PRIVILEGE SPEECH OF REP. ATIENZA
REP. ATIENZA. Maraming salamat po, Mme.
Speaker. Thank you, Dep. Majority Leader, at sa aking
mga kasamahan sa Kongreso, mayroon po kaming nais
iparating sa inyo sa araw na ito.
Today is a very important day in our history,
September 21, 2015. On September 21, 1972, Martial
Law was declared all over the country. Magmula po
noong araw na iyon, nagsimula ang landas ng ating
bansa sa landasing hindi natin naiintindihan.
Ngayon, sa paglingon ng panahon, maaari na
nating gunitain ang mga aral ng Batas Militar. For 14
years, we were deprived of our rights and freedoms in
a democratic society. We sacrificed ourselves in the
process, and we saw with our very own eyes and our
lives the lessons of this very critical, important period
in our nation’s life, most important of which, I would
like to state, Mme. Speaker, is the element of national
discipline. Disiplina ang kailangan upang tayo ay
gumalaw bilang isang lipunan, isang bansa tungo sa
kaunlaran.
Marami po ang nangyari sa pamamagitan ng
panawagang tayo ay magkaroon ng disiplina. Higit
sa lahat, sa aking gunita, ang napakagandang aral ng
Martial Law ay ang pagpupunyagi ng sambayanan sa
kanilang karapatan because in the long run, no matter
what transpired in those 14 years of martial rule, where
rights were violated and the good old saying that power
corrupts and absolute power corrupts absolutely, it
overtook the good intentions probably of the ruler of
our country then.
Tayo po ay nakawala sa tanikala ng Martial
Law sa pagpipilit, pakikipaghamok at pakikibaka ng
sambayanan, na hindi makapaniwala ang buong mundo
na nagawa natin ang tama. Magmula noong Pebrero
25, 1986, itinanghal ang Pilipinas na nagkaroon tayo
ng kalayaan sa ating pagsisikap bilang nagkakaisang
mamamayan.
So as we look back in history, we have to
commemorate these very significant events in our
national life, lest we do not also gain any benefits out
of them.
Many of our colleagues in this Congress were
deprived of 14 years of their freedom. Many of our
countrymen sacrificed their lives even. Up to now, many
faceless, nameless Filipinos have disappeared, nowhere
to be found. Wala na po tayong alaala rito kung hindi
ang ating pansariling karanasan.
As we pause today, as we cannot allow this day to
pass without commemorating and inculcating in our
minds that we have to learn from the past, therefore
my colleagues, mga minamahal kong mga kababayan,
kinakailangan ding paalalahanan natin ang lahat ng
sektor upang tayo ay hindi na dumaan pa sa ganyang
uri sa ating buhay.

We have to learn, ladies and gentlemen, distinguished
Members of Congress, to be very careful in how we
wield our powers. Iyan din po naman ang panawagan
ng panahon na ang mga namumuno, both in the national
and the local levels, should be very careful so as not
to abuse power, authority and our helpless people. Sa
mga makapangyarihan, ang pag-apak sa isang mahirap
ay napakadaling gawin, subalit sa damdamin ng isang
mahirap na naaapi, hindi po maaaring madampian ng
anumang solusyon kung hindi katarungan lamang.
I am calling on all the levels of government today
to be very careful, circumspect and always remember
the lessons of Martial Law so that we will not abuse
our newfound freedom and authority.
Tingnan po natin ang nangyayari sa Maynila. I
would like to focus on the city of Manila in this particular
case simply because I know that in my city, our poor are
being deprived of their rights by a government that did
not keep its promise. Ang sabi po nila, sila ay tutulong sa
mga mahihirap. Subalit ngayon, ano ang nangyayari sa
Maynila? Sinimulan ang pagsingil ng serbisyo sa health
center. Sinimulan ang pagsingil ng serbisyo sa ospital.
Sinimulan ang pagsingil sa paggamit ng playgrounds.
Iyon bang mag-swimming ka sa public swimming pool
magbabayad ka pa? Ito po ay ginagawa ngayon dito sa
ating lungsod.
The biggest issue now, Mme. Speaker, is the so-called
“sell-out” of all our public markets. Can you visualize
a country with no public markets? Ang pamilihang
bayan po ay isang pangako sa isang demokratikong
sistema na ang mahihirap ay mabibigyan ng paraang
makabili ng bilihing mas mababa ang presyo sa pribado.
Ang pamilihang bayan po ay isang commitment ng
pamahalaan upang ang maliliit ay magkaroon ng lugar
upang sila ay makapagnegosyo.
This is mandated in the city of Manila by no less
than the Local Government Code and the Revised
City Charter of Manila which mandates that the
local government must provide and maintain public
markets. Saan po nila hinuhugot? Iyan po ang tanong
ng mga kabataan ngayon. Saan nila hinuhugot ang
kapangyarihan na ang pamilihang bayan ay ibenta mo
sa pribado? Ang tawag po nila, “privatization.” Ang iba
naman ang tawag ay restoration. Ang iba naman ang
sabi, ito raw po ay negosyo ng pamahalaang lungsod.
Pero hindi ko po maalaala sa aking paglaki sa Maynila
na nagkaroon kami ng batas na ang pamilihang bayan
ay kinakailangang kumita ng salapi para sa gobyerno.
In fact, all the expenses of a public market operation are
derived from the appropriations granted by the people
themselves through their elected councilors.
Kaya ang katagang “privatization” ay ang
pagsasaayos para sa ating kapakanan ay hindi po
kapani-paniwala. Nasa kontrata po sinasabi na
ang palengke ay kukunin na ng isang pribadong
korporasyon. Magmula po noon, giniba na ang Quinta

Market, ang pinakamakasaysayang palengke sa buong
Pilipinas—probably,because ito po ay ilang centuries
nang nag-o-operate— giniba noong isang buwan at
papalitan daw ng bagong palengke sa pamamagitan ng
puhunang pribado.
