SUBJECT: Third Amendment for Housing Development Consulting Services
RECOMMENDED ACTION
Approve Third Amendment to Agreement with Daniel B. Lopez and Associates relating to
housing development and finance consultation services for the Office of Supportive Housing,
extending the term of the Agreement for a 12-month period through June 30, 2017 with no
change to the maximum contract amount, that has been reviewed and approved by County
Counsel as to form and legality.
FISCAL IMPLICATIONS
Amending the agreement with Daniel B. Lopez & Associates will only extend the term of the
Agreement. There is $33,817 remaining in the Agreement’s budget. The expenditures for
the consulting services is already included in the Office of Supportive Housing’s (OSH)
Fiscal Year 2016-17 budget.
CONTRACT HISTORY
On April 8, 2013, the OSH (previously the Office of Affordable Housing) issued a request
for proposals for Housing Development Financial Consulting Services for the County’s
affordable housing programs. Daniel B. Lopez and Associates was selected. The original
Agreement with Daniel B. Lopez and Associates started on July 1, 2013, with a total
maximum financial obligation of $60,000. The First Amendment increased the contract
amount by $60,000 and changed the term end date to June 30, 2015. On May 19, 2015, the
Board approved the Second Amendment which increased the Agreement amount by $80,000
and extended the term of the Agreement through June 30, 2016 (#76462).
REASONS FOR RECOMMENDATION
The contractor is an expert in the financing and development of affordable housing. The
contractor’s services were an important resource for the OSH even before the Board made

increasing supportive housing and reducing homelessness top priorities. Extending the term
of the agreement would enable the contractor and OSH to complete several projects in a
timely manner. The OSH is currently reviewing the financial viability or determining the
financial needs for 12 housing projects. The OSH anticipates that the Notice of Funding
Availability (NOFA), which we recently released in partnership with the City of San Jose and
the Housing Authority of the County of Santa Clara, will result in five to ten additional
projects for the OSH to review.

BACKGROUND
The County’s affordable housing programs are funded through a variety of sources including
County General Funds, Mental Health Services Act funds, the Stanford Affordable Housing
Fund, Community Development Block Grants and HOME Investment Partnership Program
funds. Daniel B. Lopez and Associates assists the OSH increase the supply of affordable and
supportive housing by: 1) assessing the viability and feasibility of housing projects; 2)
recommending ways to improve the viability and feasibility of housing projects; and, 3)
developing financial models for different types of housing projects. For example, the
contractor assisted County staff to assess and develop financing options for Renascent Place,
a 162-unit permanent supportive housing project that will be available in the summer of
2019.
In addition, the contractor’s expertise is used to support special projects that expand and
improve the supportive housing system. For example, in FY 2016, Daniel B. Lopez &
Associates assisted in the coordination of six permanent supportive housing roundtables and
served as a resource during the County’s Housing Task Force meetings. The Supportive
Housing Roundtables improved developers’ understanding of the County’s housing needs
and capabilities to provide supportive services.
CONSEQUENCES OF NEGATIVE ACTION
If the amendment is not approved the pending projects may experience significant delay. In
addition, staff resources would need to be redirected from other projects including working
with the Facilities and Fleet Department to identify potential sites for housing development.
