INSTRUCTION TO TENDERERS
Sealed tenders are invited by the General Manager, Tamil Nadu Minerals Limited, 31,
Kamarajar Salai, Chepauk, Chennai - 600 005 for the sale of black and colour dimensional granite
blocks from various quarries of TAMIN.
CONDITIONS:
1(a) Eligibility to participate:
i.
Buyers from Foreign Countries
ii.
100% Export Oriented Units having a minimum turnover of Rs.1.00 crore (Rupees one
crore only) per year during three preceding financial years prior to the year in which this
tender is floated
iii.
Granite factories having a minimum turnover of Rs.1.00 crore (Rupees one crore only)
per year during three preceding financial years prior to the year in which this tender is
floated.
iv.
Exporters having a minimum turnover of Rs.1.00 crore (Rupees one crore only) per year
during three preceding financial years prior to the year in which this tender is floated.
v.
Proof of having factory, either SSI certificate or other document and in case of 100%
EOUs., letter of permission indicating commencement of production, Green card and in
case of Exporters RBI code number or Import and Export Code Number etc., should be
furnished along with the tender.
vi.
Authorized and paid up capital of the Company and Audited annual accounts of the three
preceding years of the tender should be enclosed with Cover-I, as proof of minimum
turnover of Rs.1.00 crore (Rupees one crore only) in respect of tenderers ii, iii and iv
above.
FOREIGN BUYERS:
vii.
The foreign Buyers shall be allotted entire quantity of dimensional granite blocks produced
in the quarries quoted for, every month, in a sustained manner and shall provide assurance
for the same in column 12 of the Annexure - 2 of the Tender.

INLAND BUYERS:
viii.
The Inland buyers should have the financial and commercial capability to lift 30 percent of
the quantity of dimensional granite blocks produced in the quarries quoted for, every
month, in a sustained manner and shall provide assurance for the same in column - 12 of
the Annexure - 2 of the Tender and allotment is restricted to 30%. Managing Director,
TAMIN reserves the right to enhance the percentage of quantity to be lifted by successful
tenderer.
ix.
TAMIN reserves its right to debar or black list both the Foreign and Inland tenderers from
competing in future offers, tenders, or contracts or negotiations either on by their name or
through any third parties, if earlier transaction is found not to the satisfaction of TAMIN or
found to be prejudicial to the general interest of TAMIN.
1(b). The following categories will not be eligible to participate in the tender:
i.
Buyers who came to adverse notice in dealing with TAMIN either as buyer, Raising agent
or Raising-cum- Sales Agent or in any other capacity
ii.
Buyers who are defaulters in any of the earlier tenders.
iii.
Those who have indulged in malfeasance during the course of their business transactions
with TAMIN.
iv.
Quarry operators of adjoining quarries of similar / same varieties within the radius of 1000
meters
v.
Inland Buyers who can not produce sufficient proof to establish financial and commercial
capabilities to lift 30 percent of the quantity of the material produced in the quarry quoted
for and who do not provide assurance as required under 1(a) viii above.
vi.
Buyers / Parties / Firms / Persons owing any dues to TAMIN as on 30.06.2015. If they
cleared the dues before participation in tender, evidence to be enclosed.
2. Location of quarries.
The details of locations of the quarries and quantity offered for sale, distance to the nearest
district headquarters/town and distance to Chennai Port by road are furnished in the Annexure-1.
3. Specimens of samples:
The polished samples of the areas offered for sale are displayed for perusal and collection at
the Registered office of TAMIL NADU MINERALS LIMITED, at 31, Kamarajar Salai, Chepauk,
Chennai - 600 005 on any working days during working hours.