We all know that when a private investor goes
into any project, the ultimate objective, the purpose of
which, is to make money, to generate profits. Wala po
namang pribadong negosyanteng papasok sa anumang
proyekto na hindi pagkakakitaan ang proyektong
iyon. Ang tanong ko po ay napakasimple. Papaano po
ang manininda roon na nagbabayad lamang ng P40
araw-araw upang makapagtinda sa loob ng palengke?
Papaano po ang mga maybahay na bumibili sa palengke
sa murang bilihin? Sa palengke lang po nakakabili ng
tingi--tinging suka, tinging patis, tinging bigas. Lahat
po, natitingi sa palengke sapagkat iyan ang tunay na
buod at tunay na dahilan na ibigay ang mga pamilihang
bayan sa tungkulin ng mga pamahalaang lungsod.
It is the duty of the local government unit to establish
and maintain—iyon po ang mga kataga, “establish and
maintain”—public markets as a major public service.
Papaano po mangyayari na ito ay mapapasa-pribado,
mabibili ng isang bilyonaryo, itatayo ay isang mini
mallat ito ay malamang ma-convert into a full-blown
mall? Ang pinag-uusapan dito ay hindi lamang ang
pamilihang bayan, kung hindi ang real estate na
kinatatayuan ng palengke. Lahat ng palengke sa buong
Pilipinas, sa Manila most especially, are all located in
prime real estate that if these projects in Manila succeed,
all public markets in the country, in Laguna, in Calamba,
in Los Baños, in the Visayas, in Mindanao, all our public
markets will be eyed by the super-rich and negotiate
for a sell-out too. Hindi ko po maubos-maisip, Mme.
Speaker, ano na ang mangyayari sa bansa pag wala na
tayong pamilihang bayan dahil lahat na po puro mall?
Alam naman natin na sa mall, ang kumikita diyan, ang
may-ari ng mall. Ang retailers, napakahirap po sigurong
kumita sapagkat napakalaki ng upa sa loob ng mall kung
kayo ay magnenegosyo doon.
In other words, the essence, the real meaning of
establishing and maintaining a public market is lost
if the right to sell this particular business that provide
affordable goods to our people is privatized where
profits would be the primary consideration.
Ito po ay ipinananawagan ko sa inyo sapagkat alam
ko, nakatingin ang ibang lungsod—dito lang sa Metro
Manila, Pasay is probably watching, the same with
Caloocan, Mandaluyong, Parañaque and all the other
cities. If this succeeds, the local government unit of
these cities and municipalities will also sell out their
public markets.
Mme. Speaker, I cannot think of any more relevant
way of commemorating Martial Law, lost rights and
privileges, and recovery of the same out of people’s
perseverance, as I congratulate the public market
MONDAY, SEPTEMBER 21, 2015 vendors of Manila for their resistance. Tumatanggi
sila dito sa pang-aaping ito sapagkat alam nila, hindi
tama, hindi makatarungan, hindi ayon sa batas. Ito
po ay kagustuhan lamang ng mga nakaupong lider
at pagkakamali ng mga mamamayan sa paghalal.
Nagkamali rin po ako sa aking pagkakarekomenda sa
kanila. Kaya binabawi ko po ang aking rekomendasyon.
Sa darating na halalang ito, kinakailangang magkaisa
ang Maynila upang itakwil natin sila, upang sila ay
matuto sa ating kasaysayan na hindi po nagpapaloko
at magpapaloko pa ang taumbayan.
Naaalala ko po ang mga kataga ni Hen. Antonio
Luna noong hinihimok niya ang mga lider ng ating
bansa, “Huwag tayong paloloko sa mga banyagang ito.
Ang kalaban natin ay ang ating mga sarili.”
I urge the public market vendors, some of whom
are present this afternoon, “Ipaglaban ninyo ang
inyong karapatan.” Mayroon po naman sigurong
magtatanggol din sa karapatang iyan tulad po ng
nangyari sa ating pag-aalis ng tanikala ng Batas
Militar sa ating bansa. Fight for your rights, as we
will continue to defend these hard-earned rights that
we are now enjoying
My reminder to those who are wielding power,
matuto rin po sana kayo na hindi magtatagumpay ang
inyong hangarin na isapribado ang lahat ng serbisyo
ng gobyerno. Naibenta na po ang iba at ibinebenta
pa ang iba. Ang aming Manila Zoo, katangi-tanging
zoo sa buong Kamaynilaan, nasa kalagitnaan ng
lungsod, kalahati po ay naibenta na rin. Ang alam
ko, nine-negotiate na ang Ospital ng Maynila at
marami pang bahagi ng lungsod na nakikitaan nila ng
pagkakakitaan.
Ang sabi ng isang konsehala, “This is the first time
that we, the members of the council, thought of some
ways and means, so that we will generate money for the
public market.” I am sorry to say but that lady councilor
does not even know why she is in the city council,
sapagkat kung ang purpose ninyo ay kumita ng salapi
para sa ating mga pamilihang bayan ay nagkakamali po
kayo. Ang pamilihang bayan ay handang mamuhunan
sa pamamagitan ng pamahalaan.
What is doubly painful for this Representation,
Mme. Speaker, is that I was Mayor of Manila for
nine years, and I am proud to say, we had renovated,
repaired, restored and rebuilt public markets like
Quinta Market, San Andres Market in Malate,
Dagonoy Market in San Andres Bukid, Santa Ana
Market and Tejeron Market, lahat po ng palengke
sa Maynila ay aming inayos. Salaping mga tinipon
ng isang matinong pamamahala upang ang ating
pamilihang bayan ay maiayos.
