It was further resolved to approve the Town Clerk' s action in loaning barriers to the Ramsey Branch RNLI. 2015116: 225) Town Clerk' s Report —Spar Store - Alcohol Licence: Resolved: To note and approve the Town Clerk' s Report dated 30 °i November, 2015, advising that the attention of the Licensing Court has been brought to views expressed in 2014 concerning the sale of alcohol within a sub -post office. 2015/ 16: 226) Town Clerk' s Report— Spar Store - Wind Farm Manx Coastal Waters: Resolved: To note and approve the Town Clerk' s Report dated 30 °i November, 2015, advising that the Department of Infrastructure has signed a contract, by way of an Agreement for Lease with DONG Energy, which, the Department say, is aimed at further unlocking the Isle of Man' s potential to become a leading in offshore energy production. Queries with regard to various accounts were answered to members' 1 Ramsey Town Commissioners —Board Meeting 16 "' December, 2015, Public Continued: 11 Works and Development: 2015/ 16: 228) Town Clerk' s Report— Public Phone Kiosk Stanley Mount: Members considered the Town Clerk' s Report dated 30° i November, 2015, concerning the advice given by Manx Telecom of their intention to remove the public telephone kiosk from Stanley Mount, due to its lack of use. Resolved: To inform Manx Telecom that the Commission have no comment to make on their wish to take the telephone out of commission as a public payphone. Members queried whether the Emergency Services had expressed any comments and whether the kiosk could be or an alternative use found. 2015/ 16: 229) Chief Technical Officer' s Report —Planning Applications: Resolved: That Chief Technical Officer' s Report dated 10 "' December, 2015, detailing planning applications received from the Department of the Environment, Food and Agriculture, under the planning consultation procedures, be noted and approved, subject to the following:REP NO: 3336 P. A. NO.: 15/ 01238/ C APPLICANT: Mr. B. Forrest PROPOSED: Additional use of the building as tourist accommodation NOTES: P. A. - Change of Use SITE: The Gables, 1, Grove Mount South, Ramsey It was agreed to request that consideration of this application be deferred pending receipt of further information. Concern was expressed about lack of on- street parking. Dr. A. J. Allinson declared an interest due to proximity of the Group Practice Centre. 2015/ 16: 230) Chief Technical Officer' s Report —Consultation Local Government and Building Control (Amendment) Bill 2016: Members considered the Chief Technical Officer' s Report dated 10 °i December, 2015, and an Addendum Report dated 16 °i December, 2015, concerning amendments proposed to be introduced by the above -titled Bill, comments on which are invited to be submitted by 22` 1 December, 2015. Resolved: To inform the Department that the Commission consider the requirement of a local authority to make application, in term of Section 22 of the Building Control Act 1991, is protracted and think it would be better if the Local Authority could indicate its wish to act and the person against whom it proposed to take action appeal to the Department in the first instance, and then the High Bailiff, if necessary. Mrs. S. P. Beattie attended the meeting at this stage, 7. 25 p. m. Concern was also expressed with dangerous buildings abutting a highway. It was felt that powers formerly vested to the " Highway Authority" should be reintroduced and become the responsibility of a local authority. 3 Ramsey Town Commissioners —Board 2015/ 16: 229) Meeting 1601 December, 2015, Public Continued: Chief Technical Officer' s Report —Flooding Event: Resolved: To note and approve the Chief Technical Officer' s report dated 10 °i December, 2015, advising of works undertaken by the Direct Labour Workforce during recent incidents of flooding on 3" 1 December, 2015, and in subsequent extreme weather conditions. Members wished their appreciation of all the work done by our workforce and all the emergency services. Members also questioned the need to have a rolling programme of street cleaning, and were informed that one was in place. The Chief Technical Officer informed members that part of the problem in this incident of flooding was the detritus swept down because of the heavy rain running off the Mountain Road and blockage of the Leighany Stream culvert and road gullies. Despite regular attention to the gullies it had been necessary to hire a road sweeper. It was agreed to investigate the acquisition of a road sweeper. Members suggested that fliers be distributed, particularly in Autumn /Winter in areas where it has not been possible to clean streets /gullies because of parked cars, in an attempt to ensure access to gullies. Concern was expressed about the bridge collapse in Laxey, and as the Ramsey Stone Bridge is understood to be of similar construction, it was agreed to seek assurances from the Department of Infrastructure as to the bridge' s integrity. 