4. Tender Submission:
i.
The tender document purchased or down loaded by a tenderer is not transferable.
ii.
Tenders should be submitted in a sealed cover superscribed "TENDER FOR THE SALE
OF BLACK AND COLOUR DIMENSIONAL GRANITE BLOCKS FROM
CERTAIN QUARRIES OF TAMIN" and sent by Registered post or by special
messenger so as to reach Tamil Nadu Minerals Limited, 31 Kamarajar Salai, Chepauk,
Chennai - 600 005 on or before 02.00 P.M. on 14.8.2015.
5. Delays in Transit:
Tender documents received after the due date and time either by post or by courier or by hand
delivery or by any other mode, shall not be accepted by TAMIN. TAMIN cannot be held responsible
for any delay in transit for delivery of the tender documents.
6. Tender Opening:
The tenders will be opened at the Registered Office of the Corporation by the authorised
Committee by the tender accepting authority in the presence of the Tenderers or their authorized
representatives, if any as noted below:
Cover-I: Containing the E.M.D. for each quarry as per the Serial Number mentioned in the
Annexure – 1 and other details will be opened at 03.00 P.M. on 14.8.2015.
Cover-II: The date and time of opening of Cover II (Price Bid) will be communicated to the
qualified tenderers by Post / Fax / E-Mail. For further details please refer clause 13 (A).
7. Formats:
All the tenders (Price Bid) should be submitted in the prescribed form only Annexure – 3
(Cover II). The status of the tenderer should also be furnished in the Proforma available in Annexure2 (Cover I).
8. Quotations:
i.
The Foreign tenderers are requested to quote FOB Chennai rates in U.S. Dollars. Those
who quote in U.S.Dollars should pay only in U.S.Dollars
ii.
The Inland tenderers have to quote Ex-quarry rate in Indian Rupees only.
iii.
Sizes of black and colour dimensional granite blocks are furnished in clause 11.
Quotations shall specify the amount both in figures and words and rates shall not be
altered. If there is a difference in rate offered in figure and words, whichever is higher will
be taken as offered rate. The tenderer can quote separate rates for different sizes of
dimensional granite blocks as in Annexure 1 without insisting percentage of any specific
size of dimensional granite blocks .
iv.
There is only single quality for all the quarries as specifically called for in the Annexure-1.

9. Period of Agreement:
The successful tenderer will enter into an agreement with TAMIN within 30 days of sale award
of the tender and also the Security Deposit amount to be remitted within the above period. The period
of validity of the agreement under normal circumstances will be one year. TAMIN reserves the right
to extend the period of validity of the agreement for further period of three months at the end of one
year as per the provision of The Tamil Nadu Transparency in Tenders Act, 1998.
10. Quantity to be supplied:
i.
The approximate quantity of black and colour dimensional granite blocks for sale is
indicated against the quarries in column 9 of Annexure - 1 of the document.
ii.
Supply will be made by TAMIN to the successful tenderer during the period as mentioned
in clause 9 or till the date of supply of the quantity specifically mentioned in the tender
document, whichever is earlier.
iii.
The successful Inland buyers will be supplied 30 percentage of the quantity of material
produced from the quarries and the balance 70 percentage will be earmarked for foreign
buyers at the accepted tender price equivalent Ex-Quarry in US Dollar plus FOB charges
Chennai Port and will be supplied on first come first served basis. If there is no request
from foreign buyers, 70% of the quantity will be supplied to Inland tender buyers and then
to other interested inland buyers on spot order basis.
11. Specification:
TAMIN will supply dimensional granite blocks from quarry as detailed below:
A. BLACK AND COLOUR GRANITE:
Monumental sizes (Black granite blocks from the quarries ):
Blocks having a net volume of less than 0.250 cbm.
Random sizes (Both black and colour granite quarries ):
a. Blocks having a net volume of 0.250 cbm to 0.499 cbm
b. Blocks having a net volume of 0.500 –1.499 cbm
c. Blocks having a net volume of 1.500 cbm & Up
(Excluding)
d. 200 x 100 cm & up but below 280 x 180 cm (GROSS) (Medium size)
e. 280 x 180 cm & up (GROSS) (Super size)
* Separate rates to be quoted for each volume from quarry.
B. FREE ALLOWANCE.
Up to 5 cm will be allowed on all three dimensions.

