Gentlemen:
This letter agreement i s prepared a s a follow-up t o t h e meeting conducted
yesterday, October 17, 2007, among representatives from all o f the Upshur County
Commission, E.L. Robinson represented by Randal Lewis, the Upshur County
Development Authority, and t h e City of Buckhannon. D u r i n g t h i s meeting t h e r e was
extensive discussion about t h e City of Buckhannon, through i t s Sanitary Board, cosigning together with t h e Upshur County Commission, the grant application seeking
financial support t o extend sewer service t o a proposed development site at t h e
Upshur County Industrial Park. One of the conditions established by the City of
Buckhannon i n order for our City t o co-sign this application was for t h e Sanitary
Board to be a b l e t o exercise certain c o n t r o l s and authority regarding engineering
design and construction. These c o n t r o l s a r e a s follow:
1. The Buckhannon Sanitary Board shall b e required t o provide written
acceptance of the design of t h e sanitary sewer extension p r i o r t o i t s
submittal t o any other regulatory agency. This acceptance shall include
design concept, layout, materials, and specifications. The Buckhannon
Sanitary Board shall be required t o provide a registered professional
engineer to review t h e design and provide the acceptance, and any
requests for modifications by Buckhannon must be i n accordance with
sound engineering practice, regulatory agency standards, and standard
practice o f the Buckhannon Sewer Department.
2. E.L. Robinson shall utilize a Buckhannon Sewer Department employee who
shall b e designated by Buckhannon, to perform all construction observation
services during construction o f this sewer extension. This employee shall
be suitably qualified and s h a l l b e required to perform the construction
observation duties i n accordance with standard practices of E. L.
Robinson. E. L. Robinson s h a l l be responsible for a l l costs of construction
observation, including wages and reasonable expenses.
3. The Buckhannon Sanitary Board shall be required to approve and sign all
pay estimates submitted by the contractor constructing the sewer extension
before payment is made t o t h e contractor. Any deficiencies noted by

Buckhannon regarding t h e construction work covered by the pay estimate
shall be corrected or deleted from the pay estimate before approvals and
payments are made.
The City o f Buckhannon considers this letter t o be a condition to its
agreement to co-sign the grant application and will attach a copy of this letter to its
commitment letter to the project s o that i t can be included w i t h the application
package.

IndustriaYBusiness Park. Upshur County's unemployment rate for April 2007 is 4.4%. The sanitary sewer extension
would stimulate fuurther growth and employment oppomnities to arise in and around the Town of Buckhannon.

I. INTRODUCTION
The project, described in this report, is the construction of sanitary sewer lines to expand an
existing industrialhusiness park and to enable an economic development project to be
implemented by the Upshur County Commission and the City of Buckhannon.
The proposed site is approximately twenty-seven acres and is a part of the existing Upshur
Counij Industrial Park. The industrial park is located off of County Route 13 approximately two
miles northeast of Buckhannon. The park is currently home to the Trus Joist Manufacturing
Facility. It is from this facility's existing sanitary sewer lift station that improvements will begin.

II. CURRENT SITUATION
A.
SOURCES/DISCHARGE
The sanitary sewer will tie into the Buckhannon Sanitary Board’s existing system at a lift
station near the Trus Joist Manufacturing Facility. The wastewater treatment plant discharges
into the Buckhannon River. Current customers include residents in the Buckhannon area and also
those from the Tennerton Public Service District. The wastewater collection system consists of
ductile iron, PVC, and concrete pipe.
B.
CUSTOMERS
According to the United States Census Bureau, Upshur County’s 2005 population was
23,712. The City of Buckhamon had a population of 5,725 in the year 2000. The City of
Buckhamon’s Sanitary Board currently serves 3,035 customers as well as 562 customers
from the Tennerton Public Service District.
C.
DISTFtIBUTION/COLLECTION
Shown on the following page are the conceptual layout of the proposed site and an aerial
photograph of the proposed site with the proposed site boundaries and utilities overlaid. Full
sized copies of both illustrations are included as attachments.

