Explosives Regulation 1955 s2 EXPLOSIVES REGULATION 1955 [as amended by all amendments that commenced on or before 1 July 2002] PART 1—PRELIMINARY 1 Short title This regulation may be cited as the Explosives Regulation 1955. 2 Definitions In this regulation— “ammunition” means a class 1, 2, 3, 4 or 5 explosive (other than when in a firework) enclosed in a case or device, or adapted or prepared to form any of the following— (a) a cartridge or charge for small arms, cannon, or another weapon, or for blasting; (b) a safety or other fuse for blasting or for shells; (c) a tube for firing explosives; (d) a percussion cap, detonator, fog signal, shell, torpedo, war rocket or a similar device. “approved form” means a form approved by the chief executive. “chlorate mixture” means an explosive containing a chlorate and includes a chlorate preparation consisting partly of nitroglycerine or another liquid nitro compound. “danger building” means a building that contains, or usually contains— (a) an explosive; or (b) an ingredient of an explosive that is capable of forming an explosive if it is mixed with any other thing contained, or usually contained, in the building. “dangerous substance”, for part 9, means— s2 8 Explosives Regulation 1955 s2 (a) coal gas; or (b) ethylene; or (c) acetylene; or (d) another unsaturated organic compound or substance that is claimed to have ripening or colouring properties. “detonator” means a capsule or case of a strength and construction containing a class 5 explosive in such quantity that the explosion of 1 capsule or case will cause similar capsules or cases near it to explode. “explosive of doubtful quality”, for schedule 3, means an explosive that an inspector considers does not have the composition, quality and character mentioned for the explosive in the register of explosives. “factory magazine” means any part of a factory, consisting of a building or part of a building, that contains, or usually contains— (a) an explosive made in the factory; or (b) a partly made explosive, other than gunpowder, that was made in the factory; or (c) the ingredients for an explosive, other than gunpowder, intended for use in making an explosive in the factory. “firework” includes firework composition and manufactured fireworks. “firework composition” means a chemical compound or mechanically mixed preparation of an explosive or inflammable nature used for making manufactured fireworks, not included in class 1, 2, 3, 4, 5, or 6, and includes a star and a coloured fire composition. “fulminate” means a chemical compound or mechanical mixture, whether or not in class 1, 2, 3 or 4 that— (a) is suitable for use in a percussion cap or another appliance for causing detonation because of its great susceptibility to detonation; or (b) is especially dangerous because of its extreme sensitivity to explosion and great instability (its readiness to undergo decomposition). “gunpowder” includes black powder and blasting powder. “initiate” an explosive means fire, explode or ignite the explosive. s2 9 Explosives Regulation 1955 s2 “manufactured fireworks” means a class 1, 2, 3, 4, 5, or 6 explosive or a firework composition, enclosed in a case or device or manufactured to form any of the following, and includes a substantially constructed and hermetically closed metal case containing not more than 450 gm of coloured firework composition of such a nature as not to be liable to spontaneous ignition— (a) a squib, cracker, serpent, rocket (other than a war rocket), maroon, lance, wheel, chinese fire, roman candle, aluminium torch, magnesium torch, sparkler; (b) another article adapted for producing pyrotechnic effects or pyrotechnic or sound signal. “manufactured fireworks (shop goods)” see section 5A. “nitrate mixture” means a preparation (other than gunpowder) formed by mechanically mixing a nitrate with any form of carbon or carbonaceous substance with no explosive properties, whether or not the preparation has sulphur added to it or another non-explosive substance is mechanically mixed with it. “nitro-compound” means a chemical compound with explosive properties, or capable of combining with metals to form an explosive compound, produced by the chemical action of nitric acid (whether or not mixed with sulphuric acid), or a nitrate mixed with sulphuric acid, on a carbonaceous substance, whether or not the compound is mechanically mixed with another substance. “percussion cap” does not include a detonator. “road” has the meaning given in the Transport Operations (Road Use Management) Act 1995. “safety fuse” means a fuse for blasting that— (a) burns and does not explode; and (b) does not contain its own means of ignition; and (c) is of a strength and construction, and contains an explosive in a quantity that the burning of the fuse will not ignite other fuses in contact with it. “the Code” means the Australian Code for the Transport of Explosives by Road and Rail. “travel expenses” of an inspector who has to examine, test, inspect or sample explosives under the Act, for schedule 3, means— s3 10 Explosives Regulation 1955 s 5A (a) the cost of travel; and (b) the expenses the inspector is entitled to under the Public Service Management and Employment Act 1988. 3 Meaning of “containing its own means of ignition” In this regulation, a reference to an explosive “containing its own means of ignition” means that the explosive contains, or is attached to, a thing capable of initiating the explosive by friction or percussion. 4 Fees Schedule 3 sets out the fees payable under the Act. 5 Classification of explosives Unless otherwise stated, explosives are classified in schedule 4.1 5A Declaration of “manufactured fireworks (shop goods)”—Act, s 33 For the Act, section 33, the following explosives are declared to be manufactured fireworks (shop goods)— 1 • amorces • indoor table bombs • model rocket motors • snaps for bon bon crackers • sparklers • straitline starting pistol caps • streamer cones • toy pistol caps. See section 30 (Classification of explosives) for the classification of explosives for part 5 (Carriage of explosives). s6 6 11 Explosives Regulation 1955 s6 Exemptions (1) Subject to this section, the chief inspector may, by writing— (a) grant to a person an exemption from compliance with a provision of this regulation, other than a provision relating to the payment of fees; or (b) subject an exemption to conditions; or (c) revoke an exemption. (2) An exemption must specify— (a) the person to whom it applies; and (b) the provisions of this regulation to which it relates; and (c) any conditions to which it is subject. (3) The chief inspector may not grant an exemption to himself or herself. (4) The chief inspector must not grant to a person an exemption from compliance with a provision of this regulation unless satisfied that— (a) the person has taken action that is at least as effective in achieving the purpose of the provision as compliance with the provision; or (b) compliance with the provision is otherwise unnecessary in the person’s circumstances, having regard to the purpose of the provision. (5) This section applies in respect of a class of persons in the same way that it applies in respect of a person. (6) If the chief inspector grants an exemption to a class of persons, the chief inspector must publish a copy of the exemption in the gazette. (7) If— (a) the chief inspector grants to a person, or to a class to which a person belongs, an exemption from compliance with a provision; and (b) the person complies with any conditions to which the exemption is subject; the person is not required to comply with the provision. s7 12 Explosives Regulation 1955 s9 PART 2—ADMINISTRATION Division 1—Inspection 7 Inspection Every person shipping, trans-shipping, or discharging from any vehicle or vessel, conveying in any vehicle or vessel, storing, keeping, using, or manufacturing any explosive shall, for the purpose of examination, at the request of an inspector of explosives, or any person duly authorised in writing by an inspector of explosives, open or cause to be opened at a government magazine, or any other place approved by an inspector or authorised person, any or every case or package containing explosives, and shall deliver or cause to be delivered without payment to such inspector or authorised person samples of such quantity as such inspector or authorised person may deem necessary and shall at once and without delay fasten or cause to be fastened safely and securely any package which may be so opened. 8 Samples (1) An inspector of explosives and any person authorised by an inspector of explosives for the purpose may keep and convey any sample taken for the purpose of this Act so that the amount of it does not exceed what is reasonably necessary for the purpose of enabling such inspector or authorised person to perform his or her duties under this Act. (2) It shall be kept and carried with all due precautions to prevent accident; and such inspector or authorised person shall not be liable to any penalty, punishment or forfeiture under this or any other Act for so keeping or conveying such sample. Division 2—Licences 9 Requirement to be licensed (1) A person shall not import, export, manufacture, carry or use a vehicle to carry, be in possession of, store, sell or use any explosive unless the person is licensed or permitted to do so under the provisions of the Act. s 10 13 Explosives Regulation 1955 s 11 (2) A person shall not give away, hand over, leave unattended or abandon any explosive or conduct any dealings in explosives which are not authorised or licensed under the provisions of the Act. 10 Licences (1) All applications for licenses shall be made in duplicate to the chief inspector of explosives in the approved form and accompanied by the prescribed fee. (2) On approval of the application the licence shall be issued but the chief inspector in his or her discretion may refuse his or her approval to any application. (3) Every licence issued shall be valid only for the person to whom it is issued. (4) A licence when issued shall be granted subject to any terms and conditions specified in the Act and to any further conditions specified in the application, and in the licence and all drawings descriptions and specifications submitted with the application and which have been approved shall be deemed to be conditions of the licence and be part of it. (5) Licenses shall not be transferred except with the approval of the chief inspector of explosives and on payment of the prescribed fee. (6) An application for a shotfirer’s licence or a shotfirer’s (restricted) licence shall be accompanied by 2 passport sized photographs of the applicant. 11 Renewal of licences (1) Every licence shall terminate on 30 June next following the date of issue but may be renewed from year to year in the manner prescribed. (2) Applications for renewals of licences shall be made in the approved form and shall be accompanied by the prescribed fee. (3) Applications for renewals of licences shall be lodged with the chief inspector on or before 1 June in each year. (4) The chief inspector may in the chief inspector’s discretion grant or refuse any renewal. (5) If the chief inspector in the exercise of the chief inspector’s discretion grants a renewal of a licence the chief inspector shall— s 12 14 Explosives Regulation 1955 s 14 (a) issue a renewal certificate in the approved form; or (b) endorse the licence accordingly. (6) When a renewal certificate has been issued in respect of any licence or a licence has been endorsed, that licence shall be deemed to be renewed, subject to the same terms and conditions as the original licence was subject, until 30 June of the year next following. 12 Replacement licences (1) Where a licence granted under this regulation has been destroyed, damaged or lost, the chief inspector of explosives may, upon application by the licensee in the approved form and payment of the prescribed fee, issue a duplicate copy of the licence to the licensee and such duplicate copy shall have effect in substitution for the licence so destroyed, damaged or lost. (2) An application for a duplicate copy of a shotfirer’s licence or a shotfirer’s (restricted) licence shall be accompanied by 2 passport sized photographs of the applicant. PART 3—IMPORTATION AND EXPORTATION 13 Unlicensed importation or exportation Any explosive imported into or exported from Queensland by any person who does not hold a licence to import and export under the authority of the Act may be forfeited and destroyed or otherwise disposed of as the Minister may direct. 14 Prohibited and restricted explosives For section 17A of the Act, explosives in schedule 5 must not— (a) be brought into, or sent out of Queensland; or (b) be manufactured, kept, stored, carried, sold or used in Queensland. s 15 15 15 Explosives Regulation 1955 s 17 Unauthorised explosives Except as provided for under section 17(2) of the Act, no person shall import into or export from Queensland any explosive which is not an authorised explosive. 16 Licence to import or export Applications for a licence to import into or export from Queensland explosives shall be made to the chief inspector of explosives, and shall contain the name in full, occupation, and address of the applicant, the class, division, and name of the explosive to be imported or exported, the place where it is intended to import or export, and the mode of transport, and be signed by the applicant. 