To provide background information and a summary of public submissions to the hearings panel and submitters prior to the hearing on granting leases for: Counties Manukau Off Road Racing Club, Kartsport Manukau, Papakura City BMX Club, Auckland Radio Controlled Car Club, and Main Jet Events (motocross); and granting a licence to occupy for Coggan and Williams Limited (family jet sprint) at Colin Dale Park. 2. The scope of the report is to provide information on the six motorsport leases/licence to occupy arrangements, to assist the Hearings Panel in making recommendations to the OtaraPapatoetoe Local Board on the granting of these agreements. Executive summary 3. Colin Dale Park is a 57.6 hectare reserve acquired by council in 2003 to initially accommodate the Rally of New Zealand. It also has a broader purpose to promote motorsports as a legitimate recreational activity, and to establish quality facilities for a range of family entertainment, safe participation for young people and for commercial attractions. The location was also chosen as it was away from residential areas. 4. There have been numerous non-statutory concept plans prepared by council with a focus on the motorsport portion of the site (the two relevant ones being 2006 and 2013). There has also been a plan change (PC19) supporting a wide range of motorsport activities (amongst other activities), which became effective in November 2007. 5. The portion of Colin Dale Park subject to this hearing, is classified as recreation reserve. This requires provisions of the Reserves Act to be adhered to, and approval from council and the delegated Minister prior to any proposed use, development or occupancy of the reserve. 6. Originally the six motorsport user groups were given site allocation in 2010. To formalise this the Otara-Papatoetoe Local Board publicly advertised the intent to grant six motorsport leases/licence to occupy at Colin Dale Park on the 6th May 2014, and sought submissions from the public. The submission period closed on the 6th June 2014 and 89 submissions have been received (including 2 late submissions). There are 85 submissions in support (some subject to conditions), and four submissions in opposition (one in part), with 13 submitters confirming they wish to be heard. 7. Consultation with mana whenua groups has been ongoing throughout the process of developing Colin Dale Park. Consultation specifically on the proposed six motorsport groups and their leases/licence to occupy arrangements commenced in early 2014. Three formal responses have been received from Ngati Te Ata who opposes in part, and Te Aakitai Waiohua and Ngati Tamaoho who oppose the proposed leases/licence to occupy at this point in time. That the Hearings Panel: a) Considers the public submissions in relation to the intent to grant five leases and a licence to occupy, including the submission summary and discussion tables of this report. b) Considers the two late submissions (submissions 88 and 89) with all other submissions received for motorsport leases/licence to occupy. c) Make recommendations to the Otara-Papatoetoe Local Board on the granting of leases for Counties Manukau Off Road Racing Club, Kartsport Manukau, Papakura City BMX Club, Auckland Radio Controlled Car Club, and Main Jet Events (motocross); and licence to occupy for Coggan and Williams Ltd (family jet sprint) at Colin Dale Park. Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 5 Comments 1) COLIN DALE PARK A. Site description and surrounding land uses 9. Colin Dale Park is a 57.6 hectare site located at 87 Prices Road, Puhinui. Prices Road is a no exit road located off SH20B Puhinui Road. There is a sealed driveway off Prices Road providing access to this site. 10. At present the site currently operates as a rural farming pastoral lot, with grazing cattle. Formerly it was utilised for agricultural purposes. 11. There are rows of pine trees lined across the site, acting as shelter belts to the prevailing westerly winds. The topography of the site is generally undulating with a number of gullies and ridges falling towards the watercourse along the northern boundary. There is a volcanic crater referred to as “pond crater” which sits in the centre of a well-preserved tuff cone located near the entrance of Puhinui Reserve (on the south-eastern boundary of this site) which is partially within Colin Dale Park. These features were assessed by Bruce Hayward (April 2012) to be of “national significance” (see Attachment J for values reports). 12. The site abuts the Manukau Harbour to the west, a small inlet and stream along the northern boundary. The southern and eastern boundaries abut Puhinui Reserve (199 hectare reserve), with clear sightlines to Matukutureia Maunga (McLaughlin’s Mountain). 13. There are seven dwellings within the peninsula south of Puhinui Road, with the land predominantly being utilised for farming purposes, and/or market gardening/orchards. B. Background to acquisition of Colin Dale Park 14. After numerous approaches to council that the needs of motorsport enthusiasts and members were not being met, council sought to acquire a parcel of land that accommodated those needs. 15. As a result, Colin Dale Park was acquired by council in 2003 and was to initially accommodate the Rally of New Zealand. More broadly the site was to promote motorsports as a legitimate recreational activity, and to establish quality facilities for a range of family entertainment, safe participation for young people and for commercial attractions. The location was chosen for these activities as it was away from highly populated residential areas, bound by the sea, as well as being in the direct flight path of the Auckland International Airport. These characteristics indicated that this is the ideal location for motorsport activities to occur within the region. C. Legal status 16. The eastern portion of the park (the area these leases/licences are subject to) is held as a classified recreation reserve under section 17 of the Reserves Act 1977 (the Act). The Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 6 western portion of the park (which is not subject to these leases) is classified under the Act as local purpose (marae/community buildings); and local purpose (esplanade). See Attachment A for certificate of title and aerial plans. 