TREATMENT
Buckhannon’s wastewater treatment plant utilizes is an oxidation ditch which utilizes
aeration and activated sludge as its treatment. The plant’s design capacity is 2.5 million gallons
per day. It has an average flow of 1.23 million gallons per day. The plant operates twenty-four
hours per day. The lift station near the Trus Joist Manufacturing Facility has a 7.5 horsepower
pump. The lift station is rated at 80 gallons per minute at 30 feet TDH. The Buckhannon
wastewater treatment plant is in good condition with normal maintenance being an ongoing
process. The sanitary sewer system contains combined sewer overflows, therefore infiltration
and inflow at the treatment plant is a common occurrence. Plant manager Sam Ludlow stated that
the plant can and has handled up to 5.0 million gallons per day in wet weather events. There are
currently fifteen employees at the plant. Nine are general employees, six are plant operators.
There is one Class 4, one Class 3, and four Class 1 operators.
E.
NEED FOR PROJECT
The Upshur County Development Authority has approximately twenty-seven acres to be
used for development within the Upshur County Industrial Park. The construction of a sanitary
sewer line is necessary to facilitate potential businesses that would be housed on the developed
site. The sanitary sewer would tie-in to the existing Buckhannon system and thus alleviates the
need for an individual package treatment plant for the site.

111. FUTURE SITUATION
A.
POPULATION PROJECTIONS
Enclosed is the summary page of “West Virginia Population Projections 2000-2050”prepared
by the Regional Research Institute, West Virginia University. Projections show a popu!ation
increase in Upshur County, fiom 23,404 in 2000 to 29,223 in 2050. This is an increase of2,829
persons or 25% or about 117 persons per year. The population projections included with this
report indicate an increasing population in Upshur County, a housing estimate, published by the
U S . Census Bureau (Included in Appendices), and listed 10,779 housing units for the year 2000
rising to 11,223 in 2005, an increase of 4%. In the City of Buckhannon Sanitary Board Annual
Report for the fiscal year 2006, the average number of customers was 3,100.

POPULATION PROJECTION SUMMARY BY COUNTY
The proposed site will be located in the southeastern corner of the existing Upshur County
Industrial Park site. The industrial park is bordered at the north by County Route 13 and the Trus
Joist Manufacturing Facility. An abandoned connector road runs northeasterly through the site
and connects with County Route 13. The proposed site shall have a 3,600 foot long access road
that begins at a point along the connector road.
Utilities shall tie in near the Trus Joist Facility. The estimated distance from utility tie-in to
the proposed site is approximately 4,700 feet. The waterline tie-in is approximately 1,200 feet
further. These utilities will follow the meanderings of the abandoned connector road and then the
proposed access road.
B.

IV. A L T E ~ A T I V E S
1. N o Action -Take no action to extend the proposed wastewater collection system.
This alternate would not address the need for a wastewater collection system for the
proposed site. Without adequate wastewater collection a new facility could not use the
site. This is not considered a viable alternate.
2. Package Treatment Plant - Installation of an onsite package treatment plant at the
proposed site would be a solution for future wastewater collection and treatment. This
alternate would involve additional operation and maintenance costs for potential owners.
Also, this alternative would not be taking advantage of the existing Buckhannon Sanitary
Board’s wastewater collection system and treatment plant.
3. Tie-Into the Buckhannon Sanitary Board system - This alternate would involve
installing sewer lines from the site and tying into an existing lift station. The lift station is
a part of the Buckhannon Sanitary Board’s existing wastewater collection system. The
tie-in would be approximately 4,700 feet from the site. This alternate would utilize an
existing system for collection and treatment. Buckhannon’s wastewater treatment plant
has the additional capacity to handle the daily flow from the proposed site. Therefore, this
alternate is the most cost effective and beneficial alternative.
V. PLAN SECTION AND PUBLIC PARTICIPATION
The engineered design of the necessary infrastructure to serve the proposed economic
development site is crucial to the success of the project. Listed below are the components of the
infrastructure and site development construction project and the desigdengineering work needed
prior to construction.
A.
Wastewater Collection System
As in the construction of a water distribution system, a wastewater collection system must be
constructed to meet the minimum standards of the WVDHHR-BPH. A final engineering design
of the project components complete with construction drawings, construction details, profiles,
hydraulic calculations and specifications would need to be submitted to the WVDHHR-BPH in
order to receive a permit to Construct or Modify a Wastewater Collection andor Treatment
System. This permit must be obtained to satisfy Chapter 16, Article 1, Section 9 of the West
Virginia Code.
VI. PROJECT SUMMARIES
A.
ENGINEERING SUMMARY
The proposed wastewater collection mainsilaterals would be constructed of eight-inch
Polyvinyl Chloride (PVC) Pipe. Approximately forty feet of sixteen-inch diameter steel
casing pipe will be required for road crossings. The minimum slope for eight-inch diameter
lines will be 0.4% and the minimum slope on six-inch diameter lines shall be 0.62% in
accordance with West Virginia Bureau of Health Standards. The estimated quantity of eightinch PVC and sixteen-inch steel casing pipe is 4,700 feet and 40 feet respectively.
The calculated peak flow for the eight-inch mains, using a peaking factor of five, is
approximately 0.36 cubic feet per second (cfs). The calculated maximum capacity of an
eight-inch diameter line installed on the minimum slope of 0.4% was calculated as 0.76 cfs.
The calculated excess capacity of the proposed eight-inch sewer is approximately 0.30 cfs.