The challenge of good governance is to find ways
and means to improve the conditions of our public
market. I cite Subic, for instance, Mayor Jay Khonghun,
a son of one of our colleagues, nagtipon ng salapi,

Ganyan po sana ang gamiting pamantayan ng

now, so that we may also prevent the same from
happening in Batanes, in Mindanao. Public markets
have become part and parcel of a public serviceoriented local government unit. They should never
be sold to anybody. They should never be privatized
even, because the essence is to serve the public, the
essence is to give the poor a source of affordable
goods. Huwag nating kalimutan ang aral na ito
sapagkat kinakailangang sama-sama nating balikatin
ang mga hamon ng ating panahon.
September 21, 2015—we declare it as a day
where we should learn the lessons of history. Ang
sabi nga nila, kung hindi pa tayo matututo, ay wala
tayong pare-parehong pupuntahan. Pero, naniniwala
po ako na malayo ang mararating nating mga Pilipino.
Naipakita natin sa buong mundo, kaya nating itawid ang
ating sarili sa iba’t ibang yugto at hamon ng panahon.
Therefore, we will overcome, and we shall prevail,
and with the help of God, we will have a prosperous

At the outset, allow me to congratulate the honorable
Gentleman from BUHAY Party-List for amplifying the
sentiment of people from the city of Manila and fighting
for the cause of the people opposing the privatization
of markets.
Nakalulungkot po talaga, ayon sa sinabi ni
Kagalang-galang Atienza, ang estado po namin sa
Siyudad ng Maynila. Hindi ko maintindihan baka sakasakaling ito naman ay kayang-kaya namang sagutin ni
Honorable Atienza. Hindi ko maintindihan, is there a
compelling reason para itong mga palengkeng ito ay
isapribado? Ano ba talaga ang dahilan? Baka naman

mas naaabot mo being a former mayor, bilang isang
naglingkod sa siyudad, ano ang naging dahilan kung
bakit isinasapribado ang mga palengke natin? Baka
mayroon po kayong kasagutan diyan, Honorable
Atienza.
REP. ATIENZA. Mme. Speaker, nabanggit ko
po kanina at medyo naipagmalaki ko, noong mga
nakaraang taon ay pinagsikapan naming ayusin ang
lahat ng 17 palengke ng Maynila, 17 po iyan; at gaya
ng sinabi ko, very choice real estate ang kanilang
kinaroroonan. So we performed our task. We spent the
hard-earned money of the city to provide improvements,
renovation and reconstruction, dahil maraming palengke
po, noong bago ako naging mayor ay talagang parang
barong-barong. Katulad po noong palengke namin
sa San Andres Bukid, kailangang yuyuko ka bago ka
pumasok, sa putik ay magtatampisaw ka.
Iyon po ay naipagawa namin, panibago pong gusali
na matatawag nating modelo ng palengke. Alam ninyo
taon-taon, binibigyan po ng premyo iyan. The best
public market in the Philippines was the Dagonoy Public
Market, coming from a severe impoverished condition,
pero ngayon ay gigibain sapagkat …
REP. BAGATSING. Bakit nga?
REP. ATIENZA. … isasapribado. Kaya hindi ko po
maintindihan, distinguished Gentleman from Manila
whom I know, whose heart is in the right place in his
chest, whose brains are also in the right place in his
head. Hindi ko po maintindihan, bakit ang palengke
ang pinag-iinitan at bakit hindi gumamit ng kanilang
paraan at kapangyarihan upang ang palengke ay iayos
na hindi ibinibenta kanino pa man.
REP. BAGATSING. Mr. Speaker, naitanong ko rin
po sa ating Kagalang-galang na Atienza, ito bang mga
tao sa palengke, na mga nagbebenta roon, pati iyong
mamimili sa palengke, sila ba ay nakonsulta bago gawin
ang plano ng siyudad ang kanilang ninanais? Mayroon
bang konsultasyon, mayroon bang due process na
ginawa? Dahil sa nadidinig ko sa telebisyon, sinasabi
nila, nagkaroon daw ng konsultasyon, nagkaroon daw
ng public hearing. Kapag tinatanong naman natin iyong
mga tao sa palengke, sila-sila ang nag-hearing pero
wala ang publiko.
Hindi ko maintindihan na ito bang mga leaders
na ating tinulungan-- nakasama kita noong nakaraang
eleksyon, natulungan natin--ay naging insensitibo na ba,
naging highly insensitive, at iyong kanilang personal
agenda na lamang ang kanilang pinaiiral? Balewala
na ang sentimyento ng mga taong nakapuwesto sa
palengke. Balewala na rin ang sentimyento noong
mamimili na sakop nitong mga palengkeng ito. Hindi ko
po maintindihan kung bakit po ganito ang pakiramdam
ng mga taong iyan. Isinasawalang bahala ang ‘ika ngang
concern ng mga taong tatamaan sa planong iyan.
Kagaya ng sinabi po ninyo kanina, Kagalanggalang na Atienza, noong panahon ninyo, ginugol
ninyo, sariling pondo ng siyudad para ipagpagawa
ang palengke. Noong panahon po ninyo, hindi katulad
ng panahon ngayon, medyo masikip nang kaunti ang
pera ng city hall noong panahong iyon, pero sa kabila
niyan, naituloy ninyo. Itong panahon ng kasalukuyang
alkalde, itinaas ang presyo ng real estate, 100, 200,
300 percent. Itinaas ang presyo ng business tax to 300
percent, maraming buwis na ipinatong. Sa kabila ng
dami ng buwis na ipinatong sa balikat ng mga Manileño,
bakit kinakailangan pa siyang kumuha ng partner
kung talagang ang interes ng mga tao sa palengke ang
kanyang inaalagaan? Bakit hindi siya tumulad sa inyo
na noong kayo ay alkalde, sa kabila ng kakulangan ng
pondo, hindi ninyo isinapribado ang palengke bagkus,
pinaganda ninyo? Baka ‘ika ko mayroon kayong alam
na dahilan kung bakit may pera naman sila, ay bakit
humahanap ng joint venture partner.
