Earlier Writ application being W.P. No. 12511 (W) of 2012 was
disposed of on 9.9.2015.

the month of April, 2010 advertisement was published by the
authorities for appointment of Asha employees.

POINTS OF LAW
That the Scheme has been framed by the Central Govt. and as per the
Scheme the Govt. of West Bengal has also adopted the Scheme for
engagement of Asha employees in different Gram Panchayets at Raina
- it Block according to the Scheme so many candidates have been
applied in different Gram Panchayets and interview was taken up and
appointment letter has been issued to the petitioner medical
examination has been taken on the basis of the Samity two(2)
candidates selected by the authorities as per the regulation and that
the authorities without hearing the petitioner, without mentioning the
specific objection has taken a plea a panel has cancelled though there
is no whisper regarding such cancellation of panel by the three (3)
Men Committee and a person was a judge of a case cannot be a
member of the Committee and also taken the plea to cancel the panel
and by violating the natural justice everything has been done by way
of a political reason and the action of the authorities are violative of
Article 14,16, 21 and 39d of the Constitution of India and also
violative of the regulation of the appointment for Asha employees.

Health has not cancelled the panel
as such the panel is valid and the
petitioner is entitled to get the
actual engagement by way of
training

Candidates was filed the aforesaid
Writ application and that matter
came up for final hearing before the
Hon'ble Justice Dr. Sambuddha
Chakrabarti wherein by the order
dated 9.9.2015 His Lordship has
been pleased to pass an order that
as the panel is defective and in
procedural irregularity as such
fresh cause of action is arisen and
the liberty is given to the petitioner
but challenge as a totality of the
new cause of action as arisen, in
view of the circumstances and
liberty was given to file a fresh
proceeding.

The authorities have not cancelled
the panel of the Asha employees to
whom
the
appointment/
engagement was given and thereby
sent them for medical examination
before the Block Level Health
Centre after completion of the
medical.examination the petitioner
in spite of undertaking by the

The Humble petition of the
petitioner abovenamed most
respectfully Shcweth:
1)
That, the petitioner is the citizen of India and resides in the
address as mentioned in the cause-title and entitled to file this
ap plication .

That, the Respondent Authorities are the Authorities who come
under the purviewof the Article 12 of the Constitution of India so the
Writ application is maintainable against the Respondents.
3)
That, challenging the illegal action of the authorities by not
sending the petitioner in training for Asha Prakalpa employees in
spite of giving appointment letter n spite of making medical
cxmaination the petitioner and 53 others moved the Writ application
being W.P. No. 2511 (W) of 2012 and that matter came up for final

hearing before the Hon ble Justice Sambuddha Chakrabarti on
9.9.2015 and upon hearing the matter His Lordship has been pleased
to observe on the basis of the submission of the Govt. Advocate that
the recruitment of Asha Prakalpa employees, Raina — II Block stood
cancel, as such, there is a new cause of action and the same to be
challenged in totality in view of such the Writ application is disposed
of as an infractuous with a liberty to file fresh Writ Petition
challenging the new cause of action accordingly the present Writ
application is being filed.

That, the main grievance of the petitioner are very much legal
and fair and the authorities have no right to make an enquiry on the
basis of the objection without disclosing the same the authorities
conducted the enquiry of the three (3) men Committee and District
Magistrate was issued the order of enquiry by appointing three (3)
men Committee who is approving and recommending authority of the
pancl to send the same before the State Mission Director (NM-1M) as
such entire process has been done a authority who is a party to the

proceeding as such no man can judge of his own case who has signed
and approved the panel of Asha Prakalpa employees of Raina - II
Block
The copy of the report of the enquiry and also the forwarding
letter dated 26.3.2012 of the Chief Medical Officer of the authority
and the letter dated 22.3.2012 issued by the District Magistrate have
been deposited and disclosed before the Hon'ble High Court at the
time of hearing of W.P. No. 12511 (W) of 2012, dated 9.9.2015 is
annexed hereto and marked as Annexure - P/1'.

That, a guideline has been framed by the Govt. of West Bengal,
Department of Health & Family Welfare for engagement of Asha.
Prakalpa employees for implementation of the Central. Govt. Scheme
wherein 800-1200 vacant posts to be filled up in 135 blocks and the
borough rules and regulations of such engagement has been
ecl in such notification on the basis of such different Gram
Panchayets in the year April, 2010 in different dates made an
advertisement n the Panchayet Office and at the wall of the library of
the Village and also accessible place of the Village for engagement of

the Asha employees with. the rules and regulations for engagement
under Raina -- II Block.
The Xerox copy of the regulation of the Govt. of West Bengal,
Department of Health & Family Welfare and also the specific
advertisement of the Gram Panchayet which was wall up in different
places in every Village of the respective Gram Panchayet is collectively
ar (mod hereto and marked as Annexure `P/2'.

