[No. 3243 ' Schedule to this Act forms part of the land described in the Second Schedule to this Act: And whereas it is expedient to provide that so far only as relates to so much of the land described in the Second Schedule to this Act as is described in the Third Schedule to this Act and is defined as hereinafter provided, the construction on such land and the maintenance and operation of the tramway by this Act authorized to be constructed and of all proper works and conveniences in connexion therewith may be carried out and effected notwithstanding anything in the hereinbefore recited Crown erant: Be it therefore enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) :— short title 1 . This A c t m a y be cited as t h e Melbourne to West and citation. Brunswick Tramway Construction Act 1922 and shall be read and construed as one with the Melbourne and Metropolitan NOS. 2995,3023, Tramways Act 1918 (hereinafter called the Principal Act) 3074, and any Act amending the same all of which Acts and this Act may be cited together as the Melbourne and Metropolitan Tramways Acts. Authority to SortSot40 2 . The Board is hereby authorized under and subject to the Melbourne and Metropolitan Tramways Acts to construct the following electric tramway in the line and rirst schedule, upon the lands described in the First Schedule to this Act, and all proper works and conveniences in connexion therewith, that is to sav:— A double track electric tranway commencing in William-street in the city of Melbourne on the north side of Collins-street and terminating at Moreland-road the boundary between the city of Brunswick and the citv of Coburff. provisions as to construction. 3 . (1) The following provisions shall apply to the construction of the permanent way of the said tramway:— (a) In Peel-street and Flemington-road in the city of Melbourne the tracks may be laid in any portion of such street or road set aside bv the council of 13. [No. 3243; of the city of Melbourne to be used exclusively for tramway purposes which portion the said council is hereby authorized to set apart ; and (b) Through the Royal Park the tracks may be constructed of open ballast railway design and shall be fenced and provision shall be made for all openings required for access to the tramway or for cross thoroughfares together with the necessary protection therefor and all necessary culverts subways and other works ; and all crossings under over or on any line of railway shall be made by arrangement with the Victorian Railways Commissioners. (2) Except as provided in this Act and in paragraph (c) of sub-section (2) of section fifty-two of the Principal Act the tramway shall be constructed laid and maintained in such a manner that the uppermost surface of the rails shall be on a level with the surface of the road. 4 .