17. Broadly, recreation reserves are for the purposes of providing areas for recreation and sporting activities, and the physical welfare and enjoyment of the public, with an emphasis on the retention of open spaces and on outdoor recreational activities. 18. The primary objectives of management are to – • Allow the public freedom of entry and access subject to such conditions as are necessary for the protection and well-being of the reserve and for the protection and control of the public using it • Conserve those qualities which contribute to the pleasantness, harmony and cohesion of the natural environment, and to the better use and enjoyment of the reserve. 19. A secondary objective is to manage and protect (to the extent compatible with the primary purpose of the reserve) the scenic, historic, archaeological or other natural features of the reserve, including indigenous flora or fauna. 20. The administering body is charged with the duty of administering, managing and controlling the reserve to ensure its use, enjoyment, maintenance, protection, and preservation for the purposes of its classification, as the case may require and within the means at its disposal (under s41(1) of the Act). D. Background to motorsport leases/concept plan 21. The Colin Dale Park project’s purpose is to develop a motorsport facility within the OtaraPapatoetoe Local Board area. 22. To commence design and development of the motorsport portion of the site, a nonstatutory concept plan for Colin Dale Park was initially drafted in 2006 with interested motorsport parties, highlighting the potential layout of activities on the reserve (see Attachment B for concept plans). This concept plan was also utilised as background information to support Plan Change 19 (see below for details on the plan change). 23. Subsequently, council requested further “expressions of interest” in September 2009, and in April 2010 council determined the six potential user groups who best complimented the initial concept design and purpose of Colin Dale Park. Site allocation was then given in principle to the six groups (see Expressions of Interest and resolutions in Attachment C). In addition, the Otara-Papatoetoe Local Board has also signalled its desire to work with these motorsport groups. The Parks Sport and Recreation Department has collaboratively developed indicative lease areas and resource consents to progress the development of the site for motorsport activities. 24. An updated concept plan was developed in 2013. The key amendments to the 2006 concept plan, included: Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 7 • • • the withdrawal of Speedway from the park development; requests from Ngati Te Ata to shift the Motocross track further away from the future marae site; and Confirming the extent of the volcanic cone, requiring the relocation of the Auckland Radio Controlled Car Club. 25. On the 28th April 2013, at the Otara-Papatoetoe business meeting this concept plan was endorsed (see Attachment B for latest concept plan and resolution OP/2014/49). 26. The activities/facilities of the proposed motorsport user groups are set out in the table below (and further background details in Attachment D). Table 1. To formalise the intent to grant leases/licence to occupy the motorsport groups, consultation with mana whenua and the public is required to meet the terms of the Act and the Conservation Act 1987. 28. Consultation with mana whenua groups has been ongoing throughout the process of development for Colin Dale Park. Consultation specifically on the proposed six motorsport groups and their leases/licence to occupy arrangements commenced in early-mid 2014, with one-on-one meetings, a collective meeting in May, and one-on-one meetings related to submissions received. 29. Of the ten mana whenua contacted in relation to the lease process, three mana whenua representatives have been involved in dialogue with council and have submitted on the leases/licence to occupy - Ngati Te Ata; Te Aakitai and Ngati Tamaoho. Ngati Maru and Ngai Tai ki Tamaki responded, and agreed they will delegate this matter to other mana whenua kaitiaki representatives. 30. On 28th April 2014 at the Otara-Papatoetoe Local Board business meeting, approval was given to publicly advertise for submissions on the proposed motorsport Agreements to Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 9 Lease, and subsequent Leases/licence to occupy on a portion of Colin Dale Park (see resolution OP/2014/50 and notifications in Attachment E). 31. Information packs were sent to mana whenua on 17th April 2014, and key stakeholders on the 8th May and 13th May 2014, outlining the specifics of the proposed leases/licence to occupy (see Attachment F for letter(s) and list of key stakeholders/mana whenua groups). 32. Public notification (seeking submissions) of council’s intention to issue 5 agreements to lease and a licence to occupy upon Colin Dale Park was notified on 6th May 2014. The submission period closed on 6 June 2014, and 89 submissions have been received (including 2 late submissions). In general, there are 85 submissions in support (some subject to conditions) and four submissions in opposition (one in part), with 13 submitters confirming they wish to be heard. A summary of submissions is provided in Attachment G, along with full submissions in Attachment P. 33. Three formal responses have been received from mana whenua: Ngati Te Ata (submitter 61) who oppose in part, Te Aakitai Waiohua (submitter 82) and Ngati Tamaoho (submitter 63) who oppose the proposed leases/licence to occupy at this point in time. The other opposition received was from a neighbour, John Cooney (submitter 80). 