2015/ 16: 230) Chief Technical Officer' s Report — Glasgow Refuse Vehicle Crash Inquiry: Resolved: To note and approve the Chief Technical Officer' s report dated 9 °i December, 2015, advising of recommendations made to Glasgow City Council with regard to refuse collection, issued after the Inquiry into the Glasgow refuse vehicle crash that occurred in December, 2014. Actions already implemented by this authority with regard to staff training and non peak time refuse collections were noted. It was agreed to ask the Department of Infrastructure if definitive guidelines might be issued with regard to Heavy Goods Vehicle Drivers. 2015/ 16: 231) Chief Technical Officer' s Report - Market Square Regeneration Works: Resolved: To note and approve the Chief Technical Officer' s Report dated 9° i December, 2015, advising of progress of works at Market Square as part of the Ramsey Regeneration works. 4 1 Ramsey Town Commissioners —Board Meeting 16 °1 December, 2015, Public Continued: 11 2015/ 16: 232) Chief Technical Officer' s Report - Monument Parliament Square Resolved: To note and approve the Chief Technical Officer' s Report dated 9 °i December, 2015, advising that delivery of the Victoria style lamp to be installed on the monument at Parliament Square will, it is anticipated, be delivered in early January, 2016. 2015/ 16: 233) Chief Technical Officer' s Report - Works to Bircham Avenue: Resolved: To note and approve the Chief Technical Officer' s Report dated 10 °i December, 2015, advising of progress of road reconstruction works, including the laying of new below ground services at Bircham Avenue, Ramsey. Housing and Property: 2015/ 16: 234) Housing and Property Manager' s Report - Lakeside Centre Public Conveniences: Resolved: To note and approve the Housing and Property Manager' s Report dated 10`x' December, 2015, advising of near completion of refurbishment of the public conveniences situate at the Lakeside Centre, Mooragh Park. Parks and Leisure: 2015/ 16: 235) Town Clerk' s Report —Promenade Run Series: Members considered the Town Clerk' s Report dated 9 °i December, 2015, advising of the request made that the Commissioners' permit a run to be held in the vicinity of the Mooragh Park and Mooragh Promenade on 2` 1 April, 2016, as part of a series of runs. Resolved: That permission be granted subject to the Commission being indemnified, in writing, against loss or damage prior to or as a consequence of the event and the event receiving athletics governing body approval. Mayers apologised that he had not been able to attend the November Board meeting, and asked if he could report on various matters, viz: 2015/ 16: 237) Ramsey Courthouse: The ad hoc Committee formed to consider future options for the Courthouse building has had a preliminary meeting, at which he was appointed to its chair. During the meeting Mr. Shimmin had intimated that re- organisation of local authorities was not high in departmental priorities. Mr. Mayers asked if he might be appointed the Commissioners' official representative to the Association. Resolved: Following a proposal by Mr. L. L. Hooper, seconded by Mrs. S. P. Beattie and agreed without division that Mr. Mayers be so appointed. 2015/ 16: 240) Decorative Street Lighting: Dr. Allinson raised concerns voiced by the Chamber of Commerce, concerning the lack of decorative street lighting in the vicinity of the Courthouse and Regeneration area. The Chief Technical Officer reminded members that the lights had been initially removed as part of the regeneration scheme and that problems had arisen in fixing replacements because of power supply and insurance implications. It had been proposed to fix the lighting, using a bracket, to street lighting columns, but problems had arisen in that a firm involved with this was no longer in business. Resolved: To note that the matter has been raised at recent Regeneration Meetings and it is hoped that it can soon be resolved. 6 II Ramsey Town Commissioners —Board Meeting 16 "' December, 2015, Continued: The Chairman thanked the public and media representatives for their attendance and, after wishing everyone all good wishes for Christmas and the New Year, closed the public part of the meeting at 8. 00 p. m. 0000000--- The following items were considered in private the detail of which, having regard to data protection, matters affecting persons who cannot be named, etc., is not as extensive as that contained in minutes of matters discussed in public. 2015/ 16: 241) Minutes - Board Meeting: Resolved: To note that no Minutes of the Board meeting held on 18 °i November, 2015, were recorded in private. 