17 Requirements before importing or exporting (1) In the case of any explosive other than explosives of division 1 of class 6 (ammunition), a person shall, before importing or bringing into Queensland or exporting from Queensland any such explosive, give notice in writing to the chief inspector of explosives and to the officer in charge of the government magazines, if the explosive is for storage in a government magazine, of the name of the explosive, the quantity of the explosive which it is desired to import or export, the place where the explosive is to be imported or exported, and the date when the explosive is expected to arrive or leave. (2) The notice shall be delivered not less than 7 days before the expected arrival into or dispatch from Queensland of the explosive. (3) In the case of any explosive of division 1 of class 6 (ammunition) other than safety cartridges, the holder of a licence shall, before importing or bringing into Queensland any such explosive, give notice in writing to the chief inspector of explosives of the name of the explosive, the quantity of the explosive which it is desired to import, the place where the explosive is to be imported, and the date when the explosive is expected to arrive, and such notice shall be delivered not less than 7 days before the expected arrival of the explosive. (4) In the case of safety cartridges of division 1 of class 6 (ammunition), the holder of a licence shall, before importing or bringing into Queensland in the first instance any such safety cartridges, submit samples of such safety cartridges to the chief inspector of explosives and obtain the approval thereof of the chief inspector of explosives. s 18 16 Explosives Regulation 1955 s 22 (5) The holder of a licence shall also within 21 days of the end of every month furnish to the chief inspector a return showing the brand, type, and quantity of each kind of approved safety cartridge imported into the State within the preceding month. 18 Importation or exportation contrary to notice A person shall not import into or export from Queensland any explosive at any place or in any quantity other than in accordance with the information submitted when giving notice as prescribed by section 17. 19 Transferring explosives A licensee or any other person shall not transfer or cause to be transferred any explosive from the vessel or vehicle in which such explosive was imported to any other vessel or vehicle until permission has been granted for such transfer by an inspector of explosives. 20 Temporary storage Any explosive imported into Queensland and intended for export from Queensland may be temporarily stored in a government magazine under such conditions as an inspector of explosives may deem necessary for public safety; such temporary storage shall be deemed to be an importation. 21 Inspection certificate No explosive shall be cleared at the Customs House without a certificate from an inspector of explosives that the explosive has been inspected and is certified as safe for transport, storage, and use. 22 Responsibility for short shipments The Minister, the chief executive (under the Transport Operations (Marine Safety) Act 1994), or the chief inspector of explosives shall not be held responsible for any short shipments made through any omissions of the exporter to furnish a proper notice in writing of such shipment or for any incomplete arrangements for the same or for delivery at other than hours duly appointed of any explosive which may be short shipped. s 23 23 17 Explosives Regulation 1955 s 24 Short shipments Any explosive short shipped may remain at a government magazine pending the arrival of another vessel; or if already delivered and the exporting vessel be not ready within 8 hours after such delivery to receive same then such explosive shall be returned to a government magazine or retained in a licensed vessel subject to the approval of an inspector of explosives at the cost of the exporter, owner, or agent, and storage may be charged at such rates as would have been levied if such explosive had not been delivered. PART 4—MANUFACTURE 24 Licences to manufacture explosives (1) Applications for a licence for the manufacture of explosives shall be made to the chief inspector of explosives, shall contain the full name and address of the applicant, and shall specify the situation, character, and construction of all buildings, mounds, and works, existing or proposed on the site of, or connected with, the factory, and such of the following matters as are applicable— (a) the nature of and the place at which each process of manufacture and each description of work is to be carried on; (b) the place at which explosives and ingredients of explosives and any articles which are inflammable or otherwise dangerous are to be kept; (c) the amount of explosives and ingredients thereof, wholly or partially mixed, to be allowed at any one time in any building or machine, or in any process of manufacture; (d) the maximum number of persons to be employed in each building or room; (e) any special conditions. (2) The application shall be accompanied by a plan, drawn to scale, of the proposed factory. (3) The chief inspector of explosives may refuse the application or may endorse it with or without modification of or addition to the conditions. s 25 18 Explosives Regulation 1955 s 26 (4) On the endorsement of any application for a licence for the manufacture of explosives the applicant shall complete the factory and the arrangement thereof, in accordance with the conditions of the endorsed application and to the satisfaction of the chief inspector of explosives, before approval is granted and the licence issued. (5) For the purposes of the provisions of this part with respect to the manufacture of explosives, all buildings and places adjoining each other and occupied together shall be deemed to be the same factory, and shall accordingly be included in one licence. (6) The person who applies for and to whom a licence to manufacture explosives is issued shall be deemed to be the occupier. 25 Factory rules (1) Every occupier of a factory shall, with the sanction of the chief inspector of explosives, make special rules for the regulation of the persons managing or employed in or about such factory, with a view to securing the observance of this Act therein, and the safety and proper discipline of the said persons and the safety of the public. (2) The occupier may, and if required by the chief inspector of explosives shall, with the sanction of the chief inspector of explosives, repeal, alter, or add to any special rules made in pursuance of this section. (3) If an occupier is required by the chief inspector of explosives to make, repeal, alter, or add to any rules under this section and fails within 3 months after such requisition to comply therewith to the satisfaction of the chief inspector of explosives, the chief inspector of explosives may make, repeal, alter, or add to the special rules, and anything so done by the chief inspector of explosives shall have effect as if done by the occupier with the sanction of the chief inspector of explosives. 26 Licensed factories The following provisions shall apply to all factories licensed to manufacture explosives— (a) neither the factory nor any part thereof shall be used for any purpose whatever not in accordance with the licence; (b) the conditions of the licence shall be duly observed, and any breach of or noncompliance with any of such conditions shall be deemed to be a breach of this regulation; s 26 19 Explosives Regulation 1955 s 26 (c) the factory and every part thereof shall be kept and maintained strictly in accordance with the licence, and no material alteration whatsoever in the factory shall be made without the written approval of the chief inspector of explosives; (d) the quantity of any explosive, or ingredients, that may be placed or stored at any time in any factory or in any part thereof shall not exceed such quantity as may be prescribed in the licence; (e) every factory magazine shall be used only for the keeping of such explosives and of such ingredients thereof as may be specified in that behalf in the licence, and of such tools or implements as are required for work connected with the keeping of such explosives and ingredients; (f) the manufacture, or keeping, or any process in, or work connected with, the manufacture or keeping of explosives, shall not be carried on except under the conditions approved by the chief inspector of explosives; (g) every building in which an explosive or any ingredient thereof which by itself is possessed of explosive properties, or which when mixed with any other ingredient or article also present in such building is capable of forming an explosive mixture or an explosive compound, is kept or present, or in the course of manufacture is liable to be, shall, unless specially exempted by the licence or by an order of the chief inspector of explosives, be deemed to be a danger building, and the interior of every such building and the fittings and equipment in such building shall be so constructed as to avoid unnecessary risks and shall, so far as is reasonably practicable, be kept free from grit and otherwise clean; (h) before any repairs are effected to any part of a danger building, that part shall, so far as practicable, be cleaned under skilled supervision, and to the satisfaction of an inspector of explosives, by the removal of all explosives and ingredients thereof and by the thorough washing of such part, or by any other suitable process; and such part of the building after being so cleaned shall not be deemed to be a danger building within the meaning of this regulation until an explosive or any ingredient thereof is again taken into it; (i) there shall be constantly affixed to every danger building, in such manner as to be easily read, a statement showing the maximum s 26 20 Explosives Regulation 1955 s 26 number of persons and the maximum quantities of explosive or ingredients thereof allowed to be in the building at any one time, the distinguishing number of the building as shown in the licence, and a copy of such conditions, rules or regulations as may be required by the chief inspector of explosives to be so affixed; (j) if required by the chief inspector of explosives, suitable and efficient lightning conductors shall be erected and maintained on the factory or any part thereof; (k) all tools and other implements used in a danger building shall be made only of wood, or copper, or brass, or some soft metal or material, or shall be covered with some safe and suitable material, and shall be limited to the actual working requirements of the room; (l) the outer clothing of all workers engaged in any danger building shall be of woollen or other non-inflammable material, and due provision shall be made, by the use of suitable working clothes without pockets, suitable shoes, searching, and otherwise or by some of such means, for preventing the introduction into any danger building of any iron, steel, or grit, or other article likely to cause explosion or fire; (m) wherever danger may arise from foreign matter being present with the explosive or any ingredient thereof, all ingredients to be made or mixed into explosive shall, before being so made or mixed be carefully examined, sifted, and otherwise treated for the purpose of removing therefrom, or excluding, so far as practicable, all such dangerous foreign matter; (n) no person shall smoke in any part of the factory except in such part as may be allowed by the special rules made in accordance with the provisions of section 25; (o) any person before entering the factory shall examine the person’s clothes to see that the person has no matches or other dangerous articles in the person’s pockets or about his or her person, and the occupier shall satisfy himself or herself that such examination is carefully carried out and that all persons employed in that factory are duly searched from time to time; (p) no person under the age of 18 years shall be occupied in or enter any danger building except in the presence or under the supervision of some responsible person; s 26 21 Explosives Regulation 1955 s 26 (q) any vehicle or vessel in which explosive, or any ingredient thereof which by itself is possessed of explosive properties or which when mixed with any other ingredient or article also present in such vehicle or vessel is capable of forming an explosive mixture or an explosive compound, is conveyed from one part of a factory to any other part or to a place outside of such factory, shall, unless specially exempted by the licence or by an order of the chief inspector of explosives be constructed without any exposed iron or steel in the interior thereof, and shall be closed or otherwise properly covered over; and the explosive and ingredients shall be so conveyed with all due diligence and with such precaution and in such manner as will sufficiently guard against any accidental ignition or explosion; provided that so much of this regulation as applies to the exclusion of iron and steel shall not be obligatory in the case of a vehicle or vessel in which no explosive other than explosive of division 1 of class 6 (ammunition) is conveyed; (r) every ingredient in course of manufacture into explosive which by itself is possessed of explosive properties or which when mixed with any other ingredient or article also present in any working building is capable of forming an explosive mixture or an explosive compound, shall be removed with all due diligence from such working building as soon as the process connected with those ingredients which is carried on in such building is completed and all finished explosive shall with all due diligence be either removed to a factory magazine or conveyed from