34. Upon receiving submissions, council officers have been engaging with a number of key stakeholders in this process. Council has a responsibility to manage relationships with key stakeholders and is working with submitters who have indicated that they have concerns they wish discussed, or have opposed the development. A brief summary of recent engagement in this process with the following key stakeholders will be provided (and tabled) at the hearing: i. ii. iii. iv. v. vi. vii. viii. ix. In addition, the proposed motorsport user groups have been kept updated regularly through a fortnightly/monthly meeting led by Auckland Council, Sport and Recreation Advisor. F. Land owner approval/lease agreements 36. If the hearings panel recommends that the leases be granted and the local board accepts the recommendation, formal land owner approval with agreements to lease for each of the motorsport groups will need to be endorsed by the Otara-Papatoetoe Local Board, prior to obtaining consent of the Minister of Conservation or delegate. Subject to local board approval, it is proposed to establish a Colin Dale Park Management Committee, with each motorsport user group being required under the terms of their lease to have an appointed representative on this Committee. The committee will be an advisory group that will advise the Manager, Local and Sports Parks South (or delegate). It will involve both council and external stakeholders. The terms of reference and membership is yet to be determined. Possible roles, could include (but not limited to): • Wider site coordination; • Site wide services; • Gating and security; • Setting the annual events calendar; • Events overview; • Advocating for site wide issues; • Dispute resolutions; • Funding, sponsorship and purchasing coordination; • Media and promotions; and • Consents, compliance and monitoring. H. Health and Safety 38. Each of the individual motorsport user groups would retain responsibility for Health and Safety (H&S) within their individual sites. This includes maintaining and enforcing up-todate H&S, with an appointed officer for events and competition management. The H&S plans will be provided to the Park Management Committee and council Parks, Sport and Recreation for their records and may be subject to review and/or audit by either party, as appropriate. 39. Fuels and hazardous substances will in general not be stored on-site, other than items relating to track/facility maintenance (e.g. weed control sprays, small fuel storage containers for mowers). It is envisaged that motorsport facility users will bring their own fuel with them and be required to remove potential hazardous waste/rubbish, such as: lubricant containers, old oil packs, brake pads (asbestos), etc. I. Motorsport funding/grants 40. To date, council has contributed significant funds into the proposed motorsport portion of the site, with $520,000 for design, consenting and removal of some buildings. There is also $2m allocated by council for 2015, and $2,083,000 allocated by council for 2016. 41. In addition, some of the motorsport user groups have also secured funding grants to develop their proposed facilities. Some of these grants are conditional and time bound. See Attachment H for grant details. J. Plan Change 19 42. This plan change was initiated by council in 2006 and successfully sought to rezone the site from Mangere-Puhinui Rural zone to several Public Open Space (POS) zones. These Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 11 included: 44.3ha of land for active outdoor recreation/outdoor sport (POS3) for the motorsport portion of the site; 10.1ha of land zoned for community purpose buildings and indoor recreational facilities (POS 4); and 2.1ha of land on the coastal margin being zoned for esplanade purposes (esplanade reserve, drainage and water quality areas - POS 5). This plan change was effective as at November 2007 and is included in Attachment I. K. Resource consents 43. Auckland Council, Parks Sport and Recreation Department (via independent consultants), have lodged two bundles of resource consent applications for land use activities and associated regional consents for the motorsport portion of the site. In general, the resource consents are for: • 216,000mᵌ of cut-fill earthworks over a 31.4ha area (no net import or export) • Formation of development platforms for each User Group and creation of a minilake for Jet Sprint boat activities; • Access roading and car parking areas, with overflow car parking available on Puhinui Reserve; • elevated bund areas for pedestrian access from the car park area to the western end of the park, and for spectator viewing of Counties Manukau Offroad Racing Club and Motocross activities; • Three “pits” areas for Kart Sport, Off Road Racing, and Motocross use; • Removal of trees; • A new water bore, and capping an existing groundwater bore; • Capping of old landfill; • on-site wastewater and stormwater discharge devices; and • Extensive landscaping both within the park and along adjacent riparian areas. 44. One bundle of consents were granted in March 2013. This is commonly referred to as: the eastern block (BMX, Kartsport and Jetsprint areas), which includes district land use (consent 41468); regional discharge – relating to contaminants from landfill (consent 41142); and earthworks (consent 41143). 45. The remaining bundle of consents were lodged in October 2013 and are for infrastructure requirements for the whole site and the remaining western portion of the motorsport areas. This includes: district land use consent (consent application 43596); regional water permit (permit application P43597); regional sediment control (permit application P43598); regional stormwater discharge (consent application 43599); regional wastewater discharge (permit application P43600); and regional contaminants discharge (permit application P43611). At the time of writing this report, this bundle of consents is currently on hold (s92 under Resource Management Act 1991) with further information being provided. L. Proposed Unitary Plan provisions (notified September version) 46. The proposed Unitary Plan was notified in September 2013. Further submissions close on 22nd July 2014. It is anticipated the hearings on this plan will commence October or November 2014. In respect of the Motorsport Sub - Precinct Colin Dale Park, the provisions are mostly consistent with Plan Change 19, with the exception of traffic Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 12 generation which is more permissive, and only includes NZTA as an affected party when over 1000 inwards movements a day occurs. Council and NZTA will be working through these matters to confirm what threshold is appropriate. See Attachment I for Unitary Plan provisions related to Colin Dale Park. Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 13 2) PUBLIC SUBMISSION PROCESS and OUTCOMES (motorsport) 47. A total of 87 submissions were received by the 6th June 2014 and two late submissions received on the 12th June and 20th June 2014. The lease and licence applications were generally supported by 85 submitters with some of these submissions supporting only one application (Counties Manukau Offroad Racing Club) and not disclosing a position on the other groups. Five of these submissions in support are subject to criteria/conditions being met. Four submitters opposed the applications (including one opposing, in part). 48. A summary of all submissions is included in Attachment G. These are to be read and considered in conjunction with the full submissions in Attachment P. 49. A. Summary of matters relating to motorsport leases/licence to occupy 51. Support – there were 43 submissions received in specific support of Manukau Offroad Racing Club lease, with 48 submissions specifically in support of all motorsport leases/licence to occupy and the development of the site for these purposes. In addition, there are five submissions overall which support the applications (subject to conditions). 52. Oppose/part oppose – there were four submissions not supporting the applications based on either: areas to be allocated, site values, noise, site operations and integrated planning /comprehensive development. As indicated previously, the site is considered an ideal location for these type of activities being located away from high density residential areas. The location of the site, with existing noise effects from airport, was the main reason why the site was acquired by council for these activities. Submitter 2, 3, 7-9, 12-16, 22-23, 27-28, 30-36, 3839, 41, 43, 46, 48, 50, 5357, 59-60, 62, 64-68, 7077 and 88 specifically support all leases and licences. The location of a dedicated park for motorsport activities offers a safe and controlled environment to foster interest in motorsport and to participate in a range of activities. This is the only site in the Auckland Region identified and able to host a range of motorsport activities in the one location. Submitter 61 opposes Main Jet Events (Motocross) and Jetsprint locations, and the relocation of the car parking from 2006 concept to 2013 concept plan. Submitter 80 opposes on the basis that the siting of the lease areas is a departure from what was agreed at PC19 hearing. Submitter 89 part supports Main Jet Events (Motocross) and Radio Controlled Car Club if this can be coordinated with equestrian uses at Puhinui Reserve. The proposal aligns with the Parks and Open Spaces Strategic Action Plan – in particular, enjoy our parks and open spaces – by accommodating more use and activities, and balancing the diverse needs of the community. The proposal aligns with the Sport and Recreation Action Plan – in particular, providing fit for purpose multi-purpose facilities. The lease/licence to occupy locations proposed have taken a number of years to work through, specifically to design methodologies for stormwater, car parking, and to meet noise restrictions of the Auckland Council District Plan (Manukau Section), including the matters that have taken immediate effect under the notified Unitary Plan. This process has also involved substantial input from each motorsport user group and substantial costs for preparing resource consent applications. If changes to lease locations/areas are proposed as an outcome of this hearing, then the resource consent granted, and resource applications lodged would require major amendments. Parts of the lease areas, due to health and safety reasons, particularly around tracks, are intended to be fenced off i.e. no public access/walkway tracks/bridle paths. The three clubs that will not require fencing are BMX (excludes the start ramp) and the Auckland Radio Controlled Car Club and Coggan and Williams (Family Jet Sprint). Also see integrated planning/comprehensive development table. Submitter 37 supports provided a 4m building line restriction from the bollards (10m from gas pipe). The proposed BMX lease area can be 4m away from the bollards so it is not within the gas corridor. Submitter 81 supports in general, provided airport operations are expressly contemplated for in all of the leases/licence to occupy. Regulatory matters and operation matters are considered to be covered in any future agreements, park management committee (advisory group) where appropriate. Also see operations table. Also see operations table. B. Summary of matters relating to site values/adverse effects 54. Support – there were three submissions received in support (subject to conditions), and three submissions in opposition in relation to site values/adverse effects. One submitter does not object, but does not acknowledge this as support. 55. In general, site values and adverse effects relate to matters which are covered under the Resource Management Act, and related regulatory consents, but it is acknowledged that there is an overlap with the Reserves Act whereby the administering body is responsible for managing and protecting the values of a reserve. 