EMD needs to be submitted alongwith the Technical Bid in favor of M/s. HINDUSTAN AERONAUTICS LIMITED, Sukhoi
Engine Division - Koraput. HAL will not be responsible for any transit/ postal delay in receipt of EMD. Please note that the
EMD without interest will be refunded to unsuccessful parties preferably within 15 working days from the date of order
acceptance by the successful bidder.
Offers without EMD shall be considered as unresponsive and rejected. However, SSIs registered with NSIC will be issued
tender documents free of cost and shall be exempted from payment of EMD on production of valid registration Certificate.
Any corrigendum to this tender will be hosted in HAL Website only. Hence tenderers are requested to visit HAL
website from time to time before the closing date.
HAL reserves the right to accept or ignore/reject the lower or any other Tender, either in full or part or to cancel the whole
tender process without assigning any reason thereof.

1.

Tenderers are required to follow TWO BID SYSTEM strictly. Commercial bid and Technical
bid are to be submitted separately in two different closed and sealed covers superscribing on the
cover as “COMMERCIAL BID” and “TECHNICAL BID”. Tenders which do not adhere to the
above instructions shall be rejected. First offer (Technical Bid) shall give only technical details
of the equipment with accessories and the second offer (Commercial Bid) shall give price as per
Sl. No. 6 of General Terms and Conditions and other commercial details. The offer should be
submitted by Registered Post / Courier in double sealed cover, duly superscribing the TENDER
REFERENCES, brief description of the equipment and the DUE DATE on both the envelopes.
Both inner and outer covers are to be addressed to the Manager (Purchase), Hindustan
Aeronautics Limited, Sukhoi Engine Division - Koraput, Sunabeda, Pin-763002, Koraput
District, (Odisha), India.

The Technical Bid should be to the point wise clarification to the tender specification.
5.
Offers should reach us on or before the specified due date and time. The tender (Technical
Offer) will be opened on next day in the office of the Manager (Purchase), Hindustan
Aeronautics Limited, Sukhoi Engine Division - Koraput in the presence of the tenderers or their
company’s authorized representatives who choose to be present. The tenderers or their
company’s authorized representatives who choose to be present at the time of tender opening
should bring an authorization letter from the respective firm. The date of the tender opening
shall not be extended under any circumstances. The Commercial offer shall be opened at a later
date, after scrutiny of the Technical offer.
6.
The tenderers of technically acceptable offers will be intimated about the date of opening of the
commercial offers, for their participation.
7.
EMD: An Earnest Money Deposit “EMD” for an amount as mentioned in the Tender
Notification, in the form of Demand Draft / Banker’s Cheque / Pay Order endorsed “Account
Payee” / Bank Transfer / RTGS / NEFT / CORE Banking in favour of M/s. HAL, Sukhoi Engine
Division – Koraput (A/C No: 31877151258) and payable at State Bank of India Sunabeda-2,
(Code-01304) Odisha (India) (IFSC Code: SBIN0001304; SWIFT Code: SBININBB273)
should accompany the Technical Bid.No other mode of payment including Cheques / Cash etc.
will be accepted. In case the original instrument / BG / proof of payment towards EMD is not
enclosed along with the technical bid, the offer will be considered unresponsive and rejected.
Submission of copies of EMD documents / instruments alongwith Bid and submission of
original EMD document / Instruments at a later date is not acceptable.
8.
No Tender Fees shall be charged for the Tender Documents and Tender documents may be
downloaded from HAL website (www.hal-india.com) free of cost.
The tenders submitted by H.A.L. blacklisted parties shall be rejected.
The Tenderers shall forward intimation about their willingness to participate in the tender
immediately after downloading the tender documents to our e-mail [email protected].
Tenderers should verify the completeness of tender documents after downloading and H.A.L.
shall not be responsible in case of problems encountered by tenderers for downloading the
tender documents. Please confirm acceptance of the above conditions in your offer.
9.
Please note that the net amount receivable towards EMD should not be anyway less than the
Amount specified in the Tender Notification. HAL shall not be responsible for receipt of less
amount due to deduction of Bank commission / Bank charges etc. from the payment amount.
Offers with less EMD shall also be rejected. Vendors are requested to make a note of it.
10.
Vendors exempted from submission of EMD as per Govt. of India Directives must submit
verified copy of GOI’s authority for such exemption in lieu of EMD.
11.