Pre-cast concrete manholes meeting ASTM C478, with approved lids, shall be installed at
all changes in alignment and junctions with a maximum linear distance of 300 feet between
manholes. An estimated 20 manholes will be required for the proposed sewer line.

The existing operating and maintenance costs for the City of Buckhannon Sanitary
Board are $1,035,438, as per Page 603 of the PSC Annual Report year end date of
June 30.2006.
Since the proposed sanitary sewer is gravity feeding into an existing IiR station, there
will be no additional costs for electric. Operation and maintenance costs for the 4,700
lineal feet of sewer line will be negligible.
3. EXISTING DEBT
The City of Buckhannon Sanitary Board has long term debt in the amount of
$2,836,682, per page 102 of the PSC Annual Report, year end June 30, 2006. A

4. PROPOSED PROJECT FINANCING
The Upshur County Commission and the City of Buckhannon are applying for a
Small Cities Block Grant in the amount of $500,000. This funding is for the
construction of a new sanitary sewer line. The sanitary sewer extension is an
independent portion of a much larger project, which involves the installation of utility
infrastructure and site preparation for future commercial andor industrial tenants.
5. USER RATES PROJECTED
As of April 1, 2007 the City of Buckhannon passed an ordinance to raise sanitary
sewer rates to $27.80 based upon 4,500 gallons of water used. Rates prior to April 1,
2007 for 4,500 gallons were $24.75. The new ordinance shows an increase of $3.05
per 4,500 gallons.
In order for a rate increase to be accepted it can be no more than 1.5% of the average
household income. For this particular rate increase median household income was
taken from Upshur County Block Group Number 2, which is $22,232.00.
Calculations are shown below:
1.5% x $22,232 = $333.48
$333.48 + 12 months = $27.79
If this is broken down further into gallons of water used the calculations would be:
$6.74 per 1,000 gallons for the first 2,000 gallons used = $13.48
$5.73 per 1,000 gallons for the next 2,500 gallons used = $14.325
New rate for 4,500 gallons used = $13.48

PUBLIC HEALTH BENEFITS
The construction of a new sanitary sewer to the proposed site will bring added public health
benefits. By utilizing Buckhannon’s existing wastewater collection system there will be no
discharge of untreated waste into streams. Therefore, less contamination and contact with
workers and citizens will occur. Having this new infrastructure present at the Upshur County
Industrial Park will also promote additional economic development. The residents of
Buckhannon and surrounding communities will be the initial beneficiaries of the economic
development project. When the project is completed, ownership o f the water and sewer lines
will be turned over to the City of Buckhannon for operation and maintenance.

on the above mentioned project due to the fact that the City of Buckhannoii sewer rates
did not meet the specified percentage of the MHI as determined by the PSC. We
respectfully request that the MHI used for this application be per the City of Buckhannoii
which is $23,241. This MHI would make the current rates fall within an acceptable range
thus allowiiig this project to receive approval through the Council. We request this on the
basis that the City will have ownexship of the lines and treat the waste that is carried at
their facility. In addition, the citizens of Buckhannon will be paying rates that support
the extensioii to be installed. Further, there have been discussions that the Industrial Park
area will ultiniately be annexed into the Cjty.