56. It is noted that as part of the settlement process during this plan change, two parties (the Conney’s and the Buttimore’s) were made and accepted an offer by council relating to acoustic mitigation works on their properties. Submitter 80 opposes considering that performance criteria is unable to be met. Submitter 82 opposes cumulative noise impacts. Once again, the site was strategically chosen as these activities are best located where there are existing noise activities and few residential dwellings. The intention is that noise, dust, lighting and traffic generation at the site will meet the requirements of the District Plan or require related consents before the activity can occur. An operational management plan/committee for the site will identify how the user groups will manage the activities on the site, including monitoring records to meet District Plan/consenting/lease requirements. Please see Attachment J for reports on noise, traffic, lighting and dust effects. th th Traffic generation Traffic monitoring was undertaken from 6 -8 December 2013 at the Prices Road/Puhinui Road intersection by TEAM (Traffic Engineering and Management Ltd), in respect of a 3-day event at Puhinui Reserve. This event had 841-1275 vehicles movements (both ways) over a consecutive 3 day period (Fri-Sun) with a peak hour turning volume of 158 vehicles and demonstrated the intersection may have more capacity than previously estimated with PC19 provisions (with 95% of predicted annual events working, with the exception being busy weekends). NZTA have also provided written approval for the anticipated events. Lighting LED floodlights on 8m high poles are to light the access roadway and public car parking areas, but at this stage no lease area includes lighting. All lighting has been designed to not exceed 100 lux at the site boundary, and to control glare and spilt light to avoid interference with any airport approach lighting systems. At present the light plan does not include any lighting provisions for the motor sport user groups. The latter will follow at a later stage (probably by individual application by each user group but not decided). Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 17 Topic Submission Dust Cultural values and impacts Discussion In the water supply report (Attachment J), Table 2 (section 3.6.2) sets out the anticipated non-potable water demand of each user group. Essentially each user group is responsible for the control of nuisances from their own activity, including dust. They will wet their track surfaces to control dust, using water from the proposed park water bore. The Kartsport track is sealed and hence wetting is not necessary. The Radio Controlled Car Club does not require any water for these purposes. Submitters 63 and 82 oppose for lack of knowledge, and potential significant adverse cultural effects, lack of cultural matters being considered prior to the development of the park. Submitter 61 does not object on these matters. In managing parks and open spaces the aim is to protect and care for Auckland’s special places, cultural and historic heritage values; leading by example; working in partnership with mana whenua to understand and protect the values of places of significance to mana whenua (as outlined in the Auckland Council Parks and Open Spaces Strategic Action Plan). Te Aakitai Waihoua have advised council this site is of value to mana whenua. In addition, Ngati Te Ata considers that with the existing lease for marae, and the value of the site to Ngati Te Ata has already been acknowledged by council. It is noted that council is working with these groups to understand what the values are and how these may be incorporated into any lease (if relevant). It is noted, that existing reports acknowledge the wider area is of cultural significance to Maori, such as: Puhinui Reserve, Matukutureia Maunga – McLaughlin’s Mountain), Matukutururu Maunga (Wiri Mountain) – now quarried, stream networks and Pukaki marae. In addition, an assessment on archaeological effects (from four surveys by Rod Clough and Associates 2010), outlines that no archaeological features have been identified, and concludes that sites could have either been eroded; and/or that this was not a major site for habitation (see Attachment J). The Auckland Council District Plan (Manukau Section) as part of PC19, did not include cultural values or require cultural impact assessments as assessment criteria for applications, nor did it include any overlays. However, the notified Unitary Plan rules on Sites of Significance to Mana Whenua (among other matters) have immediate legal effect. Although Colin Dale Park is not identified as a site(s) of significance to mana whenua on the notified version, council regulatory team has utilised discretion to seek input from mana whenua on cultural impact assessment in relation to the physical works. A cultural Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 18 Topic Submission Discussion impact assessment from Te Aakitai Waiohua (is expected to be received by 25/07/14) and will be utilised for the resource consent application, and also assist in management, development and/or terms and conditions of any lease (where applicable). No cultural values reports have been received at the time of writing this report. Ngati Te Ata have confirmed to council they do not need to undertake a cultural impact assessment on the site. Ngati Te Ata have also provided written support for the resource consent application(s), with conditions, but subsequently submitted partial opposition related to noise impacts of two motorsport groups (Motocross and Family Jetsprint (Coggan and Williams). Also refer to consultation/engagement section below. Volcanic crater/tuff cone Submitter 29 supports the leases if the volcanic features are physically excluded from the lease areas. There are three craters (tuff cones) located on Puhinui Reserve (discovered in 2011), one which is referred to as the “pond crater” extends into the south-eastern portion of Colin Dale Park. These tuff cones are recognised as outstanding natural features in the notified Unitary Plan. The pond crater has been excluded from the proposed lease area for Kartsport, and physical demarcation options are being investigated (such as interpretation signage, fencing