GENERAL BUILDING REQUIREMENTS, RULES, AND RESTRICTIONS
1. REQUIREMENTS AND RELATED INFORMATION NEEDED WHEN SUBMITTING PLANS
FOR APPROVAL OF INITIAL BUILD OR EXTENSIVE EXTERNAL REMODEL.
a. APPROVAL PROCESS. The ARC has 30 days to review plans once the committee
has received all the required information as stated below. The ARC will notify
the owner in writing once plans have been approved. If no action is taken by the
ARC within 30 days after plans and required information is submitted, the owner
may proceed to build without approval. (Page 4, Sec. 7, CKP covenants)
b. PLANS. A complete set of Architectural plans showing rendering of house, floor
plan with stated square footage, elevations of front, rear, and sides, roof plan
showing pitch of roof, foundation plan, etc., shall be submitted to the
Architectural Review Committee (ARC) for its records. (Page 4, Sec. 7, CKP
covenants) NOTE: ANY MODIFICATIONS TO PLANS AFTER APPROVAL MUST
BE RESUBMITTED FOR APPROVAL.
i. SITE PLANS. Site plans will be included in the plans provided to the ARC
for approval. They should show the location/orientation of the house on
the lot along with setbacks. (Page 4, Sec. 7, CKP covenants)
ii. SETBACKS. All structures must be at least 15’ from the side property line
of any lot except that they shall be at least 20’ from the side property line
abutting a street. All structures must be at least 50’ from any road. All
structures must be at least 50’ from the 813’ high pool water line. These
restrictions may be reduced or increased if, in the sole estimation of the
ARC, strict compliance would cause a hardship to a lot owner or adjacent
lot owner relative to lake view, topography or septic approvals. Setbacks
shall meet or exceed Loudon County subdivision regulations. (Page 3, Sec.

c. SITE SURVEY. Effective immediately, a property site survey must be completed
and submitted to the ARC when submitting Architectural plans. Building plans
will not be approved unless/until a current survey is submitted. (HOA Board

d. BUILDER APPLICATION. An Owner/Builder Application is required from all
Builders/Owner Builders and is provided by the ARC. The application may also be
downloaded at www.conkinnonpointe.org. (CKP Architectural Standards)
e. CONSTRUCTION RESPONSIBILITIES. The construction contractor is responsible
for installing silt fencing along roadways and adjoining property lines at the
commencement of construction. Builder is also responsible for maintaining a
clean and orderly job site and ensuring the streets are kept clean at the end of
each work day. (CKP Architectural Standards)
f. BUILDING/LANDSCAPING DEPOSIT – INITIAL BUILD. Effective July 1, 2009, a
building/landscaping deposit of $2,500.00 is required as part of the approval
process. The deposit is to insure that streets/curbing is kept clean during the
construction process and that all foundation plantings and grass is in place
before it is refunded. (HOA Board Meeting Minutes 4/09/09)
g. BUILDING/LANDSCAPING DEPOSIT – EXTENSIVE EXTERNAL REMODEL. Effective
June 1, 2016, a building/landscaping deposit of $1000.00 is required as part of
the approval process. The deposit is to insure that streets/curbing is kept clean
during the construction process and that all foundation plantings and grass is
repaired/replaced before it is refunded. (HOA Board Meeting Minutes

“Extensive External Remodel” is defined as a renovation/remodel project
encompassing ONE OR MORE of the following:

A projected cost of $100,000.00 or greater;
A projected duration of 30 days or longer;
An extensive exterior modification; and/or
A change to the footprint of the existing home (e.g., addition).
h. SQUARE FOOTAGE REQUIREMENTS. Each single-family dwelling shall have an
enclosed, heated living area (exclusive of open porches, garages, and other
unheated spaces) not less than TWO THOUSAND FOUR HUNDRED (2,400) square
feet. Multi-story homes shall be a minimum of TWO THOUSAND (2,000) heated
square feet on the main living level. The design, location, and building
construction of all improvements (fences, walls, pools, outbuilding, etc.) must be
approved by the ARC. (Page 3, Sec. 2, CKP covenants, along with revision by CKP
Board of Directors letter, dated July 13, 2000)
i. BUILDING MATERIAL. Siding material, where exterior is not either brick or
stone, shall consist of either cedar or HardiPlank. Vinyl is limited to soffits only
and not allowed for use as siding. Exposed exterior walls composed of the
following materials shall be prohibited from ConKinnon Pointe Subdivision:
concrete block, imitation asphalt brick siding, imitation asphalt stone siding and