C. Seigniorage Fee:
The free allowance in measurement as fixed by TAMIN only shall be provided in each
dimension of the blocks. However, the tenderer has to bear the actual seigniorage fee paid for the
blocks to the permit issuing authorities. The way permits will be obtained from the authorities by
TAMIN and issued to the tenderer for the transport of blocks. In the case of foreign buyers, payment
and advance payment for seigniorage fee will be made by them by means of FIRC remittance of
foreign currency in US Dollar. The advance payment for seigniorage fee will be verified for each
approval list and balance if any will be collected from the buyers.
12. Payment :
i.
a. The successful tenderer shall be permitted to select the blocks available from the quarry
without any marking on the blocks and remit the cost of such blocks plus Seigniorage fee,
VAT/CST, loading charges etc., as applicable as and when required. If the amount is not
remitted within one week from the date of intimation letter / Proforma, TAMIN reserves the
right to sell the material to any interested buyers on Adhoc / Spot basis. Any one of the
following modes of remittances may be adopted.
1. FIRC (Foreign Inward Remittance Certificate) / T.T. (Telegraphic Transfer).
2. RTGS / NEFT
3. Demand Draft drawn in favour of Tamil Nadu Minerals Limited, Chennai payable
at Chennai on any Scheduled Bank.
b. Advance seigniorage fee will be verified for each approval list and balance if any, the buyer is
liable to remit the same immediately. This seigniorage fee will be included along with the
price and will not be separately exhibited in the Export Invoice.
c. The buyer shall arrange to remove the blocks as in Clause 16 (b). However, TAMIN reserves
its right to stipulate / restrict time limit as and when required. For exports, TAMIN shall
arrange for dispatch of blocks to the port.
ii. No complaint of any nature can be entertained after the selection of Blocks by the buyer
and such blocks are at the risk of the buyer.
iii. Performance Guarantee:
a. The successful tenderers shall furnish performance guarantee in the form of irrevocable bank
guarantee from any nationalized bank branch in Chennai for value of 5% of the total value of
the contract within 30 days from the date of sale award. It shall be in force for a period of 18
months (Format is given in Annexure - 4). In case of breach of the contract or conditions
thereof or failure to lift the blocks finalised in the tender, the bank guarantee furnished by the
buyer shall be invoked by TAMIN and no claim on the same shall be entertained by TAMIN.
b. In case of failure to lift the assured quantity by the tender buyer, the quantity will be sold to
interested buyers as in Clause 10 iii.
c. In case of buyers quoting in U.S.$, the value of the bank guarantee shall be worked out based
on the exchange rate prevailing on the date of tender opening. (Price bid).

iv. Adhoc / Spot Buyer:
a. A sum of Rs.2,00,000/- (Rupees Two lakhs only) to be deposited for each transaction for
marking material (Dimensional Granite blocks ).
b. If the parties, who participated in the tender are supplied for an area in US $, the rupee
equivalent will be determined at the rate prevailing on the date of price bid opening and this
will prevail during the currency of the tender period.
c. In case of parties who do not participate in the tender and who are fixed as spot buyers, the rate
in US $ will be converted into rupee at the RBI Ex-change rate prevailing on the date of fixing
spot buyers or the rate arrived as in 12 iv (b) whichever is higher.
d. The adhoc / spot buyer should remit the payment for the quantity intended to Purchase as
indicated in Clause No.12 (i)
13. A. Quotation-Two Cover System:
The tender should be submitted in 2 Cover System viz.
Cover-I: Technical Bid: It shall contain
a. E.M.D. of Rs.1,00,000/- (Rupees One lakh only) / equivalent in US Dollar by foreign buyer
per quarry as per the serial number mentioned in the Annexure 1 by Demand Draft drawn on
any Scheduled Banks in favour of “Tamil Nadu Minerals Limited, Chennai 600 005” payable
at Chennai.
In Annexure-1 each serial number will be considered as one quarry and the tenderer should
remit Rs.1,00,000/- / equivalent in US Dollar by foreign buyer towards EMD for each Serial
number.
b. In case, the tender document is downloaded through our website, it should be accompanied by
a Demand Draft of Rs.2,000/ (Rupees Two thousand only) / equivalent in US Dollar by foreign
buyer -(Non-refundable) towards the cost of tender document drawn on any Scheduled Banks
in favour of “Tamil Nadu Minerals Limited, Chennai 600 005” payable at Chennai.
c. Audited Account of three preceding years of tender. (As indicated in Annexure-2)
d. Status proof – SSI Certificate, 100% EOU certificate, proof of having Factory, Proof of having
Export and Import code Number, etc., as stated in 1(a) (v).
e. Undertaking to the effect that the firm/buyer do not fit into any of the categories mentioned in
para 1(b)
f. Consent letter to furnish performance guarantee by way of bank guarantee as mentioned in
12(iii).
g. Proof of established clientele, financial soundness, ownership / lease of factories, warehouses,
stockyard etc.
h. Annexure – 2 (Background of the Tenderer) duly signed in the prescribed format