or the like). Wildlife/bird roosting colonies Submitter 63 opposes the leases on the potential adverse effects on bird life environment. According to, CPG report September 2011 and the Golder Associates report May 2014 (in Attachment J), the site has low ecological values due to stock grazing and lack of riparian planting. Although it is home to a variety of rare and endemic bird species, and Puhinui Reserve has large flocks of migratory wander birds which use the coastal flats for feeding and roosting. Stormwater/ wastewater discharge on site Submitter 63 opposes the leases on the potential adverse effects on stormwater discharge and waste water discharge. The proposal for stormwater pond for use by Family Jet Sprint (Coggan and Williams), will direct all treated surface runoff towards the pond (for recreation use), prior to being discharged to the existing stream after passing through a settling pond, before discharging into Manukau Harbour via the northern gullies. It is understood the permanent watercourses of the site will remain. Submitter 82 also opposes in regards to potential wastewater effects. Mitigation measures recommended to minimise wastewater runoff effects, include: appropriate plant species, riparian setbacks, fencing areas, maintenance, monitoring, recording and adaptive plan (remediation). Support – there were 4 submissions received in support (subject to conditions) and no submissions received in opposition related to operational matters. 58. When a proposal is outside officer delegation or of significant public interest, a recommendation would be reported to the Otara-Papatoetoe Local Board for decision. Submitter 89 supports subject to coordination of activities at Puhinui Reserve. Event coordination will be organised by the parks management committee and Manager, Local and Sports Parks, South (or delegate). Management and timing of neighbouring activities at Puhinui Reserve, in particular events for equestrian activities, are to be included in any operational management plan. The park committee/operational management plan will assist with achieving a balance around the compatibility of uses/events/traffic/car parking/access occurring on both Colin Dale Park and Puhinui Reserve, and how to consult/involve neighbours or key stakeholders. The parks management committee may also be able to produce and publish a future events schedule. Parking/traffic management/ overflow parking Submitter 37 seeks specific requirements on no parking along Prices Road in a management plan, and denies access to the gas pipeline area isolated by way of the bollards at the northeastern end (north-south alignment) on a 24/7 basis. Vehicle access through Puhinui Reserve is restricted, and keys need to be obtained from council for any event/activity requiring vehicle access. Therefore site management related to vehicle movements can be managed. Submitter 89 seeks that access through Puhinui Reserve should not be ‘as of right’, but set rules for operations especially during equestrian events. In addition, access to Colin Dale Park for walkers, cyclists, and horse riders on pathways that could extend on the outer perimeter of the park. Public access around and within each of the lease areas needs to be determined based on health and safety matters. Public access will be available along the road network and parking areas. Submitter 81 supports provided aviation safety is controlled. This includes: The proposed leases/licence to occupy intend to be in accordance with civil aviation requirements. Auckland International Airport Ltd may also seek representation on the Park Management Committee for coordination of events/management of operations, including identification and review of impacts. • no obstacles to penetrate the Obstacle Limitation Surfaces (designation 232) without the written approval of Auckland Airport; • a lighting plan is provided (flood lights); • the use of water carts encouraged; no accommodation; • accordance with statutory planning; no objections to airport; and • a key stakeholder forum prior to the development of the park. The Te Araroa Walkway is along Prices Road and Puhinui Reserve, but at this stage recreational cycle/bridle trails are not contemplated in the park. One submission opposes the consultation undertaken, and another submission seeks meaningful engagement. 60. The records held by council summarise that Ngati Te Ata and Te Aakitai Waiohua were in dialogue with council on the rezoning and activities. Ngati Tamaoho was not on this record. Submitter 63 opposes due to lack of consultation. Due to the nature and specifications of motorsport activities/design, input into drafting the latest concept plan was not sought by the wider public. Specific consultation on the leases commenced with mana whenua groups early 2014, and is still ongoing with Ngati Te Ata, Te Aakitai Waiohua and Ngati Tamaoho in respect of the motorsport leases/licence to occupy. In addition, the OtaraPapatoetoe Local Board requires a report on iwi consultation, prior to the local board making a decision on the motorsport leases/licence to occupy agreements. E. Summary of matters relating to integrated planning/comprehensive development 61. There are three submissions in support (subject to conditions), in addition to all the submissions received in support of all the applications. 