Subject to rules and provisions of Florida East Coast Railway Company Intermodal Directory; except as
otherwise specifically provided herein. When calculation is made on a per mile basis, it will be done so
using Rand McNally Milemaker System Version 18 Practical Mileage.

APPLICATION
Provisions of this Circular apply on drayage of trailers/containers between shipper or consignee’s
place of business or designated area and the intermodal terminals of Florida East Coast Railway
Company, and other services performed as set forth herein.
Provisions apply on intermodal shipments by FEC Highway Services at Ft. Lauderdale, Ft. Pierce,
Miami, Jacksonville, Titusville Florida and Atlanta Georgia and points within the commercial zone
of these points, and govern both trailers, containers and chassis that are privately or railroad
owned.

ITEM 25
DEFINITION OF DRAYAGE SERVICE
FEC Highway Services will be compensated for providing drayage services as defined below based on
rates as set forth in Item 69 and/or 70 of this Circular.
(1) Spotting is the movement from rail ramp location to location designated by consignor or consignee, or
his agent, of empty or loaded trailer/container following inbound rail movement or of empty
trailer/container for loading and outbound rail movement.
(2) Pulling is the movement from location designated by consignor or consignee, or his agent, to rail ramp
location of empty or loaded trailer/container for outbound movement or of empty trailer/container being
returned to rail ramp after loaded inbound rail movement.
(3) Intra-plant respotting is the movement of empty or loaded trailer/container from one location to
another location at the same warehouse or within the same plant.
(4) Inter-plant respotting is the movement of empty or loaded trailer/container from one plant or
warehouse to another plant or warehouse.
(5) Bobtailing is the movement of an empty or loaded trailer/container from a location without a
matching movement from the terminal to that location.

Note 1 - On shipments moving over Dodge Island (Port of Miami), the charge will reflect $210.00 for each
round trip loaded or empty move at Miami and $240.00 from Ft. Lauderdale. In this regard, when
a shipment is delivered and/or picked up, the total assessment will apply whether a return load or
empty is handled or when the driver bobtails to or from the Island. This rate includes scale
charges.
When driver is delayed beyond one (1) hour in picking up or delivering a shipment at the Port of
Miami, a charge of $75.00 per hour, or fraction thereof, will be assessed. This charge applies
only when such delay or power detention is attributable to consignor, consignee or others
designated by time.
Note 2 - On drop and pull, one half (½) hour free time will be allowed.
Note 3 - On containers drayed from Ft. Lauderdale to Port Everglades, charge will be $145.00. On
containers drayed from Miami to Port Everglades, charge will be $170.00. This rate includes
scale charges.
ITEM 35
LOADING AND UNLOADING
(A) Carrier will not load or unload lading nor provide labor, except as provided in this Item.
(1) Loading/Unloading and Driver Count Charges – Flat rate/Minimum 1 hour
a. Unloading Charges - $75.00
b. After 1 hour:
i.
Each additional 15 minutes - $18.75
c. Power detention/waiting time accrues concurrently with unloading charges – See Item
40
d. FEC reserves the right to hire helpers (lumpers) at responsible party’s expense to
assist driver in loading/unloading a shipment.

ITEM 40
DRIVER DETENTION/WAITING TIME
(1) On all delivery applications free time when FEC is performing pick-up or delivery service, and due
to no disability, fault or negligence on the part of FEC, the loading and unloading of freight is
delayed beyond the free time of 120 minutes for loads that are palletized, slip sheeted, or floor
loaded, a charge of $18.75 for each fifteen (15) minutes thereafter, or fraction thereof, will be
applicable.
(2) Computation of time per tractor shall begin at the time the trailer/container is available for loading
or unloading and shall close when the trailer/container is released. If shipper/consignee makes
appointment on a first come, first serve basis, computation of free time shall begin at time of
trailer/container arrival at facility or at time facility opens for business, whichever is later.
(3) If consignor at origin or consignee at destination telephones carrier prior to 3:00 PM requesting
carrier to pick up trailer/container (trailer/container being available for pick up between 3:30 PM
and 5:00 PM) and, through no fault of the consignor or consignee, carrier fails to pick up
trailer/container by 11:59 PM of the day request for pick-up is made, the trailer/container will be
considered as delivered to carrier’s terminal at 11:59 PM of that day. Responsibility for protection
of the trailer/container rests with consignor or consignee until the trailer/container is actually
picked up by the carrier. Consignor or consignee must execute the following certificate, which will
be furnished carrier at time of release: “User (Consignor/Consignee) hereby certifies that carrier
was requested at (Time) on (Date) to pick up trailer/container (Trailer/container Number) for
handling to carrier’s terminal.”
(4) When carrier does not provide assistance in loading or unloading the lading, or when the power
unit does not remain with the trailer/container during the loading or unloading operation, if carrier
is delayed in reaching point of pick-up or delivery after arrival at shipper’s or consignee’s place of
business or other designated area, a charge of $18.75 for each 15 minutes, or fraction thereof,
will be assessed.
(5) Drayage service, as defined in Item 25, does not include the performance of inside collection or
delivery, except immediately inside doorway, removal from vehicle of carrier or its agents, nor does
it include sorting, packing, unpacking, erecting, dismantling, inspection of property and other similar
services.
(6) Shipments consisting of pieces or packages which, on account of weight, dimensions or physical
characteristics, cannot be handled by one (1) man will not be loaded on or unloaded from
trailer/container by the carrier, but the consignor shall be responsible for such loading, and the
consignee for such unloading. Such shipments shall not be deemed delivered to the carrier until
the loading on the carrier’s trailer/container and the responsibility of the carrier shall cease on
arrival of trailer/container at the place of delivery ready for unloading.
(7) FEC does not recognize prices on prenotes. All prices for services to be rendered must be agreed
upon in writing with the Pricing Department, FEC Railway.