j. WINDOWS. Only wood windows are acceptable. Wood windows with exterior
cladding consisting of vinyl or metal are acceptable. (CKP Architectural

k. GARAGES. The garage door must not face the street on which the house is
located unless on a corner lot. (revision by CKP Board of Directors letter dated
July 13, 2000)
l. ROOF. Roof must have a pitch of no less than 12.8. Boat dock and outbuildings
roof material must match that which is on the house. (CKP Architectural
Standards)
m. AESTHETIC. The ARC refusal or approval of plans may be based upon purely
aesthetic considerations, which in its sole discretion the ARC shall deem
sufficient, but approval shall not unreasonably be withheld. (Page 4, Sec. 7, CKP
covenants)
n. COLOR. Falls under Aesthetic.
2. RULES AND RESTRICTIONS.
a. RESIDENCE. Appearance of front yard landscaping shall be maintained, and free
of excessive weeds to a degree not to distract from the rest of the
neighborhood. Lawn clippings are not to be left in the street after mowing. (CKP
Architectural Standards)
i. All design and material for residence, boathouses, private docks and
shore protection shall be subject to Architectural review and approval by
the ARC. (Page 4, Sec. 10, CKP covenants)
ii. Any dwelling or boathouse constructed upon a lot must be completed
within one (1) year subsequent to commencement of construction. (Page
4, Sec. 9, CKP covenants)
iii. New owners of waterfront lots with an existing permit for erosion
control, a boat house, swim dock, or other structure, must transfer
ownership of the permit through TVA within 60 days of the transfer of
the title. (TVA, Section 26a, Subpart A, Subsection 1304.10)
iv. Bottled gas containers and oil tanks shall be screened from public view;
such containers capable of holding more than fifty (50) pounds or fifty
(50) gallons of fuel shall be buried. (Page 5, Sec. 14, CKP covenants)
v. AC units shall not be visible from view from all roads. Either planting or
decorative fencing shall screen said AC unit. (CKP Architectural Standard)
vi. Trash, garbage, or other waste shall not be kept, except in sanitary
containers screened from view from all roads and all other lots. (Page 5,
Sec. 15, CKP covenants)
vii. There shall be no above-ground swimming pools, unless approved by the
ARC. (Page 5, Sec. 14, CKP covenants)
viii. Except within the building site or within 20 feet of the main dwelling, no
HARDWOOD trees of any kind in excess of 6 inches in diameter at ground
level may be removed from any lot without prior approval of the ARC.

ix. MAILBOX. CKP approved mailboxes may be purchased from the
Christmas Lumber Company (10519 Kingston Pike, Knoxville; 865-6932571). The Mailbox model number/description is “Imperial #311-6, green
with a paper box below.” Mailbox units or replacement parts may also
be ordered through Imperial Mailbox Systems at
www.imperialmailbox.com.
1. NOTE: It may take up to three (3) weeks to receive mailbox
orders in the approved color.
2. Color changes/repairs should be made using Krylon Hunter Green
Spray Paint.
b. VIOLATIONS/NUISANCE ACTIVITIES. All owners shall be held responsible for the
acts of their builders, employees, subcontractors, suppliers, and other persons or
parties involved in construction or alteration of a structure. Usage of water and
electricity from adjoining properties is not permitted, nor may any vehicles be
driven upon, materials stored upon, or in any other way use neighbor’s property
before, during, or after any building project expressed written approval by the
owner of adjoining lot and a copy of this written approval filed with the HOA.
Street must be diligently kept free of mud, gravel/rocks, and other debris at all
times during the construction process. All temporary access gravel driveways on
any lot must be maintained. The construction site shall be kept free of debris at
the end of each day. (CKP Architectural Standards)
I/We have read and fully understand the General Building Requirements, Rules and Restrictions
as stated and outlined above and acknowledge a receipt of same.
I/We acknowledge that the intent of this document is to highlight The “General Building
Guidelines of ConKinnon Pointe Subdivision,” and is not meant to replace the Covenants of
ConKinnon Pointe Subdivision at any time.
I/We further acknowledge and understand than any exceptions requested will be reviewed by
the ARC and the ConKinnon Pointe Board of Directors before any variances or exceptions will
be granted.