62. Reserve Management Plan Submitter 82 seeks the comprehensive development for the wider area, including preparation of a reserve management plan. In September 2010, Colin Dale Park NZ Gazette Notice declared the land to be reserve under the Act, and makes it a statutory requirement to prepare a reserve management plan under s41 of the Act. Reserve management plans are statutory documents which provide a framework to carry out management and future development of a reserve in an integrated way, taking into account community needs and aspirations. The current approach, developed in consultation with local boards and endorsed by the Parks, Recreation and Sport Committee at its meeting on 4 March 2014, is that reserve management plans will only be prepared or reviewed when necessary and no proactive programme of statutory management plan development will be undertaken. Instead, a suite of non-statutory park and reserve management policies will be prepared to guide the management of parks and reserves which do not have an operative management plan with a view to these forming the basis for statutory plan development in the future. Initial work to develop these policies is currently underway. In the absence of reserve management plans, the Reserves Act, the Auckland District Plan, Auckland Unitary Plan and Auckland Council strategies and policies guide the management and use of reserves, including leases. Preparation of a plan in the future would need to evaluate the feasibility of including both Puhinui Reserve and Colin Dale Park into the one management plan, particularly as their boundaries are contiguous. Puhinui Reserve Submitter 89 part supports Main Jet Events (Motocross) and Radio Controlled Car Club provided impacts on equestrian activities are mitigated. In addition, this submitter also seeks that the motorsport leases/licence to occupy Council is working with Auckland Equestrian Eventing on the provisions of their licence to occupy which expires in 2016. There is continued support for these equestrian events to continue at Puhinui Reserve. Any changes to the existing licence to occupy, either as a result of the development of Colin Dale Park and recent understanding of the values/impacts of Puhinui Reserve (or other matters) will be worked through with Auckland Equestrian Eventing. As noted in the background, the proposal by Puhinui Trust Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 23 Topic Future road upgrades Submission Discussion should not negatively impact on future use of Puhinui Reserve, including the proposal by Puhinui Trust for equestrian centre. proposal is a separate matter, and council is working through this request to assess its merit. Submitter 69 supports the application if there is a requirement to upgrade Prices Road, and other improvements in the immediate area such as the possible McLaughlin’s Road (per PPC35 or structure plan). It is noted that Prices Road has been widened to 6m in width, and there are no further planned upgrades to this road. Submitter 81 supports provided effects of development and the burden of any road upgrading should be apportioned equitably. Council is unable to require a tenant to contribute towards the cost of public road maintenance in a lease. In addition, motorsport activities are already provided for and envisaged through Plan Change 19 of the Auckland Council District Plan (Manukau Section). Regulatory consents will address traffic, parking, access, drainage, lighting concerns in relation to performance criteria. In respect of SH20B, NZTA have provided written approval to the resource consent proposal. Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 24 3) WIDER CONTEXT A. Background to marae lease at Colin Dale Park 64. A site for a Ngati Te Ata marae had been contemplated for a number of years in the Manukau area. It appears that in response to this (including other matters related to Matukutureia Maunga and Matukutururu Maunga), council contemplated a marae and its activities within the concept plans and Plan Change 19, and the reserve classification of the site. 65. On 26th October 2010, Council entered into an agreement to lease for 10.1ha on the western portion of Colin Dale Park with Te Ara Rangatu o Ngati Te Ata Waiohua Incorporated, thus enabling the Public Open Space 4 zone provided for in Plan Change 19. It is acknowledged that the support for the lease was on the basis that “no objections can ever be put up regarding any motorsport activities on this park”, and this condition was intended to be included in the terms of the lease. For the current agreement to lease and lease see Attachment K). 66. At present there are no building(s) for marae purposes or marae activity on site. B. Puhinui Reserve 67. Puhinui Reserve is a 199 hectare site adjoining Colin Dale Park to the south and east, which occupies the southern end of the Puhinui peninsula. It has considerable historic, conservation and cultural amenity value. The reserve forms part of the extensive Matukuturua volcanic field and is linked with pre-European settlements centred on Matukutururu Maunga (Wiri Mountain) and Matukutureia Maunga (McLaughlin’s Mountain). It is also home to a variety of rare or endangered species including the black stilt, NZ dotterel, fernbird (a coastal fringe bird) and wrybill. Large flocks of migratory birds use the reserve and coastal flats for feeding and roosting. 68. The site was intended to be classified as local purpose (esplanade) reserve; recreation reserve; and scenic reserve under the Reserves Act 1977, as per resolutions PA/FEB/22/09 from the former Manukau City Council in 2009 (see Attachment L). However, the only portion that is classified is the local purpose (esplanade) reserve, with the remainder of the site currently held in fee simple. A portion of the site (southern-most end) is also subject to the Wildlife Refuge under the Wildlife Act 1953. 69. Puhinui Reserve Management Plan was prepared in 2002 (subject to final classification under Reserves Act). A policy in this management plan is for council to establish an Advisory Committee to manage the reserve using contemporary techniques and a cooperative approach. The plan includes a development plan for the site (see Attachment L). Classification is required to be completed for this plan to be formally recognised as a Reserves Act document. Nonetheless, it remains the guiding document for this park. 70. There are currently two licence to occupy arrangements for this reserve (see Attachment L for details). One licence is for grazing cattle (expired); and the other is for a horse event by Auckland Equestrian Events Incorporated (expires in 2016). Although not formalised in Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 25 the licence for equestrian events, part of Colin Dale Park is utilised for horse yards and parking associated with the two March and December events. 