FEC will provide tarping and untarping services, when required, for moving of flatbed traffic. The
charges for these services are as follows:

ITEM 42
DRAYAGE FOR VALIDATION OF CUSTOMS PAPERS
When FEC is requested to perform drayage service for validation of customs papers, a charge of
$75.00 will apply.
ITEM 43
TOLLS AND PERMITS
When FEC is required to purchase a special permit for transporting shipments to specific locations or for
specific commodities, a charge of $50.00 will be assessed to the party requesting the service.
If FEC incurs tolls when delivering a unit, the customer requesting the drayage service will be responsible
for charges.

ITEM 45
RESPONSIBILITY FOR TRAILER/CONTAINER DAMAGE
When carrier does not provide assistance in loading or unloading the lading, or when the power unit does
not remain with the trailer/container during loading or unloading operation, all damage to trailer/container
that occurs while in custody of shipper or shipper agent at origin shall be the responsibility of the shipper.
At destination, all damage to trailer/container that occurs while in custody of consignee or consignee agent
shall be the responsibility of the consignee.
ITEM 50
SPOTTING OF TRAILER/CONTAINERS FOR SHIPPER’S OR CONSIGNEE’S CONVENIENCE
When either the shipper or the consignee requests a carrier to drop or spot a trailer/container at any
specified point to load or unload, for and at their convenience, the shipper or consignee, as the case may
be, shall be responsible for any damage to cargo or property and shall indemnify the carrier against any
legal liability while such trailer/container is in his care, custody and control.
Shipper or consignee, as the case may be, shall also be responsible and shall reimburse the carrier for
any physical damage to the trailer/container while in their possession, including loss or theft of
trailer/container, or parts thereof, including tires, and shall return trailer/container to the carrier in the same
condition as when received.
ITEM 55
WEIGHING AND REWEIGHING
When a trailer/container is weighed or reweighed, either empty or loaded at request of shipper or
consignee or their agent, the charge will be $50.00 per trailer/container up to 20 miles. Over twenty (20)
miles, charges will be based on the mileage rate as found in Item 69. Service includes furnishing weight
certificate when requested via fax.
Upon request by shipper, consignee or their agent, carrier will detach tractor from trailer/containers at the
scales to secure weight of trailer/container. Additional charge for this service will be $50.00 per
trailer/container, which will be in addition to the weighing or reweighing charge.
Charges shown herein do not apply when customer has an automatic drive through scale and driver is not
required to detach trailer/container from tractor and there is no charge for weigh ticket.
When a trailer/container is weighed or reweighed with scale on premise to increase/decrease
merchandise/product, at request of shipper or consignee or their agent, the charge will $17.00 for each
additional re-weighing spot.

