Official Rules
2015 Referral Incentive Program Contest (”Official Rules”)
The 2015 Referral Incentive Program Contest (the “Contest”) is sponsored by
Bluewave Energy, a brand of Parkland Industries Ltd. (“Parkland.”) Enter, in
accordance with these Official Rules, for a chance to win two thousand five
hundred Canadian dollars ($2,500) (the “Contest Prize”)
CONTEST PERIOD
The Contest commences at 7:00 a.m., Eastern Standard Time (EST) on April 1,
2015 and closes at 11:59pm Eastern Standard Time (EST) July 8th, 2015 (the
“Expiry Time”).
ELIGIBILITY
The Contest is open only to persons of the age of majority or above who are legal
residents of, and have a permanent residence within the boundaries of, the
provinces of Alberta and British Columbia.
This Contest is not open to: (i) directors, officers, employees, representatives,
agents and contractors of the Sponsor (as defined herein) and its related or
affiliated companies, nor their immediate families or persons with whom they are
domiciled.
PROCESS AND CONDITIONS FOR ENTERING
To enter the Contest, an individual must complete the attached referral form (the
“Form”) in its entirety by providing the individual’s required information as well
as the required information for the commercial entity which the individual
believes will wish to conduct business with the Sponsor in the future. The
individual is known as an Entrant and the entity which the individual puts forth as
a potential referral is a Referral Opportunity.
The Sponsor shall telephone each Referral Opportunity prior to the Expiry Time.
If such Referral Opportunity 1) agrees to conduct business with the Sponsor and
executes a written agreement, prior to the Expiry Time, to purchase at least one
thousand (1,000) litres of Lubricants per calendar year or ten thousand (10,000)
litres of petroleum products (e.g. fuel, propane) per calendar year; and, 2)
successfully passes the Sponsor’s credit requirements, then the entity will be a
Confirmed Referral.
For every Confirmed Referral, the name of the corresponding Entrant who
provided the Sponsor with the completed Form identifying the Confirmed
Referral shall be entered into a draw for the Contest Prize (a “Confirmed
Entrant”).
If a Referral Opportunity does not become a Confirmed Referral through the
above means, the corresponding Entrant’s name shall not be eligible to be
entered into the draw for the Contest Prize (an “Ineligible Entrant”).
All Entrants must sign the Form and send it as follows:
1. Provide the completed form to Entrant’s local Bluewave Energy representative;
or,
2. Provide the completed form to the attention of Erin Garriock using one of the
following methods:

3. All Forms must be received by the Sponsor prior to the Expiry Time.
4. Entrants may complete as many Forms as he or she wishes but each Form
must contain a different Referral Opportunity.
CONTEST PRIZE
1. There will be one (1) Contest Prize awarded to the Selected Entrant (as defined
herein).
2. The Contest Prize is composed of two thousand five hundred Canadian dollars
($2,500) to be provided by cheque to the Selected Entrant.
3. The Contest Prize must be accepted as awarded, is not transferable and cannot
be substituted or redeemed for alternative prizes. If the Contest Prize is
unavailable for any reason, the Sponsor reserves the right to substitute for the
Contest Prize or any component thereof, a prize of equal or greater value. No
reimbursement will be provided if the Contest Prize is not taken by the
Selected Entrant. Contest Prizes cannot be combined with any other
promotional offer or offers.
4. By accepting the Contest Prize, the Selected Entrant agrees to abide by the
decisions of the Sponsor which are final on all matters regarding the Contest.
This Contest is subject to all applicable federal, provincial and municipal laws
and regulations.
5. Odds of winning are dependent on the number of eligible entries.
WINNER SELECTION AND CONDITIONS
Within two (2) days of the Expiry Period, the third party marketing firm
administering the Contest shall randomly draw, from the pool of Confirmed
Entrants, one Entrant who will, if he or she meets all conditions set forth in these
Official Rules, be the winner of the Contest Prize. The winner of the Contest Prize
shall be known as a Selected Entrant. Non-selected Confirmed Entrants will not
be carried over or included in any subsequent draws.