the factory; (s) all explosives intended for conveyance from a factory shall be packed and marked in accordance with section 31 relating to the packing of explosives; (t) no broken or defective cases or boxes containing explosive shall be admitted into a factory magazine; (u) the doors of every magazine shall be kept securely locked except at such time as explosives are being placed into such magazine or are being removed therefrom; (v) the keys of all danger buildings in connection with the factory shall remain in charge of a person duly authorised in writing by the occupier, and shall be at any time available if required by an inspector of explosives; s 26 22 Explosives Regulation 1955 s 26 (w) on the approach of a thunderstorm the magazines and other danger buildings shall be closed and every person engaged in and about them shall be withdrawn therefrom; (x) the occupier of and every person employed in and about the factory shall take all due precaution for the prevention of accidents by fire or explosion in or about such factory, and for preventing unauthorised persons having access to the factory or any part thereof or the explosives therein, and shall abstain from any act whatever which tends to cause fire or explosion and is not reasonably necessary for the purpose of the work in such factory; (y) where an accident by explosion or fire has occurred in and wholly or partly destroyed a factory the factory shall not be reconstructed nor shall any further supply of an explosive be put therein without the permission of the chief inspector of explosives and any explosive put therein in contravention of the section shall be deemed to be kept in an unauthorised place and the offence may be punished accordingly; however, this enactment shall not prevent the reconstruction of a factory magazine in any lawfully existing factory upon such site in the factory and with such precautions as seem reasonable to the chief inspector of explosives, due regard being had to the working of the factory and of the persons employed therein as well as to the safety of the public; (z) where an accident by explosion or fire in a factory has wholly or partly destroyed any building of such factory as to which an inspector of explosives has previously to the accident sent to the occupier a notice that the building is unduly near to some building or work outside the factory, such building shall be reconstructed only upon such site in the factory and with such precautions as may seem reasonable to the chief inspector of explosives, due regard being had to the working of the factory and of the persons employed therein as well as to the safety of the public; (za) where an accident by explosion or by fire in a factory has wholly or partly destroyed 2 or more buildings in such factory not more than one of such buildings shall be reconstructed except with the permission of the chief inspector of explosives; however, this enactment shall not apply to any building in a lawfully existing factory if either, both or all such buildings are incorporating s 27 23 Explosives Regulation 1955 s 27 mills, or if as regards any other building an inspector of explosives has not previously to the accident sent to the occupier a notice that such buildings are unduly near to each other; (zb) where a building is constructed on a different site in pursuance of this section, the licence shall be submitted to the chief inspector of explosives for amendment; (zc) the reconstruction of any building in contravention of this section shall be an offence; (zd) a record shall be maintained in a strongly bound book showing the quantities of explosives manufactured, the date of manufacture, the quantity sold or used, and the date of selling or use; where the explosive was used the purpose shall also be shown together with the user’s signature. 27 Manufacturing certain explosives (1) In this section— “explosive” means— (a) a mixture formed by mixing ammonium nitrate to which has been added other non-explosive ingredients with any carbonaceous or organic substance or substances that is classified in accordance with the order in council dated 9 June 1955 and published in the Queensland Government Gazette 11 June 1955 page 762, as “Class 2—Nitrate-mixture class”; or (b) a mixture of ammonium nitrate with carbonaceous or organic substance or a mixture formed by mixing ammonium nitrate to which has been added inert substance with carbonaceous or organic substance; in either case, with or without water or metal powder provided that the metal powder shall not be added to any mixture except where a licence granted by the chief inspector under this regulation expressly authorises metal powder to be added to the mixture; or (2) For the purposes of subsection (1)(b)— (i) no carbonaceous or organic substance may be used unless it is included in schedule 1 to this section; (ii) no inert substance may be used unless it is included in schedule 2 to this section; s 27 24 Explosives Regulation 1955 s 27 (iii) metal powder shall be as specified in schedule 3 to this section. (3) The manufacture of the explosive shall be exempt from the operation of the provisions of this Act prohibiting the manufacture of any explosive elsewhere than at a factory licensed under this Act where the explosive is manufactured— (a) under, and in accordance with the conditions of, a licence granted by the chief inspector under this regulation; and (b) otherwise in accordance with the provisions of this regulation. (4) Every licence to manufacture explosive under this regulation shall be granted subject to the following conditions— (a) the explosive shall be manufactured exclusively for use at the place specified in the licence; (b) the process of manufacture of the explosive shall be carried out by the uniform mixing of the prescribed ingredients; (c) the manufacture of the explosive shall be carried out under the direct supervision and control of a competent person appointed in writing for that purpose by the licensee; (d) the ingredients shall be kept apart until ready for manufacture and the manufacture of the explosive shall be carried out as close as practicable to the actual place where the explosive is to be used provided that— (i) subject to the design and construction of the unit having first been approved in writing by the chief inspector, the explosive may be manufactured in a fixed or demountable unit attached to a diesel powered vehicle which is equipped with suitable means (or other means approved in writing by the chief inspector are provided) for transferring the explosive directly to the actual place where the explosive is to be used; and (ii) metal powder shall not be used as an ingredient of the mixture except when added by means of a mechanical device which is an integral part of such approved unit; (e) the quantity of explosive manufactured at any time shall not exceed that required for immediate use and the explosive shall not be kept or stored unless by reason of unusual circumstances it is not possible to use the prepared mixture. It shall then be s 27 25 Explosives Regulation 1955 s 27 marked and stored in a properly constructed and approved magazine a record shall be kept in a strongly bound book showing the quantity of explosives manufactured, the date of manufacture, the quantity used, the purpose for which it was used and the name of the person having the supervision and control of such manufacture in accordance with the provisions of paragraph (c) hereof or the name of the person using the explosive; (f) all detonators, priming cartridges, detonating fuse and other explosive shall be kept in secure receptacles at a safe distance from the explosive until immediately before being required for use; (g) no person shall smoke when manufacturing, carrying or handling the explosive; (h) no person (other than a person engaged in the manufacture, carrying or handling of the explosive) shall be within 10 m of any place where the explosive is being manufactured; (i) no naked light or fire shall be permitted within 10 m of the place where the explosive is being manufactured, carried or handled; (j) tools and other articles used in the manufacture, carriage and handling of the explosive, and the footwear worn by the persons so engaged, shall be of a type approved by the chief inspector; (k) such further conditions (if any) as the chief inspector may specify in the licence. (5) However, the chief inspector may with the approval of the Minister exempt any licensee, either generally or in a particular case, from any of the foregoing conditions where the chief inspector is satisfied that such exemption is consistent with the safe manufacture, handling and use of the explosive. (6) The chief inspector may grant or refuse to grant licences under this regulation. (7) The chief inspector may at any time by notice in writing to the licensee cancel, suspend or vary any licence granted under this regulation. (8) An application for a licence under this regulation shall be in the approved form. (9) A licence under this regulation shall be in the approved form. s 28 26 Explosives Regulation 1955 s 28 SCHEDULE 1 CARBONACEOUS SUBSTANCE (a) coal; (b) charcoal. ORGANIC SUBSTANCE (a) mineral oil with a flash point of not less than 61ºC; (b) mineral oil with a flash point of not less than 61ºC and an anionic surface active agent, with or without a suitable colouring agent; (c) sugar; (d) molasses. SCHEDULE 2 KIESELGUHR SCHEDULE 3 ALUMINIUM POWDER of particle size such that— (a) all particles shall pass through a B.S. 10 sieve; (b) not more than 20% shall be retained on a B.S. 36 sieve; (c) not more than 1% shall pass a B.S. 150 sieve. 28 Filling safety cartridges for sale (1) The provisions of the Act and regulations prohibiting the manufacture of explosives except in a licensed factory shall not extend to the operation of filling for sale safety cartridges for small arms. (2) The following sections shall apply to such operation— (a) no person shall, for sale, fill with any explosive any safety cartridges for small arms, unless the person is in possession of a licence to store and sell explosives; (b) such filling shall be done only in a room approved in writing by the chief inspector of explosives; s 28 27 Explosives Regulation 1955 s 28 (c) not more than 2.5 kg of explosives not contained in safety cartridges shall be in the room at any one time; (d) no exposed iron or steel shall be on the floor near the explosives or on the bench or table at which the filling of cartridges is carried on; (e) the floor, shelves, and fittings of the room shall be kept clean and free from grit, and before the filling of cartridges is commenced the bench or table at which such filling is to be carried on shall be carefully swept down; (f) no work unconnected with the making of the cartridges shall be carried on in the room while such filling is being carried on; (g) no fire or any artificial light, except a light of such construction, position and character as not to cause any danger of fire or explosion, shall be in the room while such filling is being carried on; (h) no matches or any substance or article likely to be a source of danger shall be permitted in the room while such filling is being carried on; (i) every person employed in filling cartridges shall wear outer clothing of woollen or other non-inflammable material made without pockets; (j) the wearing of ordinary clothing of woollen or other non-inflammable material with all pockets removed or sewn up shall be deemed to be sufficient compliance with this condition; (k) the wearing of clothing, whether as an outer or under garment, which is liable to acquire high charges of static electricity shall not be permitted; (l) suitable shoes, without iron or steel nails, shall be worn by every person in the room while such filling is being carried on; (m) any process involving pressure shall be conducted with great care and in such manner as to avoid jerking or concussion; (n) no finished cartridges, beyond the quantity at hand in the immediate course of preparation, shall be allowed to remain on or in close proximity to the bench or table at which they were filled; s 29 28 Explosives Regulation 1955 s 31 (o) no person under the age of 18 years shall be employed in or allowed to enter the room except under the supervision of some responsible person; (p) articles of a highly inflammable nature, or which are liable to cause fire or explosion, shall not be stored in close proximity to the room; (q) an inspector of explosives may at any time stop the filling of small-arm cartridges by any licensed person provided the inspector of explosives deems such stoppage necessary in the interest of public safety, or may, in the said interest direct the licensee to alter or amend the process of filling in such manner as such inspector may require. PART 5—CARRIAGE OF EXPLOSIVES Division 1—Preliminary 29 Definitions In this part— “carry” an explosive means transport the explosive in a vehicle or a vessel. “licence” means a licence issued under the Act to carry explosives. 