Transfer of Land Acts and for other

in Victoria form or may form portions of the lands vested in
The Melbourne Harbor Trust Commissioners (hereinafter,
called the Coinniissioners) by the Melbourne Harbor Trust
Act 1915 for the purposes of that A c t : And Aviiereas The
Mount Lyell . Alining and Kailwaj7 Company Limited a
company incorporated and having its registered office in
Victoria (hereinafter called the Mount Lyell Company) is
registered as the proprietor of an estate in fee simple in the
laud described in the Fourth and Fifth. Schedules to this
A c t : And whereas The Vacuum Oil Company Proprietary Limited a company incorporated and having its
registered office in Victoria (hereinafter called the
Vacuum Oil Company) is registered as the proprietor of
an estate in fee simple in the land described in the Fighth
Schedule to this Act : And whereas Cuming Smith and
Company Proprietary Limited a company incorporated and
having its registered office in Victoria (hereinafter called
the Cuming Smith Company) is registeied as the
proprietor of art estate in fee simple in so much of the land
described in the Eleventh Schedule to this Act as is
comprised in certificates of title Volume 2401) Folium
481753 Volume 2409 Folium 481754 and Volume 2807
Folium o61245 entered in the Register Hook of the Office
of Titles in Victoria : And whereas the lands constituting
the street in the citv of Footscray known as Com benstreet set out on Crown land will not be required for the
purposes of a public highway when the land described in
Fh>t Ninth and Second Schedules to this Act have been
proclaimed public high ways in lieu thereof: And whereas
the council of the citv of Footscray has agreed to the
closing of Comben-street as aforesaid: And whereas it is
expedient that the land constituting Comben-street shall
cease to be a street and shall be vested as hereinafter
provided and that in lieu thereof the lands described in the
said First Ninth and Second Schedules shall as soon as
available for the purpose be dedicated to the public as
hidiwavs : And whereas doubts as to the correct lines of
demarcation between their several properties have arisen
between the Commissioners and the hereinbefore recited
companies and agreements have been entered into between
them for the adjustment of such lines of demarcation in the
manner hereinafter provided : He it therefore enacted by
the King's Most Excellent Majesty by and with the advice

and consent of the Legislative Council and the Legislative
Assembly of Victoria in this present Parliament assembled
and by the authority of the same as follows (that is to
say):-—

other conveyance or transfer than this Act
vested in the Commissioners freed and discharged
from any easements mortgages charges or liens
heretofore affecting the same respectively but
subject however to any rights or easements over
parts thereof granted or created by this Act.
(6) The Registrar of Titles is hereby authorized and
directed to indorse upon the certificates of
title for the lands described or referred to
in the said First Second Fifth Figlith

Twelfth

Thirteenth
Schedules to this Act or for any parts of the
said lands notifications that such lands or such
parts have become vested in the Commissioners
by virtue of this Act and that the easements
(if any) affecting the same have ceased to
operate thereover and to indorse similar
notifications imon the mortgages (if any)
affecting the same respectively and upon the
duplicates of such certificates of title and
mortgages (if any) which said duplicates
the person or persons having the custody of
the same are hereby required to produce to the
Registrar of Titles for the purposes of such
notifications.