The Selected Entrant will be contacted by the Sponsor (as defined below) within
five (5) business days of the draw. All decisions of the Sponsor, including
determining the Selected Entrant and whether any individual entry is eligible for
consideration for the draw, are final and are not subject to appeal or challenge.
No further correspondence will be issued once the Selected Entrant has received
his or her Contest Prize, other than as set out below. No correspondence will be
issued to any Entrant other than the Selected Entrant determined in accordance
with these Official Rules.
To be declared a Selected Entrant, the Selected Entrant must correctly answer a
time-limited, skill testing mathematical question. Failure by a Selected Entrant to
correctly answer this question will mean the Contest Prize will be foregone
without compensation.
In the event the Sponsor, after making reasonable efforts, is unable to notify a
Selected Entrant within seven (7) business days following the Contest Prize draw,
the Sponsor shall have the right to disqualify the Selected Entrant and select an
alternate Selected Entrant from all remaining eligible entries received by the
Sponsor and the Sponsor shall be fully and completely released and discharged
from any and all liability or responsibility in this regard.
If a Selected Entrant is unable to accept his or her Contest Prize, that Contest
Prize will be foregone without compensation.
RELEASE AND INDEMNIFICATION
By accepting the Contest Prize, the Selected Entrant consents to the use of his or
her name and city, town or district of residence, and photograph for promotional
purposes by the Sponsor without prior notice or additional compensation.
By submitting a Form, each Entrant agrees and confirms: (i) the Entrant’s
eligibility for the Contest and the Entrant’s compliance with these Official Rules;
(ii) that, if chosen as the Selected Entrant, he or she will accept the Contest Prize
as offered; and, (iii) the Entrant grants to the Sponsor the unrestricted right, in
the Sponsor’s collective or individual discretion, to produce, reproduce, publish,
broadcast, communicate by telecommunication, exhibit, distribute, adapt and
otherwise use or re-use the winners’ name, likeness, photo, voice, biography and
comments, for advertising and promotional purposed worldwide and in any
media without limitation or additional compensation unless prohibited by law.
Notwithstanding anything in these Contest Rules to the contrary, the Entrant
releases and holds harmless each of Parkland Industries Ltd. and its respective
parent companies, subsidiaries, affiliates and/or related companies and each of
their employees, officers, directors, shareholders, suppliers, agents,
administrators, licensees, representatives successors or assigns, and advertising,
media buying and promotional agencies (collectively the “Sponsor”) from any
and all liability for any loss, harm, damages, injuries, cost or expense of any kind,
to the Entrant or to any other person, arising directly or indirectly out of
participation in the Contest, participation in any Contest related activity or the
acceptance, use or misuse of the Contest Prize, or the breach of the Official
Rules, including but not limited to costs, injuries, losses related to personal
injuries, death, damage to, loss or destruction of property, rights of publicity or
privacy, defamation, or portrayal in a false light, or from any claims of third
parties arising therefrom. The Selected Entrant agrees to fully indemnify the
Sponsor from any and all claims by third parties relating to the Contest, without
limitations.
CONDUCT
By participating in the Contest, Entrants agree to be bound by these Official
Rules, which will be posted at www.BluewaveEnergy.ca. Entrants further agree to
be bound by the decisions of the Sponsor which shall be final and binding in all
respects. The Sponsor reserves the right, at its sole discretion, to disqualify any
Entrant found to be: (a) violating the Official Rules; or (b) tampering or
attempting to tamper with the entry process or the operation of the Contest.
The Sponsor reserves the right to cancel, terminate, modify or suspend the
Contest, including any method of entry.
THIS CONTEST IS VOID WHERE TAXED, RESTRICTED OR PROHIBITED BY LAW.