71. There is a proposal by Puhinui Trust seeking council support for an international equestrian facility (and subsequent lease) at Puhinui Reserve. Council has been working through matters with the Puhinui Trust, and is awaiting completion/assessment of the following needs (among other matters): the Equestrian Facility Plan; feasibility/business case for the project; the development of Colin Dale Park for motorsport; and an assessment of development areas available within Puhinui Reserve (among other matters). C. Matukutureia Maunga (McLaughlin’s Mountain) 72. This site is owned by the Crown (Department of Conservation), purchased in 2008 to protect and recognise values of the site. It is currently zoned for public open space purposes. The site, being owned by the Crown could be subject to treaty settlements. D. Auckland International Airport 73. Auckland International Airport Ltd is located to the west of Colin Dale Park, across the Manukau Harbour, with key access to the airport from the south being via Puhinui Road (SH20B). A submission has been submitted on the notified Unitary Plan to amend the Aircraft Noise Notification Area noise levels between 55 dB Ldn and 60 dB Ldn, to Medium Aircraft Noise Area with future noise levels between 60 dB Ldn and 65 dB Ldn. This also means it is not appropriate for activities sensitive to aircraft noise to be established i.e. buildings with overnight stay facilities. The hearings for notified Unitary Plan are anticipated to commence later this year, and continue into the following year. E. Private Plan Change 35 74. A private plan change has been lodged by the Southern Gateway Consortium, which is made up of some of the land owners in the block of land to the south of Puhinui Road (SH20B), to the east of Prices Road, and land to the north of Puhinui Stream. The private plan change seeks to rezone 150 hectares of land from Mangere-Puhinui Rural Zone to Business zoning – manufacturing/warehousing, with a service centre zone (covering 1.8 hectares of land). The plan change is to be assessed by council and a hearing to be held (possibly August/September 2014) to determine whether to accept the private plan change. A map of this area is included in Attachment M. F. Puhinui Structure Plan 75. As at February 2014 council endorsed preparing a structure plan to inform council’s position on the future land use and development framework for the Puhinui Study Area, including the location of the Rural Urban Boundary (RUB) in respect of the submissions to the Proposed Unitary Plan. 76. The study area is approximately 1100 hectares of land, located east of the Auckland International Airport and includes Colin Dale Park. See Attachment N for map. 77. This structure plan aims to provide a holistic perspective to development of this area. It includes assessing significant infrastructure requirements (roading and waste water Colin Dale Park – motorsport leases/licence to occupy hearings report – prepared 29 th July 2014 Page 26 upgrades); archaeological, geological, cultural and natural landscape values; including the impact of development on Auckland International Airport operations and cumulative effects. 78. The structure plan needs to be completed in time to inform the hearing of submissions on the Unitary Plan. Hearing matters relating to the RUB is likely to occur during 2015. G. Otara-Papatoetoe Area Plan 79. A draft area plan has been prepared to support the future growth and development of Otara-Papatoetoe over the next 30 years. The plan is currently out for public consultation (closing 17th August 2014). The plan sets out projects and initiatives needed to achieve the key moves on the ground in responsible and practicable ways, including funding requirements. Colin Dale Park is identified in key move 7 (safe, accessible and high quality parks and community facilities), as project 7.5 – Progress the development of Colin Dale Park. Refer to Attachment O for key move 7 and draft maps. Consideration Local board views and implications 80. The local board wants to ensure the activities, uses and development on the site are undertaken legally and follow due process, and has indicated that it will not undertake any physical works on site for motorsport development until the lease agreements have been finalised and resource consents granted. 81. The recommendations of the Hearings Panel, along with any further information or staff advice, will be provided to the local board for its determination of the leases/licence to occupy. Maori impact statement 82. There are ten mana whenua-iwi groups identified by Council with interests in the OtaraPapatoetoe Local Board Area. These groupings are Ngati Maru; Ngai Tai Ki Tamaki Tribal Trust; Ngati Te Ata – Waiohua; Te Aakitai Waiohua; Ngati Paoa; Ngati Tamaoho; Te Kawerau a Maki; Ngati Whanaunga; Ngato Tamatera; and Waikato-Tainui. 83. Ngati Te Ata have an agreement to lease with council for 10.1ha on the western portion of Colin Dale Park to build a marae. Since the formation of Auckland Council, Te Aakitai Waiohua have also raised concerns about their level of involvement in the development of the park, and want to ensure cultural values are appropriately taken into account. 84. Consultation with mana whenua groups has been ongoing throughout the process of development for Colin Dale Park. Consultation specifically on the proposed six motorsport groups and their leases/licence to occupy arrangements commenced in early 2014 (see Attachment F). The local board has also requested a report on iwi consultation (anticipated to be) prior to granting any of the leases/licence to occupy. The recommendation from the Hearings Panel, in granting the proposed leases/licence to occupy will be reported to the Otara-Papatoetoe Local Board for implementation. 86. The council will determine the final terms and conditions of any lease/licence to occupy and will require consent of the Minister (delegate).
