AND FJE COUNCIL CHAIR
The American Bar Association works tirelessly to uphold the rule of law,
which is the cornerstone of a free and just society. As members of the legal
profession, we are uniquely positioned to carry out this work. Representing
more than 400,000 members of the legal profession worldwide, the ABA is at
the forefront of defending our human rights so that citizens, domestically and
abroad, do not suffer injustice or brutality.
Working together, we can bring about powerful change. As lawyers, we strive
to ensure justice for our clients. As members of the American Bar Association,
we are bound together by our shared goal to build a globally stronger
justice system. Thank you for supporting ABA Sections, Divisions, Forums,
Committees, and Commissions whose programs are having a meaningful and

The enclosed FJE Annual Report demonstrates just a few of the many ways that
the Association ensures access to justice for all. Your generosity makes these

HUMAN RIGHTS
Justice Defenders Program
Retaliation against lawyers is one of the most severe threats to the
rule of law worldwide. Lawyers and other human rights defenders have
been threatened, imprisoned, and even killed for their efforts to hold
governments accountable and to realize the basic rights of their clients
and communities. In Swaziland, attorney Thulani Rudolf Maseko was
imprisoned in 2014 for publicly criticizing the lack of independence of
the judiciary in Africa’s last absolute monarchy.
The American Bar Association developed the Justice Defenders
Program to provide pro bono legal assistance to lawyers and other
human rights defenders, such as Mr. Maseko, facing retaliation for
their work. A unit of the ABA Center for Human Rights, the Program
mobilizes the global legal community to address critical rule of law
issues and hold governments accountable for restricting human rights
activities.
After Mr. Maseko was charged with contempt of court for his editorial,
he was remanded into custody and denied access to legal counsel. In
a closed proceeding, he was sentenced to two years in prison. The ABA
immediately issued a letter of concern over the violations of his rights
to freedom of expression and a fair trial. The Program then recruited
the global law firm Hogan Lovells to represent Mr. Maseko before the
United Nations Working Group on Arbitrary Detention, which found that
his detention was arbitrary and urged the Government of Swaziland to
release him immediately. On June 30, 2015, the Swazi Supreme Court
ordered his release from prison after conceding that they had no case
against him.
Over the last four years, the Justice Defenders Program has provided
similar pro bono legal assistance and strategic support to hundreds of
advocates, in 50 different countries. Today, through the efforts of the
Justice Defenders Program, Mr. Maseko has returned to his family and
practicing law.

WORKING GROUP ON UNACCOMPANIED
MINOR IMMIGRANTS
Recruiting Volunteers with a Purpose
The legal community was outraged when an Executive Office for Immigration
Review judge stated that children as young as 3-years-old could be taught
immigration law and be able to represent themselves in court. The ABA
responded by reaffirming its position that counsel – both pro bono and
government-funded – should be provided to unaccompanied children to help
navigate the complexities of the U.S. immigration system.
The American Bar Association has long worked to ensure access to counsel
for asylum applicants and other detainees – and for good reason. When
children and others are competently represented by counsel in adversarial
proceedings, all parties benefit. Legal representation serves not only the
clients, but also the efficiency of the courts, saving taxpayer dollars.
Over the past few years, tens of thousands of unaccompanied children have
entered the United States, often fleeing the extreme violence of El Salvador,
Honduras, or Guatemala. In response, the ABA amplified its existing efforts
by forming the Working Group on Unaccompanied Minor Immigrants.
Composed of lawyers from more than a dozen ABA entities, the Working
Group is recruiting, training, and mentoring lawyers to increase capacity and
complement the efforts of existing legal services programs.
To help attorneys respond to this humanitarian crisis, the Working Group
established www.ambar.org/ican to enroll volunteer attorneys to represent
unaccompanied children. Those who register are connected with a legal
service provider in their area that matches the volunteer with a child in need
of representation. If needed, the Working Group also finds the volunteer an
experienced mentor to collaborate with on the case.
Whatever their reason for coming to America, the ABA believes each child
deserves due process in our nation of laws. Through its Working Group,
nearly 250 pro bono attorneys have stepped forward to represent vulnerable
children in immigration and state courts across the country.

STANDING COMMITTEE ON LEGAL AID
AND INDIGENT DEFENSE
The Slow Justice Movement
Decades after Gideon v. Wainwright, “fast food” justice has taken
root in jurisdictions across the nation. Despite the promise of counsel
provided by the decision, generations of public defense attorneys
have been socialized to churn out cases at a rapid pace, with little
consideration for the client. Legal scholars and practitioners are now
speaking out against the assembly line model of justice, as it violates
attorneys’ ethical and constitutional duties.
The Slow Justice Movement is a nationwide intentional shift toward
ethical, quality representation. The ABA has long championed quality
representation through its Criminal Justice Standards, which extensively
detail defense counsel’s duties. But effective representation cannot be
achieved when lawyers have too many cases.
A recent ABA study of the Missouri Public Defender Office found that
attorneys spent, on average, 2.3 hours on each misdemeanor, but should
spend 11.7 hours in order to deliver reasonably effective assistance of
counsel. Few of the tasks outlined in the Criminal Justice Standards—
investigating the facts, researching the law, communicating with the
client, negotiating with prosecutors, filing appropriate motions—could be
completed in the time allotted, much less all of them.
In February, the ABA gathered over 100 public defense leaders and
scholars at its Annual Summit on Public Defense. A plenary session
called “ethical blindness” addressed the tension between quantity
and quality in public defenders’ offices, as well as attorneys’ failure to
recognize cursory representation. It also discussed innovative ideas to
ensure that their clients receive a fair trial, such as lowering caseloads
through decriminalization and using the private bar as a release valve
when caseloads are too high.
The ABA is working toward a slower, constitutional and ethical approach
to defense where quality precedes quantity. Your charitable support will