2015/ 16: 242) Housing Allocations Committee: Resolved: To note and approve the Minutes of the Meeting of the Housing Allocations Committee held on I" December, 2015, subject to the following: Clause 55a) The Lead Member advised that those tenants offered tenancies at the new properties at Shipyard Road had accepted them. The Lead Member verbally informed members that the property vacated consequent upon legal action for non -payment of rent, was not yet ready for re- allocation and that the offer of a transfer to that property and associated action remained pending. Finance and General Purposes: 2015/ 16: 243) Town Clerk' s Report - Former Railway Line - Gardener' s Lane: Members considered the Town Clerk' s Report dated 8 °i December, 2015, concerning the request made by Dandara Ltd., with regard to the acquisition of land in the Commission' s ownership forming part of the former Railway Line, at Gardener' s Lane, Ramsey. Mr. H.S. Bevan declared an interest, due to residential proximity. Members felt they needed further clarification from the Government Valuer' s Office particularly in view of an established formula for calculating land value in similar circumstances to this enquiry. Resolved: That and officer from the Government Valuer' s Section be invited to attend the at the Commissioners' meeting in January; 2016, and subject to such advice the Chairman, Lead Member for Finance and Town Clerk be authorised to meet with representatives of the developer and report further. II Ramsey Town Commissioners —Board Meeting 16 °i December, 2015, Continued: 2015/ 16: 244) Finance Officer' s General Report: Resolved: To note and approve the Finance Officer' s Report dated 10'' December, 2015, subject to the following: Aged Debtors: It was agreed the Town Clerk seek an update front our Advocates with regard to pending legal action for debt recovery from a particular party. Estimates —Proposed by Mr. L. L. Hooper, seconded by Mr. H. S. Bevan and agreed to accept the recommendations submitted. Works and Development: 2015/ 16: 245) Town Clerk' s Report - Electric Vehicle Charging Points: Members considered the Town Clerk' s Report dated 8 °i December, 2015, concerning the installation of two electric vehicle charging points at the Market Place car park and a request made to determine if any further points will be established in the Town. Resolved: That the Electric Vehicle Isle of Man Group be informed that the Commissioners regret they are not prepared to consider the provision of further electric vehicle charging points within the Town. It was agreed that the matter be reviewed in approximately 12 months' time. Housing and Property: 2015/ 16: 246) Town Clerk' s Report - Public Sector Housing in the North: It was noted that the Department of Infrastructure representatives had decided against attending the meeting. Members considered the Town Cleric' s Report dated 30 °i November, 2015, concerning the possible establishment of a Housing Authority to serve the North of the Island. Resolved: To receive the Town Clerk' s report dated 30°i November, 2015. 2015/ 16: 247) Housing and Property Manager' s Report - Ramsey Future Projects: Resolved: To note the Housing and Property Manager' s Report dated 9 °i December, 2015, concerning the current status of Ramsey future housing projects. It was further resolved That Messrs' A. J. Harmer, G. S. Jones and L. L. Hooper be authorised to meet with the Housing and Property Manager and to liaise with the with regard to future projects at Close Woirrey and Mayfield. Design Team 11 Ramsey Town Commissioners —Board Meeting 16 "' December, 2015/ 16: 247) 2015, Continued: Housing and Property Manager' s Report - Ramsey Future Projects continued: Further to her report the Rousing and Property Manager provided a verbal report that authority is required to progress fee negotiations with a new Mechanical and Engineering Consultant, and to approve fees in the sum of £7, 620, plus V.A.T., to an Addendum D1 Stage. It was agreed that authority be granted and funding be met from the Housing Reserve Fund if required. Parks and Leisure: 2015/ 16: 248) Town Clerk' s Report - Interpretation Boards: Members considered the Town Clerk' s Report dated 30 °i November, 2015, concerning the approach made to Dr. A. J. Allinson with regard to the provision of interpretation boards on the Mooragh Park to reflect its history and development. Resolved: That the Town Clerk be authorised to obtain the text available and discuss the matter further with Isle of Man Advertising and PR Ltd. Any other Business: 2015/ 16: 249) Town Clerk' s Report - Local Authority Transition: The Town Clerk' s tabled report dated 15 "' December, 2015, detailing a request made by the Department of Infrastructure that local authorities have additional responsibilities, under recent transition arrangements. The additional responsibilities include on street parking and public toilet management, for those not in the Commission' s ownership. Resolved: To take responsibility for the day to day management of public toilets situate at Derby Road, Ramsey, with effect from I" April, 2016. In this regard it was noted that discussions will need to take place with the contractor engaged by the Commission to clean public conveniences in Ramsey. It was further resolved that the Department be informed that the Commission would be interested in management of on street car parking and the Town Clerk be authorised to seek further information on what is entailed. It was noted that on- street parking controls would relate only to disc zone areas. 