On February 2, 2W7 the Upshur County Development Authority was invited by the US
Economic Development Ad~ini~ration
(EDA) to submit an application to fund 50% of
the above referenced project. The EDA application requires that we request comments
from you regarding the project.
I have attached project description & maps/air photos of the project for your
consideration. There is an identified wetland area to the north of the project area. This
area has been designated a wetland reserve on the Industrial Park Property and
identified as such in the EDA pfe-application, It is outside the scope of the project.
US EPA gives applicants a very short turn around on the application process after the
invitation is issued. The full application needs to be mailed kom Buckhannon no later
than February 21, 2007. Your consideration and attention to this request for comments

I have been able to get a more detailed map (attached) OF the Upshur County Industrial Park
Project from the engineer on record since our last correspondence (attached for your
convenience). In conjunction with a top0 map (attached), it clearly shows that this project will
take place on ground that has been previously disturbed,
There has been a new road constructed in the area since the last topo update to serve the
industrial traffic created by Trus Joist at their engineered structure wood facility. The Road is
designated 33/15 by the West Virginia DOT. The project will have access vla this new road.
Proposed infrastructure improvements and the new road are clearly marked on the E.L.
Robinson (engineer) air photo. I n light of the additional information we are asking for another
review OF this project for archaeological clearance. A phase I archaeological survey is a very
expensive undertaking, a worthwhile burden to the community only if absolutely necessary.
It is my understanding that US EDA will issue invitations for project applications before the
year's end. We have 30 days from the invitation date to submit a full application and SHPO
clearance is very important to make the application competitive. A timely response will be very

We have reviewed the above referenced project to determine its effects to cultural
resources. As required by Section 106 of the National Historic Preservation Act,
as amended, and its implementing regulations, 36 CFR 800 “Protection of
Historic Properties,” we submit our comments.
Project infomiation states that the Upshur County Development Authority is in
the process of developing an industrial park located adjacent to County Route 13
and will be pursuing a grant from the Economic Development Administration.
Architectural Resources:
It is our understanding that no structures aged 50 years OF older are within the area
of potential effect of this project; therefore, no architectural resources eligible for
or incIuded in the national Register of Historic Places will be impacted by this
project. No further consultation regarding architectural resources is required.
Archaeoloaical Resources:
Project information states that the project area has been impacted by prior ground
disturbing activities associated with surface mining, road construction, and
railroad line construction. However, the submitted aerial photograph and the soil
survey for the project area indicate that there are portions of the project area in
floodplain and river terrace settings that have not been heavily impacted by prior
ground disturbing activities. These types of landforms are considered to have a
moderate to high poteiitial for containing archaeological resources. Our records
indicate that four known archaeological sites are located on similar landforms
within a one-mile radius of the project area. We are concerned that there are
unrecordcd archaeological resources within the undisturbed portions of the project
area. Therefore, we request that a Phase 1nrchaeological survey be conducted in
all undisturbed areas within the project area that will be iiiipacted by proposed
ground disturbing activities (e.g., iiifxastructure installation and building
construction). We will complete our review upon receipt of the results of the

requested Phase I archaeological survey.
Please be aware that archaeologists supervising all phases of archaeological
investigations including the person(s) who will be in the field on a daily basis,
must meet the Secretary of the Interior's Professional Qualification Standards (see
enclosure) as outlined in 36CFR61. Resumes of all qualified personnel should be
requested when seeking bids. If you need heIp in determining whether an
individual is qualified, please contact staff in the West Virginia State Historic
Preservation Office. Resumes of all qualified personnel must be appended to the
back of the report documenting the result of the investigations. Failure to do so
will result in the report being rejected.

Thank you for providing to our of‘fice a more detailed aerial photograph illustrating the

Upshur County Industrial Park project. In earlier correspondence dated October 17,
2006, our office had requested thar a Phase I archaeological survey be conducted in the
proposed industrial park project area. Current project information, however, indicates
that a majority o f t h e proposed activities will occur in areas previously impacted by
mineral extraction activities. It is our understanding that a section of the water and
sanitaiy sewer lines will be installed within the existing right-of-way for County Route
33/15. The noted disturbances, in our opinion, makes it unlikely dut there are intact
archaeological deposits within the proposed industrial park project area. Therefore, we
rescind our pravious request that a Phase I archaeological survey be conducted and have
determined that this project will have no effect on any known archaeological sites listed
in or eligible for inclusion in the National Register of Historic Places. rf, however,
cultural materials are encountered during construction, ail activity shall cease and our
office shall be contacted immediately.