REP. ATIENZA. Ginoong Kinatawan ng ating
lungsod, wala po akong makitang kadahilanan kung
hindi po iyong gusto nilang pagkakitaan itong mga
pamilihang bayan, whether officially or personally,
sila lang po ang nakakaalam noon. Pero hindi po natin
puwedeng ipaliwanag, bakit ninyo ginagawa iyan?
Isa lang ang aking nakikita rito, akala nila ang mga
taga-palengke ay maliliit. Ang akala nila ay hindi
makalalaban. “Puwedeng-puwede natin itong alisan ng
kapangyarihan at karapatan, walang magagawa iyang
mga iyan.” I can only sense that they are not respectful
of the rights of our people in the public markets.
Akala nila ay magtatagumpay ang kanilang maruming
hangarin. At ikinalulungkot ko namang aminin, tila wala
nang naiwan na mga miyembro ng konseho municipal.
Alam ko sa pagkakataong ito, Congressman Bagatsing,
palagay ko ay iyong mga nakaupong Congressman ay
magagalit sa iyo, ikaw pa naman ay haharap sa lungsod.
Sabihin mo na lang, magalit sila sa akin dahil, unanguna ay inalagaan ko sila, nagkamali rin ako sa kanila.
Dahil, ang pagkakamali po ng marami ay iyong
maliitin ang maliit. Akala nila ay maloloko, malilinlang,
mapagsisinungalingan sila, sapagkat narinig ko rin sa
telebisyon, sinasabi nila nagkakaroon daw ng public
hearing. Pumapayag daw ang ating mga taga-palengke.
Na kapag tinatanong ko naman ang mga taga-palengke
ay talaga namang sinasabi nila, “Hindi, hindi kami
pumapayag, hindi kami papayag sapagka’t iyang
palengke ay kung ibibigay din lamang sa pribado,
ang sabi ng batas, ibigay iyan sa kooperatiba sa loob
ng palengke.” So, they know their rights, but it is the
underestimation of the authorities at city hall today. Sila
ang nagkakamali, ang akala nila, iyong kaliitan ng mga
manininda ay kaya nilang pagsamantalahan.
MONDAY, SEPTEMBER 21, 2015 I am 100 percent certain, matutuwid lahat ito sa
pamamagitan ng ating batas kung lalaban din lamang ang
ating mga manininda at mamimili. Uulitin ko ang sinabi
ni Hen. Antonio Luna, “Ang problema natin ay ang ating
sarili.” Para bagang tayo ay natatakot sa kapangyarihan,
samantalang kapag tayo ay lumaban, mananalo tayo.”
Katulad noong ating desisyon, alisin ang tanikala ng
Batas Militar, nagtagumpay ang maliliit na mga Pilipino.
Ito rin ang dapat gawin ngayon, kung inaabuso
ang mga maliliit na manininda, tulungan po ninyo,
Congressman, kailangang-kailangan nila ng tulong.
REP. BAGATSING. Yes, tama po iyong sinasabi
ninyo. Kaya lang po, tayong dalawa po ay lehitimong
taga-Maynila. Para bagang, sasabihing deretsahan, para
bang hindi na natuto itong mga liderato ng Maynila, saka,
‘ika nga sa history. Alam ninyo, iyong aming palengke
sa Paco, na isang magandang palengke, ay isinapribado
ng dating alkaldeng si Lim, nai-privatize niya. Ngayon,
iyong mga stallholders namin sa Paco nagbabayad na sa
City Hall, nagbabayad pa ng management fee doon sa
binigyan ng dating alkaldeng Lim. Siya ang nag-umpisa
sa privatization. Hindi ko lang maintindihan kung bakit
itong kasalukuyang Mayor ay sumunod at ang sinundan,
siyam o 10 palengke, phase one.
So, hindi ko maintindihan kung bakit sa kabila
ng dami ng pera nila ay humahanap pa rin sila ng
joint venture partner. Ako ay gulong-gulo, siguro ba
itong mga taong ito ay talagang wala nang pakialam
sa pakiramdam ng mamamayan, pinipilit na lang
nilang gawin iyong gusto nila. Walang public hearing,
at nabalitaan ko pa na nag-file ng anti-graft ang mga
market stallholders ng Quinta, at noong makita ko
iyong kanilang ‘ika ngang, kasong nai-file laban sa
kasalukuyang Alkalde, sampu ng ilang miyembro ng
konseho at ilang mga sa legal counsel, napag-alaman
ko na iyong Market Life Leasing na siyang nakakuha
ng kontrata sa Quinta ay, nang ipa-check iyong address,
Unit 2018 sa Mayfair Tower ba iyon, doon sa may
Mabini at United Nations, eh nang i-check noong
Administrador, “Mayroon bang Unit 2018 dito?” Ang
sabi ng Administrador, ang unit ho sa condominium na
ito ay hanggang 2010 lamang.
So, ibig kong sabihin, hindi ba nag-due diligence
iyong legal department, pati ang konseho ng Maynila
na magbigay ng kontrata sa isang non-existent
office to the detriment of the market stallholders?