11 1 Ramsey Town Commissioners —Board Meeting i 16 ° December, 2015, Continued: 2015/ 16: 250) Lakeside Centre Tenancy: The Town Clerk verbally reported that he had met with the prospective tenant of the Lakeside Centre earlier in the day. The tenant is now in a position to sign a lease and has confirmed that permission has been granted to enable the sale of ice -cream and the intention to open by Taster 2016. It was noted that some preliminary works are required, which can be undertaken by the Commissioners' workforce. Resolved: That the Town Clerk be authorised to submit the required Petition seeking the Department' s formal approval to the leasing agreement. 2015/ 16: 251) Planning Appeals: The Chief Technical Officer referred to decisions made in respect of planning appeals submitted by the Commission, as follows: 80, Parliament Street The planning application has been approved, but there is now a condition that the two windows affecting the Dolce Vita property have been deleted. Murdoch House The Commission' s appeal was not successful and the application has been approved. Resolved: To be noted. 2015/ 16: 252) Planning Application: The Chief Technical Officer verbally reported that the planning application concerning the demolition of bungalows on Park Road, Ramsey, has been approved, and queried whether or not the Commission wished an appeal to be submitted. Resolved: That no appeal be submitted. It was further resolved to draw the attention of the owner of the property to the restrictive covenant in place with regard to the use of the property on this site. The meeting closed at 9. 45 p. m., giving duration for payment of attendance allowances of 3 hours. Mr. L. 1. Hooper asked that his apologies be recorded should he be absent from meetings held in January, 2016. Chairman. IU 11 RAMSEY TOWN COMMISSIONERS CHAIRMAN' S REPORT JANUARY, 2016. Fellow Members, Holocaust Memorial Service 2016 The Hon. A. R. Bell,M.H.K., Chief Minister, has extended and invitation to a representative and guest from the Commission to the Island' s commemoration of Holocaust Memorial Day on Sunday 24 January 2016. The Service takes place at St Thomas' Church, Finch Road, Douglas at 3. 00 pm. The congregation is requested to be seated by 2. 45 pm. Holocaust Memorial Day is a time to remember all the innocent victims of Nazi persecution, and to remind ourselves that evil ideologies and regimes are not necessarily a thing of the past. The Isle of Man has a long and proud tradition of parliamentary democracy and it is therefore entirely appropriate that the Government and the people of the Island should be marking Holocaust Memorial Day. Civic Attendances Ramsey Rotary Club Community Carol Service Town Christmas Events I was pleased to attend the 26`x' Charter Dinner of the Ramsey Probus Club in the company of His Excellency the Lieutenant Governor Mr. Adam Wood. 150`x' Commemorative Concert The next Ramsey Town Commissioners commemorative concert will feature the Manx choir - Cliogaree Twoaie together with duo - Marlene Hendy & Dilys Sowrey and guest organist - David Kilgallon It will be held at St Mary Star of the Sea & St Maughold Catholic Church, Ramsey on 7: 30 pm ( Doors open 7 p. m.). RAMSEY TOWN COMMISSIONERS TOWN CLERK' S REPORT ARTS COUNCIL' S STRATEGIC PLAN FOR THE ARTS JANUARY 2016 —PUBLIC Mr. Chairman and Members, The Isle of Man Arts Council has circulated its draft Strategic Plan for the Arts for comment. A copy of the document has been circulated to Members in advance of the meeting. I and Chief Executive RAMSEY TOWN COMMISSIONERS TOWN CLERK' S REPORT CONSULTATION —IDENTIFICATION MEASURES JANUARY 2016 —PUBLIC Mr. Chairman and Members, The Department of Home Affairs is inviting feedback on the possibility of introducing border identity checks for people travelling to and from the Isle of Man by sea. Identity measures at sea ports are being considered as a way of improving the safety of the Isle of Man and its residents. The Department believes that a requirement for people to verify their identity before travelling by sea would help to combat crime. The Chief Constable' s annual report for 2014 -15 highlighted the vulnerability of our borders as the biggest threat to national security. The report said action was needed to prevent the Island being seen as a soft target by criminals who travel under a false name to commit offences such as drug smuggling and money laundering. People entering and leaving the Island via sea ports are currently not required to produce photographic identification. The public consultation is seeking the views of individuals and businesses on whether this needs to change to aid the detection of criminal activity. The proposal would require people travelling by sea to show one of 14 valid forms of identification —such as a driving licence, passport or bus pass — when checking in. This would have an impact on ferry boarding times and result in a need for additional