Do Not Track Statement Survey
On 4 December 2013, 2 January 2014, 3 February 2014 and again on 2 March 2014, Athena surveyed website privacy statements for clauses
referring to “Do Not Track”, based on the top 100 websites in the United States per Alexa (http://www.alexa.com/topsites/countries/US) as of 4
December 2013. In some cases, we explored a website further to search for relevant statements, but we may not have found all statements. For
example, we might have looked in cookie policies or advertising policies as well.
We attempted to identify whether there were statements made that specifically address this requirement from the California Online Privacy
Protection Act:
 22575 (b)(5) Disclose how the operator responds to Web browser “do not track” signals or other mechanisms that provide consumers the
ability to exercise choice regarding the collection of personally identifiable information about an individual consumer’s online activities over
time and across third-party Web sites or online services, if the operator engages in that collection. 1
 22575 (b)(6) Disclose whether other parties may collect personally identifiable information about an individual consumer’s online activities over
time and across different Web sites when a consumer uses the operator’s Web site or service.
 22575 (b)(7) An operator may satisfy the requirement of paragraph (5) by providing a clear and conspicuous hyperlink in the operator’s privacy
policy to an online location containing a description, including the effects, of any program or protocol the operator follows that offers the
consumer that choice.
The top 100 websites listed by Alexa are an amalgamation of consumer websites, supporting and associated domains, and service providers (e.g.,
email marketers, advertisers, affiliate networks, hosting services). Although the list is US-centric, it includes several non-US websites that are
popular to the US audience. This survey reports on this list, even though there are some anomalies.
This survey is not a review of compliance, but rather is an exploration on the current state of privacy statement disclosures related to the California
rules. It was generally very clear when the websites indicated that they do honor the Do Not Track signals. For websites indicating they do not
honor, recognize, or respond to Do Not Track signals, the disclosures were often less clear as to what they meant. Statements about other parties
collecting personally identifiable information (related to Section 22575 (b)(5)) were significantly complicated and difficult to understand. In many
cases, it was unclear as to whether the website operator considered the collection by other parties to be personally identifiable or not. This is
further complicated by the differing definitions used by the California rules and by the various industry self-regulatory programs.

On September 27, 2013, California Governor Jerry Brown signed into law A.B. 370, amending the California Online Privacy
Protection Act (CalOPPA) to require website operators such as LinkedIn to disclose: (1) how LinkedIn responds to "Do Not Track
Signals"; and (2) whether third parties collect personally identifiable information (PII) about users when they visit LinkedIn.

What is Do Not Track? Do Not Track (DNT) is the concept that has been promoted by regulatory authorities, in particular the U.S.
Federal Trade Commission (FTC) for the Internet industry to develop and implement a mechanism for allowing Internet users to
control the tracking of their online activities across websites.
What is a DNT signal? Currently, various browsers - including Internet Explorer, Firefox, and Safari - offer a DNT option that
relies on a technology known as a DNT header, which sends a signal to websites' visited by the browser user about the user's
DNT preference. You can usually access your browser's DNT option in your browser's preferences.
Is there a DNT technology standard? The World Wide Web Consortium (W3C) has been working with industry groups, Internet
browsers, technology companies, and regulators to develop a DNT technology standard. While some progress has been made on
this issue, progress has been slow, and no standard has been adopted to date. Without a common, industry standard for DNT,
users cannot know how any given company abides by DNT signal they receive from browser headers.
How does LinkedIn respond to the signal? LinkedIn takes privacy and security very seriously, and strive to put our members
first in all aspects of our business. With regard to DNT, LinkedIn currently does not respond to DNT signals in browsers because it
doesn't track individual members across the web with the exception of proactive sharing of articles on LinkedIn (see below).

What about javascript buttons like "Share on LinkedIn"? As described in our Privacy Policy, javascript buttons ("plugins")
create impressions on LinkedIn's servers when pages with these buttons load in your browser. Because this is a source of
tracking, LinkedIn has taken great care to ensure that our commitment to not follow our members across the web is honored. As
noted in our Privacy Policy, LinkedIn de-personalizes all plugin impressions within 7 days.
Other Party Collection. Does LinkedIn permit third parties to collect personally identifiable information about an individual
consumer's online activities over time and across different Web sites when a consumer uses LinkedIn's site?
As the world's largest professional network, our 100s of millions of members come to LinkedIn to connect with other members, to
find jobs, to be found by other members for any number of professional reasons. LinkedIn is, inherently, a public place, and there
is a lot of personally identifiable information on LinkedIn that is viewable by any visitor. In other words, third parties can find out
about you from the LinkedIn site.
In the DNT context, however, LinkedIn does not authorize the collection of PII from LinkedIn members through advertising
technologies deployed in ads that may appear on LinkedIn without separate consent.

include third-party web beacons, which are prohibited from collecting your personal information. We also use identifiers passed to
us by app developers that choose to use our advertising services.
DNT. Browser Controls for “Do Not Track” and Tracking Protection. Some newer browsers have incorporated “Do Not Track”
features. Most of these features, when turned on, send a signal or preference to the web sites you visit indicating that you do not
wish to be tracked. Those sites may continue to engage in activities you might view as tracking even though you have expressed
this preference, depending on the sites’ privacy practices. Because there is not yet a common understanding of how to interpret
the DNT signal, Microsoft does not currently respond to the browser DNT signals on its own websites or online services, or on
third-party websites or online services where Microsoft provides advertisements, content or is otherwise able to collect information.
We continue to work with the online industry to define a common understanding of how to treat DNT signals. In the meantime,
users may continue to opt-out of targeted ads from Microsoft as set forth above.
Internet Explorer (versions 9 and up) have a feature called Tracking Protection that helps prevent the web sites you go to from
automatically sending details about your visit to third-party content providers. When you add a Tracking Protection List, Internet
Explorer will block third-party content, including cookies, from any site that is listed as a site to be blocked. By limiting calls to these
sites, Internet Explorer will limit the information these third-party sites can collect about you. For more information about Tracking
Protection Lists and Do Not Track, please see the Internet Explorer privacy statement or Internet Explorer Help.
Other Party Collection. Advertising Opt-Out Controls. Because cookies may be used for many purposes, users who object to
behaviorally targeted advertising may choose to accept cookies but opt out from that particular use at Your privacy and Microsoft
personalized ads. Companies in the online advertising industry have developed guidelines and programs to help protect users’
privacy, and these industry programs include web pages you can visit to opt out from receiving behaviorally targeted
advertisements from all participating companies (including Microsoft). These pages include:

We gather anonymous information such as on the types of pages visited, and keywords searched on in order to build an overall,
but anonymous, picture of interests or preferences based on individual users browsing habits so that we can offer a more personal
experience. To this information, we include information relating to a user’s country, region and connection type gathered from
elements of the IP of the browsing device. This practice is a core method used by our group to make our online advertising more
efficient for our advertisers and more relevant to consumers.
With permission from our advertisers, we also collect information about their sites, for use on their advertising campaigns. This is
often called Retargeting, or Remarketing, and involves showing ads to groups of users that have, for example, visited that client’s
homepage.
We will also gather information, still anonymously, on the users that reach an action page on an advertiser’s site. This allows us to
monitor how many sales or actions we achieve for a client, and therefore how effective our advertising is.
In order to know how many advertisements we serve, how many times these are clicked, how many advertisements we show to a
given user and how many customer actions these generate, we use cookies when we show advertisements on a page.
As well as our licensed ad servers, ads are also often served from third-party ad servers, such as those of media agencies, which
all use cookies to track the same metrics as ours do.
