ating mga mangangalakal, at para na rin po sila magkaroon ng pagkakataon na magkaroon ng mga stall o kaya mga kalakaran na mas maganda at kumpara sa iba pang mga private market. Hindi po kayo naniniwala sa ganoon? Ito po ay walang pasubaling pangunguha at pangongontrol sa mga public market na iyan at pagdating ng pagkakataon ay mawawalan na pati ang mga nandito na, ang mga original na mga nandidiyan na stallholders. Kasi, ganoon po ang nangyari sa ibang mga lugar. Nagiging basehan po ito para magkaroon ng panibagong grupo ng mga stallholder at ang panibagong grupo ng stallholders na iyon, nagkakaroon din po ng ano, ang naging eksperiyensiya po sa ibang mga bayan, sila mismo ang magbabayad ulit, mayroon silang bayad para sila magkaroon ng stall doon sa bagong market na iyan na ginawang joint venture. Kaya dalawa po ang magiging problema po nito, ang mga orihinal na nandoon na po at mayroon nang stall doon ay hindi lamang kung sakaling sila ay mananatili pa doon, tataas ang kanilang rental. Kung hindi naman, kung hindi na nila kaya ang mga pagrerenta na iyan, mawawala sila at magkakaroon ng ibang grupo ng stallholders, at ang stallholders na iyon, magkakaroon din ng panibagong 18 kalakaran doon sa mga mamamahala ng bagong market na iyan. REP. ATIENZA. Tama po si G. Dela Cruz sa kanyang mga tinuran, Mme. Speaker, sapagkat sa nakikita ko, ako po ay laki sa Maynila. Diyan po ako isinilang, diyan po ako lumaki, ako po ay naglaro at lumaki sa pamilihang bayan ng Paco. Diyan po ako talagang lumaki masasabi ko, sapagkat nandiyan ang aking tunay na tirahan at diyan kami lumaki bilang mga batang Maynila at iyan po ang nakita ko. Marami nang binuhay ang ating mga pamilihang bayan na pamilya ng mga nagtitinda. Marami na rin naman ang natulungan ng mga pamilihang bayan sa serbisyo publiko na kanilang ibinibigay. Kaya hindi ko po masasang-ayunang putulin itong uring ito ng relasyon ng mamimili sa manininda sa loob ng isang pamilihang bayang sinusuportahan, subsidized by the city government. So, the challenge, Mme. Speaker, for any local government unit is to provide the essential service of operating clean, wholesome and effectively managed public markets. That should be the challenge for anyone running for mayor and not to sell it out to the rich, while depriving the poor of their source of livelihood. REP. DELA CRUZ. Ang sinasabi po ng mga proponent ng privatization na ito ay modernization, actually modernization daw po ito. Kayo po ba ay naniniwala at kayo po ba ay sumasang-ayon na ito ay modernization program, hindi naman daw po ito privatization? Iyong mga kritiko daw po nitong programang ito ay parang ayaw nilang maging moderno ang ating mga public market, para bang gusto pa daw ng mga kritiko na parang kalakarang, parang pawarde-warde na lang ang mga public market natin. Kayo po ba ay naniniwala sa ganoong kalakaran o pagtaya ng mga ibang proponent nitong tinatawag nila, hindi daw ho privatization ito, modernization daw po ito? REP. ATIENZA. Mme. Speaker, iyon po ay malaking kasinungalingan sapagkat hindi natin matatawag na modernization ang isapribado ang management o ang pagmamaneho ng isang palengke ng lungsod. Hindi po natin matatawag na modernization ang ibigay ang pagmamaneho ng palengke sa pribado dahil pagkatapos pong gawin iyan, tiyak ang magmamaneho niyan ay iyong namuhunan. Ano po ang kanyang gagawing motivation? Mabawi ang kanyang puhunan at mapatungan ng dagdag kikitain. Motivation niyan ay profit generation, kumita sila sa kanilang proyekto. Gaya ng isinumbong ni Congressman Bagatsing, ang nakakuha ng kontrata nang ito ay ibinigay ng city council ng Maynila ay ni hindi man organisadong korporasyon, inorganisa pagkatapos inaprubahan ang kontrata. Kaya iyon po ang mangyayari dito, igigisa na naman sa sariling mantika ang mga mahihirap sa katagang “modernization.” Kung gusto nilang i-modernize iyan, bigyan nila ng karapatan, manatili ang mga manininda, na hindi nila gagambalain, ayusin nila ang bubong, ayusin nila ang drainage, ayusin nila ang airconditioning system, sapagkat meron pong palengkeng airconditioned pa nga po ang aking binuo. Ngayon lamang, wala na po ang mga airconditioning unit sapagkat hindi naman nila inaayos. Noong nabulok na, ang kanila ngayong kadahilanan, to modernize the public market. Wala na pong imo-modernize sa public market. Kailangan lang ng pamilihang bayan na gawing malinis at maaliwalas. Meron pong paraan upang ang mga mamimili naman ay maging ligtas at hindi po magagambala ng mga elementong kriminal. Iyon po ang tungkulin ng gobyernong lokal at hindi po ang tawaging “modernization.” Ang alam naman namin talagang ibinebenta ay ang negosyo ng pamilihang bayan. Kaya ang akin pong panawagan naman sa mga vendor, lumaban kayo, dahil karapatan ninyo ang pinaguusapan dito. Kung ang batas-militar ay ating naialis dahil sa pagpupunyagi ng pangkaraniwang Juan Dela Cruz, hindi kailangan ang yaman, hindi po kailangan ang kapangyarihan. Kung tama, ipaglaban natin ang ating karapatan at magtatagumpay po naman ang ating pagsisikap. REP. DELA CRUZ. Maraming salamat po, Mr. Speaker, Your Honor. Pero araw-araw, nagbibilang sila. Ibigay ninyo ang pagmamaneho ng public markets sa mga kooperatiba sa loob ng pamilihang bayan sapagkat may batas po tayo diyan, Mme. Speaker. Hindi na natin kailangan pang bumuo ng panibago, ipatupad lang ang layunin po ng batas na iyon on cooperatives, and that would display a genuine intention to help and not to take advantage of. Ngayon, lahat po ng kasinungalingan sinasabi po, “Babalik kayo diyan, meron kayong guarantee letter,” pero wala po silang sulat na garantiya, “babalik kayo diyan,” pero wala naman po silang pinanghahawakan na sila ang babalik. Alam ko na ang mangyayari diyan, Mme. Speaker. Pag nabuo na ang palengke, sasabihin doon sa mga original stallholders, “O, gusto ninyong bumalik, ang ganda ano? Magbayad kayo ng goodwill, magbayad kayo ng additional, dahil kung hindi, kukuha kami ng bagong applicant, dahil kayo, apo na kayo, anak kayo o apo na kayo noong mga original.” Ganoon po sa palengke, ang mga nakikinabang na ngayon ay kaapuapuhan ng mga original stallholders.