Pagkatapos, binanggit ng ating Kagalang-galang na
Atienza iyong Cooperative Code of the Philippines na
sinasabing preferential rights should be given to market
stallholders. Hindi man lang sila kinonsulta at sinabi,
“Hoy, kayong mga taga-palengke, gusto ba ninyong
kayo ang magpalakad nito? Ayon sa batas, kailangang
ialok muna namin sa inyo.” Hindi man lang inalok, at
ang higit sa lahat, sa kaso nila na nakita ko, nag-violate
ang city hall sa Procurement Law. Talagang nakakatuwa

ito, nakakagulat. Nakita ko iyong kanilang petisyon,
nag-offer iyong Market Life Management and Leasing
Corporation ng unsolicited proposal, September 15,
2014. October 20 ‘ata, the following month, na-refer
sa Market Selection Committee, at ang sabi ng Market
Selection Committee, okay ito, ie-endorse na for
contract, favorable ang endorsement. Ang malungkot
nito, iyong korporasyon na nagbigay ng unsolicited
proposal ay lumabas lamang ang kaniyang registration
papers sa SEC noong November 11, 2014. Hindi pa
ipinapanganak, may kontrata na.
Ewan ko kung anong klaseng magic ang ginagawa
ng lider ng Maynila na pumirma sa kontrata, pati
naman itong konseho, sinang-ayunan ang kontrata.
Saan pupunta ngayon ang mga biktima katulad ng
mga market stallholders at ang mamimili? Hindi pa
ipinapanganak iyong korporasyon, may kontrata na iniendorse ang Market Selection Committee. Ito ay isang
statement of fact, hindi po gawa-gawa ito. Kaya noong
makita ko ang kanilang anti-graft case, sabi ko, palagay
ko, sagutin muna ng mga kinauukulan iyong kaso na
nai-file ng Quinta Market stallholders dahil sabi nga
ng ating kasama, Kagalang-galang na Atienza, “Up to
this day, Mr. Speaker, two and half months have passed,
giniba iyong Quinta Market, ngayon wala naman ni
isang construction na ginagawa.”
Ito ay nakiki-share lang ako doon sa sinabi ng
ating kasamahan na si Honorable Atienza, na talagang,
akala ko nga tapos na ang era ng pagsasalampak ng
kapangyarihan, pang-aapi sa mga inaapi, sa mga
stallholders pero tila bagang kapag hindi tayo nagbantay
ay talagang iyong abuse of power, abuse of authority
ay maaaring mangyari muli.
So, at this point, I would like to thank the Honorable
Atienza for amplifying the issues concerning the city
of Manila. Ang sabi nga sa akin ng ilang mga tagapalengke, pagpasensiyahan na natin iyan, iyang mga
iyan ay hindi naman po taga-Maynila kaya hindi nila
alam ang kultura ng isang Manileño.
So, hindi ko na pakakahabaan. Salamat kay
Congressman Atienza, at nakikiisa ako sa laban ng mga
market stallholders na itigil itong kabulastugan na ito na
ginagawa ng opisyales ng siyudad ng Maynila. I think
at the appropriate time, Congress will have to take the
cudgels not only for the markets in Manila but markets
all over the land, which can set a very bad precedent if
we allow these things to happen.
Salamat po and thank you again to the Hon. Lito
Atienza.

Amado Bagatsing, sa kanyang suporta at sa kanyang

ganitong uri ng pagsasamantala sa kahinaan ng mga
malilit na manininda ay gagawin po ito sa lahat ng dako
ng ating kapuluan, the essence of public service, one
essential service is the operation of public markets, ay
mawawala na po sa ating libro at aalisan ng karapatan
ang mahihirap na manininda.
To prove to you that this is considered an essential
service of the government, it is even written in the
law that you cannot put up any other market within a
perimeter of 250-meter radius from all public markets,
to protect the business of the poor where the poor also
get their daily subsistence.
Pero sa ganito pong ginagawa sa Maynila ngayon ay
talagang walang pakundangang paglabag sa karapatangpantao, karapatan ng mga manininda at karapatan
ng mga maybahay na umaasa sa palengke. Kagaya
ng sinabi ko po, wala naman kayong mabibilhan ng
tingi—tinging patis, tinging suka, tinging asin, tinging
bigas, kung hindi sa pamilihang bayan.
Ang gusto nila marahil, maibigay ang pamilihang
bayan sa mga bilyonaryo ng ating lipunan sapagkat
sila lamang ang maaaring magtangka na kamkamin
ang yaman ng ating mga pamilihang bayan, that if it
happens, our country will have nothing else to offer
except malls and structures of the super rich. Ang
nakikita po natin ngayon na ang mayaman, yumayaman
at ang mahirap, lalong naghihirap ay lalo pong
mangyayari at lalaganap.
So, I urge—umupo na pala si Congressman
Bagatsing—ay bibigyan ...
po.

Ang kaibigan po ba natin, iginagalang na
Representante ng BUHAY Party-List, ay maaari pong
matanong ng mga ilang question?
REP. ATIENZA. Opo, isa pong karangalan
ang matanong at mausisa ng isang katulad po ni
Congressman Jonathan A. Dela Cruz na alam kong
kagalingang pambayan din ang kaniyang pakay.
REP. DELA CRUZ. Maraming salamat po.
Nabanggit po ninyo kanina na naaayon sa batas at
naaayon na rin sa matagal-tagal na rin pong practices
natin, ang isang public market ay talagang puntahan
at ito ay pondohan para sa ating mga mamamayan
lalung-lalo na ang mga nagsisikap na magkaroon ng mas
maayos na buhay, ang mga maliliit na manininda at iba
pa pong mga nangangalakal. Tama po ba iyon?
REP. ATIENZA. Tama po iyon, Mme. Speaker. As
I have repeatedly said, and I have a copy of the Local
Government Code provisions, on the operation and
maintenance of public markets, tungkulin po iyan ng
mga local government units. Hindi po tungkulin ng
Kongreso iyan, hindi tungkulin ng Senado, tungkulin
po ng local government units—mayor and governor.
Nandito rin po ang Republic Act No. 409, the Charter
of the City of Manila, kung saan malinaw na malinaw
na iniuutos na ang mga pamilihang bayan ay itatag
ng gobyernong lokal at bigyan ng proteksyon, huwag
pabayaang magkaroon ng anumang mga negosyong
pampalengke sa paligid-ligid nito.
