A M E N D M E N T S OF THE WEIGHTS AND MEASURES
(PACKAGED GOODS)
REGULATIONS t
1. Regulation 2 of the Weights and Measures (Packaged Goods) Regulations
is a m e n d e d by omitting the word and figures " (Regulations 5-21) " and inserting
in their stead the word and figures " (Regulations 5-21 A ) ".
2 . Regulation 3 of the Weights and Measures (Packaged Goods) Regulations
is a m e n d e d —
(a)
by inserting in sub-regulation ( 1 . ) , after the definition of " lubricating
oil ", the following definition:—
" main display p o r t i o n " , in relation to a package, means that
portion of a package on which the n a m e or b r a n d of the
article contained in the package is shown, o r —
(a) where the n a m e or brand is shown on t w o or m o r e
portions of a p a c k a g e — t h e portion on which it is most
prominently shown; or
(b) where the n a m e or brand is shown on two or more
portions of a package in t h e same p r o m i n e n c e — a n y one
of those portions;"; and
(b)
by inserting in that sub-regulation, after the definition of " peas ", the
following definition:—
" ' poultry ' includes pigeons and pheasants;".
3 . Regulation 4 of the Weights a n d Measures (Packaged G o o d s ) Regulations
is a m e n d e d —

of the item relating t o t h a t article in Part I., o r the metric
units of m e a s u r e m e n t specified in those columns in P a r t II.,
of that Schedule m a y be m a r k e d on the package containing
the article; a n d
(b) the same units of m e a s u r e m e n t shall be marked o n a
package containing an article as are used in relation to
that article." .
4 . Regulation 7 of the Weight'; and Measures (Packaged Goods) Regulations
is a m e n d e d —
( a ) by omitting sub-paragraph (i) of p a r a g r a p h (a) of sub-regulation
( 1 . ) and inserting in its stead the following p a r a g r a p h : —
" (i) b e on the m a i n display portion of the package and, where the
package is of such shape or design that one or more portions
of the package, other than the m a i n display portion, is likely
to be displayed w h e n the article is exposed for s a l e — o n that
portion or on one of those other portions, as t h e case m a y
be;";
(b)
by omitting sub-paragraphs (iii) a n d (iv) of p a r a g r a p h (b) of subregulation (1.) and inserting in their stead t h e following s u b
paragraphs:—
" (iii) shall, in the case of a p a c k a g e that is cylindrical or oval or
substantially cylindrical o r oval, be placed within the,
segment of t h e p a c k a g e subtended horizontally by an angle
of o n e h u n d r e d a n d twenty degrees a t the centre of t h e per
pendicular axis of the p a c k a g e ;
(iv) shall be in the English language and, subject t o these R e g u
lations, shall be expressed either in C o m m o n w e a l t h legal
units of m e a s u r e m e n t related t o t h e yard, t h e p o u n d o r the
gallon o r in terms of t h e metric system of m e a s u r e m e n t related
to the m e t r e , t h e g r a m m e o r the litre; a n d
( v ) shall n o t be o b s c u r e d or crowded by any o t h e r p r i n t e d o r
graphic m a t t e r . " ;
( c ) b y inserting in p a r a g r a p h ( a ) of sub-regulation ( 2 . ) , after t h e w o r d s
" t w o fluid o u n c e s " , t h e w o r d s " or 75 g r a m m e s o r 7 5 millilitres " ;