REVISION OF PRICE BIDS AFTER OPENING OF TECHNICAL BIDS SHALL NOT BE
ACCEPTABLE.
12.
QUOTATION RECEIVED AFTER DUE DATE SHALL NOT BE CONSIDERED. HAL will
not be responsible for loss or delay in receipt of tender documents / tender in transit. In view of
the above, you are requested to despatch the bid in advance so that it reaches us within the due
date and time.
SPECIAL NOTES:
1)
Presently only quantity 2 Nos. would be considered for ordering and development.
2)
Requirement: Annual Requirement is 10 Nos& requirement is for next Five years.
3)
UNIT PRICE :Vendor should quote single unit price per item irrespective of developmental /
bulk order considering annual requirement for next five years. There should not be
two different unit price for developmental quantity and annual requirement quantity.
4)
Price Escalation: Vendor may indicate escalation percentage if any for the projected annual
requirement quantity for next five years.
5)
Developmental Charges: Please consider the developmental charges if any in unit prices of
each item in your quotation. There should not be separate developmental charges.
6)
Considering the above Terms and conditions sl 5, 6 & 7 your quoted price should be valid for
next 5 years. Please confirm the same in your quotation.
7) Tender Evaluation: Bid with lowest price (L1) conforming to the Technical specification will be
considered for placement of order and L1 shall be determined based on quoted unit price with
escalation if any Plus taxes & levies as applicable for total requirement projected i.e.
Developmental quantity plus annual requirement quantity for next five year. It is requested to
quote single rate irrespective of developmental/bulk order considering average annual requirement
for next five year.
8) Long Term Business Agreement(LTBA): After successful completion of development order,
HAL may enter into Long Term Business Agreement (LTBA) for projected annual requirement
quantity for next five years as per quoted price, & escalation if any.
9) The drawings are uploaded separately.
GENERAL TERMS AND CONDITIONS
1) Bidders are eligible to quote only for the items for which the Tender Documents have been issued
directly or downloaded from HAL Website as per the instructions indicated therein.
2)
These General Terms and Conditions shall apply to the extent that they are not superseded by
provisions of the Specifications of the items.
3)
Quotation should be FOR delivery of the Itemsat Destination, HAL, Sukhoi Engine Division –
Koraput, Sunabeda-763002, Odisha, India.
4)
Quotation must be in the unit in which the quantity is indicated in the tender. You should quote
price per unit and total price in figures & in words as detailed below. The schedule of item should
not be changed.
5)
Please specify the CST against "C" form, as HAL will provide the C-form. The other duties, taxes
&octroi if any should be indicated explicitly in the offer. It may be either in "%age or absolute
terms". The offer would be considered as "Offer is inclusive of all
taxes & duties" if there is
absence of these inputs and no further amendment in the offer shall be entertained.
6)
Quotations must be in Indian Rupees.
10) Quotation should be free from cuttings and over writing. Any inevitable correction should be
clearly legible and countersigned.
11) While submitting the offer, bidder should comply the following :
a) Technical specification of 5-Point Thermocouple is attached as Annexure-A for
reference.
b) Parts are to be manufactured as per the drawing enclosed. The are enclosed at
Annexure-B.
c) Parts should be manufactured as per the original Russian material as specified in the
drawings or alternate MIDHANI type approved or alternate western grade material as
specified in Annexure-B. Firm certificate for original Russian Material/MIDHANI
material shall be submitted while supply of the items. In case of usage of alternate
material other than specified, concurrence should be taken from HAL-SED, Koraput
prior to usage. Necessary details for material property like Chemical composition and
Mechanical Properties for other alternate grade material shall submitted for approval at
our end.
d) Presently, 02 nos. (1set) will be considered for developmental trial and proving
purpose. After successful test trial result and proving of the item, bulk order
(approximately 10 Nos. or 5sets) will be given annually.
e) As thermocouple wire is Pt-Rh (Platinum-Rhodium; 30% Rh) type, material test
certificate indicating the properties of wire shall be submitted for concurrence before
start of the fabrication. Calibration certificate of the thermocouple (Individual Channel)
shall be submitted for the temperature range from 0-1800⁰C.
f) Quality of 5 nos. ceramic tube should be ensured as they have to withstand temperature
up to 1800⁰C degree Celsius and air mass flow rate of 35kg/sec. Filling of the SS tube
for thermocouple wire should be done with fibre glass sleeve and alumina powder.
g) Suppliers may visit the division while participating in tender and before submission of
the offer in order to carry out feasibility study and resolve technical clarification.
h) Heat treatment if applicable for any material should be certified from any NADCAP
certified source.
i) Plating and Coating if applicable for any material should be certified from any
Government approved source.
j) In case of any deviation found during development trial & proving, supplier has to
correct the deviation with no financial implication.
k) Delivery time to be indicated in the quotation
12) The quotation should be firm & fixed and valid till 120 days from the closing date of the tender.
