Income limits are expanded to $125,000 for individuals and $225,000 for joint filers. Households who have (40WA) binding contracts in place by April 30 will be allowed an additional 60 days to complete their transaction. The legislation places an $800,000 cap on the home sale price. The legislation was included in a broader bill to extend unemployment benefits. Thanks to all who responded to the Calls to Action to help get this through. The sooner, the better as there is Limited Seating…. 484-9426 MLS/COMPUTER COMMITTEE REPORT The MLS/Computer Committees met on Thursday, November 5, 2009. Present were: Rick McMahon, MLS Chair; Lory Anderson, Craig Butler, Sandy Haines, Donna Breen; Lynn Weaver, MLS Coordinator and Jan Murray, Executive Officer VORSTAR, SoftMLS Changes okayed @ $85.00/hour were: 1) CC and BCC when emailing property 2) Cloan a Listing 3) Mobile Home Message Board to be available to Public. Additional Request of 1) “DRI-VIT” to be added in descriptive codes as a siding choice 2) Attorney to replace “Owner Contact” in the listing input 3) on CMA and Prospect sheets – show average acreage 4) In Average/Median Report, add Sq Ft range, Bedroom #, and Acreage – and also have median DOM also/instead of average. CLOSED DATA IN DATA FEEDS A survey was put out to members asking their opinion of allowing closed data in the data feeds. 87 members responded. Of the 87 there were 66 (76.7%) against and 20 (23.3%) for allowing closed data to be displayed on IDX sites or the Public Side of the CCBRMLS site. The Committee, therefore, moved that no closed data will be allowed on the Public side or in data feeds at this time. Companies may display their own closed properties, but not other firms. To do so, would be a violation of the Board’s MLS Rules and Regs Section 18. REQUEST FOR MLS FEE RETURN for a member that the firm paid for and changed companies shortly after. The MLS Committee upheld the policy of no refunds of fees. They agreed that it is an internal issue with the firm. THE NEXT MEETING will be held December 3, 2009. Traylor 3 4 NYSAR issue alert - DOS photo identification card name requirement Implementation of the new Department of State (DOS) photo license cards has raised some concerns for those licensees who have different names registered with the DOS and the Department of Motor Vehicles (DMV). NYSAR has brought these concerns to DOS. While DOS is working to be flexible in some matters, it is clear that the law requires individuals to have one legal name, and that name must be identical on both the DOS and DMV licenses. If a licensee uses a distinctly different name, such as a nickname, on their real estate license and it does not match their DMV ID, the real estate ID may not be created. If a last name has been changed by marriage or any other reason, it should be changed with both the DMV and DOS. Real estate licensees can update their names with DOS by emailing [email protected] or by calling DOS at 518474-4429 and requesting a Change of Personal Name or Address card. The card should be completed and mailed to the address listed on the card with legal proof of the name change (a photocopy of the legal document is acceptable). NYSAR has been told that if a name is being changed with the DOS due to marriage and the supporting documentation is provided, the name change fee will be waived for the real estate license. Other name changes, with satisfactory proof, will incur a $10 fee for license reissuance. Real estate licensees are reminded that failure to advertise using the exact name on their DOS license may be a violation that is punishable by a fine, license suspension or both. According to the DOS Real Estate Advertising Guidelines of 6/24/94, “advertisements should state the exact name under which a license was issued. It is possible that the use of advertising of any other name might tend to mislead the public and not correctly identify the true advertiser. If abbreviations are necessary, a licensee should use their first initial, first and middle initials or nickname and last name.” On business cards, the individual’s full name, exactly as stated on the license, should be used. We have had our first batch of IBOXES for over 6 years now. The battery in the IBOX is likely to be getting low. Using your ActiveKey, scroll down to "release shackle", enter shackle code, press 2 for "no"(assigning box) and once shackle releases - it will show battery %. Start watching it at 40%... 15% or below - turn it in to your Office for them to exchange it for a new IBOX 5% ---- it will NOT open. (note: you cannot get the IBOX battery % unless you are the listing office with shackle code) ALSO…….. Sometimes the Active Key program gets stuck and the key needs to be reset. If your key is charged, yet won't turn on - you need to reset (1090666) the key. Using a large paperclip as your tool, on the back of the key - just below the serial # you will see a small hole. Insert the paperclip end & feel around for a small button that you can push in and out. If your key needs recharged - put it on the charger and you should be good to go. Supra suggests you do not let your key battery to run low. Put it on the charger nightly – or at least every couple days. The keys lock up and you’ll have to call Supra.
