Noble Furniture Repair and Restoration,
Worcester County - On June 25 MDE
issued a complaint and order and
administrative penalty to Noble Furniture, located in Worcester County. The
order was issued for discharge of
stripping solvents onto the ground,
illegal disposal and storage of hazardous
waste. A penalty of $15,000 was
assessed.
Status: Pending (Ref # Co-99-032).
Lead Program Enforcement – June 1June 30, 1999 – a total of $22,730 in
fines were assessed to property owners

Bethlehem Steel Corporation - Baltimore County – On June 25, 1999,
Bethlehem Steel Corporation paid a
$5,000 stipulated penalty to the Clean
Water Fund in settlement of the April
1999 monthly average zinc effluent
violation at Outfall 101. This penalty was
assessed in accordance with the
requirements of Consent Order CO-980002.

M.G. Industries – Howard County – On
June 17, 1999, MDE reached a settlement
with M.G. Industries to resolve NPDES
permit violations. M.G. Industries has
agreed to pay a $4,500 administrative
penalty to the Clean Water Fund for
recent pH effluent violations.
Status: Case closed. (Reference # PS99-0107).
GAF Corporation – Baltimore County –
On June 11, 1999, MDE reached a
settlement with GAF to resolve NPDES
permit violations and unauthorized
discharges. GAF has agreed to pay an
administrative penalty of $5,000 to the
Clean Water Fund.
Status: Case closed. (Reference # PS99-0098).
City of Hagerstown – Washington
County – On July 1, 1999, MDE assessed
an administrative stipulated penalty of
$1,525 to the City of Hagerstown for
delays in construction of the Hamilton
Run collection system improvements.
The penalty was assessed pursuant to
the April 19, 1995 Consent Order.
Penalty payment is due by July 31, 1999.

Owens Corning, Inc. – Howard County On June 30, 1999, MDE reached a
settlement with Owens Corning to
resolve NPDES permit effluent violations.
Owens Corning has agreed to pay an
administrative penalty of $1,500. The
penalty was assessed pursuant to the
requirements of administrative Consent
Order CO-98-0002.

Deleon Access Floors – Howard County
- On June 18, 1999, MDE issued a
Corrective Order to Deleon Access
Floors for installing and operating an
access floor manufacturing facility
without first obtaining the required
construction and operating permits. The
plant emits volatile organic compounds
into the atmosphere. A public notification and review process is required
before issuance of the permit. The
Corrective Order requires the Company
to immediately cease operation of the
equipment until the required permits
have been obtained.
Status: The Company has 10 days to
appeal the Order. (Reference # 99-04-01)
New England Container – Baltimore
County - On June 18, 1999, MDE finalized
a Consent Order with the New England
Container Company to address violations of volatile organic compound
(VOC) emission requirements. The
Company refurbishes and paints metal
drums. The Company exceeded a permit
condition limiting the amount of VOCs
they were allowed to emit. The Consent
Order requires the Company to install a
control device to achieve compliance and
to pay a $30,000 penalty for past noncompliance.
Status: Case Closed. (Reference # CO99-06-01)
BGE Brandon Shores – Anne Arundel
County -On July 6, 1999, MDE entered
into a Consent Order with Baltimore Gas
and Electric Company (BGE) to resolve
violations of nitrogen oxide (NOx)
emission standards that occurred at the
Brandon Shores Generating Station. The
Order requires BGE to pay a $30,000
penalty and perform a Supplemental
Environmental Project (SEP) to evaluate
and improve energy efficiency at a
school in the vicinity of the Brandon
Shores Generating Station. In response
to a Corrective Order previously issued
by MDE, BGE has corrected the violations and is now operating in compliance
with the NOx standards.

Fort Meade will begin an extensive restoration
project that will benefit wildlife habitat and aid
in pollution reductions under a February 1999
settlement with the Maryland Department of the
Environment. The project is in lieu of a
$75,000 penalty for waste management violations and resultant contamination at the military
installation’s Defense Reutilization and Marketing Office (DRMO) Salvage Yard.
Commonly referred to as the Burba Lake
Project, the enhancement effort will include
establishment of riparian vegetation buffers,
stream bank stabilization, the removal of a
concrete aqueduct, and other components to
control run-off.
The approximately 700-foot stream segment
located above Burba Lake is a relatively straight
channel that supports little stream bank vegetation. The stream characteristically receives
sporadic high water which has resulted in
stream bank erosion and scouring of the stream
channel allowing increases of nutrients and
sediment into Burba Lake.
Logs will be anchored at locations in the main
channel of the stream to form check dams.
These structures will reduce stream channel
scouring and stream bank erosion by reducing
the pace of the flowing stream. Additional
shallow pool stream habitat also will be provided by the structures.
Wetlands and riparian vegetation buffers will
be created. As part of the project, the current
stream configuration will be modified to include
a shallow overflow wet meadow plant community. This wetlands area will allow a portion of
high water flows to be detained and filtered.
The wetlands plant community will be composed primarily of native Maryland plants.
Additionally, an upland vegetation buffer, 15-

Below - In addition to providing wildlife habitat, an
upland buffer will intercept water runoff and should
improve water quality.
25 feet wide, will be created along the entire
stream segment. This area will be a no-mow
zone to allow vegetation to re-establish through
natural succession. In addition to providing
wildlife habitat, the upland buffer will intercept
water runoff and should improve water quality.
A concrete flume, which currently delivers
stormwater runoff to the stream, will be removed.
The remaining swale and adjacent areas will be
established with native shrubs and grasses.
Aside from the aesthetic benefits, the project
will reduce the water flow and promote infiltration
of overland flows to help reduce the movement
of nutrients and sediment. The function,
composition and structure of the plant community will be enhanced and also will provide
wildlife habitat.
Fort Meade must spend at least $75,000 on
the enhancement project and provide MDE with
documentation of the associated costs. Fort
Meade is currently pursuing appropriate permits
from MDE, the U. S. Army Corps of Engineers
and Anne Arundel County before the project
may begin.