QUALITY & WORKMANSHIP:
13) The Stores/ Goods supplied shall conform to the standards, if mentioned in the Technical
Specifications, or, where no applicable standard is mentioned, to the authoritative standards
appropriate to the Goods’ country of origin. Such standards shall be the latest issued by the
concerned institution.
14) The stores shall be of the International Standard quality and workmanship incorporating latest
technology and standards relevant to the industry. Bidder shall comply with the conditions of the
tender and these Terms & Conditions. The proposal to supply shall be deemed to be an admission
on Bidder’s part that he has fully acquainted himself with details and no claim on his part, which
may arise on account of non-examination or insufficient examination of the conditions of the
tender and these Terms & Conditions, will, in any circumstances, be considered.
15) Vendors while submitting the proposal should categorically declare that items quoted by them are
their own manufactured products and not resold (2nd sale). Offers without such declaration are
likely to be ignored.
INSPECTION, CONSEQUENCES OF REJECTION
16) The goods on receipt in HAL will be subject to inspection and tests and HAL inspector’s decision
as regards acceptance/rejection of goods, in part or full, shall be final and binding on the parties.
If any stores are rejected, HAL shall be at liberty to:

Allow the bidder to supply stores in replacement of those rejected within a time specified
by HAL, the bidder bearing the cost of freight in such replacement without being entitled
to any extra payment,
OR,
Buy the quantity of stores rejected or other of a similar nature elsewhere at the risk
and cost of the bidder without effecting the bidder's liability as regards the supply of any
further consignments due under the contract,
OR,
Terminate the contract and recover from the bidder the loss HAL may thereby incur. The
bidder shall not be entitled to any gain on the repurchase,
17) Any stores rejected by HAL's Inspector must be removed by the bidder within 14 days from the
date of receipt of intimation of rejection and at his own cost, failing which the bidder shall be
liable to pay storage charges at 1% for each day of delay on the invoice value of the stores. If the
stores are not removed within a month from the date of intimation of rejection, the stores will be
liable, to be sold by HAL at the bidder’s risk and responsibility and the proceeds adjusted towards
storage charges.
COUNTER TERMS & CONDITIONS:
18) Conditional Offers will not be accepted.
19) When counter terms & conditions of the business are offered by the bidder, HAL shall not be
deemed to be governed by such terms & conditions unless written acceptance thereof has been
given by HAL. No conditions & terms, notice of which has not been given in the tender by
bidders submitting quotations will be considered by HAL, if put forward in subsequent
correspondence and after placement of order.
AGENTS/AGENCY COMMISSION:
20) The seller confirms and declares to the buyer that theseller is the original manufacturer or
authorized distributor / stockiest of original manufacturer or Govt. Sponsored / Designated Export
Agencies (applicable in case of countries where domestic laws do not permit direct export by
OEMS) of the stores referred to in this offer / contract / Purchase order and has not engaged any
individual or firm, whether Indian or Foreign whatsoever, to intercede, facilitate or in any way to
recommend to Buyer or any of its functionaries, whether officially or unofficially, to the award of
the contract / purchase order to the Seller; nor has any amount been paid, promised or
intended to be paid to any such individual or firm in respect of any such intercession,
facilitation or recommendation. The Seller agrees that if it is established at any time to the
satisfaction of the Buyer that the present declaration is in any way incorrect or if at a later
stage it is discovered by the Buyer that the Seller has engaged any such individual / firm,
and
paid or intended to pay any amount, gift, reward, fees, commission or consideration to such
person, party, firm or institution, whether before or after the signing of this contract/ purchase
order, the Seller will be liable to refund that amount to the Buyer. The Seller will also be debarred
from participating in any RFQ / Tender for new projects / program with Buyer for a minimum
period of five years. The Buyer will also have a right to consider cancellation of the Contract /
Purchase order either wholly or in part, without any entitlement or compensation to the Seller
who shall in such event be liable to refund all payments made by the Buyer in terms of the
Contract / Purchase order along with interest at the rate of 2% per annum above LIBOR (London
Inter Bank Offer Rate) (for foreign vendors) and Base Rate of SBI (State Bank of India) plus 2%
(for Indian vendors). The Buyer will also have the right to recover any such amount from any
contracts / Purchase order concluded earlier with Buyer.