staff and new facilities for foot passengers and vehicle drivers waiting to pass through the border checks. Further information on this proposal can be found in the consultation paper attached, or which can be viewed on the Government consultation website at httus:// www. gov. im /ConsultationDetail. gov ?id =556 Responses to this consultation are required by Thursday, 12th February, 2016. V and Chief Executive RAMSEY TOWN COMMISSIONERS TOWN CLERK' S REPORT CONSULTATION SEMINAR ON LEGAL AID JANUARY 2016 —PUBLIC Mr. Chairman and Members, Mr. Andrew Swithinbank, Chair of the Independent Legal Aid Committee (LAC) has written to all local authorities and other groups, regarding the review of how legal advice and representation is provided to those without means to pay for it themselves. As part of the review, the LAC consulted publicly, providing an opportunity for relevant agencies and the wider community to submit their views, in particular on the ability of the current system to provide: 1. fairness and equity in access to justice; 2. Effective use of limited resources and value for money; Transparency, simplicity and efficiency; 3. 4. 5. Professionalism and continuous quality improvement in practice; and Shaping the service around the needs of its customers / clients / users. The Committee has also met with several organisations that are important stakeholders in the criminal and civil justice arena. Through this process the LAC has identified areas for streamlining, simplification and improved efficiency and consistency in the delivery of the current service and considered areas with the potential for more radical structural change in the future. The Committee has extended an invitation to a seminar so that it can share the story so far on this review and engage as it considers the future shape of government supported access to legal help. At the seminar, members of the Legal Aid Committee and officers in the Legal Aid service will: 1. Provide feedback on the consultation process; 2. Explain the improvements to the existing system which have already been implemented; 3. Outline the further improvements to the existing system which have been proposed in our consultations and through our own analysis of the current system; 4. Outline areas for more radical changes which have been proposed in our consultations and through our own analysis of alternative systems; and 5. Suggest the next steps to engage you in considering these potential changes. The Electoral Registration Officer has also written to all authorities advising that the annual canvass for electoral registration has commenced, with forms having been delivered to every household in the week commencing 4° January. i The Electoral Registration Officers main priority is to ensure the electoral register is accurate and complete. In the absence of gateways for sharing information from other sources, the only way of obtaining information at the moment to ensure the accuracy of the register is by requiring the information to be supplied by householders in the Isle of Man. The annual canvass is the method by which this information is required. The canvass serves two purposes. Firstly to ensure information is provided to confirm the eligibility for continued inclusion on the register and, secondly, to provide the opportunity for those not registered to become registered. The legislation is quite clear that any person who without reasonable excuse fails to comply with the requirement to provide information is guilty of an offence and liable on summary conviction to a fine not exceeding £ 1, 000 ( section 5( 4) of the Registration of Electors Act 2006). No person should be incorrectly registered or registered when not entitled. lto Town Clerk' s Report - Electoral Register January, 2016 - Public Continued: As referred to above the only way of establishing whether a person is entitled to be registered or is correctly registered is by requiring information to be provided. If the information is not provided to confirm their eligibility then the Registration Officer cannot be satisfied they should continue to be included in the register. 'Therefore it is not a requirement to re- register annually but it is a requirement to provide information to confirm eligibility for continued registration. This concept is not unique, the objective is to encourage registration rather than criminalising people. It is well recognised that electoral legislation, both in respect of registration and for provisions relating to the holding of elections, requires modernisation. A root and branch review of all aspects of such legislation and practices will address the deficiencies to provide a clear and practical basis for electoral registration going forward. New legislation arising from the review will not be in place for a number of years. It is important to understand that ultimately failure to return the completed form could result in removal on the basis there is no evidence of eligibility. Communication of the importance of