Ito pong—ang nangyayari ngayon sa Maynila,
ang aming ipinagbibigay-babala ay hindi lamang po
bibigyan ng kompitensya, iyon mismong palengke ang
ibinenta. Ang tawag nila ay privatization. Pero ang totoo
po, ibinebenta ang pagkakataon at karapatang magtinda
doon sa loob ng palengke.
REP. DELA CRUZ. Ang naibibigay po, Your Honor,
na dahilan kung bakit itong mga ito ay kinakailangang
pondohan o samahan ng private sector ay sapagkat
kailangan pong mailagay sila sa isang antas na kung
saan sila ay makakapagkumpitensya sa mga nasa iba
pang mga lugar na private malls or enterprises. Sa tingin
po ba ninyo, ayon na rin sa inyong karanasan, iyon
po ba ay marapat na iyon ang ating magiging parang
standard o kagalingan kung saka-sakali? Sapagkat and
binanggit po ninyo dito, ang public market ay parang
public service na nga rin po iyon at iyon nga ay isang
pagkakataon upang ang mga mamamayan, lalo na
ang mga maliliit na mangangalakal, ay magkaroon
ng pagkakataong maghanapbuhay. So, bale, parang
public service na rin po iyon. Kumbaga, binibigyan
natin ng pagkakataon ang ating mga kababayan na
maghanapbuhay nang maayos at marangal.
REP. ATIENZA. Tama po kayo, kagalang-galang na
Congressman Dela Cruz. Tamang-tama po ang inyong
tinuran. Public markets or the operation of public
markets is an essential—hindi po pangkaraniwan—
essential public service. Para po itong peace and order,
MONDAY, SEPTEMBER 21, 2015 para po itong kalusugan, para po itong edukasyon,
hindi po puwedeng ibenta po iyan. Kinakailangang
proteksyunan po ng pamahalaang lungsod upang
magpatuloy at yumabong ang pagnenegosyo sa loob
ng pamilihang bayan.
So, what is happening in Manila is pure and simple
greed, if I may call it. Masyado pong katakawan na
pati ang pamilihang bayan ay kanilang pag-interesan
sapagkat wala pong benepisyo na makukuha ang tao
diyan. Ang benepisyo po diyan, mapupunta sa gumawa
ng anumang ordinansa at pupunta sa kamay ng mga
namumuno.
We cannot see any benefit out of fooling. Lokohin
pa ninyo ang mga manininda at mamimili na ito ay
mag-aayos lamang ng palengke, ito ay magbibigay ng
panibagong palengke. Kung panibagong palengke at
pag-aayos lamang ang inyong hangad, bakit po kayo
kukuha ng mamumuhunan panlabas?
Uulitin ko, common sense dictates, when the investor
puts in millions of pesos to reconstruct or construct a
new public market, and I am sure magkakaroon iyan ng
mga additional floors, e sino po ang kikita roon?
Ang sabi noong konsehala, this is the first time
that the city government will earn money from public
markets. E maling-mali po ang konsehalang iyon. Hindi
po dapat kumikita ang lungsod sa operations ng public
market.
REP. DELA CRUZ. Sa inyo pong pagtaya, ilan
po ba ang mga mangangalakal natin, maliliit na
mangangalakal na sa ngayon ay nabubuhay nang
marangal at nagkakaroon ng hanapbuhay sa lahat ng
mga public—by the way, ilan po ba talaga ang public
markets sa Maynila?
REP. ATIENZA. Labimpito po.
REP. DELA CRUZ. Labimpito.
REP. ATIENZA. Labimpitong public markets.
REP. DELA CRUZ. Dito po sa 17 na mga public
markets po na ito, ilan po ang sa pagtaya ninyo, ilan po
ang mga mangangalakal na nabebenepisyuhan ngayon
at nagkakaroon po ng pagkakataon na magkaroon ng
marangal na hanapbuhay sa pamamagitan ng pagtitinda
sa ating mga 17 public markets?
REP. ATIENZA. Mayroon pong palengkeng maliit,
Mme. Speaker, mayroong palengkeng napakalaki. Kung
ia-average natin iyan, puwede na nating sabihing 1,000
manininda sa bawat palengke.
So, if we are to estimate the affected parties here,
no less than 15,000 small …
REP. DELA CRUZ. Stallholders.

REP. ATIENZA. … market vendors, small
entrepreneurs of the city of Manila will lose their
opportunity to do business.
Alam ninyo kung bakit?
REP. DELA CRUZ. Bakit po?
REP. ATIENZA. Kapag nagawa na ang bagong
palengke, again, common sense should tell us, iyong
rate na P40 na binabayaran ng isang may-ari noong
puwestong iyon ay tiyak sisingilin baka P80 bawat
metro kwadrado. So, if you are occupying 10 square
meters in a public market, you will have to pay P800
a day. E wala na pong makapagbabayad ng ganyan
na hindi naman niya itataas ang presyo ng kanyang
ititinda.
Kaya sino po ang papasan nito? Ang pangkaraniwang
maybahay na araw-araw namamalengke dahil hindi niya
kayang bumili sa malalaking mga supermarket for a
week’s supply or a month’s supply, ang binibili lang
nila, lalo na po ang mga mahihirap, ay ang kakainin
lang nila sa gabing iyon. Kung maaari, makabili sila ng
konting ulam, konting bigas, konting panluto, at iyon
ang kanilang ikinabubuhay.
So, we will continue to fight, Mme. Speaker,
this malpractice and abuse of authority, and we will
win and prevail over the dictates of greed. I call that
nothing else but greed on the part of those who are
taking advantage of the helplessness of the small
market vendor.