ITEM 56
OVERWEIGHT FINES
A carrier can only rely on the shipper’s documentation as to the amount of weight on a unit. The shipper
must take into consideration the tare weight of the vehicle, the position of the trailer/container tandems
prior to loading and the weight distribution of the lading being shipped, including blocking and bracing,
pallets or other dunnage.
No loaded unit shall be tendered to carrier for transportation when the gross weight or axle weight of such
loaded unit exceeds the maximum gross weight or maximum axle weight permissible under Federal, State
and/or Municipal weight laws via route over which transportation service is to be performed. If through
error, carrier is tendered a loaded vehicle exceeding the permissible gross weight or which exceeds the
permissible axle weight, any fines or penalties assessed to FEC will be paid by FEC, and the amount of
the fine or penalty plus a $50.00 service charge will be assessed by FEC to the party responsible for
payment of the transportation charges for the shipment or unit. A copy of the law enforcement ticket will
be furnished by FEC when billing the responsible party.
ITEM 60
CHASSIS CHARGES
Charge if carrier furnished chassis or other equipment suitable for handling containers from or to FEC
terminal location will be $15.00 per calendar day and shall be assessed for each day held.
At Ft. Lauderdale and Miami, FL, special charge for handling empty or loaded containers to or from
trailer/container storage and maintenance facilities shall be $75.00. This charge is in addition to drayage
and use charge for chassis or equipment suitable for handling containers.
ITEM 64
STOP-OFF PRIVILEGES IN CONNECTION WITH DRAYAGE (DESTINATION ONLY)
WITHIN THE TERMINAL AREAS OF STATIONS SHOWN IN ITEM 20
(A TOTAL OF THREE (3) STOP-OFFS WILL BE ALLOWED, EXCLUDING THE FINAL DELIVERY)

At stop-off points, tractor must remain with trailer/container for unloading. One-half (½) hour will be
allowed for unloading after time of arrival at delivery point. Thereafter, a charge of $18.75 for each 15
minutes thereafter, or fraction thereof, will be assessed.
If trailer/container is dropped at consignee’s request, the above stop-offs are not applicable. Drayage
charges will be assessed as otherwise provided in this Circular.

Deliveries must be accepted during normal business hours (8:00 AM to 5:00 PM) unless arrangements
are made to the contrary in advance.
Deliveries outside of the terminal areas will be charged at the published line-haul rates as found in
Item 70.
Stop-off consignee must step-down load and make secure for further move at each stop-off point.
Please Note - Above stop-off provisions and charges are applicable only on shipments moving on rate
applying to ramp at destination.
ITEM 65
FAILURE TO DELIVER STOP-OFF FREIGHT
When FEC is unable to effect delivery of a component part (stop-off of the shipment), during normal
business hours, that undelivered portion of such shipment shall then be subject to rules and regulations
governing unclaimed freight, storage and redelivery of freight, to the extent that such services are
applicable.
Stopping for partial loading or for partial unloading will not be permitted on shipments moving in carrier’s
“IN BOND SERVICE” or on shipments requiring US Customs clearance unless consigned to US Bonded
Warehouses or the entire portion for US Customs Clearance is cleared by US Customs at one time either
at the stop-off point en route to final destination point. In no case may a shipment or portion thereof be
returned to a point en route after clearance by US Customs.
ITEM 66
RECONSIGNMENT OR DIVERSION
Reconsignment or diversion requests must be confirmed in writing by the responsible party, including
confirmation of agreement to pay specific charges, (with the amount annotated) which were quoted by
FEC Pricing Department at the time of the request. These charges will be in addition to any other charges
due or the shipment as it was originally tendered. The terms of reconsignment or diversion are
synonymous within the meaning of this item and mean:

Any instructions given by responsible party necessary to
effect delivery and which require an addition to or change in billing

When a request is made for reconsignment/diversion, a diligent effort will be made by FEC to affect the
reconsignment/diversion request prior to shipment reaching the original destination point.

RECONSIGNMENT OR DIVERSION
Charges for Reconsignment/Diversion:
A charge of $75.00 per unit or shipment per reconsignment will be made in addition to all other applicable
charges.
Charges for services in this Item shall be charged to the party requesting the
reconsignment/diversion.
Pursuant to the terms of FEC leases of rail or water carrier units, FEC is charged a per diem rate for use
of such units and is charged with the responsibility of returning rail or water carrier units to the point of
receipt from the rail or water carrier. Therefore, if the reconsignment/diversion cannot be effected within
the scope of operating authority granted FEC, the unit will be retuned by FEC to the origin point of receipt
from the rail or water carrier with charges applicable from point of destination (or point where
reconsignment/diversion was placed into effect).
ITEM 67
REDELIVERY SERVICE
A charge of $25.00, in addition to the full drayage rate or additional Out-of-Route mileage charged for the
initial delivery attempt and drayage rate for subsequent delivery attempt(s) as specified in this publication
and any storage or detention charges applicable will be assessed for re-delivery service under the
following circumstances:

When delivery has been attempted by FEC and was not accomplished through no fault of
FEC.
When FEC is unable to locate consignee at the address given by the shipper, or
consignee’s location is not known to FEC at destination.
If unit is returned to the ramp terminal for storage until redelivery is scheduled, storage
and detention will be charged for each day or portion thereof that it remains on the ramp
terminal. No additional free time will be given once it is back in the terminal.
ITEM 68
REFUSED OR UNDELIVERED FREIGHT
When due to no fault or negligence by FEC, a load is refused and the trailer/container must be returned to
the terminal or storage facility, a charge for Out-Of-Route mileage, subject to a minimum charge of
$150.00, or applicable drayage charge, will be assessed against the shipper. On refused/undelivered
shipments, disposition instructions must be in printed format. Verbal instructions will not be accepted as
authority to reship, return, or reconsign a shipment nor to limit storage liability.
In addition, if above shipment is to be returned to origin, charges for movement will be assessed based on
mileage rate as found in Item 69.