COMMISSION ON HOMELESSNESS
& POVERTY
International Summit on the Legal Needs of Street Youth
The U.N. Convention on the Rights of the Child stresses the inherent
liberties of all individuals, but rights are meaningless without the
mechanism to enforce them. For the staggering 150 million children –
ages 3 to 18 – living in homelessness around the world, sometimes the
mechanism needed is a lawyer.
Through global collaboration, and with the generous support of Baker
& McKenzie, the ABA Commission on Homelessness & Poverty held
the first International Summit on the Legal Needs of Street Youth in
June 2015. Hosted by the London office, the firm facilitated virtual
participation through its locations around the world. An impressive
number of experts from nearly every continent and almost 40 nations
gathered to discuss the legal rights of street youth and deliberate on
what the rule of law can do to end homelessness among this vulnerable
yet resilient population.
Former homeless youth, like Angel Benedicto from Tanzania, spoke at
the Summit. At the age of 16, Angel fled an arranged marriage and was
forced to the streets to later become a child domestic worker. Tearfully,
Angel described the grueling 17 hour days she was forced to bear.
“No one has an interest in helping domestic workers,” she told the
audience. “Nobody cares.”
Charitable giving made the powerful dialogue between experts and
survivors at the Summit possible. Domestically, the Commission
gathered representatives from federal agencies and community
organizations in January to further explore major themes that arose
from the event. Internationally, street children from around the world
are being encouraged to submit statements for consideration to the
UN Committee on the Right of the Child’s General Comment on
Children in Street Situations. Many of the Summit partners that
continue to work closely with the ABA, like the Consortium for Street
Children, will help these children get their voices heard.

Founded in 1942, the ABE is a charitable organization dedicated to
improving the quality of justice in the United States by funding research,
educational and public service projects in the field of law. ABA members
who participate in the Endowment’s group insurance programs can

LEGAL OPPORTUNITY
SCHOLARSHIP FUND
Diversity in the Profession
Racial and ethnic diversity in the legal profession simply will not
happen without engaging members of diverse backgrounds early
in their academic career. Financial aid during law school is a vital
component of diversifying the legal profession. The American Bar
Association responded to this need by creating the ABA Legal
Opportunity Scholarship Fund.
Established in 1999 by former ABA President William G. Paul,
the ABA Legal Opportunity Scholarship Fund provides $15,000
in financial assistance to 20 diverse law students each year and
helps encourage people from all segments of society to bring their
perspectives and potential to the legal profession.
Charitable giving helps ensure that attending law school is possible
for the ABA’s outstanding Legal Opportunity Scholars. Since its
inception, the ABA and its members have invested in the talents of
320 diverse students from across the country.

Doan Nguyen
Profile of a Scholar
At four-years-old, Doan and her family fled the tyranny of their homeland on a
small boat, floating 14 days on the Indian Ocean with no food or water. Doan
lost all five of her siblings on the treacherous journey. After being granted
asylum in the United States, Doan’s parents struggled to assimilate to life in
America. Desperately poor, not knowing any English and without friends or
relatives, her family scraped together a livelihood only to survive; affording
law school was an impossibility.
With financial assistance from the ABA Legal Opportunity Scholarship Fund,
Doan earned her law degree at the University of California, Berkeley. Today she
pursues justice for other immigrants through the Legal Services Trust Fund
Program of The State Bar of California.

JUSTICE FUNDS AND ENDOWMENTS
Justice Funds are named endowment funds established to honor those lawyers
whose careers have demonstrated dedication to the pursuit of justice and
outstanding service to the profession and the public. Justice Funds, or other
forms of endowments, provide the perfect opportunity to ensure a permanent
source of revenue for an ABA entity’s public service work.
A Justice Fund can be established with a commitment of $25,000 or more,
and the investment income earned is applied to the charitable programs of the
Association. If a Justice Fund reaches a threshold of $100,000 or more, the
annual endowment income may be designated to support a specific charitable
ABA activity.

In honor of its 75th Anniversary, the Section established the Tax Assistance
Public Service (TAPS) endowment to help ensure that its members can meet
the growing demand for legal representation of underserved taxpayers across
the country now and in the future. With a goal of raising $5 million, the
income earned from the endowment will support the Christine A. Brunswick
Public Service Fellowship program, among other public service programs.
Frank DiPietro is one of the 2015-2017 young tax attorneys funded by this
two-year fellowship to provide tax-related legal assistance to the underserved.
A recent graduate of the University of Minnesota Law School, Mr. DiPietro
is working for the University of Minnesota Law School’s Ronald M. Mankoff
Tax Clinic and the Center for New Americans, as well as providing support for
Mid-Minnesota Legal Aid and the Minnesota Assistance Council for Veterans.

Legal Visionary
Former ABA President William Reece Smith, Jr., was widely recognized for
his commitment to justice and his passion for pro bono service was a notable
legacy of his leadership term. Through a bequest of $25,000 directed to the
ABA Standing Committee on Pro Bono and Public Service, Mr. Smith will
continue to influence the delivery of legal services long after his passing.
In May, three lawyers from across the country will attend the 2016 Equal
Justice Conference in Chicago, Illinois, through the William Reece Smith,
Jr, Award. Awardees, like Shawndrica N. Simmons from the Black Women
Lawyers Association of Michigan, will receive a full conference waiver and
expenses paid up to $1,500. The conference helps pro bono and civil legal
aid attorneys maximize the pro bono delivery system.