IPR CLAUSE:
21) In the development orders, where technical inputs/assistance is provided to the vendors, the
Intellectual Proprietary Rights (IPR) will rest with HAL. Vendor will not directly deal with
HAL's customer for these items.
CONFIDENTIALITY
22) The Supplier shall hold confidential technical data and information supplied by the Purchaser or
on behalf of the Purchaser and shall not reproduce any such technical data or information or
divulge the same to any third party without the prior written consent of the Purchaser. The
Purchaser shall hold confidential technical data and information supplied by the Supplier or on
behalf of the Supplier and shall not reproduce any such technical data or information or divulge
the same to any third party without prior written consent of the Supplier except as far as may be
necessary for either party to carry out its obligations under this Contract.
FALL CLAUSE:
23) The price quoted shall be in no event exceed the lowest price at which you sell the stores or offer
to sell stores of identical description to any person(s) / organization including the purchases by
any department of the Govt. of India, the State Govt. or any statutory undertaking of the Govt. of
India / State Govt., as the case may be during the period till the completion of the performance of
the order placed and during currency of the order. Incase you have entered into Rate Contract
with DGS&D, please quote Rate Contract reference and send a copy of the same along with your
quotation.
24) If at any time during the said period, the Seller reduces the sales price, sells or offer to sell such
stores to any person(s) organization including the purchaser or any department of Govt. of India
or State Govt. and any statutory undertaking of the Govt. of India / State Govt. as the case may
be, at a price lower than the price chargeable in the order, Seller shall fore with notify such
reduction / sales or offer to sale to Hindustan Aeronautics Ltd., and the price payable in the order
for the stores supplies after date of coming into force such reduction or sale or offer to sale shall
stand correspondingly reduced.
PAYMENTTERMS:
25) There will be no advance payment made from HAL side.
26) In the event of an order, 100% payment will be made within 30 days after receipt &inspection and
acceptance at our Stores. All Bank charges to supplier account.
SECURITY DEPOSIT
27) Security deposit will not be considered for developmental order.However after successful
completion of the developmental order Security Deposit should be deposited 5% of the LTBA
values within 15 days of signing of LTBAby a Demand Draft, Bank Transfer or Bank Guarantee
in the prescribed format of H.A.L. provided at Annexure –III. The Bank Guarantee shall be valid
up to 60 days after the completion of contract period/last supply. The Bank Guarantee shall be
from a scheduled Bank in India. This deposit will bear no interest and will be returned after the
completion of the contract to the satisfaction of HAL. Loading factor of 5% shall be considered
for the vendors who do not agree to submit Security Deposit.
28) The deposit is liable to be forfeited if the contract is not executed to the satisfaction of HAL or
Seller withdraws from the performance of the contract, in addition to initiation of risk purchase
action by the Purchaser.
29) No claim will be entertained against HAL either in respect of interest, if any due on the security
deposit or depreciation in value.
30) On due performance and completion of the contract in all respect, the Security Deposit will be
returned to the bidder without any interest on presentation of “No Demand Certificate” and upon
return of specification, drawings, samples or any material / property belonging to the Purchaser
which may have been issued to the bidder.
EARNEST MONEY DEPOSIT
31) An Earnest Money Deposit “EMD” for an amount as mentioned in the Tender Notification, in the
form of Crossed Demand Draft / Banker’s Cheque / Pay Order endorsed “Account Payee” and
drawn in favour of “HAL, Sukhoi Engine Division – Koraput”, and payable at Sunabeda (India)
should accompany the Technical Bid. EMD can also be paid through RTGS / NEFT / CORE
Banking.No other mode of payment including Cheques / Cash etc. will be accepted.
Submission of copies of EMD documents / instruments alongwith Bid and submission of original
EMD document / Instruments at a later date is not acceptable.
EMD by foreign bidder should be in the currency of Bidder’s country or any other convertible
foreign currency in line with RBI / FEMA rules.
32) Offers not accompanied with the aforesaid EMD will be rejected, except by Bidders who have
been exempted by Govt. of India and proof of such exemption is submitted alongwith Technical
Bid in lieu of EMD.