30 Classification of explosives In this part, a reference to the class or division of a class relating to an explosive is a reference to the classification of the explosive determined under section 2 of the Code. Division 2—Carriage of explosives 31 Code to be complied with Subject to this part, a person must— s 32 29 Explosives Regulation 1955 s 33 (a) comply with section 8 of the Code; and (b) comply with any other provision of the Code so far as it is a requirement of section 8 of the Code to do so. 32 Exemption under s 7 of the Act for carriage of small quantities of certain explosives (1) Subject to subsection (2), explosives of a type, and not exceeding the relevant quantity, set out in schedule 1 are exempted from the operation of— (a) part 5 of the Act; and (b) this division, other than this section. (2) Subsection (1) applies to explosives being carried by a person only if the person ensures that this section is complied with in relation to the explosives. (3) The explosives must be packaged and labelled in compliance with the Code. (4) The explosives must be accompanied by a shipping document that complies with section 4.2 of the Code, unless the person carrying the explosives has bought them for the person’s own use and not for resale. (5) The explosives must be segregated in compliance with section 7.3 of the Code. (6) While the explosives are carried— (a) the explosives must be securely stored in an enclosed part of the vehicle or vessel; and (b) all necessary precautions must be taken to ensure that the explosives are not stolen or initiated; and (c) except in the case of explosives of class 1.4S—the vehicle or vessel must not carry any passengers for hire or reward. (7) The explosives must be transported without any unnecessary delay. 33 Packaging and labelling of unauthorised explosives (1) A person must not carry an unauthorised explosive unless it is packaged and labelled in compliance with a direction of the chief inspector. s 34 30 Explosives Regulation 1955 s 36 (2) Subject to subsection (1), a person is not required to comply with the Code in relation to the packaging and labelling of an unauthorised explosive. 34 Transparent outermost package A person does not contravene section 312 in respect of labelling required by the Code to be on the outermost package if the required labelling is clearly visible through the outermost package. 35 Prescribed conditions for carriage without a licence (1) For the purpose of section 23 of the Act— (a) the prescribed maximum weight for any type of explosive is 50 kg; and (b) the prescribed manner and conditions for carrying the explosive are in compliance with this regulation. (2) For the purpose of section 23 of the Act— (a) the prescribed maximum weight for any type of explosive is 50 kg; and (b) the prescribed purpose for which the explosive is intended for use is a purpose for which the explosive was designed; and (c) the prescribed manner and conditions for carrying the explosive are in compliance with this regulation. 36 Licence to carry explosives (1) The form prescribed under section 11(2) of the Act for an application for a licence to carry explosives is the approved form. (2) Subject to the Act, a licence authorises the person to whom it is issued, and any employee of that person, to carry explosives only— (a) of the type and in the quantity specified on the licence; and (b) in the vehicle or vessel specified on the licence. 2 Section 31 (Code to be complied with) s 37 31 Explosives Regulation 1955 s 39 (3) A person carrying explosives under a licence must have the licence, or a copy of a licence, in the vehicle or vessel. 37 Theft or other incident involving explosives to be reported (1) This section applies to a person while carrying an explosive under a licence. (2) If the explosive is stolen or otherwise goes missing, the person must immediately— (a) report the incident to the police; and (b) give to the chief inspector full details of the incident and of the action being taken to recover the stolen or missing explosive. (3) If there is— (a) a fire or explosion; or (b) an accident or breakdown involving the vehicle or vessel carrying the explosive; or (c) a leakage or other escape of the explosive from the vehicle or vessel; the person must immediately give to the chief inspector full details of the incident. 38 Explosives to be carried without delay A person carrying explosives must ensure they are transported without any unnecessary delay. 39 Maximum quantities of explosives that may be carried (1) In this section— “excess quantity” means a quantity greater than the quantity permitted under section 7.4 of the Code. (2) A person must not carry an excess quantity of explosives other than in compliance with written approval given by the chief inspector. (3) An application for approval must contain— (a) the applicant’s name and address; and s 40 32 Explosives Regulation 1955 s 41 (b) the classification, type and quantity of explosives to be carried in an excess quantity; and (c) a description of the vehicle or vessel to be used; and (d) the route to be followed; and (e) the intended date of travel. (4) The chief inspector may grant the approval only if satisfied that it would be safe in all the circumstances to allow the proposed carriage. (5) The chief inspector may subject an approval to such conditions as the chief inspector considers necessary, having regard to all of the circumstances of the proposed carriage. PART 6—STORAGE Division 1—Storage in government magazines 40 Government magazines The following magazines have been appointed government magazines in accordance with section 28 of the Act— 41 • Helidon • Bajool • Brookhill • Queerah. Sending for storage in government magazines No person shall send or convey explosives for storage in a government magazine unless notice has been previously given in writing to the officer-in-charge of the government magazine. s 42 42 33 Explosives Regulation 1955 s 44 Storage in government magazines (1) The chief inspector of explosives may demand the payment of storage rent and other charges authorised by the Act and regulations before any explosive is released from a government magazine. (2) Every person desiring to convey explosives from a government magazine must give sufficient notice to the officer-in-charge accompanied (if required) by the housing certificate and particulars of the explosives, the quantity required, the name of the consignee, and the place of consignment and mode of transit, and must depute a trustworthy and sober person who shall be under the orders of the magazine keeper, to assist in the delivery and give the necessary receipt for the same. (3) Any explosive stored or kept in a government magazine, or in a magazine erected by a private person on an area of land which is a government magazine and any explosive stored or kept on such an area of land shall be stored or kept at the risk of the owner of that explosive, and the chief inspector of explosives shall not nor shall any inspector of explosives or any magazine keeper be liable for any loss, miscarriage or damage or in respect of any explosive stored or kept as aforesaid and whether arising out of any negligence on the part of them or any of them or from any other cause whatsoever. 43 Notice of sale or transfer In case any importer or proprietor of any explosive shall at any time whilst it shall be deposited in a government magazine in manner aforesaid, sell or transfer the whole or any part of the same to any other person such sale or transfer shall be immediately reported in writing to the officer-in-charge of the magazine, and a certificate of such sale or transfer from the importer or proprietor shall also be produced to the said officer in order that the same may be duly registered, and in case of failure thereof the said officer may refuse to deliver up such explosive. 44 Nonpayment of storage costs If the storage rent due upon, and all other charges and expenses incurred in respect of, any explosive in any government magazine be not paid before the expiration of 1 year after such explosive has been deposited, or within 60 days after demand shall be made by the officer-in-charge of such magazine, such officer may cause such explosive, or so much thereof as may appear to be necessary to satisfy all such storage rent and other s 45 34 Explosives Regulation 1955 s 45 charges and expenses, to be sold by public auction, after having been advertised for 1 week in the gazette and in 1 newspaper circulating in the locality; and the proceeds thereof shall be applied first to the payment of such storage rent and all other charges and expenses as aforesaid, and the surplus (if any) shall be paid to the importer or proprietor or other person duly authorised to receive the same. 45 Government magazine rules (1) This section applies to a government magazine. (2) It shall be the duty of the magazine keeper to— (a) remain at the magazine during working hours and on no account to leave it unless on duty elsewhere or with the permission of the chief inspector of explosives or an inspector of explosives; (b) superintend the receipt, issue, storage, sampling, examination and repacking of explosives; (c) keep a daily journal of all such transactions, and a ledger showing particulars of all explosives stored in the magazine and the receipt and issue thereof; (d) maintain the magazine reserve and all buildings, tools and plant under the magazine keeper’s care in good order; (e) see that the provisions of the Act and regulations thereunder, in so far as they apply, are strictly observed; (f) report weekly to the chief inspector of explosives on all details relating to the magazine keeper’s position; (g) issue explosives in sequence according to date of manufacture. (3) The ordinary work at magazines shall be carried out between 8 a.m. and 5 p.m. or such other hours as may be approved and the magazine keeper shall so arrange that the working hours shall not exceed the equivalent of 40 hours per week; but to facilitate the loading or unloading of explosives the hours may be extended from sunrise to sunset, provided that the persons so desiring that extension shall pay such overtime as the chief inspector of explosives may direct. (4) No person other than an inspector of explosives shall be admitted within the proclaimed precincts of a government magazine except with the authority of the chief inspector of explosives, and when so admitted shall s 45 35 Explosives Regulation 1955 s 45 be attended by an inspector of explosives or magazine keeper, who shall be responsible that all necessary precautions are observed. (5) No person shall enter a magazine unless the person is wearing the special magazine shoes provided for the purpose. (6) No person shall enter a magazine or its precincts carrying or having about his or her person any fire, light, matches, grit, iron, steel or other article liable to cause explosion or fire. (7) Every person about to enter a magazine shall either himself or herself examine his or her clothing, or, if required, shall submit himself or herself to examination to ensure observance of this rule. (8) No person shall smoke in or about any magazine. (9) No person while intoxicated shall be permitted to enter a magazine or remain within its precincts and no intoxicating liquor shall be taken into a magazine. (10) Every magazine shall be kept scrupulously clean and dry and free of gravel, sand and grit. (11) Magazines shall be regularly aired, but always with due regard to the state of the atmosphere. (12) They must not be aired or kept open longer than is absolutely necessary in wet or damp weather. (13) The magazine temperature is to be noted daily and every time it is opened, and a record of such readings sent weekly to the chief inspector of explosives. (14) Every magazine shall be effectively protected from grass fires and, to this end, a space of at least 10 m wide all round the magazine shall be kept clear of grass and bush, and no inflammable material shall be left within the area that is required to be clear of grass and bush. (15) No explosive shall be received into or issued from any government magazine without the authority of an inspector of explosives or magazine keeper and every receipt or delivery of explosives shall be undertaken and completed in the presence of an inspector of explosives or magazine keeper. (16) The chief inspector of explosives shall forward at least biannually to each owner a statement of stock stored on the owner’s behalf in the government magazines. s 45 36 Explosives Regulation 1955 s 45 (17) It shall be the duty of each owner to advise the chief inspector of explosives in writing whether or not this statement of stock agrees with the owner’s records. (18) Before any package of explosives is taken into a magazine, the magazine keeper must satisfy himself or herself that it is in sound condition and free from any exposed iron, steel, dirt, grit, trace of explosive, or other dangerous or objectionable substance. (19) Every package containing a compound of nitroglycerine should, before being received into the magazine, be examined to ascertain whether it is free of any oily stain caused by exudation from the package or absorbed from another case. (20) Should any package be found so stained, it is to be carefully handled and removed forthwith from the magazine and isolated, and notice of its condition at once sent to the chief inspector of explosives. (21) Every such package is to be opened at a safe distance from the magazine and any repacking of such explosive shall be carried out under the supervision of an inspector of explosives. (22) No damaged or deteriorated explosive is to be destroyed without the authority of the chief inspector of explosives and no explosive is to be destroyed except under the supervision of an inspector of explosives. (23) No explosives contained in an open package shall be allowed in a magazine. (24) Packages of explosives shall not be opened or closed in a magazine. (25) Every package of explosives shall be carefully carried or passed by hand from place to place, and on no account shall any package be thrown, slid or rolled. (26) Packages or cases shall