this matter will be through a number of different methods which includes radio, newspaper and social media to reach as many people as possible. Until such time as the legislation can be updated the following process has been adopted for 2016:- Forms have been issued at the beginning of January clearly stating it is a requirement to return the form and specifying that the penalty for failure to return the form without reasonable excuse is a fine of up to £ 1, 000. An earlier return date, by 1 February 2016, has been specified to seek to minimise the risk ofpeople putting the form to one side to complete at a later date and then forgetting about it. Those who fail to respond will be contacted subsequently as the Electoral Registration Officer is obliged to ensure that the information on the register is accurate. Ongoing publicity will be issued throughout the period. A leaflet has also been included with the household form to draw attention to the local authority elections taking place in April and the House of Keys General Election in September. As stated above the aim is to have a register which is both accurate and complete. In seeking to achieve this aim it must be recognised that the participation of the householders in the Isle of Man is required in the process; it cannot be the sole responsibility of Government. Whiteway Town Clerk i 7° January, 2016. 14 and Chief Executive RAMSEY TOWN COMMISSIONERS TOWN CLERK' S REPORT ISLE OF MAN CENSUS 2016 JANUARY 2016 - PUBLIC Mr. Chairman and Members, The Isle of Man Government is due to hold an interim Census in 2016, with Census Night being on Sunday 24 °i April, 2016. The 2016 Census will be conducted in a different way than previously, utilising technology to improve efficiency and acting on feedback received from both staff and the public after the 2011 Census. Unlike in previous censuses where census forms were hand delivered and collected, for 2016 the Census Office have partnered with the Isle of Man Post Office who will deliver census forms to every residential property on the Island. Householders and individuals will then be required to either return their census forms by post in a provided pre -paid envelope or complete their return online. Every household will receive a physical copy of the form regardless of whether they choose to complete it online. The Isle of Man Post Office will also be responsible for the handling and processing of all returns, including scanning and data capture of every form. Due to the change to a mixed -mode postal and online Census, the role of Supervising Officers and Census Officers ( previously known as Census Enumerators) has significantly changed. The number of field staff required has been greatly reduced. In previous censuses, a team of over 200 Enumerators and Supervising Officers was deployed to deliver and collect census forms from households, communal establishments and individuals and follow — up those that had not been returned. In 2016, it is estimated that the field staff will be around 80 Census Officers overseen by 7 Supervising Officers. The primary role of the field staff will be to follow -up on census forms that remain outstanding after a set period following Census Night. Some Census Officers will also provide assistance to household and individuals at their home addresses, where requested. The Census Office would be happy to arrange a briefing or to answer any queries that elected representatives may have. Recommendation: to be noted. T. P. Whiteway Town Clerk 6° i January, 2016. r4 and Chief Executive RAMSEY TOWN COMMISSIONERS TOWN CLERK' S REPORT MUA EASEMENT —BLEAK HOUSE JANUARY 2016 —PUBLIC Mr. Chairman and Members, At the October, 2015, meeting the Commission agreed in principle to enter into wayleave agreement with Manx Utilities for the bringing of a power cable to the property Bleak House, Mooragh Promenade across land in the Commission' s ownership subject to the following conditions: 1. such agreement would have to indemnify the Commission against any future costs or charges associated with any requirement to relocate the supply cable permitted under the easement in the event that a future development of the land was undertaken; 2. the easement could only be granted after the Commission was satisfied that the property to which the supply was to be made complied in all respects with the Housing (Registration) Regulations 2013 and with the Housing Standards) Regulations 2013 as applicable; 3. prior to granting the easement the Commission would have to be satisfied that the building complied in all respects with the provisions of the Building Control Act 1991; A. the Commission obtaining prior statutory consent under Section 25 of the Local Government Act 1985 ( as amended). The Commission has received agreement from the MUA that it will be indemnified against any future costs associated with re- routing the proposed cable, and statutory consent to the petition has been granted by the Department of Infrastructure. At present the Commission