i. A Separate sheet indicating the name of the quarries for which E.M.D. is furnished.
Cover-I should be superscribed “Cover I- Technical bid” on the face of the cover and sealed.
This will be opened first. The tenderer should specifically mention the quarry’s name with
serial number as mentioned in the Annexure 1 for which EMD remitted.
Cover II: Price Bid –
a. The price / rate quotation in Annexure – 3 may be done for one quarry in each sheet.
b. The price quotation for each quarry may be put into separate envelopes and sealed and
superscribed with the name of the quarry for which rate quoted.
c. All the individual envelopes should be submitted in one common sealed cover superscribed as
Cover II – Price / Rate quotation on the face of the Cover.
d. (i) This Cover-II will be opened only if the tenderer is qualified to execute the Tender as per
Cover - I (Technical Bid). The individual envelope of each quarry will be opened only if the
tenderer is found qualified for the respective quarry.
(ii) Covers I & II both sealed separately should be put in a common cover sealed and dropped
in the tender box
(iii) If the tenderer fails to comply with the above conditions, their offers will be totally
rejected.
B. Earnest Money Deposit:
i.
Every tender must be accompanied by a deposit of Rs.1,00,000/- (Rupees One
lakh only) / equivalent in US Dollar by foreign buyer to be specified as Earnest
Money Deposit per Quarry by way of Demand Draft. Each serial number will be
considered as one quarry as mentioned in the Annexure – 1.
ii.
Demand Draft towards EMD must be drawn on any Scheduled Bank in favour of
“TAMIL NADU MINERALS LIMITED, CHENNAI 600 005” payable at Chennai.
iii.
The tenders received without EMD will be summarily rejected.
iv.
The E.M.D. of the unsuccessful tenderers will be arranged to be refunded within a
reasonable time, consistent with the rules and regulations of the Company and will
bear no interest thereon till date of refund.
v.
The EMD will be forfeited if the tenderers subsequent to the sale award fail to
furnish the Performance Guarantee in the form of Bank Guarantee or remit the
Security Deposit within the stipulated period. This is without prejudice to other
rights that are available
vi.
The EMD amount of successful tenderer will be adjusted against the Security
Deposit if they satisfy all other above conditions.

vii.
The EMD will be forfeited if the party does not respond to the call for negotiation
of rates etc.
14. Security Deposit:
The successful tenderer should pay a sum of Rs.5,00,000/- (Rupees Five lakhs only) as
Security Deposit for each quarry in the form of Demand Draft drawn on any scheduled bank in
favour of TAMIL NADU MINERALS LIMITED, payable at Chennai and execute an agreement in
prescribed Form towards the fulfillment of this contract within 30 days from the date of Sale Award.
TAMIN reserves the right to cancel the sale award or allot the material to other parties if the Security
Deposit is not deposited and the agreement is not executed, within 30 days period. The Security
Deposit will not bear any interest. In case of breach of contract, the Security Deposit will be forfeited
to TAMIN. After successful completion of the contract the Security Deposit will be refunded. If the
successful tenderer drags TAMIN for any litigation, the expenses incurred would be deducted from
this amount.
15. Inspection of materials:
a. The Successful tenderers shall make their own arrangements at their own cost to inspect the
materials at quarries and any rejection of the materials shall be effected at the quarry itself.
The inspecting authority shall make sufficient indication on all three sides of the materials in
proof of inspection after making payment as in clause 12. In case of any dispute that may arise
with regard to colour, cracks, mineral segregation etc. in the blocks, the decision of the Tender
Accepting Authority shall be final
b. Tenderers shall visit the quarry of interest and assess the quarries and quote with reference to
the quarry materials and it is binding on the tenderers. Claim on colour variation will not be
accepted subsequently as a cause for rejections.
16. Shipment / Delivery:
a. In respect of Export sales shipment will be made by regular Liner Vessels or Chartered vessels.
Booking and reserving of required shipping space for materials will be done by TAMIN.
TAMIN shall inform the successful tenderer the details of shipment after despatch of Cargo,
extension of shipping period up to three months or more as required by TAMIN shall be
allowed. Freight Insurance shall be made by the buyer to cover against any loss or damage in
transit.
b. In respect of Inland sales, loading and transportation of approved Blocks from quarry site
should be arranged by Inland buyers. If loading of blocks required, a sum of Rs.1,000/- per M3
for A.D. measurement is being collected as loading charges. In case, the blocks are not
removed from the quarry site within 20 days from the date of permit, the demurrage charge at
Rs.100/- per day per block will be charged for the first 15 days and there after Rs.200/- per
day per block will be charged for next 15 days. If there is no response even after the
completion of the above days, the dispatch order will be cancelled and amount remitted for sale
will be forfeited. TAMIN shall not be made responsible for any damage or loss of the blocks
beyond the above period.
17. Force Majeure Clause:
Delivery is agreed upon in good faith and TAMIN shall not be liable for damage or otherwise
for failure to carry out the obligation which may be occasioned by ACT OF GOD, war, civil