33) EMD will be refunded to unsuccessful bidders after order acceptance by the successful bidder.
EMD shall carry no interest.
34) EMD will be forfeited, if the renderer withdraws or amends impairs or, derogates from the tender
in any respect within the period of validity of his tender.
35) EMD of successful bidder will be adjusted towards Security Deposit.
DELIVERY AND LIQUIDATED DAMAGES FOR DELAY IN DELIVERY
36) Delivery period for supply shall be at the earliest from the date of receipt of Purchase Order.
Please indicate realistic delivery period. In the event of the Bidder’s failure to meet delivery
schedule so committed and specified in the purchase order, HAL reserves the right to collect a
sum of 0.5% per week of delay or part thereof, subject to a maximum of 10% as our claim
towards liquidated damages on the undelivered part of the order.
APPROPRIATION
37) Whenever any sum of money is recoverable from sum of money payable by the bidder, HAL
shall be entitled to recover such sum by appropriating in part or whole by deducting any sum then
due or which at any time thereafter may become due to the bidder in this or any other contract
entered by HAL as a whole its Divisions and Branch Offices etc., held by him alone or in
partnership with others. Should this sum be not sufficient to cover the full amount recoverable,
the bidder shall pay to HAL on demand the remaining balance due.
IMMUNITY OF GOVERNMENT OF INDIA
38) It is understood and agreed that the Government of India is not a party to this agreement and has
no liabilities, obligations or rights hereunder. It is expressly understood and agreed that HAL is an
independent legal entity with power and authority to enter into contracts solely on its own behalf
under the applicable Laws of India. The bidder shall agree, acknowledge and understand that
HAL is not an agent, representative or delegate of the Government of India. It is further
understood and agreed that the Government of India is not and shall not be liable for any acts,
omissions, commissions, breaches or other wrongs arising out of the contract. Accordingly,
bidder expressly waives, releases and foregoes any and all actions or claims against the
Government of India arising out of this contract, not to sue the Government of India as to any
manner, claim, cause of action or anything whatsoever arising out of or under this agreement.
RESPONSE/ REGRET
39) Please send your Regret Reply in case the subject item is not covered in your range of products
or you are not willing to submit proposal. All drawings (photo and sketches), data and technical
specification communicated by HAL with the tender documents should be returned immediately
alongwith your letter of regret and should not be disclosed / communicated to the third party.
APPLICABLE LAW
40) This contract shall be governed by and subject to and interpreted and construed in accordance
with the Laws of Republic of India, as may be in force from time to time.
INDEMNITY
41) The bidder shall at all times indemnify HAL against all claims which may be made in respect of
the stores for infringement of any right protected by patent, registration of design or trade mark.
BRIBES AND GIFTS
42) The buyer requires that the Bidders/Suppliers under this contract, observe the highest standard of
ethics during the procurement and execution of this contract. In pursuance of this policy, the
Buyer
a. Defines, for the purpose of these provisions, the items set forth below as follows.
i) “Corrupt Practice” means the offering, giving, receiving or soliciting of anything of value
to influence the action of a public official in the procurement process or in contract
execution; and
ii) “Fraudulent practice” means a misrepresentation of facts in order to influence a
procurement process or the execution of a contract to the detriment of the Buyer, and
includes collusive practice among Bidders (prior to or after bid submission) designed to
establish bid process at artificial non-competitive levels and to deprive the Buyer of the
benefits of free and open competition.
b. Will reject a proposal for placement of order if he determines that the Bidder recommended for
award has engaged in corrupt or fraudulent practices in competing for the contract in question.
c. Will declare a Bidder in-eligible, either indefinitely or for a stated period of time to be awarded
a contract/contracts if he at any time determines that the Bidder has engaged in corrupt and
fraudulent practices in competing for, or in executing, the contract.
d. Any bribe, commission, gift or advantage given, promised or offered by or on behalf of the
bidder or his parties, agent or servant or any one on his or their behalf to any officer, servant,
representative or agent of HAL or any person on his or their behalf in relation to the obtaining
or to the execution of this or any other contract with HAL shall in addition to any criminal
liability which the bidder may incur, subject the bidder to the cancellation of this and all
other contracts with HAL and also to payment of any loss or damage resulting from any such
cancellation under clauses- 19 (a) to (c) thereof. Any question or dispute as to the commission
of any offence under the present clause shall be settled by HAL in such manner and on such
evidence or information as they may think fit and sufficient and their decision shall be final
binding and conclusive.