words " in terms of the metric system of m e a s u r e m e n t related to t h e
m e t r e , the g r a m m e or the litre "; and
by omitting sub-regulations ( 9 . ) a n d ( 1 0 . ) a n d inserting in their
stead the following sub-regulation:—<
" ( 9 . ) T h e provisions of sub-regulation ( 1 . ) of this regulation
a p p l y to a n d in relation t o t h e m a r k i n g o n a p a c k a g e containing an
article of t h e statements required t o be m a r k e d p u r s u a n t t o regulation
18, 19, 21 o r 2 1 A of these Regulations.".
5. Regulation 9 of t h e Weights and M e a s u r e s (Packaged G o o d s ) Regulations
ii amended—
( a ) by omitting from sub-regulation ( 1 . ) the w o r d s " a unit of m e a s u r e
m e n t of the metric system,";
(b) b y a d d i n g at the end of t h a t sub-regulation the w o r d s " or in t e r m s
of t h e t o n n e , k i l o g r a m m e , g r a m m e o r m i l l i g r a m m e " ;
( c ) b y adding at the end of p a r a g r a p h ( a ) of sub-regulation (2.) t h e w o r d s
" or in t e r m s of the t o n n e , k i l o g r a m m e , g r a m m e o r milligramme ";
(d) by omitting p a r a g r a p h s ( c ) and (d) of that sub-regulation and
inserting in its stead the following p a r a g r a p h s : —
" ( c ) subject to the next succeeding p a r a g r a p h , w h e r e the weight
or measure of an article is expressed in t e r m s of t h e metric
system of m e a s u r e m e n t and in terms of units of m e a s u r e
m e n t related to the yard, the p o u n d and the gallon—
(d)
(i) fractions of a unit of m e a s u r e m e n t related to the yard,
the p o u n d or the gallon m a y be expressed in decimal
sub-multiples of that unit; and
(ii) decimal sub-multiples of a unit of m e a s u r e m e n t of the
metric system of m e a s u r e m e n t m a y be expressed in
fractions of that unit;
where fractions of a unit of m e a s u r e m e n t related to the p o u n d
m a y , in p u r s u a n c e of t h e last preceding p a r a g r a p h , be
expressed in decimal sub-multiples of that unit, decimal submultiples of an o u n c e m a y be expressed in t e r m s of h u n d r e d t h s
of an o u n c e for quantities not greater than four ounces and in
tenths of an ounce for quantities greater t h a n four ounces but
less t h a n one pound;".
6. Regulation 10 of t h e Weights and Measures (Packaged Goods) Regulations
is a m e n d e d —
( a ) by omitting from sub-regulation ( 1 . ) the words " i n terms of a unit
of m e a s u r e m e n t of t h e metric system or ";
(b)
by adding at the end of that sub-regulation the words " or in t e r m s of
t h e cubic metre, cubic decimetre or litre, or cubic centimetre or millilitre "; a n d

( c ) by omitting sub-regulation ( 3 . ) and inserting in its stead the following
sub-regulations:—
" ( 3 . ) W h e r e t h e volume of an article is expressed in t e r m s of
units of m e a s u r e m e n t related t o t h e gallon and in units of m e a s u r e m e n t
related to the litre, fractions of a unit of m e a s u r e m e n t related t o the
gallon m a y be expressed in decimal sub-multiples of that unit.
" ( 4 . ) W h e r e t h e v o l u m e of an article is expressed in terms of units
of m e a s u r e m e n t related to the cubic foot and in terms of a metric
unit of v o l u m e , fractions of a unit of m e a s u r e m e n t related t o t h e
cubic foot m a y be expressed in decimal sub-multiples of that unit.".
7. After regulation 10 of t h e Weights a n d Measures
Regulations the following regulation is i n s e r t e d : —

" 10A. W h e r e the weight o r measure of an article t o which section 8 of the
O r d i n a n c e applies is m a r k e d o n the p a c k a g e containing the article by reference
to a decimal sub-multiple—
( a ) the decimal sub-multiple shall n o t be expressed to m o r e t h a n three
significant figures; a n d
(b) t h e decimal point that indicates t h e sub-multiple shall be p r e c e d e d
by z e r o o r b y a n u m e r a l . " .
8. Regulation 11 of t h e Weights a n d M e a s u r e s (Packaged Goods) Regulations
is a m e n d e d —
(a)
b y omitting from p a r a g r a p h (a) of sub-regulation ( 2 . ) the w o r d s
" o r t h e y a r d " a n d inserting in their stead t h e w o r d s ", y a r d , kilo
g r a m m e , cubic decimetre, litre or metre ";
(b) b y omitting from p a r a g r a p h (d) of sub-regulation ( 2 . ) the w o r d s
" and an additional statement stating t h e quantity in fluid ounces
m a y be added " ;
( c ) by omitting pat igraph ( / ) of that sub-regulation and inserting in
its stead the folljwing p a r a g r a p h : —
" (/) in any case, t h e package containing an article m a y be m a r k e d
with an additional statement stating t h e quantity of t h e article
in fluid o u n c e s . " ; a n d
(d)
by adding at the end thereof the following s u b - r e g u l a t i o n s : —
" ( 3 . ) Subject to the next succeeding sub-regulation, where t h e
quantity of an article is expressed in terms of a unit of
m e a s u r e m e n t of t h e metric system, the statement of weight or
measure used in relation to t h e article may be expressed in t e r m s
of a unit of weight o r m e a s u r e specified in the First C o l u m n of the
table in this sub-regulation if t h e weight or m e a s u r e so expressed is
n o t greater t h a t t h e weight o r m e a s u r e specified in t h e Second C o l u m n
of t h e table opposite t o t h e first-mentioned weight o r m e a s u r e .