MILEAGE – OUT-OF-ROUTE MILEAGE
The FEC operating system is integrated with the Rand McNally Milemaker System. Unless otherwise
indicated, all rates and charges on a per mile basis will be calculated using Rand McNally Milemaker
System Version 18 Practical Mileage.
Rates are to apply between specific points and are formulated on basis of carrier’s most direct route from,
to, or between such specific points. In addition to rate applicable, any additional mileage over that mileage
of carrier’s most direct route will be charged for at a rate of $1.50 for each additional mile, subject to a
minimum charge of $175.00, when such additional mileage is caused by conditions outlined below.

PROVISIONS FOR OS&D (OVERAGES, SHORTAGES AND DAMAGE)
When, upon delivery, there is found to be commodity overages, shortages or damages, the FEC Highway
Services driver will immediately contact FEC’s OS&D office at (305) 889-5559. The OS&D officer will call
the freight services buyer for disposition and/or instructions for handling of the shipment in question. Upon
expiration of free time, the FEC Highway Services driver will remain with the shipment for up to two (2)
additional hours awaiting disposition. If disposition instructions are not received within that time frame, the
shipment will be considered as abandoned and the merchandise will be handled through normal salvage
channels. The driver will be instructed by the OS&D office to take the merchandise to the FEC ramp or an
alternate third party warehouse. The freight services buyer will be responsible to any third party warehouse
costs associated with the disposition of merchandise and payment of all fees and charges from that
facility. The freight services buyer will be responsible for all accessorial charges related to handling
shipment, including but not limited to: drayage, waiting time, storage, detention, cleaning of trailer and
stop-offs.
For physical damages to merchandise, the OS&D office must be notified immediately so that the
opportunity is provided to inspect and verify the damages. If there is physical damage to merchandise that
is not FEC’s liability, or if the trailer is returned to the FEC facility with the merchandise, an additional
minimum charge of $128.00 local dray will be assessed for the movement and handling of damaged
merchandise. In addition, should it be necessary to have trailer cleaned because of leakage or damage to
cartons, the cleaning charges will be as follows: $55.00 per trailer when washing is not required; $128.00
when washing is required; $165.00 when steam cleaning is required.
Should the damages be as a result of FEC’s handling, a claim must be submitted promptly and with
proper documentation provided by the freight services buyer. No claim for $250.00 or less of cargo loss
or damage will be made by shipper or accepted or paid by FEC and shipper hereby waives any and all
recovery, remedies and/or rights with respect to such claims.

FUEL SURCHARGE ON DRAYAGE SERVICES
Florida East Coast Railway Intermodal Department has developed the following scale to institute and
adjust a fuel surcharge for drayage services, up or down, according to, and based upon, the U.S.
Department of Energy’s (D.O.E.) weekly average fuel price index [hereinafter “Index”]. The fuel surcharge
will be adjusted on the first Monday of each month based upon the level of the Index as announced
seven (7) days prior to that first Monday of each month, (Or Tuesday in cases where Monday is a holiday).
The fuel surcharge columns in the Scale below reflect percent (%) of the trailer/container line haul. The
scale will remain in effect until the Index falls below 121.0 cents per gallon.

Note 1 - The fuel surcharge applies to all intermodal moves.
Note 2 - Fractions resulting from the application of the fuel surcharge will be dropped if less than one-half
cent and fractions of one-half cent or greater will be increased to the next whole cent.
Note 3 - The fuel surcharge will be computed and stated separately on each invoice by multiplying the
freight rate by the applicable fuel surcharge percentage.
Note 4 – Should the cost of fuel increase beyond the above matrix, the percentage increase will be .5% for
every $.04 increase in DOE fuel price index.
ITEM 73
RULES GOVERNING SPOTTED TRAILERS
When FEC provides door-to-door or door-to-ramp service using FEC Highway Services or a contractor
thereof, the shipper is allowed day of drop of trailer, plus 3 working days to load same trailer. Once free
time has expired, charges as set forth in Item 440 of the FEC Intermodal Directory will apply. They are as
follows:
Day 1-3 - $25.00/Day
Day 4+ - $50.00/Day