REP. DELA CRUZ. So, hindi po kayo naniniwala,
Mme. Speaker, Your Honor, na ang ginagawang ito ay
para sa kabutihan ng ating mga mangangalakal, at para
na rin po sila magkaroon ng pagkakataon na magkaroon
ng mga stall o kaya mga kalakaran na mas maganda at
kumpara sa iba pang mga private market. Hindi po kayo
naniniwala sa ganoon? Ito po ay walang pasubaling
pangunguha at pangongontrol sa mga public market na
iyan at pagdating ng pagkakataon ay mawawalan na pati
ang mga nandito na, ang mga original na mga nandidiyan
na stallholders. Kasi, ganoon po ang nangyari sa ibang
mga lugar. Nagiging basehan po ito para magkaroon ng
panibagong grupo ng mga stallholder at ang panibagong
grupo ng stallholders na iyon, nagkakaroon din po ng
ano, ang naging eksperiyensiya po sa ibang mga bayan,
sila mismo ang magbabayad ulit, mayroon silang bayad
para sila magkaroon ng stall doon sa bagong market
na iyan na ginawang joint venture. Kaya dalawa po
ang magiging problema po nito, ang mga orihinal na
nandoon na po at mayroon nang stall doon ay hindi
lamang kung sakaling sila ay mananatili pa doon, tataas
ang kanilang rental. Kung hindi naman, kung hindi na
nila kaya ang mga pagrerenta na iyan, mawawala sila
at magkakaroon ng ibang grupo ng stallholders, at ang
stallholders na iyon, magkakaroon din ng panibagong

kalakaran doon sa mga mamamahala ng bagong market
na iyan.
REP. ATIENZA. Tama po si G. Dela Cruz sa
kanyang mga tinuran, Mme. Speaker, sapagkat sa
nakikita ko, ako po ay laki sa Maynila. Diyan po ako
isinilang, diyan po ako lumaki, ako po ay naglaro at
lumaki sa pamilihang bayan ng Paco. Diyan po ako
talagang lumaki masasabi ko, sapagkat nandiyan ang
aking tunay na tirahan at diyan kami lumaki bilang mga
batang Maynila at iyan po ang nakita ko. Marami nang
binuhay ang ating mga pamilihang bayan na pamilya ng
mga nagtitinda. Marami na rin naman ang natulungan ng
mga pamilihang bayan sa serbisyo publiko na kanilang
ibinibigay. Kaya hindi ko po masasang-ayunang putulin
itong uring ito ng relasyon ng mamimili sa manininda
sa loob ng isang pamilihang bayang sinusuportahan,
subsidized by the city government.
So, the challenge, Mme. Speaker, for any local
government unit is to provide the essential service of
operating clean, wholesome and effectively managed
public markets. That should be the challenge for anyone
running for mayor and not to sell it out to the rich, while
depriving the poor of their source of livelihood.
REP. DELA CRUZ. Ang sinasabi po ng mga
proponent ng privatization na ito ay modernization,
actually modernization daw po ito. Kayo po ba ay
naniniwala at kayo po ba ay sumasang-ayon na ito
ay modernization program, hindi naman daw po
ito privatization? Iyong mga kritiko daw po nitong
programang ito ay parang ayaw nilang maging
moderno ang ating mga public market, para bang
gusto pa daw ng mga kritiko na parang kalakarang,
parang pawarde-warde na lang ang mga public market
natin. Kayo po ba ay naniniwala sa ganoong kalakaran
o pagtaya ng mga ibang proponent nitong tinatawag
nila, hindi daw ho privatization ito, modernization
daw po ito?
REP. ATIENZA. Mme. Speaker, iyon po ay malaking
kasinungalingan sapagkat hindi natin matatawag na
modernization ang isapribado ang management o ang
pagmamaneho ng isang palengke ng lungsod. Hindi
po natin matatawag na modernization ang ibigay
ang pagmamaneho ng palengke sa pribado dahil
pagkatapos pong gawin iyan, tiyak ang magmamaneho
niyan ay iyong namuhunan. Ano po ang kanyang
gagawing motivation? Mabawi ang kanyang puhunan
at mapatungan ng dagdag kikitain. Motivation niyan
ay profit generation, kumita sila sa kanilang proyekto.
Gaya ng isinumbong ni Congressman Bagatsing, ang
nakakuha ng kontrata nang ito ay ibinigay ng city
council ng Maynila ay ni hindi man organisadong
korporasyon, inorganisa pagkatapos inaprubahan
ang kontrata. Hindi po ba malaking anomalya iyon?

Inaprubahan ang kontrata na wala pong partido,
wala pong kumpanya, wala pong korporasyon na
tumatayong sila ang umaako sa trabahong iyon. Binuo
lamang ang korporasyon pagkatapos na ibigay na ang
kontrata. Samakatuwid, puwedeng pumunta sa bangko
ang grupo ng mga taong iyon at sabihin sa bangko,
pautangin ninyo kami ng salapi sapagkat kailangan
namin ng puhunan. Binigyan kami ng kontrata ng city
hall, ng city council. Kaya iyon po ang mangyayari
dito, igigisa na naman sa sariling mantika ang mga
mahihirap sa katagang “modernization.” Kung gusto
nilang i-modernize iyan, bigyan nila ng karapatan,
manatili ang mga manininda, na hindi nila gagambalain,
ayusin nila ang bubong, ayusin nila ang drainage, ayusin
nila ang airconditioning system, sapagkat meron pong
palengkeng airconditioned pa nga po ang aking binuo.
Ngayon lamang, wala na po ang mga airconditioning
unit sapagkat hindi naman nila inaayos. Noong nabulok
na, ang kanila ngayong kadahilanan, to modernize
the public market. Wala na pong imo-modernize sa
public market. Kailangan lang ng pamilihang bayan
na gawing malinis at maaliwalas. Meron pong paraan
upang ang mga mamimili naman ay maging ligtas at
hindi po magagambala ng mga elementong kriminal.