be received into and removed from the magazine only 1 at a time. (27) However, where it is safe for the handling of explosives, hand barrows and trolleys constructed of non-sparking materials and the use of rollers fabricated as a set and made of such material that no hazard is introduced by its use may be used. (28) In addition, the safe working capacity of the hand barrow and trolley is not exceeded nor shall the stack of cases on the rollers exceed 1 case in height. s 45 37 Explosives Regulation 1955 s 45 (29) Cases of explosives shall not be stored more than 6 cases high, not less than 150 mm from the wall, and spaces should be left between the cases to facilitate free circulation of air. (30) Grades and batches should be kept as much as possible together. (31) Nitro-compound explosives must never be exposed to the direct rays of the sun. (32) On the approach of a thunderstorm the receipt, delivery, examination, loading or unloading of explosives shall cease at once and the magazine shall be immediately closed. (33) All tools or implements used in the opening, closing or removal of any package containing explosives shall be made only of copper, brass, bronze or wood. (34) Cases shall be removed only 1 at a time from the magazine. (35) Care shall be taken to ensure that no dirt, grit or other objectionable material comes in contact with the case or its contents. (36) Cases shall not be opened in the storage chamber of any magazine, but may be opened singly either in the vestibule or outside the magazine. (37) Sampling of explosives stored or kept in government magazines shall be at the discretion of the chief inspector of explosives. (38) If any explosives are sampled then, after sampling, the case shall be closed and marked with the official stamping stamp, the initials of the person sampling, and the date before returning to the magazine. (39) The gross weight of explosives samples forwarded in any one case shall not exceed 25 kg. (40) Every case of explosives samples shall bear the word ‘Explosives’ in large red letters in at least 2 positions on the case. (41) Every person entering the detonator-room shall wear the shoes provided for the purpose. (42) The floor and bench shall be swept clean before any work is commenced, and shall be swept clean on completion of work. (43) A package containing detonators shall not be opened. (44) Detonators not exceeding 1 000 in number may be packed in a single outer case, clean wood shavings or sawdust being used to prevent movement within the case. s 46 38 Explosives Regulation 1955 s 47 (45) Electric detonators not exceeding 1 000 in number may be packed in packets in a single outer case. (46) Only an approved screwdriver shall be used for the opening and closing of cases. (47) Special care shall be taken to ensure that packages of detonators are at all times carefully handled. (48) Throughout all process of repacking, the use of force or pressure must be avoided. Division 2—Storage in private magazines 46 Exemption under s 7 of the Act for storage of small quantities of certain explosives (1) Subject to subsection (2), explosives of a type, and not exceeding the relevant quantity, set out in schedule 2 are exempted from the operation of— (a) part 6 of the Act; and (b) this division, other than this section. (2) Subsection (1) applies to explosives being stored by a person only if the person ensures that this section is complied with in relation to the explosives. (3) Explosives of division 1 of class 6 (ammunition) must be stored in a secure, dry, safe place. (4) Explosives of division 3 of class 7 (fireworks) must be stored in compliance with section 56. (5) Due precautions must be taken to prevent theft of the explosives or accidents by fire or explosion. (6) No explosives other than the explosives exempted under this section may be stored at the place. 47 Requirement for licence (1) Except as otherwise provided for in section 46 of these regulations, no person shall have or keep in his or her possession at any one time on any s 47 39 Explosives Regulation 1955 s 47 premises, any explosive unless the person holds a licence for a magazine for the storage of that explosive. (2) This section shall not apply where explosives of the kinds not exceeding the respective quantities set out hereunder are had or kept by any person on any premises for the person’s private use and not for sale, vis— gunpowder or small arms explosives class 2 and class 3. . . .5 kg explosives class 2 and class 3 for blasting . . . . . . . . . . . . . . .5 kg detonators. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .110 in number detonating fuse. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .250 m in length (3) A person who has or keeps in his or her possession any explosive under and in accordance with subsection (2) shall keep that explosive— (a) in a secure, dry place that is inaccessible to the public; (b) away from any inflammable substance; but (c) shall not in any case keep that explosive for a longer period than 3 months commencing on the day after the date of the purchase thereof by the person. (4) However, a person who is a bona fide farmer substantially engaged in that pursuit may have and keep on the person’s farm property for the person’s own use and not for sale explosives of the kinds not exceeding the respective quantities set out hereunder, vis— (a) explosives class 2 and class 3 for blasting . . . . . . . 25 kg (b) gunpowder for use in a timber splitting gun . . . . . 25 kg (c) anti hail rockets . . . . . . . . . . . . . . . . . . . . . . . . . . . 25 kg (d) detonators. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . 110 in number (e) detonating fuse . . . . . . . . . . . . . . . . . . . . . . . . . . . . 250 m in length. (5) A person being a bona fide farmer as aforesaid who has or keeps any explosive under and in accordance with subsection (4) shall keep that explosive— (a) in a secure, dry place at least 50 m from any human habitation; (b) away from any inflammable substance; but s 48 40 Explosives Regulation 1955 s 51 (c) in the case of explosives class 2 and class 3 shall not keep that explosive for a period longer than 3 months commencing on the day after the date of the purchase thereof by the person. 48 Licensees The person to whom a licence for a magazine for the storage of explosives has been issued shall be called the licensee and the licensee shall be deemed to be the magazine keeper. 49 Application for licence Applications for a licence for a magazine to store explosives including any annex for the storage of detonators shall be made in duplicate to the chief inspector of explosives in the approved form, shall be signed by the applicant and shall contain the name in full of the applicant, the applicant’s occupation and full address, the kinds of explosives to be stored, the maximum quantity of each kind to be stored, the local government area in which the magazine and any annex will be situated and the actual location of the magazine and any annex and shall include a plan drawn to scale of the proposed site showing the position of the magazine and any annex, mounds or works in relation to any railway, road, river, public place, private dwelling, store or other structure and a plan drawn to scale of the magazine, and any annex. 50 Works before licence issued On endorsement of an application for a licence for a magazine for the storage of explosives by the chief inspector of explosives, the applicant shall erect the magazine and any annex, mounds or works in accordance with the plan and conditions of the endorsed application and to the satisfaction of the chief inspector of explosives before approval is granted and the licence issued. 51 Maximum quantity in magazines The maximum quantity of any explosive which may be kept at any place is the quantity specified in the magazine licence and all explosives except those defined under— (a) division 1 of class 6 (ammunition); or s 52 41 Explosives Regulation 1955 s 53 (b) division 2 of class 7 (fireworks) where the total quantity does not exceed 1.5 kg net explosives content; or (c) division 3 of class 7 (fireworks) where the total quantity does not exceed 250 kg; shall be kept in a licensed magazine. 52 Licensed magazine classifications Licensed magazines shall be classified under the following categories— (a) where the total quantity of explosives stored does not exceed 100 kg—category I. retail magazines; (b) where the total quantity of explosives stored exceeds 100 kg but does not exceed 250 kg—category II. bulk magazines; (c) where the total quantity of explosives stored exceeds 250 kg—category III. bulk magazines; (d) where the explosives stored belong solely to division 3 of class 7 (fireworks) and exceeds 250 kg—category IV. fireworks magazine. 53 Modes of storage (1) As regards category I. retail magazines, the explosives may be stored in either of the following modes— (a) mode 1— (i) in a substantially constructed building detached from a dwelling house and at a safe distance therefrom and from any road, railway, waterway or public place; (ii) the building shall be weatherproof, secured at all times against access by unauthorised persons, protected externally with tar, bitumen or paint, screened from the sun if so directed by an inspector of explosives; (iii) it shall be used exclusively for the storage of explosives provided that if detonators are stored in the same building they shall not exceed 2 000 in number and shall be kept in a separate receptacle situated at least 10 m horizontally from the other explosive in the building; s 53 42 Explosives Regulation 1955 s 53 (iv) there shall be painted conspicuously on the door of the building the word ‘Explosives’ in red paint on a white background and on the door of the detonator receptacle the word ‘Detonators’ in red paint on a white background; (b) mode 2— (i) in a receptacle exclusively appropriated for the keeping of only one kind of explosive and placed inside any building which is not itself qualified for the keeping of explosives in mode 1 provided that where detonators are stored in the same building the number shall not exceed 2 000 and shall be stored in a separate receptacle placed at least 10 m horizontally from any other receptacle containing explosives; (ii) every receptacle shall be secured at all times against access by unauthorised persons and shall be placed in a safe part of the building away from goods of an inflammable or dangerous nature and close to an exterior door where it will be readily accessible and easily removed from the building in case of fire. (iii) the lid and door of the receptacle shall have copper or brass hinges and fastenings and there shall be no exposed iron or steel within the receptacle; (iv) the word ‘Explosives’ shall be painted conspicuously on the door of the building in which any receptacle is placed and on the exterior of any receptacle containing blasting explosives the word ‘Explosives’ and on the exterior of any receptacle containing detonators the word ‘Detonators’. (2) As regards categories II. and III. bulk magazines the magazine shall be a substantially constructed building at a safe distance from any dwelling house, hospital, railway, waterway, road, public place, public hall or other building where persons are accustomed to assemble, store, workshop or other building where people are employed. (3) The building and any annex used as a magazine for the storage of explosive shall be protected externally with tar, bitumen or paint and if so directed by an inspector of explosives shall be provided with an approved sun screen. s 54 43 Explosives Regulation 1955 s 54 (4) The interior shall be close lined throughout with wood or other approved material and shall have a close joined wooden floor covered with linoleum or bitumen based floor covering. (5) There shall not be any exposed iron or steel inside the magazine and it shall be waterproof. (6) A substantial wooden door faced externally with iron and having nonferrous metal or heavily galvanised iron hinges whose screws are inaccessible from the exterior shall be securely fixed to each building. (7) The door shall be provided with a substantial lock and the words ‘Explosives’ or ‘Detonators’ as the case may be, shall be painted conspicuously in red on a white background on the exterior of the door and any annex. (8) The interior dimensions shall be such as to permit a sufficient free air space between the explosive in the magazine and the sides when the magazine is carrying its maximum licensed capacity. (9) As regards category IV. fireworks magazines, the magazine shall be a substantially constructed building of concrete, brick or galvanised iron, either detached on all sides, or if attached the dividing walls between the magazine and other part of the building shall be of brick or concrete throughout or alternatively the magazine if within a building shall be a room substantially constructed of brick or concrete fitted with a self-closing fire proof door. (10) The magazine shall have a close joined wooden, brick or concrete floor covered with linoleum or bitumen based floor covering. (11) The door shall be fitted with a substantial lock and the words, ‘No smoking, Fireworks, Explosives’ shall be painted conspicuously in red on a white background on the outside of the door. (12) Windows shall be on external walls only, glazed with wire-obscured glass and protected with substantial wire gauze. (13) Electric light fittings shall be of a design approved for hazardous industry and there shall be provided, in addition to an ample water supply, 2 soda ash fire extinguishers sited on either side of the door externally. 