CONCERNING
ASSIGNMENT TO PT. PERUSAHAAN LISTRIK NEGARA (PERSERO)
TO ACCELERATE THE DEVELOPMENT OF ELECTRIC POWER GENERATION
USING COAL
BY THE GRACE OF GOD ALMIGHTY
PRESIDENT OF THE REPUBLIC OF INDONESIA,
Considering:

that in order to accelerate the diversification of energy for power generation to a nonpetroleum fuels in order to meet the needs of electric power, it is necessary to accelerate the
construction of power plants that use coal and is ready to operate in 2009;
that the accelerated development of power referred to in letter a okum require certainty in
the process of land procurement;
Based on the considerations referred to in letters a and b, it assigns PT. Perusahaan Listrik
Negara (Persero) as the Holder of Electricity Business Authority to accelerate the construction
of power plants using coal in Presidential Decree;

(PERUM) Listrik Negara to become PT. Perusahaan Listrik Negara (Persero) (State Gazette Year
1994 Number 34);
Presidential Decree Number 80 Year 2003 on Guidelines for Procurement of Goods / services
of the Government (State Gazette of the Republic of Indonesia Year 2003 Number 120,
Additional State Gazette of the Republic of Indonesia Number 4330), as amended by
Presidential Decree No. 8 of 2006;
Presidential Regulation Number 36 Year 2005 on Land Procurement for Development
Implementation for Public Interest as amended by Presidential Regulation Number 65 Year
2006;
DECIDED:
To Stipulate : REGULATION OF THE PRESIDENT OF THE ASSIGNMENT TO PT. PERUSAHAAN LISTRIK
NEGARA (PERSERO) TO ACCELERATE THE DEVELOPMENT OF GENERATING ELECTRICITY

The Government assigns to PT. Perusahaan Listrik Negara (Persero), hereinafter referred to PT
PLN (Persero), to organize the procurement of the construction of power plants using coal at
the site and with the operating schedule of the project as contained in the Appendix hereto.
Procurement of development of power plants as referred to in section (1) including the
development of related transmission.
In the event of adjustment of the operating schedule of the project as referred to in section (1)
determined by the Coordinating Team to Accelerate Power Plant Development.

In the case of PT PLN (Persero) conduct development of power as referred to in Article 1 with
the cost of the funds that are not binding, carried out through an open auction method.
In the case of PT PLN (Persero) conduct development of power referred to in Article 1 at a cost
of binding funds, it can be done through the direct election method.
In implementing the development of power plant quickly as referred to in Article 1, then all
the permissions related to Environmental Impact Assessment (EIA), exemptions and
compensation of transmission lines, and the land acquisition process will be completed within
a maximum period of 120 (one hundred and two twenty) days by the agencies / officials
authorized since it was first proposed.
The implementation of procurement of development as defined in Article 1, implemented
based on the principle of efficient, effective, transparent, fair, and accountable.
PT PLN (Persero) submit a report once every 1 (one) month of the implementation of
procurement of power plant development as referred to in Article 1 to the Minister of StateOwned Enterprises, Minister of Finance and Minister of Energy and Mineral Resources.
Article 3
State Minister for State Owned Enterprises to guide and control development procurement of power
plant as referred to in Article 1.
Article 4
Development of power plants are done by prioritizing the use of domestic products over quality and
price are eligible to compete.
Article 5
This Presidential Regulation shall come into force on the date of stipulation to the date of December
31, 2009.