Iyon po ang tungkulin ng gobyernong lokal at hindi po
ang tawaging “modernization.” Ang alam naman namin
talagang ibinebenta ay ang negosyo ng pamilihang
bayan. Kaya ang akin pong panawagan naman sa mga
vendor, lumaban kayo, dahil karapatan ninyo ang pinaguusapan dito. Kung ang batas-militar ay ating naialis
dahil sa pagpupunyagi ng pangkaraniwang Juan Dela
Cruz, hindi kailangan ang yaman, hindi po kailangan
ang kapangyarihan. Kung tama, ipaglaban natin ang
ating karapatan at magtatagumpay po naman ang ating
pagsisikap.
REP. DELA CRUZ. Maraming salamat po, Mr.
Speaker, Your Honor.
Ang panghuli ko hong mababanggit ay ang
eksperiyensya ng ibang mga napa-privatize o minomodernize na mga public market sa ibang mga lugar.
Ang sinasabi po ng mga manininda doon ay kaya
naman nilang mag-modernize at kaya nilang buuin
ang kanilang mga sarili into cooperatives. Kung sila
ay pagbibigyan, sila na mismo, bilang isang grupo,
ang magpapa-modernize kung hindi kaya ng local
government unit iyon.
Sa katunayan, sabi nila, kami mismo, kung
ibibigay sa amin ang pagkakataon, kami na mismo ang
magtatayo ng kooperatiba. Bakit kailangan pang ilagay
iyan sa private sector? Iyan po ba ay isang paraan para
maibsan o magkaroon ng maayos na pagtaya ang ating
mga mangangalakal na nandodoon na po. Iyon po ay
kanilang, kumbaga, ay sila ay nagkatubo na po doon,
doon sa palengke na iyon. Sinasabi nga nila, kaya naman
natin kung modernization lang ang pinag-uusapan,
MONDAY, SEPTEMBER 21, 2015 kaya naman namin na kami mismo bilang kooperatiba,
halimbawa, isang grupuhan, ay magpa-modernize at
ibigay sa amin iyan kung saka-sakali, hindi na kailangan
ang outside na interes para doon. Iyon po ay isang
maaaring solusyon, pagdating po ng pagkakataon, kung
saka-sakali?
REP. ATIENZA. Mme. Speaker, tama po ang
tinuran ng ating kagalang-galang na Jonathan Dela
Cruz.
Kung gusto ninyong ibigay ang pagmamaneho sa
ibang tao dahil baka naman pagod na lahat ang mga
taong city hall, pagod na sila sa pagbibilang, kung ano
ang binibilang nila, hindi ko alam. Pero araw-araw,
nagbibilang sila. Ibigay ninyo ang pagmamaneho
ng public markets sa mga kooperatiba sa loob ng
pamilihang bayan sapagkat may batas po tayo diyan,
Mme. Speaker. The cooperative in every public market
is given the opportunity, para bagang, first refusal.
REP. DELA CRUZ. To refuse.
REP. ATIENZA. Kung kinakailangang isapribado,
ibigay ninyo sa mga kooperatiba sa loob ng palengke.
Iyon po ay meron na pong batas diyan. Hindi na natin
kailangan pang bumuo ng panibago, ipatupad lang ang
layunin po ng batas na iyon on cooperatives, and that
would display a genuine intention to help and not to
take advantage of.
Ngayon, lahat po ng kasinungalingan sinasabi po,
“Babalik kayo diyan, meron kayong guarantee letter,”
pero wala po silang sulat na garantiya, “babalik kayo
diyan,” pero wala naman po silang pinanghahawakan
na sila ang babalik. Alam ko na ang mangyayari diyan,
Mme. Speaker. Pag nabuo na ang palengke, sasabihin
doon sa mga original stallholders, “O, gusto ninyong
bumalik, ang ganda ano? Magbayad kayo ng goodwill,
magbayad kayo ng additional, dahil kung hindi, kukuha
kami ng bagong applicant, dahil kayo, apo na kayo, anak
kayo o apo na kayo noong mga original.” Ganoon po sa
palengke, ang mga nakikinabang na ngayon ay kaapuapuhan ng mga original stallholders. Pero hindi po ilegal
iyon, iyon po ang layunin ng batas. First preference
should be given to the children, the grandchildren of
the original stallholder. Pero pag dito nanaig po ang
ganoong klaseng uri ng pag-iisip, ang bibigyan po
ng karapatan, tiyak, ang magbabayad ng panibagong
goodwill money sa kanino pa man, gobyerno o pribado.
We would like to prevent this, Mme. Speaker,
because otherwise, not only the market vendors but the
housewives who are dependent on shopping in public
markets, and the public in general—alam po ba ninyo
sa Quinta ngayon, hindi na kayo makadaan sapagkat
giniba iyong palengke, nagkalat po ngayon doon

iyong relocation market. Doon po sa amin sa Malate,
nagtatayo na po ng relocation market along San Andres,
along Leveriza. Aba ay wala na pong dadaanan ang mga
sasakyan. Huwag muna kayong pumunta sa Malate
kapag ito po ay hindi namin napigil sapagkat ilalagay
iyong mga vendor na nasa loob sa labas at gigibain
iyong bagong palengke. Hindi po namin maintindihan
iyon. Makikita ninyo iyong purpose is not to help; the
purpose is commercial.
REP. DELA CRUZ. Maraming salamat po, Mme.
Speaker, at iyon lang po. Sana maliwanagan ang
ating mga kababayan lalung-lalo na iyong ating mga
mangangalakal na ngayon ay naghihirap at nag-aayos
upang sila ay patuloy na makinabang dito sa ating
mga public service kagaya po ng public market.
