Reflective triangle placement diagram: 4 LIABILITY AND THE LAW What would happen if you were involved in an accident in which a child is injured? There is a very real possibility that the child’s parents will sue both the district and you for damages. They may claim that negligence on your part caused the accident and the ensuing injuries to the child. Proving this in court is difficult. If you were using school equipment in school functions, the school district will defend you and itself. Generally speaking, the school district would protect you from paying damages. However, if you were significantly out of compliance with driver’s rules and regulations or district policies, or if you did not follow standard practices and procedures, you could be held personally liable for punitive damages. Your best protection is to know and follow all district policies and procedures to the letter. As long as you are doing your job correctly and competently, you will not be personally held liable for damages. A few things to remember: Do not take any medications that may impair your driving ability. This includes prescriptions and over-the-counter medications. Look for warning labels. Complete all pre and post-trip inspections thoroughly. Stop for red lights, stop signs and pedestrian traffic. Do not turn right on red lights without sufficient sight. Do not exceed the speed limit.