is progressing action under the Building Control Act in regard to the condition of the premises, so that at present the premises are not considered to satisfy condition 3 above. Confirmation has been sought from leaseholders to the agreement that the building may be occupied as a single residence by Mr Morris to which as response has been sought —this would obviate the requirement to register the premises under condition 2 above. However the owner has made repeated requests to allow the cable to provide a power supply to the premises which he is presently occupying. Recommendation: for discussion. T. P. In addition to the nuisance impact of feeding birds the distribution of food can attract other vermin. In the Light of the complaints attention is drawn to the general advice leaflet previously issued by the Commission as copy of which is appended. Copies are available at the Town Hall, on the Commissioners' website and will be highlighted on the Commission' s social media Faceboolc page. Recommendation: to be noted P. RAMSEY TOWN COMMISSIONERS N< O S PEST CONTROL ADVICE FERAL PIGEONS & HERRING GULLS NUISANCE Just because there are pigeons or gulls in your area does not necessarily mean that there is a problem or that health or public safety issues will arise. However: Large numbers of gulls or pigeons in an area may drive other smaller birds away as they compete for available food and nesting spaces. Nesting gulls can become aggressive especially when chicks have left the nest and may be on the ground. Droppings can contaminate food supplies, especially in food stores, warehouses, bakeries or canteen. Mites can cause skin diseases and feather dust can cause other infections. Where there are large numbers of these birds in a small area, droppings can make pavements slippery; with a risk of pedestrians slipping and injuring themselves. Birds flying around busy thoroughfares may startle motorists who may go on to cause accidents. Pigeon droppings in particular are acidic and can cause damage to buildings, machinery, lawns, shrubberies and machinery. Nesting materials from gulls and pigeon nests can clog drains and air vents. PEST CONTROL ADVICE The best way to control the problems caused by gulls and pigeons is to reduce their food supply. To avoid feeding gulls and pigeons, while intending to feed smaller garden birds, use seed and nut feeders or general bird food feeders. Cover bird tables with a cage of 3 inch mesh which will allow access for small garden birds, but prevent access by pigeons & gulls. Do not use bread or kitchen left -overs, but more importantly do not throw scraps on the ground. Scraps are one of the biggest attractors of pigeons, gulls and vermin. The RSPB ( Royal Society for the Protection of Birds) has booklets on bird food and feeders. Information can be obtained from the RSPB by telephoning 01767 680551 or by looking on the internet —type RSPB or search for " Bird Food." Gulls and pigeons are quick to realise where a ready meal is available and will remember particular places and also the times when food may be on offer. If you have a problem through inadvertently feeding these birds then the best course of action is to cease feeding for a while. When you recommence bird feeding, use appropriate bird feeders. After a while gulls and pigeons soon realise food is not available and will move on. 35 DETERRENTS The Ramsey Town Commissioners support the cessation of feeding of these two species of birds in Ramsey, but do not condone residents taking direct action such as nest or egg removal. Pigeon proofing measures using spring steel wires or spike boards are good roosting deterrents. However, great care must be taken to avoid injuring other wildlife. These measures will also work for herring gulls —although larger spikes and the use of netting may be required in roosting and nesting sites. The removal of herring gull nests in September will not solve the problem on its own. In warehouses and other large buildings with large openings rapid roll doors or curtains of split plastic will let pedestrians and some machines through whilst deterring the ingress of pigeons and gulls. Air blowers, blowing outwards will also deter birds. Care must be taken not to displace protected birds such as house martins, swifts, swallows or tree and house sparrows. Smell deterrents, high frequency sound and model birds of prey may have limited effect on pigeons or gulls. LEGAL CONTROL MEASURES The culling of pigeons or gulls is not considered to be effective because other pigeons or gulls quickly take their place, especially if a ready food supply is still available. The removal of the food source is by far the best form of control. The Ramsey Town Commissioners actively discourage the feeding of gulls or pigeons, but members of the public and food supply merchants in particular should also ensure that food is not easily available to these birds. Persons who feed gulls and pigeons that are considered to be a nuisance in a public place may be charged with a