That, on the basis of the advertisement of the. Gram Panchayet
in the year 2010 in specific and specimen format of the application
for appointment in different Gram Panchayets under Raina - II Block
was Lilted up by the Candidate/Petitioner and thereby deposited the
same in due time.
Xerox copy of such specimen copy of the application will
produce at the time of hearing of the application.

That, on the basis of such application for engagement of Asha
emt~ioyees at Gram Panchayet Arui, Sub-centre -- Madhabdihi
B.P.H.C. - V the authorities issued the AdmitCard to he petitioner

for interview specifying the date, time of such interview in respect of
the petitionerwhich has been mentioned in the Admit Card itself as
the petitioner^ has requisite qualification as per the advertisement and
the rules. The Admit Card was issued by the authorities, so, there is
no dispute regarding academic qualification and if required the
petitioner will refer and produce the certificate of academic and other
qualification at the time of hearing of the application.
Xerox copy of the Admit Card is annexed hereto and marked as
Annexure -'P/3'.
That, after completion of nterview in different Gram Panchayets
under Raina -.II Block for filled up the post of Asha employees
whereas lfairly and properly advertised the vacancy and also the
engagement of Asha employees in the accessible place of every village,
library in. a reputed wall of the shop, the Gram Panchayet Office etc.
and accordingly after eceiving the application from the Candidates
interview was completed and thereby a panel was prepared by the
authorities on the bas's of the regulation as made as stipulated being
Anr.e.ture - P/2 of the application and thereby issued the
appointment letter to the petitioner on 8.9.2011 by the Block Health

and Family Welfare, Raina II Block Madhabdihi, Burdwan by
requesting to report to the Secretary, Block Health and Fa y
Welfare Sanity of the Block between 12.10.2011 to 18.10.2011 at any
working days between 1 a.m. to 4 p.m. for reporting of medical
examination and bring medical certificate from a registered Medical
Practitioner.
Xerox copy of the appointment letter is annexed hereto and
marked as Annexure - `P/4'.

That, in the appointment letter the authorities have been
directed the petitioner to appear before the Block Medical Officer for
Nleyical Examination in specific date and time and the petitioner have
appeared and thereby fit for appointment but no fit certificate has
been given and thereby said the petitioner that he will send for
training in the training centre very soon.
10) l.t is stated by the petitioner that the authorities who have
advertised the post in wide circulation in the Village concerncd and
many candidates have been applied in the said post and upon taking
the interview by the respondent authorities prepared the panel and

recommended the panel and sento the State Mission.Director for
final approval of panel and thereby issued the appointment letter to
the selected candidates upon preparation of panel and thereby the
said Officer without specifying an objection which has not been
mentioned by the District Magistrate as well as the three(3) men
committee, without canceling the appointment letter kept the matter
pending for indefinite period and thereby before the Hon'ble High
rn the earlier Writ application being W.P. No. 12511 (W) of 2012
the Govt. Advocate submitted, the panel has been cancelled and
thereby submitted a bunch of paper wherein there isno whisper
regarding the cancellation of panel and the respondents have mislead
the Court. Considering such situation the petitioners are entitled to
get the actual training and posting the said post and they are also
entitled to get the salary, allowances and benefits month by month.
11) :t is stated by the petitioner that as per the scheme of the
Central. Govt., the Govt. of West Bengal implemented. the Scheme and
thereby tried to give appointment of Asha employees in other blocks
except Raina - II as per the advertisement the Asha employees have
bean en aged earlier but in respect of Raina - II Block no one has been

given actual posting and training as such local people are suffering to
a great extent.
12 it is stated by the petitioner that no man can judge of his own
case the authorities who have prepared the panel, recommended the
panel, and given an appointment and medical examination has been
made to the petitioner the said authorities cannot by making a false
three(3) men Committee cannot stop the panel.
13) It is stated by the petitioner that it is case of judicial review
because no cancellation of the panel has been made in the report
being Annexure - P/1 of the Writ application which has been
prat ed before the Court a connection with the hearing of the
earlier Writ application being W.P. No. 12511 (W) of 2012.
1/'' It is stated by the 'petitioner that after the medical ex-
atoll
and getting the appointment letter the petitioner along with others
made the representation to the authorities but nothing has been done
and in the hearing of the Writ application being W.P. No. 1251.1 (W) of
2012 in the year 2015 they have produced a report that panel has

been cancelled. In such report there is no whisper regarding the
cancellation of the panel.

It is stated by the petitioner that the authorities have violated
the provisions of the Scheme for appointment of Asha employees and
also violated the provision of Article 14, 16 and 21 and 39d of the
Constitution of India and also the provision of judicial review and
without giving a hearing to the petitioner who have been appointed in
the post, the cancellation of panel is arbitrary, illegal and
dis:rirninatory and it is required to be set aside and quashed and
thereby pass an order to send the petitioner in training for Asha
employees under Raina
II Block in the respective Gram.

