The Lieutenant-Governor in Council:
The undersigned has the honour to report:
THAT certain land located in School District No. 1 (Fernie), known
as the old Grasmere School property, and more particularly known and described
as follows:
That piece of land situate in the Kootenay District, Province
of British Columbia, particularly known and described as:Part of Subdivision Sixteen (16) of District Lot Three hundred
and fifty seven (357), Plan X Twelve (X12), the said part being
more particularly described as follows:- Commencing at an
iron pin which is twenty-five hundredths (0.25) chains south of
a post planted on the North boundary of said lot Three hundred and
fifty-seven (357), which is twenty-five and two hundred and five
thousandths (25.205) chains West of the North East corner of said
lot, thence South three degrees thirty-three minutes East
(S 3° 33"E) four and five hundred and fifteen thousandths (4. 515)
chains thence West two and twenty-seven hundredths (2.27) chains
thence North three degrees forty-four minutes West (N3° 44'1 W)
four and one hundred and twenty-five thousandths (4. 125) chains,
thence North forty-three degrees eight minutes East (N43° 08"E)
five hundred and forty-seven thousandths (0.547) chains thence
East one and eight hundred and eighty-five thousandths (1.885)
chains to the point of Commencement.
is now registered in the name of the Board of School Trustees of Grasmere
which no longer exists:
AND THAT title to this property, being No. 30249-I, should become
vested in School District No. 1 (Fernie) by virtue of section 176 of the Public
Schools Act:
AND TO RECOMMEND THAT under section 176 of the Public Schools
Act the title to this property be vested in the Board of School Trustees of School
District No. 1 (Fernie):
AND FURTHER TO RECOMMEND THAT the Registrar of the Land
Registry Office , Nelson, be authorized and directed to issue title to the land
described herein to the Board of School Trustees of School District No. 1 (Fernie)
upon compliance with the conditions set forth in the Public Schools Act and the
Land Registry Act, except payment of Ad Valorum and Assurance Fund fees
under the second Schedule of the Land Registry Act:
AND TO RECOMMEND FURTHER THAT in accordance with a
resolution of the said Board of School Trustees of School District No. 1
(Fernie) and pursuant to the provisions of section 169 (4) of the Public Schools
Act, the above described land, which is no longer required for school purposes,
be returned to Mr. James Lancaster who donated the land for school purposes
in 1922 with the proviso that it be used for no other purpose.