" ( 4 . ) Notwithstanding t h e provisions of the last preceding s u b regulation, the measure of paper lengths may be expressed in milli
metres if the measure so expressed is not greater t h a n ten t h o u s a n d
millimetres.".

" ( 9 . ) T h e preceding provisions of this regulation d o not apply to
additional statements of t h e weight o r m e a s u r e of an article that
are m a r k e d on the package containing the article p u r s u a n t to p a r a
graph (b) of sub-regulation ( 8 . ) of regulation 7 of these Regulations.".
10. Regulation 13 of t h e Weights a n d M e a s u r e s (Packaged Goods) Regulations
is a m e n d e d —
{a) by omitting from p a r a g r a p h (b) of sub-regulation (1.) the w o r d
"or";

1 1 . R e g u l a t i o n 14 of t h e W e i g h t s a n d M e a s u r e s ( P a c k a g e d G o o d s ) R e g u l a t i o n s

sub-regulations:—
" ( 2 . ) N o t w i t h s t a n d i n g t h e last p r e c e d i n g s u b - r e g u l a t i o n , a s t a t e m e n t of t h e
weight of a n u m b e r of eggs c o n t a i n e d t o g e t h e r in a p a c k a g e m a y be e x p r e s s e d —

package; or

" ( 3 . ) Notwithstanding sub-regulation ( 1 . ) of this regulation, a statement of
the weight of dressed poultry m a y be expressed in t e r m s of a m i n i m u m net
weight and, where the weight is so expressed, the statement shall include the
size n u m b e r of the poultry, being the size n u m b e r specified in the second column
of the Fifth Schedule opposite to the m i n i m u m net weight specified in t h e first
c o l u m n of that Schedule.
" ( 4 . ) T h e size n u m b e r m a r k e d on a package containing dressed poultry in
p u r s u a n c e of t h e last preceding sub-regulation shall be m a r k e d in figures of a
size n o t less t h a n 10 millimetres.
" ( 5 . ) T h e last two preceding sub-regulations d o not apply to cooked poultry
or t o dressed poultry that has been detached from t h e carcass.".
1 2 . Regulation 18 of t h e Weights a n d M e a s u r e s (Packaged G o o d s ) Regulations
is a m e n d e d —
( a ) by omitting sub-regulation ( 1 . ) a n d inserting in its stead the following
sub-regulation:—
" ( 1 . ) Subject to this regulation, a p a c k a g e containing pre-packed
m e a t , natural cheese, dressed poultry, fish (including Crustacea), u n sliced bacon, h a m o r smallgoods shall, before being exposed for sale,
be marked—
(a)
(b)
(b)
with a statement of the price p e r p o u n d or per k i l o g r a m m e
of the article; and
where the p a c k a g e contains m o r e t h a n one article, with a
statement of the price p e r p o u n d or per k i l o g r a m m e of each
of the articles contained in the package.";
by inserting in sub-regulation ( 2 . ) , after the word " p o u n d " t h e words
" o r per k i l o g r a m m e ";
( c ) b y omitting sub-regulation ( 3 . ) a n d inserting in its stead the following
sub-regulation:—
" ( 3 . ) Sub-regulation ( 1 . ) of this regulation does n o t apply to or
in relation t o an article if—
( a ) a statement of the price p e r p o u n d or per k i l o g r a m m e of the
article is indicated by a p r o m i n e n t statement in letters of a
size of not less t h a n T e n millimetres placed on o r i m m e
diately adjacent t o a tray in or on which there a r e displayed
packages containing that article;
(A) t h e article consists of—
(i) frankfurts;
(ii) minced m e a t ;
(iii) sausage m e a t ;
(iv) sausages;
( v ) saveloys;
(vi) sliced cooked m e a t ; or
(vii) sliced b a c o n ,
p a c k e d in net weights of two ounces, four ounces, six
ounces, eight ounces, twelve ounces, one p o u n d , one and
one-half p o u n d s or in multiples of one p o u n d , or in net
weights of fifty g r a m m e s , one h u n d r e d g r a m m e s , one h u n
dred and twenty-five g r a m m e s , t w o h u n d r e d g r a m m e s , t w o
h u n d r e d and fifty g r a m m e s , three h u n d r e d and seventy-five
g r a m m e s , five h u n d r e d g r a m m e s o r in multiples of five
hundred grammes;