littering offence. In this latter case a fixed penalty for £50 may be issued or a fine of up to £2, 500. WHAT YOU CAN DO Do not feed gulls or pigeons Do not leave lids of refuse bins open Do not leave any food lying about for gulls, pigeons or rodents. Join Forces with your neighbours to ensure food is not left out for pests. Use good quality bird feeders and appropriate quality food, do not throw bread or waste food out for birds. Do remember it is illegal to interfere in any way with most birds including their nesting and roosting areas their nests, eggs and young. ' file works will include new MUA cabling fed from Royal Park which will be taken below the donkey path. In addition, the works include the rerouting and replacement of an existing asbestos cement water main and the rerouting of a Manx Telecom fibre optic cable. The contractor for the enabling works, Stephen Christian and Sons Limited has programmed these works to be completed by the end of February, 2016 however much of this work is weather dependent in terms particularly of making good once the excavations have been carried out. Once the enabling works have been carried out, the main contractor, Auldyn Construction Ltd will commence works for the construction of the new sewer pumping station and holding tanks. These works are to be carried during 2016 with completion programmed to be at the end of 2016. During these works, the new pipework to connect the pumping station to the new sewer treatment plant at Balladoole will also be carried out, again with completion at the end of 2016. Once the new pumping station and associated works are completed and running, decommissioning of the existing pumping station and storage tank infrastructure will be carried out which is presently programmed for early 2017. Chief Technical Officer. 3T RAMSEY TOWN COMMISSIONERS CHIEF TECHNICAL OFFICER' S REPORT WORKS TO BIRCHAM AVENUE JANUARY, 2016 —PUBLIC Mr. Chairman and Members, Works have recommenced on the this scheme following the Christmas and New Year break by the Department of Infrastructure on the reconstruction of the roadway on Bircham Avenue together with the laying of new below ground services. The road from Station Road to the junction with Gladstone Avenue is now open with the road tarmacadam base coated to provide vehicular access in this area. The works have moved further along Bircham Avenue from the rear of the Fire Station to a point midway on the Bircham Avenue Close junction to maintain access. Excavations have taken place down to formation level and new services are being laid in place. Existing high and low voltage electricity supplies which provide supplies to the majority of the Town are being renewed as part of the works which will require the footpath to the East side of the road being closed. Chief Technical Officer. 3 `o RAMSEY TOWN COMMISSIONERS TOWN CLERK' S REPORT CONSULTATION —MANX INTERNATIONAL CYCLING GP JANUARY 2016 —PUBLIC Mr. Chairman and Members, The Commission has been contacted by the organisers of a proposed Manx International Cycling GP to be run on Sunday 10`x' April, 2016, around the Mountain Course. A copy of the correspondence has previously been circulated to Members. By introducing the Manx International Cycling GP the organisers intend to reestablish the Isle of Man as a respected high level competitive cycle event venue which will generate positive economic benefits and publicity. It is a condition of British Cycling that the race route is closed to traffic. This condition is non -negotiable with British Cycling therefore if the event is to progress organisers do need to have agreement to close roads to public traffic. The organisers understand the sensitivity to road closures particularly in respect of the TT Course which is the intended route; however the road closures will not be the same as those imposed for the TT Races. All footpaths will be open to pedestrians. Pedestrians will be able to cross the roads when safe to do so and whilst in sight of a marshal. Spectators will be actively encouraged onto the roadside. There will be numerous traffic crossing points open during the race period. Access routes will remain open on some major junctions throughout the race period. Organisers will endeavour to assist with special requests for access. The roads will be opened on a controlled basis commencing at Park Avenue, Douglas well before the official latest time ( approximately 4 pm). There will be three separate races on the circuit each with their associated race convoys. Each race will be strictly managed to ensure that competitors who are dropped from the peloton' are removed from the race. This means that the races can pass crossing points relatively quickly. e. g. organisers envisage an individual race convoy front to rear elapsed time of no more than 10 minutes. Crossing points will be opened when the Official `tail end' vehicle has passed each junction and closed again when the lead vehicle of the following race approaches. Recommendation: for discussion.