54 Repackaging fireworks (1) Where in connection with any fireworks magazine fireworks are repacked this shall be done in a separate room within the magazine or in an approved place outside the magazine. s 55 44 Explosives Regulation 1955 s 55 (2) An ample supply of water and a soda ash fire extinguisher shall be available at all times during operations. (3) The maximum quantity of fireworks allowable in the packing room at any one time is 250 kg. 55 Care and management of private magazines (1) This section applies to a private magazine. (2) The magazine and every part thereof shall be maintained in accordance with the licence and no material alteration whatsoever shall be made except with the approval of the chief inspector of explosives. (3) The interior of the magazine and any annex including the shelves and other fittings shall be kept free from grit and otherwise clean and dry. (4) The magazine and any annex shall be used exclusively for the keeping of such explosives as may be specified in the licence together with approved tools and the quantity of each such explosive shall not at any time exceed the maximum permitted for such explosive on the licence. (5) Only wooden or nonferrous tools shall be used for opening or closing the cases of explosives. (6) Every magazine and any annex shall be kept in sound condition and before any repairs are done all explosives shall be removed from the magazine and any annex. (7) No person shall smoke in any part of the magazine or in any annex or in the vicinity thereof and no person under the influence of alcohol shall be permitted to enter the magazine or any annex or frequent its vicinity. (8) No person under the age of 18 years shall be employed in connection with any magazine or annex. (9) The magazine and any annex shall always be kept securely locked except for the purpose of receiving into or issuing therefrom explosives or for purposes necessary in the conduct thereof. (10) The keys shall be in charge of the magazine keeper who shall be responsible for the care and management of the magazine and any annex. (11) In the conduct of the magazine and any annex there shall be kept a magazine book in the approved form in which shall be recorded against the date, the kind, quantity and markings on the outer package of all explosives received into the magazine or annex and against the date, the kind and s 55 45 Explosives Regulation 1955 s 55 quantity of all explosives issued from the magazine and the name of the person to whom each issue of explosives is made. (12) This provision shall not apply to magazines used solely for the storage of explosives of class 7 (fireworks). (13) No substance of a dangerous or inflammable nature or which is liable to cause fire or explosion, other than the explosive specified in the licence, shall be introduced into or kept in the vicinity of the magazine and the area surrounding the magazine to a distance of 10 m therefrom shall be kept free from grass, weeds and rubbish. (14) No fire, lights, matches, charcoal, oil-bearing substances, iron, steel, grit or any substance liable to spontaneous ignition or likely to cause fire or explosion shall be taken into or be permitted at any time to be in the magazine or any annex or in close proximity thereto. (15) If so directed by an inspector of explosives an efficient fire extinguisher charged and in working order or an adequate supply of water shall be maintained at the magazine. (16) The licensee and every person employed in and about the magazine shall take all due precautions for the prevention of accidents by fire or explosion and for preventing unauthorised persons having access to the magazine or annex or to the explosives therein and shall abstain from any act whatever which tends to cause fire or explosion and is not reasonably necessary for the purpose of the work in such magazine or annex. (17) Any break-in or attempted break-in of a magazine, any theft or any shortage in the quantity of explosives held in storage shall be reported to the nearest police station and to the chief inspector immediately on becoming aware of such break-in, attempted break-in, theft or shortage. (18) This report shall include full details of the circumstances surrounding the break-in, attempted break-in, theft or shortage and shall state what action has been taken to repair the magazine and has been or is being taken to recover the explosives. (19) The licensee may with the approval of the chief inspector of explosives and if required by the chief inspector of explosives shall make, alter or repeal special rules for the regulation of the persons managing or employed in or about such magazine with a view to securing the observance of these regulations therein, the safety and proper discipline of the said persons and the safety of the public. (20) A copy of such special rules signed by the licensee shall be posted in a conspicuous place in the magazine. s 55 46 Explosives Regulation 1955 s 55 (21) No explosive shall be allowed into a magazine or annex unless it is packed and marked or labelled in accordance with the requirements of this regulation and in the case of gunpowder or propellant powders the explosives shall be contained in a substantial bag made of linen or other material, canister or other receptacle so made and closed as to prevent the escape of any explosive. (22) Gunpowder and propellant powders shall not be removed from the inner packages whilst they are within the magazine. (23) There shall not be in any licensed magazine or annex any explosive of class 4 (chlorate mixture) or of class 5 (fulminate class) or any unauthorised explosive and where various classes of explosives are kept under licence they shall be kept in separate magazines or annexes so separated from one another as to effectively prevent fire or explosion in one being communicated to any other provided that explosives belonging to class 1 (gunpowder) class 2 (nitrate mixture) class 3 (nitro compounds) may be kept in the same magazine without any intervening space or partition. (24) The licensee shall not sell explosives unless the licensee holds a licence to sell explosives and no person shall give away, hand over, leave unattended or abandon any explosive. (25) Deteriorated explosive and any explosive surplus to requirements shall be disposed of in a manner approved by an inspector of explosives. (26) No person shall be in the vicinity of the magazine or annex either at the approach of or during a thunderstorm and the doors shall not be left open at such times. (27) If so directed by the chief inspector of explosives the magazine shall be protected by an efficient lightning conductor. (28) For the proper conduct of the magazine the following minimum equipment shall be provided and kept available at all times— (a) 1 hair broom; (b) 1 wooden mallet or nonferrous hammer; (c) 1 wooden or nonferrous wedge; (d) 1 pair of rubber overshoes or rubber soled sandshoes except in the case of a receptacle licensed under mode 2 of category I retail magazine; (e) 1 coir or other approved mat on which to open or close cases. s 56 47 Explosives Regulation 1955 s 56 (29) No case, container or package shall be opened or closed inside a magazine. (30) The magazine and its contents shall be inspected at intervals not exceeding 1 month, and the details of each inspection shall be recorded in the magazine book. (31) Any signs of deterioration of the magazine’s contents shall be immediately reported in writing to the chief inspector. 56 Storing no more than 250 kg of division 3 of class 7 explosives This section applies to the storage of no more than 250 kg of division 3 of class 7 explosives— (a) no licence shall be required to be taken out for the storage of not more than 250 kg of such fireworks; (b) no explosives whatsoever other than those described in division 3 of class 7 (fireworks) shall be kept on the premises; (c) except when required for immediate sale, all such fireworks shall be retained in the original outer package which shall be effectively closed and maintained in good order, or they shall be stored in suitable spark proof receptacles effectively closed except when fireworks are being placed therein or withdrawn therefrom; (d) all such packages or receptacles shall be kept in a position protected from shop traffic and away from any articles of an inflammable or combustible nature; (e) the interior of all receptacles used for the keeping of fireworks shall be kept clean and free from dust and grit; (f) no bengal or other matches whatsoever and no articles or substances of an inflammable or combustible nature whatsoever shall be kept in or about any unopened packages or receptacles used for the keeping of fireworks; (g) smoking in the vicinity of any unopened packages or receptacles used for the keeping of fireworks is prohibited; (h) fireworks which allow the escape of the composition shall not be placed or kept in any receptacle or magazine. s 57 48 Explosives Regulation 1955 s 59 PART 7—SALE AND USE Division 1—Sale of explosives other than class 7 explosives (fireworks) 57 Division 1 of class 6 explosives (ammunition) A licence is not required to sell explosives of division 1 of class 6. 59 Licence to sell explosives (1) This section applies to a licence to sell explosives. (2) The licence shall be valid only for the person to whom it is issued. (3) The words ‘Licensed to sell explosives’ shall be painted or affixed above the entrance to the premises. (4) The licensee shall not sell an explosive other than propellant smokeless powders of divisions 1 and 2 of class 3 nitro-compound for the reloading of safety cartridges to a person unless the person is an inspector or he or she is the holder of a shotfirer’s licence or a shotfirer’s (restricted) licence or a permit authorising the use of the explosive or is exempted from the necessity to have such a licence by the provisions of section 35A of the Act. (5) The licensee shall obtain proof of the identity of the purchaser before effecting the sale of any such explosive and the purchaser’s name and address shall be stated by the purchaser. (6) Subsections (4) and (5) shall not apply to the sale of explosives— (a) to a person not being an inspector the holder of a shotfirer’s licence or shotfirer’s (restricted) licence or a permit, authorised in writing by the chief inspector to purchase explosives of the nature and quantity purchased; or (b) made by— (i) a manufacturer from a factory; or (ii) an importer, to a purchaser who— (A) is licensed to sell explosives; and s 60 49 Explosives Regulation 1955 s 60 (B) acquires the explosives for resale and not for use by himself or herself. (7) The manufacturer or importer shall furnish to the chief inspector at not longer than fortnightly intervals a list showing the sale of explosives in accordance with the provisions of subsection (6) during the period covered by the list. (8) The licensee shall keep an explosives sales book in the approved form in which shall be recorded the date of sale, the name and address of the purchaser, the quantity and kind of such explosives sold, and the purpose for which the purchaser states such explosives are to be used. (9) The licensee shall record the number of the shotfirer’s licence or the shotfirer’s (restricted) licence or shall record details of the permit or other authority which the purchaser claims enables the purchaser to have the explosives in his or her possession, and the purchaser shall sign the above record in the appropriate space. (10) When buying explosives from a licensee, a person must not— (a) state anything, relevant to the purchase, to the licensee that the person knows is false or misleading in a material particular; or (b) omit from a statement made, in relation to the purchase, to the licensee anything without which the statement is, to the person’s knowledge, misleading in a material particular. Maximum penalty—5 penalty units. (11) It is enough for a complaint against the person for an offence against subsection (10) to state that the statement was false or misleading to the person’s knowledge. 60 Public sale of explosives (1) A person shall not expose for sale in any shop window, or hawk or expose for sale upon any road or in any public place, any explosive included in division 1.3 (2) However, not more than 2 kg of explosives of division 1 of class 6 (ammunition) may be displayed for sale in a receptacle which receptacle shall be inaccessible to the public within the place where such explosives are stored. 3 Division 1 (Sale of explosives other than class 7 explosives (fireworks)) s 61 61 50 Explosives Regulation 1955 s 62A Sale of more than 450 g of explosives All explosives exceeding 450 g in weight when sold shall be in a substantial case, bag, canister or other package made and closed so as to prevent the explosives from escaping and on the outside of such package there shall be affixed in conspicuous characters by means of a securely attached label or mark— (a) in the case of gunpowder—the word ‘Gunpowder’; (b) in the case of ammunition of class 6 division 1—the name of the explosive; (c) in the case of explosives other than gunpowder or ammunition of class 6 division 1—the word ‘Explosive’ and the name of such explosive. Division 2—Sale of class 7 explosives (fireworks) 62 Application of div 2 This division does not apply to a class 7 explosive (firework) mentioned in schedule 6. 