(c) So far as may he necessary for tlie purpose of
carrying into effect the foregoing provisions of
this Act whereby such of the lands described
or referred to in the said First Second Hfth
Sixth Eighth Ninth Tenth Twelfth and
Thirteenth Schedules to this Act as are not
already vested in the Commissioners are
vested in the Commissioners the Registrar of
Titles is hereby authorized and directed to
cancel in such manner and to such extent as
the Commissioner of Titles directs any Crown
grant or certificate of title of any of such lands
and the registration thereof in the Office of
Titles and the duplicate of the said grants or
certificates which said duplicates the person or
persons having the custody of the same are
hereby required to produce to the Registrar of
Titles for the purposes of such cancellation.
3 . Notwithstanding anything in the Melbourne Harbor Vesting of
Trust Act 1915- the fee simple of the land described in the the MounWyeS
Third Sixth Fourteenth and Fifteenth Schedules to this iuiningyan
Act together with a right of carriage way over the land hSed!
described in the Fifth and Tenth Schedules to this Act shall N°-2594upon payment by the Mount Lyell Company to the Commissioners of the sum of Seven hundred and seventy-five
pounds become vested in the Mount Lyell Company
subject however to such rights for sewerage purposes
over the said land described in the Third Schedule to
this Act as may he required by the Melbourne and
Metropolitan Board of Works and the Vacuum Oil
< ompany or either of them and subject also as to
the land described in the Sixth Schedule to this
Act to the riffhts of the Southern Cross Motor Fuels
Company Limited under the lease thereof to it from the
Commissioners subsisting at the commencement of this Act
reserving; however to the Commissioners the rioht to use
the said land described in the said Fifth and Tenth
Schedules to this Act for railway purposes.

4 . Notwithstanding anything in the Melbourne Harbor Verting of
Trust Act 1915 and notwithstanding that the Mount gfvlcSS?011
Lyell Company is the registered proprietor under the Spffiry
Transfer of Land Acts of the lands described in the Fourth LlmltodSchedule

Schedule to this Act the fee simple of the land described in
the Fourth and Seventh Schedules to this Act together with
a right of carriage way over the land described in the
Thirteenth Schedule to iliis Act and together with the
right to use for sewerage purposes the land described in
the Third Schedule to this Act shall become vested in the
Vacuum Oil Company reserving however to the Commissinners the rii>ht to use the land described in the said
Thirteenth Schedule to this Act for railway purposes.
5 . Notwithstanding anything in the Melbourne Harbor
Singsmith Trust Act 1915 the fee simple of so much of the land

7 . Upon applications in writing being m a d e t o t h e
Registrar of Titles by t h e M o u n t 1/vell Company t h e
Vacuum Oil Company and the Cuming Smith Company
respectively under their respective common seals to be
registered as the respective registered proprietors of the
respective parcels of land vested in them respectively by
virtue of this Act with the respective rights or easements
hereby created in favour of such parcels of land respectively

and upon payment to the Registrar of Titles as a contribution
to the assurance fund under the Transfer of Land Acts of
a contribution at the rate of one half-penny in the pound
upon the value of the land so vested in the said respective
companies as aforesaid and upon payment to the Registrar
of Titles of the prescribed fees for new certificates of title
in relation thereto respectively and upon payment in the
case of the Mount Lyell Company to the Comptroller of
Stamps of stamp duty as on a sale in respect of the sum of
Seven hundred and seventy-five pounds in relation to the
land in the said Third Schedule to this Act the said
Registrar of Titles shall :—
(a) issue in the name of the Mount Lyell Company a
certificate of title or certificates of title in
respect of the land described in the said Third
Sixth Fourteenth and Fifteenth Schedules
to this Act together with an easement of
carriage way over (but subject as to such
easement of carriage way to the diverse right
in favour of the Commissioners reserved by this
Act) the land described in the said Fifth and
Tenth Schedules to this Act :
(b) issue in the name of the Vacuum Oil Company a
certificate of title or certificates of title in
respect of the land described in the Fourth and
Seventh Schedules to this Act together with
an easement of carriage way over (but subject
as to such easement of carriage way to the
diverse right in favour of the Commissioners
reserved bv this Act) the land described in the
Thirteenth Schedule to this Act and together
with the right to use for sewerage purposes the
land described in the Third Schedule to this
Act ; and
(c) issue in the name of the Cuming Smith Company
a certificate of title or certificates of title in
respect of the land described in the Eleventh
Schedule to this Act together with an easement
of carriage way over (but subject as to such
easement of carriage way to the diverse right in
favour of the said Commissioners thereover
reserved by this Act) the land described in the
Twelth Schedule to this Act.