ASSIGNMENT TO THIRD PARTY
43) Bidder shall not be entitled without HAL’s consent to assign or transfer to a third party all or part
of the benefits or obligations of this contract.
ARBITRATION:
44) A standard arbitration clause to be followed as recommended by Indian Council of Arbitration
(ICA) or International Centre for Alternative Dispute Resolution (ICADR) under the Arbitration
Act or as per laws of India are required for settling all the disputes arising out of contracts/ orders.
The award made in purchase thereof shall be binding on the parties
CANCELLATION OF THE CONTRACT IN PART OR IN FULL
45) If the Contractor, in the opinion of H.A.L., fails or neglects to comply with any of the terms or
conditions of the contract or with any order issued thereunder, then in such a case H.A.L. shall,
without prejudice to any other right or remedies under this Contract, have the right and be entitled
to cancel the contract by giving fourteen days’ notice in writing to the Contractor, without being
liable to pay any compensation for such cancellation. The contractor, however, will be entitled to
be paid at contract rates, after deduction of any amount due to the Government, for the work
already completed, which, in the opinion of H.A.L., is in accordance with the terms of the
contracts. In the event of cancellation of the contract in the circumstances aforesaid, the
Contractor shall, on demand by H.A.L. or the authorized representative thereof, hand over
immediately to H.A.L. or the authorized representative, all H.A.L. stores/components in the
possession or custody of the Contractor without waiting for the payment or even settlement of any
claim already made or intended to be made by the Contractor.
JURISDICTION
46) The Court at Jeypore / Koraput of Odisha, India only shall have jurisdiction to deal with and
decide any legal matter whatsoever arising out of this contract.
OTHER CONDITIONS
47) The applicable purchase preference to public sector enterprises/ price preference to SSI Units
registered with NSIC as per the guidelines circulated by Govt. of India shall be extended.
48) HAL does not bind itself to accept the submitted tender and reserve the right to itself of accepting
or rejecting the whole or any part of the tender or the quantity offered in full or in part without
assigning any reason thereof. Bidder will have the obligation to supply the accepted quantity at
the offered rate.
49) EMD shall not carry any interest. EMD shall be refunded after finalisation of the Tender by
Electronic Payment System (EPS) through RTGS / NEFT / directly to your Bank account.
Hence, you are requested to furnish your complete Bank details which will facilitate EMD
refund.
50) Please forward your proposal in two bids as follows:
i.
Technical bid (without price): Bidder should furnish all requisite technical details,
EMD, ‘Compliance Matrix-Terms & Conditions’ as per Annexure II duly filled in, for
confirmation of adherence to the conditions of the tender. Technical enclosures and
other information deemed appropriate in respect of this tender may also be enclosed.
Please note, this bid will not have any prices/ price details.
ii.
Commercial bid: Include the complete Price Details and Annexure I (Price Bid) duly
filled in.
iii.
Both bids should be submitted in separate sealed covers duly superscribed with the
nature of the bid i.e. Technical or commercial bid (as the case may be) along with
Tender No., Closing date of tender. The above two sealed covers are to be sent in one
single sealed cover superscribing with Tender No. and closing date indicating as
containing Technical & Commercial bid and should be addressed to.

51) a) The bids should reach at above address not later than the date and time mentioned in the tender
notification.
b) Technical bid of the complete & in time received offers will be opened on the due date and
time indicated in the Tender Notification. Bidder, if so desired, may participate in Technical Bid
opening after producing authorization / identity as per schedule indicated in the Tender
Notification. Commercial Bid of only Technically acceptable offers shall be opened, for which
opening schedule shall be intimated later.
52) Late and / or incomplete tenders shall not be opened and not considered. The tenders should be
despatched well in advance (at least 15-20 days before the due date) to reach to us within the due
date.
53) Canvassing in any manner, including unsolicited letters after submission of Tenders, or post
tenders corrections shall render offers liable for rejection.
54) Risk Purchase:
The Supplier will supply quality items and also the quantity intended in full as per terms and
conditions of purchase order. In case the Supplier fails to execute the order either in terms of
quality or in quantity, HAL reserves the right to procure from elsewhere at the risk and cost of
theSupplier and any extra expenditure incurred due to this purchase is payable by the Supplier.
55) All correspondence/communication shall be in English.