62A Sale of class 7 explosives (fireworks) (1) A person must not sell a class 7 explosive unless the person holds a licence to sell the explosive. Maximum penalty— (a) for an individual—84 penalty units; or (b) in any other case—840 penalty units. (2) The holder of a licence to sell a class 7 explosive must not sell a class 7 explosive to a person unless the person is— (a) an inspector; or (b) a holder of a shotfirer’s licence authorising the use of the explosive; or (c) another holder of a licence to sell the explosive. Maximum penalty— (a) for an individual—84 penalty units; or s 63 51 Explosives Regulation 1955 s 65 (b) in any other case—840 penalty units. (3) The holder of a licence to sell a class 7 explosive must not keep a class 7 explosive in a shop, on a road or in another public place. Maximum penalty— (a) for an individual—40 penalty units; or (b) in any other case—400 penalty units. (4) The holder of a licence to sell a class 7 explosive must not sell a class 7 explosive unless the explosive is contained in a package that is closed to prevent the escape of the explosive and is labelled to indicate the presence of the explosive. Maximum penalty— (a) for an individual—5 penalty units; or (b) in any other case—50 penalty units. Division 3——Use of blasting explosives 63 Blasting explosives (1) Where any person prepares for use or uses blasting explosives the approved procedure shall be that prescribed by the S.A.A. Explosives Code No. CA 23-1967 issued by the Standards Association of Australia or any amendments thereto. (2) However, subsection (1) shall not apply in the case of a person who prepares for use or uses blasting explosives in accordance with the procedure approved under any other Act or any regulation, by-law, ordinance or rule thereunder or in accordance with any approved procedure prescribed by any instrumentality duly authorised by law in that behalf. 65 Shotfirers’ licences and shotfirers’ (restricted) licences for blasting explosives (1) A person who prepares for use or uses an explosive for the purpose of blasting or producing a similar effect other than under the Mines Regulation Act 1964 or the Coal Mining Act 1925 or the Petroleum Act 1923, shall be an inspector or be the holder of a shotfirer’s licence or a s 65 52 Explosives Regulation 1955 s 65 shotfirer’s (restricted) licence or a permit authorising the use of the explosive. (2) A shotfirer’s licence shall not be issued by the chief inspector to a person unless that person shall satisfy the following conditions— (a) the person shall be over the age of 18 years; (b) the person shall be physically capable of carrying out the duties of a shotfirer; (c) the person shall produce evidence by way of a certificate from an examining authority that the person has reached a satisfactory standard after attendance at a course conducted by that authority in relation to the use of explosives for blasting; or (d) the person shall produce documentary evidence that prior to the coming into force of section 35A of the Act the person has had practical experience in the use of explosives for blasting for a total period of not less than 2 years within the period of 3 years preceding the date of his or her application for a licence; (e) the person shall be proficient in the following matters— (i) a knowledge of the requirements of the Act and regulations in relation to the storage, carriage, preparation for use and use of explosives; (ii) a knowledge of the requirements of S.A.A. Explosives Code CA 23-1967; (iii) the classification of explosives; (iv) the characteristics of explosives; (v) the preparation and charging of holes; (vi) safety rules; (vii) testing of circuits, methods of firing, and instruments used; (viii)the preparation of priming charges; (ix) detonators and detonating fuse; (x) misfires; (f) the applicant may be required to undergo a practical test by an inspector. s 65A 53 Explosives Regulation 1955 s 65A (3) A shotfirer’s (restricted) licence may be issued by the chief inspector to a person over the age of 18 years, who has experience only in relation to a limited use of explosives. (4) An applicant for a shotfirer’s (restricted) licence shall produce evidence to the chief inspector of the applicant’s knowledge in relation to the matters referred to in subsection (2)(e)(i), (ii) and (iv) to (x). (5) An applicant may be required to undergo a practical test by an inspector. (6) A person applying for renewal of a shotfirer’s licence or a shotfirer’s (restricted) licence may be required to produce evidence that the person has conducted blasting operations in the period covered by the licence to be renewed. (7) Should a shotfirer’s licence or a shotfirer’s (restricted) licence not be renewed, for any reason, in any year, the applicant may be required by the chief inspector to undergo a test to demonstrate the applicant’s ability to use explosives satisfactorily prior to the issue of a shotfirer’s licence or a shotfirer's (restricted) licence. (8) Any person who acquires explosives, other than those of division 1 of class 6 (ammunition) shall keep a record in a strongly bound book showing the quantity on hand at any one time, the time, date and quantity when explosives were used. (9) The details shall be verified by the signature of the person using the explosives. (10) It shall be a condition of a shotfirer’s licence and a shotfirer’s (restricted) licence that any theft or shortage of explosives either in transit or at the site at which it is intended to use the explosives shall be reported immediately to the nearest police station and to the chief inspector. (11) This report shall include full details of the circumstances surrounding the theft or shortage and shall state what action has been or is being taken to recover the explosives. Division 4—Use of class 7 explosives (fireworks) 65A Application of div 4 This division does not apply to a class 7 explosive (firework) mentioned in schedule 6. s 65B 54 Explosives Regulation 1955 s 65C 65B Use of class 7 explosives (fireworks) (1) A person must not use a class 7 explosive unless the person is— (a) an inspector; or (b) the holder of a shotfirer’s licence authorising the use of the explosive. Maximum penalty— (a) for an individual—84 penalty units; or (b) in any other case—840 penalty units. (2) However, another person may assist in the use of a class 7 explosive if the person is under the direct and personal supervision of a holder of a shotfirer’s licence authorising the use of the explosive. 65C Shotfirers’ licences for class 7 explosives (1) An applicant for a shotfirer’s licence must— (a) be 18 years or more; and (b) be physically capable of carrying out the duties of a shotfirer; and (c) produce evidence that the person has— (i) completed a course approved by the chief inspector in relation to the use of the explosive to which the licence relates; or (ii) experience satisfactory to the chief inspector in relation to the use of the explosive to which the licence relates; and (d) have a knowledge of— (i) this Act and regulation; and (ii) the requirements of AS 2187 Part 4—Outdoor Fireworks Displays. (2) The chief inspector may also require an applicant for a shotfirer’s licence to attend an interview with an inspector or undergo a written or practical test conducted by an inspector or other examiner approved by the chief inspector. s 65D 55 Explosives Regulation 1955 s 65F 65D Recording use of class 7 explosives The holder of a shotfirer’s licence must keep a record of their use of class 7 explosives, including the date, time, location and type of explosive used. Maximum penalty— (a) for an individual—5 penalty units; or (b) in any other case—50 penalty units. 65E Reporting theft or shortage of class 7 explosives (1) The holder of a shotfirer’s licence must immediately report a theft or shortage of a class 7 explosive either in transit or at the site at which it is intended to use the explosive to the nearest police station and to the chief inspector. Maximum penalty— (a) for an individual—10 penalty units; or (b) in any other case—100 penalty units. (2) The report must state— (a) full details of the circumstances of the theft or shortage; and (b) what action has been or is being taken to recover the explosives. 65F Reporting accidents involving class 7 explosives The holder of a shotfirer’s licence must immediately report an accident involving the use of a class 7 explosive to the chief inspector. Maximum penalty— (a) for an individual—15 penalty units; or (b) in any other case—150 penalty units. s 66 56 Explosives Regulation 1955 s 66 Division 5—Permits to use explosives 66 Permits (1) The chief inspector or a police officer authorised by the chief inspector, may, upon application duly made grant to a prescribed person a permit to use, fire, detonate or cause explosives to be otherwise exploded. (2) For the purpose of section 12A of the Act and of this section a prescribed person is a person over the age of 18 years who is substantially engaged in primary production. (3) An application for a permit shall be made in duplicate to the chief inspector or to a police officer authorised by the chief inspector in the approved form. (4) The fee set out in schedule 3 shall accompany the application but shall be refunded if such application is refused. (5) Where an application is approved, the chief inspector or a police officer authorised by the chief inspector shall grant a permit in the approved form. (6) A permit granted pursuant to this section shall remain in force for a period of 1 year unless earlier revoked by written notice from the chief inspector but if revoked the permittee shall forthwith return the permit to the chief inspector. (7) The chief inspector or a police officer authorised by the chief inspector shall not approve any application where the chief inspector or police officer is of the opinion— (a) that, by reason of any fact or circumstance, the applicant is not a fit and proper person to hold a permit; or (b) that the applicant is a person who is not capable of using explosives safely or competently; or (c) that the amount or type of explosives required at any one time by the applicant is excessive or unsuitable for the purpose which such explosives are to be used. (8) A permit granted pursuant to this section shall authorise the permittee to use explosives subject to the following terms, conditions and restrictions— (a) explosives shall not be used except on the property of the permittee which shall not be less than 2 ha in area; s 66 57 Explosives Regulation 1955 s 66 (b) blasting shall not be carried out within 100 m of a road, building, structure, caravan, tent or place that is occupied by any person as a dwelling unless approval in writing has been first obtained from the chief inspector; (c) a permit shall not be transferable; (d) a permittee shall report any theft or shortfall in the amount of explosives the subject of the permit which occurs after purchase. (9) Such report shall be made immediately to the nearest police station and to the chief inspector, shall fully set out the circumstances of the theft or shortfall and shall state what action has been or is being taken to recover the explosives. (10) A permittee may prior to the expiration of a permit make application to the chief inspector or to a police officer authorised by the chief inspector in the approved form for the renewal thereof and such application shall be accompanied by the prescribed fee. (11) The chief inspector or a police officer authorised by the chief inspector shall consider such application for the renewal of a permit and when doing so the chief inspector or police officer shall have and may exercise the same powers as are conferred on the chief inspector or police officer by this regulation in respect of an application for a permit and the chief inspector or police officer may approve or refuse any application for a renewal accordingly. (12) When an application for renewal of a permit is approved, the chief inspector or a police officer authorised by the chief inspector shall make a notation or endorsement to the effect that the permit is renewed for a period of 1 year on the back of the permit held by the permittee. (13) Upon renewal, a permit unless earlier revoked by written notice form the chief inspector remain in force for a period of 1 year but if revoked the permittee shall forthwith return the permit to the chief inspector. (14) Where the chief inspector or a police officer authorised by the chief inspector refuses an application for a permit or any renewal thereof the chief inspector or police officer shall notify the applicant in writing of such refusal. s 67 58 Explosives Regulation 1955 s 68 PART 8 Division 1—Inquiries into explosions and fires 67 Notice of fire or explosion required Where in, about or in connection with any vehicle, vessel, factory or magazine containing explosives or at a site where explosives are manufactured other than at a factory there occurs an explosion or fire the owner or master or licensee of such vehicle, vessel, factory or magazine or the person having authority to manufacture explosives other than at a factory shall immediately send or cause to be sent to the chief inspector of explosives notice of such explosion or fire and of the loss of life, personal injury, or other damage occasioned thereby. 