In consideration of the rents and covenants hereinafter set out, the above-named Owner rents to the
above-named Occupant, to be used for storage only (unless otherwise permitted in writing by Owner),
the above Unit situate in the storage building on Owner’s premises in Simcoe Ontario, Canada.
Term
To have and to hold unto Occupant, subject to the conditions of this Lease, for the term beginning on

Rent
In consideration for the use and occupancy of the Unit, Occupant agrees to pay to Owner the sum of

Insurance
Customers store at their own risk, and are responsible to carry their own insurance.
I understand that the Owner is:
- A landlord renting space.
- Is not responsible for loss of or damage to my property.
- Does not provide insurance on my behalf.
Late Charges
3 Days: A $5.00 late charge is applied, the unit is overlocked, and a late letter is sent
15 Days: A $15.00 late charge is applied, and another letter is sent.
35 Days: A $15.00 late charge is applied, and another letter is sent.
45 Days: Your lock is cut, a $45.00 Bailiff charge is applied and a registered letter is sent notifying you of the
auction date.
Returned Cheques:
Returned (NSF) Cheques and Declined Credit Card payments will result in a $45.00 fee and unit will be
overlocked.
Terms & Conditions
As a further consideration for the use and occupancy of the Unit, the parties hereto agree to faithfully keep and be bound by
the following covenants, conditions and agreements:
(a) Occupant may place a lock on the access to the Unit, and Occupant shall have access to the Unit during normal
posted hours. After hours access can be arranged through the office. Owner shall not be responsible for acts of Occupant or
other persons entering the premises under Occupant’s authorization.
(b) This Unit shall not be used for unlawful purposes and shall be kept in good condition. No property shall be stored
in the Unit unless Occupant has the lawful right to have that property in his/her possession. Occupant may from time to time
place personal or commercial property in the Unit during the term of this agreement, and Owner is under no obligation to
maintain any records of such contents. The storage of welding equipment or flammable’s, explosives, firearms or other
inherently dangerous materials is prohibited. Occupant shall not store any items which shall be in violation of any order or
requirement as imposed by any health board, sanitary or police departments or governmental bodies, or do any act or cause
to be done any act which creates or may create a nuisance in or upon the premises during the term of this agreement.
Occupant will be held liable for any and all clean up, repair or replacement costs should this condition not be met.
(c) Occupant will NOT store any food products in the Unit. These will include but not limited to Spices, Flour, Sugar,
Condiments, Pasta or any other items which would attract pests. Occupant will be held liable for any and all clean up, repair
or replacement costs should this condition not be met.
(d) Occupant shall not (i) paint or decorate the Unit or mark, paint or decorate the Unit or mark, paint, cut, drill into,
drive nails or screws into, or in any way deface any part of the Unit or premises without written permission of Owner; (ii)
Make installation, alterations or additions to the premises; (iii) Assign this agreement; (iv) Erect signs advertising material; (v)
Operate any electrical device in the Unit without written permission of the Owner.
(e) Owner or Owner’s representatives shall have the right without notice to enter into and upon the Unit to examine
for lease violations or condition thereof or making repairs or alterations thereto. Owner may, if required, remove contents
from the Unit to another Unit.

(f) Owner carries no insurance that covers any loss whatsoever that Occupant may have in the Unit or premises.
Occupant must obtain any insurance desired at his/her expense. Owner shall not be liable to Occupant or Occupant’s
invitee’s, family, employees, agents, or servants for any personal injuries or damage to property or personal injury and costs
including attorney’s fees arising from Occupants use of the Unit or premises. Occupant must safeguard what is in the space.
(g) Time is of the essence. If any fee or charge shall be due and unpaid, or if Occupant shall fail or refuse to perform
any of the covenants, conditions or terms in this agreement, Occupant shall be deemed in default in the performance of this
agreement. In addition to remedies and liens provided by law to secure and collect fees, Owner is hereby given a lien upon
Occupant’s Property, now or at any time hereafter, stored in said Unit to secure the timely performance of this agreement by
Occupant. Owner may terminate this agreement re-enter, seize and take possession of said property for arrears of fees or
breach of covenant or by reason of abandonment, without being deemed guilty of any manner of trespassing or conversion,
and without prejudice to any remedies of Owner. At the time of such re-entry and seizure, Owner shall provide notice in
writing to Occupant. Such notice shall be by regular mail, shall be deemed received by Occupant when deposited in mail,
and at any time after THIRTY (30) days from the date of giving such notice, Owner may sell said property at public or private
sale. If proceeds of the sale are greater than necessary to pay lien, charges, appraisal, moving, storage, and expenses of
collection, the balance shall remain the property of the Owner. Occupant expressly grants the right of disposal and destruction
of any personal property including, but not limited to, all papers, pictures and documents.
(h) In case of holding over by Occupant after the expiration of any stated term, with or without written agreement,
such holding over will be construed to be a renewal from month-to-month.
(i) All terms of this agreement, charges and conditions of occupancy are subject to change, upon NINETY (90) days
prior written notice to Occupant. If changed, Occupant may terminate this agreement on the effective date of this change. If
Occupant does not elect to terminate this agreement, the change shall become effective and apply to this agreement.
(j) This agreement constitutes the sole and only agreement of the parties hereto and supersedes any prior
understanding or written or oral agreements between the parties respecting the within subject matter. No amendment or
alteration of the terms hereof shall be binding unless the same be in writing.
IN WITNESS WHERE OF the parties hereto have executed this Lease on the date first above written.