Being aggrieved by and dissatisfied with the inaction on the part
of the respondent authorities by not sending the petitioner in training
as an Asha employees and not allowed actual posting in the
respective Gram Panchayets/Villages as an Asha employees and

cha.'lenging the illegal engagement of three (3) men Committee for
enquiry without any specific basis without notice to the empanel
candidate stopping for such engagement by not sending the petitioner
in training and by submitting before the Court that panel has been
cancelled and taking the plea for cancellation of panel as stipulated in
Annexure - PR of the Writ Application, the petitioner is filing this
application under Article 226 of the Coinstitution of India on the
following amongst other grounds:-
GROUNDS
1)
FOR THAT that the authorities who have advertised the post in
wide circulation in the Village concerned and many candidates
have been applied in the said post and upon taking the
interview by the respondent authorities prepared the panel and
recommended the panel and sent to the State Mission Director
for final approval of panel and thereby issued the appointment
letter to the selected candidates upon preparation of panel and
thereby the said Officer without specifying an objection which
has not been mentioned by the District Magistrate as well as the
three(3) rnen committee, without canceling the appointment

letter kept the matter pending for definite period and thereby
before the Hon'ble High Court in the earlier Writ application
being W.P. No. 12511 (W) of 2012 the Govt. Advocate submitted,
the panel has been cancelled and thereby submitted a bunch of
paper wherein there is no whisper regarding the cancellation of
panel and the respondents have mislead the Court. Considering
such situation the petitioners are entitled to get the actual
training and posting the said post and they are also entitled to
get the salary, allowances and benefits month by month.
FOR THAT as per the Scheme of the Central Govt., the Govt. of
West Bengal implemented the Scheme and thereby tried to give
appointment of Asha employees in other blocks except Raina II as per the advertisement the Asha employees have been
engaged earlier but in respect of Raina - II Block no one has
been given actual posting and training as such local people are
suffering to a great extent.
11-1) FOR THAT that no man can judge of his own case the
authorities who have prepared the panel, recommended the
panel and given an appointment and medical examination has

been made to the petitioner the said authorities cannot by
making a false three(3) men Committee cannot stop the panel.
IV)
FOR THAT it is case of judicial review because no cancellation of
the panel has been made in the report being Annexure - P/1 of
the Writ application which has been produced before the Court
in connection with the hearing of the earlier Writ application
being W.P. No. 12511 (W) of 2012.
V)
FOR THAT after the medical examination and getting the
appointment letter the petitioner made the representation to the
authorities but nothing has been done and in the hearing of the
Writ application being W.P. No. 12511 (W) of 2012 in the year
2015 they have produced a report that panel has been
cancelled. In such report there is no whisper regarding the
cancellation of he panel.
FOR THAT the authorities have violated the provisions of he
Scheme for appointment of Asha employees and also violated
the provision of Article 14, 16 and 21 and 39d of the
Constitution of India and also the provision of judicial review

and without giving a hearing to the petitioner who have been
appointed in the post, the cancellation of panel is arbitrary,
illegal and discriminatory and it is required to be set aside and
quashed and thereby pass an order to send the petitioner in
training for Asha employees under Raina - II Block in the
respective Gram Panchayets/Villages.
VII) FOR THAT the authorities who have been taken interview,
prepared the panel, recommended the panel and send before
the Higher authorities for final approval those officers cannot
take the plea that the panel has been prepared illegally without
proper advertisement and in spite of issuance of the
--Appointment letter the training facilities has not been given to
the petitioner as such which is arbitrary, illegal and violative of
Article 14, 16 and 21 of the Constitution of India.
VIII.) FOR THAT without giving any notice to the petitioner without
allowing to the petitioner in three(3) men Committee though the
panel has not been cancelled cannot deprive the petitioner from
their employment of Asha employees and such action is violative
of principle of natural justice.

IX) FOR THAT the report which has been placed before the Hon'ble
Court at the time of hearing being W.P. No. 12511 (VV) of 2012
and the copy has been handed over o the Advocate of the
petitioners in that case, there is no whisper regarding the
cancellation of panel so the authorities have mislead the court
by making submission which is arbitraryand illegal.
FOR THAT the action of the authorities are otherwise bad and
illegal.
17) That, challenging the illegal action of the respondent authorities

other application has been filed before this Hon'ble Court or any
other Court of law.
1.8) That, relevant records in connection with this application is
lying in the Office of the respondent authorities which is within the
jtar .;fiction of the Appellate Side of this Hon'ble Court.