68 Inquiry (1) When any such explosion or fire has occurred the Minister may order an inquiry to be held, and may appoint a magistrate, or other person, or persons possessing legal or special knowledge to constitute a court of inquiry with the chief inspector of explosives. (2) The persons holding such inquiry shall hold the same in open court in such manner as they think most effectual for ascertaining the causes and circumstances of the explosion or fire. (3) The court of inquiry shall for the purpose of such investigation have all the powers of a court of summary jurisdiction and all the powers of an inspector of explosives, and also the following powers— (a) they may enter and inspect any place or building the entry or inspection whereof appears to them requisite for the said purpose; (b) they may by summons under their hands require the attendance of all such persons as they think fit to call before them and examine for the said purpose, and may for such purpose require answers or returns to such inquiries as they think fit to make; (c) they may require the production of all books, papers and documents which they consider important for the said purpose; s 69 59 Explosives Regulation 1955 s 70 (d) they may administer an oath, and require any person examined to make and sign a declaration of the truth of the statement made by the person in the person’s examination; (e) any person who without reasonable excuse (proof whereof shall lie on the person) either fails to comply with any summons or requisition of a court holding an investigation under this Act, or prevents or impedes such court in the execution of their duty, shall, for every such offence, incur a penalty not exceeding $200 and, in case of a failure to comply with a requisition for making any return or producing any documents not exceeding $200 during every day that such failure continues. (4) The court shall make a report to the Minister stating the cause of the explosion or fire and the circumstances attending the same, and may make any observations which they think desirable on the matter, and the Minister shall cause such report to be made public in such manner as the Minister thinks expedient. Division 2—Other provisions 69 Interfering with posted rules A person must not (without lawful excuse) deface, remove or otherwise interfere with a document fixed to something under this regulation. Maximum penalty—4 penalty units. 70 Chlorate mixtures Any substance consisting of a mixture of a chlorate and any oxidisable material including ammonia or ammonium salts is declared to be an explosive under and for the purposes of this Act and the manufacture, use, carriage, storage, or handling is thereof prohibited. s 71 60 Explosives Regulation 1955 s 72 PART 9—FRUIT RIPENING 71 Use of dangerous substance A person shall not use or permit or allow to be used, any dangerous substance for or in relation to or in connection with the ripening or colouring of fruit or vegetables— (a) except under an in accordance with a fruit ripening licence under this regulation to use such dangerous substance for such purpose; and (b) unless such dangerous substance is used in such manner and under such conditions as may be prescribed by this regulation. Maximum penalty—4 penalty units. 72 Application for fruit ripening licence (1) Every application for a fruit ripening licence shall be made in duplicate to the chief inspector in or to the effect of the approved form, shall contain the particulars required thereby, shall be signed by the applicant and shall be accompanied by the prescribed fee and any other particulars that may be prescribed. (2) The application shall be accompanied by a plan in duplicate drawn to scale of the site of the rooms showing its relation to the neighbourhood and the exact position of the rooms on the site. (3) On endorsement of an application for a fruit ripening licence by the chief inspector the applicant shall erect the room in accordance with the plan and any condition of the endorsed application and to the satisfaction of the chief inspector, before approval is granted for the issue of the fruit ripening licence. (4) On approval of an application, the fruit ripening licence, accompanied by a plan endorsed by the chief inspector, which plan shall form part of the fruit ripening licence, shall be issued. (5) A fruit ripening licence shall be valid, unless suspended or cancelled, up to and including 30 June next after the date of issue. (6) Application for the renewal of the fruit ripening licence shall be made at least 28 days before 1 July in each year and shall be accompanied by the requisite fee. s 73 61 Explosives Regulation 1955 s 74 (7) Every fruit ripening licence shall be in or to the effect of the approved form. 73 Form of application for renewal or transfer of fruit ripening licence (1) Every application for the renewal of a fruit ripening licence shall be in or to the effect of the approved form. (2) The renewal certificate shall be in or to the effect of the approved form. (3) Every application for the transfer of a fruit ripening licence shall be in or to the effect of the approved form. (4) The form of transfer of a fruit ripening licence shall be in or to the effect of the approved form. 74 Construction and maintenance of rooms A licensee shall not use a dangerous substance for or in connection with or in relation to the ripening or colouring of fruit or vegetables unless— (a) such ripening or colouring is carried out in a room specified in the licensee’s fruit ripening licence; and (b) such room is constructed and maintained in accordance with the following requirements— (i) no room shall be situated below ground level and any room within any place shall be so situated as to provide adequate ventilation to the outer air; (ii) each room shall be properly constructed of sound timber or other approved material, close floored, lined and ceiled so as to be virtually impervious to ripening or colouring agents and shall be maintained in this condition; (iii) a hole 13 mm in diameter securely plugged except when in use shall be provided in the door for examination of the atmosphere within the room; (iv) all gas and electrical control points shall be situated outside the room; (v) all electrical equipment shall be in accordance with the provisions of Australian Standard 3000 Wiring Rules in s 75 62 Explosives Regulation 1955 s 75 force for the time being, appropriate to the relevant Hazardous Areas as defined by Australian Standard 2430 Part I, Appendix A, Section A10, Fruit Ripening Rooms; (vi) all gas pipes, fittings and connections shall be of rigid metal and installed so as not to be exposed to injury; (vii) the equipment and fittings of the room shall be maintained in good working order and condition and no material alteration shall be made to the room equipment or fittings without the approval of the chief inspector. Maximum penalty—4 penalty units. 75 Conditions under which rooms are to be operated (1) The licensee shall not operate a room specified in his or her fruit ripening licence unless the following conditions are complied with— (a) no gas or other inflammable or explosive substance shall be passed into the room except through an approved metering device so installed that the operations of filling and discharging are independent of each other, and every tap delivering gas to or from the metering device shall have its plug sealed against removal except by breaking the seal; (b) no unsealed tap shall be used before it is resealed; (c) there shall be no direct connection through the meter or by any other means whatsoever; (d) where ethylene only is used in operating the room the installation and method of operation shall be approved by the chief inspector; (e) acetylene gas or calcium carbide shall not be used in any room without the approval of the chief inspector; (f) coal gas and ethylene may be used provided that the proportion of either gas at no time exceeds— (i) for coal gas 1.5% of the volume of the room; (ii) for ethylene .05% of the volume of the room; (g) before any other substance is used approval of the use thereof should be obtained from the chief inspector who shall fix the permitted limit. Maximum penalty—4 penalty units. s 76 63 Explosives Regulation 1955 s 78 (2) Subsection (1)(e) does not apply to a room below ground level that was being used at the commencement for ripening or colouring fruit or vegetables, if the chief inspector considers the room provides adequate ventilation to the outer air. 76 Safety rules The licensee shall display or cause to be displayed in a prominent position, where each and every employee engaged in operating the room shall see it, a set of approved safety rules and shall see that every employee engaged in operating the room is fully conversant with such safety rules. Maximum penalty—4 penalty units. 77 Log book The licensee shall keep a log book wherein the licensee shall record or cause to be recorded for each and every room against the date and time of day the recorded number of the charge and the quantity of gas in the charge delivered to the room. Application for, or renewal of, fruit ripening licence . . . . 9.51 68 Explosives Regulation 1955 SCHEDULE 4 CLASSIFICATION OF EXPLOSIVES section 5 1 Classes of explosive (1) Explosives are divided into 7 classes as follows— (a) class 1—gunpowder (b) class 2—nitrate mixture (c) class 3—nitro-compound (d) class 4—chlorate mixture (e) class 5—fulminate (f) class 6—ammunition (g) class 7—firework. (2) If an explosive is in more than 1 class it is taken to be in the last class in which it is mentioned. 2 Class 1 explosives Gunpowder is a class 1 explosive. 3 Class 2 explosives An explosive with a nitrate mixture in it is a class 2 explosive. 4 Class 3 explosives (1) An explosive with a nitro-compound in it is a class 3 explosive. (2) There are 2 divisions of class 3 explosives. (3) Division 1 includes any chemical compound or mechanically mixed preparation all or part of which is nitroglycerine or another liquid nitro-compound. 69 Explosives Regulation 1955 SCHEDULE 4 (continued) (4) Division 2 includes any nitro-compound that is not in division 1. 5 Class 4 explosives An explosive with a chlorate mixture in it is a class 4 explosive. 6 Class 5 explosives (1) An explosive with fulminate in it is a class 5 explosive. (2) There are 2 divisions of class 5 explosives. (3) Division 1 includes— (a) the compounds fulminate of silver and mercury and preparations of these substances as used in percussion caps; and (b) any preparation consisting of a mixture of a chlorate with— (i) phosphorus or certain descriptions of phosphorus compounds, with or without the addition of carbonaceous matter; or (ii) sulphur or a sulphide with or without carbonaceous matter. (4) Division 2 includes substances such as the chloride and the iodide of nitrogen, fulminating gold and silver, diazobenzol and the nitrate of diazobenzol. 7 Class 6 explosives (1) Ammunition is a class 6 explosive. (2) There are 3 divisions of class 6 explosives. (3) Division 1 includes safety cartridges, safety fuses for blasting, railway fog signals and percussion caps. (4) Division 2 includes ammunition (not included in division 1) that does not contain its own means of ignition, for example, cartridges (other than safety cartridges) for small arms, cartridges and charges for cannon, shells, mines, blasting or other similar purposes, shells and torpedoes containing an explosives, fuses (other than safety fuses) for blasting, fuses for shells, tubes for firing explosives, and war rockets. 70 Explosives Regulation 1955 SCHEDULE 4 (continued) (5) Division 3 includes ammunition (not included in division 1) with its own means of ignition, for example detonators, cartridges (other than safety cartridges) for small arms, fuses (other than safety fuses) for blasting, fuses for shells and tubes for firing explosives. 8 Class 7 explosives (1) Fireworks are class 7 explosives. (2) There are 3 divisions of class 7 explosives. (3) Division 1 includes firework compositions (other than manufactured fireworks). (4) Division 2 includes manufactured fireworks containing more than 40 gm of firework composition in each firework. (5) Division 3 includes manufactured fireworks containing not more than 40 gm of firework composition in each firework, enclosed in a case of paper or other suitable material, and includes— (a) amorces or toy caps containing not more than 5 gm of explosive and not more than 0.7 gm of amorphous phosphorus in each 1 000 dots; and (b) throwdowns containing not more than 2.5 gm of explosive and at least 2 kg of non-explosive material in each 1 000 throwdowns; and (c) snaps for bon bon crackers containing not more than 2 gm of explosive in each 1 000 snaps. 71 Explosives Regulation 1955 SCHEDULE 5 PROHIBITED AND RESTRICTED EXPLOSIVES section 14 1. Cartridges for small arms— (a) with a bullet or projectile containing an incendiary, tracer, explosive, lachrymatory or noxious composition, other than— (i) cartridges for use as a flare, distress signal, pyrotechnic signal or wildlife control device; or (ii) cartridges kept in small quantities with the chief inspector’s approval by a genuine collector of ammunition; or (b) in which the bullet or projectile is not firmly fixed; or (c) from which composition may escape because of its construction; or (d) with a split, cracked or defective case. 2. A firework from which firework composition may escape because of its construction. 3. Fireworks liable to explode en masse. 4. A firework, all or part of which explodes, containing aluminium or magnesium mixed with potassium chlorate or another chlorate, with or without another substance. 5. A firework (other than amorces) all or part of which contains potassium chlorate or another chlorate mixed with sulphur, a sulphide or phosphorus, with or without another substance. 6. A firework (other than a class 7, division 2 firework, amorces, throwdowns or snaps for bon bons) containing its own means of ignition. 8. A firework that, on ignition, may be projected through the air in an erratic or unpredictable flight. 9.
