Note:
The research for this thesis was completed in February 2005. In April 2005 the book Law in the
Documents from the Judean Desert appeared (full bibliographical details below). The conclusions
about the relationship between the laws given there do not diverge significantly from what was
maintained in scholarship before: a division according to language is maintained, stating that ‘the
Greek documents reflect a legal practice different from that manifest in the Jewish sources.’ Obviously
I do not agree with this conclusion, as I believe that the legal framework did not change at a substantive
level. The pronounced differences between the Aramaic and Greek documents are mainly due to the
need for adjusting the Greek documents to a Roman court context, that is, adjustment in a formal sense.
The documents can be seen as having been generated with different formal contexts in mind, but with
one continuous substantive underlying the whole.
While it was not possible at such short notice to incorporate opinions from the aforementioned book in
the running text of this thesis, I have added a few references to the book in my footnotes. I plan to
respond to the views given as part of my argument in a later version of the thesis, meant for
publication. These additions will not alter my line of argument and the conclusions as presently
presented.