9) That, the petitioner along with others made representations to
the respondent authorities but nothing has been done as yet so the
justice has been denied.
20) This application is made bonafide and for the ends of justice.
Under the aforesaid facts and
circumstances it is most humbly
prays that Your Lordship will
graciously be pleased to pass Rule,
Order, Direction as follows:-
a) A Rule do issue out and under
the Seal of this Hon'ble Court

dated August 31, 2015 written by the Mission
Director, National Health, Mission, to the Chief
Medical Officer of Health, Burdwan intimating
him that the approval of recruitment of ASI-IA in
respect of 12aina-II Block stood cancelled on the
basis of the report of enquiry committee
constituted by the District Magistrate, Burdwan,
on receipt of complaints of procedural
irregularities and lapses in preparation of the
panel and selection of ASHA.
By the present writ petition the petitioners
have, inter alia, prayed for approval of their
appointment and to engage them as ASI IA in
different sub-centers.
In view of what has been produced in Court
today to the writ petition the petitioners are given

liberty to challenge the same as a totally new
cause of action has arisen and since in view of
this communication, the prayer made in the writ
petition cannot be acceded to, I dispose of the
writ petition as infructuous with the liberty as
mentioned above.
Mr. Chatterjee is directed to submit the
copies of the records produced in Court today to
Mr. Chattopadhyay in course of today.
There shad be no order as to costs.

As per order of District Magistrate Burdwan, a thorough vedification is made in respect of all
original records including Advertisement Notice inviting applications, original applications, the relevant
register of the applications, application details, interview marks, compilation sheet and the panel — all in
connection with engagement of ASHA under Raina — Il Block.
The verification ofthe original records as aforesaid is made on 3 (three) different dates on and
from 04/03/2 012 to 06/0

Committee Members called for the said purpose and the facts revealed in the course of verification of
records are stated in the Paras noted Panehayatwise below.

applications were found. Rest 5 (five) applications are missing. No Register was maintained
entering details of applications.

No intimation was sent to Applicants shortlisted for interview. Prodhan claimed that a general
notice having list of such applicants were walled up at GP Office only. Candidates collected the
call letter from GP Office only after seeing the list. Thus it is very clear that some candidates
who did not appear for interview were actually unaware of the fact that they were actually short
listed for inmrview, since they did not see the notice and did not come to GP Orrice to milk
their interviews call letter. Further no attendance sheet was found on interview due

did not have any memo number, but during hearing Prodhan produce anther notice bearing
memo number. But Prodhan failed to show any proof that this notice was actually circulated.
2) GP failed to submit any original applications Prodhan claimed that the original applications were
sent to the 13D0 earlier but failed to show sufficient proof.
3) Scrutiny of applications before interview was not done by all Members of Selection Committee
but by the Prodhan only.
4) Two Selection Committee Members namely (i) Suprava De, ANM Chotobainan Sub -- Centre
and (ii) Sipra Chandra, ANM Sherpur Sub — Centre have deposed to the effect that they have
signed the interview sheet but not allowed to put any marks thereon. It is also deposed that notice
in respect of ASHA engagement was not published in the respective area. As a result many
eligible candidates could not submit any application.
5) The CP Level Panel included 3 (three) under aged candidates namely Mithu Chaietjee
(Mukherjee), Rine Chakrabarty (Bhattacharjee), Tumpa. Samanta (Nandi) vide approved list SF
No, — 58, 59, 60 and anon—resident candidate Tapasi Rana vide approved list SI. No. - 63. who
are not eligible to be engaged in the post of ASHA.

automatically comes to be termed as equally irregular from the point of view of the procedures ought to
be followed in the engagement process as per the Govt. guidelines.

reporting you shall have to bring Medical Certificate in the enclosed format, from a
registered Medical Practitioner having at least MBBS degree, along with original
documents/ certificate in support of your age, educational qualification, residential
status and marital status for verification, Your appointment is. provisional subject to
production of original documents as to proof of age, residence, educational
qualification, marital status and medical fitness. It may be reiterated that selection will
stand summarily rejected if any one of the documents produced by you are found to
be ingenuine.
On engagement as ASHA you will be imparted a compulsory residential training of
23 days in five phases, spread over a period of one year after engagement. You will be
reimbursed TA (based on annals) subject to provision of necessary proof by the
MNGO for attending the training. Your fooding and lodging will be arranged by the
MNGO during the training period(s).
You have to compulsorily attend the five phase training to be conducted by the
MNGO of your district failing ivbieh the engagement sdall stand automatically
cancelled. You will have to report to the ANM of your respective Subcentre and the
PRI of your village and perform your duties in close coordination with the ANM,
AWW and other health system functionaries at the village level,
Note: ft may be noted that ,ASHA will be entitled for performance based
:
t ,compensation only after completion of second round 4 days training. She will also be
eligible for payment for conducting household survey in her area. This will be
provided as per approved guideline.