( c ) t h e article consists of natural cheese packed in net weights
of four ounces, six ounces, eight ounces, twelve ounces, o n e
p o u n d , one a n d one-half p o u n d s or in multiples of o n e
p o u n d o r in n e t weights of one h u n d r e d g r a m m e s , t w o
h u n d r e d g r a m m e s , five h u n d r e d g r a m m e s or in multiples of
five h u n d r e d g r a m m e s ;
(d)
t h e article consists of frozen fish;
(e)
t h e article consists of dressed poultry the statement of t h e
weight of which is expressed to be a m i n i m u m weight; or
( / ) the article is p a c k e d t o a net weight of one p o u n d o r a n
integral multiple of one p o u n d , or one k i l o g r a m m e o r a n
integral multiple of one k i l o g r a m m e . " .
1 3 . Regulation 19 of t h e Weights and M e a s u r e s (Packaged G o o d s ) Regula
tions is a m e n d e d —
(a)
b y inserting in sub-regulation ( 1 . ) , after the word " t o n "
o c c u r r i n g ) t h e w o r d s " o r one t o n n e " ; and
(wherever

14. After regulation 2 1 of the Weights and M e a s u r e s (Packaged
Regulations the following regulation is inserted in Part I I I . : —

" 2 1 A . — ( 1 . ) I n this r e g u l a t i o n —
' Class A fibre' m e a n s a fibre consisting of w o o ! or o t h e r animal fibre,
viscose or c u p r a m m o n i u m r a y o n o r a mixture of any t w o o r m o r e
of t h o s e fibres;
' Class B fibre' m e a n s a fibre consisting of silk, cotton or
a c e t a t e o r a mixture of any t w o o r m o r e of those fibres;
cellulose
' Class C fibre' m e a n s a fibre or a mixture of fibres other than a Class A
fibre o r a Class B fibre;
' cotton w o o l ' includes cotton wool m a d e from fibres other t h a n c o t t o n .
" ( 2 . ) Y a r n and c o t t o n wool are declared t o b e articles that are, for the
p u r p o s e s of section 12 of t h e O r d i n a n c e , articles that may be packed in a p a c k a g e
m a r k e d " N e t weight at s t a n d a r d condition " o r w o r d s t o the like effect.
" ( 3 . ) Subject t o sub-regulation (5.) of this regulation, t h e n u m b e r specified
in C o l u m n 2 of t h e F o u r t h Schedule opposite to a class of fibre specified in
C o l u m n 1 of that Schedule is prescribed for the purposes of p a r a g r a p h ( c ) of
sub-section ( 4 . ) of section 12 of t h e O r d i n a n c e .
" ( 4 . ) Subject t o sub-regulation ( 6 . ) of this regulation, the n u m b e r specified
in C o l u m n 3 of t h e F o u r t h Schedule opposite t o a class of fibre specified in
C o l u m n 1 of t h a t Schedule is prescribed for the p u r p o s e s of p a r a g r a p h (ft) of
sub-section ( 5 . ) of section 12 of t h e O r d i n a n c e .

fibres of which the article contained in the package is composed.".
15. Regulation 22 of t h e Weights and M e a s u r e s (Packaged Goods) Regulations
is repealed a n d t h e following regulation is inserted in its s t e a d : —
" 2 2 . — ( 1 . ) Subject t o t h e next succeeding sub-regulation, an expression that
is m a r k e d on a p a c k a g e containing a pre-packed article (other t h a n an article
referred t o in item 4 or 5 of the Second Schedule) is a prohibited expression for
the purposes of section 15 of the O r d i n a n c e if it relates to the contents of the
pre-packed article or the package and consists of o r includes the word ' gross '
or the words ' gross w e i g h t ' or words t o the like effect.
" ( 2 . ) Sub-regulation ( 1 . )
where—
of this regulation does not apply to a package
(a)
t h e gross weight of t h e p a c k a g e exceeds ten pounds or four kilo
grammes;
(b) t h e net weight of the contents of the package is marked on the
package; a n d
( c ) the words ' for transport only ' are marked on the package.".
16. Regulation 25 of the Weights and Measures (Packaged Goods) Regulations
is a m e n d e d by omitting the w o r d " T h i r d " a n d inserting in its stead the word
" Second ".
17. After regulation 25 of the Weights a n d Measures (Packaged
Regulations the following regulation is inserted:—

contained in a package on which there is set out a direction that the entire contents
of the package, or each of a stated number of smaller packages contained in the
package are to be diluted to a stated weight or measure, including—
(i) jelly crystals, blancmange powders, custard powders, junket tablets and junket
powders;
(ii) photographic developers and fixers and chemicals packed for use in connexion
with photography;
(iii) chemicals packed for agricultural or horticultural use; and