disturbances, Disorders, strikes for want of Labour, Act or Regulations of Government Authorities or
Agencies, the rulings by the Judicial authorities or similar circumstances beyond their control.
18. Arbitration:
Any dispute or difference whatsoever arising between the parties out of or relating to the
construction meaning and operation or effect of this contract or the breach thereof shall be settled by
Arbitration, if both parties agree for in accordance with the Arbitration and Conciliation Act, 1996 and
the Award made in pursuance thereof shall be binding on the parties. The venue of Arbitration shall be
Chennai and the language is English
19. Court Jurisdiction:
The courts situated within Chennai alone shall have jurisdiction to decide all disputes and
claims that may arise between the parties.
20. Assignment:
The Contract is not assignable on either side
21. Insurance:
It shall be the responsibility of the successful foreign tenderer once the materials are put on
board the vessel to insure the materials as the rates are accepted on F.O.B. Chennai .
22. Criteria for considering the Tender offers:
The tender will be decided based on: i.

Quantity proposed to be purchased vide Tender condition 1(a) vii & viii.
Past business relationship with TAMIN.
Market presence of the buyer for the particular variety quoted by him.
Rate in U.S. $ for direct export by TAMIN
Offer by 100% Export Oriented Granite Units, S.S.I. units, granite Factories and Exporters.
Third Party Export (Export benefit to TAMIN)
23. Discretion:
a. (i) TAMIN reserves the right to sell part of its products to others also, in the manner, as it
likes to the advantage of the Company
(ii) In the event of conflict of interest resulting in short supply of assured quantity of
production by a raising agent of a particular quarry, TAMIN reserves the right to provide
substitute material to the buyer. The decision will be taken on a case-to-case basis on
merits.
b. TAMIN shall have the right to divert part / whole of the produced blocks at any time
during the currency of the contract irrespective of the size specifications, to its cutting and
polishing unit, "TAMIN GRANITES" at Manali or “TAMIN GRANITES Tile Plant”, at
Madhepalli or TAMIN Granites Plant, Melur for processing and selling to any buyer or to
Direct Export.

c. The tender accepting authority, Tamil Nadu Minerals Limited reserves the right of
rejection of all or to any of the tenders without assigning any reason thereof or split up the
tender as he deems fit.
d. The tender accepting authority, TAMIN reserves the right to cancel the bid even after
acceptance or during performance of the contract.
e. The tender accepting authority reserves the right to alter/modify any of the above tender
conditions before the award of the contract in the interest of the Corporation
f. TAMIN reserves the right to insist the successful tenderer to take other size blocks (other
than sale award issued ) in order to achieve sales turn over.
24. General
a. In the event of any dispute between TAMIN and the successful tenderer, TAMIN reserves its
right to stop the supply irrespective of the quantity so far supplied and the matter would be
referred to the Indian Arbitration Council and during the said dispute the successful tenderer
has no right for the specific performance of the contract nor he will be entitled for any
damages or any action against TAMIN. The successful tenderer specifically agrees that in
respect of any dispute arising out of this contract, he will not pray for any interim order or
restraint order against TAMIN in any judicial forum.
b. If the successful tenderer has got any trade representative, the said representative will be
utilized only for the purpose of trading activity and NOT as the representative of the successful
tenderer in the arbitration proceedings or in the court proceedings or in respect of any matter
other than the act of mere representative in the inspection of materials and other allied subjects
and the said agent will not have any right to represent the tenderer either to commence or to
continue or to participate in any dispute or litigation that may arise between the tenderer and
TAMIN.
c. The agreement on Non-Judicial stamp paper to a value of not less than Rs. 50/- incorporating
the above conditions has to be executed by the successful tenderers or authorized person with
passport size photo and proof of identity such ration card / pan card etc., with power of
attorney duly notarized with two witnesses to execute the agreement within 15 days from the
date of sale award issued. The draft agreement will be prepared by TAMIN and sent separately
after finalization of tender.
