Wyboo Plantation 100 Recreation Drive Manning, SC 29102 803-478-8688 803-478-8774 FAX [email protected] WYBOO PLANTATION OWNERS' ASSOCIATION The WPOA operates and maintains a 166 space recreational vehicle parking lot (storage lot) for the convenience of the Wyboo Plantation homeowners. The Storage Lot Regulations and Lease Agreement follow in part to South Carolina Code Title 39 Chapter 20, "Self Service Storage Facilities". The following rules have been created to assist in the management of the lot. 1. Each assigned storage space is owned by the WPOA. 2. The storage lot is strictly for the use of resident Wyboo Plantation homeowners (or their designated renters) only. The homeowner must be a WPOA member in good standing per the WPOA Covenants. 3. Vehicles are defined as cars, trucks, SUVs, motorcycles, golf carts, riding mowers, motor homes, travel trailers, fifth wheels, campers, boat and/or trailers, personal water crafts, ATV and service trailers. 4. All vehicles stored in the lot must be functional and maintained in good condition. This is not a storage lot for junk items. 5. All vehicles must have current insurance, registration and be licensed as required by the State of South Carolina. 6. An annual Storage Space Lease Agreement signed by the homeowner or designated renter (Space Lessee) and lot administrator is required before a vehicle may be placed in the lot. 7. A description of the vehicle stored in each assigned space must be on the Storage Space Lease Agreement. If the vehicle stored does not match the description on file the vehicle will be subject to removal by the WPOA. Any property stored in each assigned space must be owned by occupant whose signature appears on the WPOA Storage Space Lease Agreement for that assigned space. Periodic checks by Space Lessee are required to check for leaks that may cause hazardous conditions. Each Space Lessee is responsible for the cleanliness of their assigned space(s). 9. A vehicle may only be parked within the assigned space. 10. The Lot Administrator will assign space size appropriate to each stored vehicle. 11. There will be a $24.00 annual fee charged for the first space requested and assigned to a Space Lessee. Each additional space, if available, will require an annual fee of $24.00. A portion of each fee will be refunded pro-rata if the space is no longer needed and the Lot Administrator is notified in writing. In the event a new lease request for a storage space occurs after October 1 but prior to September 30 the fee charged will be on a pro-rata basis and a Pro-Rata Storage Space Agreement will be required. 12. Fees for all spaces will be payable in full October 1 of each year. Fees paid after the due date will incur a 15% late penalty. Personal property stored in occupant's space will be sold or otherwise disposed of if no payment has been received for a continuous fiftyday period after default. If any annual installment is not made by the fifteenth of October, or if any check given in payment is dishonored, the occupant is in default from date payment was due. 13. The occupant of any stored item declared by the WPOA as unserviceable, nonregistered or junk will be given a written notice and 30 days to remove it. If the stored item(s) are not removed within 30 days a $50 penalty be assessed and the occupant will be given an additional 30 days to remove the item(s). At the end of 60 days, the WPOA will have the item(s) removed at the owner’s expense. 14. Additional Spaces may be limited due to availability. Priority will be given to "initial" space requests over other additional space requests.
